Should the city make rules about shrubs and vines in people’s yards? Changes could be coming to the city’s property maintenance code, for both business and residential, but they are pretty far down the road. City staff is going to submit proposed new regulations to the Quality of Life Advisory Board in the fall, and their recommendations will then go to the City Commission for consideration. At a board meeting on July 2, City Manager Joyce Shanahan got feedback from the advisory board for city staff to use in crafting proposed new regulations. The idea for structural codes came out of an effort last year by Citizens For Ormond Beach, a local volunteer group that researched “zombie houses,” structures that are in a state of limbo in the foreclosure process. Police in Tallahassee have identified a body found July 7 as Garrett Schroeder, 22, who was being sought on a charge of first-degree murder. Tallahassee police notified Ormond Beach police that they found the Mitsubishi Eclipse the suspect was believed to be driving. In a search of the area, they found a deceased white male matching the description of the suspect. Using a Rapid-ID fingerprint scanner, the deceased subject was identified as Schroeder. He apparently died from a single, self-inflicted gunshot wound. SEE MURDER PAGE 4

MUSEUM HIRES NEW MARKETING DIRECTOR Justine Wintersmith, of Flagler Beach, recently joined the Ormond Memorial Art Museum as director of membership and marketing. Originally from Seattle, Wintersmith has owned an art gallery, written for an arts and culture magazine and was the creator and director of the Flagler Fine Arts Festivals for the city of Flagler Beach. “We are very pleased to have someone of Justine’s caliber and background with us at the museum,’’ said Susan Richmond, museum director. A sculptor herself, Wintersmith created the Show Low Main Street Farmers’ Market and Art Walk in Arizona — a weekly event series that is still in operation. “I really believe the arts are vitally important to communities, and a fundamental part of what makes us human,’’ Wintersmith said.
The work of local artist Sang Roberson is currently being displayed in the Mennello Museum of American Art in Orlando. Until Sept. 27, people can view her terracotta work that is inspired from shapes of nature and natural beauty. Roberson has exhibited at the Smithsonian Craft Show and in galleries and museums throughout the U.S., as well as in Europe and South America. She is recipient of an NEA fellowship.
JUDGE WALSH TO RETIRE FROM COURT Circuit Judge J. David Walsh has announced that he will retire from the Seventh Judicial Circuit in February 2016. Walsh has been on the bench since 2001 and served for four years as chief judge of the circuit, which includes Flagler, Putnam St. Johns and Volusia counties. He currently presides in Flagler County. “I always have strived to be polite and fair to all litigants, to be prepared, and to rule in accord with the law and the facts as proven to me,” he said.

Daniels announces re-election bid Doug Daniels, county councilman for District 4, which includes Ormond Beach, has announced his candidacy for re-election in 2016. Daniels, 62, of Ormond Beach, is a long-time Daytona Beach business attorney who entered politics for the first time in 2012, winning his District 4 county council seat. Douglas A. Daniels, P.A. is a full service business law firm. He has represented companies seeking to redevelop the tourist industry in Daytona Beach. Daniels graduated from the Florida State University College of Law.

