ell, we’ve had a pretty typical Upstate New York summer so far this year. Some cool and dry days, some hot and steamy days; some drenching downpours, and some days when our lawns and gardens looked parched. Summer always brings us interesting weather in this part of the world. Anyone who has driven along Western Avenue in McKownville in recent weeks has noticed the sidewalk construction project going on in the area between the Guilderland-Albany line and Fuller Road. The new sidewalk construction, which is being directed by the NY State Department of Transportation, is the result of a collaboration involving DOT, the Capital District Transportation Commission, and the Town of Guilderland. As the summer progresses, construction crews will work their way west to fill in all gaps in the current sidewalk network all the way out to Route 155 on the north side of Western Avenue. Next year, the same work will be undertaken on the south side of Western Avenue. This project will provide a major improvement in walkability and pedestrian safety along Guilderland’s most heavilytraveled road. I hope that our residents appreciate the results. Many Guilderland residents travel on the NY State Thruway. In light of the recent closing of the E-Z Pass office located in Guilderland, the Town has become a vendor for E-Z Pass On-the-Go. Under this program, you can purchase an E-Z Pass tag at the Town Clerk’s Office during regular business hours for a cost of $25. You can then register that tag with E-Z Pass either on-line or by telephone. Once the tag is registered, attach it to your car’s windshield and you are all set to save time and money

when traveling on the Thruway and other roads and bridges that accept E-Z Pass. More information can be obtained through the Clerk’s Office. As I have mentioned before, please remember to include some of the recreational opportunities available to you right here in Guilderland as you plan your summer activities. Our extensive parks system offers you the quiet enjoyment of our small neighborhood-scale parks or the varied activities (swimming, trail hiking, basketball, tennis, picnicking, or visiting our brandnew playground) at Tawasentha Park. Come back to Tawasentha on Thursday evenings for the free concert series at the Guilderland Performing Arts Center. If you’re a golfer, consider a reasonably-priced round at Guilderland’s own Western Turnpike Golf Course. Please check the Town website, www.townofguilderland.org, for parks information and the Performing Arts Center schedule, and call the Pro Shop (456-0786) for golf course information and tee time bookings. As we progress through the summer season, please be sure to be careful in your travels around Guilderland. Also, with the hottest part of the year upon us, please be careful of children and pets, and also take a moment on the hot days to check on elderly relatives and neighbors. It is almost Altamont Fair me! Come celebrate the 121th Altamont Fair. The Altamont Fair opens Tuesday, August 12 and runs through August 17th. The pay one price admission includes unlimited rides, Circus Hollywood under the big tent, a rac ons, and parking. Admission for 36” tall and up is $15 on Tuesday and Wednesday, $17 on Thursday through Sunday. Children under 36” are free. On Wednesday, Senior and Armed Forces Day, seniors 65+ and ac ve/veteran military receive free admission un l 4pm Chauffeured golf carts provided St. Peter’s Health Care Services are available on Wednesday for seniors and veterans to assist with transporta on around the fair grounds. New this year is a llama exhibit in the pavilion, joining the alpaca exhibit on Thursday through Sunday to share their passion of camelids with our fair-goers. Do you like to see how we live in the late 1800’s? The Altamont Fair has many museums to visit – Schoolhouse, Farmhouse, Village and Carriage, Circus, Auto and An que Machinery. Enjoy a quiet moment exploring the Hardware store seeing early washing machines and vacuum cleaners. New this year in Cars: Past, Present and Future: The Cadillac-LaSalle Club of New York Capital District Region will display their collec on of Cadillac models from the past to the present. The Altamont Fair is the home of one of the finest An que Farm Machinery collec ons on the East Coast. Much of the collec on are gas engines, also known as “Hit and Miss” engines that were developed in the 1890’s and used un l about 1930. The dedicated volunteers work all year long to prepare the exhibit for the Altamont Fair, researching and repairing the Fair owned equipment, ge ng the gas powered machines tuned up and ready for live demonstra ons of early hay baling, bone crushing and log sawing. This windmill is pumping water this year, refurbished just last year; the windmill illustrates how farms pumped water without electricity so important in rural areas. Also, there will be an exhibit of shingle making, an important component in the construc on of homes and businesses. In addi on to the many compe ons that are open to adults, the Altamont Fair is proud to host 4H compe ons and exhibits. 4H is a youth development program for kids from 5-19 for both urban and rural youth in our coun es. The 4H program provides an arena for posi ve experiences – “learning by doing” in so many areas. Stop in and enjoy 4H public presenta ons, club exhibits and the many compe ons in crea ve arts, food science, animal science, natural resources, photography and more!

