The Napanee River’s water level was holding steady, although its current flow was nearly three times its typical flow rate in cubic metres per second. The conservation authority announced on Tuesday that the Napanee River’s water levels were approaching levels not seen since 1976. Yesterday morning, Stone Mills Township council was holding a special meeting to address local flooding. The municipality also

declared a state of emergency to deal with the high water. Anyone concerned about flooding can call the Quinte Conservation office 24 hours a day and follow the prompts to report any flooding. As gardeners get set to pick up their trowels this season, the Napanee Community Garden volunteers are asking the public to keep them in mind when they plot out their patch. Returning with their ‘Grow A Row’ program, the volunteers with the Napanee Community Garden are hoping upwards of 20 members of the community will donate space in their backyard garden to grow fruits or vegetables for the Salvation Army Food Bank. “People that have their own gardens at home, we ask them to grow a row of food and they donate it back to the food bank,” explained Community Garden volunteer Steve Pitt. “We supply them with the seeds and plants that they want to grow.” To promote a diverse harvest they try to encourage each grower to look after a different crop, be it beans, carrots, tomatoes, peppers, cabbage, squash and the like. When harvest time comes around they’re able to provide a healthy selection for those who rely on the food bank. “A lot of people when they donate to the food bank it’s a can of this or a can of that, and that’s great. But we thought if we could grow some local fresh food that would be good too,” said Pitt. “We’re kind of limited by the season, but we do grow a lot of things that can be stored.” Food grown by the public, in addition to food grown on a oneacre donated plot of land on the south end of town, is harvested and donated to the food bank which supports families in need.

Health-care upgrades needed: union study BY ADAM PRUDHOMME Staff Reporter
After giving Ontarians a year to sound off on the accessibility of the province’s health care, the Ontario Association of Speech-Language Pathologists and Audiologists, Ontario Council of Hospital Unions and the Canadian Union of Public Employees are hoping their stories will spark change. Representatives of the group have embarked on a cross-province media tour, presenting their findings of their study titled Pushed Out of Hospital, Abandoned at Home: After 20 Years of Budget Cuts, Ontario’s Health System is Failing Patients. In the report, they’ve highlighted samples of some of the more than
600 calls they received from upset patients and family members who feel they didn’t receive adequate care. Whether it was forcing them out of the hospital too soon or not providing reasonable access to rehabilitation, the report is full of claims of unfair treatment. Several claim that unaffordable rehabilitation services forced seniors to go without proper care, leading to a greatly-reduced quality of life. Patients and their family members were asked to call into a now-inactive hotline, which the two groups had set up for 12 months, and relate their stories. Among the 600 complaints, about 75 of those came from this region which spanned Trenton to Kingston. As part of the 60-com-

munity press tour, the President of the Ontario Council of Hospital Unions, Michael Hurley, was at the Napanee Legion last week to discuss the report. He says the complaints of inadequate health care stem from budget cuts that have seen 19,000 acute care hospital beds removed from Ontario’s hospitals. “It’s left us with the fewest number (per capita) of any province in Canada and of any country in the OECD (Organization for Economic Co-operation and Development),” said Hurley. “No country with a developed economy has fewer beds to population than we do. And we have the fewest number of staff for those beds and the shortage lengths of stays.” In the report, they allege that many hospitals are forcing seniors out of their beds before they’re fit to go home, instead focusing more on caring for the younger generation. Part of their plan to stir change is to seek legal action against the government, citing ageism against seniors seeking health care. They’re scheduled to meet with a lawyer next Tuesday as they prepare their case. “What we believe is happening is that the system is coping with its loss of

province’s health care, but Hurley feels getting people talking about it will. While admitting fixing the problem will require a lot of money, the two groups feel focus needs to be on where the money is spent versus how much. “We believe within the existing envelope of the Ministry of Health there’s more than enough money to meet these needs,” said Hurley. Instead of working with private companies to help fund hospitals and borrowing money at high interest rates, Hurley suggests the government focus on keeping hospitals publicly funded. Eliminating tax cuts for wealthy businesses is another suggestion for garnering the funds needed to fix the problem. As part of their plan they
call for privatized aspects of health care such as physiotherapy and speech language pathology to become public to keep them affordable for seniors and those living in poverty. As it stands now, Hurley says most seniors who suffer a stroke can’t afford the recommended 32 therapy sessions they need to recover. “We estimate the cost of bringing back physio and restorative therapies at $100 million,” said Hurley. “For example if (the government) would reconsider doing some of the things that they’ve been doing there are more than enough to pay to provide enough beds to take care of the people who need the care. There’s enough to invest in the community care and there’s more than enough to deal with providing the essential rehabilitative services to be able to recover from what are otherwise debilitating catastrophes.” When it comes to pointing fingers Hurley says all three major political parties have closed hospitals while in power. That’s why the group plans to meet with the Liberals and two opposition parties as part of the press tour. “We’re asking them to stop the cuts to the acute care hospital beds, we’re asking them to make meaningful investments,” said Hurley. “I think a fair amount of public pressure is going to be required to move anybody off the existing policy, radically downsizing the acute care sector.” Hurley says they have plans to hold public meetings across the province in the near future as they continue to drum up public support and keep the issue in the spotlight.

Both Greater Napanee Emergency Services and the Loyalist Fire Department were needed to fight a fire on Townline Road last Wednesday night. According to the Greater Napanee department, the call came in at around 6:47 p.m. When firefighters arrived, heavy smoke was issuing from the home’s attic. The firefighters made an “aggressive interior attack” in an attempt to restrict the fire to the attic. However, due to the
type of construction and the multiple roofs of the structure, the fire advanced to the point where the interior crews had to be pulled out of the home for their safety. The Loyalist Fire Department was activated under the Mutual Aid Agreement; the neighbouring municipality sent a pumper, tanker, air vehicle and firefighters to the scene to assist. Fire crews were on scene for several hours. GNES estimates that the fire resulted in $400,000 worth of damage; the cause is still being investigated.
Stone Mills Township hires Deseronto clerk Beaver Staff
Last week, Stone Mills Township announced that it had found a new chief administrative officer/clerk — and the township didn’t have to go far to find him. Reeve Doug Bearance and the township announced the municipality had selected Bryan Brooks, who had been serving as clerk and deputy-treasurer for the Town of Deseronto since 2005. Brooks has also worked for an accounting firm and
for the Town of Greater Napanee in “administrative capacities.” The NDSS and Loyalist College grad said he’s looking forward to the new challenge. “Not only will I be able to contribute my energy and knowledge to the township’s affairs, I will also have the opportunity to learn from and collaborate with a team of accomplished senior managers,” he said. He starts at Stone Mills on May 12.

