NE WS Walmart T O S E T T L E E E O C D I S C R I M I N A T I O N L A W S U I T Walmart will pay $60,000 and provide other relief to settle a sex discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today. The EEOC charged in its suit that Walmart refused to promote an employee to a department manager position at its Ottumwa, Iowa store based on sex stereotypes about women with young children. According to evidence presented by the EEOC, when the employee asked why she was passed over for the promotion, a store official noted that she had young children at home and that store management assumed she was not interested in advancing her career at Walmart long-term. Walmart instead promoted a woman who did not have any children. This alleged conduct violated Title VII of the Civil Rights Act of 1964, which prohibits sex discrimination. This prohibition on sex discrimination includes discrimination against an employee because of sex-based stereotypes, such as the stereotype that mothers are unreliable or uncommitted employees. The EEOC filed suit (Civil Action No. 4:22-cv00037-SMR-SBJ) in U.S. District Court for the Southern District of Iowa, Central Division, after first attempting to reach a pre-litigation settlement via its conciliation process. The settlement follows an earlier ruling by the court rejecting Walmart’s motion to end the case without a trial. In its rejection of the company’s motion, the district court

The EEOC is pleased that the employee in this case has received a measure of justice for the opportunity that she was wrongfully denied.”

quoted a U.S. Supreme Court case that the “‘pervasive presumption that women are mothers first, and workers second’ is among the sex stereotypes Congress has explicitly identified as impermissible.” The district court found that there was evidence that Walmart’s promotion decision was based on sex stereotypes and that a jury trial was warranted. That trial had been set to begin on Jan. 8 in Des Moines. Under the consent decree resolving
the lawsuit, Walmart will pay $60,000 in compensation to the now-former employee. Walmart will also provide training to relevant management employees on federal laws prohibiting sex discrimination and will report any additional complaints of sex discrimination in promotions to the EEOC for the decree’s duration. “Discriminating against a woman because of stereotypes about working mothers is sex

E N T E R TA I N M E N T A N N U A L J A Z Z G A R D E N S M u s i c Fe s t D E B U T S L I N E U P The 17TH ANNUAL JAZZ IN THE GARDENS MUSIC FEST already had us buying tickets and ready to catch flights with their initial rollout of artists. Can you blame with Maxwell, Babyface, DJ Cassidy, Jeezy, Scarface, Tamia, Jaheim, Marsha Ambrosius and October London all announced as performers? Now the Jazz In The Gardens Music Fest has revealed the complete artist lineup, and it’s gotten even bigger and better. Scheduled to take place in Miami Gardens, Florida at the Hard Rock Stadium on Saturday, March 9th and Sunday, March 10th, the first round of artists are all set for Day 2 of the festival. Day 1’s lineup is just as lit with a trio of headliners and additional acts throughout the day. R&B lovers will be in heaven with Summer Walker and Jazmine Sullivan both scheduled to headline on the first day. As the festival’s new partner the Black Promoters Collective previously stated, they wanted to bring Afrobeats artists to JITG, and they’ll do just that with one of the biggest in the genre, Nigerian superstar Davido, on board as a headliner.
Day 1 of the festival will be on a Saturday, but you can expect for gospel music great Kirk Franklin to have it sounding like church on a Sunday during his performance. There’ll be even more R&B to be heard from everyone’s favorite unbothered heartthrob Omarion, singer/rapper Tink and the singer-songwriter with one of the most prolific pens in the game Eric Bellinger. Rounding things out will be a special DJ set by Kid Capri who is sure to bring some hip-hop flavor to JITG’s opening day this year, which will be hosted by comedienne JessHilarious. Organizers of the 17th Annual Jazz In The Gardens Music Fest still have some tricks up their sleeve and “more artists to be announced” according to their latest flyer. Expect your mind to be blown even more than it already is once JITG shares who else they’ve got on tap to perform. One thing is for sure, you’re not going to want to miss this Black Music extravaganza this March in South Florida. Be sure to visit the Jazz In The Gardens Music Fest website to lock in your tickets ASAP and plan your trips accordingly.

