Guilderland, NY - With this opening Supervisor’s Notes of 2016, I begin by thanking my predecessor Kenneth D. Runion for his sixteen years of exemplary service to the Town of Guilderland and its residents. I express my appreciation to our Town employees for their professional and courteous service to Town residents and businesses. I also thank Lowell Knapp, the publisher of Our Towne Guilderland, for printing this column which serves an important role in keeping you informed of happenings in your Town.

This first column is an opportunity to provide an abbreviated “State of the Town of Guilderland for 2016.” I am pleased to report that the Town starts 2016 with a balanced budget, significant reserves, and a strong credit rating. In the coming months, with the support of the Town Board and Town employees, we intend to pursue the following initiatives: •

Adopt the proposed new Zoning Code with streamlined approvals for new and expanding businesses, more allowed uses of property, increased protections of residential properties, and enhanced environmental protections.

•

Open a beautifully designed new pool house at Tawasentha Park and expand recreational activities at Town parks.

•

Award contracts for construction work to address storm water and flooding issues in McKownville.

•

Complete sidewalk and pedestrian improvements on Route 20 and seek funding for similar work on Route 146.

•

Secure dedicated space necessary for senior services programs.

•

Continue improvements to Town parks, historic buildings, and the Guilderland Performing Arts Center.

•

Review the use of Town parks, fields, and facilities to ensure their proper management.

•

Enhance the Town’s website to provide better access to Town forms and records, improved sharing of information, and greater public participation in public meetings.

I also thank State Senator George Amedore and Assemblymember Patricia Fahy for their tireless efforts to secure grants and funding for much of 2016’s planned initiatives. In future columns, I will provide updates on these and new initiatives.

The safety of Town residents, property, and Town employees is paramount. With winter’s arrival, I remind residents that overnight parking on Town roads is prohibited during winter months so that our Highway Department may safely clear and maintain our roads, and that drivers should maintain a safe distance from Highway Department trucks. Please also help our Town firefighters by taking the time to keep fire hydrants free of snow and ice and make sure that your house street number is visible from the road. In the months ahead, I intend to work with our Police Department to increase public awareness of recommended responses to security threats and improve security at Town-owned facilities.

We also invite you to use your Town park system for winter recreation activities, including snowshoeing, groomed cross-country skiing, and sledding. Please check the Parks and Recreation Department’s webpage or call the Parks Office at 456-3150 for information on current activities.

On behalf of the Town of Guilderland and its employees, we wish all of our residents, their families, and businesses a happy, safe, and prosperous New Year.

Happy New Year!

2016 is shaping up to be a great year at the GCC so far! First I would like to give a warm welcome to our new Membership Associate, Briana Lampman. Briana holds an associates in Business Administration as well as a Bachelors Degree in Communications. She is a hair and make-up artist as well, and has already hit the ground running!

I would also like to welcome Bill Coons of CMK & Associates Real estate and Dr. Richard Berning as our very first shared workspace members! We are excited to get our place up and running and are very happy with our official launch.

Looking back at 2015 and what the chamber has accomplished, is pretty amazing. When I think back to where we were this time last year, to where we are now, we have grown by leaps and bounds.

2015 marked the year we finally had a clear-cut feasible strategic plan approved in order to better help serve our members. We ended a pretty intensive research project to find out what our members, and our business community really needed and wanted from us. We expanded on our GuilderLocal campaign and will continue to do so in 2016. We really started to clean up our focus, have a direction, and really thought about who we were as a chamber.

For the first time in our history we implemented a core values and a vision approach, which can be found on our website. We also really worked to improve the quality of our programming and the services we offer you and even saw some old members come back to us. 2015 also saw the advent of a health and wellness program, new partnerships with other chambers and organizations, and of course, our shared workspaces.

As I look on to 2016 and where we are going, I feel confident that we will continue to serve our members and be innovative in our thinking. Without our members and businesses, none of this would be possible. I know we will continue to grow, and be successful in connecting our community and our businesses.

We will continue with our new programming as well as implementing new luncheon programs. 2016 will still feature our mixers, GuilderLocal, speed networking, partnering with other organizations and chambers for great networking events and partnering with those in our community.

