Welcome to the 2014 Midcontinent Oil & Gas Awards commemorative Yearbook

elcome to the 2014 Midcontinent Oil & Gas Awards commemorative Yearbook. These were the 2nd annual Awards for the Midcontinent region and the organizations and individuals in this journal were acknowledged by the award’s judging panel to have excelled in their work in 2013, whilst also focusing on the industry core values of Health & Safety, Environmental Stewardship and Corporate Social Responsibility. The Oil & Gas Awards champion best practice and recognize organizations operating in the upstream and midstream sectors of the industry. The media and members of the general public do not distinguish between the different sectors of the industry, which is why the Awards incorporate categories for all parts of the upstream and midstream sectors. The absent mindedness of an individual on an assembly line can have dramatic consequences months later should equipment fail when being used in the field. This reflects badly on the industry as a whole, we therefore think it is extremely important that best practice is championed from top to bottom and the Awards are a platform to promote to the press and public the great work being done. The Oil & Gas Awards are unique in highlighting the incredible innovation and commitment to positive industry development and expansion, rebutting traditionally negative mainstream coverage. The Awards celebrate corporate success twinned with organization’s commitment to health & safety, environmental stewardship and corporate social responsibility.

In this 2nd year for the Awards in this region we also added the Industry Summit during the day immediately before the Awards gala dinner in the evening. In this yearbook you can read coverage from the Industry Summit keynote presentations and speaker panels discussing the challenges the industry faces. Retaliation to Regulation through Litigation Oklahoma Attorney General Scott Pruitt leads the charge against regulations stemming from “sue and settle” deals with environmental groups.

During the Obama administration, federal agencies like the U.S. Environmental Protection Agency (EPA) and Fish and Wildlife Service (FWS) have been expanding their reach into the states in an effort to enforce environmental regulations. Oftentimes, however, these agencies either change existing statutes or ignore them entirely, and Oklahoma Attorney General Scott Pruitt is taking on the feds to stop this practice. “We see administrative agencies in Washington, D.C. – particularly the EPA, but there are others – that are truly engaged in the practice of changing, altering, repealing and amending laws after the fact, and doing so unapologetically,” Pruitt told attendees of the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. “In fact, they’re saying without much bashfulness that their role and responsibility at the agency level is to improve upon a statute or change a statute if they disagree with it.”

Although this type of activity affects just about every American industry, the U.S. energy sector is particularly hampered when it cannot adjust to various regulations when changes are made without warning. “It creates regulatory uncertainty,” Pruitt said. “When you have agencies that abuse the rule of law and act postscript to a statute, it creates tremendous regulatory uncertainty, which means that you in the industry have difficulty knowing what is expected of you.” For example, in March 2014, Pruitt filed a lawsuit against the U.S Department of the Interior and the FWS alleging the FWS engaged in “sue and settle” tactics when it agreed to settle a lawsuit with a national environmental group. Wild Earth Guardians sued the FWS in 2010 alleging the agency had not met deadlines in determining the listing status of 251 species, including the lesser prairie chicken. The FWS entered into a consent decree that mandated the agency decide the listing status of those species by September 30, 2015.

Specifically, the FWS agreed to determine whether to grant the lesser prairie chicken threatened status under the Endangered Species Act by March 31, 2014. The FWS subsequently listed the lesser prairie chicken as threatened, and Oklahoma led a coalition that includes Kansas, North Dakota, the Domestic Energy Producers Alliance and the American Farm Bureau to challenge the ruling that brought this to be. This is just one example of what Pruitt described as “regulation through litigation.” Environmental groups will target a discretionary duty and sue a federal agency to change that portion of a rule. If a judge in one state signs off on the consent decree between the plaintiff and the agency, it effectively forces the change upon the rest of the nation.

“That is called rulemaking outside of the parameters of the Administrative Procedures Act,” Pruitt said. “That is taking the court process and judicial process and using it in an abusive way.” Another concerning issue Pruitt addressed was the changes the EPA and the U.S. Army Corps of Engineers (USACE) has proposed to the definition of what constitutes the waters of the United States. Historically, according to Pruitt, waters of the United States were those requiring navigability. If waters were navigable, they have the ability to cross state lines,

which gives the federal government jurisdiction over them through the commerce clause. The EPA and USACE have proposed changes that would include retention ponds and other standalone waters under the guise of better implementing the Clean Water Act. Opponents of the changes, however, claim the EPA once again is attempting to extend its jurisdiction further into the states’ rights to primacy. Pruitt predicted if the EPA passes these proposed changes, numerous concerned states will mount lawsuits. “The whole reason for this modification for what constitutes water to the United States is really just about one thing, and that’s about the jurisdiction to the EPA – extending the jurisdiction of the EPA in permitting to make sure that if there are any land-use decisions being made around oil and gas development, farming and ranching, or building a subdivision, they have jurisdiction as they have expanded it to water in a drainage ditch,” Pruitt said. “Now those businesses will have to get a permit to do anything differently with that land in the future.” Industry also is dealing with changes to the Clean Air Act due to a Supreme Court decision in 2007. Massachusetts and a few other states sued the EPA to say carbon dioxide is an air pollutant under the act and it should be regulated for non-stationary sources like automobiles. The Supreme Court agreed, adding Rule 111-D to the act. However, Section 112 of the act still does not list CO2 for stationary emissions, yet the EPA continues to attempt to regulate it due to this ruling for autos. “They’re using their power in the regulatory space to pick winners and losers,” Pruitt said. “They are using their regulatory authority and reach to try to elevate renewable at the expense of fossil fuels.”

The Merits of the Midcontinent Like most oil-producing regions of the United States, the benefits outweigh the setbacks in the Midcontinent.