Partisan ‘act’ dispelled (for now) Business-as-usual in Ottawa ground to a halt on Thursday when news the sudden death of former Finance Minister Jim Flaherty quickly made its way across the nation. We’ve already assessed Flaherty’s performance as finance minister — we found that performance to be a mixed success. Many others have reflected on the job he did, both after he stepped down and immediately after his untimely passing. Regardless of where we peg Flaherty on list of all-time-best finance ministers, however, he undoubtedly worked very hard in the public service, and for that he deserves all Canadians’ gratitude. Indeed, that’s why Flaherty’s passing has struck such a chord: someone who works hard their whole life deserves to enjoy a retirement with their family. Flaherty certainly deserved that, too. There was another element to Flaherty’s death that was worth noting too — the façade of the daily political bickering and grandstanding was utterly torn down. NDP Leader Thomas Mulcair — who does his best to portray the Conservative government to be crooked, underhanded and/or monstrous on a daily basis — was almost reduced to tears in front of cameras on news of Flaherty’s death. Anyone who regularly watches politics knows they have to take what’s said between parties with a grain of salt. Partisanship, particularly the overblown partisanship we’ve seen in Ottawa for the past several years, distorts reality. Amid the sadness of Flaherty’s death, it was refreshing to see our MPs acting like rational, reasonable human beings. Among the many eulogies that have been written about Flaherty, many have said that the former finance minister ‘was not like the other MPs’ in this respect, that he was above it, that he operated on a different plane. Perhaps that’s true, but from where we sat, it appeared that could play the rabid partisan role as easily as anyone. He may have been a ‘happy warrior’, but he was a warrior nonetheless. Clearly, his opponents on the other side of the partisan divide didn’t hold it against him, if their outpouring of grief is any indication. Politics in Ottawa or anywhere will never be — and never should be — a quiet, uncontroversial pastime. However, when people, and not ideas, are attacked, ‘politics’ isn’t working the way it should. It’d be naive to think that things will change much, if at all, following Flaherty’s death. The behaviour of parliamentarians in the moments after his passing, however, show us that it can be different.

Can’t be ‘idle’ on helping the environment One real important benefit of the recent increases in the price of natural gas and other fuel is that folks will conserve more. These price increases will cause lights to be turned off, thermostats turned down or off in unused rooms. thus reducing our overall carbon footprint. We have been slow in modifying our environmental habits. When the Kyoto protocol was abandoned by our government, it should have fallen at our feet, as we by now should have understood its goals and what we can contribute toward achieving good results. Therefore, we as individu-
als should have set our sails into the good environmental wind and ‘become Kyoto’ ourselves, in all our actions. One doesn’t have to look any further than drive-thru windows to witness that the light hasn’t come on in too many. During our Earth Day event in 2005, ‘the Good Friends of the Earth Napanee’ presented a letter to the then Ontario Environment Minister, Leona Dombrowsky, proposing a 10 per cent tax on drive-thrus, with eco cars and handicapped vehicles being exempted. The Ministry of the Environment passed the buck to the municipality.
We had suggested that the tax revenue could be channeled into other environmental initiatives and that the tax should also produce an epiphany, for many, causing them to resume the healthy actions of parking and walking into the store or restaurant. Not long ago we managed without drive-thrus. Anyone can Google ‘car pollution’ and see the nasty results such as respiratory diseases, cancer, acid rain and greenhouse gas. Tim Hortons and McDonalds, together, have 5,000 drive-thrus in Canada.

