If a Tree Falls in the Forest ...

f nobody is around to hear a tree falling, does it still make a noise? There’s a philosophical question for the ages. It begs the question as to whether or not sound requires someone to hear it for the sound to exist. More importantly, if you call your dog and she doesn’t do what you tell her, does that count as sound? But I digress. My car was recently parked in town in a place that I figured was relatively safe. I did what I had to do and, upon my return, found a note in the front seat from a very nice woman who apologized for having hit my front bumper and gave me her phone number. In addition to restoring a huge amount of faith in at least one member of humanity, it brought to mind the idea that there are things that happen to us, regardless of how well we might plan, that don’t necessarily fall under the rubric of “good things.” Someone bumping into your car while it’s parked is one such thing. The thing about the “accident” was that I would have never known there had been any incident whatsoever had she not brought it to my attention. And that’s the thing about a lot of issues that come up: If nobody tells you it happened, do you really notice? It’s kind of like that whole tree falling but nobody hears it thing. Case in point, consider the current Cliff Road bike path debacle that we’re living through. For the uninitiated amongst us, let me explain. There’s a bike path that goes out Cliff Road, in case that much wasn’t obvious enough from the first sentence, and there have been plans in the works for quite some time to extend it further east. That plan came to fruition recently, as a trench was dug and asphalt was laid. The only catch is that there are a few telephone poles in the middle of the path. So be mindful if you’re pedaling that way. The official party line is that the premature laying of asphalt was designed to spur the phone company into action, as they’d supposedly been dragging their corporate feet in terms of getting the poles moved. The logic — odd as it might sound — was that by putting the asphalt down around the poles, it would get the phone company to move them, so the asphalt company could relay the asphalt. Logical fallacies aside, there’s a point here. Let’s fast-forward a year or so, say to the summer of 2013. Assuming we didn’t all evaporate into thin air in 2012, we’ll probably see a pretty smooth, pole-free bike path that runs from Sherburne Turnpike out to the Madaket Road. If we’re lucky, there will be no evidence of telephone poles ever having been in the middle of the path, much like there’s pretty much no evidence of anybody ever hitting the bumper on my car. So basically if a tree falls in the forest and you’re not there to hear it, it probably still makes noise. But it doesn’t matter as far as you’re concerned, because you’re not there to hear it. The same holds true for just about all house-related projects, believe it or not. Buying or selling a house is a tricky game. There are legal issues at every turn, which is why doing it yourself is such a difficult prospect. How do you avoid falling into one of those deep legal holes? Hire somebody who knows what they’re doing to take care of the whole process for you. Find a Realtor and wash your hands of the process. Let them handle the issues that come up and just do what you’re told. Things will progress much more smoothly that way. And then there’s construction. The easiest way to delay a construction project is for you, the non-contractor, to get involved. You hire people to do the job, one assumes, because you like the examples of work they’ve done or they because they came highly recommended or because you trust them. Or maybe you have some other entirely different reason. It doesn’t matter. You’ve hired people to do a job, so let them do it. And rest assured, things will come up. Issues will arise. Problems will rear their ugly heads. But again, you’ve hired people to do the job, so let them. Part of their job description is dealing with the problems that come up, and when you take it upon yourself to get involved, you delay the process of righting the wrongs and getting the project completed. Nantucket, as I keep telling you people, is blessed with an abundance of professionals who know the whole real estate-related game – whether it be buying and selling, building or renovating – so let these people do their thing. What you don’t know won’t hurt you, believe it or not.

NEWS REPORT 8 Pine, continued from page 1 married Eunice Starbuck, daughter of Nathaniel and Mary Starbuck, who, according to the Nantucket Historical Association, led the Quaker movement on Nantucket. The Nantucket Meeting gathered for its monthly meetings for a time at 10 Pine Street, the so-called Parliament House. Upon George Gardner’s death in 1750, the house passed to his son, Grafton Gardner. It later passed to Grafton’s son, George, who was a mariner and justice of the “inferior” court, according to the HABS report. The latter George died in 1785 when “something fell from the mast and struck his head,” according to the report. In 1790, tailor Paul Pinkham bought the property. Paul Pinkham Jr. sold the home again in 1795 to mariner Christopher Buck. Buck’s ownership lasted until 1819 when for $850 he sold it to a “trader” named Elizabeth Black. Black bequeathed the home to John Folger, a house carpenter, in 1831. Folger kept the home until his death in 1871 when his grandsons sold it Phebe M. Swain. Swain and her husband, Joseph, sold the home months later to Mary F. Austin. The Austin family retained the home into the 20th century, when Sarah Lawrence acquired it in 1922. In 1943, Margaret Yates Berkheimer bought the George Gardner House, which she owned until her death in 2009. In 2010, Berkheimer’s estate sold the house to Richard and Nancy Scott of Pittsburgh, Pa.

