I hope everyone has had a busy summer with their business. Things have really picked up here in my shop. August was a little slow, but I attributed that to customers taking their last summer vacations and the Minnesota State Fair. I should know, as all three of my employees have taken a full week of time off between the last week in July and the first week in September. Right now I am in the final planning stages of celebrating 40 years of family ownership, with an Open House in early October. In 1974, my father and his partner formed a corporation. My father bought out his partner in 1984 and I took over the business in 1998. We have been fortunate to stay in business for the last 40 years. But we couldn’t have done it without the dedication, hard work, great employees and, most importantly, the long-time customers that have supported us over the

years. I have always believed that taking care of your customers by being honest and charging a fair price is what keeps them coming back. We are now working on the cars of a lot of our original customers’ grandchildren. Of course, we always have to attract new customers as well. This is where AASP-MN comes in. I have learned many things from other shop owners by attending the convention, training seminars and even the golf outing. I usually will pick up some type of an idea. So if you are looking for an idea, please consider attending an event that the AASP-MN is hosting. Talk to other shop owners and you will be surprised how many of us are having the same issues. Insurers Meet With AASP-MN on 2015 Issues Representatives of AASP-MN and the Insurance Federation of Minnesota met in early September to discuss each organization’s priorities for the 2015 Legislative Session. These meetings have been held on a regular basis for many years. Typically, the two organizations’ interests differ at the Capitol – but Legislative leaders expect the organizations to communicate with one another to try to address differences before proposals are debated at the Capitol. One of the AASP-MN priorities that was discussed is proposed legislation to prohibit insurers from requiring that an insured have their automobile inspected at a particular motor vehicle repair shop designated by the insurer. The bill also would prohibit insurers from specifying or requiring that a repair

shop use a specific vendor, distributor, manufacturer, supplier, business platform or internal process in order to carry out vehicle repairs for an insured. The AASP-MN proposal would also prohibit insurers from mandating that repair shops comply with third party pricing agreements negotiated by an insurer with manufacturers, distributors or suppliers. Insurance officials expressed concern that some language in the AASP-MN proposal was overly broad and created problems with interpretation. The AASP-MN proposal will be refined in the coming weeks through our Committee process in order to make our objectives clear. The Insurance Federation identified auto glass costs as a significant legislative priority for 2015. Their data indicates that

Minnesota is the second highest state in the country for auto glass costs. Based on the conversation between members of the Associations, it is not collision repair shops that are driving auto glass costs. The Insurance Federation will have a legislative proposal this year that addresses the “batching” of auto glass claims for purposes of arbitration. AASP-MN will watch this legislation closely – although it might not ultimately be a major concern for the Association. The parties agreed to share information in advance of the Session. While we don’t expect the Insurance Federation to embrace our proposals, it is better to know the objections they will raise and the arguments they will make before we bring our proposals forward in the legislative process.

LOCAL NEWS There’s Help on the Way for Hiring the Right People A challenge for all mechanical and collision repair shops is to recruit and hire employees who not only have the skills needed for the job, but who will also be a good fit with the culture and work environment of the shop. Many AASP-MN members have found valuable help in this process by utilizing employee assessment tools to not only screen job applicants, but also to improve performance in current employees. AASP-MN would like to expand and build on those success stories by offering its members the opportunity to provide information that will benchmark the traits and behaviors of high-performing employees and then utilize that information to improve their own hiring and performance evaluation processes. • The Association is partnering with Assessment Associates International (AAI) to conduct a study that will help AASP-MN members identify job applicants that are likely to be long-tenured employees, provide high-quality work, and contribute to the shop’s bottom line. • The study data will be used to develop an Internet-based, pre-employment screening tool that will help member businesses identify the right people to hire. • The jobs being studied are: Service advisors, estimators, mechanical techs, body techs and painters. • Data collection will start on October 1 and conclude on November 15, 2014. Here’s how it will work: • Participating shops will have selected employees complete a 20-30 minute online questionnaire. • The shop owner will provide a basic “quality rating” of the job performance of the employees who complete the study. • AAI will coordinate the data collection process, analyze the data and develop a profile of characteristics of highperforming employees. • Based on that profile, AAI will prepare an Internetbased job applicant screening system specifically tailored for AASP-MN members.

