ave you had a chance to go through your notes you took at the recent convention seminars in Hartford? Have you ordered a new tool or tried different materials you saw at the trade show? Hopefully, after you thawed out from that freezing weather, you diligently began to incorporate some of the ideas you learned at the convention. It’s easy to absorb all the new information, but it’s sometimes hard to implement them once you’re back home with all the other distractions that take place. My business life has been a whirlwind since the first of the year. Just before the Hartford convention, I was the host for my Management Information Exchange (MIX) group. That entailed sharing my future short term and long term goals and being prepared to show all aspects of my business to others in the group. Believe me, while it can be hectic and very exhausting, this group review is probably the best tool I have for getting things done. It holds me accountable when a group of my own peers is my own board of directors. This type of structure that I have learned will also help me in regards to our board of directors and staff as we move forward. Springtime for me and my business has always been the time to rejuvenate and make changes that will hopefully help things run more efficiently and add value to our services for the rest of the year. It’s that time of the year in regards to NCSG as well. By the time that you read this, I will have led my first Annual Planning meeting. During this meeting, the board gets to do some brainstorming for new ideas to better facilitate goals. We also revisit the prioritization of the goals that were set at past meetings. In this fast-paced life we live, it can be challenging to keep up with the most useful technology available. I’ve always been one to wait awhile to adopt new

Moving Forward

technology. A good example is that I’m still sporting a flip phone; but hey, I just learned how to text with it. Technology has come a long way since the sweep days of just a pole and brush, shop vac, and a smile. One of my good sweep friend’s tagline reads “New World Technology, Old World Traditions”. While there’s nothing wrong with remembering our roots and the principles and foundations that have done us well over the years, we must always strive to do better and to better serve the public. Just a few examples of recent technology growth: • GPSs in the trucks to enable quickest routes, track employees, establish job arrival times, etc. • Laptops in our trucks with wireless printers so technicians can establish condition reports and proposals before they leave the client’s property.

• Smart phones that can download documents and can transmit them to and from the office or swipe a credit/debit card. And all that information integrates with the software back in the office to reduce duplication of information. • Digital cameras and internal scanning devices that you can send up a flue or dryer vent • Rotary tools that sweep a flue spotless and a vac that keeps the client’s home dust-free. • The list goes on and on… You should have received a recorded message from me on your phone recently. If you are like me, you receive a number of solicitation calls, surveys and political messages each week, and it can get your guard up at first when you hear a recording. I hope my message was well-received. It’s just a gentle reminder that we are working diligently for you, and striving to keep the membership engaged. Tentative plans are to have each regional director send a phone message from time to time to provide you with an NCSG “state of the union” as well as any regional updates in your area. Just one more way, to help establish communications, and to remind you that the Guild is here as a resource for you. We have also introduced a new phone system to get help from the Technical Advisory Council. When you use the central phone number, you will be prompted to choose the appropriate category for your question. The system will enable us to track

the number of calls each month for each category so we know where the most help is needed. Being able to determine the categories of your questions will give us a better understanding of your technical needs. We have started once again contacting existing sweep companies that are not presently members to extend an invitation for them to join us in our industry growth, communications and director benefits. While it is NCSG’s duty to take care of its members, and to promote the hiring of a professional chimney sweeps to homeowners, it is also our duty to promote growth of the industry. Today, for me was a wonderful day. We had a beautiful cool morning, spring gobblers sounding off in the woods and boats on the lake. A chimney sweep in Florida? Yep, it has its benefits. Hopefully, if you reside in the snowy northern climate of our great country, you are now seeing a break from that weather and your clients are ready for their spring work they pre-scheduled. Be sure to mark February 15-18, 2012 on your calendar for NCSG Innovation 2012 in Orlando, Florida. Come learn some more new ideas, meet friends and join in the educational experience. Sweeps luck to you and your family, and God Bless. Jay K. Walker

his month’s issue is a very special issue for NCSG and for the industry. There is a great chance that you will learn something new about the Guild in this month’s issue, regardless of if you’re a current member or a future member of the organization. Jay Walker, NCSG’s new President highlights the state of the industry as he takes time to reflect upon renewal that comes with springtime. In this month’s Chimney Sense, Dennis Dobbs takes a moment to remind us of simple ways to advance our professionalism on the job site. We introduce you to the Guild’s volunteer board members and to the entire lineup of membership benefits and to the state guilds and associations which support the industry on the local level.

