5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - The calendar says that Spring has arrived and, in anticipation of actual Spring-like weather, Town employees are preparing parks, open spaces, hiking trails, and sports fields for your enjoyment. The Town’s 2018 Summer Day Camp and Activity Camp Brochure, which lists programs and activities for students, will be delivered to most homes via “backpack mail.” This information is available at www.guilderlandrec.com or at Town Hall, Parks Department, and local libraries. On Tuesday, April 10th at 7:00pm at Town Hall, the Town and the Lyme Action Network will provide a presentation on Lyme and tick-borne diseases. Professor Holly Ahern, SUNY Adirondack (Microbiology), a nationally recognized expert on Lyme disease, will explain the nature of tick pathogens, strategies to avoid tick bites, problems with diagnostic testing, and treatment options. State Senator George Amedore, a member of the State Senate’s Task Force on Lyme and Tick-Borne Diseases, will provide updates on the State’s efforts to combat Lyme and tickborne diseases, including enhanced funding in the recently approved State budget. The presentation will be videotaped and added to the Town’s on-demand video library available at www.townofguilderland.org/town-meeting-videos. This presentation is timely with the anticipated opening of the Town’s hiking trails, open spaces, parks and sports fields. On Saturday, April 28th from 8:00am to 2:00pm, the Town is holding the first of two Household Hazardous Waste Days at the Highway Department’s garage on French’s Mill Road. Over the past two years, this event has set records for the number of participants and volume of materials. Before heading over, please review the list of acceptable items on the Transfer Station’s page on the Town website or call the Transfer Station at (518) 861-6776. The bi-annual Confidential Document Shredding event will take place at the same place and day except that it ends at Noon. Please limit your confidential material to four standard paper boxes. Residents can pick up free passes at Town Hall, Transfer Station or Parks Department. On Saturday, April 28th at 10am at Tawasentha Park, the Town, Guilderland Chamber of Commerce, Guilderland Public Library and several Veterans’ organizations are holding the opening ceremony of the Guilderland Hometown Heroes Banner program. The program consists of 28 banners 4

Trails at Tawasentha (25 at Tawasentha Park, 3 at the Guilderland Public Library) honoring local veterans of World War II, Korean War, Vietnam War, Operation Enduring Freedom veterans and active duty members of all five military branches. As part of this special event, Tawasentha Park will be the temporary home of the Vietnam Veterans Memorial Moving Wall, a half-size replica of the Vietnam Veterans Memorial in Washington, D.C. On the morning of Thursday, April 26th, the Moving Wall will be escorted to Tawasentha Park by American Legion Riders Post 977. On Friday, April 27th and Saturday, April 28th, visitors are invited to visit the Moving Wall. I want to thank the dozens of volunteers who have tirelessly worked to make this special celebration of our hometown heroes possible. I was recently honored to accompany Senior Paramedic Supervisor Jay Tyler as he responded to 911 emergency calls. The Town Emergency Medical Service Department responds to every 911 call and provides prehospital medical care to the sick and injured in the Towns of Guilderland and Knox. Over the past year, the EMS Department responded to 6,227 emergency calls – an average of 17 calls per day. For whatever reason, Senior Paramedic Tyler received only two emergency calls over our day and a half together (for my police ride-along, there were no tickets or emergency calls over four hours, an

The Town’s EMS response is coupled with the arrival of a private ambulance company which can provide basic life support and transportation to a hospital. The Town’s EMS response is by NYS certified paramedics who provide advanced life support consisting of invasive techniques such as IV therapy, tracheal intubation, administration of medications, ekg monitoring and transmission, and medical control privileges. The Town’s EMS Department employs the most advanced procedures practiced by pre-hospital providers and is recognized by its peers as setting the benchmark for providing superior emergency medical services. The Town’s emergency response is overseen by Dr. Donald Doynow, the Department’s Medical Director, who responds to emergencies such as cardiac arrest, severe trauma, pediatric emergencies and difficult airway calls. As with my joining a Town police officer on his patrol and serving as a “wingman” (kind of) for a Highway Department employee operating a truck plowing snow, my time with Senior Paramedic Tyler was relatively brief and not nearly enough to experience the wide-ranging medical issues that he and his fellow paramedics might face on any call. But even that limited exposure was sufficient to witness Senior Paramedic Tyler’s singular devotion to helping persons in need and his dedication to the highest standards of medical care. It was very insightful to see a highly trained paramedic’s quick assessment of a patient’s medical needs, comforting of family members, working closely with the ambulance crew, and relaying important information to hospital emergency room physician and staff. I want to thank the Town’s EMS paramedics for their dedicated service to residents. Does Your Portfolio Match Your Risk Tolerance? by

