Strength in Numbers

If you have been to an AASP-MN event in the past year, you have probably heard me say, “Hi, I’m your Executive Director Linden Wicklund. I run the Alliance/ AASP-MN and I am an extension of your team.” No, I don’t know how to fix cars and I haven’t checked my own oil since I owned a car that was built in 1992. What this does mean is that I am actively engaged with shops, technical schools and allied organizations from across the country. I work to make sure your voice carries, you have access to industry information and critical networking connections, and most importantly, I am here on the other end of the phone line to let you know you are not alone in the challenges you face and will help you find solutions.

Membership in an association can mean different things to different people and changes with every chapter of life or business. Over the past 15 years of working with membership organizations, I’ve typically seen people fall into the following buckets of engagement. All are valid and important with different benefits. They are the transactional member, the hands-on member and the insurance policy member.

Transactional members are looking for black and white ROI in their membership. They are motivated to join because of business discounts, educational content and access to customers or suppliers.

Hands-on members are the classic “engaged member.” They tend to show up for most things, provide volunteer support as a committee or board member and actively seek out relationships with other members for business gain or social purposes. When they need to outsource work or borrow a tool, they immediately think of other members of the association.

The insurance policy member is perhaps the one that is most undervalued but is critical for the success of the mission of the association. These are the members that are little known, reliably pay their dues year after year and know the association is just a phone call away in a time of need, just like insurance should be. They are the unsung heroes that make the work of the association possible through their support in dues and by adding to the number of shops banding together. They are unlikely to rattle off exactly what they directly receive

in membership, but they also know that having an association looking out for the industry in their area is deeply important.

If you have been a member for many years, you have likely cycled between all these buckets. If you aren’t a member and have resisted joining because you don’t think you will get much out of it, remember, you don’t need to be taking advantage of every benefit to know you are supporting the health of an industry you work hard in and believe in. There is strength in numbers, so join AASP-MN if you’re not already a member or encourage a shop near you to join if you are! I’m here to be an extension of your team and work on your behalf regardless of how you choose to engage with AASP-MN!

‘Tis the Season: For Legislator Shop Tours

Why AASP-MN members lead tours

Following the recent redrawing of legislative districts (occurring every 10 years), many incumbent lawmakers chose to retire rather than run for reelection in a new district. This spike in legislative retirements resulted in many fresh faces running for and being elected to office in 2022. Nearly 30 percent of legislators were freshmen during the 2023 legislative session. They took a leading role as chief authors of important bills, with some even serving as vice-chairs of various committees. There was no shortage of bills introduced, with the final amount totaling 3,300 (2,000 is the approximate average). With single party control, a record number of bills were passed into law, many of significant consequence.

While legislators largely took a break after a long session, in-district events and appearances have picked up again. Given this context, now is the time to connect with your elected officials to set up shop tours and begin developing personal connections with elected officials in your area. Legislators, long-time incumbents and freshmen alike, will be anxious to hit the ground running

in the 2024 legislative session, a session that will focus on policy as opposed to the budget setting year that just concluded.

As legislators look to champion impactful legislation, they source ideas from their constituents to decide which legislative solutions are most needed. This is a prime opportunity for shop owners to showcase the amazing work occurring, while highlighting the challenges and obstacles. It is also critical that AASP-MN continue to build relationships with legislators who lead key committees that were developed during the 2023 legislative session.

Shop tours are an opportunity for AASP-MN members to showcase their businesses, including highlighting unique challenges. They also serve as a critical pathway for introducing legislators to the variety of issues AASP-MN members face as well as framing potential solutions.

AWAIR Program Required in Minnesota

All automotive repair facilities in Minnesota are required to have A Workplace Accident and Injury Reduction (AWAIR) program. The Minnesota legislature has also added a requirement for a safety committee to any company that needs an AWAIR program. Any auto repair facility in Minnesota that does not have a current AWAIR program could be cited, and the penalties have increased substantially.

AASP-MN, in conjunction with its partner, Complete Health Environmental & Safety Services (CHESS), has developed “Creating an AWAIR Program for Your Shop.” This online webinar helps members understand the components of an AWAIR program and helps them create an AWAIR program for their own facility. The cost for the webinar is $100 and it includes a 20-minute phone consultation with a representative from CHESS to review the program you draft for your company.