Falling oil prices may test the mettle of the oil and gas industry in the Midcontinent, but as long as the price of an oil of barrel stays around $80 range, operators should continue to thrive. “The customers we’ve talked to are very comfortable drilling wells in the Permian Basin and western Oklahoma at $80-a-barrel oil,” said John Poarch, Vice President of Commercial and Business Development for Access Midstream. “We haven’t seen any slowdown. Obviously I think everybody is watching it cautiously and if it does appear oil prices go down much more, then it will start directly affecting how many rigs are running.” The bigger concern, however, is the ever-changing federal regulations the oil and gas industry must follow. Whether those stem from species that make various plays their habitats or greenhouse emissions, the evolving regulatory landscape could prove to be more troublesome for the Midcontinent than oil prices. Poarch joined Jim Leathers, Director of Gas Supply for Superior Pipeline Co., and Moderator Carolyn Davis, Senior Editor of Natural Gas Intelligence, for a panel discussion on the importance of the oil and gas industry to the Midcontinent at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma. There certainly isn’t a lack of opportunity in terms of resources in the Midcontinent. Davis reminded the

audience of the various plays in the region that were ready for extraction and the countless business opportunities available through them. “The Midcontinent is composed of so many kinds of plays. It’s so different than some of the other kinds of basins with the shales, the rocks, the limestone and the [Mississippi] chat [a combination of chert, limestone and dolomite],” Davis said. “There are so many different types of formations and so many different players here that are active.” According to Leathers, the main concern for operators in eastern Oklahoma is working around the American burying beetle, which has been categorized as “endangered” by the U.S. Fish and Wildlife Service since 1989. He said there are reports that the bug should be removed from the endangered list, yet it remains an obstacle pipeline operators must consider. In western Oklahoma, the oil and gas industry must work around the lesser prairie chicken, which was listed as a threatened species in March 2014. “There are programs in place to work around some of those issues depending on where you’re at and where you’re operating and trying to drill wells,” Leathers said. “There’s a very big burden for some operators and some pipeline companies to manage that issue.”

From a national perspective, Poarch said Williams Partners – which merged with Access Midstream in June 2014 – primarily deals with state regulatory agencies for its pipeline projects. However, when its projects cross state lines, the company must adhere to Federal Energy Regulatory Commission (FERC) guidelines, as well. Poarch said the average lead time for a FERC approval is a year and a half. “Williams has proposed quite a few projects in the northeast to move gas, and the permitting process has a significant impact,” Poarch said. “Obviously that strands gas, it affects pricing significantly, and all those costs ultimately are usually translated to the consumer who ends up paying for those extra administrative costs and delays. That regulatory system has a significant impact on our business and ultimately the whole economy of our country.”

Even if commodity prices continue to dwindle, midstream pipeline companies should be busy with projects for years to come if recent studies are any indication, according to Poarch. He said there are tens of billions of dollars’ worth of projects annually required for infrastructure, which is great news for Williams Partners. “That’s our business and there’s a tremendous amount of demand across the country for that major infrastructure,” Poarch said.

“The Midcontinent is composed of so many kinds of plays. It’s so different than some of the other kinds of basins with the shales, the rocks, the limestone and the [Mississippi] chat [a combination of chert, limestone and dolomite],” Davis said. “There are so many different types of formations and so many different players here that are active.” Despite oil prices being on a downward trend, Leathers remains confident that the industry will be able to withstand smaller margins within reason. He credits the industry with being an adaptable business that will find the best ways to make money no matter commodity prices. “There will be ample opportunities to grow in the pipeline business, and I think on a going-forward basis, our industry is very resilient,” Leathers said. “As we learn how to unlock the secret code in various plays, we get more efficient. Making Sense of Regulations Determining state or federal primacy often is the main factor in maintaining compliance with mandates.

No matter where a company is attempting to produce oil and gas, there will be state and federal regulations to follow. The question most times is which government takes the lead in these mandates, and that oftentimes remains unclear to countless operators. “Primacy – it seems to me that’s the heart of the issue,” said panel moderator Jim Willis, Consultant at Natural gas Intelligence. “Who is the first among equals here?” Willis led a discussion on regulatory compliance at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. Keith White, Director of EH&S for Chaparral Energy, said the oil and gas industry is fortunate that Oklahoma historically has been an energy friendly state, so regulating agencies often work hand-in-hand with business.

With so many agencies involved – Willis describes the regulatory environment as an “alphabet soup” due to the various acronyms – primacy between federal and state regulations constantly comes into play. White cites the example of Chaparral Energy’s work in Osage County, Oklahoma, which also is the location of the Osage Indian Reservation. The company performs CO2 injection in this part of the state while refurbishing a 1930s-circa field to extract additional oils.

“Rather than having a confrontational attitude with our regulatory agencies, typically we will be collegial, and it almost always boils down to a dialogue between the two,” White said.

Since the play is located on a reservation – which is sovereign territory – the Osage Nation also has mineral rights as if it were a state, according to White. The bureaus of land management and Indian affairs have regulations that must be met, as well.

how they’re approaching projects, water contamination, spill response and things along those lines.” No matter how many organizations are involved, the key to working through regulations efficiently is by forging relationships with those who enforce them, according to Stuart Wittenbach, Director of EH&S for Cimarex Energy. “It’s learning about working with those people,” Wittenbach said. “It’s really about people skills. You have to work with those agency offices and district offices to understand what’s on their radar screen and how do you comply with that so you can have your project move forward.”

One area where regulating agencies and oil and gas companies are working together is to determine the sources of Oklahoma’s increased seismic activity. Cimarex is one of many companies sharing their seismic research with government bodies to help create the most accurate results possible.