discussion list or by calling a regional director to chat. If you’re looking for new ways to get connected, give us a buzz at the Guild office. We can help you learn more about the benefits of membership, including volunteer opportunities which help you network with your peers from across the country. Volunteering on a committee is an excellent way to get connected and it doesn’t necessarily mean a huge time commitment.

If you aren’t active within the industry, we encourage you to reach out to your fellow sweeps by attending a state guild meeting or by connecting with NCSG members on the NCSG

All the best,

Enough from me for now, let’s get to this month’s issue! Many thanks to everyone who contributed information to our advertisers who support the publication and the organization and to you, our members and our readership! I hope you enjoy this month’s issue!

Technical Q&A

Q

DENNIS DOBBS, NCSG TECHNICAL ADVISORY CHAIR

I have a potential customer who only wants a top-mounted damper. Do you see any problems with this?

A

Absolutely, I do. Before installing a top-mounted damper on any chimney, a Level 1 inspection is a must. A partial Level 2 could also possibly be required. Flues which serve an open fireplace can sometimes have hidden elements of surprise like other appliances vented into the same flue. A few that I’ve seen over the years are gas furnaces, water heaters, wood burning stoves in basements and, the most surprising, dryer vents. Top-mounted dampers can sometimes be a

quick and simple fix. We must remember that we are not replacing a throat damper; we are altering the damper’s location which can cause carbon monoxide issues. We are professional chimney sweeps and any time we are at the chimney top, it is our obligation to our customers and to ourselves to thoroughly check the chimney. This could ultimately save someone’s life and prevent problems for our business in the future.

Chimney Sense

BY DENNIS DOBBS, TECHNICAL ADVISORY COUNCIL CHAIR

Professionalism: the Best from the Rest

I

have met many talented chimney sweeps that have great abilities. You would think that by being a competent sweep your business would be growing at a rapid pace, with phones ringing and the calendar full year-round. This may not be the case. Some sweeps have all the know-how, all the right credentials but for them business is always a struggle. What they are lacking may be

1-800-735-5272 www.continentalindustries.com scouse@continentalindustries.com

12 SWEEPING MAY 11

professionalism. Professionalism comes down to two words, projection and perception. Whether we realize it or not we all project an image to the consumer. Professionalism starts with the customer’s perception of your business. Sometimes, when it pertains to advertising, just stating what we do may not be good enough. Advertising is the window to your business. By giving your business an identity, you can help it stand out from the rest. Classic examples of this would be the Lennox man, Ronald McDonald and the Aflac duck. All three create visual notoriety to their perspective businesses. Service vehicles are one way that sweeps project the image of their businesses. I’ve seen a range of service vehicles from pickup trucks with the open bed piled full of vacuums, ladders and brushes going down the interstate with no business name on the side, screaming “fly by night” to the most impressive wrapped vans and trucks which project a professional image but also double as a rolling billboard. Vehicle signage is a must for the professional sweep. Customers see your vehicles as part of your business identity. Some recognizable vehicles are UPS, Ryder trucks and Coca-Cola. When we see their colors, we know immediately which businesses they represent. Keeping your vehicles clean and organized also helps with your image.