Guilderland, NY - How much risk are you comfortable taking with your investments? This key question in portfolio construction is very difficult to answer, given a world of high volatility in stock returns, constantly-changing economic conditions, and the fact that none of us can say with certainty how any financial asset will perform in the future! Financial experts often break down an investor’s risk tolerance into three categories: need to take risk, ability to take risk, and willingness to take risk. The “need” and “ability” factors are a function of one’s financial situation – for example, a retiree with a multi-million dollar investment portfolio and no need for portfolio income has a very high ability to take risk (his/her life isn’t negatively impacted if the portfolio drops in value by a lot), and a very low need to take risk (earning high returns won’t impact standard of living ). In fact, we find that for many investors, the “need” and “ability” factors merely offset one another. As such, we turn to the critical third factor, one’s “willingness” to take risk. Another way to think about willingness to take risk is how various levels of declines in your portfolio impact your ability to sleep at night. Do you shutter with fear if you hear that the market is down 3% today? Or, do you welcome these downward movements, believing that what goes down will soon go back up? We encourage investors to try to quantify their willingness to take risk by thinking about the maximum portfolio value that they could emotionally tolerate losing in a down-market. When considering this, try not only to think about your reaction, but how such a drop would impact your financial life, if at all. For example, a 30-year old investor with stable employment may have a difficult time stomaching a 20% loss on her retirement portfolio, however such a loss will likely have little impact on her financial future, as she still has a lot of time prior to needing the money.
Once you settle on a maximum tolerable loss, we suggest that you consider an investment portfolio that has at most two times that maximum loss invested in risky assets, such as stocks, real estate, high-yield bonds, commodities, etc. In other words, if you believe you can tolerate a loss of 20%, we recommend that you hold no more than 40% in risky assets. This follows from the notion that you should be prepared for risky assets to drop in value by 50% from time to time. We’ve seen broad stock market indices suffer losses of this approximate magnitude 3 times in the past 40 years (2007-2009, 2000-2002, and 1973-1974), and it will likely happen again. We suggest that the remainder of portfolio assets should be invested in relatively safer alternatives, such as cash equivalents or investment-grade bonds. Please review your portfolio or consult your financial advisor to determine if your current mix of investments aligns with your tolerance for risk.

Generally, it is incorporated, but not merged, into a judgment of divorce which means that it can be enforced both through the judgment of divorce and as a separate contract. What happens if you sign an agreement and then change your mind? There are very narrow avenues to set a separation agreement1 aside: A separation agreement may be set aside based on evidence of one parties’ overreaching, fraud, duress or a bargain so inequitable that no reasonable incompetent person would have consented to it…
To prove fraud, “The proponent must establish (1) misrepresentation of a material fact, (2) [knowledge of wrongdoing] (3) justifiable reliance (4) injury or damages” 2 Marital agreements are examined with a higher degree of scrutiny than most other contracts.3 The law and public policy hold: Marriage being a status with which the State is deeply concerned, separation agreements subjected to attack are tested carefully. “A court of equity does not limit inquiry to the ascertainment of the fact whether what had taken place would, as between other persons, have constituted a contract, and give relief, as a matter of course, if a formal contract be established, but it further inquires whether the contract (between husband and wife) was just and fair, and equitably ought to be enforced, and administers relief where both the contract and the circumstances require it”
Even with the higher standard, it is still public policy to allow parties to freely contract. Therefore, an agreement between spouses does not need to be fair or “equitable” but does need to be free of fraud, duress, or coercion. [T]o prove legal duress, a party must adduce evidence that a wrongful threat precluded the exercise of the party’s free will” 4 There is an old saying in the legal field “a good settlement means everyone is unhappy.” Why? Because it shows there has been give and take to reach a meaningful compromise. While you may not be “happy” you do need to make sure that you understand what you are agreeing to and realize that this is the most important contract of your life.
In other words, the law provides that there is a fiduciary or high degree of accountability between spouses to be fair and honest with each that is not required in a contract between “strangers”.

