12-Point Plan (Part2)
The Oklahoma State Legislature release the House Republican advance comprehensive medical marijuana policy package on March 7, 2022. The package includes a 12-point plan to stop illegal grows requiring the following (points 1-6 were discussed in the January 2023 issue):
7. All medical marijuana businesses to post standardized permit signage at the place of business (HB 2025)
8. Stringent electrical and water data reporting by marijuana growers (HB 4055)
9. Annual inspections (HB 2024)
10. Product packaging standards and maximum beyond use dates (HB 3019; HB 4288)
11. Standardized laboratory testing and equipment (HB 4056)
12.0Marijuana grows to register as environmentally sensitive crop owners with the Agriculture Department (HB 3827)

HB 4055 ultimately did not go into effect.
HB 2024 requiring annual inspections died in committee. But the Oklahoma Medical Marijuana Authority has rules requiring license holders to comply with inspection reports and requests. Further, rule 442:10-5-4 states “Submission of an application for a medical marijuana commercial license constitutes permission for entry to and inspection of any licensed premises…Refusal to permit or impeding such entry or inspection shall constitute grounds for administrative penalties…”
HB 3019 was passed on May 2, 2022 and became effective November 1, 2022. HB 4288 died in chamber March 28, 2022. HB 3019 modifies and adds definitions, allows clear containers, and requires exit package at point of sale and transfers, and new warning labels.
HB 4056 was passed on May 26, 2022 and become effective November 1, 2022. HB 4056 “Directs the OMMA's contract laboratory to provide recommendations for brands and models of equipment and standards to be used by testing laboratories.” https://oklahoma.gov/omma/rules-and-legislation/legislative-updates.html
HB 3827 died in chamber April of 2022.
