uest of Honor at the Southwest Oil & Gas Awards was Chairman Barry T. Smitherman, Railroad Commission of Texas.
leadership directives from Barry designed to increase efficiency, promote transparency, and be more responsive to the public’s needs.
Barry Smitherman was elected to Railroad Commission of Texas, in a statewide General Election, with 74% of the vote, in November 2012. He was previously appointed by Governor Rick Perry to the Railroad Commission in July 2011, and was selected Chairman by his colleagues in February 2012. The Commission regulates the oil, natural gas, surface coal mining, pipeline and gas distribution utilities in Texas. Despite its name, the Commission no longer regulates railroads.

Judge’s Comments: P2 Energy solutions being one of the largest consulting companies in the world, deserves to win with their perseverance. They helped a Dallas-based company go from 105 operated wells to 1,127 operated wells and 867 nonoperated wells. P2 illustrates a strong history of service and commitment to clients since its beginnings. It has transformed itself to accommodate clients and stay ahead of their needs. It shares commitment to its employees by providing an innovative Company culture. The results it can reach with clients is solidly outlined in the FWB case presented.
Eighty-five years ago, P2 Energy Solutions’ roots took hold. The year was 1928. The man with an idea was 32-year-old Edgar Tobin. Is U.S. Really On Track To Become “Saudi America?” Chris Faulkner, President & CEO Breitling Oil & Gas
It’s fun to toss around terms like “Saudi America” and contemplate the possibility. What if…? It’s not as preposterous as it may sound. In fact, Texas alone now produces more oil than the U.S. imports from Saudi Arabia. The U.S. government recently doubled its estimates of recoverable energy in North Dakota’s Bakken and Three Forks shale formations, to 7.4 billion barrels of oil and 6.7 trillion cubic feet of natural gas. And, according to the International Energy Agency (IEA), the U.S. is on track to surpass Saudi Arabia in oil output by 2017. In addition, the price of West Texas Intermediate (WTI) crude -- the benchmark for domestic oil prices -- has been increasing, suggesting that the WTI is back as the world’s leading oil benchmark.

At the same time, OPEC recently announced it expects demand for its oil to drop by 300,000 barrels a day next year, and projections for future demand for OPEC oil are flattening even as OPEC members compete more fiercely with each other for market share.

The U.S. and Mexico have formed a mutually beneficial relationship, with Mexico exporting most of its oil production to the U.S., then importing 60 percent of its gasoline back from the U.S. China Could Help or Hurt U.S. Goal of Reduced Imports from Middle East These favorable relationships bode well for the U.S., but there are no guarantees. Looming large as a possible threat is China, which has been quietly buying interest in oil and gas companies in the U.S. and Canada. While China’s investments could help the U.S., financing further exploration and development, the question that remains to be answered is whether China’s deals in Canada and the U.S. also give China the leverage it needs to control energy markets. It’s a worry we can’t shrug off. Chinese oil companies are not privately owned; they operate with the backing of the Chinese state. A recent deal in Canada raises red flags because it increases China’s influence over American access to Canada’s reserves. Since 20 percent of U.S. oil flows from Canada, it’s not unreasonable to be nervous about any potential for China deciding to act against U.S. interests by cutting off some of that supply. Fracking Should Be the Solution But Could Be the Problem Fracking continues to be a lightning rod for criticism, protest, and seemingly endless new regulations, despite, or maybe aided by, a seeming dearth of credible data

Oh, there’s plenty of data, and it generally weighs in favor of fracking. The Energy Institute at the University of Texas at Austin published a report in 2012 titled “Fact-Based Regulation for Environmental Protection in Shale Gas Development.” The authors conducted an exhaustive study of the claims versus the facts, concluding that there is little actual evidence of risk to aquifers: “None of the water well claims involve hydraulic fracturing fluid additives, and none of these constituents has been found by chemical testing of water wells.”
Journalists like Sci-Tech-Today reporter Kevin Begos have also attempted to find evidence supporting the dramatic accounts of health problems stemming from nearby gas wells. Begos tried to find supporting evidence for claims made by environmental groups and Josh Fox, the maker of the antifracking documentary “Gasland,” in a letter to New York Governor Andrew Cuomo. In his July 23, 2012 article investigating the claims, Begos reported that he was unable to get any form of confirmation from researchers at the University of Texas Southwestern Medical Center, the Texas Cancer Registry, or Susan G. Komen for the Cure.
A 2011 study by Duke University concluded: “We found no evidence for contamination of drinking-water samples with deep saline brines or fracturing fluids.” Even environmental groups have come up short of verifying the anti-fracking claims. For example, the Pacific Institute, a nonprofit organization whose stated purpose is to “create a healthier planet and sustainable communities,” tackled the question of fracking’s impact on water resources. Its June 2012 report noted that while there are numerous anecdotal accounts of polluted water sources and/ or adverse health effects caused by suspected fracking pollutants, “Most significantly, a lack of credible and comprehensive data and information is a major impediment to identify or clearly assess the key water-related risks associated with hydraulic fracturing and to develop sound policies to minimize those
Unfortunately, anti-fracking groups persist with their own unsupported claims, hyperbole and outright lies about fracking, while discounting the data from reputable institutions like the University of Texas because of alleged conflicts of interest. “Saudi Americas” a Worthwhile Goal Between the constant threat of disruption due to political unrest and the increasing terrorist attacks on oil infrastructure in the Middle East, the Western hemisphere has all the reason it needs to continue striving toward a goal of independence from oil from the Middle East, if not a goal of becoming the “Saudi Americas.” Continued exploration, investment in improved technologies, and maintaining a strong partnership with old allies and close neighbors will all be key to unlocking that American dream.

During the day of the Awards gala dinner and presentation we hosted the 2013 Southwest Oil & Gas Awards round table discussion. The round table gave industry leaders a chance to sit down and discuss some of the key topics and challenges of the day.
DC: Thanks for attending the round table, there are a number of topics that I would like to discuss but for the most part I think we can see where the conversation takes us. My name is Daniel and I am the Chairman of the Oil & Gas Awards, can I ask that we go around the table and introduce ourselves please?

