T
o my mind, the typical attorney is an intimidating person. Lawyers are kind of like the dentist. They’re just somebody you don’t want to go see. It’s not that they’re mean or unkind or anything like that. I’ve certainly got more than my fair share of legal-minded family members, and most of them are actually pretty nice people. Rather, it’s just that when you go see a lawyer in their office, it typically means something is wrong. Something is wrong enough, in fact, that you need legal guidance. And that’s never a good thing. And then when you start writing about lawyers, you’ve really got to watch what you say, which adds a whole new dimension of trepidation. Like I said, the typical attorney is an intimidating person. Suffice it to say that Sarah Alger is not your typical attorney. Born in Hyannis and raised in Osterville, this most non-intimidating of lawyers began her legal career in the most unlikely of ways: she first honed her legalese by studying Romance languages at Dartmouth College in New Hampshire. “I never thought about being a lawyer,”

hough it has been roundly defeated several times in the past dozen years, a proposal to impose a new local occupancy tax is resurfacing at this year’s Annual Town Meeting as Article 31, a Home Rule Petition. Town Meeting 2011 opens at 6 p.m. on Monday, April 4 in the high school auditorium. ou can shy away from Nantucket’s annual Town Meeting, begging off because of the ennui-filled zoning discussions, laborious amendment-making process and the alwayspainful budget articles. But, this year is one that should not be missed. Yes, there are what have come to be the inescapable annual, neighborhood-changing revisions to the island’s zoning districts. These include swapping residential for commercial uses, or tweaking the density of developable lot space — there’s 11 of them. But, the real hand-
raisers this year are of the energy and money saving persuasion at the municipal level. With the town’s fiscal challenges, lowering its energy costs and shedding excess real estate are two options embodied in articles on this year’s warrant. There are also several longstanding infrastructure improvement proposals.

here’s been a lot of talk recently about the need for a parking garage in downtown Nantucket. Well, I think it’s time that I offered an alternative solution. Build a house. You heard me right. Build a house. Or, barring that, do a renovation, or an addition, or any kind of home improvement project that involves a local contractor. Here’s what happens when you do that. You hire the person to do the work on your house and this starts a labor-intensive process that involves a lot of people and a lot of meetings and a lot of talking and a lot of creating and modifying plans. And the thing that is most important to the entire process, regardless of the actual size of the project itself, is communication with those people who are involved in the process. Just like in any good relationship, communication is key. Talk to the people who are doing the work. And start the conversation long before the first hole is dug or the first hammer is swung or the first board is cut. Make sure everyone is on the same page so that there are no surprises in the end. Or at least as few a number of surprises as is humanly possible. And I don’t just mean talk to the lead contractor. Make sure you’re in conversations with every member of the team, right down to the guy whose job it is to sweep the floor at the end of the day. An important note here that needs to be mentioned. Oftentimes contractors prefer to be the single point of communication in a project, which means that they prefer you not go bothering their subcontractors with issues you might think are important. It’s important –— vital is not too strong a word — that you, as the client, respect your contractor’s wishes. However, you also need to remember that you are, in fact, the customer here, and if you want to talk to the electrician or the painter or the guy building the staircase, you’ve got every right to do so. Just make sure to go through your contractor first so that everyone is on the same page. Communication is a twoway street, and it’s just as important for you to respect your contractor’s wishes regarding communication as it is for him to respect yours. Speaking of two-way streets, this is the part where I explain my solution for the traffic issues that seem to plague us every summer. A job site is oftentimes a hectic, messy place to have a meeting where you hope to be able to hear yourself think, let alone talk. Between nail guns and table saws and radios, there’s enough noise inside a construction project to drown out even the loudest of talkers. I’ve got the solution for you, and I’m going to solve your parking problems while I’m at it. Get in your car and drive downtown. Now you’re all sitting there thinking that Andrew’s lost his marbles. Maybe the recession has finally gotten to his brain and he can’t think straight any longer. Or maybe it’s the winter taking its toll on him. But I digress. So, you’re driving downtown. And since you’re on Nantucket, it’s a small town where you oftentimes happen to see folks you know driving the other direction. With a little planning on your part, you can time it so that you and your contractor are driving in opposite directions on, let’s say, Washington Street at the same time. You see each other, and being the friendly types you are, you wave to each other. And because you’re on Nantucket, you can kick it up a notch. That’s right. Stop your car. Put it in park. Have your conversation right there in the middle of Washington Street, and if people behind you get a