Although its use is not regulated yet, water is at the forefront of discussions within many oil and gas businesses. Kirk Schoppe, Water Resource Manager for Select Energy Services, said his company has clients who work with water in a variety of creative options for removing water. “As far as setup, it really runs the gamut and sometimes you see some pretty creative options, whether that’s a frack tank farm or aboveground containment with your SWD [salt water disposal] tied in with a manifold from your SWD to store it so that it is ready to move to location, or built up enough so you can complete your well,” Schoppe said. “Others we’ve seen actually tie into the network of pipelines or underground systems directly to temporary hose to move it from well to well.” Many companies attempt to reuse produced flowback water on their wells. However, that depends on the geology of the play and whether or not a specific formation can handle that type of water. “It really depends on the formation geologically where you’re at,” Wittenbach said. “You don’t want to spend $3 [million] to $8 million and then use the wrong constituent water to go into the well and not have return on your production that you expect.”

“We were allowing on our input to help the agencies in that study get it accurate,” Wittenbach said. “They have good science based on it. It’s not something that is driven by what the public sees. I can say personally I lived in Oklahoma City and I did feel some earthquakes. Alarming? No, not really, but we do need to know if what’s happening there is the norm or if it’s something unusual.”

The New Leader in Oil As the top oil-producing nation in the world, the United States is in the midst of an “industrial revolution.”

Fourth-generation oilman Greg Lorson, CEO of environmental services firm TEEMCO, takes umbrage with the statistic that makes Americans out to be gluttons for the world’s energy. “To say that we consume 25 percent of the world’s energy is really a misnomer,” Lorson told attendees of the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. “We utilize 25 percent of the world’s energy to produce goods and services for the rest of the world. And we’re doing it in an increasingly efficient manner; we’re doing it in an increasingly green manner; and we are doing a great job of developing our natural resources and gaining energy independence for this country. It’s going to change the landscape not only of this country but of the entire world.” As someone who has been in the energy industry for 30 years, Lorson sees this period in U.S. oil and gas history as more than an economic boom – he describes this era as an “industrial revolution,” citing the facts that the United States has grown from nine oil-producing states to more than 20 and has increased oil production so dramatically that the industry now contributes more than $1 billion a day to the nation’s economic output. “We also have a number of changing geopolitical circumstances occurring not only globally but domestically,” Lorson said. “We have a growing

population. We have emerging economies. With all that driving oil production, I would say its way more than a boom – it truly is an industrial revolution.” One of the geopolitical game-changers stemming from the increased production of U.S. oil is the nation’s dwindling reliance on foreign sources of petroleum. According to the Institute for Energy Research, the United States took over as the world’s largest oil and natural gas liquids producer in the world in July 2014. The U.S. oil industry produced more than 11 million barrels a day for the first five months of, and it overtook Russia as the world’s largest natural gas producer in 2010. As a result, U.S. oil imports have decreased by almost half since 2005, according to Lorson. In 2013, the United States imported 32 percent of its oil vs. 60 percent in 2005. Lorson also said that the United States still spent $427 billion on imported oil, which represents a large void to fill for the domestic industry. “We’re still spending a lot of money on imported oil,” Lorson said. “That represents a lot of opportunity. We’ve got a lot of ground we can cover as we continue to reduce our imports.” Not only has the United States reduced its oil imports, but for the first time since 1949, according to Lorson, the United States is now a net exporter of refined products.

The nation exported over 1 million barrels of distillates and gasoline in 2013. Refined petroleum products exports exceeded 3.5 million barrels last year. Also in 2013, according to Lorson, the United States set a monthly record of 4.3 million barrels in one month.

“Today, the environment is the battlefield – that is what is being used against the industry,” Lorson said. “We’ve got to earn our social license to operate, and that means protecting the environment and changing the public perception of what we do.

The next step the United States must take in its increasing dominance of the worldwide oil market is to allow more exporting of crude oil, according to Lorson. The United States primarily re-exports crude oil it brings in from Canada and other nations. Last year, the U.S. oil industry was able to export some crude to Spain, Switzerland and Italy.

With these figures in mind, Lorson sees no reason why the federal government should keep the crude export ban in place. He called upon the oil and gas industry to help change the mindset of the American people about its business to combat the stigma that often stifles progress.

Emissions have dropped significantly over that same time period, according to Lorson. In 1949, the oil and gas industry produced almost 1,200 metric tons of emissions per $1 million of GDP. In 2011, emissions stood at 412.

“Years ago, you may recall the battle cry, ‘Drill, baby, drill’ – well, we’ve drilled,” Lorson added. “I say our new battle cry needs to be ‘Ship, baby, ship’ – let’s export oil.”

However, according to Lorson, the numbers don’t match up to the arguments from environmentalists. Lorson said the industry is increasing its efficiency. He cited the reduction in millions of British thermal units (Btu) of per dollar of gross domestic product (GDP) as one way of measuring energy efficiency. In 1949, Lorson said, the United States was at $17 million per GDP. That number decreased to $10 million in 1989, and it went down to $7 million in 2011. Less is More The lesser greater prairie chicken has the oil and gas industry maneuvering a complex conservation plan in order to operate in the Midcontinent.

You’d have to forgive compliance managers throughout the oil and gas industry if they mistook the lesser prairie chicken for Oklahoma’s official state bird. Considering how much the U.S. Fish and Wildlife Service (FWS) and the Oklahoma Department of Wildlife Conservation (DWC) have focused on regulating this grouse’s habitat, it’d be an easy error to make. Instead, the lesser prairie chicken is one of a number of species the FWS was forced to act upon as part of a multidistrict litigation settlement of a 2011 court case. As part of the settle, the FWS agreed to put a timeline to ultimately come to a listing decision on a variety of species between 2013 and 2018. There are at least 27 species connected to Oklahoma, and the lesser prairie chicken was first among them on FWS listing timeline. A few hours after Oklahoma Attorney General Scott Pruitt took the FWS to task for allowing “regulation through litigation” like this take place by settling out of court instead of going to trial, FWS Biologist Ken Collins and DWC Research Supervisor Allan Janus explained the listing process from the Endangered Species Act and the a multistate effort to grow the population of the lesser prairie chicken. According to Collins, the lesser prairie chicken occurs in five states – Colorado, Kansas, Oklahoma, Texas and New