CF: Chris Faulkner, CEO of Breitling Oil & Gas, we’re an independent E&P and we have operations through two business divisions. One is drilling liquids out of conventional plays in Mississippi, Oklahoma, Kansas, Eagle Ford and the Three Forks, Bakken. The other thing we have done for the last ten years is develop mature old oil fields, conventional oil fields, shallow stuff, Gulf Coast onshore Corpus Christi and Duval County. Non-sexy assets I would call them, wells that we drill for $500,000 vertically, run acid - no fracking and they produce 60-70 barrels a day. Or, we rework wells that have been drilled in the 50’s so not moving the needle, or any kind of excitement but, you know, economically they work really well. RW: Ray Walker, I’m the COO at Range Resources. Range is a $12-13 billion market cap, publically traded company and the

company has been around since ’76. We started in Appalachia, through a series of mergers with John Snyder and some other people in Fort Worth, became a Fort Worth company called Range Resources. In the early ‘90’s John Pinkerton was senior VP at Snyder and became CEO, at the time they were very much an acquire and exploit company mostly centered in Appalachia buying old properties fixing it up, drilling a few wells. The day I went to work for Range, in ’06, they had 14,000 wells in Appalachia and average production was less than 10 MCF per day, per well. We drilled a lot of wells, 600800 a year at that time, and we had a really brilliant geologist that had a great idea to try a Marcellus completion in ’04, today we have over 500 wells and we’re close to a BCF coming out of the Marcellus and it’s probably a couple of years away from being the largest producing gas field on the planet. MK: I’m Mike Krancer, I was formerly the Secretary for Governor Corbett for environmental protection and presided over I think the key time from 2011 through about 2013. Now, I am the energy petrochemical natural resources practice leader at Blank Rome, an international law firm based in Philly. GL: I’m Greg Lorson, CEO of TEEMCO. We are a registered professional engineering consulting firm, we’re environmental engineers first and foremost and this is my 32nd year in the oil and gas business. I’m a fourth generation oilman and I love our industry. I’ve watched for years as we get heat and we’ve always had heat,
but with the advent of the green movement I think we’ve been under more political pressure recently than ever before. So about five years ago we started our environmental engineering company to serve the industry. To be a guide if you will, trying to help oil and gas companies comply with the regulations. We’re very pro oil and gas but also very pro environment and we don’t think the two interests have to be in conflict. We now have the largest market share of any environmental engineering firm in the country with over 1,400 clients. DN: I’m Dennis Naeger, Director of Marketing, Water Management at Tetra Technologies. Essentially what Tetra does is; everything in terms of pumping, filtering, light water transfer, blending, water treatment, flow back, production testing, recycled water on location, so essentially everything - hauling it and disposing of it.
DC: Today we will discuss regulation, public opinion, technological developments and the opportunities and threats to our industry. To begin, energy independence is a common theme at the moment, what does this mean for the USA, the World and where is the market at the moment? MK: Let me kick off one thing and I would love to hear what others think, I was in Pittsburgh, where I was the keynote at the Energy Inc event. Some folks ridiculed me, and this was to be expected. I made the point that the bumper sticker ‘Frack a Well, Bring a Soldier Home’, means what it says - that we have projected military powers in nations costing trillions of dollars over a generation into the Middle East, into Afghanistan, in the Middle East and this is an opportunity literally to cease that. When you think about it historically, the Roman Empire was dependent upon the Middle East and would have loved an opportunity to render the Middle

East irrelevant in terms of its food supply. We have an opportunity now to bring our soldiers home and stop spending our money on projecting military power. That poll that just came out, you might have heard this because Newt (Gingrich) said this when he spoke at Shale Insight - 80% of the American population did not want to get involved in Syria. That tells you something, that tells you that America is looking for something different than projecting military power and as Newt said, and he said it so well, this is not a republican or democrat issue and it’s not an isolationist issue. He says that there are hawks and doves, but he has invented a new kind of bird - an owl, to be wise. In a very, very broad sense, that’s where I see on a big picture the opportunity that the United States and North America and our allies share. CF: I did an interview with CNBC, they are running ‘US Oil Boom Week’ and they’re interviewing people from all over. The topic was energy security and what does it mean? What does this US oil boom mean outside of America besides the obvious? There are thousands of things we can talk about for the
benefits to our country, but what does it mean to the Middle East or China or wherever? It’s interesting when you think about the energy for security deals we have done over the past several decades and the fact that we still look back at the Arab embargo in the ‘70’s and have some concern it will happen again. We’re out dealing with China in the Strait of Malacca, where the Fifth Fleet is guarding that waterway for them, and when you go there, you talk to people in those countries and they are concerned. If America can become, not an oil island, but self sufficient or not relying upon the Middle East as much as China is going to, they will be importing more than 50% of their oil from Middle East, they’re concerned whether we are still going to be the energy police of the world. I think Beijing understands, they just built a 6,000 meter pipeline from Turkmenistan because they want to try to avoid this Achilles heel, which is this waterway. It’s interesting, you go to the Middle East and they think that we’ll always be married to them, but you see comments from President Obama, that basically says, maybe we should
look at someone else taking over the role of the energy guard of the world and then china pretty much comes back and says no. The United States is doing so well and we have 3.9 trillion reasons to make you do so. It’s interesting and I think no one realizes what these ten million people in America are doing, what all this energy coming out of the ground means and what it means to surpass Saudi Arabia as the biggest oil, bio fuel, NGL’s and crude combined producer of the world. RW: I agree with everything Chris said, but I don’t think the American public understands the situation, and I think a lot of the leadership gets parts of it. The President is talking positively about gas, positively about the environment, and positively about energy independence. All these things we’re hearing and seeing, we’ve got the science and the data and the facts to back it up, but I just read before I came here an email that synthesized a bunch of articles from the last week about the surveys going around, ‘do people approve of natural gas and American energy and independence?’. All these good things that we’re talking about and 80% plus in every single survey wants energy independence, however, in almost the same sentence it asks ‘do you approve of hydraulic fracturing?’. You can’t have one without the other. Initially, we didn’t do a good job of educating the public and until the public gets educated they’re not going to put pressure on the elected officials, who are not going to put the right policies in place and we’re