One of the most important aspects of a professional business is how the phone is answered. Preferably this should be by a real person who is courteous, knowledgeable, patient and up-beat with a clear voice and a good sense of direction. This person is the voice of your business. First impressions are very important. Consumers do not like being put on hold for extended periods of time, constant busy signals or talking to someone who seems to be lackadaisical. Consumers want to know your costs, your procedures and your time of arrival. By the way, if your business must rely on an answering machine or voicemail, the most effective greeting is always one that is well-scripted. Now for the three A’s: Actions, Appearance and Attitude. These usually go together. Be aware that homeowners are anticipating your arrival and are often watching their driveway. Just the way you or your employees pull up to the customer’s home says a lot about your business. Be as respectful to the home’s grounds as you are to its interior. Examples of some things that are frowned upon: parking on the manicured lawn, thumping your cigarette into their grass, leaning your ladder against the gutter, sitting in the truck talking on your cell phone for a extended period of time and tucking your shirt in on the way to their front door. Dirty hands and shoes and no uniform can also be a turn off. Good personal hygiene is also a big plus; customers do not want to smell you before they see you! A kind and courteous introduction is important. Also, interaction that your customers notice between you and your coworkers is just as important as your interaction with the homeowners themselves. Never talk down to either and remember that whispering among the technicians can cause wariness. Using clean equipment, drop cloths and rug runners shows that you are being mindful of your customer’s home and that you take pride in what you do. Being respectful to the homeowner and competent in your abilities will encourage confidence and trust in your business which helps with the perceived value of the services you provide.

Professionalism stems from projection and perception. I’m not trying to reinvent the wheel. I know this information is not new. Take a long look at what has worked for many successful mainstream service companies in your area such as pest control, electrical contractors and satellite providers. Researching successful service businesses and their operational procedures may inspire all of us to become better at what we do. Remember, when on the job doing “just enough” may not be enough, professionals strive to excel. This separates the best from the rest.

Meet a Board Member Prior to the board elections each year, we introduce you to your slate of candidates by running brief biographies. This month, we’re taking that a step further by introducing you to your current NCSG Board of Directors in a less formal twist on our monthly Meet a Member feature. Each board member was asked to share a little about themselves and their businesses before answering a few questions. Here are their responses:

President and Region 3 Director: Jay Walker

Vice President and At-Large Director: Diane Pilger

Born 1961 in Tallahassee, Fl. Swept his first chimney in 1981 while employed by another company (All Service Industries, Inc.). Opened his own sole proprietorship, Jay Walker Enterprises, in 1991. After incorporating in 2001, Jay Walker Enterprises, Inc. hired employees to help grow the business.

Chief Chimney Services is a small family owned and operated chimney service. My husband John and I started the business in 1986, just before the birth of our first daughter. It is located on Long Island in New York State. We have a small off site office in which our daughter works.

JWE, Inc. now employs three certified technicians, and one office employee. Jay serves as CEO and operations manager and is a certified technician as well. Operations consist of sweeping and repairs, inspections, dryer vent delinting and repair and exterior washing services. JWE, Inc. has also moved into more retail sales (woodstoves, gas dv inserts, etc). Though no commercial walk-in type retail store, clients can visit the office site (by appointment only) to inquire about a retail purchase. How many years did you work before you really were convinced that your business could support you? – David Doherty in Syracuse, NY Within 3 years in business and a lot of hard work and living very economically, I was at the stage of having no debt (paid off mortgage and vehicles), therefore it was at that time I felt more comfortable moving forward and striving to grow the business. After many years of staying the same, it wasn’t until becoming a NCSG member and CSIA certified, that my eyes opened wide and saw the opportunities available... Then to take it one more step - the best aspect to grow the business is my MIX Group involvement of having a board of directors and being held accountable with my goals.

14 SWEEPING MAY 11

My husband John, our employee and myself are all CSIA Certified Chimney Sweeps. I have been a CSIA Certified Sweep since 1998 and I am out in the field almost daily. Our business is comprised of mostly sweeping, relining and masonry repairs. I have been on the NCSG Board of Directors since 2006. I am chair of the Bylaws committee, Site-Selection and I am a member of the CSIA CEU committee. I have presented several seminars related to Government Affairs at past conventions at both the National and Regional level. Time to hold the National Convention in Maui. Hawaii? “Tiny bubbles, in the wine, make me happy, make me feel fine…!!!” – Kekuhaupio “Keku” Akana in Maui, Hawaii I would love to see the NCSG Convention go to Maui, Hawaii. However, there are many elements that go into convention site selection and planning, from finding a suitable venue to negotiating dates and rates, shipping, etc. It would also be cost prohibitive to many members, exhibitors and the organization to take the NCSG Convention to Hawaii. Not to mention the logistics of relocating the Indianapolis office there would be challenging to say the least.