The 2016 Tomoka Marathon, presented by Halifax Health, will have the same format as in 2015 with the starting and finishing at The Casements. The city recently approved sponsorship with no financial assistance at the request of Runner’s High Timing and Race Management LLC, the company that organized the first two annual races. The company will handle all expenses, including police support, and it will take place on March 26, 2016. As a city-sponsored event, the organization will be able to provide complimentary food and beverages, including beer, at its post-race party. In the March, 2015, race, there were a total of 1,427 runners with 399 in the marathon, 782 in the half-marathon and 246 in the 5K race. A survey of runners after the race showed that every age group was represented, from teenagers to over age 70. Almost half said it was their first trip to Ormond
Beach and more than two-thirds of the respondents said they would participate again. For the first race in 2014, the company requested financial backing from the city to cover fees, police support, etc., but the commission balked at providing funds. It was agreed that the city would only assist the event with marketing on the city website and a message on utility billings, and that understanding continues for the 2016 race. WILLIAMSON PROJECT VETOED
The City Commission was set to send a letter to Governor Rick Scott to support funding by the
state legislature for the widening of Williamson Boulevard, but canceled it because the governor recently vetoed it from the budget. On June 15, Volusia County staff notified the city that the legislature included $2.5 million in their proposed budget for the expansion project, and asked that the City send a letter of support to Governor Scott. Scott vetoed it before signing the budget. The improvements would have been to a two-mile section of Williamson Boulevard from Ormond Beach south. The cancelled letter to Scott said “this important corridor anchored on the north by Florida Hospital Memorial Medical Center is a vital arterial supporting the economic vitality of the region. The project is well advanced in planning and design and can go to
construction quickly once funding is secured.” ATTORNEY GETS HIGH MARKS
City Attorney Randy Hayes received an annual evaluation by the City Commission at their last meeting, receiving a score of 4.7 out of a possible 5, with 4 meaning “exceeding expectations” and 5 meaning “outstanding.” Commissioner Troy Kent, who works as a teacher, said the grade translates to a “strong A plus.” “Thank you for representing the city in a positive way,” he said. Commissioner Rick Boehm jokingly brought up the possibility that Hayes is cloned, pointing to the recently completed Interlocal Agreement for North U.S. 1 with the County. “That was an extraordinary amount of work,” Boehm said.

Fourth of July was celebrated this past weekend, leaving cigarette butts, aluminum cans and used paper plates up and down the beach in the name of independence. But rather than letting the elements take care of the garbage, a few dedicated volunteers took on the job themselves. Cory Trusty and Scott Johnson, owners of Aquarian Bath, recently became a part of a campaign called Plastic Free July. With a goal of reducing plastic in their local community, Trusty and Johnson gathered their friends, families and customers to cleanup the beach at Tom Renick Park. “The main focus of this is to learn how to decrease our amount of plastic usage,” Maryanne Burley said. “The cleanup is just one way, especially after the Fourth of July when there’s a lot of garbage on the beach.” Find “Aquarian Bath” on Facebook for more information on their Plastic Free July.
“He’s done a terrific job.” Hayes, who has been city attorney for 17.5 years, said that he enjoys the legal challenges and there is no place he’d rather be. “It’s an honor to serve this commission,” he said. Also at the meeting, the officials approved a wage increase for Hayes and City Manager Joyce Shanahan that had been discussed at an earlier workshop. Research showed that their salaries were below levels in comparable cities and their increases had been infrequent in the past. The city manager will receive a 2% salary increase for the current fiscal year and a 2% salary increase the following year, and the city attorney will receive a 5% salary increase for the current fiscal year and a 5% salary increase the following year.

such things as peeling paint, rotting wood and broken garage doors. “CFOB has been working on this problem for one and a half years,” President Rita Press told the board at the meeting. “There’s a house on Lake Bridge that has been empty since (Hurricane) Charley. Outside, there are no steps. There’s no garage door.” Houses in disrepair bring down property values, as well as create safety hazards, CFOB contends. New codes now being considered would affect all housing, and not just those in the foreclosure process. Shanahan told the board that the City Commission has clarified that their interest is limited to maintenance of the exterior of the structures only, and not inside houses. Landscaping codes are also being considered. Shanahan said the board can consider regulations for empty businesses that are deteriorating. She pointed out that the Texaco gas station, at the corner of Nova Road and Granada Boulevard, does not break any codes, even though many residents consider it an eyesore. The board discussed its preferences, with some members wanting structural rules applied only to businesses, but most indicating there should be rules for residential also. Some were concerned that a homeowner might not have funds to make repairs, but others said church groups or others often help, and there are also grants available from the county. As a starting point, the board approved a motion to craft a set of regulations based on those in New Smyrna Beach, which covers both residential and business. They will make decisions and specific recommendations this fall, after city staff presents proposed new guidelines.

