notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - I start this New Year with a summary of the “State of the Town of Guilderland for 2017.” The Town begins this year with a balanced budget, increased reserves, reduced tax levy, and a very strong credit rating. With the hard work by Town employees and the support of the Town Board, here are some of the notable achievements in 2016: • Adopted a new Zoning Code with streamlined business approvals, expanded allowed uses of commercial properties, and increased protections for residential properties and the environment • Opened a beautiful new pool house and Chalet building at Tawasentha Park • Opened an expanded new senior center at the Mill Hollow Senior Community • Created a new Town website with improved access to information about Town government, online forms, and increased transparency • Acquired over 100 acres of environmentally sensitive land as Town-owned preserved open space • Applied for and obtained grants for the following future work: - installing sidewalk on Old State Road to Lynnwood Elementary School; - designing hiking and biking trails in Town open space and parks; and - acquiring additional water treatment equipment • Secured funding for widening Carman Road including a twoway left turn lane at Lydius Street and pedestrian improvements. • Acquired a new paver, additional sidewalk snowplow, and two senior citizen buses • Awarded contracts for extending the water line on State Route 158 and access another water source in Rotterdam • Award engineering contracts for the design of storm water management facilities in McKownville I again thank State Senator George Amedore, Assemlbyperson Pat Fahy, and their staffs for their past and continuing efforts upon behalf of Town residents and the successful funding of initiatives that promote quality of life. For 2017, we hope to continue these achievements by starting the construction of the McKownville drainage work and the water interconnection with the Town of Rotterdam. We anticipate completing the design work for the Carman Road/Lydius Street intersection, expanding snowshoeing and cross skiing trails, and installing more hiking trails in the Town’s open space. The New Year should also bring further development of vacant buildings and underutilized properties. We encourage you to use the Town’s winter recreation area, including snowshoeing and groomed cross-country skiing at the Western Turnpike Golf Course, and sledding at the Winter Recreation Area, a short distance south of Tawasentha Park on Route 146. Peter G. Barber - Town Supervisor ahead by renting cross-country skis and snowshoes on weekdays at the Parks’ Office on Route 146, opposite Tawasentha Park. During last Thursday’s snowstorm, I had the privilege to ride along with Don Barlow (a fellow GHS ’79 alumnus) as he deftly operated a Highway Department snowplow in the west end of Town. While I was not much of a “wing man,” and it was only a snapshot of an operator’s work, the outing showed the professionalism and care exhibited by Highway Department employees. It also urged me to remind residents to keep a safe distance (at least 100 yards) from operating snowplows and remember that operators don’t have rear cameras and cannot see automobiles pulled up to the back of the truck. This is particularly true at intersections, where snowplows often need to back-up to clear the entire intersection. And while the operators are experienced and use extreme care, their heavily laden trucks cannot stop on a dime and need a wide berth. Also, please remember that no overnight parking is allowed on Town streets during the winter and that violators are subject to ticketing and towing to allow for the safe removal of snow by the Highway Department. The end of 2016 brings the well-earned retirement of two Town employees who served vital roles in advancing the quality of life of residents. Alice Begley, the Town Historian since 1994, played a starring role in the Town’s purchase and renovation of the Schoolcraft House. Alice shepherded the careful work by artisans and volunteers who have returned the building to its original appearance. Her writings on local history and her organizing of historical events reflect a love for the Town and its rich history. Alice’s tireless preservation work has left the Town’s historical properties in excellent condition and ready for improvements. For nearly thirty years, Jan Weston has served as the Town Planner and provided her professional comments to reviewing boards for nearly every residential subdivision and business development. She was a leading contributor to the Town’s Comprehensive Plan and its neighborhood studies. Her devotion to sound planning principles and acting in the best interests of residents is reflected in the Town’s growing network of sidewalks and expanding hiking trails, the preservation of open space and protection of environmentally sensitive areas, and overall positive appearance of the Town. On behalf of the Town and its residents, we wish Alice and Jan a relaxing and enjoyable retirement. We also wish Town residents a happy, safe, and prosperous New Year. Peter G. DON’T LET BACK PAIN STOP YOU IN 2017 By: Dr. Amanda Boccio Guilderland, NY - We hope you all had a great holiday and healthy start to 2017. Due to our activities this is the time of year that we tend to see an increase in lower back injuries. Lifting heavy boxes full of holiday decorations, shoveling snow, and spending more time sitting indoors to avoid the winter cold all put extra strain on the lower back, particularly the intervertebral discs. The intervertebral discs are located between each vertebrae of the spine, allowing