Treasurer and Region 5 Director: Mark Maynard Mark Maynard is the Operations Manager of The Chimney Guy, LLC in Menasha, WI. I have been a chimney sweep for 20 years. I am the founder of The Chimney Guy, LLC which started in 1996. Over the years, the business has grown from a husband/wife team of chimney sweeps to a multi truck operation with a small retail showroom. We presently employ 4 full time employees and 2 part timers. I have presently served on the BOD for the NCSG for 3 years as the Region 5 rep. In the past, I have sat on multiple committees for the guild. I also have held all of the executive positions for the Wisconsin Guild of Chimney Service Specialists over the last 10 years except Treasurer. I have a wonderful supportive wife and family who keep me driven. What is the single most important thing that you learned from the NCSG that had a big impact on your business? – Joe Sauter in Indianapolis, IN The NCSG has done so much for our company that I couldn’t single out just one. The networking opportunities are awesome between convention, MIX group, NCSG list, and everything we participate in. The technical support is just a phone call away. The benefits package offered… coupons, liability insurance, product discounts, educational discounts. I think the biggest thing is – if you don’t belong, you are missing out on the single most important opportunity to make your business successful.

Secretary and Region 1 Director: Phil Mitchell I started my business as a part-time venture in 1980, a student of the College of August West and Mother Earth News. I worked an evening shift and slowly built the business to a point where I could take it full time in 1991, which is when I joined the NCSG. My youngest daughter would often accompany me in those early years and would be entertained by my client while I worked. I still have people ask for her. She is 29 now. I now employ an office person and one certified Sweep. We focus on sweeping, minor repairs and limited relining. Forward scheduling has allowed us to start spring with a full schedule and run right into January with a solid calendar. As Region 1 director, I am enjoying talking with constituents across the region and getting a pulse on business practices and climate. I hope to be able to continue to get out and meet with members on an individual basis. Recently I have become Secretary of NCSG and Government Affairs Chairperson. With such great resources and the camaraderie that goes with it, I’d like to ask if they’re a member of their local Guild and if not why? – Jeanmarie Jacobson in Kingston, MA MAY 11 SWEEPING 15

Belonging to a state guild for me is a relationship thing. I have been able to meet sweeps on a more local level and form longlasting friendships, which have provided me with many valuable net-working opportunities and the chance to work closely with NH sweeps to accomplish projects. In the past our state guild has sponsored some great educational workshops and events. To be involved at the “local” level brings a strong sense of ownership to the mix.

Region 2 Director: Bob Fleer I started my business, like many of us, after reading the Mother Earth News article in 1979. I came from a business background with marketing knowhow and I applied this to my new “craft”. At first it was just me as CinderFella Chimney Sweep. In a short period of time I met another sweep, David Liddle, and we formed Complete Chimneys Inc. Dave has moved on to do other things within the industry, and we still stay in touch. Complete Chimneys has six service technicians. We offer sweeping, relining, duct cleaning, gutter cleaning and replacement along with installing gutter guards. We sell and install several lines of wood and gas appliances and the usual array of hearth accessories. Most recently we have become a HeatShield dealer. The office is staffed by one full

time and a part time employee. At this time we do not have a store front, not sure in this economy. Do you have a growth goal for your business in terms of size… Number of trucks, employees, etc. and why or why not? – Eric Bereta in Lombard, IL Eric these are some good questions. I am making a few small changes, adding another truck this year, this will put 5 on the road. We have outsourced some work in the past but the new sweep has the skills so we will keep some of this work in house. I would like to grow about 8-10% this year, and I feel it is possible with the housing market moving as it has. Going through the warehouse more and more looking at the inventory is helping the bottom line.

