Battle heats up over “non-existent” Rössmund Golf Estate It is no golf estate - it is an ordinary suburb of Swakopmund that happens to be situated next to a golf course - resident

The Rössmund suburb of Swakopmund has allegedly been misrepresented as a golf estate to prospective buyers. Furthermore, each of the home owners has notarial bonds against their title deeds in favour of a Section 21 Company which never existed. A Section 21 Company number not related to the registration has allegedly been fraudulently used for the registration purposes at the Deeds Office.

These are some possible damaging pieces of evidence against developer Wim van der Plas and coastal attorneys Danie Malherbe and Gerhard van der Merwe, after criminal charges of fraud and theft under false pretense were laid against the trio in August this year at the Swakopmund Police (CR 58/08/2016).

Angry residents first noticed all is not well when they questioned half of their levies paid to the Rössmund Golf Club. Upon closer inspection they discovered to their astonishment they never bought into a golf estate, but merely purchased a plot in the Rössmund suburb, which happens to be situated next to a golf club.

Then further shocking discoveries: The notarial bonds registered against their Title Deeds were for a Section 21 Company that does not exist. A

fraudulent Section 21 Company number was allegedly utilised.

Then it was also discovered the Rössmund Golf Estate Home Owners Association to which they pay levies has no standing, by virtue of the fraudulent Section 21 Company number.

A complaint was lodged with the Anti Corruption Commission of Namibia against van der Plas, Malherbe and van der Merwe. The Commission after investigation recommended criminal charges be laid against the trio.

In the meantime, the Rössmund Golf Estate Home Owners Association lodged an application in the Swakopmund magistrates court yesterday, for the rectification of these Notarial Deeds against this non-existent Section 21 Company.

Nine Rössmund home owners oppose this application on the grounds the magistrates court has no

jurisdiction over such matter and that any application involving the Deeds Office can only be launched in the High Court of Namibia. The matter was postponed yesterday morning indefinitely for the presiding magistrate to consider the arguments whether the magistrates court has jurisdiction over the matter. · The Rössmund Golf Estate has never been a bona fide golf estate development they now claim, but was merely an ordinary suburb of Swakopmund that happens to be situated next to a golf course. When Rössmund suburb was marketed for sale some years ago, the impression was created this is part of the Rössmund Golf Course and part of the larger golf estate.

questioned why they should subject themselves to a Rössmund Golf Estate Home Owners Association which not only places architectural and coverage restrictions on the housing development, but which demands levies and a string of other rules imposed on residents.

Home owners, who organised themselves into a resistance are paying municipal rates and taxes and also have separate electricity accounts at Erongo RED, enforcing their claim they are living in an ordinary suburb of Swakopmund and no golf estate subjected to any form of a home owners association.

Documents in the possession of namib times confirm the discontent home owners have instructed their legal representation by mid-July already this year to lay criminal charges against van der Plas, Malherbe and van der Merwe at the soonest opportune time. The home owners in question's legal representative Advocate Richard Metcalfe could not be reached for comment yesterday, to provide more details as regard to the criminal charges against van der Plas, Malherbe & van der Merwe.

The proposal by the above mentioned company details the intention stating that the company “combines scientific research, education, training and introduction of animals to various country markets.” It is the intention of Welwitschia to invest a total initial amount of N$30 million which will include the equipment, vessel and boats to start the operation. “The project plans to harvest excessive marine mammals and other sea based fish type such as cetaceans, pinnipeds and penguins and to export live animals to plough back funds into sustainable development of the project (sic),” it states.

As part of the project, it is assumed that the Namibian sea has “abundant marine lives which include fur seals, penguins and cetacean species, such as Killer Whale, Fin Whale, Pygmy sperm whale, Rough-toothed dolphin and Heaviside's dolphin (sic).” In the proposal it is argued that the Namibian fish catches are on a “downward spiral” in recent years, partly because of overprotected cetacean species. Together with pinnipeds these species have increased “dramatically” and they are preying on a large number of fish. “This state of affairs has led to dramatic reductions in the available fish numbers in the Namibian waters,” the proposal reads. This statement is in direct conflict with the current situation though, as the Namibian fish stocks have been increasing steadily since independence.