Mean What You Say and Say What You Mean In this day and age of people marrying a er they have established themselves financially, marrying and remarrying, and baby boomers becoming financial recipients of the greatest genera on, it is not uncommon that a spouse owns property (i.e., house, condo, etc.) prior to the marriage, or inherits it prior to or during the marriage. At some point during the marriage one may decide to transfer tle so that both spouses own the property. This can be done for many reasons: to make a gi to the spouse; to be able to obtain [re] financing; to ensure that property will transfer upon the owner’s death; or “for comfort.” In other words, the non- tled spouse may feel that if s/he is not the owner of the property, why be paying money towards a mortgage, care for the property, make improvements, etc. when s/he will not be the beneficiary of those efforts? Imagine you have transferred tle to property and then divorce – can the original owner recoup the value of the property at the me that it was transferred? While this had been the law of the land in the Third Department (the part of the state where we live), it was modified by the decision of Campfield v. Campfield1. In that case, the par es were married for seventeen (17) years when the wife inherited property and then transferred it to herself and her husband. The court stated that when the wife transferred the property to the husband, there was a presump on that the property was now marital, and thus could be distributed between the Husband and Wife. The Court looked not just at the transfer but the Wife’s reasons for it – her inten on to give him an interest and the value could be used for re rement. The court stated that she transmuted her separate property to marital property. The recent case of Myers v. Myers2 held that the trial court may give a credit for the value of the property at the me of the transfer. Therefore, a separate property credit is not precluded as a ma er of law when tle to separate property has been transferred.

For the origina ng spouse, a sigh of relief should be let out. However, and as we have discussed in other ar cles, it is very important that yyour inten on is clear aat the me that you make the transfer. m TThis should be done iin the form of a fformal agreement, but minimally a b cconversa on should occur as to each o party’s wishes and p ggoals. IIf it is your inten on tto benefit the other person even if you p eventually divorce, then a transfer of property is appropriate. If that is not your inten on, then perhaps a transfer should not be made, or made in part, such as an unequal ownership of property. Before “giving away” perhaps your most significant financial asset, a conversa on with an a orney upfront is far less expensive than lengthy divorce li ga on. 1

Bond Performance Update In August 2013, we wrote about the negative performance that bonds had seen during the second quarter 2013. We discussed the two broad types of risk that impact the prices of bonds, interest rate risk and credit risk. Finally, we urged investors to “stay the course� with respect to their bond positions, assuming that bonds were a component of the target asset allocation within their Investment Policy Statement. Bonds continued their lackluster performance throughout the remainder of 2013. Have you ever stood in front of the refrigerator with the door wide open and said to yourself, “I want something, but I don’t know what at you I want.”? Well chances are, what wanted was not in that refrigerator. Really? Yes, really! I have stood in front of the refrigerator or kitchen cupboard countless mes thinking for sure that I was hungry, but through mindfulness I can now dis nguish between whether I am hungry for food, or hungry for something else. I’d like to introduce you to the concept of Secondary Foods vs Primary Foods. Secondary Foods would be what we actually eat. Simple enough, right? Primary Foods, however, would be all of those other things that “feed” us that are not on our plates. Examples of these would be our careers, our rela onships, our spiritual prac ces (or lack of), or exercise. All of these things feed us in a way that Secondary Foods do not. The rela onship between Secondary Foods and Primary Foods is such that, if our Primary Foods are out of balance, most likely our Secondary Foods are as a result. Let’s break this down a bit. Let’s say you are in a dead end job that isn’t the least bit challenging or offers no real opportunity for crea vity. In other words, you dislike going to work every day but you stay in this job because you feel you have no other op ons. On top of this, throw in the scenario that you have been in a long term rela onship that is fairly boring and one where there is no real communica on. Again, you stay in this rela onship because you feel it’s be er than nothing. Maybe this picture is becoming clear to you now. In simple 18