Mexico – as an obligate grassland species, which means it resides in grassland areas and not forested areas. As the forest begins to encroach into the grasslands, the chicken can’t persist. In fact, Collins said some research shows the lesser prairie chicken could require as much as 25,000 acres just to have a single self-sustaining population. As the grasslands get smaller and smaller through a process called fragmentation, the lesser prairie chicken numbers begin to decline. Fragmentation is caused by a variety of factors, including oil and gas development, wind farms, transmission lines and roads. “If you take a large parcel that’s essentially contiguous from border to border, it may not be identical from border to border,” Collins said. “It may have some diversity within that area all for the most part unbroken. Fragmentation is the process by which that larger, unbroken parcel gets broken into smaller and smaller pieces.” In order to maintain state primacy over the conservation of the lesser prairie chicken, the Oklahoma DWC has led a five-state coalition to develop the Lesser Prairie Chicken Range-wide Conservation Plan. According to the Western Association of Fish and Wildlife Agencies, the Lesser Prairie Chicken Interstate Working Group – which consists of Oklahoma, Texas, Kansas, New Mexico and Colorado – developed the plan to emphasize tools and incentives to

encourage landowners and others to voluntarily partners with agencies in habitat conservation efforts while also achieving their land-use needs.

“We did work with folks and were able to get clearance for projects but it was a lot more cumbersome than some folks expected.”

“Under the Range-wide Plan, we went through and listed all of the threats and discussed ways to mitigate for those threats,” Janus said. “So when you enroll in the Rangewide Plan or become a part of it, mitigation – while folks tend to focus on that – is equally important or more so important in my mind as the conservation measures that are agreed to and implemented upon enrolling in the plan.”

With five states involved in protecting the lesser prairie chicken and the FWS overseeing the listing of the species through the Endangered Species Act, the question of primacy could bring confusion to the oil and gas industry’s compliance efforts. However, Janus said the Lesser Prairie Chicken Range-wide Conservation Plan was drafted specifically to keep regulatory authority with the states.

There are many conservation measures in place that vary depending on the specific type of impact. Janus said the oil and gas industry typically is most concerned with the avoidance of 24-hour operations during the breeding season of the lesser prairie chicken, which is between March 1 and July 15. This restriction is imposed with 1.25 miles within any known leks, or mating areas.

Surveying was a huge issue this past year because of the timing of the listing, which was announced at the end of March 2014 before going into affect at the beginning of May 2014. “So, industry did not have a big heads up, and not a lot of folks got geared up to do surveys in some areas, and because of that weren’t able to get clearance,” Janus said.

“We all grouped together and all felt similarly that the species should not have been listed,” Janus said. “That was the ultimate goal of the Range-wide Plan – to preclude the need to list the species, which ultimately did not work. But it also serves as a recovery plan, as well.” As dire as the situation currently may be for the lesser prairie chicken, landowners still have the right to profit from their land. Moderator Jim Willis, Consultant at Natural Gas Intelligence, asked if conservation measures are necessary for species like the lesser prairie chicken, or if nature should be allowed to take its course. “Maybe the lesser prairie chicken has seen its days,” Willis said. “We won’t cry over spilled milk. What’s wrong with that attitude?” While many people may not miss the lesser prairie chicken were it to become extinct, Janus said the species’ struggles are indicative of larger problems within the environment of its natural habitat. “It’s endemic of a greater problem,” Janus said. “We talk about indicator species often in biology, or keystone species, and if you see one going down, it talks about the greater health of the environment. There is a reason to keep that species and keep that habitat out there for the greater good of society.”

Guiding the Efficiency Whether using conventional drilling tools or advanced geosteering technology, oil drillers in the Midcontinent aim to keep costs down.

When drilling an oil rig can cost tens of thousands of dollars a day, companies will take any and every opportunity to add efficiency to their operations. One would expect the number of rigs to decrease as efficiency rises. Instead, according to Dexter Steis, Executive Publisher of Natural Gas Intelligence, rig counts continue to rise alongside production. “What we’re looking at today is we’re seeing more rigs and we’re seeing more efficiency from those rigs and that’s resulting in greater production,” Steis told the audience at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. Steis, serving as Moderator, was joined in a panel discussion on efficiencies in rigs by D. Steven Tipton, P.E., Completions Engineering Advisor for Newfield Exploration, and Juliana Tarazona, Geosteering Specialist for Halliburton. As of the date of the summit – October 31, 2014 – the U.S. rig count was up 11 percent. Fifty-four percent of that increase was in the Permian Basin, but the second largest increase to the land rig count is due to the Cana Woodford Shale in Oklahoma, which represents 9.3 percent the U.S. rig count growth, according to Steis. Steis also cited a Raymond James report that said rig count would increase another 5 percent in 2015.

According to Tipton, Newfield Exploration has applied a variety of new technologies to its operations in order to drive efficiencies. Newfield is operating eight rigs in the Cana Woodford Shale today, and in the northern region, the company has taken its rigs setups down from 45 to 50 to less than 20 days mostly by removing intermediate casing strings, watching its mud program more closely, and by improving drilling tools to some degrees. No matter the application, Tipton said the most important factor to consider is time required to set up a rig. According to Tipton, the costs to drill rigs can run anywhere from $50,000 to $80,000 a day, so eliminating days leads to significant cost savings. “Anything you can do to cut the amount of time you spend drilling a well is what you should be looking at,” Tipton said. “I don’t look at this stuff mostly as new technology, but how we’re applying the technology we already have available now.” A relatively new method many drilling contractors have adopted is geosteering. According to the American Association of Petroleum Geologists’ (AAPG) Explorer magazine, geosteering relies on subsurface data being interpreted in real time to provide the geologist on the well with the information necessary to enable the driller to stay on target in the lateral leg.