From the Library: Recently I was honored to be invited to speak at the annual State of the Town event sponsored by the Guilderland Chamber of Commerce. Here are some high points from my presentation: Everyone these days needs an “elevator speech” to explain why their product, service, organization or institution is necessary and vital, and libraries are no different. In the age of the internet, it is often asked why we need libraries at all. There are lots of great answers to that, which I will address in a future column, but for now, let me just ask you to take our parking lot challenge. As you pass by, note how the lot is usually almost full. One of the main things libraries are doing in recent decades is programming— holding events of wide public interest. In 2017, 22,674 people attended an event at our library. Not too bad for a town of 36,100 residents! We were up 3,750 people over the previous year. We are gearing up now for the Summer Reading program—our biggest annual effort. This past year, participation in the reading aspect of SRP was up 25%, to 439 kids. Won’t you help us break the 500 mark this summer? Last year, 4,467 kids attended an event at the library in July or August. Keep them coming, folks! The library does a great service to families, kids, and the School District by working hard to counteract the “Summer Slide,” which can happen to kids who don’t read and study over the summer break. As in past years, we are in need of prize donations for these readers, so if you’d like to donate new toys, books, or gift cards, please let me know. Thank you! Flipster—Get to know this free app! We recently announced details of our proposal to renovate the library and add 6,000 square feet to the east end of our building. After a year of soliciting public and staff input through meetings and surveys, the plan can now be viewed on our website and at the Altamont Enterprise website. Please note that the plan is not finalized, nor has it been approved by our board. If adopted, the plan would greatly expand space for children’s and teens collections and services. It would add a café—probably run by a local business in a rental arrangement, and it would nearly double the available meeting room and programming space by adding a third meeting room in the lobby area, and a large program space in the children’s department. As it considers the plan, our board is looking at financing options for the 6.875 million dollar project, which hopefully will include grant funds and a fundraising campaign. If you are reading this before April 11, architect Paul Mays will be hosting two public meetings on the plan here at the library on Wednesday, April 11th, at 3 p.m. and at 7 p.m. No reservations are required, just come on by! I was reflecting the other day on how a great library serves it’s community by reaching out and connecting to it, and came up with the following very partial list of organizations we’ve collaborated with lately: The Guilderland Central School District, Guilderland Historical Society, Guilderland Garden Club, Town of Guilderland, Boy Scouts and Girl Scouts, Guilderland Police and Fire Departments, the Guilderland Food Pantry, WMHT and its cool sister station WEXT, the Red Cross, AARP, the Pride Center of the Capital Region, the YMCA, the Pine Bush Center, the New York State Writer’s institute, and the Colonie-Guilderland Rotary Club. Lastly, I want to plug some upcoming events:

• We are delighted to be working with Family Danz, the low bidder on our project to replace the 26 heat pumps which heat and cool our building with new high efficiency units. The project will save us approximately 20 percent on heating and cooling, and will pay for itself in 4.1 years. We are also working with the university at Albany’s Going Green Globally (G3) initiative, an intensive 2-week project in May where seven MBA students analyze every aspect of library operations, in an effort to identify $100,000

