And with last month’s blizzard as another reminder, I want to thank the Highway Department for its fine job of keeping our roads open regardless of the amounts and the duration of snow and ice. Not to be overlooked is the clearing of snow from sidewalks by Town sidewalk plows operated by Parks Department employees Andrew Huggins and Jeffery Valletta who worked each day from Tuesday, the start of the blizzard, through the following Tuesday, including Saturday, to clear and re-clear miles of sidewalks. For sidewalks on Routes 20, 146 and 155, they had to return multiple times. NYS DOT snow trucks would first dump two or more lanes of plowed snow on the sidewalks, return at various times over the next day or so to clear more snow, and then “top off” snow banks, and finally remove melting snow that had slipped onto the highway. At various times, private contractors would clear parking lots and driveways and leave huge piles of snow on sidewalks. Each time, Andrew and Jeff were up to the task and cleared the sidewalks. The accompanying photo shows that even days after the blizzard, they were still dealing with the latest dumping of snow on a Route 20 sidewalk. To better handle the increasing task of snow blowing the Town’s growing pedestrian network, the Town has added more sidewalk plows to its fleet.

The first of two Town Household Hazardous Waste Days will take place on Saturday, May 13th from 8:00am to 2:00pm at the Highway Department’s garage on French’s Mill Road. Due to last year’s record attendance and volume, you can pick up a resident’s pass at Town Hall, Transfer Station or Parks Department. Please also take time to review the list of acceptable items at the Transfer Station’s page on the Town website or by calling the Transfer Station at 861-6776. On March 16th, I gave the “2017 State of the Town” address at the Chamber of Commerce’s annual breakfast. Here’s an abbreviated version. I noted that the 2017 budget reduces expenditures and the property tax levy, retires debt, and adds reserves. The Town’s property tax rate remains unchanged.

I provided a review of activities in 2016, including the launch of a new website (www.townofguilderland.org) and an expanded Nixle® service which provides free text and email notices of Town events and announcements. A new senior services center and a new pool house and “chalet” building at Tawasentha Park were opened. The Town adopted a new zoning code which expands uses for commercial properties, adds environmental protections for water resources, promotes green infrastructure and reduces light pollution, eliminates regulations for certain business uses and expansions, and cuts the approval process and time for most business uses. To provide assistance with applying the new zoning code and address legacy zoning, the Town created a Land Use Review Committee to assist with rezoning applications and suggest necessary amendments to the Town code. Over the past year, the Town has received applications for significant commercial developments including a potential large manufacturing facility at the Industrial Park; proposed Concordia Senior Community, 2298-2316 Western Avenue (former Master Cleaners site); proposed Pine Bush Senior Living Center, 20 New Karner Road (opposite Post Office); proposed Cumberland Farms at the intersection of Routes 20 and 146, and proposed 200 room hotel at the Crossgates’ entrance. These applications are at various stages of the approval process.
Finally, I recently received the City of Watervliet’s voluminous application to the Federal Energy Regulatory Commission to re-license its hydroelectric project at the City-owned Watervliet Reservoir. The application is full of reports and tables about protecting aquatic habitats for the Largemouth Bass, Common Carp, Brook Trout and other types of fish, habitats for the Bald Eagle and Northern Long-eared Bat, safe passage of the American Eel, protecting water resources, and other important environmental concerns. The application is full of easily readable text about the Reservoir’s living environment and is available for download on the Supervisor’s page of the Town website. Buried in the City’s application were NYS DEC’s comments that the City should consider allowing public access for fishing from nongas powered hand launched boats and shoreline, and creating a trail system as a recreational opportunity for the community. In 2001, public access was blocked by a dirt berm and fishing was prohibited. We are working with DEC and the City to restore public access for fishing and linking future hiking trails to the Town’s planned trails on over one-hundred acres of nearby open space, with the goal of linking Tawasentha Park to the Reservoir by a trail over Town-owned property. In the coming months, I plan to provide updates on trail access and planning. Thank you for taking time to read these notes. We encourage investors to try to quantify their willingness to take risk by thinking about the maximum portfolio value that
Once you settle on a maximum tolerable loss, we suggest that you consider an investment portfolio that has at most two times that maximum loss invested in risky assets, such as stocks, real estate, high-yield bonds, commodities, etc. In other words, if you believe you can tolerate a loss of 20%, we recommend that you hold no more than 40% in risky assets. This follows from the notion that you should be prepared for risky assets to drop in value by 50% from time to time. We’ve seen broad stock market indices suffer losses of this approximate magnitude 3 times in the past 40 years (2007-2009, 2000-2002, and 1973-1974), and it will likely happen again. We suggest that the remainder of portfolio assets should be invested in relatively safer alternatives, such as cash equivalents or investment-grade bonds. Please review your portfolio or consult your financial advisor to determine if your current mix of investments aligns with your tolerance for risk.

