While it was pool weather for the thermally ambitious, I write these notes in anticipation of a return to more normal winter weather this December. The Town park system offers wide-ranging recreation activities, including snowshoeing and groomed cross-country skiing at the Western Turnpike Golf Course, sledding at the Winter Recreation Area, and winter hiking at Tawasentha Park. If you’re interested in renting snowshoes or crosscountry skis, or need more information about Town parks, please check the Parks and Recreation Department’s webpage or call the Parks’ Office at 456-3150. Please note that winter sports equipment is only available for rent during workday hours at the Parks’ Office. And while Spring is more than a season away, it is not too early to start making plans for the warmer weather. Starting January 3, 2017, Tawasentha Park’s three pavilions, including the newly reconstructed Chalet building, can be reserved for outings and special events at the Parks’ Office. The Western Turnpike Golf Course is offering residents and non-residents the opportunity to purchase by December 31st discounted 2017 memberships that allow unlimited golf for one season. You can print out a membership application at: https://www.westernturnpike.com/ membership. At the request of Town Departments, I draw your attention to two recurring issues. Town law prohibits overnight parking on Town roads during winter months so that the Highway Department may safely clear and maintain roads. An illegally parked vehicle can delay or prevent a snow plow operator from clearing the road, negatively impact neighbors, and increase snow removal costs. An illegally parked vehicle is subject to ticketing and towing. Town law also states that “all animals shall be kept on a leash at all times pursuant to Town Code §120-19.” The Parks Department receives complaints from park patrons who are confronted by unleashed dogs while walking their own dogs, and while enjoying Town parks with their family. The Town maintains a Nott Road Dog Park which allows for unleashed dogs during daylight hours. I again note work performed by Town employees that can be overlooked. As you may not know, the Town has assumed responsibility for clearing snow from the Town’s extensive and growing sidewalk system. Parks Department employees operate sidewalk plows that are kept in good working order by Highway Department mechanics. This shared workload has dramatically increased over the last several years with the construction of dozens of miles of sidewalk on Western Avenue (Route 20), Route 155, and Route 146, and in new residential subdivisions and commercial developments. Even more sidewalks are funded and/or scheduled for construction in the near future. As you might expect, keeping over 22 miles of sidewalks clear of 4

Peter G. Barber - Town Supervisor snow can be daunting with our typical winter weather. But this burden is greatly amplified when Parks Department employees are clearing snow from sidewalks on State highways after State DOT plows have repeatedly dumped tremendous amounts of snow from multiple lanes onto adjacent sidewalks. Sidewalk snowplow operators make repeated passes to keep up with falling snow and highway snow plows. For the past 17 years, the Town has used two Trackless machines equipped with a “V” plow and blower attachment. Despite their heavy usage in severe conditions, Highway Department employees have repaired and kept both machines in operation. But, as with this year’s purchase of a used paver and the conversion of a used school bus into a senior services’ bus, Town employees were keeping an eye out for affordable options for sidewalk snow removal. A few weeks ago, Greg Wier of the Parks Department and Lee Knaggs of the Highway Department, located, evaluated, and purchased at auction for $5,600, and later refurbished, a 2003 Trackless machine (see photo) with only about 1/3rd of the usage hours logged by the existing machines. A new Trackless sidewalk snow blower would exceed $100,000. With the three machines, the Town will be in a much better position to clear sidewalks of snow on a timely basis. It also important to remind drivers and pedestrians to be watchful for the presence of sidewalk snowplowing. Like the drivers of Highway Department snowplows, the operators of sidewalk plows are well trained and careful. But with inclement weather, poor lighting conditions, the noise of the machines, and looking over and around 10 foot or higher snow banks, the drivers and operators need your help by staying clear of their work area. Town offices will be closed on Monday, December 26th and may be subject to late opening or early closing due to inclement weather. The safety of Town residents and employees are paramount so, if bad weather is anticipated or taking place, please call ahead to make sure that Town office is open. The Town will also issue updates on closings and impacts on Town services on the Town website and using Nixle, a free text and email service. Thank you for taking the time to read these notes. What a month! The national elections are history. What do we think the effect will be on the business community? That’s a very good, important question.