PEDIATRIC CHIROPRACTIC CARE: OUT OF THE MOUTHS OF KIDS By: Dr. Kim Leis-Keeling
Guilderland, NY - When my son was 4 years old, he asked me “Mom, why are you carpet-practor?” Of course I had to laugh hysterically then explain the correct pronunciation of “chiropractor”. He has since gotten to understand more about sports chiropractic and reap the benefits. Both of my children are my also patients. Over the years, they have learned to listen to their bodies and know what needs attention. They are the ones coming to me and asking to be treated - not me telling them it is time for a “tune-up”. I wanted to share some perspective from my children and other parents who bring their children in for chiropractic care. The following is a brief interview of my children, Tristan and Taylor. As well as, testimonials from parents who bring in their children regularly for care. Here is what they had to say about being chiropractic patients. What is chiropractic care? Tristan: “Working on your body so it feels better.” Taylor: “Adjusting and massaging.” What is your favorite part about me working on your body? Tristan: “I love the lower back stretchy thing.” (He is talking about traction.) Taylor: “I like the massage and when you tape my sore legs.” How do you know when your body needs some work done on it? Tristan: “When I’m really sore after practice or games, when I get a headache or my tailbone hurts.” Taylor: “When my back or legs hurt after gymnastics practice.” What does it feel like to get a spinal adjustment? Tristan: “It feels sooo good!” Taylor: “It feels good and relaxing.” What would you tell parents who may be nervous about their children going to a chiropractor? Tristan: “What is there to be nervous about?” Taylor: “I don’t understand why they would be nervous.” Is there anything else you want to share about your chiropractic experience? Tristan: “Nope, I’m good.” (haha - typical tweenager) Taylor: “I like it that you taught me how to tape my legs and ankles when they are sore. One time at gymnastics practice, the coach asked me to help tape a teammate because she didn’t know how to use the kinesiotape and I did. It made me feel proud.” My personal testimony I have been treating my children since the day they were born. We started with gentle infant massage, craniosacral therapy, various chiropractic adjusting techniques and have advanced into more dynamic treatments including stretching, strength exercises, taping, cupping, acupuncture and they have even used the Normatec Recovery Pants. Why do I treat my children? I understand the concept that we simply cannot run our body into the ground with the physical demands of life, sports and stress without it taking its toll – regardless of our age. The joints, muscles, tendons and ligaments all take a beating and over time joints
become strained while muscles and fascia get filled with adhesion and knots. Both of which can lead to faulty sports mechanics and injuries. When pain starts to set in, you cannot take enough NSAIDs to realign your joints and remove muscle adhesions. And with our national opioid epidemic roaring strong, I want my children to learn how to remove pain from their body without resorting to drugs. Testimony by Wendy Keaney “I take my children to Dr. Kim on a monthly basis, during the seasons that they compete. She provides much more than adjustments and physical therapy. As a mom, I appreciate the education Dr. Kim provides my children on the specific demands their sports put on their bodies and why. That knowledge has made them more aware of their everyday aches and pains and how to treat them, before they turn into more serious overuse injuries.” Testimony by Thomas Green “We believe that proper spine alignment at any age returns excellent overall health benefits. Our hope by adjusting our children at a young age is to maintain a strong immune system and prevent sports injuries as they grow. Chiropractic adjustments fit well into our overall family belief in prevention of diseases, over our lifetime, instead of treatment after the fact.” Testimony by Mandi Tooker My 3.5 year old twins have been going to Dr. Kim for a couple years now for help with leg muscles and GI complaints. She has been an amazing asset in their care, they will ask to see her when feeling in pain. She will massage and stretch muscles from head to toe. They love going there and helping with the “clicker”. She really knows what she’s doing and highly recommended. Testimony by Sheryl English “I decided to take my seven year old daughter to a chiropractor because she plays several sports, and takes dance and gymnastic lessons. She also wears a full backpack to and from school. So when she began complaining of headaches I was concerned that she strained something in her neck and would be prone to injury because of an imbalance in her body or lack of muscle strength. My daughter’s pediatrician was in favor of her visiting a chiropractor and liked Dr. Kim Keeling at the Sports & Spinal Wellness Center. At the first appointment, Dr. Keeling observed my daughter’s posture and examined her from head to toe. My daughter can be fearful of new experiences but immediately felt very relaxed with Dr. Keeling. We received a simple and quick exercise to do at home, and Dr. Keeling massaged my daughter’s neck and muscles along the back to loosen them. She also worked on my daughter’s hips to ensure that they were aligned. Dr. Keeling uses massage or a painless, non-invasive tool that makes clicking sounds when working on my daughter. My daughter loves going to the chiropractor. She finds it very relaxing and always feels great afterwards. I have been amazed at how tight my daughter’s muscles can be and that she has trigger points at such a young age. Tournament Season Guilderland, NY- Tournament season is well under way at GMA. On March 17th, eight students competed at the New York State Championships at Queens college in New York City. It was an excellent day for all students and all students qualified for the National Championships to be held in July. Students competed in forms (floor exercise) and board breaking. All students challenged themselves physically and mentally, but two students attempted the championship for the first time, Sulaf Khatib and my wife Zeynep Rice; both received multiple medals in their divisions! In fact, Zeynep and I competed in pairs forms as the first adult pairs team from GMA ever. This was amazing for us and our detail coordinated performance was worthy of a gold medal! We are very excited to attend the National Championships with our son Mete, who is a board breaking enthusiast. We go to the Nationals not because we think we will win, but because we need the goal, need to challenge ourselves and need to be in the game side by side with the best in the country. Training for and competing in martial arts tournaments takes a lot of practice and improves mental focus and physical ability. Having a competition goal for Taekwondo training helps students push harder and focus on the details of great technique. Training together and competing alongside of your family is something I encourage everyone to do. It is among the most rewarding experiences I have had, and I have been fortunate enough to be doing it for the past 18 years. The Guilderland Chamber of Commerce, the Town of Guilderland, the Parks Dept, GPL, VFW and the American Legion Riders have partnered up for this amazing event! 28 Banners, featuring World War II, Korean War, Vietnam War, Operation Enduring Freedom, and other Veterans along with those in Active Duty Service, will be hung in Tawasentha Park and the Guilderland Public Library lot. Many of the banners were sponsored by family members and the rest were sponsored by local businesses.
Tawasentha Park Thursday 4/26 – Morning procession bringing in the Vietnam Veteran’s Memorial Moving Wall to Tawasentha Park led by the American Legion Riders Post 977 in Altamont. Thursday afternoon – All visitors are welcome to stop by and view the wall. Friday 4/27 – Viewing of the wall is open to visitors all day. Saturday 4/28 @ 10:00am – Hometown Heroes Opening Ceremony featuring Military Presentations, guest speakers, music provided by the Guilderland Music Academy and the unveiling of the Hometown Heroes Banners. Many thanks to all the families and businesses who have helped to make this project possible. We look forward to adding many more banners in future years.