LETTER FROM PAGE 7 If one assumes a modest average of two minutes of idling per car and only 200 cars per day, it would add two million unnecessarily idling minutes per day. This doesn’t take into consideration all the other drive-thru windows at other restaurants. This tiny planet is a mere 40,000 kilometres around, with its finite atmosphere, where the ‘death zone’ begins at just eight kilometres high, where all important oxygen becomes reduced much below that level. Therefore, we do live in a dome or fish bowl that is zipping through the darkness of space that night skies reveal. Every household should have a photo of our magnificent Planet Earth, taken from space, mounted where it can be viewed daily. We need to focus on improving the only home that we are certain of. Too many warning signs of climate change are being dismissed or ignored. Previous climate change events, which happened without massive human contribution, have caused civilization collapse and great diaspora. Hollywood movie scripts may not equal the worst scenario when we thoughtlessly bypass the predicted tipping point as we do much too little — while pollyannas and pessimists debate. The earth’s population will add 2.4 billion newcomers to arrive at the 9.6 billion mark by 2050. Cars exceeded one billion in 2010 and are expected to reach 2.5 billion by 2050 as exponential growth continues to play a larger role as the driver. Cars are by no means the only contributors to atmospheric pollution. There is a sign posted on the Napanee fairgrounds warning of a $5,000 fine if one is caught smoking a cigarette outdoors! However, I’ve often seen government trucks left idling as they perform tasks, such as mounting signs. I can’t figure if irony or absurdity fits here. I can’t imagine the amount of the fine when it’s determined that there’s no comparison with a single cigarette versus car exhaust. Ten million minutes of needless idling in Canada, per day, would be a low guesstimate. Let’s target Earth Day on April 22 as our new beginning and set a new standard of conduct by replacing ‘me’ with ‘we’ and turning off the exhaust at every possible opportunity. Technology is hastening and will catch up (providing our economies remain strong) but we have a huge role to play until it does. What in this world could be more important than our air supply, water supply and climate! Let’s begin erasing those 10 million minutes. Respect is the finest word in the English language. Easter a challenge for the faithful Editor’s Note: The following is an Easter message from Rev. Jean Brown, Retired United Supply Minister serving the United Churches of Selby and Empey Hill. Easter, that gloriously wonderful time to celebrate that Jesus Christ defeated death, and rose from the dead, after crucifixion, is here once again and what a challengingly fantastic time it is. We know that Jesus Christ, born at Christmas time, did grow up, perform miracles, train followers, was crucified, died, buried and that He rose from the dead. For those who are stuck at the Christmas happening with all the appeal of an infant Christ in a glitzy manger, the Easter event is a bit of a stretch — and yet it is an important reveal for all of us. For if we have the faith and the mindset of Jesus Christ as a helpless and somewhat romantic infant, then the Easter event will seem very gruesome, in that it involves death, resurrection, and where we will spend eternity. If we have what I call a ‘Christmas faith’, then when heartaches, sorrows, death comes along we will throw up our hands in despair. However, with an Easter faith, we are equipped for all that life sends our way — joys, sorrows, defeats, death, heartaches. So the Easter even,t in a nutshell, is that Jesus Christ, that little baby that we celebrated at Christmas, grew up and He asks us to grow up in our faith, our thinking and our living. Jesus Christ grew up, and inspired by His heavenly Father performed miracles, offered new life and in so doing threatened the authorities who put Him to death. He rose from the dead, appeared to His followers, all of whom were frightened for their future, and He gave His Holy Spirit or presence to us and to
the world, and He lives with us today. I consider it a sacred privilege to share some thoughts via this paper, however will admit that the Easter event is hard to capture in words, images, discussions, and that it is more of an ongoing experience for all of us. For instance, when I was young, my Mom refused to allow Easter candy like eggs and bunnies into the house, fearing that the religious significance of Easter would thus be ruined. We used to cry and beg for Easter toys and candies like most of our friends received, but she refused and I admire her stamina in doing so. It couldn’t have been easy back in the 1950s to stand your ground on the religious significance of Easter, yet she did, and I am eternally grateful. Over time, and as I consider Easter to be an ongoing happening in that the Spirit, presence, ideas and ideals of Jesus Christ keep inspiring, motivating and leading forward, I would say that the message of Easter is much more than some mere candies, and that it is a message of hope — hope that in life, in death and in life after death we are assured of the accompaniment of a living Saviour who is in the world today, who walks with us, talks with us, changes and challenges us. Jesus Christ challenges us in the same way He challenged those first followers who found the tomb empty and who tried to make sense of the resurrection appearances of Christ as He revealed Himself in a garden, on a deserted road and to some followers on a beach. He challenges us in that we can never really pin him down, never really fully comprehend His message and never fully understandeven though we try. Yet, Christ makes a difference in our lives. When Mary Magdalene sees the risen Christ and realizes who He is, Christ says to her (and to us as well) — “don’t hold on to
me, I haven’t yet ascended to the Father,” we need to really listen up to those words. They are very significant. Christ says them to Mary Magdalene and also to us today — don’t hold on, don’t try to nail me down, don’t think you've ever got it all figured out, for there will always be the element of surprise, or there will always be some challenging documents or some way that life will challenge or change who you are. In the same way that Mary Magdalene, after the Easter resurrection experience ventured forth in fear and in wonder, so too must we — and we can never pin down the power and the energy of Jesus Christ. We can never really nail Him down to a cross, and that is what Easter is all about. We might prefer to hide out and to eat a few Easter candies, but we are challenged to go with Jesus Christ in whatever direction He is leading. We live in the shadow of the cross and we are Easter people. The real message is that the followers didn’t run away, didn’t keep silent; they ran to the tomb and they embraced Jesus Christ and they told the good news. That is our mandate — to serve a risen saviour, to tell, to believe to be open to the risen Christ as He appears to us today in the words of scholars, in the answers to prayers, in nature and in our lives. The real message to us is that Christ has no hands now but ours, no body now but ours, no feet but ours, and that the risen Christ is with us to help us out each and every moment. So, as we serve a risen Saviour we respect the many challenges, many ways of serving, ways of thinking, and in so doing we honour God. May we, as Easter people, be inspired and challenged by the risen Christ and filled with resurrection inspiration. May we live life to the fullest with no fear of dying and no fear of eternity. May we know who we are and whose we are.

Three swans a-swimming There was a time when the Bay of Quinte region had no swans. Hard to believe. The Trumpeter Swan had long been extirpated from the region due to hunting; the Mute Swan had not yet found its way into the region; and we were so far removed from the normal migration route of Tundra Swans that seeing one in the area was an unusual event. Today, all that has changed. There are three species common to our area. We can now count the day lost when we don’t spot a swan somewhere in Bay of Quinte waters. Perhaps the most obvious is the Mute Swan. Despite their name, they do have a voice, albeit muffled. Mute Swans are not native to this area; they were introduced many years ago as an ornamental swan for parks and other confined areas. A few eventually escaped into the wild and by 1958, were actively breeding, and multiplying, in the Great Lakes. The very first Mute Swan made its debut in the Quinte region at Consecon Lake, in 1963. The Great Lakes population has since expanded to an estimated 10,000, doubling every five years or so. In fact, the Prince Edward County and Quinte region in general, probably harbour the largest
breeding population of Mute Swans in eastern Ontario. The damage that these large, aggressive, territorial birds cause is well documented. They displace other nesting waterfowl within their large territories and consume large amounts of submerged aquatic vegetation by uprooting twice as much plant material as they actually consume. There is grave concern over the future of other waterfowl species too due to their extremely aggressive nature during the breeding season when territories have been established. When patrolling their appointed space, adult swans will often drown any waterfowl species that dare enter their chosen territory. They often attack canoeists and kayakers out for a paddle and their powerful wings are capable of breaking an arm. At all other times of the year, they are passive birds and the symbol of grace and beauty as they readily take food from the hands of the admiring public. For many years, the Mute Swan’s counterpart, the much smaller Tundra Swan, formerly known as the Whistling Swan, was also a rare occurrence in our area. An Arctic breeder whose home is so far north that it barely touches Ontario, thousands