TRI-PARENTING: THE CHANGING FACE OF FAMILIES by Leyla A. Kiosse
Guilderland, NY - In two prior articles, we discussed how the definition (and creation) of families has changed over time, and how the law is beginning to keep pace with advances in medicine and changes in social values. In 2016, our highest court in New York State, the Court of Appeals, rendered a decision in the Matter of Brooke S. B. v. Elizabeth A. C.C., which altered (and expanded upon) the custodial rights of non-parents. We first told you about this case in our February 2016 article, and described the facts of the case and the decision in detail in our September 2016 article. In Brooke S.B., the Court of Appeals specifically overruled the prior case on the rights of non-parents (known as the Alison D. case), and held that “where a partner shows by clear and convincing evidence that the parties agreed to conceive a child and to raise the child together, the non-biological, non-adoptive partner” has the right to seek visitation and custody of the child. The Court, however, left the door open as to the rights of third party nonparents (neither biological nor adoptive) when the parent(s) of a child encourage and foster the formation of a parent-child relationship between the third party and the child. The aftermath of the Brook S.B. case is already starting to take effect. A recent case was decided out of the Suffolk County Supreme Court that addressed the rights of a third party nonparent vis-à-vis the biological parents of a child. In Dawn M. v. Michael M.1, a married couple (“Michael” and “Dawn”) 1
befriended a neighbor (“Audria”), and later developed a romantic relationship with her. Since Dawn could not conceive a child, the three of them agreed that Audria would conceive a child (“JM”) with Michael, and the three of them would parent JM together. After the birth of JM, the trio lived together happily and shared parenting responsibilities of JM for approximately one year. Thereafter, Dawn and Michael divorced, and Dawn moved in with Audria and continued a romantic relationship with her. After divorcing Michael, Dawn sought custodial rights to JM. Audria agreed to this, but Michael objected and argued that Dawn had no right to JM because she was not a biological nor adoptive parent. The Court disagreed, and held that Dawn could seek custodial rights to JM because “a person is responsible for the natural and foreseeable consequences of his or her actions especially when the best interests of a child is involved.” In other words, Michael could not undermine Dawn’s right to seek custodial access to JM because he encouraged and fostered a parent-child relationship between Dawn and JM. The Dawn M. case has created, for the first time, a legal basis for three people to fulfill the role of “parent” to a child. While this may seem foreign, the Dawn M. case expanded upon what we already have in our society, with extended families and step-parents often fulfilling traditional parental roles. As the old saying goes, it takes a village to raise a child.

Is your calendar starting to fill up with weekend soccer and lacrosse tournaments or the baseball double header? If the answer is yes, then how are you feeding your athlete to perform their best? Sports nutrition is an exploding field and very scientific. There is so much information available that it can often be overwhelming. Here are some tips to help you manage tournament day. Carbohydrates are an athlete’s primary fuel. When eaten, carbohydrates break down into small units of glucose or simple sugar. There are various types of carbohydrates that break down at different rates. Whole grains break down slower than white flour grains. Using whole grains in general is a great idea. But when feeding an athlete who has a soccer game in an hour, it is recommended they get quick fuel by eating simple carbohydrates. Post-game meals or end of the tournament day are good times to eat whole grains. The overall nutrition plan of an athlete should be 50-60% carbohydrates. While fat and protein are important nutrients too, they take longer to breakdown and are best eaten when there is adequate time to digest (such as post-game or at least 2- 3 hours before the game). Pre-game nutrition and eating in between games at tournaments should consist of mainly carbohydrates. Follow these tips to help give your athlete the nutritional edge and keep their energy level high. (The following list does not take food sensitivities or allergies into consideration). 1.
It is always better to be prepared for those long days at your sporting event. Take food with you so you can avoid the hot dogs, burgers, fries and soda at the concession stand. Save those foods for after the sport is done for the day.