Fall Golf Event Announced

The Minnesota I-CAR/SkillsUSA Volunteer Committee invites golfers and sponsors to Oak Glen Golf Club in Stillwater, Wednesday, September 20 for a fun-filled day of golf and networking. All proceeds from the event go toward scholarships for future technicians, equipment for technical colleges and other collision industry training needs in Minnesota. The event includes a four-person scramble, grilled dinner and awards reception following the golf. In addition, there will be complimentary refreshments on several holes around the course, as well as unique contests for prizes.

Distribution Shakeup

COVID-19 created greater changes in the strength of the five major distribution channels during 2020 to 2022 than any event since the Great Recession of 2008. The significant changes in the product volume and share of distribution channels that occurred over the past three years are analyzed in-depth in the recently released 2024 Lang Aftermarket Annual.

Light Vehicle Distribution Channels

In the U.S., five major distribution channels supply the car and light truck aftermarket: Traditional, Integrated, Specialized, Import and OE.

The light vehicle aftermarket suffered a 7.3 percent decline in 2020 product volume from the onslaught of COVID-19, followed by nearly a 15 percent product rebound over the next two years. However, this product loss and recovery was not distributed equally across the five major aftermarket distribution channels.

Winners and Losers

Over the past three years, there has been a massive shift in aftermarket product volume among the five major distribution channels supplying the car and light truck aftermarket in the U.S.

There were big winners and big losers in product volume and share during the past three years. Two channels dominated product growth. In contrast, three other channels declined in product share, combining for only a 0.4 percent annual growth rate.

Integrated Channel Dominates

In the Integrated channel, ownership of products does not change hands from when products are purchased from manufacturers to the point of ultimate consumption or sale to an installer (repair outlet or DIYer). Like all channels, the Integrated channel was hit hard in 2020 by COVID-19, but it managed to increase its distribution channel share that year.

The Integrated channel outperformed all other channels during the 2021 and 2022 aftermarket rebound, recording the largest increase in share and dollar volume.

The Integrated channel’s growth was fueled by the outstanding performance of retail auto parts chains during 2021 and 2022 (as DIY volume soared at a doubledigit rate).

The Integrated channel also benefited from eCommerce sales, which surged in the past three years, as reported in the 2024 Lang Aftermarket Annual.

Import Channel Shows Strength

The Import channel (distribution involving Import warehouses and Import jobbers) was the only other channel recording product share growth during 2020, despite the onslaught of COVID-19.

The Import channel declined in dollar volume during 2020, but it dramatically increased product volume over the next two years, significantly topping its pre-COVID-19 product share and dollar sales.

The Import channel’s growth reflected the strong aftermarket performance of foreign nameplates. See the 2024 Lang Aftermarket Annual for complete details.

Distribution Channels Declining in Strength

The Traditional channel was hit hardest by COVID-19. It fell by nearly one-tenth in dollar volume during 2020 as its market share fell sharply.

The significant downturn in Do-It-For-Me (DIFM) auto repair during 2020 hit the Traditional channel hard. It could not offset its reduction in DIFM volume by expanding DIY product distribution.

The Specialized channel is focused on a limited range of products or involved in an aftermarket sector specializing in certain types of products. In 2020, the Specialized channel lost a significant share, followed by a weak performance in the next two years.

Independent Versus OE Distribution

The OE channel suffered a product share decline during 2020 and continued to lose share during the next two years as the light vehicle aftermarket rebounded sharply in product sales. However, the increasing size of the aftermarket enabled the OE channel to expand its dollar volume, despite its lower share compared to preCOVID-19 years.

Notwithstanding the declining share of the OE channel, dealers increased their DIFM product share between 2019 and 2022. This reflected dealers’ growing use of non-OE products, particularly for the refurbishing of used vehicles and bay repairs on nameplates other than what they sell new.

Aftermarket Impact

Aftermarket changes created by COVID-19 and other factors have concentrated the volume of aftermarket products among fewer distribution channels.

Only the Integrated and Import channels increased their aftermarket product share in 2022 compared to 2019. These two channels generated more than 90 percent of distribution volume growth during these years.

Six Major Takeaways

• The onslaught of COVID-19 created massive shifts in product volume and share among the five major distribution channels supplying the car and light truck aftermarket across the U.S.