The key time-saving aspect of geosteering is the speed with which wells can be drilled as drillers receive their information in real time. In conventional motor drilling, the drillers must wait for information to reach the surface before continuing. “An important difference between the motors and the rotary steerables is the speed and how fast you can drill,” Tarazona said. “Rotary steerable saves a lot of time because that technology helps when you want to steer your trajectories when you’re not drilling vertical wells, but when you’re drilling deviated wells or horizontal wells. That helps to guide the well pad faster compared to a motor or mud motor because you can change the direction you’re drilling while drilling without waiting to give the orientation to the motor.”

While geosteering often proves more efficient than conventional drilling, the technology has more up-front costs attached to it and isn’t always suitable for all geologies. Tipton said Newfield always considers rotary steerable drilling for its well pads, but it isn’t always the best solution for a variety of reasons.

The Midcontinent oil and gas industry has spread into the South-Central Oklahoma Oil Province (SCOOP), a relatively new play that, according to the AAPG, targets the Woodford Shale across parts of a seven-county area and southwest of Oklahoma City. Also, operators are working in the Springer Shale, as well. Tipton said Newfield is one of the two biggest players in the SCOOP (Continental is the other), where the Woodford shale has stable geology. The Springer Shale, according to Tipton, will prove difficult because it is not as stable. In the Springer, Tarazona said Halliburton can help drillers stay within the zone with or without its geosteering capabilities to maximize efficiencies by providing pre-well studies to understand what the best sensor is to use on a job. “Even if companies are building the horizontals by themselves, we want to give them the proper tool or sensor to help them stay in zone because that’s the objective of everybody,” Tarazona said.

Shaking Out Solutions The Oklahoma Corporation Commission and other state agencies are working with the oil and gas industry to determine the source of increased seismic activity.

The last time the Oklahoma oil and gas industry had a pending environmental issue about to blow out of proportion, the industry partnered with environmentalists to launch FracFocus, today used by 15 states to monitor chemicals used in fracking. That was 2012. In 2014, oil and gas operators in Oklahoma are besieged by demands to know if their business is contributing to the seismic activity felt throughout the state. With increased seismic activity throughout Oklahoma, the state’s Corporation Commission is leaving no stone unturned in attempting to determine the exact cause of the temblors. According to Commissioner Dana Murphy, the oil and gas industry operating within the state has been more than forthright with its information about the geology of the most affected areas as the state and the business work together to keep the industry going. On October 28, 2014 – a day before Murphy delivered remarks at the Oil & Gas Awards Midcontinent Industry Summit – representatives from the Oklahoma Corporation Commission, Oklahoma Geological Survey, governor’s office and other researchers updated a legislative committee on ongoing efforts to better

understand the state’s ongoing earthquakes, according to a report by The Oklahoman. Murphy told the audience that the commission is now looking at 10 kilometers around 4.0-magnitude events or significant swarms of activity to determine if there are disposal wells or any other possible triggers in the area. “We are going through with a fine-toothed comb to make sure that every operator that is actually disposing in any formation,” Murphy said. The dominant formation the state is investigating is the Arbuckle formation. According to The Oklahoman newspaper, the commission specifically has been paying more attention to the how deep disposal wells are drilled in this region and whether they approached or cross into the so-called “basement rock” that underlies the Arbuckle. To possibly prevent further seismic activity, Murphy said her commission will shut in the well if there are any issues encountered with these wells in this region. “To make sure that the wells are properly permitted, if there are any types of issues with anything or minor problems, they’re shut in,” Murphy said.

According to Murphy, the U.S. Geological Survey (USGS) is not all that concerned with injection wells as a catalyst for Oklahoma’s seismic activity. She said this is because these wells are water flood or enhanced recovery, which means water is injected and produced at a particular reservoir, so pressure is consistent for the most part. Deep disposal wells, however, are an area of concern for the USGS.

“It makes a big difference in knowing exactly where some of these faults are so that we can be looking and know where to focus some of our attention, especially with regard to applicants or where operators might request to put in disposal wells,” Murphy said. “We’re really looking for some correlation between these seismicity events and what’s happening in the area.”

Help is on the way for the Oklahoma Corporation Commission, as well. Murphy said Oklahoma’s Secretary of Energy Michael Teague has approved her agency’s request to hire a reservoir engineer to study the container of the Arbuckle in conjunction with the operations that are occurring there.

Murphy praised the oil and gas industry for working handin-hand with the Oklahoma Corporation Commission to share information about the geology of the land. She said a great deal of the data the commission has been provided as proprietary information from 3-D seismic that the industry had.

The commission also now requires seismicity language in some of its orders, and those orders pertain to where operators are putting in a disposal well within the area of concern. With 11,000 disposal and injection wells installed throughout Oklahoma, trying to determine the source of seismic activity may require another FracFocus-type initiative between industry and the watchdogs. “I have to give a lot of credit to the industry in Oklahoma who have really collaborated with the regulators to provide proprietary information so we have better fault maps,” Murphy said. “I have to commend some of the larger companies that are looking at recycling and reusing water because that’s a challenge on an economic basis. And the challenge for us as regulators is to do enough to protect the public and look out for the safety and welfare of the public, and to make sure that the industry can operate.”

Keeping the Community Informed The oil and gas industry must continue to win the battles in the court of public opinion to retain its social license to operate.

Oil and gas companies operating in Oklahoma may have to work around the mating season of the lesser prairie chicken and submit proprietary 3-D seismic information to comply with regulations, but the state overall is quite energy friendly compared to other regions of the country. As Dexter Steis, Executive Publisher of Natural Gas Intelligence, pointed out, the U.S. oil and gas industry has had to diffuse the backlash from: •

The Gasland movie franchise;

A 2011 New York Times series about documents from the Energy Information Administration calling the validity shale gas reserves into question; and

Hydraulic fracturing ban measures appearing on ballots throughout the United States.