It’s one of the few remaining examples of a gambrel-roofed home from the 18th century, and it’s notable as well for the details within its walls, including its paneling and kitchen, according to the HABS report. Thanks in large part to Berkheimer, the house’s historic features will per-
‘Wow. This is huge.’ I was just in awe.” Eventually, the family relocated to Dorchester, Mass., where other Polish immigrants helped them lease an apartment. Their furniture and toys came from The Salvation Army and through donations. Magdalena’s father had been a truck driver in Poland, and found a job driving in the U.S., traveling back and forth across the country while her mother raised the girls and they learned English in school. Tradition and heritage were important to them, so the family always spoke Polish when at home, and with one another. The girls spent summers with relatives in Poland to maintain their connections and native language. The family’s next move was to Burlington, Mass., where Magdalena graduated from high school. She spent some time at college, but having a natural affinity for work and leadership, decided to begin her career. She entered the retail industry with a shoe company and became a vital part its management team in her first year. On Cape Cod, Magdalena met someone with family on Nantucket, and 10 years ago they moved here. Her first island job was with a T-shirt shop downtown, which she described as a perfect entrance to Nantucket life.

sist. In 2005, she placed an easement on the house, which covers the entire exterior, the floor plan and interior details including woodwork, hardware and doors. The easement is administered by Nantucket Preservation Trust, which in 2010 posthumously bestowed Berkheimer with its John A. and
“That was a great way to meet people and a great introduction to the island,” she said. By the end of that first summer, Magdelena desired a more permanent position and was hired as a teller at Nantucket Bank. She found the work more challenging than expected. “Banking was new. It seemed like something I could do, but it wasn’t as easy as I thought it would be, initially. There is a lot more to a teller’s job than people think. It looks simple when you’re on the other side.” Her job location shifted from the Orange Street branch to the office on Amelia Drive. That is when she met Phil Stambaugh, who, while adept at many things, is not so good at retiring. Magdalena knew Stambaugh planned to leave Nantucket Bank as its Branch Administrator and go on to be Regional Manager for the new island extension of Cape Cod Five Savings Bank. She saw opportunities for her with CC5, as well. “Once I learned more about Cape Cod Five and their commitment to their customers it was something that resonated with me,” she said, seeming quite relaxed behind her desk as Branch Manager. “I like to be part of a community and be part of an organization that gives back.”
Katherine Lodge Stewardship Award. Berkheimer, who wrote two detective novels including “Widow’s Walk” in 1945, which was set on Nantucket, lived in Manhattan and spent summers on Nantucket. According to her obituary notice in The New York Times, she held degrees from Sarah Lawrence College and the Columbia School of Journalism, and served in the Office of Strategic Services, the U.S. intelligence service, during the second world war. Active on Nantucket, she held a keen interest in the island’s history and its architecture. “Margaret did one of the best things you could do for a home by placing the preservation easement on it,” said Michael May, the trust’s executive director. “It had been her family’s home for many years, and she wanted to make sure it was preserved beyond her ownership.” Although alterations to the home are less likely now, there have been changes to the property in its relatively recent past. In the 1940s, Sconset architect Frederick Hill built “a very sensitive addition” to the house, May said. The HABS report notes the erection of a chimney and the creation of the Pine Room, formerly a shed, and the restoration of a large fireplace. Those modifications reflect the changing needs of the various residents of the George Gardner House. Yet, with its preservation easement and its steward-owners, the house enters its 26th decade as a physical reminder of the past and a continuing embodiment of its tradition as a family home. It remains and will remain, as May says, “a rare timepiece.”
When Magdalena has free time she most wants to be with her seven-year-old son, Jacob — who plays Little League baseball — walking their dog and simply enjoying Nantucket. “I love spending my time on Nantucket. I just feel very fortunate to be here. The people I deal with on a day to day basis on Nantucket make my day.” Magdelena’s sister currently lives in Boston and her mother works in Norton, Mass., but her dad moved here two years ago. He helps care for Jacob when Magdalena is working. “I’m so glad that he’s here,” she said. “You don’t realize how much you miss having family near until you have a child. [My success] all came from the courage my parents had to keep pushing and pushing.” It took barely a second for Magdalena to respond to the question of whether she is fulfilled in her life right now. “Very,” she said, looking forward to taking Jacob to the community’s Memorial Day parade. Mary Lancaster moved to Nantucket 40 years ago after spending several years as an advertising illustrator in New York City and Connecticut. Her 24-year journalism career includes work with the Inquirer & Mirror, The Nantucket Beacon and The Nantucket Independent. She currently works as a freelance writer.