Guilderland, NY - I have written about the accomplishments and contributions of our Guilderland Martial Arts Leadership Team before. This month I wanted to share with you a new program the team has begun. Recently, they have volunteered their time to work with children from our community that have physical limitations, to help them experience the martial arts. These students can now benefit from the focus, balance, coordination and exercise gained through the study of taekwondo that can positivity impact their functioning with their disability.

You may wonder what motivates our team to give back to our community in his way. The study of taekwondo has positively affected our lives in many ways and we love to share it and give back to our community. Taekwondo has changed our lives by developing our character for perseverance and integrity. It has given us greater success in all aspects of our lives. If we can help even just one person improve their life through taekwondo, then our contribution would be significant, but we help many every day. We know helping children with disabilities to accomplish martial arts tasks like breaking boards will help their self image and improve their physical condition. How could we miss the opportunity to change someoneâ&#x20AC;&#x2122;s life?

NEW YEAR, NEW RULES

Guilderland, NY - As we say goodbye to 2015, we in the matrimonial bar say hello to new laws about maintenance. Before we explore what the new law is all about, let’s review what the law was prior to the new statute.

First, some basics about maintenance: “maintenance” is also known as spousal support (fka alimony). In New York, maintenance can be awarded by the Supreme Court within the context of a divorce action, or by the Family Court where the parties are still married.

The statute that the Supreme Court applies for awarding maintenance is the “Domestic Relations Law,” whereas the statute that the Family Court applies is the “Family Court Act.” The language concerning maintenance in each statute was different, which resulted in Supreme Court applying one standard for deciding maintenance and Family Court applying another.

In 2010, New York significantly changed its laws concerning the payment of maintenance.

Up until that time, whether a Court awarded maintenance was discretionary. In other words, the Court would decide whether maintenance was appropriate and, if so, how much should be paid and for how long; this decision was based on a consideration of a series of statutory factors (for example, the age and health of the parties, the length of the marriage, the ability of one spouse to be self-supporting, the ability of the spouse to pay maintenance, etc.)1. Since maintenance was discretionary, there was tremendous uncertainty as to what a Court would do for a client that was seeking maintenance.

The 2010 maintenance statute (Domestic Relations Law Section 236 Part B) introduced a formula that the Supreme Court is required to apply whenever a request is made for “temporary maintenance” (i.e. maintenance that is paid while the divorce is pending). This formula is based on the incomes of each spouse, and “income” is defined by statute.

The statute imposes a “cap” on the amount of income that can be used for calculating maintenance awards. Otherwise known as the “income cap,” this amount was set at $543,000. So, for example, if the spouse being asked to pay maintenance earned $750,000 annually, the Court could only use $543,000 of that spouse’s income to calculate the temporary maintenance award. The amount of maintenance calculated pursuant to the formula is presumed to be the amount that should be paid; however, the Court retained discretion to adjust this amount, and whether to use income above the cap, through the consideration of numerous statutory factors.

While the 2010 legislation did provide clarity as to what a client could expect for temporary maintenance, it did not resolve any uncertainty about what that same client could expect in maintenance after the divorce. There was no formula for “post-divorce” maintenance (i.e. maintenance paid after the parties are divorced). Post-divorce maintenance was entirely discretionary.

There were also numerous other problems with the legislation, including the fact that it did not apply to a spouse seeking maintenance from the Family Court. So if a person wanted maintenance (but not a divorce) and went to Family Court for relief, that person could not take advantage of the statutory formula because the 2010 legislation was not made part of the Family Court Act. As you can imagine, right out of the gates, matrimonial and family law practitioners and other stakeholders began advocating for amendments to the 2010 legislation.

These are the factors that the Supreme Court would consider and are set forth in the Domestic Relations Law.

Although it took five years, in 2015 the legislature finally passed comprehensive legislation to correct problems surrounding the maintenance statute. On September 25, 2015, Governor Cuomo signed this legislation into law. The law that pertains to temporary maintenance took effect on October 26, 2015, and applies to actions commenced on or after that date. However, all other provisions of the new law will take effect on January 25, 2016 and applies to actions commenced on or after that date. Pages could be written about the new statute, how it has changed from 2010 and how it applies, but here is a brief summary of some key changes: 1.

The Court must still apply a formula, but the formula now applies to temporary and post-divorce maintenance. The Family Court must now also apply the same formula.