• The Integrated and Import channels increased their aftermarket product share during 2020, despite the 7.3 percent product decline among light vehicles.

Minnesota’s Top 10 Auto Body Shops

Last month, AASP-MN News featured the top 10 auto repair shops consumers are raving about online! (See grecopublishing.com/aasp-news-july-2023/) This month, AASP-MN News once again combed the internet to find what consumers are saying about Minnesota auto body shops. After pouring over countless Google, Yelp and Facebook reviews and monitoring these businesses’ digital interaction, AASP-MN News included those with the most positive reviews and online engagement on this list. It should be noted that eight out of the 10 shops listed are AASP-MN members, a confirmation of their commitment to be sure they have access to the necessary tools and resources needed to run a successful collision repair business.

ABRA – AUTO BODY REPAIR OF AMERICA (Est. 1984) - Marshall

For nearly 40 years, ABRA (Auto Body Repair of America) has been growing throughout the country; here in Minnesota, its Marshall location stood out the most via its online presence among reviewers and interactions over social media. Customers find the Marshall crew to be friendly and helpful, which is one of the things that keep them coming back again and again. As one Google reviewer put it, “The employees at ABRA were superior in customer service. Every single person stopped to say hi and greeted me with a smile when I walked in. Bridge Your Auto Policy Gap with Drive-Other-Car Coverage

If you provide company vehicles to your employees and these employees don’t have their own personal automobile policy, a potential gap in coverage may exist. To adequately cover your risk, a drive-other-car endorsement is specifically intended to bridge this gap.

Drive-Other-Car Coverage Basics

If you have employees who are provided with company-owned vehicles, they often do not have an additional automobile and therefore do not carry a personal automobile policy.

If the employee doesn’t carry a personal policy and drives a vehicle borrowed from another party, other than the company-issued vehicle, drive-other-car coverage affords them protection should an accident occur.

In all of these circumstances, the business automobile policy provides no coverage since the “covered auto,” or company-owned vehicle, was not involved in the accident. A drive-other-car endorsement closes the exposure loop in

• Hired automobile coverage is provided for vehicles that are leased, rented, hired or borrowed by the insured or its employees for business purposes.

If a fire is too large, if there is too much smoke or if you are too frightened, evacuate immediately.

Using the wrong fire extinguisher can result in more damage than the fire itself. All extinguishers have nameplates identifying their usage instructions, as outlined below.

• Non-owned coverage is afforded to employers when an employee uses their own personal vehicle for business purposes.

Take these steps to minimize your exposure: Require all employees who are either issued or will drive company vehicles to have personal automobile policies. There are also extinguishers known as a Class ABC extinguishers, which can be used for all types of fires.

Prior to the tour, AASP-MN leadership will work to prepare you to host your lawmaker by providing talking points and walking through the process. AASP-MN leadership will also attend the tour.

Tours typically start out with introductions where members can share information about themselves and their business and learn about the legislator’s interests and background. From here, your tour may showcase a high-level of technology legislators may not be familiar with (such as paint booths, diagnostic computers, etc.). This helps legislators understand the level of skill involved with some repairs and that the business provides highwage job opportunities in their districts.

As the tour moves on, AASP-MN members should share their unique experiences and concerns with the elected official. AASP-MN leadership can help provide broader industry issues and proposed solutions. Tours will typically end by asking the legislator to support

proposed legislation or be open to meeting closer to session to review draft legislation.

These tours are relatively painless and can pay huge dividends for AASP-MN later on. Lawmakers who develop personal connections with local businesses are much more likely to be responsive and helpful in enacting legislation in the future.

Mitchell: Section Quarter Panel Labor Time

OEMs may have a procedure to allow for both full panel replacement and sectioning of a quarter panel. When such situations arise, Mitchell users should reference the following statement per the CEG 20 Quarter Panel.

“FULL PANEL REPLACEMENT PROCEDURE: Labor times are for replacement at factory seams if feasible. However, many quarter panels cannot be replaced at roof seams because the roof panel overlaps the quarter. If a quarter panel is designed in this manner and a section time is not listed, the time in the text represents replacement of the panel at the

most practical area - usually below the roof seam. This method is considered a full panel replacement provided the back glass and, if applicable, the quarter glass is removed for splicing in the pillar/sail areas.”