terms, if we are lacking in any of our Primary Foods, doesn’t it make sense that we might try to fill those voids with Secondary Foods? The problem is, the void we want to fill is not usually sa sfied with a nice green salad or a beau ful plate of fruit is it? No, No the hunger we are experiencing seems much more sa sfied by some chips and dip, or a pint of ice cream, or perhaps indulging in some alcohol will wi do the trick. Temporarily. The ques on now becomes, how do I strike a healthy balance between P Primary Foods and Secondary FFoods? First, we must be able to rrecognize the difference between tr true hunger for nourishment and emo onal ea ng. If you are having one of those “standing in front of the refrigerator door” moments, ask yourself a few simple ques ons. Am I bored? Am I sad? Am I angry? Am I lonely? What am I hungry FOR? If you take the me to answer these ques ons, you may be able to talk yourself down from the ledge, so to speak, and move in the direc on of what it is you really do want. Some mes something simple like physical contact, a walk outside in nature or calling a friend can be enough to bring you back into balance. The key is mindfulness. Adult Learn to Swim Program The Guilderland YMCA at 250 Winding Brook Drive will present An Adult Learn to Swim Program on Friday mornings from September 12th to October 31st, 2014 for all levels from the very beginner to advanced swimmers. The instructors are fully qualified with extensive aqua c teaching experience. Classes are in small groups from 9:30 to 10:30 AM in the Handicap accessible pool. This year on Saturday, September 13th we are looking to gather together for a great day of family fun organized with single goal in mind - to help the local Rodino family. As many community members know, this family has been struggling with providing around the clock care for three family members who are all ba ling Hun ngton’s Disease. This debilita ng illness took the life of their beloved daughter Rachel in 2010. The father, Rick and two other children, Anthony and Gianna all have this disease and are currently at dierent stages of this illness – a illness which has no cure.

DESIRE LEADS TO SUCCESS If you want to be successful at something it requires only the desire to be successful and a passion for learning it. When I was a child, to learn something new, you had to either get a teacher or a book, and a book could only show you words or pictures to help you along the road. In today’s world a passion for learning something can lead to quick success through available technology. Recently my son Mete decided he really wanted to learn how to fly fish. He became inspired while researching fishing techniques to improve our fishing adventures. I don’t know the first thing about fly fishing, so he was on his own. He used the mulƟmedia aspects of Internet to teach himself techniques and research equipment. He used his own money to buy equipment to Ɵe flies and fish, and pracƟced his technique in the front yard all the while referring to the internet to learn more. Yesterday I took him to a stream to try it for the first Ɵme. Amazingly he successfully was able to get bites from trout. One of the best parts is that even though he did not catch a fish, he considered the trip a total success; part of the road to achieving a goal. You can do almost anything these days given a passion for it, because of the Internet and other available technologies that are making the world a smaller place and are making finding mentors and partners much easier. My other two children Tamer and Emre wanted to learn how to play bass and guitar respecƞully. All I did was provide the space and the equipment. AŌer years of passion and pracƟce using both the internet and music resources, they experienced performance and recording success.