2.

The income cap which is used to calculate maintenance was reduced from $543,000 to $175,000. The purpose of the reduction is to bring the income cap in line with what the majority of New Yorker residents earn annually.

3.

Any child support that is paid is taken into consideration when the Court is calculating what the maintenance award should be. When child support is paid, the formula applies different percentages to the payor and payee incomes.

4.

The Court shall now consider and allocate, when appropriate, the parties’ respective responsibilities for paying other family expenses. Prior to the new law, it was uncertain who had the obligation to pay the carrying costs for the household or other expenses.

5.

Maintenance is to be calculated before child support because maintenance will be subtracted from the payor’s income and added to the payee’s income when computing child support.

6.

The statute expressly provides for a modification of maintenance based upon the retirement of the payor spouse and allows the Court to consider retirement assets and eligibility age of both parties when it is considering a post-divorce maintenance award.

7.

When considering a request for post-divorce maintenance, the Court has a durational guideline that it may refer to for deciding how long maintenance should be paid. The duration of maintenance is tied to the length of the marriage. For example, if parties have been married for 10 years, then the Court may order post-divorce maintenance to be paid for up to three years after the divorce. Again, this guideline is advisory only. The Court retains a lot of discretion as to how long post-divorce maintenance should continue and still must consider the statutory factors in fashioning any award.

“Enhanced earning capacity” as a marital asset is eliminated. Prior to the new law, a degree or license earned during the marriage was considered a marital asset and its value (measured as enhanced earning capacity) could be equitably distributed as part of the divorce. This concept created a quagmire for Courts and litigants.

As we make our way through 2016, it will be interesting to see how the Courts begin applying the new law and what impact that application will have on our clients. For more information about the 2015 maintenance statute, contact our office.

Set SMART Goals

Guilderland, NY - We are not huge fans of "New Years Resolutions" here at CrossFit ÆVITAS. Why? Because we believe that the journey toward self-improvement should be a continuous effort, not something dictated by a date on the calendar. However, in the spirit of the season, here are some of our tips to achieve the goals you set for yourself.

First, some statistics for 2015 (From StatisticsBrain.com): NOTE: These are not meant to scare you out of making resolutions, just some things to think about • Most popular type of resolution: Self-improvement/education-related • % of Americans who usually make resolutions: 45% • % of people who are successful: 8% • % of resolutions maintained through the first week: 75% • % of resolutions maintained past 6 months: 46% So, how do we make resolutions (or goals, in general) that we are likely to succeed at? It starts with the type of goals we make, and then is followed by the path we take to achieve them.

How To Make Goals - follow the SMART model!

You may or may not have heard of this method, but we'll break it down for you with an example goal that you might see one of our athletes make.

When creating goals, you want to include the following features: • Specific: "I want to improve my back squat" <back squat is a specific movement (vs "I want to get stronger" or "I want to squat more") • Measurable: "I want to improve my back squat 1 rep max by 15 lbs" <- 15lbs is the measure • Assignable: "I want to improve my back squat 1 rep max by 15lbs" <- clearly, this goal is assigned to yourself :) • Realistic: "I want to improve my back squat by 50 lbs" might be pretty unrealistic. however, 15lbs is a more conservative and therefore more realistic number. Always err on the side of realistic vs ambitious, or you run the risk of becoming overwhelmed and never actually getting anywhere!

Worst case? You accomplish your original goal and make another!

• Time-oriented: "I want to improve my back squat 1RM by 15lbs in 6 months" <- Setting this timeframe is important, and usually it's better that the time is not a full year

How To Stick With Your Goals: Plan and Execute!

Now that we know how to set goals, let's talk a little bit about how to achieve them. This comes down to two things: making a plan, and executing on that plan!

Our tips for actually achieving your goals: Make A Plan Taking the goal above, you're probably not going to walk into the gym tomorrow and improve your back squat by 15lbs.

You'll have to first break your personal record by, say, 5lb. Since you have a time frame in mind (6 months), maybe you break it up into mini goals of improving by a mere 5 lbs every 6-8 weeks. Sounds more doable now, right?

Also, keep in mind the statistic we stated earlier: maintaining a resolution for one week has a much higher success rate than maintaining for 6 or more months (75% vs 46%). Make smaller mini-goals, and you're more likely to reach them one by one and be able to move on to the next!