Landmark Minnesota Supreme Court Decision May Mean More Workers’ Compensation Retaliation Claims Against Employers On August 27, 2014, the Minnesota Supreme Court held that employees are entitled to jury trials in cases alleging they were retaliated against by their employers for seeking workers’ compensation benefits, and where they were seeking only money damages. Although workers’ compensation claims themselves are not eligible to be tried by a jury, the court held that workers’ compensation retaliation claims are similar to other types of retaliatory discharge claims, and thus are similarly entitled to determination by a jury. This decision closely follows a recent amendment to the Minnesota Human Rights Act, allowing for jury trials of state law discrimination and retaliation claims. This trend toward providing jury trials for more types of employment cases generally favors plaintiffs, who may be able to evoke sympathy from jury members more easily than from more seasoned, potentially dispassionate judges. More importantly, as plaintiff lawyers find these claims more lucrative, employers can expect more “wrongful discharge” claims by employees alleging they were terminated in an attempt by their employer to avoid workers’ compensation claims or liability. LOCAL NEWS 2014 Is Record-Setting Year for Industry-Sponsored Scholarships The Class of 2014 set a new record in the scholarships awarded through the Global Automotive Aftermarket Symposium (GAAS) scholarships, University of the Aftermarket (UAF) scholarships and collaborating organizations at the automotivescholarships.com website: 295 awards for a total of $320,050. The previous record set in 2013 was 250 awards for $264,050. This year’s recipients include 241 US students and seven Canadian students. AASP-MN’s scholarship program has been linked to the GAAS platform since 2012. By completing a single application at the automotivescholarships.com website, students can be considered for multiple scholarships. A total of 34 of the 2014 GAAS scholarship recipients received two awards, and five recipients received three awards. In fact, Minnesota has the distinction of one of its students receiving a total of four awards and also marking a first in the history of the GAAS scholarship program: The first-ever father and son scholarship winners. Matthew Bisbee, a US Army veteran, is the four-award winner, including $1,000 from AASP-MN for his fall 2014 tuition. He is currently enrolled in the collision training program at Lake Superior College in Duluth. Bisbee’s son, Courtney, also an AASP-MN scholarship winner, is enrolled in the automotive service technology program at Lake Superior College. This year, AASP-MN awarded $15,000 in scholarships to help Minnesota post-secondary automotive students pay for tuition during the 2014-15 school year. The scholarships are in the amount of $1,000 per student and were made possible by a successful fundraising drive within the AASP-MN membership, as well as a generous donation from the Minnesota State I-CAR Committee.

The DEG (www.degweb.org) is an initiative that was developed to help address collision repair estimates data, through proactive feedback from the collision repair industry to the information providers (IPs) that supply the databases for the various estimating products. The DEG was created - and is equally funded and maintained - by the Alliance of Automotive Service Providers (AASP), the Society of Collision Repair Specialists (SCRS) and Automotive Service Association (ASA). It is a perfect example of how these organizations put membership dollars to work to address real issues in the industry. The DEG has processed more than 7,000 inquiries from the industry, many of which have resulted in changes to the estimating system database, or necessary explanations of how they work. The process is simple: The shop submits the inquiry to the DEG and the administrator works with representatives from the IPs to bring the inquiry to resolution. Here are some great recent examples of responsive results from DEG submissions: #7112 - 2004 VW Beetle Left Door Skin: After review, the estimated work time applied to the Outer Panel has been adjusted to 6.5 hours from 4.5 hours. #6939 - 2013 VW Beetle Roof Panel: The PANEL, ROOF TRIM (GN 0358,359) labor time has changed from 0.3 hours to 5.9 hours. Top 10 Reasons Why You Should Buy Employment Practices Liability Insurance (EPL) 1. EPL covers both actual and ALLEGED acts of discrimination, harassment, retaliation, wrongful termination and other similar employment practices violations. 2. Three out of five employers are sued by former employees every year. 3. Over 40 percent of EPL claims are against firms with fewer than 100 employees. 4. Some Federal and State employment laws apply to all employers regardless of employee count - any size company has exposure! 5. The Equal Employment Opportunity Commission (EEOC) recorded nearly 93,000 charges in 2013 and obtained more than $365 million in administrative settlements for claimants.