Ormond Beach police have not released the identity and cause of death of the male found July 3 at 8 Foxhunter Flat, pending autopsy results. According to county property records, the house is owned by Christian Schroeder, who is the father of Garrett Schroeder. Police were called to the Foxhunter Flat house near Breakaway Trails by a person who had discovered the body. In a statement released earlier, police spokesman Keith Walker said Garrett Schroeder has ties to the Tallahassee, Daytona Beach, South Daytona and Ormond Beach areas. Anyone with information concerning this incident is asked to contact Detective Sgt. James Doggett at 295-7028.

n Tree maintenance. The Land Development Code contains regulations that promote safe sight at intersections, but there are no provisions that require trees to be maintained. For example, a homeowner needs a permit to cut down a tree, but can remove all of the limbs because there are no trimming ordinances. n Green pools/water conditions. There is no specific requirement for pool maintenance. (However, the city does enforce pool security and will immediately secure a pool that presents a hazard.) n Overgrown shrubs and vines and unkempt landscaping are not regulated. Guidelines for the board noted that this can be a difficult issue, because vines, for example, can provide aesthetic appeal in some cases but in other cases are simply not being maintained. n Structural problems. The DIY magic of spray paint Don’t worry, I’m not sniffing anything.

There is nothing more frustrating, time consuming and self-esteem damaging than trying to decorate a room. We all think we know what
we’re doing. We come in with our printout photos of these impossibly high ideals for our idea of the perfect bedroom, and are immediately disappointed to discover we lack the talent — and funds — to ever get the dream space we desire. Personally, I get hung up on these do-it-yourself projects that never quite turn out the way I want them too. Whether it’s a self-installed canopy that keeps falling on my head, or a tree branch candle holder that catches on fire, these DIYs generally do more harm than
good. Or so I thought. This past weekend I rediscovered my love for spray paint. Taking some raggedy old thing from Goodwill or your grandma’s closet, giving it a fresh coat of paint, and telling everyone you “made that.” There’s no greater high than an undeserved feeling of accomplishment (again, I swear I’m not huffing the spray paint). Currently, I’ve been painting everything I can black and gold: a huge frame, old patio furniture, ugly vases and almost my roommate’s cat (sorry Lily). I’ve thought about venturing out

into other colors, but there’s something about that combo that just feels fancy and rich. That’s probably my favorite aspect of spray painting: the idea that something old and worn can be completely revamped and made new again just by a few coats of paint. It’s almost a metaphor for our own lives, that just a touch of improvement, whether it’s makeup or clothes, can make us feel brand new again. OK, this spray paint conversation is starting to get too deep. Maybe I should put down the can and open a window.
Hospital reaches out to community This past month, Florida Hospital Memorial Medical Center employees donated their time to help three local schools: Campbell Middle School, Holly Hill Elementary School and Ormond Beach Elementary School. According to a hospital press release, at Ormond Beach Elementary School the team bagged 147 commercial bags of leaves, spread 375 large bags of mulch and replaced treated lumber siding around key buildings. “Our mission is to extend the healing ministry of Christ, and we aim to do that in more ways than just within the four walls of our hospitals,” said Farzad Nourian, director of mission and ministry for the five Florida Hospitals in Volusia and Flagler counties. “We knew these three schools in our community needed assistance in sprucing

NASCAR DRIVER JAMIE MCMURRAY VISITS PATIENTS
Staff and patients at Florida Hospital Memorial Medical Center received a surprise visit July 2 from NASCAR driver Jamie McMurray, according to a hospital press release. Driver of the No. 1 Chevrolet SS in the NASCAR Sprint Cup Series for Chip Ganassi Racing with Felix Sabates, McMurray is one of the most successful drivers in Daytona International Speedway history. He claimed victory in three of the biggest races at the Speedway, winning the 2007 Coke Zero 400, 2010 Daytona 500 and the 2015 Rolex 24 at Daytona. He is the only driver to have ever won all three races. While visiting Florida Hospital Memorial Medical Center, McMurray toured the birth care and cardiovascular units. The

stop at the hospital’s BirthCare Center was a personal highlight of the tour, as McMurray and his wife Christy have two children. Upon learning that the Daytona Beach hospital was in the midst of building a $10 million Level II neonatal intensive care unit to treat sick and premature babies, McMurray shared his experience with his son. “One of the cooler parts of our tour through the hospital is the fact that they are building this new NICU,” McMurray said. “When we had our first child, we took him home, and three days later we had to go back to the hospital and were actually in the NICU for a few days. As a parent, I know how important a unit like this is. It was also great to see how the rooms will be laid out in the NICU; your child is going to be in the room with you. That’s a huge deal because it is different from a lot of other hospitals, and even the hospital that we were at. The plans they have for the future are pretty awesome.” While in the BirthCare Center, McMurray visited with new parents and gave a special racing onesie to some of his newest fans. “It was a really fun day,” McMurray said. “One of the new moms I met, she shared with me that every year her grandparents have a Daytona 500 party and she always looked forward to that and enjoyed it. It’s always fun to walk into a room when someone is excited to meet you.”

