notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - I write this month’s column with a touch of sadness, as it is the last time I will be speaking to you via Our Towne Guilderland as your Town Supervisor. After 16 years in office, I decided that it was time to retire from public office so that I could spend more time with my family. It has been an honor to serve the people of Guilderland as Town Supervisor since January, 2000. I entered office with the intention of working hard, of listening to people with an open mind, and of staying focused on the goal of leading the Town’s efforts to provide excellent municipal services at a reasonable cost. I am happy to say that, over the course of my time in office, Guilderland’s Town tax rate remained the same, a record that it was not always easy to sustain, especially during the recent recession. However, even as we worked to hold the line on taxes, Guilderland maintained and improved the services provided to residents. Some of the things we were able to accomplish that I will remember going forward involve needed improvements to public infrastructure. We expanded municipal water services to large areas of rural Guilderland, built miles of sidewalks in a number of our neighborhoods, significantly reduced flooding on Western Avenue, and have secured grant funding to address stormwater issues in McKownville. Some of our efforts have also addressed the quality of life enjoyed by Guilderland’s residents. We have significantly expanded our public

park system through the addition of DiCaprio Park and Western Turnpike Golf Course, and have maintained and improved those facilities, as well as the rest of the Town’s parks, most notably Tawasentha Park. We have also maintained and expanded a wide range of resident services, from senior services to summer recreation programs, and have continued to provide public safety and emergency services programs that the community can take great pride in. I would be remiss if I failed to note that, as we achieved these successes, we did so in a fiscally responsible manner, and I will leave office secure in the knowledge that Guilderland has a balanced budget and a sound level of financial reserves. I did not, as Town Supervisor, accomplish any of this on my own. It is important for me to acknowledge, as I have always endeavored to do, the hard work of Guilderland’s dedicated workforce. We could never have achieved as much as we have without their efforts. They remained loyal and committed to the mission of delivering quality services cost-efficiently, even during the economic downturn. I would also like to acknowledge the cooperation I received from numerous other elected officials at various levels of government, most especially the Guilderland Town Board. When people work together, as was generally the case during my time in office, real progress is possible. The voters of Guilderland spoke their minds on November 3, and selected Peter Barber as my successor. I have

known Peter for a number of years, and have had an opportunity to see his capabilities demonstrated during his tenure as Chairman of Guilderland’s Zoning Board of Appeals. He is an experienced leader, with the knowledge, integrity, and commitment to maintain and build upon what we have achieved during my time in office. I wish him every success going forward, and hope that he is fortunate enough to receive the level of cooperation I enjoyed from Town staff and other elected officials. I know that he intends to keep in touch with our residents through this column in Our Towne Guilderland, and I salute Publisher Lowell Knapp for continuing this tradition. 7 Ways to Flex Your Flex Spending Account: on your eyes by Dr. Chad Vaughn Guilderland, NY - With less than a month left to use the funds in your Flexible Spending Account, don’t forget to use some of that flex money to give your eyes a little love. Here are the top SEVEN ways you can use your Flex Spending Account on vision-related needs before you lose your dollars for good. Prescription Sunglasses: Because prescription sunglasses are considered medical devices, they qualify as an eligible Flex purchase. So if you’ve been dying to add a great pair of designer prescription sunglasses to your eyewear collection, now is the time. Any sunglass frame qualifies — including designer sunglasses — just as long as they contain valid prescription lenses. Prescription Eyeglasses or Reading Glasses: Like prescription sunglasses, eye glasses are medical devices. So Flex funds can be spent on both prescription lenses and the frames to hold the lenses. If you’ve been putting off getting a new pair of prescription glasses, December is a great time to get an eye exam and upgrade your eyewear. Q. What year did your music education program for adults 50+ start? A. The Keys to Fun® program started over 20 years ago by its founder Lou Lansing and is continued by qualified instructors in four states. Q. Where are you located and were you always in the same location? A. We are now located at 1 Charles Blvd., 1.9 miles from Crossgates Mall. Our teaching facility is over 5,000 sq. ft. with two main teaching rooms and 4 private lesson rooms. Q. Do you teach children? A. No we only teach adults 50 and over. All of our instructors are specially certified to teach mature adults. Q. When did you get into the business? A. I started in the business in 1996 and am the current President of Keys to Fun. Q. Do you have many regular students? Is there anything specific that they are always coming in for? A. We have over 200 students attending classes and our students come in to see us once a week for classes and sometimes twice when they have a scheduled private lesson. They come in for small group music lessons on the piano, organ and/or keyboard. Q. Are you known for anything special? A. Our specialty is teaching to mature adults age 50+, in fact we just celebrated a birthday with a customer who just turned 91. We are known for taking someone who has never played a musical instrument, can’t read music or “carry a tune in a bucket” to love and enjoy making the kind of music that they love in a way that they can accomplish with great success. Q. What hours are you open? A. We are open most days from 10-5, but we also offer classes in the evening and teach until 8:00.