The project aims to ensure sustainable development of the Namibian fishery industry and also bring a number of economic benefits through the harvesting and exporting of excess live animals. “The Chinese market is enormous: Ten killer whales per year; 50-100 Indo-Pacific bottlenose dolphins; 50-100 heads of Common bottlenose dolphins; 500-1000 Cape Fur Seals; 300-500 penguins; and various sharks (sic),” the proposal reads; and: “The company plans to help Namibia sustainably harvest excess marine mammals in a humane manner, which instead of killing, will consist of the life exportation for such marine life to add value to other cultures and markets as well as breed and increase in such new habitats (sic),” the proposal states.

News about the application spread like wildfire since namib times first reported about it last week. “If it is indeed true, that dolphins are being considered, I don't even know how the proposal managed to get this far,” said Barry McGovern of the Namibia Dolphin Project (NDP) to namib times. He is especially concerned as the entire population of bottlenose dolphins along the Namibian coastline is less than 100 animals. “Even if you remove ten animals it would have a devastating effect,” he said. The same applies for the Heaviside's dolphins which are endemic to the Benguela system. The current local population is estimated at 450 animals.

“Dolphins shouldn't even be considered for something like this as they are protected species,” McGovern added.

In the meantime various environmental organisations from Namibia and abroad have contacted the newspaper regarding the proposal. Many of which are very concerned and wish to investigate the matter themselves.

“We are very concerned about the ship that is apparently preparing to catch penguins and marine mammals in Namibian waters,” the Namibian Envornment and Wildlife Society (NEWS) said. Similarly the organisation Sea Shepherd South Africa also contacted namib times for more information on the matter.

Swakopmund to register Erwin Leuschner all Taxis In an attempt to curb crime and reduce illegal activities in Swakopmund, Town Council has decided to mark all Taxis and equip them with a number – similarly to the system already in place in the capital Windhoek. This announcement was made by Mayor Pauline Nashilundo at the recent Council meeting.

“The registration and distribution of numbers will commence during the month of September,” she said at the meeting. Each vehicle will accordingly receive a disc to identify the taxi. By doing so Nashilundo believes that illegal operations will be reduced while illegal operators will be eliminated.

“This exercise will also enable Council to have a proper data base of the legal taxis,” she said.

Registered taxi owners, which currently amount to about 300, are called on to visit the Municipal Office building at the Traffic Section and consult the Senior Traffic Officer: Trudie Xoagus to receive their number. Nashilundo didn't say though if a deadline exists for all taxis to be registered.

During her Council announcement the Mayor once again mentioned the many fire incidents, which had become a regular occurrence in town.

“I again appeal to the residents to be extra cautious in order to prevent fires in Swakopmund,” she said. Nashilundo thanked the many companies, individuals and groups from communities who support the fire victims and

donated items.

Furthermore Nashilundo showed concern about “safety and security which remains a concern in our society”.

She called on the community to work hand in hand with the Namibian Police and report any criminal activities. “We should embrace the Harambee Prosperity Plan to contribute positively to the development of our town and country at large,” she said; and added that anybody engaging in criminal activities should reframe from that as the police is working around the clock to create a safe environment.

The Mayor encouraged the community and school learners to refrain from alcohol and drug abuse by focusing on more productive activities.

“Scholars are encouraged to study hard as we need bright future leaders. Our Swakopmund Municipal Youth Officer is running programs to develop youth to engage in business and various activities to improve on their life standards, therefore youth should attend to this call when made,” she said.

Swakopmund does not owe NamWater N$74m Erwin Leuschner The municipality of Swakopmund does not owe the national water utility NamWater any money due to outstanding bills. This was now reiterated by Swakopmund town councillor Wilfried Groenewald during an interview with namib times.

Groenewald was reacting to reports after the Minister of Agriculture, Water and Forestry, John Mutorwa, visited Swakopmund recently during an information session regarding the future of the water supply.

During that meeting Nam-Water CEO Dr. Vaino Shivute informed the municipality that it is required to pay N$74 million for the new water pipeline leading from the desalination plant towards Swakopmund, even though the new infrastructure was meant to be financed by government.