VICTIM CLEANED OUT 3:13 p.m. — 300 Block of South Atlantic Avenue. Fraud: The suspect hooked up an apparatus to perform a duct cleaning service at a condominium. He showed the filter to the owner, saying that there was a serious mold and mildew problem. A witness who was helping the owner said he was very versed and charming. The suspect told the victim that she would need $785 worth of work done. He wrote up two quotes, one saying “preventive” and one saying “corrective,” and said never to show anyone the one that said “corrective” because it could devalue the property. The suspect sprayed something into the vent and said it takes a long time to work. He said the victim would not need to look at the vents for another 10 years and not to call anyone. The witness felt like it was a scam but the suspect had started work so he didn’t know what to do. The suspect would not accept a credit card, only a check. Using information from where the check was cashed, the officer was able to identify a suspect who lives in Melbourne. The company name used by the suspect was familiar to the officer from fraud cases.

JUST ONE MORE LOAD 1:56 p.m. — 700 Block of South Nova Road. Stolen Vehicle. The victim was helping the suspect move, and rented the U-Haul truck because the suspect said he lost
his identification. While loading, the victim hurt his shoulder and had to go home. The suspect was left with the truck to do the last load himself. Later, the suspect told the victim he returned the truck. The next day, the victim was notified that the truck had not been returned. He later learned that the U-Haul was found in Georgia, an arrest had been made and narcotic paraphernalia was found in the truck. Georgia police said the truck was completely full of scrap metal.

AH, SHOOT 9:31 p.m. — First Block of Palmetto Dunes Court. Disturbance. The officer responded to a report by neighbors of an argument followed by gun shots. The woman at the residence said she and her husband, who had left, had a disagreement that evening. The officer called the husband, and he said he knew nothing about gun shots. He said they had an argument and he had no intention of coming back. The wife admitted to the gun shots. She said she and her husband shoot their revolvers in the backyard from time to time. She said she went out back to shoot her pistol a few times to blow off steam. The officer told her it was not a good idea because she did not have a proper back stop in the yard to stop the fired rounds. She agreed it was bad judgment and said she not shoot in the yard in the future.

One of the more significant recent developments has been the extension of the Community Redevelopment Area that has been designated to provide funds for constructing an overpass over the railroad tracks into the business park. There are graded crossings into the business park, but the bridge, at a cost of about $8 million, would enhance the desirability for development. “It would provide an unimpeded flow into the development,” said city Economic Development Director Joe Mannarino. In a CRA, tax collected over a set base rate can be used for improvements to the area, such as the railroad track crossover. Tomoka Holdings owns properties along U.S. 1 that are in the CRA. So far, the economy is cited as the cause for the lack of money being raised. The City Commission agreed to extend the CRA for another five years in April. Another step taken this year is that Tomoka Holdings began platting a portion of both the business park and residential area. Once the city approves the platting, the area will be ready for utilities to be extended by the city, if development were to

efore an evening of barbecue, family, friends and fireworks to celebrate the nation’s birthday, runners, representing various states, participated in the fourth-annual Halifax Health Team RWB Firecracker 4 Mile, 10 Mile & Virtual Race Saturday, July 4, on Daytona Beach. “When we started this race four years ago, we had 150 people; today, we have about 600,” said Lani Faulkner, the Daytona Beach chapter captain of RWB and president of the Daytona Track Club. “We grew the virtual site, and today we have 2,200 people around the U.S. running this race. We were shooting to earn $50,000 for our team, and I’m pretty sure we’ve reached, and even exceeded, that. I can’t tell you how many patriotic comments I’ve heard out here from people who are happy