Q. What do you love most about the business? A. All the instructors and I love working with adults and teaching them to play a musical instrument and teach them to fall in love with music all over again. They get to play their music, their way… It is a lot of fun. Q. What do you think is your biggest challenge with the business? A. Convincing people to start is the biggest challenge. Most adults feel they are too old, not dexterous enough, or have no musical ability. I have one student who started when he was 72 and is now 83. He was told he had a “tin ear” and that he should never try to sing or play music. He now enjoys making music and playing in retirement centers bringing them the music that they love. Q. Are their health benefits from being involved in the KEYS TO FUN® program? A. There have been countless studies that have shown the benefits to learning a musical instrument but there is one that is specific to the type of program we teach. The Music Making and Wellness Project headed by Dr. Fredrick Tims of the Michigan State Music Therapy department assembled a multi-disciplinary team of researchers from various universities throughout the United States and Sweden. The study was projected over a five-year span. Phase I was a preliminary trial that took place from January 1996 to September 1997 at Music Centers in Clearwater, Florida. In this phase, 80 subjects were divided into two groups: the experimental group took weekly organ/keyboard lessons of varying levels, whereas the control group did not. All participants were asked to complete written wellness inventory tests to assess general physical health and self-perception of their mental states. The data were collected over 50 weeks: blood tests were taken and participants completed written survey tests every 10 weeks. The research results were positive. Anxiety, depression and perception of loneliness all decreased for those taking music lessons, while very little change occurred for members of the control group. Most significant in the study was that the blood tests of those taking lessons indicated a 90 percent increase during the test period in levels of Human Growth Hormone (hGH), which normally decreases at a rapid rate as one ages. Higher hGH levels will increase energy, while decreasing the occurrence rate of illnesses related to aging. Those not taking lessons showed very little change in hGH levels during the same time frame. Q. When do classes start? A. We start classes a couple of times through out the year and will be beginning classes in the very near future. We teach both day and evening classes through out the week.

We are once again out and about supporting our small (and large!) businesses right here in our community with our GuilderLocal initiative. Make sure you hop on our facebook and website and look at all of the different businesses we are highlighting with question and answer sessions! Our shop local Elf is also back and visiting our businesses with his antics! We are also officially launching our shared workspace for local businesses who wish to share a low cost space, or a temporary office for those looking for a desk or entire office to rent. Shared workspaces are an up and coming trend is something that the Guilderland business community and surrounding communities are looking for due to the low cost and low commitment options. This past May we just finished up a pretty extensive research initiative on what our local businesses want and need. We found that many of them really wanted infrastructure, but didn’t necessarily want to commit to an entire office. We also found that many of our small and home based businesses really just want the opportunity to connect and meet with people in order to brainstorm, get ideas, and advice from other businesses owners. The shared workspace will feature free wi-fi, access to the space, a business address, use of fax, scanner, and printer, meeting room,

free and easy parking, and a desk provided by the chamber. There are different options for people who are interested in renting a desk and sharing a space with another business, or you can rent an entire office. You can also rent for the day, or the month! That’s the great part about this program, we are flexible, and our location is surrounded by places to eat, coffee shops, we have Vent fitness right here, we are on the bus line, and we have stores and shops all within walking distance, not the mention the easy parking. This is part of what is coming up in our future, it’s all part of the new shared economy theme which we are proud to be a part. Guilderland Chamber holds Successful Surprise Cash Mob The Guilderland Chamber of Commerce hosted their first Cash mob on Tuesday November 24th at 11am at Oliva Gourmet Olive Oils and Vinegars located in Stuyvesant Plaza. The Cash mob is an effort part of the GuilderLocal programming to get customers through the doors of local retail businesses. “We figured this would be perfect timing with Small Business Saturday coming up on the 28th. We want our businesses to know that we are trying to get the community to use them, and make a tried and true effort to get people in the local stores, ones that they may not have known are right here in our town.” Cash mobs are much like the ever popular flash mobs. However, in a cash mob, the group arrives to one location at the same time to buy goods in order to give a quick boost to the store. The group arrived unannounced at 11am to browse and purchase items and surprised owner Kathy Connelly who was there as the lone employee for the day. “Kathy was a really great sport and took the group of people arriving at the same time in stride! I don’t think she was expecting the 15 people we had to all show up at the same time to shop on a Tuesday morning!” Gauthier said. Gauthier went to say that “We are hoping to do more cash mobs soon in the area to really get our GuilderLocal efforts out there. We are also implementing other programming to help those businesses who don’t have customers, but have clients, or other businesses as a base, and provide services instead of items. We have a lot of great things in store soon, but this so far has worked out great and I cannot wait to do another one in the days ahead.” Gauthier hopes that more members and community members will be on board for more cash mobs and that these cash mobs will be used as a way to draw more attention for our local businesses.