The matter will now be addressed by Minister Mutorwa.

“It was revealed at the meeting that the new pipeline cost N$550

million, but NamWater did not inform us about this development, nor was the municipality involved in any way with it, but instead now NamWater wants us to contribute these millions of dollars towards the investment,” Groenewald said to namib times. During the meeting Dr Shivute informed the attendees that central government was supposed to contribute N$350 million towards the investment.

“We were told that Government only contributed N$150 million,” Groenewald continued and added: “Now they are looking for this short-fall from the municipalities.”

Dr. Shivute also told the municipalities that the money should ulti-

mately be recovered from the consumers, being the residents.

According to NamWater calculations, Swakopmund has to contribute N$74 million towards the pipeline, where Arandis is required to pay N$11 million. This calculation stems from the percentage of water each local authority utilises. In Swakopmund's case this amount was calculated to be 14%.

“According to law one cannot just do a job and order somebody to pay for it retrospectively. It does not work like that,” Groenewald said. He also doubts the calculation of the amount of N$ 74 million being 14%. “If you take N$550 million and subtract N$ 150

million (that Government contributed), you end up with an amount of N$400 million. 14% of this amount only makes N$ 56 million,” he said.

A further bone of contention regarding the financing of the new pipeline came up during the meeting. “Imagine we pay for a part of the pipeline.

Who will ultimately be the owner and who will be responsible for maintenance?

It does not make much sense, especially considering that the pipeline does not fall under our jurisdiction, but was built on state land,” the councillor added.

The meeting concluded with Mutorwa inviting the local authorities to submit a proposal on how the matter can be resolved to his ministry.

The M.O.T.H. (Memorable Order of Tin Hats) Escarpment Shellhole in Walvis Bay announced this week it would be observing the International Day of Peace this Sunday, as part of the worldwide commemoration of this Day every year on 21 September. Due to practical purposes the M.O.T.H. Escarpment Shellhole will observe as from this year the International Day of Peace on the Sunday closest to 21 September which is this coming Sunday on 18 September 2016.

The United Nations General Assembly declared in a Resolution sponsored by the United Kingdom and Costa Rica in 1981 International Day of Peace. International Day of Peace was between 1982 and 2000 held on the third Tuesday of September of each year to coincide with the opening day of the annual sessions of the United Nations General Assembly. In 2001 the universal day was set as 21 September of each year.

This day is important to commemorate and strengthen the ideals of peace from individual to global level. Sunday's observance will take on the form of a church parade at the M.O.T.H. centre in Rikumbi Kandanga Avenue at 11:00. Delegations of the Namibian Police, the NDF, the Navy and the Walvis Bay local authority council are expected.

The public is invited to attend the proceedings.

Share these tips with your neighbors and friends, to make it tough for criminals to work in your neighborhood.

AT HOME: · Never open your door automatically. Install and use a peephole. · Lock your doors and windows. (Three quarters of the burglaries involving older persons involved unlocked doors and windows and, less than one half of these robberies are reported) Keep your garage doors locked. · Vary your daily routine. · Use "Neighbourhood Watch" to keep an eye on your neighbourhood. A concerned neighbour is often the best protection against crime, because suspicious persons and activities are noticed and reported to police promptly. · Leave lights on when going out at night. · Notify neighbors and the police when going away on a trip. Cancel deliveries and arrange for someone - a neighbor's child, perhaps - to mow the lawn if need be. · Be wary of unsolicited offers to make repairs to your home. Deal only with reputable and wellknown businesses. · Keep an inventory with serial numbers and photographs of resaleable appliances, antiques and furniture. Leave copies in a safe place. · Don't hesitate to report crime or suspicious activities. · Install deadbolt locks on all your doors. · Keep your home well lit at night, inside and out; keep curtains closed. · Ask for proper identification from delivery persons or strangers. Don't be afraid of asking . . . if they are legitimate they won't mind. · If a stranger asks to use your telephone, offer to place the call for him or her yourself. · Never let a stranger into your home. · Do not leave notes on your door when you are gone, and do not hide your keys under the mat or in other conspicuous places. · Never give out information over the phone indicating you are alone or that you won't be home at a certain time. · When you are gone for more than a day, make sure your home looks and sounds occupied, ask a family member or good friend to check up on the house regularly. · If you arrive at home and suspect a stranger may be inside, DON'T GO IN. Try to have a friend accompany you in high risk areas . . . even during the daytime. · Avoid carrying weapons . . . they may be used against you. · Always plan your route and stay alert to your surroundings. Walk confidently. · Have a companion accompany you. · Stay away from buildings and doorways; walk in well-lit areas. · Have your key ready when approaching your front door. · Don't dangle your purse away from your