As Moderator of a panel discussion focused on best practices for communications in the oil and gas industry, Steis relayed his experience visiting Colorado in August as Colorado Gov. John Hickenlooper and the Colorado Oil and Gas Association was maneuvering to remove initiatives related to local control of oil and gas from the November ballot. According to the Denver Post, U.S. Rep. Jared Polis (D-Boulder) agreed to drop two measures he supported aimed at requiring drilling rigs to be set back 2,000 feet from homes and bolstering local control

by adding an environmental bill of rights to the state constitution. The Post also reported the removal of two industry-supported measures – one of which would have withheld state oil and gas revenue from communities banning drilling, and another which required a fiscal impact note for all initiatives. “Had those local control measures gone into lay, a lot of experts believe it would have seriously derailed oil and gas production in that state for some time,” Steis said. “If Governor Hickenlooper ever needs a job, I seriously think we in the energy industry should hire him because he’s a winner and he knows how to fight.” The panelists for this discussion play key roles with their companies to prevent those fights from coming to fruition. Robert Hatley, Vice President of Communications and Strategic Outreach for Williams Co., said one way his company has avoided clashing with the opposition is by bringing the communication function of project development into the upfront work conducted by land teams. By obtaining this intelligence before breaking ground, Hatley said his department can influence routing activities to help avoid potential conflicts. “We have a series of gating activities we go through when we evaluate projects and different milestones that we meet and commitments to decide whether that

project is actually going to come to fruition,” Hatley said. “[Communications] is engaged in that. There are check-offs that we want to do from a communications perspective and a community perspective to understand that.” Once a project is ready for shovels to hit the ground, the community outreach becomes an ongoing effort. For David Eberhardt, Vice President of Human Resources for Chaparral Energy, said there are multiple ways to give back to communities to stay in residents’ good graces, including money and employment opportunities.

Chip Carter, Vice President of Corporate Communications and Business Development for Jones Public Relations, believes this method is best applied when top-level executives get involved with the community directly. He suggested having executives that resonate with them personally. For example, a CEO may be interested in Habitat for Humanity but isn’t involved with the organization in any way. Carter said businesses should leverage that excitement for a good cause.

The most important, in Eberhardt’s opinion, is leadership. Chaparral Energy accomplishes this by following up requests for contributions from the community with making sure the money is used wisely.

“People connect with passion,” Carter said. “If you’re passionate about something that some people may think is dull, but you’re passionate about it, it’s going to be lively. If that’s where your heart is, then you need to identify your company with where your heart is.”

Executives shouldn’t have the only say in how a company supports the community, however, according to Eberhardt. To get the rest of the Chaparral Energy workforce involved with community outreach, the company formed the Chaparral Cares Committee. This is a group of even individual contributors in the company who come together to discuss potential outreach efforts based on what they’ve heard from within the community.

“If we see an opportunity to give money to the community, we always ask the question, ‘Who works for us that can get involved there and provide leadership to see that the money is being put to good use?’” Eberhardt said. “Let’s not just throw money at the problem, but let’s use this as an opportunity to give more than just money by giving some influence to the community through having our employees involved in building up those programs.”

“Typically, those aren’t huge dollar investments, but we have enough passion among those individuals that we can be nimble in that regard and respond to those quickly,” Eberhardt said. “What’s important to us is that it’s not limited to the executive team making all of the decisions as it relates to outreach. We want to empower all of the employees to act whenever opportunity comes around.”

Changing Hearts and Minds In order to bring a culture of safety preparedness to an oil and gas company, buy in must take place at every level.

There oil and gas industry is a dangerous one – a fact operators do not ignore because it cannot be ignored. The inherent risks involved in this business enter the mainstream media’s scope when accidents like the Deepwater Horizon explosion in 2010 make international headlines.

Dan Regouby, HSE Manager of Systems Integration for Willbros Group Inc., said the only way a safety program takes hold in a business is if there is passion about the initiative at the top of the organizational chart. There’s a fine line between wanting zero incidents and believing that being injured is unacceptable, Regouby said.

However, according to the U.S. Bureau of Labor Statistics, 1,077 oil and gas workers lost their lives on the job between 2003 and 2012, including a high of 142 workers for that period in 2012 alone. There are also concerns about respirable crystalline silica levels at hydraulic fracturing operations to be considered among a host of other potential hazards.

“If we can convince them that when [Willbros’ employees’] hands hit the task, and they believe that they will be supported doing it the way it needs to be done – with excellence and safety and all of those things – then we see the dots connect,” Regouby said. “And when that happens, the lagging indicators will see the safety that we’re looking for.”

Most environmental, health and safety (EH&S) managers agree that an overall shift in the corporate culture of the oil and gas industry is the most powerful way to protect workers in the field. Making that shift a reality, however, often can be more easily said than done.

While executive embracement of a safety program may bolster workforce acceptance of the new culture, middle management often needs a reminder that these practices are necessary for the good of everyone. Keith White, Director of EH&S for Chaparral Energy, said the best way to appeal to those not coming around on a safety culture is to show how work stoppages can cut production tremendously, so preventing incidents is worthwhile in the long run.

“The biggest issue is trying to change the culture in a workplace and how difficult it can be sometimes,” said Carolyn Davis, Senior Editor of Natural Gas Intelligence and the Moderator of the job site safety best practices panel discussion at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City.

process for them to learn that production can be inhibited by an accident – the whole process stops, and there’s the cost of litigation. So it’s actually more efficient to look at safety and prepare to operate in a safe manner than it is to concentrate strictly on the production side.” Oftentimes, executives must be convinced there is an issue with their company’s safety culture – or lack thereof, in some cases. White said in these instances with Chaparral, he has likened himself to an expensive insurance salesman because he primarily conducts risk assessment to determine which safety issues need the most attention.