Holiday Hope By Master Rice Over the thanksgiving break I got to watch my nephew and my son play the new Star Wars Battlefield video game. I don’t really play video games often any more; maybe my run ended with Super Mario Bros in the nineties, or maybe I just can’t compete any longer, but I do like to watch my relatives and friends play. While I was watching this new Star Wars game and feeling thankful for the family and friends I was surrounded by, it occurred to me that one of the underlying themes is hope, in fact, if memory serves the first episode I saw in 1977 was entitled “A New Hope”. It is hope quite often that drives us. Without it we can flounder and lack focus. With it we find energy and stamina which could easily be replaced with laziness and despair without it. Call it desires, dreams, aspirations or hope the same is true; we need it. Personally, the hope of finally winning a medal at Nationals drives many aspects of my life not the least of which is my physical and mental training and my detailed study of the martial art I teach. This aspiration gives focus and strength every day. Among other foci, it makes it easy to get up in the morning and possible to work through the day. It allows me to maintain a positive attitude (most of the time), even when things get tough. Add to this that the next white belt I teach may grow into a black belt of excellent character developing memories to last their whole life, or that my next preCalculus student could go on to develop important technology that helps us get to Mars, and my motivation package is complete.

As I was thinking of all of these things at once while watching the kids play, I realized that I am very fortunate, as most of us realize this time of year. Just like the pervasive yin yang in martial arts there is the other side of the proverbial coin. Many people lack hope. They do not have access to education, they may even lack some of what we would call necessities. They are families that love each other dearly and work very hard, but somewhere along the way, hope disappeared into poverty or misfortune. We live in a very generous community. I have seen so much selflessness among the wonderful Taekwondo family I have managed to surround myself with. Each year we adopt a family for the holidays and our students provide an incredible assortment of gifts. It gives me great joy that we can cause this and give some family just a little more hope during the holidays, because with that hope, perhaps something can change. You never know, maybe that little burst of hope will inspire one of the children to study hard and some day find a cure for cancer. At GMA we try to do our small part as members of our community to make Guilderland and the surrounding communities better places, and I sincerely thank all of our students for having the character to achieve this. Do not feel bad when you have to say no to some, because you simply cannot contribute to every cause, but pick your thing to be involved with this season, make your contribution and be proud and hopeful about it. On behalf of Guilderland Martial Arts, I wish all of the families of our community the happiest holidays as we roll into 2016.

Guilderland, NY - The air is getting chilly, the sleigh rides have begun in Stuyvesant Plaza, and the Starbucks red cups (although hotly debated this year) are popping up all over the Capital Region the holiday season is officially here! As the craziness sets in, it can become difficult to stay on track with our health. We are bombarded with tasty treats at every turn, and may feel the need now and then to skip a workout because there is just so much to do. So by New Years, we feel frumpy, lazy, and ready for a change. Let’s try to turn that around this year by staying healthy THROUGH the holidays! Here are just a few of our CrossFit Aevitas tips to stay healthy and happy during the holiday season. Below you’ll find our top tips for keeping your health in check during the most difficult seasonal scenarios: holiday parties, holiday shopping, and the holidays at work.

Tips for Holiday get-togethers: 1- Pre-eat before parties! If you’re heading to a neighborhood or work party where you know there will be mostly rich temptation foods, save yourself by eating a salad before you go. JUDICIAL BRANCH 101 by Leyla A. Kiosse As the recent supreme court judicial race has just occurred and absentee ballots are still being counted, I thought I would discuss our state system of government as it pertains to the judicial branch. This is part one of a two part series on this subject. The “supreme” court in New York is not the highest level court but a court of “general jurisdiction” which handles matters from divorces to personal injury to commercial claims. Our government is divided into three branches: legislative, executive, and judicial. Despite popular belief, the judicial branch is not the puppet of the legislative or executive branch. This is an independent branch of government (made up of various courts), whose obligation it is to enforce and interpret laws in order to decide their practical application and constitutionality. Whenever I hear someone say “renegade judge” I often wonder if that person was absent from school the day this lesson was taught, because each judge will think and operate differently, just as each legislator will. The structure of our court system (i.e. judicial branch) in New York State is complex1. There are the trial courts, comprised of City Courts, Town and Village Justice Courts, County Courts, District Courts (in certain counties), Supreme Court, Family Court, Surrogate’s Court, and the Court of Claims. Trial courts are courts that handle criminal and civil matters, although each court may have specific limitations on the type of case that may be brought in that court.