National Emission Standards for Hazardous Air Pollutants (NESHAP)

6H rule and how it applies to your business

Most auto body and collision repair shops generate air emissions and hazardous waste from painting processes regulated by the state or the Environmental Protection Agency (EPA) rule known as the “6H rule” (40 CFR Part 63 Subpart HHHHHH). This regulation aims to reduce the quantity of hazardous metals in automotive paint. The five targeted metals are chromium (Cr), lead (Pb), nickel (Ni), cadmium (Cd) and manganese (Mn), which are hazardous to the environment and workers’ health. This article focuses on the coating-related air quality regulations that may impact your business.

Three significant changes went into effect as of May 9, 2023:

• Electronic reporting - All reporting, including annual reports and each paint used, must be done electronically using the EPA’s CEDRI system (epa.gov/electronicreporting-air-emissions/cedri) unless exempted.

• Exempt notification - The exemption request process no longer requires supporting documentation and is now a notification. See link: pca.state.mn.us/sites/default/ files/aq4-15.pdf

• Exemption based on the new definition - Businesses are now eligible for an exemption. They can simply submit a notification to the U.S. EPA indicating that they do not spray apply any target HAP-containing coatings.

Key requirements of the “6H rule:

• Train and certify all painters.

• Use ventilated spray booths with filters that are at least 98 percent efficient.

• Use high-transfer efficiency guns such as (HVLP) spray guns.

• Do not clean spray guns by spraying solvent through the gun, creating an atomized mist.

• Shops must submit initial required notifications to the MPCA and keep records sufficient to demonstrate they are always compliant.

Who does this rule apply to?

The 6H rule applies to paint stripping and various surface-coating operations, including auto body repair shops that use:

• Chemical strippers containing methylene chloride.

• Spray application of coatings to motor vehicles and mobile equipment to finish or refinish.

• Spray application of coatings that contain target HAPs, parts and products made of metal, plastic or a combination of metal and plastic.

EPA has a screening tool to help businesses determine their compliance requirement and eligibility for an exemption. The 6H regulatory navigation tool starts by reviewing definitions to confirm a shop’s activities are under the rule. If a shop does not spray coatings to motor vehicles or mobile equipment or sprays exclusively out of three-ounce or smaller cups, then an exemption petition is not needed, as the shop is already exempt.

The 6H tool asks up to three questions, beginning with the presence of Target HAPs in your paints. Target HAPs are cadmium, chromium, lead, manganese and nickel. The tool

provides lists from major paint manufacturers showing which products contain target HAPs. If the paints are target HAPfree, you can petition for an exemption.

If you have target HAPs, the second question asks if you can switch to target HAP-free coatings. You can search the manufacturers’ paint lists for alternative formulas to see if a switch is possible.

The last question is about the composition of the paint. Some paints, such as a pearlescent, will have target HAPs above the threshold levels; however, the paint must be evaluated as sprayed, not as supplied. Since pearls are such a small paint component after toner and reducer, the pearlescent paint may be below the thresholds. After completing the questionnaire, exempt shops are provided with an example petition form and contact information for sending the form.

What if I’m not exempt?

Most manufacturers have removed target HAPs below allowable thresholds. Hence, many auto body shops can demonstrate they are exempt from the 6H rule. If your shop is not exempt, the requirements listed above apply.

Air permitting concerns

Auto body and collision repair shops must assess if an air permit is needed. Many body shops don’t need an air permit because most can qualify as insignificant or conditionally exempt facilities by following the operational, recordkeeping, and notification requirements similar to the 6H rule.

Best management practices

The rule encourages the implementation of the following best practices for worker health and environmental protection, such as:

• Using safer chemicals and cost-efficient technology.

• Follow OSHA guidelines and use proper protective equipment.

• Control dust with vacuum sanders and use low-VOC solvents and water-based paint.

• Train and certify painters and use well-ventilated spray booths.

• Use high-transfer efficiency guns and automated cleaning equipment with appropriate protective gear.

• Designate a health and safety manager, provide safety data sheets, and recycle solvents to reduce hazardous waste and disposal costs.

These practices result in less contact with toxic chemicals for the painter, less hazardous emissions to the environment, and dollars saved in paint costs for the shops.