Region 4 Director: Marge Padgitt My company is a chimney contracting business. We offer design and building of masonry chimneys and fireplaces, masonry heaters and bake ovens. We also reline and repair/rebuild chimneys, and do chimney sweeping and inspections. We specialize in historic restoration work and do large government projects. We also do forensic investigations of structural fires caused by chimneys,

fireplaces or heating appliances, and expert witness testimony nationwide. I write books on chimney-related and other topics, and am the author of The Chimney and Hearth Pro’s Resource Book and am currently working on The Complete Guide to Chimney and Fireplace Restoration. I am also working on a film project with instructional DVD’s for chimney professionals. I love the chimney business and the camaraderie I have with others in the industry. How can we raise the awareness of the public to regard Chimney Professionals as elite fire protection specialists instead of Dick Van Dyke? - Jake Cromwell in Springdale, AR While I don’t feel that Dick Van Dyke is a bad representative for our industry (he has a more serious image after doing the show Diagnosis Murder) I do think that a good alternative would be a high-profile safety-related person such as the president of the National Association of State Fire Marshals or Ralph Nader.

At-Large Director: Jeremy Biswell The Flues Brothers Chimney Service is a chimney sweeping, inspection, repair and installation business. We have three full-time staff and two part-time. We utilize an accounting firm for our bookkeeping and tax filings and also

network with other sweeps in the area on jobs. We have been around for over a decade (10 years for those who are counting). We do own a building, but do not have a hearth shop. I started this business with no experience. I attended the National Chimney Sweep Training School when I started. There I learned the technical aspect of the business. I met Bart Ogden and his wife, Lesa, who was also taking the class. I made friends and visited their business each month for approximately the next two years learning the in’s and out’s of this business. Bart is still a big part of my business structure. We are supporters of the industry. I have been serving on the NCSG board of directors and CSIA committees. My wife volunteers at convention. We have 2 children, Noah and Hailey. Life is good. What have you done with your business that has made the most impact on your success? – Michael Schock in Pittsburg, PA I have taken as many classes as the CSIA has to offer. I fully use every convention I attend to network and learn from other sweeps and classes that are offered. We also use Dave Ramsey’s finance principals at home and in our business.

Joy is a CSIA Certified Chimney Sweep, former board member of Jackson County Development Corporation and Certified Fire Fighter National Academy. He is a former CSIA CEU Committee member and is currently a member of the NCSG Convention Site Selection Committee, Technical Advisory Council Committee (Venting and Installing Pellet Stoves) and the AV Coordinator at NCSG conventions taking care of AV needs for classes. Joy is also a past-president of the Kansas Guild of Professional Chimney Sweeps. Every year my wife Barbara and I look forward to convention, talking with old friends and meeting new ones. I am always glad to see young people at convention as they are our future. I always encourage them to get involved in the guild. As our membership gets older we need to pass on to them the things we have learned so that they have the tools to carry on the craft we are so proud of and have worked so hard to preserve over the years. Convention is a learning tool we can use, a plethora of information is presented every year at convention and repetition is a means to learn the skills necessary to carry on our respected craft. I challenge each of you Young and Old to get involved. Do what you can; Ask not what your Guild can do for you but what you can do for Your Guild. Where was your most memorable national convention and why? – Drew Stein in Columbia, SC My most memorable National Convention would have to be Winston Salem North Carolina. I was presented the Roger Charron Friendship award. I am a person of many words and opinionated (just ask anyone) but that night I was so overwhelmed I could only say from my heart to the membership “Thank you for allowing me to serve you”. I was completely surprised and honored. It is a great feeling to know that you are appreciated. This is a memory that I will cherish forever.