For example, town courts handle traffic tickets, misdemeanors and lesser offenses, and they handle civil suits for monetary claims up to $3,000. The Court of Claims has exclusive authority over any lawsuit that seeks money damages against the State of New York, and certain state related entities (e.g. NYS Thruway). We also have the “intermediate” appellate courts, which are made up of four appellate divisions, with one in each judicial department. New York is divided into four judicial departments, with each aptly named the First, Second, Third, and Fourth Departments. The intermediate appellate courts hear civil and criminal appeals from lower courts. For those that live in the Capital District and the surrounding areas, you are located in the Third Judicial Department. The geographic region of the Third Department is enormous (ranging from the Canadian border to the lower Catskills and from the Vermont/Massachusetts border to the Finger Lakes). Finally, we have the Court of Appeals, which is New York’s highest court. This court hears appeals from the state’s intermediate appellate courts, and in some instances from the trial courts. We are fortunate that the Third Department and Court of Appeals are here in Albany and are open to the public. Have you ever wondered how judges are selected for each of these courts? WHAT AM I SUPPOSED TO EAT? by Kelly Pickering, Wellness Coach

Guilderland, NY - Paleo, plant based, vegan, vegetarian, lowfat, high carb, high-fat, low carb. It’s confusing to say the least and causes us to question how exactly it IS that we ought to be eating. I am not a fan of “diets” in the conventional sense because I feel that they do not work in the long run. But for the sake of ease in this article, let’s use the word diet to refer to an eating lifestyle. People choose a certain way of eating for various reasons including religious beliefs, personal eth-ics, finances, ease, weight loss/maintenance, or personal preference of taste. None of these reasons are wrong for everybody or right for everybody. We are all bio-individual meaning we all have our own unique physiologies and what works for me may be totally wrong for you. That being said, when we look at how our not so distant ancestors ate, there was much less fuss over what they should or should not be eating. Nutrition was not measured in calories, or fat grams, and certainly not carbs. Fresh food was grown and prepared at home and most families “put up” meats, vegetables and fruit for the winter by canning and freezing and breads were homemade. There were no such things as microwaves or boil in a bag meals, let alone fast food restaurants. All food was organic and non-GMO (genetically modified). How have we gotten so far away from eating the way our ancestors ate? Big food companies have catered to peoples’ busy lives by developing “fast” foods in the name of convenience. In today’s grocery stores, the aisles are lined with packaged, boxed, and bagged “foods” that are mostly de-void of real nutrition. As a result, we have become a society of overfed, undernourished people. Obesity is an epidemic and diabetes, heart disease, and cancer are prevalent.

Let’s return to the question “what AM I supposed to eat?” The idea that we “should” be eating a specific way can create feelings of guilt, stress, and failure which can lead to weight gain all by it-self and create an atmosphere of dis-ease. But the fact that we are bio-individual does mean that there is no one size fits all diet and may require some trial and error to see what works best for us. There are many things that factor into finding the eating lifestyle that’s healthiest for us, including heritage, blood type, whether we sleep well or not, or a sedentary vs. active lifestyle to name a few. But something I teach all of my clients to do is recognize food for its nutritional value. One of the best ways to do this is to buy “whole”, preferably organic foods that don’t require a food label. This way you can be sure they are foods the way they were intended to be and packed with nutri-tion! Nature doesn’t make mistakes and taking small steps back to basics is sure to yield great re-sults. FEES AND COMMISSIONS IN THE FINANCIAL SERVICES INDUSTRY BY DANIEL BAUER