History teaches us there is opportunity in change. There will be casualties and victors depending on the foresight of managers and agility in different business models. Building construction, architectural services, renovations, and the like will be watching interest rates. The Presidentelect has promised big infrastructure projects which would increase business for road and bridge builders. Everyone will focus on changes in income and business taxes also on health insurance costs. What does this mean for small businesses? I’m no economist. What I know is people will still need groceries, plumbers, local news, banks, lawyers, clothes, etc. etc. Small businesses are more attuned to what is happening on Main Street, USA than all the news media combined. They will be telling us the trends long before anyone else does. As for the Chamber of Commerce, our theme will remain the same – buy local. Remember that the people who work for small or large businesses, mom-andpop stores or the malls in Guilderland, Altamont, Voorheesville, and Rotterdam are your friends and neighbors. Don’t pay shipping charges. Do business with people you know. There is value in being part of a community and a positive investment in our future together.

Guilderland Cares by Susan Hennessy, Executive Director, Guilderland Food Pantry “I think I’m doing really well.”, said 87 years old, Roseann Malloy. Those are inspirational words from Roseann, considering the hardships she has endured in her lifetime. She inspires me to see life as a gift even if the world serves up some difficult events. Roseann is a guest at the Guilderland Food Pantry. I am the present director and have had many visits with Roseann in the past year. I have heard her story when I make food deliveries every 5 weeks. As I listened it seemed vaguely familiar until I realized that I already heard part of her story as a young adult growing ing up in Westmere and going to the same church hurch as Roseann. I remember my mother hanging nging up the phone one day and announcing with shock that Donald Malloy had died the previous evening. She told us that he was bowling with Roseann, threw a strike, ke, turned around to tell her, and dropped ed to the ground, dying of a heart attack. k. I was 16 at the time. I went to schooll with her 4 children. I remember how horrified I was thinking about how those kids would feel having a father on a Saturday night and not having one on Sunday morning. I tried to imagine how I would have felt if that was my father. Now it is 44 years later and I’m sitting in Roseann’s living room catching up with her as she tells me what happened after I left Albany for college lege and work in another part of the state. The children Kenny, Jerry, Donna, and Brian were all teenagers at the time and they all needed her. She would return to work to provide for the family at the State Nurse’s Association. She also taught quilting part time at the Colonie Town Center. She retired after 9 years of work because her grandchildren were arriving into the world she wanted to be involved in their lives. “ I do wish that I had worked longer than I did. If I had stayed 1 more year I would have been vested into my retirement with 10 years of service. I was not in the union so no one advised me about retirement. Consequently, I am not receiving a pension today.” In December 2015 at the age of 86, Roseann was having her bathroom repaired. She went in to check on the work being done and slipped and fell on the tarp the workers had laid down to collect debris. She broke her right hip. Surgery required rod placement in her thigh and her knee. After three months of therapy she returned home with a walker. Because her balance was not restored she fell again within weeks when she reached down to put away a book. She fell over her walker and broke her other hip and a wrist. This time she returned home with a wheelchair.
Because Roseann also has kidney and heart issues she requires frequent trips to doctors office. It’s very difficult coordinating all those appointments and harder to find the means of transportation. Roseann uses the town’s senior van for some doctor’s appointments because it is wheelchair accessible. She cannot use it for trips to Stuyvesant and Price Chopper because that van is not wheelchair accessible. She takes advantage of Community Caregivers but if a volunteer is not available that day they cannot offer her a ride. “My children all have full time jobs and cannot take 2 days a week off to transport me.”, says Roseann. “I’ve ttried CDTA but it cost $25 and I cannot aafford it. My copay is expensive at $50 a visit and I need to go twice a week for infusions.” inf Having enough food to eat is a challenge Hav Roseann also. “ I can’t get to the grocery for R store so I tried groceries to go. I make fruit salad with the canned fruit I get. I especially like creamed tuna on toast because I get tuna fish, chicken soup and bread. I don’ know what I would do without the pantry. All the people are so nice to me. If I ask for something they try to get that item for me.” As I continued my