Outdoor Rambles migrate from wintering grounds at Chesapeake Bay, and pass over Lake Erie every March. In recent years, their migration route has expanded, and Tundra Swans are commonly seen in our region too each spring and fall. Twenty years ago, it was also rare for a Tundra Swan to show up anywhere in our region during winter; they always migrated to Chesapeake Bay. Today, large numbers are now wintering here as more open conditions during winter offer shelter while an abundance of zebra mussels provide adequate food for their stay. The Trumpeter Swan is even larger than either the Tundra or
Mute Swan and resembles the Tundra Swan so closely that it takes a trained eye to separate the species when viewed from a distance. The larger size and some facial features around the forehead separate the Tundra from the Trumpeter. It has been only in recent years that the Trumpeter Swan has been added to the swan species regularly seen in our area now. Trumpeter Swans once nested across eastern North America in pre-colonial times, but were extirpated by early European settlers before the mid-1800s. By 1900, they were nearly extinct and survived only in remote parts of Alaska, Alberta, and the Greater Yellowstone region. Retired Ontario Ministry of Natural Resources employee, Harry Lumsden, initiated a re-introduction program in Ontario in 1982. Birds were released at over 50 sites, including the Wye Marsh in 1982, and at Prince Edward County in 2006. In Prince Edward County, those releases took place at Big Island near Demorestville (15 birds), and the following week, at Huff’s Island (11 birds). In 1993, the first wild nesting in Ontario occurred at Wye Marsh and nesting Trumpeter Swans can now be found in isolated locations
throughout the areas of release. Historically, Trumpeter Swans also migrated in winter to Chesapeake Bay, but having lost their migratory instinct over the last 100 years of near absence from our area, Trumpeter Swans now wander around locally seeking any open water free from ice where they can spend the winter. While many bird species are declining dramatically in numbers, it is encouraging to see the swan family doing well and establishing their niche in the Bay of Quinte region. Despite the current concerns over the burgeoning Mute Swan populations, all swan species appear to be getting along amicably, adding a sense of majesty and gracefulness on our local waters. Sometimes in our tampering with Mother Nature, we can produce some unexpected results. A successful re-introduction of a native species, too much of a good thing with a non-native species, and changes in wintering and feeding behaviour of a migratory species. 50 Years Ago April 15, 1964 n Napanee Mayor Glenn Herrington declared that he’d do what he could to stop what he called “hell driving” in town. Herrington told council that one driver was charged after he skidded around a downtown business intersection at the height of Saturday shopping traffic, and that later the same day another driver slammed into a tree. “On the basis of telephone calls I have received and my own observations, I am going to see that something is done,” the mayor said. He also said that young drivers were double-parking downtown, causing traffic tieups. n Napanee Industries Limited was about to see the scope of its operations expand. While the company had always been involved in the manufacture of components used in the railway industry, the company had just received an order to build entire railway cars. In the long term, the change in focus would mean that the company would have to replace its current buildings, located just west of West Street, with more modern and efficient structures.
35 Years Ago April 18, 1979 n The local Liberal campaign got a boost with a visit from Federal Agriculture Minister Eugene Whalen, the MP for Essex. Whalen rode in a hay wagon with local Liberal candidate Ron Vastokas from Lasher’s Feed Mill to Vastokas’ campaign headquarters on John Street in Napanee. Then, Whalen and Vastokas did some campaigning downtown. Whalen said that, contrary to the belief of some, he had no problem being heard at the cabinet table headed by Prime Minister Pierre Trudeau. n The town’s recreation committee was considering recommending moving the recreation director’s office from the town hall to the Napanee Memorial Centre arena. With the rec director relocated at the arena, the town would not have to pay for a full-time employee during the day at the rink. The committee was considering other options in either increasing revenues or decreasing expenses at the arena, including reducing the number of canteens from two to one, and increasing ice rental rates.

Editor’s Note: This is the eighth of an ongoing series provided by L&A County to mark the municipality’s 150th anniversary. This article discusses D.W. Allison, Warden of Lennox and Addington in 1881 and Member of House of Commons 1883 and 1891. D.W. Allison was known as the “old war-horse” of the Liberal Party in Lennox and Addington. His grandfather, Joseph Allison, was one of the first Loyalist contingents to land in Adolphustown. A few hundred feet from that landing place is where, in 1876, the younger Allison built the handsome brick residence where he spent the last years of his life. Primarily a farmer, Allison sought to better his fortune by engaging in many other lines of business, including shipping, mining, and lumbering, and he was never staggered by the magnitude of any speculative transaction. No man in his native township was more highly respected, as he was kind and generous to the poor and a friend and neighbour to all who knew him. Allison passed through the stages of municipal politics from councillor of Adolphustown to warden of Lennox and Addington County in 1881. In 1882 Allison dared challenge the greatest statesman of his day when he engaged in a political contest for a seat in the House of Commons with Sir John A. Macdonald. Although Macdonald was elected, he was later unseated through acts of bribery committed by his

In 1883 the same contestants again entered the field, and this time Allison was victorious. He too held his seat for only one session, as he was c a l l e d upon to pay the s a m e penalty as Macdonald had paid the y e a r before. In the by-election which followed, Allison was defeated by M.W. Pruyn of Napanee. In 1887, Allison was
defeated by Uriah Wilson by only 20 votes. In 1891, Allison faced Wilson for a second occasion, this time securing a majority of 61 votes. Unfortunately this election was protested and the seat once more declared vacant. In 1892 he measured swords with Wilson for a third time, but failed to secure the requisite number of votes. Village’s postmaster wraps up career Newburgh Post Office Manager Hank Bartlett has seen plenty in small, rural delivery centre

Dressed as a tourist, beach hat and all, Hank Bartlett celebrated his last day of work at the Newburgh Post Office last week. It was 30 years on the job, to the day, on Bartlett’s last day last Wednesday. There were hugs, smiles, tears and laughter, and more than enough cake to go around. When he began working at the Newburgh Post Office on April 9, 1984, there was no telephone or computer. Postal costs were determined by memory, not by a computerized system. “The changes over those years, from a place
that didn’t even have a phone, there’s now a phone, a computer, email, internet, everything is electronic, nothing is up here in your head anymore because there’s no more flipping through the books. You put it on the scale, you measure it, you weigh it, and you get the postal code rather than the province,” explained Bartlett. “Things have gotten more refined rather than easier. If the computer goes down and the power is out, that’s it. We close because there’s nothing we can do. So that’s changed a lot,” he went on. Last Wednesday, when Bartlett walked into the post office for his last day of work, he was surprised

by all the colourful streamers, balloons, cakes and gifts. “This is all more than I knew. I came up here this morning and the place was decorated and there were treats and then the cake showed up… It’s really quite a surprise,” he said. “There was quite a crowd here all morning and the area manager was here and the superintendents were here.” Bartlett says, “it’s going to be kind of weird,” getting used to the idea of retirement, but between a few trips, hobbies, and helping family and friends in the community, he is sure to stay busy. He’s planned a trip to the Dominican with his family and another trip to Peru for Machu Picchu with his daughter. Aside from that, he will be helping to care for his mother and her home, as well as a grandson he has in the village. As well, one of Bartlett’s favourite hobbies is examining the sky and he hopes to pursue that during his retirement. “I’m an observational astronomer, amateur astronomer, so I do a lot of solar observing and take images of the sun,” he said. Bartlett said when he began working for the post office 30 years ago, the career seemed somewhat unstable. He decided to stick with it as long as he could. “I decided to ride the