6. The financial ramifications of not having EPL insurance can be crippling, especially for small firms because they do not have the operating budgets to handle the defense costs, let alone settlements or judgments, of an uninsured claim. 7. The median cost of an EEOC lawsuit in 2011 exceeded $250,000. 8. There is no EPL coverage under other insurance policies such as General Liability (GL). Any endorsement to another policy generally provides insufficient limits, does not provide the breadth of coverage of a separate EPL policy and erodes the limit available for the GL exposure. 9. Based on recent data gathered by the Federal Judicial Center (a federal and research agency for the US courts),

an increase of 10 percent in the 2013 statistic was seen. The agency reported that there were only 7,064 wage and hour complaints in 2012, while in 2013, that number jumped to 7,764. 10. Recent Supreme Court decisions have lowered the standard of what constitutes retaliatory treatment. Retaliation has become the #1 most frequently cited form of discrimination, beating out race discrimination. Monetary benefits totaled just under $170 million. However, this number does not include monetary benefits obtained through litigation.

Respirator Requirements Do body techs have to wear respirators? Do detailers? Does everyone who walks through the shop? (One sales representative claimed that was the case. It’s not.) Who must wear a respirator is based, first, on exposures – both what is in the air and how much is in the air. That will vary from shop to shop, but because nearly all shops have similar operations, we can make some educated guesses. We’re helped in this by research done by NIOSH (the National Institute of Occupational Safety and Health) and others, who have measured exposures in a number of shops. From that research, we know people who paint or prime need to wear respiratory protection. When they spray, they can breathe in the paint mists and vapors, even if the booth is well-ventilated. The levels of individual solvents, such as xylene, are often below exposure limits. But paints and primers may contain a number of solvents with similar health effects. When those levels are added together, they can be high enough to require respirator use. Of even more concern: The isocyanates in the clear coat, which can cause asthma. Sanding creates a lot of dust. If the paint is old, that dust may contain lead or chromium, which can cause serious longterm harm. We don’t see those metals used in paints today. If people are sanding off body filler, the dust will be mainly polystyrene, polyester and talc – substances that don’t have specific toxic effects. Measurements of dust levels have shown brief exposures to high levels, but levels averaged over the full workday have been below legal and recommended exposure limits. Based on that, we recommend respiratory protection against dust, but we can’t say it’s mandatory. Most of detailers’ work isn’t dusty and doesn’t involve solvents. About the only task detailers might do that causes respiratory problems is spraying wheel brightener. Some of these products contain hydrofluoric acid, a very corrosive substance. (You can check the label or Safety Data Sheet for chemical contents and precautions.) Lung protection against that would be an acid gas respirator with a particulate pre-filter. But a

much better option is to change products to one less likely to cause severe eye and skin burns. So if we advise that respirator use when sanding is recommended but not mandatory, what does that mean for you? Your options: You can require anyone sanding to wear a respirator. You can tell employees that respirator use is not mandatory, but you’ll provide respirators for those who choose to wear them. You can provide dust capture systems (the best option), so dust levels stay relatively low. Keep in mind that the two-strap paper type of mask, also called an N95 filtering face piece, is a respirator. For the dust from body filler, either that or a respirator with the magenta-colored P100 filters will do the job. Those two respirators, the paper type and the cartridge type, have the same assigned protection factor. OSHA says that either can be worn in conditions up to 10 times the exposure limits. The difference

between the two: The dust mask is designed to filter out at least 95 percent of all particles 0.3 microns in size. The magenta filter is designed to remove at least 99.97 percent of particles of that size, a particularly hard size to capture. If you require use of a respirator (dust mask or cartridge type), employees need annual training and fit testing. They must be clean-shaven wherever the respirator seals to the face. They need medical approval, to ensure wearing the respirator won’t cause too much stress on their heart and lungs. And you need a written program specifying how respirators are to be taken care of. If you let employees use respirators, including the N95 dust mask, but don’t make it mandatory, you still need to ensure they are healthy enough to wear the respirator. And you need written procedures to ensure the respirators are maintained and used in such a way that they do not cause harm (for continued on pg. 19

You need to give employees Appendix D to OSHA’s respirator standard (readily available online, or contact us for a copy). You do not need to provide annual training and fit testing. And – a big deal - you do not need to require employees to shave. Where can you get the medical evaluation? Use an occupational health provider. It might be as simple as having the employee fill out a confidential questionnaire. Two companies offer online questionnaires, with review as needed by an occupational physician. A number of clinics in Minnesota offer the questionnaire as something employees can fill out at work and send in, with employees only needing to go into the clinic if an answer on the questionnaire raises a red flag. The cost: Roughly $30 per person, if no additional evaluation is needed. A quick summary: Anyone who uses any type of respirator (the paper-type dust mask, a cartridge respirator or even an air-supplying respirator) needs to have had medical approval to wear it.