interview with Roseann I understood her acceptance for her lot in life. Despite not having financial security and struggling to get food and transportation she remains a very grateful lady. Her quilting from days long ago still hang on the wall for her to look at. She is always so grateful for the food we bring her and always thanks us as we walk out the door. “I pray thanks everyday to God and sprinkle my holy water on my prayers. And I have my dog, Precious, with me every minute.” Susan Hennessy is the Director of the Guilderland Food Pantry. The Guilderland Food Pantry is located in Hamilton Union Presbyterian Church at 2291 Western Ave. The pantry operates strictly on donations from the community’s churches, schools, businesses and individual donations. Back in my years of college sports, we were told to go stand in the freezing cold whirlpool for 10 minutes after our practices or just told to ice whatever hurts. Now there are so many gadgets, tools or techniques that are available to athletes. With their gaining popularity, I thought Iâ&#x20AC;&#x2122;d take some time to explain what these things do and best times to use them. First, let me explain some anatomy of soft tissue in the human body. These tissues are the ones most affected by using recovery tools. From the outside looking in, the outermost layer of tissue is the skin. The skin contains multiple types of nerve endings that communicate to your brain about what is happening to your body. For example, there are nerve endings that differentiate pain, heat, and cold, light touch and pressure. The next layer is fascia which is an interconnected web of connective tissue that is a barrier between skin and muscle. It also surrounds all your muscles, connects them together and allows for tissue glide. Fascia has 9 times the sensory nerve endings than muscle. The next layer is muscle tissue. So what does this have to do with sports and exercise? By stimulating different nerve endings with various amounts of pressure, rates of friction and vibrations, you can get a response from the body to either relax muscles, stimulate muscles, inhibit muscle spasms or increase hydration to certain tissues. Let me try to simplify with an example of how an athlete should use these principles to maximize their workout. Pre-workout: The athlete would want to stimulate the muscles they are going to use with quick rapid stimulation using a foam roller, recovery tool, stretching or vibration that lasts about 10 seconds. The goal is to active muscle contraction to prepare for sport. Post-workout: The athlete would want to use techniques to activate the deeper nerve endings within soft tissue to stimulate relaxation by using longer sustained pressure on a foam roller or recovery tool that lasts longer than 30 seconds. The goal is to relax tissues for lengthening and recovery. RECOVERY TOOLS

Live in the Moment By Master Rice
Guilderland, NY - So I waited patiently to see the next mysteries life revealed since last I wrote in October when our Dutchmen football team was 5-0 and Mete got injured. What choice do we really have but to wait anyway? In retrospect we add the adverb patient so we feel better. As it turned out, the Dutchmen got to play in a semi final section 2 game that unfortunately Shaker won leaving the Dutchmen with an 8-1 record. Mete did however, get in the game to punt and even made a tackle after a kick. Perseverance and positive attitude paid off again even if only for one final game, which thankfully I was able to attend. Conclusion is nice, happy conclusion even better, but then again, life may not always deliver it to us. The mysteries and plot twists life reveals to us often causes us to consider the importance of enjoying each and every moment and thing we do. I am frequently reminded of this by many and you may be too. But as always the best life lessons are learned a little closer to home. We all know someone who was right there laughing yesterday but today is ill or worse. Use this as a sign to laugh more, worry less and try to be positive about everything you do. This is a great season to bring this up for as we pass from Thanksgiving into the new year we are feeling thankful and holiday spirited. Take this opportunity to make your usual holiday donations but pay extra special attention to those close to you. The best contribution you can make to their lives and yours is to be happy for them and enjoy everything in every moment. Learn to enjoy when your children misbehave and you have to discipline them lovingly, for some day you will cry your eyes out like me when you drop them off at college, or give them away at the alter. Try to enjoy that guy that cuts you off in traffic and then presents a gesture, maybe his life is in trouble and he needs to let his anger out some way. Enjoy the good and the bad because you never do know what is going to happen next. I like the tenets of the National Honor Society, and we can use them as a guide for the season and for our happiness: •
Leadership- lead by example especially for happiness for everyone especially those close to you.