Shopowners look for silver lining in court decision Judge rules that municipal staff acted properly in closure of ‘unsafe’ Pie in the Sky property

More than a year after a fence was erected around local business, Pie in the Sky, owners Anne and Stephen Hull have lost their court case against the Town of Greater Napanee, as well as their business. Jan. 14 was the final judgment on the case pertaining to safety issues relating the shop building
on John Street. The Hulls lost that case, but are thinking about pursuing a civil case against the municipality. “We just lost the appeal of the unsafe building, that’s all we lost. The monetary issues weren’t heard. None of the civil suit was heard,” explained Stephen. “It was a loss but still a moral win,” he went on. “The civil case pertains to the same issues and that I believe the town acted

with malice. We lost $21,000 by having it vacant,” Stephen said. However the reasons for judgment made by Judge Douglas Rutherford, who dealt with the case, stated otherwise. “I do not see in the evidence as to the prior dealings between the Hulls and Napanee officials… a basis for any conclusion of venal intent, malice, or bad faith dealings on the part of the Napanee officials,” the document stated, in paragraph 38. On Dec. 27, 2012, the upper levels of the Pie in the Sky building on John Street were deemed unsafe. Renters vacated the three apartments above and a short time later the municipality declared the entire building unsafe and erected a fence to block off the area. About a month-and-ahalf before that, the Hulls notified the municipality that the business adjacent to them was decaying. The owner of that building had

passed away and the back wall had begun to decompose, affecting the Hulls’ building. It is said this is what led to the Hulls’ building being declared unsafe. Anne, who ran a catering business and restaurant out of building, said she has lost everything. “We’ve got to move on. It’s unfortunate, it happened, it should have never happened,” she said, stating there is no easy way to move on from such a loss. “You can’t just walk away from it.” James McDonald, the Town of Greater Napanee’s lawyer, said the municipality has sympathy for the situation the Hull’s have found themselves in. “It’s an unfortunate situation but it’s the reality of an old building and it’s the responsibility of the owners or owner of a building to maintain it and ensure it remains in a safe condition. Unfortunately in this circumstance, it didn’t remain in a safe condition,” he said. “We’re essentially dealing with a 150 year old building that essentially has reached its useful life,” he continued. The Pie in the Sky operated out of one part of a building, while a vacant building occupied the other half. The businesses are located at 115 and 117 John St. The Hull’s complained to the municipality regarding the neighbouring decaying business, but since that owner had passed away a year prior, there was no one left to care for the building. “With 115 and 117 John St., while they’re two (distinct) properties, they’re structurally one building. The question as to whether a building is unsafe has to have reference to the entire building. So the engineering evidence was that this building was unsafe,” said McDonald. “At the end of the day, the municipality has an obligation to protect the public and to ensure buildings remain safe for occupants and the public that may venture in the build-
ings or walk through them. At this point, the condition of the building at 115 and 117 John St. became unsafe for continued occupancy and the town had to take steps to protect the public under its obligation under the Building Code Act,” McDonald continued. On March 21, the judge declared the cost of fixing the property at $49,450; however, only left the municipality responsible to pay for $27,450 of that cost. That means the Hulls are responsible for $22,000, on top of the over $20,000 they have lost in the last year from having the building vacant. “In our court system, it’s not 100 per cent loser pays system. There’s partial indemnity costs and substantial indemnity costs and the usual method of paying costs that are awards is something called partial indemnity costs. That means that anywhere from 40-60 per cent of the costs incurred are paid by the losing party and it’s always in the judge’s discretion,” explained McDonald. The Hulls suggest that the municipality could have fixed the building for much less a year ago. They say in the beginning, the building could have been fixed for about $15,000, but once the case was taken to court the costs grew significantly. The Hulls say much of the costs the municipality is now responsible for will fall on the backs of taxpayers. “They could have walked away from the lawyers and said, ‘look, we’ll handle this one on our own. This is simple, we’ll go in and we’ll fix the property,’ but they didn’t. That’s the sad thing,” said Stephen. However, the Reasons for Judgment, made by Judge Rutherford, said the municipality did what it was legally required to do. “I cannot imagine how a municipality or its building officials, faced with the information and engineering opinion Napanee and its CBO and D/CBO had before them in this case, could have made any other
decisions than those Napanee’s building officials took in making the orders they did. In light of the increasingly detailed information and advice received by Napanee’s building officials, their Orders of Unsafe Building issued initially against the Crock property on Nov. 13, 2012, and the Order issued against the Hull property on Dec. 20, 2012 limiting occupancy, and then the Order of March 12, 2013 prohibiting all occupancy of both properties, are in my view completely reasonable,” the document stated, on paragraph 37. “I cannot imagine on what basis the building officials could have properly gone against the AECOM advice and findings and permitted continued use and occupancy of either property. I think that would have been reckless and certainly would have exposed the officials and the Town to great and very serious risk,” the document continued. However, now the Hulls are left with no choice but to claim consumer proposal or bankruptcy. “We lost our retirement. My plans were to sell the business and then we could have rented that storefront, plus three apartments. We’ve lost all that,” said Anne. Stephen, who represented himself in the case, said he believes part of the reason why they lost the case was because he was unable to find a lawyer to represent them. However, he feels he has gained enough knowledge to win a civil case against the municipality, should he decide to pursue one. “But once you go down that path, there’s no way back,” he said, still contemplating it. “It’s been a long year,” said Anne, adding that she’s ready to move on. The fence is still up around the Pie in the Sky building, on 117 John St., as well as the adjoining building at 115 John St. The Hulls have up to two years to file a civil case against the municipality concerning this issue.