Working on demand, creating jobs, educating the public, all of that has got to be a big part of this because, anybody that knows anything or takes time to research gets to that same conclusion really quickly. DC: Is it because the communication channels aren’t in place? If you are within the industry you can’t but read about all the positives. Is it that the press is miscommunicating the actual facts to the people? CF: It is according to whom you ask and what your vantage point is. If we go back to 2008, that’s in my mind when this whole media storm took place, where you’ve got Shawn Penn rolling out to Pennsylvania and Yoko Ono and the other yahoos up there, the mainstream got that understanding in their minds, prior to us telling them the facts. I Googled fracking recently and I went through forty something pages of Google and I didn’t find one positive story. Forty pages deep! That’s 400 entries that were

MK: The other problem is playing one industry against another, which I always decry because it is like paying the cannibal to eat you last. I heard a radio advert for heating oil in my hometown the other day that really pissed me off. It talked about methane gas escaping and said at the end ’we don’t have to frack anything to get ours’, which actually, is maybe not even true, I don’t know, but this is the heating oil industry attacking the natural gas industry, which is really unbelievable. RW: Part of what happens is what I call the “reasonable man theory”; everything in life fits a log normal distribution whether it’s the amount of rainfall in a certain county in Texas over 100 years or its public opinion. 80% of us fit under that bell curve and on the fringe there is five or ten percent on each side that are clearly outliers. Who does the press talk to? These people on the outside because most of us in the middle, we can sit down and talk about it and we end up reaching the same conclusion and we agree with each other. I’ve seen it time after time at Range, during my four and half years in Pittsburgh I’ve spoken with many different conservation groups and there was never one that walked away that didn’t agree with what
we were doing. We just simply laid it out for them, addressed their questions, reasonably, and went through everything point by point. Unfortunately, we’re also trained socially that if you hear two opposing sides to the story you tend to think the answer is somewhere in the middle and a lot of times it’s not. GL: Another mistake we’ve made as an industry, is we’ll put together a great campaign; I know the IPAA did some ads a few years ago. We’ll raise money, our associations will raise money, come up with a great ad campaign, and then we run it in Houston! It is the people on the West coast, New York and Florida who are voting in the majority of the electorate. That’s where the majority population is and they’re the ones that control congress. The entire oil vs environment issue has been politicized. A lot of politicians know better, but they also know how to get elected, and that comes first. DN: It really comes down to the individual; the individual has to see the direct benefit from it. The best way you convince somebody to do something is when they see a personal win for them. We talked earlier about the folks in city centers, they live well, and things like that, people in Houston get it, they get because they see their home appreciate, their day to day lives are impacted positively by the oil and gas industry. They don’t see that on a day-to-day personal level in Florida so they’re not going to be connected with it. So, it’s a matter of connecting them to a personal win.

DC: In terms of people actually seeing the benefit, we talk about this abundance of oil and gas and the feedstock that is going to revitalize manufacturing in the USA. How long is this going to take? When you look at the infrastructure to take advantage of the natural gas that is being produced, at what point will it be visible to the average person? MK: It is going to take time; you take this message to your people. We need to do this at our cocktail parties, grocery stores, churches, companies and communities. The message is that this is a benefit to you because your son or your daughter might be in the military. You don’t want their child who is in the military to be hurt or killed and we all pray hoping their son or daughter comes back in one piece. We have changing political dynamics, the nonsense of America’s ethanol policy right now vis-a-vis oil, that is crafted because around twelve States produce corn. They’re forcing us to do these stupid things at refineries that we are now trying to get out of. Twelve States, that’s twenty-four Senators. We now have around thirty oil and gas producing states, that’s sixty Senators! That’s different from ten years ago, when it was around ten producing states. So, we do have political shifts that are taking place and we also all have a job to get out there and do this communication.
because they had already Googled fracking, there was no fracking in their country and they were already pissed off. In our meetings the communities say time and time again we don’t believe the full page Wall Street journal adverts that the industry takes out, they see the ads run on television and they just think it’s all gloss and it’s all fake, because anyone can pay for that advert when you’re one of the majors. When you go and sit down with people, like you guys did, we had judges and local yokels and they all asked questions - we had environmentalists come in, it’s about the conversation, it isn’t about who’s right or wrong. People are hearing there are two sides to the story and that’s important. One problem is that the industry has had this mentality where everything’s top secret, we can’t tell you what we’re doing because it’s a proprietary trade secret. We have been cavalier and now we realize; oh, the public has a lot of power! The industry has missed this whole social media movement. We now have instant communication across the world. The industry thought we can just buy Wall Street journal and TV adverts and we’re going to fix it all, I think
that’s a misnomer. The issue is at the grassroots; of course you can’t go and talk to everyone in the United States. However, there are ten million people that work in our industry, if they have one conversation a day, it’s a whole lot of conversations. That could have way more effectiveness than just buying big adverts. DC: Chris, you have been to the UK recently, where a lot of people are hoping that we develop shale gas. Not forgetting the people don’t own mineral rights, they’re the Governments. Do you think shale development will happen and what would it mean to the US? RW: At most investor conferences I get asked, and I probably go to 9 or 10 a year and as a company we go to about 50 a year, what impact is shale development overseas going to have on the US? There is no doubt technically, geologically and in every other way you can look at it that there are big shale reservoirs in every producing province. There are big source rocks and technically a lot of those are going to work, but, I will tell you realistically and commercially very few are going to work in any time frame that
CF: You are right, I’ve heard it from a lot of different people; people love their communities. At Breitling we ran a corporate social responsibility program up in the Granite wash play near Pampa last year and we have been running them ever since. I stole the idea from Poland; they were doing this (town hall meetings) in the early days of fracking. They got the villagers involved in the conversation,