Scholarship- never stop learning by using every experience to learn something new and don't be disappointed by not having known already.
•
Service- do something for someone else without any strings, from the small to the big, make a difference.
•
Character- I am pretty sure we talked about this over the years and how it lies at the heart of our martial arts training at GMA and the heart of being able to do all of the above.

ACTIVE MANAGEMENT – CAN YOU WIN THE LOSER’S GAME? BY

Guilderland, NY - Investors are faced with a choice between more than 8,000 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all actively-managed mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1. S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias. 2. The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500. 3. S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the Vanguard Total Stock Market Index Fund ($463 billion in assets) than the Nuveen Growth Fund ($49 million in assets). For the period ending 06/30/2016, the SPIVA Scorecard showed that on a 10-year trailing basis, between 68% and 99% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the bestperforming category of US equity mutual funds (those in the Large Cap Value space), only 32% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble a portfolio.
We find two common objections to the advice to avoid actively-managed funds – the first is to only use activelymanaged funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that active-manager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of actively-managed funds to those with good track records. Bradford Cornell’s 2008 paper “Luck, Skill and Investment Performance invalidates this strategy. His results “indicate that most of the annual variation in [fund] performance is due to luck, not skill.” If skill is scarce while luck dominates, then past performance should not be relied upon to make investment decisions for the future. As we are told time and time again, past performance is not indicative of future results. Finance author Charles Ellis offered this sage advice in his book ‘Winning the Loser’s Game’: “Everything I know is known by the market and worked in to the market…The best way to invest is through benign neglect. Get your asset allocation right and leave your investments alone.” We couldn’t agree more!

FOSTERING GOOD RELATIONSHIPS WITH CLIENTS- RETAINER AGREEMENTS In New York, when you hire an attorney for a Family court or matrimonial matter, you must be provided with a Retainer Agreement1 . The Retainer Agreement must include: • • • • • • • • • • • • •
your name and address the nature of the services to be provided the amount of any advance retainer how any portion of the retainer may be refunded the client’s right to cancel the Agreement; how the attorney will be paid after the retainer is depleted the hourly rate of each person whose time may be charged to the client whether there is a minimum fee that the billing must be no less than every 60 days that the client will be provided with copies of correspondence and documents under what circumstance the attorney might seek a security interest under what circumstances the attorney might seek to withdraw from the case for non-payment information about arbitration should a dispute arise
As you can imagine, Retainer Agreements are often very lengthy to accommodate all of these requirements. While it may seem that it puts the attorney and client in an adversarial relationship, a better way to look at it is that each person knows her rights and responsibilities in the relationship. The consumer will have detailed information as to what she is charged and how those charges are calculated, and the attorney has assurance that there is a time frame to bill and be paid. While often clients are in a stressful and emotion position at the beginning of their case, taking a few minutes to understand the arrangement you are entering into will save you time (and hopefully money), in the future. Never rush into signing a Retainer Agreement! If you feel rushed, that is not a good sign. I always discourage clients from reviewing and signing Agreements in my office. I would rather the client take it home and read it thoroughly. While “it may be a lot of boilerplate” to me, it may not be that to you. For example, if there is not a specific “hourly rate of each person whose time may be charged to the client”, but a range (example Associates $100-400), take the time to ask the attorney what you will be charged and have the Agreement reflect that. Ask the lawyer who will be handling your case, and the specific charges to that person(s). Is there an advantage to a paralegal or new associate doing some of the work at a lower rate than a seasoned partner? If you have any questions regarding the Retainer Agreement or your bill, you must ask your attorney promptly. An attorney cannot charge you for time spent in discussion or explanation of bills2. If you find it awkward to discuss money with the provider of services, speak with someone else in the office (another attorney; bookkeeper; assistant), to have your questions answered. While this doesn’t often happen, if a client does have a dispute, she is entitled to fee arbitration3 . 1