little irked, remind them that they’re on Nantucket and this “ain’t the mainland” and it’s a quaint little custom we have out here on the Island of Quaint Little Customs. And the beauty of this thing is if you just get out of your car, you can continue your conversation while you run the errands you need to run while you’re in town. And everyone behind you can do what they need to do, too. Everyone gets a parking spot and we didn’t have to build a parking garage. Problem solved. NEWS REPORT Alger, continued from page 1 she admitted recently. After all, her father was a lawyer, and Sarah was bound and determined not to work with her father. But a funny thing happened on the way to employment independence. “I had no idea what I really wanted to do when I grew up,” she explained. During her final year of college, she interviewed with a smattering of corporate recruiters who came to Dartmouth looking for investment banking analysts. “All my friends were doing it, so I thought about doing that. I’d only taken one economics course in college, though.” Wall Street didn’t pan out, so she turned her attention to teaching at a boarding school. “They made it sound so discomfiting,” she said of those interviews. She’d taken the Law School Aptitude Test — she admits today that she actually showed up late for the test — though she couldn’t exactly say why. “My parents didn’t even know I’d taken the LSATs,” she said. She did well on the test, and sent in an application to the Boston University School of Law. She was accepted and, “literally a few weeks before the school year started,” she enrolled. In Boston, she and her roommate took the first apartment they found. “There was a mouse shellacked into the floor,” she recalled. “And our upstairs neighbors – they had about 15 people living up there — would do their laundry in the sink, and the water would overflow and leak down into our kitchen.” Her first day of law school was equally inauspicious: “Everybody else had done all this work prior to the first day of school, and I hadn’t done anything. I thought I’d made a huge mistake.” But she plodded her way through the rigorous curriculum. “I enjoyed doing law,” she said. “I liked the practice of law so much more than school.” She spent some time during law school working in the Massachusetts Estate Tax Bureau in Boston, which was an experience that would later come in handy in her life on Nantucket. “I got a lot of experience dealing with estate taxes and a lot of experience dealing with governmental bureaucracy.” Sarah took a job after law school working for a small law firm in Boston; she’d vowed not to work on the Cape, where her father was a practicing attorney. She landed on Nantucket, ironically enough, on something akin to a dare. Her husband, Bruce, said to her that he bet she couldn’t get a job on one of the islands. Not one to be doubted, Sarah sent her resume off to several firms on the Vineyard and Nantucket, and local attorney Foley Vaughn decided to take her on. From there, she went to work with Arthur Reade for 13 years, and today is the legal genius behind the firm of Sarah Alger, PC. Many of us know Sarah from her other role as well — that of Moderator for the Town of Nantucket. It’s a position she decided to seek after a conversation with Fooods For Here and There owner Mark Arnold. Mark was, at the time, Moderator, and he told Sarah that he would not be seeking re-election. It was a position near and dear to Sarah’s heart, as her father had been the Barnstable Moderator during her childhood, and she’d grown up going to Town Meeting with him. “I loved going to Town Meeting,” she said. “I was the time keeper.” She ran for, and was elected to, the position of Moderator in 1997, and has held it ever since, dutifully rattling off the details of articles, information she readily admits her office assistant is responsible for putting together for her. She also calls on voters at Town Meeting, most of whom she knows by name, a fact I found astounding, given the number of people in attendance. “It’s actually because people tend to sit in the same seats every year,” she admitted. She is the President of the Board of Trustees of the Nantucket New School and has served on a variety of local boards. Up to three, 900-kilowatt wind turbines are expected to save the town $250,000 to $400,000 a year in electric costs to operate the digester at its Materials Recovery Facility, among other municipal power needs. The turbines would stand 350 feet above the landfill property, 194 higher than the high school’s turbine. Adoption of Article 44 allows the Board of Selectmen, acting on behalf of the town, to include wind energy generation as an additional use of the three lots of landfill property at 188 Madaket Road. The authorization to spend the estimated $7.2 million needed to make this project a reality is embodied in Article 45. Article 46 makes the use of this land for wind energy generation possible by creating a wind energy overlay district for the town’s three landfill lots. Not stopping at the landfill, the town is also eyeing three other sites for renewable energy generation. For the Nantucket Memorial Airport, Wannacomet Water Company (at Wyers Valley and North Pasture near the new water tower), and the Surfside Wastewater Treatment Plant, through articles 95, 96 and 97, the town is hoping to install four solar photovoltaic arrays for an annual savings of $285,530, $248,530, $231,420 and $285,530, respectively. Each of the four ground-based solar arrays would be capable of generating up to two megawatts. The solar arrays would be installed this year if these three articles were adopted at Town Meeting.