Keep food in a sports bag or in the car: Crackers, cereal, granola/cereal/sports bars, raisins, pretzels, dried fruit, trail mix and water.
3.
Take a cooler: Water, diluted fruit juice (apple, orange, cranberry, grape), sports drinks, V8 juice, 1% milk or chocolate milk, yogurt, fruit (bananas, apples, grapes, raisins, oranges, watermelon), vegetables (carrot sticks, celery, broccoli, etc. with a low fat dip), low fat string cheese, turkey or peanut butter and jelly sandwiches, bagel with reduced fat cream cheese or peanut butter, pudding and hummus.

Carbohydrate-rich pre-game meals: bagels, waffles, pancakes, flour tortilla, oatmeal, white rice, pasta, baked potato, sandwiches, bean burrito, peanut butter sandwich, low-fat yogurt, fig cookies and fruit cereal bar.

When eating at restaurants for pre-game meal and between games: Focus on high carbohydrate and low fat foods to refuel and provide energy. Avoid high-fat meats: beef, bacon, ham, sausage, etc. Order foods such as spaghetti, lasagna, breads and salad. Order thick-crust rather than thin crust pizza. Order low-fat toppings on pizza such as mushrooms, green peppers, lean ground meat, onions and skip the pepperoni and sausage. Try vegetable soups or chili with crackers, bread, pretzels, and graham crackers. Avoid deep fried foods such as French fries (try baked potato), fried fish or chicken. Try baked or broiled chicken and fish. Choose leafy green salads loaded with fresh vegetables. Go easy on the cheese, croutons, salad dressing and mayo.

GMA Success at New York State Championships By Master Rice
As you now know, when our students experience great success I dedicate my article space to them. Our Guilderland Martial Arts competition team returned from the New York State Championships held in Queens with a total of 14 medals: 6 gold, 1 silver and 7 bronze! Congratulations team GMA! We take competition very seriously, but we also have fun together. Team spirit and camaraderie is what we are all about. Retail customers are the DIY home owners that me be landscaping their home, adding privacy plantings, adding shade or flowering trees, mulching or repairing their law. We are very fortunate to have great loyal customer that come in year after year for their flowers, vegetables, fertilizers, and mulches and potting soil.