At literally every investor conference I get asked what impact is shale development overseas going to have on the US? we care about. Because the people don’t own the rights, you don’t have entrepreneurial, fast acting companies that are willing to do things there, and as a producer you’ve got huge political risk. We, as an industry, have lots of experience developing international assets in Countries that tomorrow can wake up and say they’re just going to nationalize the whole thing. You’ve made enough money. You’re done. A lot of people will say; well the majors are going to figure it out, I’ll argue with that till the cows come home, the majors are not going to figure it out, the majors missed the boat in every single shale play they’ve been in.
MK: Their whole approach was, pardon the pun, fractured from the beginning. It was based on keeping things secret, it was based on outlining the whole panoply of risks first without putting everything in context. The regulatory context that we already have in Pennsylvania or Texas was results oriented, it was to build the case that the EPA was a result oriented with policy driven studies more than anything else. Where they’re with it, who knows? I mean as Ray well knows the EPA has shown its ineptitude, anything involving hydraulic fracturing in Parker County Texas, in Dimmick Pennsylvania, in Pavillion Wyoming and it’s no mystery, they were never in the fracturing business.
DC: Let’s talk about domestic risk, what risks does the industry face in the US? MK: Federal regulations, I think federal regulatory risk is the number one risk for fracturing operations. DN: What is the status of the EPA hydraulic fracturing report? I thought the first part was supposed to be issued the first quarter of 2013. MK: It was delayed. DN: We had a preliminary report, I think, a year - a year and a half ago with some interest around all kinds of different things disclosure of chemicals, ground water, we had some interest around metering or monitoring water flows etc…

From the day this Clean Water Act and Safe Drinking Water Act was passed, it was decided then, that States should be the ones to regulate hydraulic fracturing. DN: So, you don’ think any federal regulations take any traction or are getting any hold right now?
MK: No, that’s not what I said! (Laughter) RW: Well, I think it’s becoming more unlikely that it will happen because, now, you’ve got the president talking positively about it. The things we talked about earlier are becoming real. To me the window of time where they could have put something like that in place is closing pretty quickly. It doesn’t mean that the risk goes away; I just think it is a little less because we’re beginning to educate some, and people are beginning to live through the cycle. The EPA thought they had three really strong cases, they struck out on all three cases, all those things are adding up and people are beginning to take note of that. The media is beginning to take note of that. DN: I understand that. We hear a lot of interest around water conservation obviously, even though we’re using less than 1% of the water for hydraulic fracturing compared to some of the other areas. There are strong incentives, strong interest in terms of reusing water, yet it becomes more difficult to do for a whole host of reasons and it is very well specific, location specific, everything else. With that, do we see regulations becoming tighter, or through our education are they’re softening? RW: A good story about that, every time I see one (lifts a bottle of Pellegrino water from the table), I remember this story. One of my very first meetings with John Hanger who took over the

DEP right after Katie Mcginty put the moratorium on the Marcellus. I went and met with him early on, told him who we were, that we were here for long haul and that we thought this was going to be big. Three or four meetings later, was the infamous meeting where Governor Rendell and his staff were in the room, talking about the fact that there were going to institute some new standards, new drinking water standards in the state of Pennsylvania. They were going to set the end of pipe discharge limits

standard then the Federal Law must incorporate that standard into the regulatory rules.
So, yes, there is going to be increasing regulations, we’ve seen the cost of our impoundments for recycling water start out at $300,000 to $400,000 and there is no doubt that we needed to make some improvements and put some monitoring rules and different things
GL: The good news is that we have the opportunity to impact what rules are coming. I believe a fracking rule is coming. We can impact it long before it gets to the public comment area, long before it gets way down the road in the regulatory side of things at the EPA. We can impact it at the ASTM level. The committee is a cross section; industry, academia, regulators, NGO’s and community representatives.
MK: So, who makes up the ASTM?
RW: Are there Petroleum engineers and petroleum geologists? GL: Yes, there are geologists and engineers. I’m optimistic that the ASTM is going to come out with a science based standard which may be little more than what the industry is already doing; it’s just going to get codified. MK: That bothers me because not only do we not have control of that process, the process is not State based.
at 500 milligrams per liter, and there was no real basis for doing that, the EPA didn’t set that. We had Ken Komoroski and all kinds of back up material from all these different river commissions across the country; it was just unsupportable, what they were going to do. Clearly they were doing it to force us to stop disposing water through the old ways. (Which we had already decided to do, but it really pushed us in to recycling faster so in all, it was a really good thing.) I was sitting there and they had put Pellegrino water out, I’m just looking at it, frustrated and trying to think of what I’m going to say next. I said Mr.
in there, but today those, that same impoundment is $2.5m and there has only been one permitted in the entire state in the last two years. GL: The EPA is still very much formulating the idea of regulating fracking. I think what’s going on from what I’ve observed is that they’re waiting for the ASTM. I serve on an ASTM environmental committee and we have been asked to, and have taken on the task, to create an ASTM standard for fracking. The EPA also serves on that committee and they have said that by Federal Law; when the ASTM comes up with an industry
RW: And if it is, the best you can say, it is just doing what we are already doing, then it is duplicative and it’s wasteful of taxpayer dollars. MK: That’s telling me as a Pennsylvania regulator that my system is not good enough or to a Texas regulator that your system is not good enough. CF: Do you think these EPA regulations are being focused on Federal lands or do you think they’re going to try to lay another…? GL: Across the board…