After it renovates the old police station at 20 South Water St., the town plans to move the Sheriff’s Department and all of its offices in the Mooney Building at 22 Federal St. into this former police station. To fund this renovation, 22 Federal, currently assessed at $2,503,000, would be sold. If Article 93 were passed, it would set that process in motion. If Article 94 makes it out of the discussion alive, it would then allow the town to sell, if it needed, another of its’ annex buildings at 37 Washington St. (assessed at $2,343,300). The town sees it as a means to bring in an estimated $1 million or more for general fund expenditures, while homeowners and realtors who represent them fear the new tax could further drive away an already dwindling tourist market. “I think rents are already being besieged because of the economy. You can’t just tack something on and pass it along,” said David Callahan, a principal of Jordan Real Estate and President of the Cape Cod and the Islands Association of Realtors. “Rates for rentals have come down. Some homeowners who bought knew they could get revenue, but to take another six percent may make their properties unaffordable to make ends meet. “Nantucket is already an expensive place to visit and people will be hit again. We are killing the goose that lays our golden egg. We can’t just keep taxing people and expect them to keep coming. I realize the town needs more money to spend, but tourism is our number one economy. You can’t keep sticking it to those people.” Cindy Lenhart, owner of Compass Rose Real Estate, echoes Callahan’s and others’ opinions. “I object to the whole idea for a lot of reasons. The rental business has really softened. We used to have a lot of middle class working folks that came here on vacation, but it became out of reach — the cost of the ferry, the cost of eating out, the cost of rentals,” said Lenhart. “If you add a six percent tax on top of what they’re paying it adds to the killing of the goose. The big thing is the rental of a private home can’t be compared to a business. The homeowners don’t make money; it only defrays the cost of ownership. For the majority who move out for the summer, it barely supports their payments. “There is a human cry to raise money for the town, but I don’t think this is the way to do it. It’s on

Similarly, Article 49, is designed to enhance the residential-only feel of nine properties along Miacomet Road by plucking them out of their RC-2 district — which is zoned for 5,000-square-foot lots — and changing their zoning to Residential-20. The Article 31 Home Rule Petition seeks to charge up to six percent of the total rent for occupancy in a seasonal rental property or other such transient accommodation, including residential properties, which are let for 90 days or less. The six percent from private renters would go to the town with a portion deposited into the general fund for fire, police and other residential services and a portion allocated to cover costs for the Visitor Services Bureau. While island innkeepers do not reap any direct monetary benefit from the six percent they pay to the town, Visitor Services is a tool of the lodging industry by providing promotions and information about local commercial lodging establishments, said Kopko. That return does not and would not apply to privately rented properties. Kopko also explained that the federal tax exemption given homeowners who rent for no longer than two weeks at a time would remain in effect, and that no town oversight in the form of a lodging tax office or the like would be required for the new fee. Charles Stott, President of the Madaket Homeowners Association, said a quantity of its members rent their homes for two to three weeks a year to help with mortgage payments and assert that charging an extra six percent will make it more difficult to rent at present prices and may cause people to lower the rent to keep costs level. “It will be harder on the tenant, and it is exacerbated by the recession,” said Stott. “It could affect the overall rental economy which has dropped in
past years.” Penny Dey, co-owner of Atlantic East Real Estate, and Ken Beaugrand, owner of Nantucket Real Estate, which this January joined as one office, added their objections to the article. They focus mainly on its financial impact for homeowners and poor timing in imposing another expense on “the lifeblood of our economy” while the nation’s economy climbs slowly back to prosperity. Bill Liddle, a broker with Great Point Properties, said he believes the article might gather more support in the future, not now when people across all strata all still struggling. “This remains ill-timed,” he said. “It was voted down last year and I wish [the town] had waited a little bit longer for the economy to get better, but they didn’t. I feel the advocates of the rental occupancy tax want to portray the home rentals as a business. It is not a business because the occupancy rate is so low and the cost of ownership is far greater than any revenue you can generate, opposed to an inn where you can effectively market and rent in the shoulder seasons along with the holidays.” Although no Massachusetts towns have instituted this locally based tax, several have passed Home Rule Petitions and await legislative approval. No new taxes can be introduced without the approval of the state legislature, and all past attempts to do so in this area, at the state level, have been defeated.