About 20 volunteers help cultivate the land, which was donated by Mayor Gord Schermerhorn. As the ground finally thaws they’re getting set to take on their fifth year at the community garden. Last year, with eight people participating in the
'Grow A Row' program, they were able to provide 60 bushels of food for local families. They're hoping to expand that even further this season and double the amount of those participating in their own garden. Funding for the program was made possible through a grant from the
Napanee District Community Foundation. They use that grant money to purchase seeds from Deseronto’s Piercy’s Farm Market. NDSS students enjoy dramatic success

For the second time ever, the Napanee District Secondary School drama club moved on to the regional level in the Sears Festival, a competition for high school drama clubs. “We’ve done well in the past but this year more so than we have in the past. It’s been a very exciting year for us. Moving on to the regional level has only happened for us once before,� said drama teacher and club director, Sue Marriott. The club competed at the Kingston and St. Lawrence District Sears Festival in Kingston before moving on to the Eastern Ontario Regional Sears Festival in Perth earlier this month. NDSS won awards in both competitions. The club will be putting on a show in Napanee next Friday, open to the public. The plays they perform will be the ones they used to compete in the festival. Three plays were performed in Kingston, one of which was written by an NDSS student. “Take me to the Gates is written by Beau Deguire, he’s a student. This play is about a man that has just passed away and finds himself in limbo. The devil is there to bring him to hell and he’s showing the devil through flashbacks of his life, that he deserves to go to heaven,� explained Marriott. “I was thinking about writing one about a singular devil and then it adapted into writing about two devils and then I thought about going through his memories

They won a number of awards at the Sears Festival this year. and his past and it all just came together,� said Grade 11 student Deguire about how his play came together. “He’s fighting to prove himself innocent through his memories and they go through each one to see if he’s innocent or not. In the end it’s decided if he’s innocent or not,� Deguire continued. That play won an Award of Excellence for the set and costume design during its competition in Kingston. The next play, The Sidekick, was a comedy written by two former students. “This play is a parody of superheroes and it’s all about the unsung hero, the sidekick, to the main superhero character. So the story
follows a sidekick and how he tries to become a superhero himself and his journey. It’s a lot of fun. A lot of crazy, superhero fun,� said Marriott. This play won two awards. Jake Anderson won an Award of Merit for his direction of the play, while Caleb Posterski won an Award of Excellence for his acting. The final play made it on to regionals. It was called, Liver for Breakfast and was directed by Grade 10 student Miriam Smith. “The idea behind the play is we’ve got three siblings in their late 20s, early 30s, who are meeting together to go have breakfast with their father. Their parents
had split not too long ago and their father is dating a woman who is younger than all three of them. So, dealing with learning this news and still coping with the parents’ separation, you see some really interesting dynamics between the three siblings in that play,� said Marriott. “We never expected that Liver for Breakfast would be the one to move on if one of ours did, so when they called Liver for Breakfast I actually fell off of my chair on to the floor,� explained Smith. “Everyone was screaming and crying. It was pretty surreal. It was a lot of work, I was tired, but it was worth it. They performed really well in the first level and then at regionals they performed even better. I was really, really pleased with how it all played out.� At the district level, this play won three awards, one of which went to Smith for her direction of the play. Rachel Agombar, Beau Deguire and Morgan Shettell-Morris won an Award of Excellence for their acting in the play. Liver for Breakfast also won the Outstanding Production Award, making it one of three plays to move on to regionals, out of the 14 competing. At the Eastern Ontario Regional Sears Festival, Smith won the Award of Distinctive Merit for directing the play, and Agombar, Deguire and Shettell-Morris won another award for their
acting. “We only had like a couple days before we had to move on to regionals,� explained Smith, stating it gave them little time to make changes or improve the performance. Smith said she replaced a bench with one more authentic, as well as worked on character development and changed some lines to ensure their performance at regionals was the best it could be. “We got to go to Perth for the entire Eastern Ontario
region and there were 12 plays, one of which was ours, performing at this festival and we brought home two more awards of merit from that. We were absolutely thrilled with their accomplishments and how they performed on stage, all three plays did a really great job at the festival,� said Marriott. All three of these plays will be performed at NDSS on April 25 at 7 p.m. Tickets are $5 each and can be purchased at the door the night of the show.

Canadian Country Star George Fox comes back to Tamworth for a show at the Tamworth Legion on April 26.
Award-winning Canadian country music performer George Fox is coming to Tamworth next weekend and promises to play some of his greatest classics, including ‘I Give You My Word,’ and ‘Mustang Heart.’ Fox has opened for some of country music’s greatest, including Randy Travis, Dolly Parton, George Straight and Willie Nelson. He has headlined his own shows and is also known to perform for Canadian troops. In recent years, Fox has stepped back from the bright stagelights to live a quieter, simpler life his with his wife and two young girls. “I’ve been trying to be a star at home lately rather than a star on the road,” Fox joked. “Through the 90s I was doing a lot of touring, I did whatever I had to do in the way of promotion and travel around the world… But now I’ve got two little girls here at home and that’s the priority right now. Fox, who left his life on the farm for a career in music, is revisiting his agricultural roots. “I grew up in the foothills of Alberta and it was way back in the sticks there and pretty isolated so I’ve kind of gone full circle. It’s just like writing a country song — you have to write what you know. I felt comfortable on the farm life so I went back to it,” Fox explained. It’s no secret that Fox was a struggling farm boy before he hit it big on the country music charts. He said he’s proud of his rural roots and think that’s what makes a true country artist. “People are familiar with my story. It’s as much the music as it is your story that catches people’s attention. It was the fact that I was kind of pulled off the tractor and put on stage and was touring around with the big names that got people talking. People were well aware that I had to sell a bunch of cows in order to be able to get the money to make my first recording. I think they always identified with that a little bit,” Fox said. Aside from farming, Fox has been busy working on a children’s book and putting together an album
covering some of his favourite artists and country classics. “With All Due Respect, of course, it’s trying to compare what I can do with some of the classic songs and vocalists that I have been inspired by to do my own thing. It’s going back to singing pretty diverse songs, Dean Martin to John Denver, and all those classics,” said Fox. “Vocally some of these were a real challenge for me but it was something I wanted to see if I could do.” He also wrote a song as a 4-H fundraiser, called ‘My First Cow,’ and although he does not have plans to publish another, he said writing children’s stories has always been something he enjoys. Though Fox is originally from Alberta, he now resides in southern Ontario. His bandmates are also Ontarians, one of which is from Camden East and another from Campbellford. Fox said he plans to perform songs from throughout his career. The concert will take place at the Tamworth Legion on April 26, as part of the Tamworth-Erinsville Community Development Committee’s 2014 Concert Series. Tickets are $30 each.