In taekwondo we pursue our passion together in class, but it extends far beyond our training area. For those that truly seek a high level of success the internet and the experience of a compeƟƟve tournament provide the edge they need. These valuable tools allow you to see performances and receive advice from people around the world. Back in my early days of taekwondo, if my instructor did not show me a poster about an event or invite me to a tournament there was no way to know about it. These days technology provides email subscripƟons and access to informaƟon about events around the world. The opportunity for development is astounding. The internet does sadly contain a vast amount of “not so nice” things and bad advice, no doubt, but part of any learning is seeing all sides and we are intelligent enough to find what is real, talk to local resources and find our path. Find your path and passion for something and make it happen. Maybe it is taekwondo, or perhaps aikido, karate, fly fishing, coin collecƟng, piano or a billion other things. It doesn’t maƩer, what maƩers is the passion we have for it and the lessons we learn from it. Have fun.

AN OUNCE OF PREVENTION IS WORTH A POUND OF CURE. ~ Benjamin Franklin

E

very year I get several dozen calls about a leaky roof, sagging floor in a bathroom, paint that is bubbling or chipping, or signs of pests. The customer usually does a great job explaining the problem and wants us to come and take a look. My first thought is: where is the water coming from? Whether it’s from Mother Nature or the home’s water supply we always have to look for the source. Once I meet with the customer to look over the problem, I then start to look for the source. If there is a roof leak I like to look on the roof, in the aƫc and in the basement. If the drywall in a living area is stained or discolored I like to look above and below the leak area and on any outside walls. In most cases, the source is preƩy easy to find. And once the source has been located then we need to fix that problem first before we move to the cosmeƟc or structural work the water damaged caused. If or when this type of situaƟon happens to you as a homeowner, I always recommend calling us at the first sign of water or change in the appearance of wall, ceiling or floor surface. Leƫng leaks and water damage conƟnue over Ɵme is just asking for problems. Not only do we conƟnue to see the observable damage, but prolonged neglect or lack of aƩenƟon to water damage will eventually damage the very bones of your home (structural framing and foundaƟon). I have seen small leaks around toilets that have been neglected for years end up being a complete floor and wall redo. I have also seen roof leaks turn into complete redo of the shingles and the structural framing. What you see on the surface of a water leak, whether it’s ceiling drywall or floor Ɵle may look innocent, but underneath all the necessary components of the floor or ceiling are being damaged.