Brent McWilliams, Field Technician for Total Safety, admitted his company’s solutions oftentimes can be a costly pill to swallow for its clients. For example, some operations may require a safety employee on site 24 hours a day. But Total Safety has earned a reputation in the industry for providing honest assessments of safety needs throughout the industry.

“Because of the size of the company and the complexity of the issues, you’re not able to attack all safety issues at one time,” White said. “So you have to do a risk assessment to find the most problematic issue which could be the worst outcome for the company, and that’s what you concentrate and focus on first.”

This relationship often starts with the formation of an emergency response plan, which operators then share with local first responders as part of an incident command system. Cimarex Energy faced an emergency situation in September 2014 when the Pecos River flooded in the Permian Basin. The company initially gave way to Eddy County, Texas, officials to handle the situation, but Wittenbach said the county actually asked more of Cimarex than expected. “If you do not have a formal emergency response plan, you need to have it,” Wittenbach said. “You also need to have an incident command system because when we went to Eddy County, they wanted to know who was the incident commander and who was the liaison officers. And if you don’t know that system, you’re going to be really behind the curve.”

Fail to Prepare, Prepare to Fail The goal for oil and gas operators is to avoid incidents, but for those rare instances they occur, it is best to be ready to manage them.

As the oil and gas industry awaits the results of the National Petroleum Council’s advice on emergency preparedness for natural disasters – as requested the U.S. Department of Energy Secretary Ernest J. Moniz – there is no reason not to adopt emergency preparedness techniques and methods already widely available. According to Jillian Robles, Supervisor of Business Continuity for Devon Energy, prevention of incidents is the top priority, but with numerous models and templates to follow currently, there’s no reason oil and gas operators can’t prepare today for the worst possible outcome tomorrow.

“Each and every day, each of us has a strong responsibility to ensure the safety of our employees, our vendors, our contractors and the general public from the hazards of our industry,” Robles told attendees at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. “Much of how we handle a response comes from how we prepare. The rest primarily from how we manage it. So it only makes sense that a company should have a coordinated management system in place to ensure that they can effectively manage an incident once it happens.”

One method oil and gas operators can follow is the guidelines the Federal Emergency Management Agency (FEMA) lays out in its incident management system protocols. This system is aligned with the national response framework and Presidential Policy Directive 8,

“It is a program mandated for use by first responders, federal agencies and all agencies receiving federal preparedness funds, so it is widely used across the U.S.,” Robles said. “In addition, policy actually speaks to critical infrastructure, those who can be engaged in any emergency-type function, and the private sector. We are all encouraged to utilize the national incident management system concepts and the incident command system for response tactics.”

“The guidance that the American Petroleum Institute provides us is pretty common sense,” Robles says. Oil and gas companies can establish “who does what” by forming an incident command system, which is based on having the right people in the right place at the right time with assigned responsibilities in the event of an incident. Robles said case studies have proven that relationships developed in advance of an incident helped to lessen the stress of the incident, provided upfront clarity of expectations and capabilities, and provided an overall teamwork approach to the response.

According to Robles, when a tornado damaged Devon Energy’s Cana gas-processing plant in May 2011, the company was able to partner with other natural gas companies to push the gas elsewhere instead of shutting everything in. “We’ve seen this at Devon in numerous cases where we’ve had incidents and we’ve had to reach out to our community partners as well as our other oil and gas partners for assistance,” Robles said.

Training is a critical component to any emergency preparedness plan, according to Robles. Conducting regular exercises to validate training and knowledge of these plans is how oil and gas operators can ensure those responsible and accountable for executing the plan know it and understand the interdependencies of it as they relate to the company operation and community partner responses. Robles believes knowing what not to do can be just as vital as knowing what to do when managing an incident. Companies have added legal officers to their traditional incident command system staffing to ensure this portion of incident management is not overlooked. “Your legal department will become your best friend during a time of incident response,” Robles said. “If they aren’t added in at the incident command level either in the field or wherever that incident command post is, they’ve even put them in as their emergency operations center as an advisor to help support the incident management team.” Knowing what matters requires examining the interdependencies a company has with other entities, including public officials, the surrounding community, first responders and products and services needed to mitigate the impacts of an incident. “This plays into truly your situational awareness of your company, and what your company must have to adequately respond to an incident,” Robles said.

Training is a critical component to any emergency preparedness plan, according to Robles. Conducting regular exercises to validate training and knowledge of these plans is how oil and gas operators can ensure those responsible and accountable for executing the plan know it and understand the interdependencies of it as they relate to the company operation and community partner responses. For companies interested in a model for its emergency response training exercises, Robles suggested the Homeland Security Exercise and Evaluation Program (HSEEP). According to FEMA, HSEEP provides a set of guiding principles for exercise programs as well as a common approach to exercise program management, design and development, conduct, evaluation, and improvement planning. Devon Energy relies on this program for its training exercises, and Robles said one of the reasons she likes it is because it provides numerous templates companies can use to build exercises, along with a variety of other useful tools. Robles also recommended involving local first response agencies that receive federal funds that are required to use HSEEP in these exercises. These agencies are mandated by their grant program to follow these procedures, so they not only are prepared for possible incidents by oil and gas producers, but meet their federal requirements for drills, as well. No matter how much oil and gas companies prepare for incidents, Robles emphasized that there always will be an unpredictable element to operations. That makes emergency preparedness even more vital for the industry. “There will always be unknowns – there will always be things we never anticipate could or would ever happen,” Robles said. “But for the risks we do know, and for what we understand about the consequences those risks could create, we have the opportunity to prepare for, mitigate against, and hopefully prevent from ever occurring. A strong incident management program is a must for a company in the oil and natural gas sector.”