to be a part of something that’s giving back to veterans, which is our mission.” Runners and supporters flooded the beach shore with patriotic clothing while some chose to take the nation’s flag with them on their run. Also, in attendance, along with her husband, Bill, was Chris Klitch, who was the honorary starter for both races. Klitch is a stroke survivor who has dedicated her life to helping other survivors cope with their new living situation. “I worked in the emergency room since 1973, and, being a nurse, I never thought it would
happen to me,” Klitch said. “But, I’m still working and helping other people. I’m able to tell them that life goes on after a stroke.” Klitch is also the head of the stroke support group at Halifax Health. Once the runners finished, they were met with medals, T-shirts and water, and they were also fed refreshments from Panera Bread, Krispy Kreme and other local food places. “The best thing about this is knowing that people came out here on their holiday and gave some time, their time, to support this awesome cause,” Faulkner concluded.
or those who traveled to the beach or sat in their backyards, grilling hot dogs and burgers, wrapped in the American flag, wearing American memorabilia or sporting the nation’s red, white and blue to take in the fireworks on Independence Day, they didn’t have to wait long for another chance to flaunt their patriotism. The following day, the United States Women’s National Team avenged its 2011 World Cup loss by beating Japan in blowout fashion. In the midst of a great national win, however, appeared the fan police, who, at one time, wanted the nation to watch more soccer, but, when it did, attempted to thwart the country’s joy of seeing its new favorite ladies win the most coveted soccer trophy for the first time since 1999. The fan police started issuing tickets, calling everyone else “bandwagon fans.” I don’t understand bandwagon patrollers. Where were they, when nearly the entire nation cheered for the Chicago Bulls in the late ’80s and early ’90s, but, when Jordan retired, they, just like the people they criticize, hopped off the Bulls’ bandwagon. Also, why are there so many Dallas Cowboys fans? Does it not have anything to do with their glory days in the ’70s and ’90s, when they racked up five Super Bowl rings? Why do the Jacksonville Jaguars struggle with attendance and ratings? Yep. Credit their mediocre-to-subpar game performances. Having said all of that, there is nothing wrong with having a favorite team or being a loyal fan. I can only imagine the joy Boston fans felt after the Red Sox embarrassed the Yankees on the way to the pennant in 2004, ending an 86-year drought. A lot of those fans endured years of failure to experience that moment. All sports fans want to experience moments like that, especially when they’re cheering for a team that’s playing for the country. It shouldn’t matter that a lot of their supporters probably couldn’t name 90% of the team, or if the World Cup final was the fans’ introduction to the sport. What should matter the most is that, when the U.S. Women’s National Team flies back across the Atlantic Ocean, they will be welcomed by thousands of their fellow citizens showing them the most support they’ve ever experienced. The 18U Lady Renegades team, of the OBYBSA, returned to Palm Coast with a champioonship trophy to present to their dads. They won first place at their Father’s Day tournament. The girls played a double-Texas tie-breaker to reach the championship game, and another Texas tie-breaker to win it. “We have had our share of tiebreaker games in the past, but never have we had this many in back-to-back games,” said Traci Olsen, the team rep.
Brian Weiss of Ormond Beach signed to play basketball at Webber International University in Babson Park. Weiss, a 6-foot2 point guard, who played his senior year for Spruce Creek, is among a few players this year in the county who signed with teams on the NAIA level or higher. The signing took place at the Holly Hill YMCA among many friends and family members. Weiss also received offers from Chatham University, SUNY Purchase College and Lees-McCrae College.

Despite the rain, the city still hosted its annual Fourth of July Celebration between City Hall, Rockefeller Gardens, Fortunato Park, and Cassen Park. Destination Daytona hosted its Biker Block Party and its first annual hot dog-eating contest, and St. James Episcopal Church held an All-American Picnic.

house built in 1925 was the top real estate sales transaction for the week of May 17-23 in Ormond Beach and Ormondby-the-Sea. David Shipman and Marilee Papale, of Lake County, Illinois, sold 175 John Anderson Drive to Paul and Yoko Katsikos, of Holly Hill, for $415,000. The house has four bedrooms, four baths, a fireplace, detached carriage house with garage and 3,272 square feet. It sold in 1997 for $299,000.
Jacqueline Waugh, of Ormond Beach, sold 31 Oak Brook Drive to Shannon Sizemore, of Ormond Beach, for $175,000. Built in 1990, the house has three bedrooms, two baths, a swimming pool and 1,524 square feet. It sold in 2005 for $210,000.