I’m optimistic that they are going to come out with a science based standard, which is really going to be no more than the industry is already doing, it’s just going to get codified.
CF: So, saying the president is high on natural gas and how he’s positive on the industry I mean that’s all smoke and mirrors.
MK: Everybody in this room knows that Federal lands are like zero productive compared to private lands, and that doesn’t surprise anybody. GL: As an example, if you look at phase-one environmental site assessments; in the EPA rules it says you must do this under various different circumstances and you will do it pursuant to ASTM 1527. That’s how they do it and I think we’re going to see the same kind of thing coming with the frack. You must perform the frack pursuant to ASTM number… MK: I think that is very negative. RW: That kills the industry and I can’t believe anybody in the industry or academia would go along with that. It Prevents us from trying anything new, it prevents us, I mean, we would never be doing what we’re doing today versus three years ago if rules like that were in place, and can you imagine the time it would take to change something like that once it’s in place.
GL: The point that I’m trying to make is that we have an opportunity to write our own law. I believe the rule is going to happen; it’s inevitable. Now, we either step up and help write it ourselves, or they’re going to write it for us. The way we can write it is through the ASTM standard. Once the standard exists, it can be changed. It takes a little while, but not as long as you might think. Within six months you can write a change to a standard. There is a very formal process to go through to change or create a standard. The ASTM meets all the time and if you have a change you need made, you go through the process. MK: I’m not sold on that. RW: I agree we can’t just ignore it, we shouldn’t ignore it, but I see no positive outcome in that. GL: I agree there are issues, but I do believe it’s inevitable, what should we do? We can be apposed to it, fight it and accomplish little or we can be proactive, participate in the process and be heard. MK: Who said it is automatically executable under federal law? I understand the ASTM standards for site assessments were built in to the law. It says if you do it pursuant to this ASTM standard
you get the innocent landowner defense etc. However, I don’t see a mechanism right now, I may not know it because I didn’t do the homework that you did, that says when a ASTM standard is passed it automatically becomes binding Federal law… GL: No, you misunderstood me; I didn’t say it becomes binding federal law. If the EPA comes up with a rule, (which they have said they’re probably going to do for fracking); the EPA is required by law to incorporate any existing standard into their rule. If they create a rule to regulate fracking and if there is an ASTM standard, then they must incorporate that standard in to the fracking rule. If ASTM comes up with a fracking standard, the creation pf the standard does not force the government to do anything. Within the Federal rule making process we can only comment, we don’t get to write the rule. The regulatory agencies write the rule and then we can argue, reactively. With the ASTM we get a lot more input, proactively. DC: But, if there is nothing there to begin with, then the EPA don’t have to consider it. That topic also raised the President’s Climate Action Plan… MK: If you were one of those people who wanted to pit one industry against another; if you were in the natural gas industry and you saw the climate change

action plan come out you’d say this is great! We’re the ones who are going to benefit from this because natural gas is going to be a big player, already is, but is coal really going to go by the wayside? CF: Coal has a target on its back. DC: What are your opinions on that? CF: Natural gas meets the standard that the President set forth, coal does not. The reality though, is that this is based on the idea of a very depressed natural gas price, so I think that coal displacement is hinged around this $4 number. If we start talking about LNG transportation, manufacturing, feedstock, supply coming down - if natural gas goes to around $5.00 or $6.00, what does that do to the overall picture and idea of us against coal? You have to ask yourself if it get back $6 or $7 do people’s minds to change? DC: On the point of economics and keeping prices low, technology plays a big part in that - Ray what is happening in your world? RW: Even as far along as we are in the Marcellus today, I think there are some 7,000 wells that have been drilled in the play, so far, with another 1,000 waiting to come online. I think we’re maybe in the second or third inning of the game, I think there are huge improvements coming in drilling technology, fit for purpose rigs and water. Today, on the downhole side, I’m not saying it’s easy, but we are way up the curve in downhole. The infrastructure, demand and logistics behind

moving water and moving drilling cuttings is where we are seeing big improvements today. At Range, we’ve got rigs in South West PA that are literally three times faster than they were 18 months ago, three times! It’s just insane, it’s becoming a problem for us because we can’t budget enough capital to keep them busy all year! (Laughs) They’re just too fast and every time they drill a well we’ve got to go frack it! MK: What is making them faster? I’m just curious. RW: For years and years, I used to be a driller, so I understood this. Someone would bring an idea, we need to drill this well outside Casper, Wyoming. You would go and research and you might find some old bit records and different records from wells that had been done there years ago and you’d use everything you know. You’d go drill your well and you might get there trouble free, you might beat the curve and you might not. In the meantime while that well was drilling, they’d bring you another one and say we now want you to go drill in West Texas, then in South Texas, or go drill in the Bakken. We’d go do all of those and you never got to practice. Now, we give you a rig and say Mike you’re going to drill 5,000 wells in this county in the next five years, I want you get better at it! Now they can design bits for the play and more, and these drillers are so good, they’re watching it from their computer and they can see the little curves and say we need to mud up or do these different things to get faster. We’re thinking completely differently about drilling rigs, we’re
even running drilling rigs off of LNG. Before we decided to make the leap and spend $500,000 to convert one of the rigs to LNG, in just the few months that it took to make the decision to order the equipment and get it out there and figure out who is going to bring the LNG to the rig and all that sort of stuff, Caterpillar had already upped their computer technology such that they can take 1900 BTU field gas. Wet gas straight off the location and run it, it’s insane, how are they managing the exhaust gas temperatures, its just phenomenal technology. So, that’s what we’re going to see. The fact that today we’ve got gas prices at $4.00, plays like the Marcellus, Bakken, Eagle Ford, West Texas and all the hot things that are going on right now, there are huge gas banks waiting to come online or huge oil banks depending on where you’re at. The instant we believe we’re going to get a quarter more gas price, boom, we’re going to bring a 1,000 more wells online and we’re going to drive it right back down. So, there is going to be this happy medium, a lot of people say $3.00 to $4.00 or $3.50, $4.50 maybe even $5 or $6 if there is a spike. Right now there is a big arbitrage in the international market, in the middle of Europe they’re paying $15 to $18 in MCF. So, if we can build LNG export facilities and put it on a ship and it is about $5 or $6 dollars there, there is a huge effort to get it over there and sell it and so we’re talking about 8 to 10 BCF of exports, but its probably 2016-2018 before they come online. We’re talking about big gas to liquid plants, huge technology changes. Did you know, that if you took all of the