movement and flexibility, as well as to serve as shock absorbers. The disc is made up of a strong fibrocartilage outer edge called the annulus, and a gel-like inner core called the nucleus pulposus. In the lumbar spine, the back wall of the annulus is thinner than the front wall, and the nucleus is positioned slighted posterior to the center of the disc. Due to our normal anatomy, the back wall of the disc is much more susceptible to injury. Poor posture, excessive sitting, improper bending or lifting mechanics, and inadequate core and back muscle endurance make the back wall of the intervertebral disc vulnerable to injury. Sitting in a slouched position in a chair or recliner over time stretches and weakens the back wall of the disc; although it feels good to slouch or sit for long periods, we often stand up feeling stiff. Imagine having a weakness in the back wall of the disc, then flexing forward and twisting while shoveling the driveway, or pulling a heavy box out of the attic. This combination forward bend and twist motion forces the gel-like nucleus to gravitate toward the weakened back wall, creating a bulge. At first, this might be painless, or cause short-lived back discomfort that resolves quickly on its own. Over time, the bulge may cause irritation to the nerves exiting the spinal column, causing more significant pain in the back that may radiate to the buttock or leg. A disc herniation in the lower back occurs when the gel-like nucleus breaks through the weakened annulus, further irritating or compressing a nerve root, often causing pain, numbness, tingling or weakness in the leg. Because these injuries can be caused over time by cumulative trauma of poor posture, excessive sitting, incorrect bending or lifting mechanics, or inadequate core strength, significant back or leg symptoms can appear with simple movements. Patients with injuries to the intervertebral discs commonly present to chiropractic offices. Fortunately, the majority of disc injuries are treated conservatively. The key is to understand the cause of the injury, to make changes in your daily life to allow the injury to heal, and to avoid movements or positions that cause a spread of symptoms further away from the spine. First and foremost, patients dealing with acute disc injuries must control inflammation to promote a healing environment. A disc injury can be compared to an ankle sprain: you would not want to stretch a painful inflamed ankle in the direction you twisted it in until it has had a chance to heal! Secondly, one must limit time sitting. Prolonged sitting, particularly with poor posture, increases intradiscal pressure and strains the already weakened back wall of the disc. Make it a point to stand up at your desk at work every half hour and try to maintain the natural curve in your spine while sitting. Good posture helps preserve the normal position of the nucleus which takes pressure off of the back wall of the disc allowing it to heal. Core stabilization exercises done in a position that maintains the natural curve of the spine helps you hold good posture at rest as well as to protect your back during movement. Sleeping position is also very important to consider when dealing with a disc injury. Lying on your back, or lying with the painful side up with a pillow between the knees tends to be a safe, comfortable position. When bending and lifting, make sure to contract your core musculature, maintain the natural arch in your lower back, and hinge from your hips and lift with your legs. Do not bend from your back. It is important to remember to look up and keep your chest up before you lift. Keep a wide stance if possible and hold what you are lifting close to your body. If you must turn, pivot from the hips instead of twisting from your lower back. Make a resolution to protect your spine this New Year and don’t delay seeking out care! INCOME TAX PREPARATION CHECKLIST BY

Guilderland, NY - We are coming up on the time of year when many of us will be busy preparing and gathering the information necessary for the completion of our 2016 income tax returns. Below are several items that you should be aware of as it relates to this process. By the second week of February, you should have received your forms W-2 (employment wages) and any 1099R (retirement income), 1099-INT, or 1099-MISC (other income) statements for 2016, as well as your social security benefits statement, if applicable. You should also begin receiving forms 1099-DIV and 1099-B for any directly-owned investments such as mutual funds. If you own a brokerage account, you may not receive your consolidated brokerage tax statement until the beginning of March at the latest. To reduce the possibility of having to send amended tax statements due to late or corrected reporting by various investment companies, many brokerage firms have opted to delay mailing these consolidated statements. Other considerations may include real estate taxes paid, mortgage interest, medical expenses, investment advisory fees, forms K-1, estimated income tax payments, charitable donations (whether by check or in-kind), etc. The 2016 individual income tax landscape is very similar to 2015. There were minor inflation-based increases to personal exemptions, standard deductions, and tax-bracket thresholds. The medical expense deduction threshold remains at 10% of Adjusted Gross Income (AGI), however individuals age 65 and older have been granted an extension of the old 7.5% threshold through 12/31/2016. Individuals not covered by “minimum essential” health insurance for all of 2016 will find themselves with additional reporting requirements and potential increased penalties compared to 2015.