Local Parkinson’s group advocates for caregivers BY ASHLEY ESPINOZA Staff Reporter
You wake up, already tired, with a long to-do list. Even though you’ve been an empty nester for years, there’s no time to put your needs first. You’re a caregiver to someone with a disability and your work never ends. You’re always on the clock. That’s why Don Ryan created the Parkinson’s Support Group in Napanee, to support caregivers as well as those living with Parkinson’s, such as himself. That group meets every second Tuesday of the month in the L&A Seniors Outreach Services building. “Our objective is to help the people that are experiencing difficulties with Parkinson’s and be supportive of on another,” he said, stating that includes caregivers. Don and Helen Thomp-
son, who is a caregiver for her husband, James, are looking to increase awareness so caregivers can receive benefits and support. Don’s wife, Connie, cares for him. “We want to bring out the fact that the caregiver is the most important person in the chain… We want to get across the message that there is no help government-wise or anything for the caregivers,” said Don. The person living with Parkinson’s, however, is able to apply for a tax credit and other assistance. “Here are the caregivers, out looking after their partners, with no benefits whatsoever and they’re not addressing the issue. The number of caregivers that are going into their senior years, over 65, is frightening. The government is not prepared to address that,” he said. Don found out he had Parkinson’s about six years
ago but believes he was living with Parkinson’s for about five years prior to that. “It’s hard to define it. I’ve been working on it for a number of years; I do a lot of research and deal with medication. I belong to a group that has a blog for people with Parkinson’s and there are about 4 million people on it from around the world,” explained Don, having a hard time describing his life with Parkinson’s. The website he contributes to can be found at, https://healthunlocked.com. Helen said doctors also had a hard time diagnosing her husband with Parkinson’s. After open-heart surgery in 2011, James believed his post-surgery medication was what was making him shaky and unstable. After falling in a muddy parking lot and taken to the hospital, he was notified that he had Parkinson’s.
Since Parkinson’s makes it difficult to complete most day-to-day activities, caregivers are often responsible for most of the person’s tasks. Helen does most of James’s daily tasks for him, but Don still tries to be as independent as he can. “I have a terrible time trying to do things that ordinarily take people no time whatsoever. I had a bank deposit… it took me the better part of a half a day to type it out, get it sent and faxed in with a void cheque, to the people that need to do it. Where I could have done that, two years ago, in half an hour. I could have sat down and typed it out and had it done. Everything that you do takes so much longer to do it,” said Don. Don’s brother also had Parkinson’s, but died about a year ago. That motivated Don to see that more is done for caregivers and to raise awareness about

ENTAL health ailments aren’t always easy to spot, but Lennox and Addington Addiction and Community Health Services is doing its part to make sure the resources to treat them are plain to see. To help promote their service, they held three drop-in sessions last week to let the public know who they are and what they offer. They were also aiming to clear up some misconceptions the community may have about them. “I think often people think our agency is for people at the very extreme end, which of course we do address,” Michelle Murray, Executive Director for LAACMHS, said at a dropin session held Thursday at the Lennox and Addington County General Hospital. “We also address the whole spectrum.” Whether it’s offering ongoing outpatient therapy, support for individuals being released from custody back into the community, someone to talk to or a referral to another program, they offer a wide variety of options for those in need. Many times, just offering an ear to listen to someone who has nowhere else to turn can make a huge difference. They’re there for the times when

even a close friend can’t provide the support someone going through a personal crisis needs. “We’re a society of fixers, we think we should be able to fix everything and if we can’t fix it we get a little angry sometimes and our anger gets projected onto the individual and it’s the ‘blaming the victim’ thing,” said Murray. Part of the drop-in sessions were aimed at shaking off some of the stereotypes associated with people who use their services. Murray says some people might be surprised to learn it’s their neighbours, friends or even family members. “I think it’s that whole thing of ‘I can’t see it so it doesn’t exist’,” said Murray. As the Canadian Pain Society’s data suggests, the problem very clearly does exist. According to their studies, some 50 per cent of patients waiting for care at a pain clinic report feeling depressed and 34 per cent of them have thought about suicide. Chronic pain is also associated with the worst quality of life as compared to other chronic diseases such as lung or heart disease. On the addictions side of things, the LAACMHS staff are trained to help people cope with not only the addiction itself, but the root causes. “There’s quite a link between mental health, chronic pain and addic-
tion,” said Susan Yee, occupational therapist with LAACMHS. “Even for mental health and chronic pain, there’s a stigma for all of them. It’s hard for people to come into our agency and for them to say they have chronic pain or
have mental health or an addiction problem. Hopefully these information sessions educate people.” It doesn’t take much for one issue to snowball into another.

Don, who was always an active member in the community and politicallyminded individual, said he has done his best to reach out for more support. “I find that we’re not addressing the governmental issue. We’re not addressing the caregiver part. My wife has arthritis and her hands are all crippled up.

rugby coaching staff on Monday as they watched both their senior and junior boys clubs take part in the KCVI Blues’ pre-season tournament at Queen’s University. Just getting onto a field, albeit an artificial one, was a welcome sight.

Lindsay Stakes and Addie Kaiser performed their best when it matter most, posting their best results of the season at the Gymnastics Ontario Provincials. Both girls represented the Greater Napanee Gymnastics Club in Windsor earlier this month that saw 800 athletes from across the province compete. Stakes, who is 14, finished 20th overall in the Level 7 division. That marked an 11 place jump of where she ranked after the qualifying round. Kaiser, who is 13, finished 26th in Level 5, powered by an 11th place finish on the vault. "I was definitely glad to hear that over everything, provincials was my highest score," said Stakes. Provincials mark the
end of the competitive season for the gymnast, who train about 48 weeks out of the year to help prepare for that final meet.
“We fought so many injuries this season. The fact that we both qualified after all the injuries we had is amazing.” Lindsay Stakes, GNGC Gymnast “It was a big challenge this year with a new coach, but it was a good coach, and a new system,” said Kaiser, referring to Angela Herrington who took over head coaching duties for AJ Ryan earlier this year. “We’ve worked since summer just training routines.” Learning a new system and jumping up a level helped contribute to a very difficult season for the girls.