body. · Don't carry large, bulky shoulder bags; carry only what you need. Better yet, sew a small pocket inside your jacket or coat. If you don't have a purse, no one will try to snatch it.

WHILE SHOPPING: · Carry your wallet very close to you . . . don't dangle it from your arm. Never leave your wallet in a shopping cart. Never leave your purse unattended. · Don't carry any more cash than is necessary. · Don't display large sums of cash. · Use cheques where possible.

Avoid this by using a direct deposit if available, which sends your money directly from the government to the bank of your choice. · Never withdraw money from your bank accounts for anyone except YOURSELF. Be wary of con artists and get-rich schemes that probably are too-good-to-be-true. · You should store valuables in a Safe Deposit Box. · Never give your money to someone who calls on you, identifying himself as a bank official. A bank will never ask you to remove your money. Banks need the use of your money, and they don't want one of their customers to invite crime by having large amounts of cash around. · When someone approaches you with a getrich-quick-scheme involving some or all of YOUR savings, it is HIS get-rich-quickscheme. If it is a legitimate investment, the opportunity to contribute your funds will still be there tomorrow after you have had time to consider it. · If you have been swindled or conned, report the crime to your local police or Prosecuting Attorney's office. Con-artists count on their victim's reluctance to admit they've been duped, but if you delay you help them get away. Remember, if you never report the crime, they are free to cheat others again and again and you have no chance of ever getting your money back.

Two vehicle - carrying ships, also known in short as ro-ro’s as the abbreviation for roll-on roll-off ships are calling at the port of Walvis Bay this week to offload imported vehicles destined for Namibia’s neighbouring states and the Democratic Republic of Congo. Galaxy Ace calls on Thursday and Queen Ace on Saturday.

A group of residents of Walvis Bay comprising of unemployed former truck drivers is looking at the possibility of engaging the Namibia Ports Authority and other relevant stakeholders to compel vehicle importers to only allow Namibian drivers to drive these imported units between the port of Walvis Bay and the various border posts.

The group argues it would create jobs for Namibians, as opposed to large numbers of Zambians, Zimbabweans and Angolans instead entering the country without valid work permits to drive the units out of the country. In this way the Namibians can organise themselves in an interest group that can liaise with the relevant authorities on road safety and also ensure export legislation is adhered to and possibilities of cross-border crimes curbed.

EBHN workers on illegal strike Walvis Bay, 9 September - Elgin Brown & Hamer (EBH) Namibia (EBHN) has the appropriate fo- retrenchment process today confirmed that workers have this morning engaged in an illegal work rum,” he adds. at the end of July stoppage.

The Workers Committee notified management of their desire to engage directly with CEO Hannes Uys on certain issues of concern in an email directly to Uys at 21h00 on Thursday 8 September.

Workers then proceeded this morning with an illegal work stoppage accordingly.

subsequently issued two notices to workers this morning, Friday 9 September, to return to work in the light of the illegal work stoppage which will result in 'no work, no pay' accordingly.

Early Christmas for 35 DRC families from the elders group Sharline Tjambari

35 Families from the Democratic Resettlement Community (DRC) Elders Group received food packages on Saturday at Mondesa Sports Stadium from the Ambassadors of Swakopmund Christ Embassy Church. The families were chosen randomly by the committee member and representative of the DRC Elders Group Ms. Sibora Auxas.