At-Large Director: Dennis Dobbs I started my sweeping business in 1981 and soon realized I wanted to do this full time. Worked my way up to full time status in 1988 and became certified, after attending certification training in Chattanooga, TN. Looking for more adventure, my wife Rhonda and I opened a hearth store in 1992, which caused me to learn much more about the hearth industry. We are very fortunate and thankful that the retail store and sweeping business are both still flourishing today. I served as president of the Southern Association of Chimney Professionals from

1996 to 2004. I was recently reelected and am now currently serving as president. I was elected NCSG Region 4 director in 2008 and have now been appointed as an NCSG At-Large Director. In 2008, I was appointed to the NCSG Technical Advisory Council. I enjoy teaching at industry events as well as teaching classes and speaking at home builder, home inspector and real estate trade events. If you knew 20, even 30, years ago what you know now, would you still be doing this and what if anything would you be doing differently? – Hank Taylor of Pleasant Gap, PA Answer: In high school if I had known sweeping was to be my career, I would have taken masonry classes at the local technical school that would have been very beneficial instead of having to learn it on the job. I would have also taken college courses in business management, accounting and marketing. A few years ago I spoke about self employment at the local high school for career day and in order to connect with the students I asked that they give me names of three different types of businesses. Then I explained that all businesses had certain things in common such as English, Accounting, Mathematics, etc. After the class I was thinking, why didn’t someone say this to me at that age? Or was I just not listening? If I’d realized what all was needed to succeed in business I know I would have put forth more effort.

He has three years of industry experience, twenty-five years of sales experience and over twenty years of construction, electrical, plumbing and heating experience and is the former owner of a marketing company. Married to wife, Kimberly, and has three children. Loves hunting, fishing and the outdoors. How do we get young people into the business? Any ideas? We’re mostly a bunch of gray beards! – Jim Smart of Apple Valley, MN By educating them to the fact that this industry is more than what it appears to be on the surface. That it is a very respectable and profitable business to be in. You can be very successful at it and keep it small or grow it to exponential proportions all depending on your individual ambitions.

CSIA Update

Sweeps Week - Indianapolis, IN June 20th – 24th It’s that time again - Sweep’s Week is just around the corner! What is Sweep’s Week? For a number of years chimney sweeps have been gathering each summer at the CSIA Technology Center near Indianapolis for good fellowship and good food. Kinda like “Bike Week” in Myrtle Beach.....But a lot smaller. During the week-long event, attendees from all over the USA, work shoulder-to shoulder on projects to spruce up the CSIA headquarters or make improvements to the training facility. The famous twisted chimney is the result of a Sweep’s Week project. Other projects include a chimney swift tower and the awesome display of contributor tiles along the front of the building. Check out www.facebook.com/chimneysafety for pictures of last year’s event.”You don’t need to be a FB member to look at these. As you can see...there’s some work, a lot of food and plenty of good fellowship. What about that food? We have a cook on site Monday thru Friday providing 3 meals a day for any and all who show up for work or to just hang out and visit.” Fare runs the gamut from great Kansas BarBQue ribs to delicious fresh caught fish-fry to traditional Italian and lots of stuff in between. Sweep’s Week is supported by generous contributions from sweeps and vendors who believe that strong personal relationships within the industry foster a stronger industry. A stronger industry benefits chimney sweeps across the board. All chimney sweeps no matter what their affiliation or nonaffiliation are invited to Sweep’s Week. Sweep’s Week this year is planned for June 20-24 We will be doing a variety of masonry” projects in preparation for the International ESCHFOE event scheduled for later this year at the CSIA Technology Center. For the first time, this year, we are looking into the possibility of earning CEU’s by making this a bonified masonry workshop! Contact Ron or Renee Brigman in regard to lodging or any other questions you may have about the event! You can reach them at 864-682-5422 or ronb@sweepstuff.com or renee@sweepstuff.com.

Why is “Named Insured” Important?

O

person, entity, or organization. This is universally true on all General Liability policies in the insurance industry.

ne of the many subjects discussed at the NCSG Convention in Hartford, CT was the importance of having the correct “Named Insured” on your policy and how it could affect you and your business if not done correctly.

The “Named Insured” shown on the insurance policy is the person, entity, or organization to which the insurance company will respond for any bodily injury or property damage claims that you become legally obligated to pay due to your negligence.