TERMS OF SALE Such tax liens shall be sold subject to any and all superior tax liens of sovereignties and other municipalities and to all claims of record which the County may have thereon and subject to the provisions of the Federal and State Soldier's and Sailors' Civil Relief Acts. However, such tax liens shall have priority over the County's Differential Interest Lien, representing the excess, if any, of the interest and penalty borne at the maximum rate over the interest and penalty borne at the rate at which the lien is purchased. The Purchaser acknowledges that the tax lien(s) sold pursuant to these Terms of Sale may be subject to pending bankruptcy proceedings and/or may become subject to such proceedings which may be commenced during the period in which a lien is held by a successful bidder or the assignee of same, which may modify a Purchaser's rights with respect to the lien(s) the property securing same. Such bankruptcy proceedings shall not affect the validity of the tax lien. In addition to being subject to pending bankruptcy proceedings and/or the Federal and State Soldiers' and Sailors' Civil Relief Acts, said purchaser's right of foreclosure may be affected by the Financial Institutions Reform, Recovery and Enforcement Act (FIRREA), 12 U.S.C. ss 1811 et. seq., with regard to real property under Federal Deposit Insurance Corporation (FDIC) receivership. The County Treasurer reserves the right, without further notice and at any time, to withdraw from sale any of the parcels of land or premises herein listed. The rate of interest and penalty which any person purchases the tax lien shall be established by his bid. Each purchaser, immediately after the sale thereof, shall pay to the County Treasurer ten per cent of the amount from which the tax liens have been sold and

PUBLIC NO T ICE the remaining ninety per cent within thirty days after such sale. If the purchaser at the tax sale shall fail to pay the remaining ninety per cent within ten days after he has been notified by the County Treasurer that the certificates of sale are ready for delivery, then all deposited with the County Treasurer including but not limited to the ten per cent theretofore paid by him shall, without further notice or demand, be irrevocably forfeited by the purchaser and shall be retained by the County Treasurer as liquidated damages and the agreement to purchase be of no further effect. Time is of the essence in this sale. This sale is held pursuant to the Nassau County Administrative Code and interested parties are referred to such Code for additional information as to terms of sale, rights of purchasers, maximum rates of interest and other legal incidents of the sale. Furthermore, as to the bidding, 1. The bidder(s) agree that they will not work with any other bidder(s) to increase, maintain or stabilize interest rates or collaborate with any other bidder(s) to gain an unfair competitive advantage in the random number generator in the event of a tie bid(s) on a tax certificate. Bidder(s) further agree not to employ any bidding strategy designed to create an unfair competitive advantage in the tiebreaking process in the upcoming tax sale nor work with any other bidder(s) to engage in any bidding strategy that will result in a rotational award of tax certificates. 2. The tax certificate(s) the Bidder will bid upon, and the interest rate(s) bid, will be arrived at independently and without direct or indirect consultation, communication or agreement with any other bidder and that the tax certificate(s) the Bidder will bid upon, and the interest rate(s) to be bid, have not been disclosed, directly or indirectly, to any other bidder, and will not be disclosed, directly or indirectly, to any other bidder prior to the close of bidding. No attempt has been made or will be made to, directly or indirectly, induce any other bidder to refrain from bidding on any tax certificate, to submit complementary bids, or to submit bids at specific interest rates. 3. The bids to be placed by the Bidder will be made in good faith and not pursuant to any direct or indirect, agreement or discussion with, or inducement from, any other bidder to submit a complementary or other noncompetitive bid. 4. If it is determined that the bidder(s) have violated any of these bid requirements then their bid shall be voided and if they were the successful bidder the lien and any deposits made, in connection with, said bid shall be forfeited. If you are anywhere in your journey with substance use disorder,
I want you to stop, look around and open your heart. Revel in the abundance of your existence. See how small substance use disorder can be when sat next to all that you are or ever could be. Fill your existence with beauty, purpose and a life of service. And your substance use disorder— your history of addiction, the things you may have done that you are not proud of—will one day be small enough to deal with while allowing you space to live this life of joy. Hold on. We are not the sum of our scars but rather a beautiful mosaic of the life they hold together. —Joseph Washington, DC In recovery from substance use disorder