About half, or nearly half. That’s the usual estimate for how much of Nantucket is protected through conservation. The figure may vary, but what doesn’t is the fact that a substantial portion of the Grey Lady will remain exactly how it is

or such a small place, there’s a surprisingly large number of groups working in cooperation to safeguard the island’s treasured resources – the Nantucket Conservation Foundation, the Nantucket Islands Land Bank, Trustees of Reservations, the Nantucket Land Council, Mass Audubon and the Sconset Trust collectively protect close to 15,000 acres.
“There’s almost no greater gift to Nantucket than the conservation movement,” said Bob Felch, executive director of the Sconset Trust. “Conservation is something Nantucketers of all stripes can be proud of.” BALANCING ACT
In addition to conservation, Nantucket faces the reality of ensuring its economy develops in such a way that the island remains a place where people can and want to live. Removing swaths of developable land from the real estate market,
however, doesn’t preclude that goal. In some ways, it enhances it. “People come here for the quality of life because there is protected land,” said Jim Lentowski, executive director of the Conservation Foundation, the island’s largest conserved holder. For Andrew Vorce, the director of the Nantucket Planning Office and the Nantucket Planning and Economic Development Commission, striking the balance between conservation and growth has much to do with working with what’s already there. “We’re trying to build with what’s already occurred,” Vorce said. “If, for instance, there’s an area with existing commercial activity, we try to encourage expansion in that area without establishing the activity in new places.” The town’s Master Plan, which was approved by Town Meeting in 2009, encourages smart growth and careful management of resources. HOW MUCH IS CONSERVED? About half of Nantucket is conserved, but the figure varies depending on who you ask and how you define “conserved.” Nantucket Planner Andrew Vorce puts the figure at about 60 percent based on the Assessors Department records of exempt properties, which include parcels owned by groups such as the Conservation Foundation and the Land Bank, and publicly owned parcels such as cemeteries and airport runways that are unlikely to be developed. Eric Savetsky, executive director of the Land Bank, said the conservation community believes the number to be 40 percent to 45 percent “that’s truly protected open space.” The Conservation Foundation, in its literature, puts the figure at about 45 percent of the island’s land area. The figure here – about 49 percent – comes from adding the acres held by the Conservation Foundation, the Land Bank, the Land Council, Trustees of Reservations, the Sconset Trust and Mass Audubon and dividing that by 30,600 acres, the island’s approximate land area based on the 2000 Census. Perhaps oversimplified, the figure still sits in that “about half ” estimate.

“You have to encourage growth in your community, but, wisely, not allow sprawl on every square inch of the island,” Vorce said. “There need to be areas for businesses, young people, music and noise, and all the other things that keep Nantucket going, but there are other areas where no activity should go on. The balance has to be there.” OPEN MARKET
Many of the island’s conservation groups contend with another balance: between what properties they wish to protect and what properties they can afford to protect. While donations have fueled much of the conservation movement’s accomplishments, especially in its formative years, rising land values and a troubled economy have recently combined to make obtaining land a more difficult proposition. “We’re less into land acquisition now and more into land management,” said Lentowski of the Conservation Foundation, which has protected nearly 8,900 acres since the organization was founded in 1963. Major purchases remain a reality, but millions of dollars must be raised to compete in the island’s real estate market. When the Conservation Foundation made the decision to buy the University of Massachusetts Field Station six years, it had to set about raising $22 million to pay for it. The Conservation Foundation isn’t alone in making big buys. The Nantucket Land Council paid $14 million in 2007 for conservation restrictions — negotiated easements where a group holds a certain right to a property — on the 270-acre Linda Loring property on Eel Point Road. In 2009, the Nantucket Islands Land Bank, which draws revenue from a 2-percent fee on most real property transfers, spent $5 million on a 1.4-acre property on Orange Street and $4 million on a 13-acre property on Polpis Road. The Land Bank must contend not only with high land values but also with a slow real estate market. A more