Execute The Plan If every 6-8 weeks you want to improve your 1 rep max back squat by 5lbs, you'll need to make sure that you're (at the very least) coming into the gym and training on a regular basis. The beauty of CrossFit is that by giving it your all in every Workout Of the Day (whether we back squat that day or not), you'll be getting stronger and more capable.

To take the execution a step further, you'll have to not only plan to come in and work regularly, but you'll also either have to set aside some extra time for back-squat specific work and mobility (which the experienced Aevitas coaches can help you with), or put in extra work on squat days to help you improve your 1 rep max (again, our coaches are here to help!)

Making a plan is first and foremost, and a plan is only as good as its execution. So master both, and you've got all you need to be successful with your New Year's Resolutions, as well as every other goal you set for yourself!

From the Director...

See Us in A Whole New Light!

Guilderland, NY - Previously, I told you about our new LED lighting, which increases brightness and reduces costs dramatically. This month, I’m proud to tell you about our new electronic sign on Western Avenue. The sign was the result of a lot of work and fundraising by many different people, and meets a goal that the library has had for some time.

The sign enables us to inform you about library programs and events. Our newsletter, website, and social media already do that, but a vital community organization has to spread its message across many channels in our modern, busy society. We feel that many people who live and work in Guilderland, and who are thus eligible to use the library, are unaware of all that we have to offer. People who lead busy lives may not have visited the library recently, and this will allow us to spread the word as they drive by. Rather than hiding our light under the proverbial bushel, we have put it right out at the front of the building!

It seemed a daunting process to raise the necessary funds -- just over $20,000 -- and file appropriate paperwork with several agencies The whole thing started when Librarian Diane Martin happened to run into an official of the Saratoga-based Alfred Z. Solomon Trust, who encouraged us to apply for a grant to improve the library. Mr. Solomon was a gifted businessman who specialized in the sale of ladies hats in the nation’s department stores.

Network & Communication Systems Technician Sean Silvernail suggested the sign as a possibility, and began researching sign capabilities and costs. We worked closely with the State Education Department, National Grid, and the Town of Guilderland Zoning Board to ensure that we kept as closely as possible to the intent of the town’s signage regulations.

Our sign will display a static message as town regulations indicate that moving text can present a potential distraction. Further, the sign conforms to the town’s square footage requirement.

We thank Peter Barber, Ken Runion, Jackie Coons, Janet Thayer and the Zoning Board for their assistance. And our gratitude goes to Spence Neil of Guilderland, who built the library’s original obelisk sign, which will remain a Western Avenue landmark. Thanks are also due to Lew Warner, our head of Maintenance, and to several members of our Board and Foundation, including Foundation President Rosemary Revoir. We also thank Rick Bult of Guilderland, owner of Fast Signs, who helped us select the most cost-effective sign from among many options.

HAMILTON SQUARE PRICE CHOPPER STORE IN GUILDERLAND TO BE TRANSFORMED INTO MARKET 32 Unique Layout Will Require Store to be Closed During Construction Guilderland, NY- The Golub Corporation, parent company of Price Chopper, Market Bistro and Market 32, today announced its newest project to convert the Price Chopper store located in the Hamilton Square shopping plaza at the corners of Routes 20 and 155 in Guilderland, NY (the former 20 Mall Plaza) into a Market 32.

Construction is slated to begin the evening of January 23 and last until Spring of 2016. During the construction period, the store will be closed to enable a more efficient construction project. Customers are encouraged to shop at the other Guilderland Price Chopper located at the corner of Western Avenue and Johnson Road (approximately two miles away) or the Colonie Price Chopper on Central Avenue (less than four miles away).

“Given the unique configuration of this store, which is very long and narrow, it’s not practical for us to keep it open during the conversion,” said Mona Golub, VP Public Relations & Consumer Services for the homegrown chain. “So, we will temporarily close the store beginning at 6:00PM on January 23 to accommodate an accelerated construction schedule that will deliver a new Market 32 to our customers by early spring.”