one ton vehicles in this country and converted them to CNG tomorrow that’s 65 BCF a day, we only make about 70 or 72 BCF right now. DC: One of the key things I wanted to look at was technology and Ray kindly gave his views, I would like to put the same question to Greg. GL: One thing that we’ve focused on is air regulations, because with Quad-O and the different components of Quad-O that are coming on, it could be very expensive for a lot of companies to comply with that. At the heart of air regulation is the emissions inventory. Basically the law says you have to know what your emissions are, you have to do an inventory and if you’re polluting, if you’re emitting, then how much? If you are over the legal threshold, then you have to take action. That action might be an air permit, reporting to the EPA, or reducing your emissions. I don’t know if you saw the TCEQ study on air emissions? They took twenty facilities, sealed them and took the actual measurements and ran the best selling air models that the industry uses on those same facilities. The industry uses computer modeling to count their emissions and the most commonly used models grossly overstate the emissions. We’re our own worst enemies because we’re reporting that this is what we’re doing. The fact is, we’re not doing anywhere near that kind of emitting. At TEEMCO our IT department focused on that problem and I think we’ve solved it, at least to a great extent, we found that the most commonly used models overestimate emissions by about 1,200 percent!
CF: Small margin of error!!! GL: Yeah give or take 1200 percent, this is what you’re putting into the atmosphere! We rewrote the model and came up with one that also over estimates, but it over estimates by less than half of one percent. It calculates emissions almost exactly at the actual emissions rate. I think that’s going to be a game changer because once you know what your emissions actually are, then you will only comply with what you really have to. When you are considering buying a vapor recovery unit you are going to get the right size. Not only our company, but other companies are going to develop more and more accurate technology to monitor, measure and control emissions. Just like we’re doing on the drilling side because the law is here. Unlike fracking rules, air emission rules are already here and we do have to deal with it. DC: Dennis, can I please ask you the same question about your business? DN: The real picture is around water, for us it’s getting the trucks off the roads, it’s minimizing the amount of water that is disposed
of never to be used and seen again and minimizing the amount of surface ground water that’s being used for fracking. That’s the visibility, that’s what lots of people are concerned about, they see trucks on the road, running through the land, tearing up the roads and making noise. That brings a lot of visibility and a lot of negativity to our industry and particularly to hydraulic fracturing, which has already been identified as the buzzword for us all. CF: I agree with Dennis, I know he’s in the water business so he’s probably got a biased viewpoint, but when you look at what is driving a lot of the backlash against the industry, I think water is the big lynchpin for a number of things. Recycling water is not cheap, cleaning water is not cheap, as a small operator those costs add up. As it becomes a bigger part of the industry, it gets cheaper. In drilling we have come a long way, we’ve still a long way to go when it comes to completion side of fracking and the water usage. DN: Cost is a big driver and we want to maximize productivity out of the wells and we want to do it at the lowest cost - while mitigating risks associated with that. A big part of the risk is around water and cost is around water when you are looking at $10 to $15 a barrel of water, water is a big expense. What we want to do is drive cost out of water management and driving those costs out is in the trucking and disposal. That’s our technology, that’s where we’re focusing, we’re developing technology to take trucks off the road and less disposal because that’s what the costs are, period.

It is difficult to move a successful company and grow at the same time, and on a time record of 99.5% is very impressive with the current activity level.
From Lakes beginnings in Houston in 1949 with four trucks to over 100 units at 8 locations in 2 states the company has always sought to challenge competitors, economic conditions, conventional thinking but mostly itself. By always asking itself ‘What’s the Next Step?’ Lake is always able to come up with new and innovative ways to learn about and serve the clients up and coming unmet needs. The administration’s (and ergo the EPA’s) attitude towards the oil industry seems to be thinly veiled contempt. The president pledged to lead our country toward a hydrocarbon-free status albeit he admits it could take decades. The motivation for a hydrocarbon-free goal is pollution. Certainly pollution is a serious health hazard so a hydrocarbon free nation is ideal but only theory. It’s tantamount to saying we want a conflict free society. Great in theory but not realistic. The technology doesn’t exist to accomplish such a goal and it might not ever exist. In the meantime, the oil industry must contend with increasingly difficult environmental regulations. The EPA and its state counterparts have created a maelstrom of regulations affecting the petroleum
industry. The regulations raise energy costs, are difficult to understand and comply with, and their effectiveness at eliminating pollution remains to be seen. We may never be hydrocarbon free, but with effort, we may become pollution free… which is really the point after all. American oil companies have led the world’s energy industry. With the right mindset, these same oil companies can lead the world to a pollution-free energy industry. Some of this nation’s greatest scientists, business people, and innovators are found at oil companies. Today’s political and regulatory threats viewed with a positive mindset, present a challenge for the industry to; instead of facing destruction-byregulation, find opportunity and future growth.

We’ve all heard that the United States represents 4% of the world’s population and consumes 25% of the world’s energy.
The “green” movement is a wave that’s been building for thirty years in this country. With the election of the Obama administration, it’s become a tsunami. Is this good or bad? Either way it’s a challenge. U.S. Energy Consumption and Pollution We’ve all heard that the United States represents 4% of the world’s population and consumes 25% of the world’s energy. Reading the popular press, it’s easy to get the impression that the United States is an energy consuming, polluting giant with a small percentage of the world’s population that’s hogging the biggest share of the world’s energy. They would have us believe at the heart of this are oil companies and their “obscene” profits. Do you sometimes begin to feel guilty? Before you renew your Prozac prescription, consider the following: According to the U.S. Central Intelligence Agency, the United States is the third largest population (behind China and India) occupying the fourth largest country by land-mass in the world. The United States occupies 3.71 million square-miles; China, 3.72 million, Canada, 3.85 million, with Russia covering 6.6 million squaremiles. We have a big population living in a large country. It takes a lot of energy to produce goods and services for our quality of life and on behalf of the rest of the world.