According to Auxas she was approached by the church and told she must choose only 35 members from her group who will be beneficiaries of the food packages which the church members had gathered. Auxas then selected two families from each section of DRC and that's how she made sure she covered the whole DRC. The reason why only 35 families were selected is because the church only have 35 families. “We are very happy and grateful for what the church has done for us, many of the elders here say they did not know where to find their next meal for the day and are thankful that the church have provided them with food that they can eat for a week or so” said Auxas.

Flamingo Combined School's top performance at the Nampower National Science Fair

The following are the results for Flamingo Combined School in Walvis Bay and of the Erongo Region, for the Nampower National Science Fair prize-giving 2016 which took place from 5 – 9 September in Windhoek. NCRST were the main organizers and Nampower provided the funding. The prizegiving was held on 9 September.

The Nampower National Science Fair 2016 Results for Flamingo Combined School In July 2016 the school was also awarded with the trophy for best primary school performance at the Regional Science Fair.

They also got the same award last year (2015). Flamingo Combined started performing well at the Regional Science Fair since 2015 and took part in the nationals for the first time in 2015.

Only 3 primary school projects qualified to go to the national science fair with the regional team. None of our high school learners qualified last year.

The learners brought home one gold medal and the learner's project was also the best in her category and two silver medals. The school became a combined school in 2015. The learners of Flamingo Combined School have been working with the guidance of Ms Anastacia de Klerk (Me) since 2015.

Primary School Phase We had 3 projects: * Mary Vries and Tusho Sechogele – silver (gr 4) * Selma Kalimbo, gr 7 – gold – gold medal (gr 7) * Priscilla Shongola, gr 7 – gold medal (gr 7) Secondary School Phase We had 3 projects: * Helena Uusiku – no medal (gr 9) * Paulus Kashimbode – bronze (gr 8) * Aili Kanime – gold medal (gr 9)

They also won the following: Best in their categories Primary School Phase *Mary and Tusho - Human Science * Selma - Maths and Statistics *Priscilla - Engineering and Architecture Secondary School Phase *Aili - Human and Medical Science Overall Best Secondary School project -Aili Kanime. She'll represent the country internationally in South Africa.

Aili is a 14 year old learner in grade 9 at Flamingo Combined School. Her project was titled 'Colour blind or not?' She tested whether colour blindness is more common in males or females by doing the Ishihara colour blind test on more than 200 people. She also wanted to find out what people's perception is of colour blindness and gave out questionnaires to members of the public. The tests and questionnaires were conducted at home, school and in public at the Pick and Pay shopping mall.

She entered the same project last year but didn't get any award at the regionals last year. So she continued and upgraded her project. They conducted experiments on more than 40 children by testing them with flashcards to see if they know the difference between candy and pills. They also tested the children with childproof pill containers to see if they would be able to open it before and/or after observing how an adult did it. This was done to show that small children observe what their parents are doing and then do the same in terms of opening the containers.

Selma Kalimbo (gr7) Flamingo- My budget is proudly Namibian: Are local products cheaper than imported products? She investigated whether local products are cheaper than imported products in order to save money in the long term and conducted a survey to see what people think of local and imported products.

Priscilla Shongola (gr7) Flamingo- Does housing affect sanitation? She investigated the effect of informal housing and formal housing on sanitation in Walvis Bay by checking out the number of dumping sites in close proximity to shacks and houses and also counted the number of bins and people living on an erf.

Rickus Pool (gr6) laerskool wb- Hydroponics He experimented with plant growth by using water.

Laura Damster (gr6) laerskool wb- How safe is our drinking water? She tested a lot of water samples around the country.

Secondary School Aili Kanime gr 9 at Flamingo - Colour blind or not?

Kristin Goede gr 12 at Duneside - I don't know what the project's name was but he made a robot butler.

Swakopmund Women Soccer League 2016/17 season to kick-off soon The Swakopmund Women Soccer League 2016/17 Season will kick-off as planned on 1 October.

The new league Executive Committee members (Exco) will be elected on 5 October as by the league's guidelines. According to Mr. Wilson Nguvauva the Swakopmund Women Soccer League Chairperson the main aim of the league is to keep young girls and women off the streets by keeping them busy with football. All women soccer teams are encouraged to finalise the registration of new players and any interested new teams are welcome to join the league and are required to register before or on 28 September.