From the Director On behalf of myself and the staff, foundation, and trustees of the Guilderland Public Library, I wish everyone a very happy holiday season and New Year! 2016 was a great year for the Library; I anticipate 2017 being even better! There are a few December events I’d like to highlight:

www.guilderhaven.org FOR ADOPTION Batman is a super friendly, easygoing, active and playful one year old neutered male kitty. He is a smallsized cat weighing in at 9 pounds. He is an all-black kitty with stunning green eyes who loves to give you eye contact. He is extremely affectionate and loves to cuddle your lap and be carried around in your arms. Batman makes sweet chirping noises to communicate with you and will meet you at the door when you come in. He enjoys human interaction and will want to be where you are in the house enjoying a family activity. Batman likes to sleep with his foster Dad every night along with the other kitties. He is loving, high-energy, yet easy-going and affectionate all in one! Poor Batman! We found him living under a porch of an abandoned house with nothing to eat. It seems his owner had moved and simply left him behind. He would come up to anyone walking by as if to ask for food. Batman is so happy to be inside and has no interest in going back outdoors. The best home for Batman would be one with at least one young cat that wishes to play with him. He seems to flourish in a multi-cat home. Teenie and Jett are two gentle but scared
“TANNER” is a neutered male cat, who was found in a back yard in January looking for food. When we took him in to be neutered, he tested positive for Feline Leukemia, therefore cannot be released back outside with other cats. He needs a home without other cats or with other cats who are Feline Leukemia positive. He is very friendly: likes to be brushed, loves to play w/toys, sat in my lap while sewing at the machine. I pick him up all the time. He had his Rabies Vaccine and Distemper Vaccine. He doesn’t seem to trust the foster dog that is downstairs w/ him so wants to atttack the dog (they are separated by a doggie gate and Tanner gets to come out when the foster dog is out for a walk. As soon as he hears us coming, he darts back to his room. If interested in this sweet cat, please call Deb at 518-765-5007.
bonded sisters about 8 months old looking for a forever home after being dumped into the innercity with no means to survive. They are tiny in size in that they weigh 5 to 6 pounds each. They were found with their mom hungry and living under a porch. They had been abandoned in an apartment and then put outside. Their mom was very friendly and has been adopted. Unfortunately because the girls were already 6 months old when rescued they are probably too old to domesticate into what most people consider “highly adoptable kitties”. That said, the girls are loving, gentle, and have absolutely NO aggression. They deserve a break in life. When you pick them up, they purr and want to be held. Teenie (the larger of the two) will cautiously come to you and wants to be held forever. Jett is more scared. With time, we do expect them to continue to become more human-oriented. As you can see by the picture the girls are very bonded. They would do great in an indoor home with other kitties they could emulate. They would also do very well in a warm barn home. Ivy is a very tiny energetic playful female looking for her forever home. She weighs in at seven pounds and is just now one year old. She enjoys people and will meet you at the door when you come home. Ivy is social and will be wherever you are in the house. She enjoys other kitties in her foster home. Ivy was found literally starving in an abandoned garage in the inner-city while struggling to feed her five kittens. She was being a great mom at the detriment of her personal health. The neighbors would watch her and the kittens but no one stepped up to feed them. Ivy is our hero! Ivy is spayed, up-todate on her vaccines, and negative for FIV/ Felv.