active market means greater revenue for the Land Bank. The current market means “it’s now where we really have to carefully pick and choose, and know that we can’t do everything we want to do,” said Land Bank Executive Director Eric Savetsky. No group was immune from the recession, which left land and restriction acquisition “somewhat stalled,” according to Cormac Collier, executive director of the Land Council. Activity has picked up recently, but “the recent downturn has made people re-think about their property assets on Nantucket and potentially have that as a fall-back position,” Collier said. Slowed but not stopped, the Land Council was in June nearing the completion of purchasing Muskeget Island for $100,000, which it was buying in conjunction with the Town of Nantucket. PROTECTING ‘CHARACTER’
Regardless of the size of a property, the cost of its purchase or the type of conservation restriction on it, the goal is common: to protect Nantucket as it is. That extends beyond dirt, sand and trees and into a more abstract idea of “character.” The Sconset Trust, which grew out of the Conservation Foundation in 1984, has as its mission to preserve the character of Sconset. That means purchasing 84 acres, but it also means purchasing Sankaty Head Lighthouse in 2007. Were it to have lost the lighthouse, Nantucket would have lost an icon. In a similar way, the Land Bank has developed a niche in protecting open spaces with an emphasis on public use and public access, especially to the waterfront. Trustees of Reservations, likewise, ensures public access on the more than 1,000 acres in the Coskata-Coatue Wildlife Refuge, which was established in 1974 through a series of gifts from landowners. Again, a balance is sought between use and protection.

“The owners never wanted to restrict public access, but the area was in need of management as use was increasing (in the 1970s),” said Diane Lang, property manager at the refuge. Just as conserving Sankaty Head Lighthouse protects Nantucket’s character, so does preserving Coskata-Coatue as a place for fishing, beach-going, and recreation in a managed wildlife refuge.
Several groups — including the Field Station, the Maria Mitchell Association, and Mass Audubon — have formed the Nantucket Biodiversity Initiative. The initiative serves as an umbrella organization that works with the Land Bank to manage invasive species, according to Ernie Steinauer, a plant ecologist and sanctuary director for Mass Audubon’s 875acre Sesachacha Heathlands Wildlife Sanctuary.

GROWTH POTENTIAL
While conservation encompasses more than the land itself, ecological protection remains at the forefront of the movement. This is especially true on Nantucket where relative isolation from the mainland presents researchers and the non-scientificallyinclined alike with precious — and sometimes unique — habitats, flora and fauna. “Nantucket is the perfect laboratory,” said Sarah Oktay, a chemical oceanographer and managing director of the UMass Field Station, noting that nearly all of the world’s sandplain grasslands habitat is found on Nantucket.
So if nearly or about half the island has been protected, what’s left? The answer, in terms of undeveloped parcels, isn’t much. Citing Assessors Department records, Vorce of the Planning Office and the NP&EDC said vacant parcels account for 7.8 percent of the island’s land area. Based on the size of the island – about 30,600 acres, according to the 2000 Census – that 7.8 percent translates to about 2,400 acres. As a guess, Vorce said he imagines that land will “probably end up split 60/40, with 60 percent open space and 40 percent developed.”
Savetsky at the Land Bank sees conservation holdings growing, as well. Pegging the figure of “truly protected open space” at 40 percent to 45 percent, “in reality, it might creep closer to 50 percent” in the future. But, he said, “the cost (of land) is so high that it makes it difficult. It’s going to take a lot more effort” to conserve land. Still, there are large properties available or ones that could become available, including the 190-acre Coast Guard’s LORAN station and 120 acres on Milestone Road in Sconset. Whether such parcels will end up in conservation remains to be seen. “A common comment is, ‘We’ve had enough of conservation. Do we need more?’ And I would say, ‘Yes,’” said Felch of the Sconset Trust. “There are some large parcels out there in undeveloped areas that absolutely should be conserved. Competition is fierce among sellers. It is a buyer’s market. What is the successful seller to do?