Guilderland, NY - The retail financial services industry offers products and services through two very broad arms – broker-dealers and registered investment advisors. It is important for consumers of financial services to understand how their advisor is being compensated. The Broker-Dealer world consists of wellknown firms such as Merrill Lynch, Morgan Stanley Smith Barney, and Wells Fargo, along with many independent firms such as LPL Financial, Commonwealth Financial, and VOYA Financial Advisors. Broker-dealers are regulated by both the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA) and their revenue is generally a result of commissions generated by securities transactions. A securities transaction may be the purchase or sale of a stock, mutual fund, real estate investment trust, variable annuity, variable life insurance, etc. An advisor with such a firm is considered a ‘registered representative’ of the firm, and his/her income is generally based on transactions processed on behalf of

clients. Commissions are typically built into the price that a consumer pays for a securities product, which means that the consumer is not making a direct payment to the broker-dealer firm. The Registered Investment Advisor (RIA) world is regulated by the SEC and/or the states in which it serves clients. Generally speaking, an RIA firm provides financial advice and guidance to clients in exchange for fees paid directly by the client. Types of advice offered by an RIA firm vary, but typically include cash flow analysis, retirement income planning, income tax analysis, investment management, estate distribution planning, etc. RIA firms are generally viewed as having fewer conflicts of interest with their customers due to the non-transactional nature of the relationship. The financial services industry has seen a large shift during the past 10 years away from the broker-dealer channel and towards the RIA channel. According to Cerulli Associates in its December 2013 edution of “The Cerulli Edge: US Asset

Management Edition”, the RIA channel grew at an average annual rate of 8% from 2004 to 2012, while broker-dealer channels actually saw an overall decline in business during this same period. We attribute this trend to the notion that RIA firms owe their clients a fiduciary duty, which is a much stronger duty of care than the suitability standard required by broker-dealer firms. In other words, an RIA firm is required to sit on the same side of the table as its client, while a brokerdealer firm is not. Eat a healthy diet. Include plenty of dairy and other calcium-rich foods in your diet. Calcium helps maintain strong bones and teeth.

Don’t smoke or use smokeless tobacco. People who smoke are four times more likely than nonsmokers to have gum disease.

Whiten teeth. While the benefits are solely cosmetic, whitening is a very safe procedure that will not harm your teeth as long as the products are used as directed and you are under the care of a dentist.

Consider cosmetic procedures. The first thing a person sees when they meet you is your smile, and having crooked, stained, or missing teeth can affect your confidence. There have been great advances in cosmetic dentistry and it is possible to fix most cosmetic problems. Veneers for improving the appearance of crooked, stained, or oddly shaped teeth and orthodontics for straightening teeth are only two of the many cosmetic procedures offered.

The Ghost of Scrapster Past reminded me of how we started, filling my Ford Ranger skyward to the point the Beverly Hillbillies were like ”Dang, look at that, Grandma!” Travelling far and wide even for one item, mee ng new people, building rela onships as the business grew, finding the best plan that would accomplish the most good. Guilderland Chamber Launches Shared Workspace for Businesses Guilderland, NY- The Guilderland Chamber of Commerce has announced that they have launched a shared workspace for local businesses who wish to share a low cost space, or a temporary office for those looking for a desk or entire office to rent. Erika Gauthier, President of the Guilderland Chamber of Commerce, says this up and coming trend is something that the Guilderland business community and surrounding communities are looking for due to the low cost and low commitment options. “This past May we just finished up a pretty extensive research initiative on what our local businesses want and need. We found that many of them really wanted infrastructure, but didn’t necessarily want to commit to an entire office. We also found that many of our small and home based businesses really just want the opportunity to connect and meet with people in order to brainstorm, get ideas, and advice from other businesses owners. We happened to have the space, and one of our board members suggested this type of idea, so we decided to put in in our strategic plan and do it” Gauthier stated. Gauthier went on to say that the chamber has revamped their entire strategic plan to bring more value to businesses in the area by launching the shared workspace as part of their GuilderLocal initiative and really focusing on businesses needs and wants by industry as well as community based education and programming. The shared workspace will feature free wi-fi, access to the space, a business address, use of fax, scanner, and printer, meeting room, free and easy parking, and a desk provided by the chamber. There are four desk total available within two offices. “We do have some different options for people. If they want to rent an entire office they can, or they can just rent the desk and share the office with another business. They can also just rent for the day or week if they wish, or have a long term lease. That’s the great part about this program, we are flexible, and our location is surrounded by places to eat, coffee shops, we have Vent fitness right here, we are on the bus line, and we have stores and shops all within walking distance, not the mention the easy parking. This is part of what is coming up in our future, it’s all part of the new shared economy theme.” Gauthier did say that any business looking to rent a space long term does have to undergo a background credit check and must sign a lease. Pricing for a monthly space starts at $175 with day passes at $25. The Guilderland Chamber offices are located in Star Plaza at 2050 Western Ave., upstairs in the plaza.