Our landscape design and build business started in 1975 upon completing degrees in horticulture, environmental science and landscape architecture, Colonial Acres Nursery soon followed in 1982 as the supplier to our landscape business. We were in need of a source of quality landscape, lawn and garden supplies so we became our own source. We then began supplying other landscape companies. Soon homeowners were stopping in buying our plants and supplies saying “you should be open all year.” We then became a seven day a week business selling retain and wholesale.
Wholesale customers are professional landscapers, grounds maintenance professionals, municipalities, businesses and large corporations that buy in volume. Q. Are you known for anything special? A. Colonial Acres is known for its large selection of landscape plants. Costumers like to stroll the pathways through the nursery that leads past many different plant types. The nursery is set up by plant departments such as; roses, annuals, perennials, ornamental grasses, vegetables, fruit trees, berries, shrubs , shade and flowering trees, evergreen trees and shrubs and much more. We also offer materials needed for planting and care of your plants. We also are known for our specimen and unusual plant materials such as topiary and grafted trees. We offer large “landscape” size plants unlike most garden centers.
Q. What do you love most about the business? A. What I love about our business is creating beautiful landscapes for everyone to enjoy. I’ve always liked the creative process of envisioning what the landscape could be and should be. Nothing is more satisfying than watching a site be transformed from a dysfunctional eyesore with all kinds of problems (drainage, soil, light, wind etc) to a space that makes you feel good and proud to live or work at Q. What do you want the community to know about you? A. Products- we are not just a plant nursery but a landscape, lawn and garden supplier, Scotts lawn products, sod, mulch, potting and garden soils, fertilizing, stone bags and boulder, garden benches, statuary, bird baths and much more We deliver what we sell. Pricing- People have the misconception that if a place of business is neat, clean and organized it must be expensive. Wrong! That big box stores and home improvement centers must be cheaper because they buy in huge volumes. Wrong! We check prices and many time we find we are cheaper or at a comparable price. www.guilderhaven.org Ivy is a small energetic playful yet cuddly spayed female looking for her forever home. She weighs in at nine pounds and is one and one-half years old. She loves companionship and will meet you at the door when you come home. Ivy is social and interested in whatever is going on in the house. Ivy likes to curl up in your lap and knead although she may not stay too long because she is a very busy kitty! She has toys to play with, windows to look out, and the other kitties in her foster home to hang out with. Although she stays busy she will always check in with you and look for sweet words of encouragement. She likes to start her mornings off with lots of hugs and kisses. Ivy gets along with all cats (male and female, young and old). Ivy was found literally starving in an abandoned garage in the inner-city while struggling to feed her five kittens. She was being a great mom in that her kittens were fed at the detriment of her personal health. The neighbors would watch her and the kittens but no one stepped up to feed them. Ivy is our hero! Since Ivy was rescued she has come a long way in adjusting to a loving home. Day by day she blossoms more and more. Her last trip to the vet she sat in her foster mom’s lap purring and kneading while waiting for her appointment. Ivy still has periods where she gets “over-stimulated” and will need to run off and regroup. Just as quickly as she takes a time out she is back ready to cuddle.Ivy is spayed, up-to-date on her vaccines, and negative for FIV/Felv. He is a medium-sized all black cat with stunning green eyes and he loves to give you eye contact. He is ever so gentle and cuddly yet loves to play with his toys and other kitties. Poor Leo! We found him living under a porch of an abandoned house with other kitties. It seems his owner had moved and simply left him behind. He was thin and cold. Leo is so happy to be inside and has no interest in going back outdoors. Leo is extremely affectionate and loves to cuddle and sit in your lap. He enjoys human interaction and will want to be around you and join in family activities. He will greet you at the door when you come home. Leo’s all-time favorite thing to do is to sleep curled up next to his foster Dad every night. He never misses a night of snuggling. Leo is just a cuddle bug - not only with humans but loves to cuddle with the other cats in his foster home. He will even groom each and every one of them if they will allow him. He is terrified, however, of aggressive cats. The best home for Leo would be one with a younger cat who wishes to interact with him. His love for other cats is so strong that he definitely needs a cat buddy. Leo has bonded with another cat, Wiggles aka Rocky, in his foster home and the two of them could possibly be adopted out together. He loves to cuddle and will want to sleep with you at night. He enjoys his cuddle cup if you aren’t around and enjoys sitting up high on his cat post. The best home for Levi will be a quieter one. From the Director: Guilderland, NY - I was recently asked how things were going here at your library. The question came at a fortuitous time as I had just finished the 2016 statistical report the library is required to file with the State of New York. So I replied, â&#x20AC;&#x153;It was a fantastic year! Program attendance was up 48% over the previous year, we held 13% more programs, and â&#x20AC;Ś my favorite stat: We had a 23% jump in the number of young readers in the Summer Reading Club! Plus, we got a new roof.â&#x20AC;? Those statistics are a reflection of the innovative and captivating programs the libraryâ&#x20AC;&#x2122;s Programming and Public Services Department created in 2016. Among them: â&#x20AC;˘
â&#x20AC;&#x153;The Teen Winter Writing Contest,â&#x20AC;? in which young authors and poets were encouraged to submit original writings for a chance to win prizes, and be published in a book, was hugely successful. The program proved so popular, and the entries so outstanding, that every entry was published.