World Bank records show the United States easily has the largest economy with a gross domestic product over $14 trillion, dwarfing our nearest rival Japan’s $5 trillion. We export much of what we produce to benefit the rest of the world. The International Monetary Fund ranks the U.S. third in the world for annual exports just slightly behind Germany’s $1.12 trillion and China’s $1.19 trillion. It takes a lot of energy. Many countries actually consume far more energy than the U.S. on a per capita basis. The United States isn’t even ranked in the top-ten. The World Resources Institute says Canada, Iceland, and Norway use more energy per capita than the U.S. It’s not just cold countries with high heating bills either. Trinidad, The Virgin Islands, Kuwait, and Qatar all consume more energy per capita than the U.S. and this is just a partial listing. None of these countries produce even a fraction of the goods that the United States produces and exports for the benefit of the other 96% of the world’s population. Some environmental pundits and some of our leaders would have us believe 4% of the world’s population consuming 25% of the world’s energy is a point of shame. This writer believes it should be a point of pride. The U.S. is 4% of the world’s population working hard to produce for everyone else. It takes a lot of energy. Do we pollute? Yes. Are we the worst? Nowhere near. Yale University and Columbia University have developed what’s called the Environmental Performance Index (EPI). The EPI uses a proximityto-target methodology, which quantitatively tracks national performance on a core set of environmental policy goals. It
identifies specific targets and measures the distance between the target and current national achievement. The EPI provides both an empirical foundation for policy analysis and a context for evaluating performance. The EPI attempts to balance the “humans first” thinking versus the “nature first” thinking so as to rank countries by their respective environmental health and ecosystem vitality. During the Bush administration, of 149 ranked countries in 2008, the United States was ranked 39th best. Far ahead of its industrial peers with the exception of Germany which was only slightly ahead. Under Obama in 2012, the U.S. fell to 49th but still outperformed its industrial peers, with the exception of Germany and Japan. The United Nations in conjunction with Yale University, the Center for International Earth Science Information Network at Columbia University, and the World Economic Forum developed a scoring system called the Human Development Index (HDI) which ranked the world’s greenest nations in 2008. The United States was ranked 23rd greenest out of 141 countries studied. Again the U.S. far outranked all its industrial peers except Germany (ranked 21st).
Another aspect of the Human Development Index is a comparative measure of life expectancy, literacy, education, standards of living, and quality of life for countries worldwide. It is a standard means of measuring well-being, especially child welfare. The United States ranked third in the World behind Norway and Australia which were only hundredths of a point ahead. The Energy Information Administration of the US Department of Energy has yet another scoring device. This score compares air pollution to the size of the economy. It measures a nation’s carbon footprint in terms relative to its gross domestic product. Known as World Carbon Intensity, the United States’ carbon intensity for its economy was higher (ranked worse) than Japan’s and Germany’s. However the U.S. was still in the best 30% worldwide with a .54 ranking; far better than China’s 2.84 or Ukraine’s 7.62. Nearly half the world’s countries scored 1.0 or higher. The United States does pollute and the oil industry is a contributing factor. Pollution isn’t simply a U.S. driven problem; it’s a world problem. The U.S. is already more part of the solution than most of the other 96% of the world’s population despite our “consumption” of 25% of the world’s energy. Given our economic productivity, exports, relative “green” rankings, and favorable carbon footprint; the United States’ “consumption” of 25% of the world’s energy should be viewed more accurately as a utilization of those energy resources for the benefit of the world. Given the Human Development Index rankings, the United States is certainly leading the world on how to use energy to create the highest quality of life for its people.

NCS Energy Services, LLC., is an independent technology and services company specializing in multistage completions. In 2007, NCS introduced a new multistage frac service, the Mongoose Frac® System, which combined sand-jet perforating with a proprietary resettable frac-isolation tool to eliminate the need for pumpdown plugs and ball-drop sliding sleeves. The system also enabled operators to design completions with no practical limits on the number and placement of stages. NCS introduced this system to the U.S. market in late 2009.
Faced with a specific customer challenges with many variables NCS demonstrate their adaptive approaches which appear to have exceeded customer expectations whilst saving significant costs! All achieved with a keen eye on HSE.
In 2010, NCS developed a new sliding sleeve (the Grip/Shift sliding sleeve) that works in conjunction with the frac-isolation assembly to further streamline multistage completions by eliminating the need for perforating. Environmental Regulations We speak of Obama’s EPA however there’s enough blame and/or credit for everyone. The 1972 Clean Water Act goes back to Nixon. The 1990 Oil Pollution act was passed during Bush senior’s administration. Bush-43 doubled the EPA’s budget during his eight years in office and President Obama doubled their budget yet again during his first eight weeks in office. The green movement is a tsunami. Most of the new EPA regulations directly affecting the oil industry were promulgated during Bush-43’s administration with a Republican congress. Obama’s EPA essentially ratified what had been done before them but is promising to add more. As CEO of the largest environmental engineering firm for the American petroleum industry, I’m in a position to hear the views of many owners and operators regarding environmental regulations. Many owners and operators object to the new regulations even when they agree to the idea of stopping pollution. I think many don’t realize the affect our industry has had on the environment. According to an independent study commissioned by the EPA, there’s been over 50,000 reportable oil spills in the U.S. during the last thirty-years.
Over half came from SPCC regulated facilities. The average spill volume was 5,900 gallons of crude per spill. According to research conducted at the University of Tulsa, one gallon of oil can pollute one-million gallons of water. That means the oil spilled during the last thirty-years is enough to pollute more water than flowed over Niagara Falls during the same time period. That’s a bunch of water. One hundred fifty thousand gallons per-second flow over the falls. Imagine twenty-four tanker trucks full of polluted water going over the falls… each second… for thirty years. The solution is sound environmental policies and best management practices adopted by oil companies. U.S. Vice Admiral James Stockdale, Navy Pilot and POW during Vietnam went on to serve (among many achievements) as president of the Naval War College. He said: “You must never confuse faith that you will prevail in the end – which you can never afford to lose – with the discipline to confront the most brutal facts of your current reality, whatever they might be.” The reality is that some oil companies have polluted, incurring multiple acts by congress and regulators to control the industry as a whole. The likelihood of these regulations ever
abating is extremely low. Recently the EPA has publicly target the petroleum industry by listing it for National Enforcement Initiatives two years in a row. The Future Growing up in the oil industry (my father was an engineer for Phillips for over thirty-years, my grandfather and great grandfather were independent producers), I appreciate the notion of legacy. I hope to leave a legacy for my children in the form of a greenenergy company. We all have that opportunity. Rather than fighting regulation we can embrace change. Many oil companies have actively done so. Some oil companies are developing alternative energy sources. It’s common to find positive statements about environmental stewardship on oil company websites. Just five years ago, this was not the case. Oil companies are perhaps best suited to be the driving force to find a lasting solution to America’s energy and pollution dilemma. Energy, specifically oil, is both a national security and national economic issue. Our industry should continue to press congress for a meaningful national energy policy that encourages domestic production.

The industry will have the strongest voice in congress and among the public when it is (correctly) perceived as helping to keep the environment clean. Turning the track record of the last thirty-years around will take the commitment of every oil company to adopt and comply with the new environmental regulations. Our industry could transform into the green-energy sector of our nation’s economy. We will continue to produce oil for many decades to come and can do so without polluting. The American oil industry has the human, financial, and technological resources to lead our nation and the world in eliminating pollution. The energy industry is the oil company’s rightful legacy. It’s in the oil industry’s enlightened self-interest to claim the green movement. Proactive development of green technology by oil companies will do more to mitigate overregulation than an army of lobbyists fighting the EPA.