The look and feel of Market 32 is distinctively more modern than Price Chopper, though many of the differences are subtle. Guilderland, NY - Happy New Year Guilderland! I hope you all had a wonderful holiday season spending time with family and friends. Now it is time to get back into the swing of our “normal” routines. Every year we are faced with a decision to make a New Year’s Resolution. Should I make one or not? Ask yourself how many years have you been successful with making a resolution or lifestyle change? Is it time for a “new normal” routine?

Eat 3 servings of vegetables each day, then gradually increase to the recommended amount of 5-9 serving per day.

Include vegetables for breakfast in an omelet two times per week.

Challenge yourself to eat 25-30 grams of fiber each day.

Drink at least half of your body weight of water- in ounces.

The number one New Year’s resolution is to lose weight. There are so many components involved with losing weight that most people get frustrated if they are not seeing immediate results and resort to old habits by February 1. To make weight loss permanent you must change your lifestyle habits. This can seem scary but if you start with small changes it is much more realistic to maintain. To make your goal more achievable, start slowly by picking one small activity to focus on. When you have mastered that small goal and it has become a new lifestyle habit, then add another. Here are a few ideas to get you started on improving your mental and physical health.

Example: a 100 pound person = 50 oz.

Replace a cup of coffee with a cup of green tea 2-3 times per week.

Have fresh fish for dinner one time per week.

Limit intake of pasta and bread to a few servings per week.

Try a new fruit or vegetable each week or prepare one you like in a different way.

Increase sleep to try to get the recommended 8 hours per night.

Increasing walking on a daily basis by parking at the end of the parking lot.

Time to Clean & Time to GO GREEN!

Scrappy New Year, Everyone! It seems like only a few days ago it was last year, doesn’t it? Time sure flies when you are having fun doing everything else besides organizing your life. Trust me, I know. There is a mound in the middle of my warehouse I call “The Pyramid”.

It started out years ago as “The Midnightmare Mass” which was followed by “The Gathering”. It quickly grew into “Gomer Pyle”, then “No Space Mountain” and finally “Mount Junkmore”. Then I no ced giving it cute nicknames only seemed to make it larger, and madder.

I see stuff from cleanouts we did 3 years ago in the center. I have my excuses, like my job is to move 30 mes a month, every month.

I originally kept things because (have you heard this one before?): “I might need that someday”. This is why I have 12 boxes of wood matches, 11 cans of WD-40, 10 crates of extension cords and… a box full of Partridge Family albums. LESSON OF THE DAY: I, AM, NEVER, EVER, EVER, GOING, TO, NEED, ALL, THIS, STUFF!!!

It’s way easier to accumulate than to reduce. Some mes we go to a house where there is just a car, 2 garbage cans and a rake in the garage and it looks…well… awesome! But mostly, garages, basements, a cs and storage sheds looks like 50-100 boxes full of games, clothes, old hair dryers and toys crashed into a rummage sale during a flea market at a going out of business sale. Anybody want to play “20,000 Items Pyramid”?

FOR ADOPTION MAX is a sweet mellow cat! He showed up one day in a feral cat colony after he was abandoned by his owners. He clearly stood out in the colony as when we would arrive to feed the ferals, Max would roll over and want his belly rubbed.

Max is a larger white w/ grey short hair kitty. He has stunning green eyes and is estimated to be about 5 years old. His favorite things are to hang out with you and join in the family activities. He is very laid-back and extremely personable. He is always interested in what is going on in the house, likes to look out windows at the squirrels and will meet you at the door when you come home. Max gets very excited when you play “mouse on a string” with him and the other kitties in his foster home. He will even talk to the play mouse. At bed time you will find Max waiting on your bed as he likes to sleep snuggled up with his foster Dad. No worries though as he happily shares the bed with the other cats. Max is neutered, up-to-date on his vaccines and has tested negative for FIV/FElv. The girls are totally bonded as they have been best of buddies since Jasmine was one month old and are looking for a forever home together.

The girls love to play w/ each other. They also like to play with the other kitties in their foster home and with you. Their favorite toy is a wand with a string and a mouse on the end. Even though playing is a high priority Jasmine and Jenny are always willing to take time out to snuggle and purr in your lap or have their bellies rubbed. Jasmine and Jenny are both very easy-going and like to join in the family activities. They both have a gentle easygoing energy. They will want to sleep with you and any other kitties at night and will meet you at the door when you come home.