Smith lives out OHL draft day dream Former Stone Mills Sabre gets nabbed by Kingston Frontenacs in Priority Selection Draft

ody Smith says witnessing the Kingston Frontenac call him as their 15th round pick of the 2014 Ontario Hockey League Priority Selection Draft earlier this month was the best day of his life. Making the moment even better was that he was with his mom and grandparents at the time, who played a huge role in his minor career. “They drove me everywhere I needed to be,” recalled Smith, who grew up playing with the Stone Mills Sabres. “We were watching the computer and my name popped up. I've never seen them jump so high.” Getting drafted by the home town club was an added bonus for the 15year-old, as it means he’ll potentially get to play in

front of his Napanee area friends and family. He admits that he was thrilled when he noticed it was the Frontenacs’ name attached to the draft pick. “I watched (the Fronts) growing up, I’ve seen them play over the years,” said Smith. “I guess I looked up to a lot of their players so it was a good fit.” Smith was well known by the team’s scouting department, having played this past season with the Kingston Jr. Frontenacs, scoring 16 goals and adding 18 assists. Along with the Sabres he also spent time with the Quinte Red Devils. Along with his mom and grandparents, he credits the early developmental years in Stone Mills for helping him get this far. “It helped me a lot, the coaches there like Al Fenwick, he was a great coach,” said Smith. “He really taught me the fun-
damentals of the game and what I had to do to be better.” After a brief chat with one of the Front’s scouts, he feels he knows what it’ll take to break camp with the OHL club next fall. “They say I need to get bigger and stronger, that’s for sure,” said Smith, who checks in at 6’0, 155 pounds. “I’m going into camp hoping to make the team. If that’s a good fit for me I’ll play. If not we’ll see what happens and I will look at my other options.” Given the Frontenac’s success this year, it presents a bit of a conundrum to all their drafted players. While they will like to play for a contending team that went 39-23-3-3 in the 201314 regular season, it means the roster will be a bit tougher to crack. They did disappoint in the playoffs however, coughing up a three games to none series lead to the Peterborough
Petes before falling in Game 7. Smith is preferring to stay positive, doing everything he can to impress in camp and earn a spot on the Opening Night roster. He’s planning for a very hockey-orientated summer, working out and getting onto the ice as much as possible ahead of August camps. He’ll need to prove himself against some older competition in camp. It’s a challenge he’s embraced and eager to tackle. While he may not have been a top 10 selection, he need not look hard for inspiration. NHL stars such as Henrick Lundqvist, Pavol Demitra and Joe Pavelski were all selected later than the 200th round. RUGBY | KASSAA season begins Tuesday CONTINUED FROM PAGE 17 Both the players and coaches were eager to get some real game action as attempt to get ready for the KASSAA season. Given the harsh and extended winter, the Hawks find themselves behind their usual schedule as they prepare for the start of the high school season. Usually the Hawks head into the annual Blues’ tournament with the goal of ironing out any last hiccups in advance of the regular season. This time around they were treating it almost as a contact practice. “The boys have had four practices, three of them outside,” said Hawks head coach Jim McKinney. “We were really doing a lot of teaching with those junior boys (during Monday’s tournament). There’s certainly a lot of talent in that first 15. We’re not really worried about this year.” The coach wasn’t all that bothered by the juniors’ 22-5 loss to the Trenton Tigers in their second game of the day on Tindall Field. “They’re a good club, year after year,” McKinney said of Trenton. “To be down 10-7 at the half with those guys, and we played
the half down a man (because of a penalty), it was very positive. In a normal year I would have been pretty upset at the lack of organization. The fact of the matter is we’re not ready to play yet. We’ve depowered the scrums to make them safe, we’re moving kids in all kinds of direction and not even worrying about the result.”

Golden Hawks soar at OFSAA Team wins in Levels 4 and 5 Beaver Sports
NDSS’ gymnastics team scored well in both team and individual categories at this year’s OFSAA championship, held April 7 and 8 in Peterborough. Napanee sent six girls to the event, all of with returned with some hardware. Their combined scores in the Level 4 and Level 5 divisions were both
tops out of all the schools. Sophie Scott was NDSS’ only Level 3 entry but she held her own, earning first place all around. She claimed silver on the floor and bars to go with bronze on the beam and fourth on the vault. It was a good opener.” The seniors will open the KASSAA season on Wednesday as they take on the Holy Cross Crusaders at Queen’s Nixon Field. Because of the long winter the first two weeks of the season will be played on turf as school’s give their grass fields a chance to thaw. The juniors will start their season on April 30 against Regi, also at Nixon Field. As for NDSS’ girls team, they will get started on Tuesday when they take on Holy Cross at Nixon Field. They will look to get back to their winning ways this year after their playoff run was cut short with a 220 loss at the hands of the La Salle Black Knights in the semifinals. Napanee is expected to return several key players for this season. La Salle was the only team to hand Napanee a defeat last year, besting them once in the regular season before meeting them in the playoffs. The Black Knights would go on to fall to the Sydenham Golden Eagles in the finals.

Greater Napanee Gymnastics Club. “I know I have somebody who knows my experience,” Kaiser said of having Stakes to talk with at the competition. “If I’m stressed about a routine I know someone who can understand what I’m going through. We’ve always had each other’s backs.” “You always know there’s someone who is going to be there for you,” added Stakes. “Even when you’re not hitting your routine or you’re not able to get a new skill.” Both are a mixture or relieved and a little forlorn now that the big event has finally come and gone. Such is the life of gymnasts that they can now look forward to a short break before getting ready to train this summer. With their success of this year they can now look to add to their skill set and perhaps consider jumping up a level. Coach Herrington says they have plenty of options moving forward but for now they’ll focus on coming up with fun ways to train and stay in shape throughout the summer months. The competitive season will start in the fall.

Loved and respected Grampa of Edward Armstrong (partner Wendy), Heather Leanne Inwood-Montrose (friend Andy) and Crystal Dawn Inwood-Angus(Alex). Lovingly remembered by greatgrandchildren, Jasmine Willow and Chloe Aria and many nieces and nephews and their families. The 6th child of 16, son of Edward Inwood and Mina (nee Storing) Inwood. Born, raised and lived in the Denbigh area all his life. Gilbert leaves behind a community and friends he cared very deeply about. He will be missed. Downtown businesses fundraise for chemo suite Special shopping event set for April 26

The Belleville and District Olde Tyme Fiddler’s recently donated $100 to Lennox and Addington County General Hospital medical equipment fund. The group holds dances featuring square dances and rounds. Admission cost to the dances is $7 for members and $8 for non-members (includes lunch). They meet every fourth Sunday of the month at the Fish and Game Hall in Belleville at 1 p.m. The Lennox and Addington County General Hospital Foundation says it is grateful for their support, time and efforts.