â&#x20AC;&#x153;Albany Distilling: A Spirited Historyâ&#x20AC;? was a talk â&#x20AC;&#x201C; and tasting! â&#x20AC;&#x201C; hosted by the Albany Distilling Company that explored the rich tradition of spirits in the Capital Region, Participants over age 21 were able to sample Ironweed whiskey, which pays tribute to the William Kennedy novel of the same name.

Concerts, as always, were very popular, with performances by The Finger Lakes Guitar Quartet, The Electric City Chorus, and The Sonny & Perley Trio attracting crowds well in excess of 100, straining the capacity of the libraryâ&#x20AC;&#x2122;s

One program that had an immediate, practical, and lasting benefit to the community was Aprilâ&#x20AC;&#x2122;s â&#x20AC;&#x153;Drug Take-Back Day.â&#x20AC;? The library and the Guilderland Police Department teamed up to use the libraryâ&#x20AC;&#x2122;s parking lot as a collection point for this nationwide, one-day collaborative effort between the DEA and state and local law enforcement agencies. The goal: To remove potentially dangerous controlled substances from our nationâ&#x20AC;&#x2122;s medicine cabinets. Just drop them off; no questions asked. It was unknown how successful Drug Take-Back Day would be. The worries were misplaced: Over 800 pounds of controlled, noncontrolled, and over-the-counter medications were collected and turned over to the authorities for destruction. The program was so well-received that GPL and GPD held another in October; this collection day brought in an even greater amount of medications.
And, just so you know: We have another Drug Take-Back Day on Saturday, April 29.

A New Collection The library launched “GPL Gadgets,” a collection that gives customers the ability to borrow GoPro cameras, metal detectors, WiFi hotspots, fishing rods, folding tables, bake ware, and similar items that patrons would love to use, but might not want to own. Another popular item is a collection of Birthday Backpacks; these give parents an assortment of themed items and activities to create fun little parties!
Library Foundation Events The Foundation had two signal events in 2016. In September it held a very successful fundraising Gala at the Albany Country Club. The Gala was a celebration of the library, and honored the Robinson family – owners of Robinson’s Hardware -- for their many years of service to the community. (Note to other libraries: Your old card catalog is the ideal piece of library furniture for raffling bottles of wine.) This was followed in November when Mets former star pitcher, sports commentator, and acclaimed author Ron Darling spoke as part of the Foundation’s Carol J. Hamblin Notable Author Speakers Series. An author’s reception at the library opened the evening, but the author talk was so popular – more than 500 attendees -- that the Foundation held the talk in the “Cafetorium” of the nearby Farnsworth Middle School. (Thanks, again!, to Farnsworth’s Principal – and Foundation Vice President -- Michael Laster.) As to the new roof: The library is marking a quarter-century in its current building, and the roof was beginning to show its age. Thanks to grants from State Senator George A. Amedore, Jr. and the Upper Hudson Library System, customers, staff, and the collections are now safe from leaks from above.

Job growth is essential to our tax base because full employment enables families to pay property taxes (yes, renters do pay property taxes – just indirectly). may mean physical expansion adding to the tax base. Jobs? We are fortunate to have many residents employed by state, educational, and medical facilities which provides stability to our economy. Next, retail has a significant presence in our town as an employer and as tax base. Lastly, our town government is the primary place to encourage job growth by cultivating economic development. There are two big projects in the pipeline in Guilderland Zoning and Planning. The first is a large manufacturing company seeking to locate in the Northeast Industrial Park. The second is a proposed hotel on the Western Avenue side of Crossgates mall. The manufacturing facility would add nearly 250 well-paying jobs to our town. The hotel project would contribute short-term construction jobs, permanent staff positions, and the economic benefits of tourism. I urge citizens to gather information on the proposed projects from the Town web site or by attending public meetings. If you are in favor of job growth, I also urge you to express your support for these projects to our Town Supervisor and the Town Board. It’s all about jobs. Guilderland, NY