Diverse Opportunities The Midcontinent region’s mix of shale characteristics give oil and gas operators a run for their money.

Many frustrated oil and gas operators have come to realize the Midcontinent region features a mixture of geological formations. This makes the only guarantee that comes with working in the area is that no two formations will respond to the same completion techniques. “They’re using different kind of completions, and they’re finding different things because even though [the Midcontinent has] long been a gas producer in certain parts –the Ardmore Basin has been very reliable – producers are working the oil zones, and it’s become a different kind of beast,” Carolyn Davis, Senior Editor of Natural Gas Intelligence, told the audience at the Oil & Gas Awards Midcontinent Industry Summit in Oklahoma City. Davis served as moderator for a panel discussion on increasing reservoir contact and drainage efficiency in completions in unconventional shale. One good thing about having so many different formations is the opportunity to experiment with a variety of completion techniques, according to Don Unruh, Exploration Manager for Sullivan and Co. His company recently completed a large dewatering of a transition zone in the Burbank Field on the Osage Reservation in Oklahoma. Traditionally, this field had required large multistage fracks into an 80-foot-thick, highly porous and

permeable sand, which he described as “out of step with the rest of the industry.” However, the key to this completion, Unruh said, was to move as much fluid as possible out of a single borehole, effectively stripping operation to recover oil and natural gas liquids as economically as possible out of the fluids. Unruh described another experimental completion using water-free fracking techniques. This completion relied only on CO2 and sand in a “very modest zone,” and as of the summit, Sullivan and Co. had surprising productivity results from the frack in a zone where seen water influx damage caused by the fracking process. “This CO2 frack allowed us to get water totally out of the picture,” Unruh said. Another new technology being used in completions in relies on nanotechnology, according to Frank Zamora, Vice President of Engineering for FTS International. These technologies include the nano dispersed particles and the complex nanofluids, which are emulsion-based nanofluids. Zamora said producers using nanotechnology are reporting increases in production up to 15 percent.

“In optimizing your overall cost structure, the more production you get for your investment, the better off the system is,” Zamora said. “These new nanotechnologies are the latest and greatest in oil and gas, and there some key operators actually using both systems right now.”

Zamora agrees that proppant logistics is the biggest issues related to the product, but he also has encountered shortages of certain in-demand proppants. The industry now demands smaller sizes, whereas courser proppants were the rage in the past.

Advances in drill bit technology also has helped drive down the costs of completions, according to Unruh. His company recently budgeted two days to drill an 80-foot core interval, but by using current bits, Sullivan and Co. finished the work in just two hours.

“Now that we’re down to 30/50 or 40/70, and in many, many cases, even 100 mesh – which used to be a waste product – it’s a highly demanded product,” Zamora said. “So, the shortages of certain sizes have definitely become an issue. There’s a tremendous demand out there and only a certain amount of mines that are providing that.”

“The bit salesman is our favorite person,” Unruh said. “It is constantly amazing what can be done with new bits. The changes are phenomenal in what we’re seeing, and the technology continues to take good incremental steps.”

However, the key to this completion, Unruh said, was to move as much fluid as possible out of a single borehole, effectively stripping operation to recover oil and natural gas liquids as economically as possible out of the fluids.

Specific types of proppant have enabled companies to increase production, as well. However, those products, they can be difficult to bring to the Midcontinent region, according to D. Steven Tipton, P.E., Completions Engineering Advisor for Newfield Exploration. Since white sand sourced from Wisconsin, Minnesota and other northern states is the proppant of choice, transporting the product can become a logistical nightmare. Tipton said Newfield has had to give vendors a forecast of three to six months so the company can get its materials when required. “It’s more of a transportation issue than a supply issue,” Tipton said. “The rails are full of other things, so it is difficult to get some of our supplies to the place we want them when we want them.”

Fresh water for fracking jobs also is in short supply, according to Tipton. Due to a drought conditions that have plagued the region for some time, Tipton said Newfield has been trying to stay ahead with its drilling operations between six to nine months to make sure it has water to complete its wells. Newfield also has looked into recycling water for its completions. “Depending on the area that we’re in, a lot of the farmers’ ponds that we used to use have dried up, and streams have dried up,” Tipton said. “Being able to work with the landowners and the Oklahoma Water Resources Board to get fresh water for our frack jobs has been very difficult some times.” Despite the variable geology, challenges with materials and decreasing oil prices, these industry veterans remained positive about the future of the oil and gas industry in the Midcontinent region. “I’m kind of bullish for the next five years,” Zamora said. “I think there’s still a lot of development as well as going back and refracking some of the wells that have existed, so there’s a tremendous amount of boreholes out here that could do some new restimulation and increase production.”

This presentation showed a genuine commitment to safety innovation at the highest levels of the company. Root cause analysis and real time sharing of incident information are not unique to C&J but seem to have been implemented well in order to earn a 100% grade in customer safety audits, including audits by some very thorough customers. The tablet based driver log is another innovation that would seem to have good acceptance prospects.

C&J has concentrated on emphasizing HSE auditing and training to improve its safety record, particularly through its Root Cause Analysis Program. All non-compliances with company driving safety and driver qualification standards are treated as audit incidents and are subjected to a root cause investigation and corrective actions. Uniquely in the industry, C&J supplies all its drivers with an electronic log tablet so that employees operating a company vehicle are in direct contact with their vehicle and management, enabling personal responsibility and supplying all with an HSE tool.

Like all the applicants they have a robust safety system. However, there are two items that stand out. First the anticipation of EPA regulatory requirements and pro-active steps to meet those requirements. Secondly, the insightful recognition of the age gap between baby boomers and Gen X created by the recent surge in oil and gas development and tailoring training that recognizes this gap.