&

In April 2011, ABC Sweeping is sued for a fire that was caused from a wood stove that was improperly installed in 2009. When Bill submits the claim to his previously insurance carrier, they deny coverage because the policy was cancelled in February. Bill then submits the claim to XYZ Chimney Sweeps insurance

pan

If a person, entity, or organization is not listed as an insured on the policy and is sued, the insurance company has no contractual obligation to defend or pay any claims for that

Example 1: In February 2011 Bill, the owner of ABC Sweeping, decides to partner/merge with Jack from XYZ Chimney Sweep. Because Jack already has insurance in place, Bill calls his agent and cancels the liability coverage on ABC Sweeping.

company and they too deny the claim because ABC Sweeping is not a named insured under XYZ’s policy. In order for Bill to have coverage for ABC Sweeping after the merge, he would have needed to do one of two things: • Continue paying premium on ABC’s insurance to keep the policy in force, or • Add ABC Sweeping as an additional “Named Insured” to XYZ’s insurance policy Example 2: Bill has reached retirement age and decides to close ABC Sweeping in March 2011. He notifies his insurance agent and the insurance policy is cancelled on March 15th. Bill’s retirement is rudely interrupted by a lawsuit for fire damage to a home due to an improper stove installation done in 2009. Bill calls his insurance agent and a claim is submitted to his previous insurance company….claim denied. Although the installation was done when the policy was in force, the claim occurred after Bill had cancelled his policy in March. Bill would have needed to continue paying his premium – even after retirement – to have the claim covered in this scenario.

In order to better understand why the policy would not pay Bills claim in the example above, you need to differentiate when the work was completed and when the claim occurred. The language in ALL commercial general liability insurance policies state, “This insurance applies to bodily injury and property damage only if….the bodily injury or property damage occurs during the policy period”. Bill performed the work during the policy period, but the fire occurred after Bill cancelled his policy, therefore, the claim would be denied because the insurance policy was no longer in effect at the time of the claim. Additional information will be provided in regards to who is automatically included as an “Insured” in the future. All insurance policies contain conditions, limitations and exclusions. Please refer to the policy for exact language and coverages that apply to you.

Perspective

BY MARK MCSWEENEY EXECUTIVE DIRECTOR

NCSG: Your Partner in Success An Update on Federal OSHA’s Fall Protection Rulings “If we are together nothing is impossible. If we are divided all will fail.” -Winston Churchill

M

ost people join an association because, at some point, they decided they didn’t want to go it alone. Be it the camaraderie, the networking or the improved access to resources, there is an overriding appreciation that we as a Guild are stronger together than we, as individuals, can be alone.

On-the-job safety has been a hot topic for sweeps for a long time. Guild members frequently share tips and experiences with one another, CSIA addresses it in their education, and it’s often a subject of seminars at conventions. No one takes it lightly, and yet we’re never quite sure if we are doing enough, not only for the sake of our employees, our clients and ourselves, but in the eyes of OSHA as well.

A few years ago, in response to increased pressure reported by sweeps from local Occupational Safety and Health Administration (OSHA) agents, NCSG engaged in a formal dialogue with OSHA at the Federal level to determine how we can work together to establish meaningful and understandable fall protection guidelines that meet the mutual goal of keeping sweeps safe without creating an undue burden on the operations of sweep companies. We knew the answer would not be simple, and we knew a resolution would take time. None-the-less, NCSG was eager to take the lead on this issue on behalf of the industry to ultimately strengthen the entire trade.

We have been encouraged by the receptiveness of the OSHA officials we have met with. Like many outside of the trade, OSHA was unaware of the level of organization and success of the sweeping industry. They have been very appreciative of the proactive stance we have taken in the area of fall protection for the trade. And they acknowledge that our trade has clearly been fortunate to not be plagued with incidents which would have caused us to be flagged in the eyes of the Administration. As a result of our initial discussions, OSHA has a much better appreciation of what sweeps do, how they do it, the training available and the fall protection measures that are already employed by the industry.