Perhaps we can agree that whether natural or manmade, the anthropogenic contribution to climate change will only exacerbate a potentially dangerous situation. We could also agree that pollution in any form is a bad thing. Eliminating pollution (as difficult as that will be) is probably more realistic than creating a hydrocarbon-free nation. Controlling, capturing and utilizing emissions are within our reach. Highly efficient waste-to-energy technology is within our reach. Developing alternative energy technologies is within our reach and indeed within the proper purview of American oil companies. As Admiral Stockdale said, we should “confront the most brutal facts” of our current reality. The future is ours to claim; using oil as our foundation to build legacy green-energy companies for ourselves and future generations.

Of all these products, none of them can compare to a 30’ flowback line that 2 men can carry. This would eliminate the need for a crane or other equipment to move the piping on site.
With the focus on fracking issues and pipeline leakages throughout the mainstream press, any company that can demonstrate an innovative and safe alternative to fluid transfer has to be near the top of those companies deserving recognition. The innovative use of lightweight and composite materials in design and use for water transport is a key factor in determining my opinion.

FiberFlex-11, leading the fluid transfer industry CFT As A Company Composite Fluid Transfer (CFT) was established in May of 2011 to pursue a solution for industries related to fluid transfer via piping systems. The mission of our venture based in Kilgore, TX is to penetrate existing markets with a superior alternative to both the leak free fluid transfer systems and the conventional, temporary fresh water transfer systems. The initial goal of CFT was to create the largest inside diameter pipe with a working pressure rating of 250 psi while being light enough that a single 30’ joint could easily be carried by two people. The FiberFlex-11® pipe at 4.26 lbs. /ft. is over half the weight of comparable diameter and pressure rated composite and plastic pipe (8.5 – 21.5 lbs. /ft.) The standard length of the FiberFlex-11® pipe is 30 feet. The pipe was specifically designed to be as light weight as possible and to be less than the maximum 140 lbs. that OSHA mandates as the maximum weight for two persons to lift. A 30 ft. section of FiberFlex-11® weighs only 128 lbs. comparable 30 ft. section of 12” HDPE SDR 9 weighs 655 lbs. The light weight pipe enables large cost savings in mobility, installation, and safety costs. The fact that the FiberFlex-11® pipe is designed so that two men in the field can easily lift and carry the pipe avoids the high cost of using large and expensive unloading equipment. Avoiding heavy equipment and using a much lighter product increases safety and minimizes work site reclamation damage costs. Developing the FiberFlex-11® pipe began with proving the concept that winding a thin walled HDPE liner with composite fiberglass tape would produce a lightweight, large diameter fluid transfer system capable of withstanding high pressures. It also needed to be capable of withstanding the rigors of the oilfield water transfer industry and others. Hundreds of hours of ASTM standard burst and cycle testing proved the pressure rating while showing the resilience of the product. Apart from the statistical advantages of this leak-free system, several field tests proved the many real world advantages of FiberFlex11® pipe. Its seamless integration into an
existing water transfer company’s infrastructure is a major advantage saving time and money. Other leak-free systems may require additional costly specialized equipment where FiberFlex-11® can be utilized with any existing water transfer equipment. Existing aluminum pipe trailers and water transfer equipment can be used to transport FiberFlex-11® without the additional expense of extra trailers, tuggers and spooling equipment. This also means lead times for implementing your equipment are lower, repair costs are lower, and employee training is simpler if not already there. From the humble beginnings of wrapping HDPE liner by hand to the design and construction of its full scale manufacturing process, FiberFlex-11® spent its time in the R&D trenches and has developed into an industry revolutionizing product. CFT’s FiberFlex-11® pipe was specifically designed for the sizeable water management market in the oil and gas industry, yet it can be applied to any large diameter fluid transfer market. A key strength of this innovation is the adaptability of the product to market demands, including any fluid transfer markets outside of the oil and gas industry. The FiberFlex-11® system can easily be altered to operate at higher pressures, in tougher environments, with larger diameters or any type of connections. Even though FiberFlex-11® pipe has been fully implemented, this innovation’s concept can continuously evolve. FiberFlex-11 Technology The FiberFlex-11® pipe is a thin wall, large diameter HDPE pipe liner wound and heat consolidated with a high modulus, fiberglass reinforced composite tape. The innovative FiberFlex-11® pipe is a concept that is designed, and manufactured by Composite Fluid Transfer LLC, Kilgore, TX. FiberFlex-11® pipe is a 10.5” ID, 11.1” OD rated at 250 psi (500 psi burst). The composite pipe incorporates Ticona’s CFRTP® Continuous Fiberglass Reinforced HDPE thermoplastic composite tape. The CFR-TP is wound around and heat consolidated by CFT’s proprietary process on to a specially
design, extruded thin wall HDPE thermoplastic liner. The tape winding / consolidation process is proprietary process developed by Composite Fluid Transfer LLC. By consolidating several layers of Ticona’s CFR-TP tape on to the thin wall HDPE pipe, the burst pressure is increased from a mere 50 psi to over 500 psi. The finishing touch to the pipe construction is an outside layer of Valeron’s 20 mil HDPE film. The film acts as the protective abrasion and UV resistant film. The film is typically a tan color to reduce the heat conduction and to blend in naturally to the surroundings. Other colors are available if desired to individually dress up the oil well operation. To enable the pipe service in various market applications, a whole line of connectors, couplings, and valves have been designed to provide the ultimate flexibility in end-use applications.

Select’s solutions to the reuse of frac water is not only economic but has a significant impact on water usage across the state. The fact that Select is focusing on the needs of the industry and putting the unfounded environmental issues on the back burner is more valuable to the industry than the industry reaction to yet another EPA unfounded and unfunded regulation on the industry.
The solution of re-use of the water is environmentally sound and is a great benefit to the entire industry. Obviously the treatment of fluids can and will spill over into other industries other than oil and gas. Everybody wins. The conservation of water in the State of Texas is paramount at the present and any procedure that curtails the further use of water and at the same time recycles a normally disposed of by-product of a fracturing treatment is a big savings on all fronts that ultimately have to handle the water.