One of the hardest parts of my job is showing a customer the amount and scope of damage that a small roof leak or leaky shower faucet has caused. We will do what we have to in order to fix the leak and all the damaged items, but a lot of the Ɵme early maintenance would have prevented the situaƟon in the first place—including the addiƟonal cost. All homes, new and old require maintenance. I have read numerous arƟcles over the years about what a homeowner can expect in terms of yearly maintenance on a home. Some of the arƟcles talk about the need to spend 1% to 2% of the homes value on rouƟne maintenance. This number maybe true, but I know for my home some years I only spend $500.00 and others I spend $5000.00. For me, the key is not how much you may or may not have to spend, but to just pay aƩenƟon to your house. In my mind, maintenance is all about prevenƟon. Walk around your house several Ɵmes during each season (inside and out) and look for changes in paint color/staining, areas where water could enter the home, missing/ cracked shingles, squeaky floors, loose floor or wall Ɵle, wet areas in cabinets or in the basement, pests, etc. If something doesn’t look right, have it checked out. IMPORTANT NEWS UPDATE! Summer con nues in the Capital District and you know what that means. Sweltering temperatures with no breeze in sight, seemingly endless stretches of humidity followed by random thunderstorms on any days you schedule an outdoor barbeque, the AC in your car suddenly stops working the one day you need to wear a suit to work, etc. Welcome to August my friends! Let’s focus on the posi ve: it’s finally nice out and all your appliances are actually working great. But if something stops working properly, you’ll want to replace it right away and have the broken one taken out ASAP. That’s where we come in, in this case, literally. Don’t let just anyone take these away for you; it’s me to call Scrapster. Here’s why: older air condi oners, central air condensers, dehumidifiers, refrigerators, freezers and water fountains/ coolers all contain refrigerants (think Freon) like R-12, R-22 and R-500. It is commonly believed that these substances are major contributors towards the deple on of the ozone layer and other problems in the environment. Even modern refrigerants like R-134a and R-410a are not the greatest, but they are vast improvements over the older technology. er a long winter, we definitely deserve the great weather that we’ve been having this summer. Wouldn’t it would be great to relax on the porch, deck, beach, or between races at the track, with a good book? Here are some recent tles that might strike your fancy. The Forsaken by Ace Atkins With this fourth entry in the Quinn Colson series, Atkins is ge ng be er and be er with each novel. Colson may be the quintessen al small-town sheriff, but this is no laid-back mystery, as he is coping with the a ermath of a shoo ng in the last novel, the release from prison of the leader of a biker gang and a request to look into a thirty year-old rape and murder by a survivor of that crime. Atkins has also taken on wri ng the Spencer novels a er the death of Robert B. Parker. The Black-Eyed Blonde: A Philip Marlowe Novel by Benjamin Black Black, a novelist who writes literary fic on under his real name, John Banville, brings us a new Philip Marlowe novel, and a return to the film noir style of detec ve novel. The blonde in ques on is Clare Cavendish who asks for Marlowe’s help in finding her missing lover, Nico Peterson. Finding out what happened to Nico is the easy part, but Clare has more to hide and Marlowe finds it a much tougher job when he starts inves ga ng his client. The Silkworm by Robert Galbraith (aka J.K. Rowling) It is the return of Cormoran Strike in this sequel to Galbraith’s smash bestselling “debut”, The Cuckoo’s Calling. The exmilitary, private detec ve and his trusty assistant Robin are called in to solve the case of a missing novelist, who latest manuscript airs the dirty laundry of many prominent English families. The debut received great praise, before the real author was known, and an cipa on for this novel was very high. Galbraith does not disappoint. The Ice Cream Queen of Orchard Street by Susan Jane Gilman Moving from Russia to the Lower East Side in the early 1900’s, Malka Treynovsky works hard to adjust to her family’s new life in America. She learns about business and the ice cream trade with training from a vendor of Italian ice and before long comes Lillian Dunkle, the head of an ice cream empire, a television personality and a force to be reckoned with, a story spanning 70 years of American life. Gilman is also the author of a very funny memoir, Hypocrite in a Pouffy White Dress.

The Matchmaker by Elin Hilderbrand It wouldn’t be summer in Nantucket without a new novel by Hilderbrand and this novel makes it a baker’s dozen. Dabney Kimball Beech is a very successful matchmaker, with forty-two couples that she has brought together and with a husband and family of her own. When an early love of her own returns home, she begins to ques on her own roman c history and the choices that she has made. It’s a novel perfect for any beach getaway. The Hundred-Year House by Rebecca Makkai Zee Devohrs and her unemployed husband Doug, return to live in the coach house of her family’s home, Laurelfield, which survived for a long me as an ar st colony following the death of the lady of the house. When Doug a empts to learn more about the history of the ar st colony, he is thwarted by Zee’s mother, the keeper of family secrets. The novel moves backwards in me as it progresses and we undercover more about this estate north of Chicago. Landline by Rainbow Rowell Rowell is an acclaimed writer of fic on for younger audiences, but this novel about marriage and second chances is aimed squarely at adults. Imagine being given an amazing career opportunity though your spouse doesn’t support your choice. This is what Georgie McCool faces and is surprised when her husband and children leave a er she cancels a Christmas vaca on. When she tries to contact them, he reaches her husband, sort of, as she is connected with a younger version of her husband. It’s then that she realizes that she has an opportunity to look at what drew her to her husband in the first place. The Heist by Daniel Silva Art restorer and former spy Gabriel Allon returns to both former jobs in the latest novel by thriller writer, Daniel Silva. Allon is a emp ng to aid his art dealer friend, who has stumbled upon a murder scene in Italy and is being held for ques oning. In addi on to finding “the real killers”, he must track down one of the most famous missing pieces of art in the world, a masterpiece by Caravaggio.