40 SWEEPING MAY 11

Relative to current OSHA standards, the Administration acknowledges that there is an ambiguity when it comes to determining where sweeping activities fall. There is not a clear differentiation between that which OSHA considers to be “construction” activities versus “maintenance” activities, and they have indicated an openness to NCSG helping them interpret that within the sweep industry. However, since beginning our dialogue, OSHA has undergone at least three Federal leadership changes which have significantly hampered our momentum. This past year, the game changed yet again for us; although perhaps in a relatively favorable way despite the additional delay in true resolution. In 2010, OSHA revoked its previous 15-year-old interim guidelines for fall protection in residential construction. We believe their action demonstrates that an OSHA field inspection is not the appropriate mechanism for recognizing and addressing the infeasibility of compliance as well as the greater hazard posed by compliance with certain requirements for industries like ours. The encouraging news is that they proposed new rules when they revoked their previous guidelines. Why is that good news? Because when OSHA proposes new rules, the process requires that any industry impacted by the proposal have an opportunity to present their case for or against the proposal before the rules can be adopted. This gave us the chance as an industry to address OSHA’s fall protection rules from the ground level from within their own process rather than trying to push for change after the fact. And what’s more, we already knew we had gained their positive attention and they were listening to us. In a post-hearing brief NCSG drafted to OSHA following the formal hearings conducted by OHSA earlier this year, we summarized our position as follows:

If adopted and enforced as proposed, the provisions of the Proposed Rule that address the structural integrity and condition of walking-working surfaces, the use of ladders, and the selection and use of fall protection would: (1) substantially affect the manner in which chimney sweeps perform their work; (2) expose sweeps to greater hazards than current industry practices; (3) threaten the continuing economic viability of the chimney sweep industry; and (4) threaten the availability of chimney inspection, sweeping and repair services at affordable prices, which would be expected to result in less chimney inspections/sweeping/repairs and a significant increase in residential fires and/or an increase in falls by homeowners or other self-employed individuals who would perform these tasks. Certainly NCSG could have remained quiet on this issue and hoped that the average Federal or State OSHA compliance officer would exercise discretion in recognizing that compliance with the new rule was infeasible and would pose a greater hazard to our industry. Instead, we opted to take the bolder step of coming forward to protect our members and the industry from the risks of relying on local OSHA discretion and being exposed to the unaffordable costs of paying fines and fighting citations. It is important to recognize that individual states are not required to follow the Federal OSHA standards as their own. In fact, the last time I checked, fewer than 30 states plus the District of Columbia did in fact use the Federal Standards as their own. However, even the remaining states tend to use the

Federal standards as a foundation for their own, so ultimately any final rule adopted by OSHA is likely to carry some weight even at the local level, making this truly a unique opportunity for the Guild to affect change that can positively impact sweeps across the country. As encouraged as we continue to be in the progress we are making, this admittedly remains a painstakingly slow process. We have been advised that it is unlikely that we will see a final resolution to all of this for another 12-18 months, but we are committed and will continue to be involved in the next stages of the process until it reaches its conclusion. For now, it is worth noting that in scenarios where sweeps may be cited by local officials for a lack of adequate fall protection, there are some key elements that can increase the odds of success at the negotiating table: • Professionalism of the sweeps when approached by an OSHA official in the field (not being argumentative or defensive); • Professionalism of the business owner when responding to the citation (a willingness to share information and work with OSHA agents); • Documented safety training (fall protection) materials that are legitimately communicated to employees (i.e. NCSG’s

Safety Services member benefit or some other well-organized program and continuing education); • Documented use of fall protection where appropriate in the field; • A commitment to improving where needed. There’s little that NCSG or Federal OSHA can do to prevent a local agent from potentially citing a perceived violation in the field. However, if you are making legitimate efforts to keep your employees (which includes the single owner/operator if he/she is incorporated) as safe as possible, you are much more likely to find success on the back end. Know that the Guild is committed to the safety and success of the sweeping industry. It is incredibly important work that each one of you does, and we want to do whatever we can to ensure that you are around for a long time to do it. Each of our members helps us to maintain and improve upon the resources we have to serve the industry, and hopefully in return we help our members maintain and improve upon their own business. If you are reading this magazine and are not a member of NCSG, I hope you will take a moment to consider joining and help us further build a partnership that brings us all closer to our true potential. Until next time I wish you health, happiness and every success!