We encourage you to consult your tax preparer to determine if you are eligible to make a 2016 contribution to a Traditional IRA or a Roth IRA. The maximum contribution limit to either type of account for 2016 is $5,500 ($6,500 if you had turned 50 by 12/31/2016). 2016 contributions to individual retirement accounts should be made no later than April 18, 2017. Whether you elect to self-prepare your income tax returns or hire a professional, we suggest you make all efforts to determine that you are taking advantage of any available opportunities for tax savings or tax deferral. In particular, retirement account contributions may serve the dual benefit of helping to reduce income taxes now while providing additional income during retirement.

Traditions By Master Rice
Guilderland, NY - Every blackbelt test hosted by Guilderland Martial Arts is attended by my friend Keith. He cooks breakfast for us and our students and teaches us all serious self-defense techniques. We have been friends for a long time and this is one of our traditions. Another one of our traditions is approaching fast; the Winter Carnival at Lake George. We have many traditions together and I realized recently just how important traditions are. While attending the Chamber of Commerce holiday party I ran into Lowell, the creator of this publication. Later that evening, we found ourselves at Wolff ’s in Albany celebrating my brother in-law Brian’s birthday. I love that place, especially during the holiday season. Lowell was telling me how much he loves Wolff ’s as well. In fact, he loves to go there with family for breakfast and football (by that I mean the original football which most of us Americans would call soccer). He explained to me that it has become a tradition. At that moment, all the things I call tradition popped into my head and we had a delightful time recalling our traditions over some fine drink and of course peanuts. Traditions are important to us and I believe necessary for our well-being. We can even expand the meaning of traditions to include those things that we do on a regular basis, particularly those things we do with others. We look forward to them so much, and feel it so badly when, on occasion, they are missed. They bind us into a common thread and deliver tremendous memories that carry us through challenging times. It has definitely become part of my tradition to go to Wolff ’s for a birthday celebration and when it is Brian’s birthday I will find Lowell at his side every time. From picnics in every season to fishing trips to holiday gatherings to a simple weekly special breakfast, traditions can be almost anything. Now when I am together with Keith for any reason and we happen to do something we enjoy together with our families, we look at each other and simultaneously say, “tradition”. From that moment on we try to repeat the event in some form on some regular interval. As we enter a new year treasure your traditions and look to develop new ones. Our togetherness and our selflessness toward each other is what makes us so strong. My thanks to Keith for helping me have traditions and reminding me how many I already had. My thanks to Lowell for always providing great conversation and sharing his traditions with me. And finally, my best wishes to all for the best new year ever. May 2017 be the year of dreams coming true and traditions continuing to bind us together!

WHO GETS THE HOUSE? by Leyla Kiosse
Guilderland, NY - Many unmarried couples buy homes together. When making what is generally the largest investment in one’s life, most people do not take into account consideration what will happen if the couple breaks up, or when one of them dies. For unmarried couples, title to real property can be held in several different ways: 1.
Joint Tenants with Right of Survivorship: This means that the couple owns the house by the “whole” and when one person dies, the other person automatically owns the house.
2.
Tenants in Common: This means that the couple owns the property by the “part” and not by the whole. Each party can leave his or her share upon death to whomever they choose. Further, if the couple break up each owns his/her share.
While owning property as Joint Tenants is wonderful if your only concern is dying, it becomes much messier if the couple breaks up. If the property is owned by the whole, there is no easy way to sever the shares. While a partition action can be brought (NY RPAPL Art. 9), it is a difficult and expensive proceeding, but if successful forces the severing of the tenancy and the sale of the property. Tenants in Common is often a good method to own property if you want to leave your share to someone upon your death (it can be your partner), or, in the event of a breakup, you want to sell your share. While this makes it easier to divide the property, how many of us are going to want to be roommates with your ex? It is important that the deed specifically states what percent each person owns (is it equal or unequal?). However, how you hold title does not address issues such as recoupment of down payments, closing costs, or how the costs will be shared during the time that you own it. The best and simplest way to address all of these issues is to have a partnership agreement. You would not go into a transaction with a business partner without this type of agreement, and yet, most people are willy-nilly about addressing these issues with a loved one. A partnership agreement can include who is paying what expenses; addressing what happens to the house in the event of a dissolution of the relationship- recouping closing costs and down payments; who will live in the house upon a breakup, and how expenses will be shared while the property is on the market for sale. If an unmarried couple buys a home together and at some point marries, the partnership agreement can continue or be amended. If a home is titled to “me” before the marriage, it does not automatically become “ours” when we marry, or vice versa. While we all hope for the best, we always need to prepare for the worst (a breakup) or the inevitable (passing away). It is always wise to prepare for the worst-case scenario which is why we stock pile disaster kits, buy insurance, and take other measures to protect ourselves and our loved ones.

www.guilderhaven.org FOR ADOPTION Batman is a super friendly, easy-going, active and playful one year old neutered male kitty. He is a small-sized cat weighing in at 9 pounds. He is an all-black kitty with stunning green eyes who loves to give you eye contact. He is extremely affectionate and loves to cuddle your lap and be carried around in your arms. Batman makes sweet chirping noises to communicate with you and will meet you at the door when you come in. He enjoys human interaction and will want to be where you are in the house enjoying a family activity. Batman likes to sleep with his foster Dad every night along with the other kitties. He is loving, high-energy, yet easygoing and affectionate all in one! Poor Batman! We found him living under a porch of an abandoned house with nothing to eat. It seems his owner had moved and simply left him behind. He would come up to anyone walking by as if to ask for food. Batman is so happy to be inside and has no interest in going back outdoors. The best home for Batman would be one with at least one young cat that wishes to play with him. He seems to flourish in a multi-cat home. Levi is a two year old very handsome grey and white neutered male looking for his forever home. He showed up cold and hungry on a kind neighborâ&#x20AC;&#x2122;s back porch. He is waiting for a forever family that will shower him with love. Levi is very gentle. He loves to hang out with other cats in his foster home and likes to sit in your lap and sleep with you at night. When you pet him he pushes back into your hand like he just canâ&#x20AC;&#x2122;t get enough love. He enjoys all family activities. Rocky is a sweet, gentle, VERY PLAYFUL neutered one year old male kitty looking for his forever home. He was found living in a cat colony. Because he was so friendly and with winter approaching we whisked him up and now he is living in a foster home w/ five other kitties hoping for his forever home. Rocky loves other kitties and likes to play and interact with them. He loves to be held and cuddle when he is not busy partaking in family activities. Rocky loves human companionship and will be wherever you are in the home. When you come home from work he will meet you at the door. Rocky has formed a great friendship w/ another foster - his look-alike, Batman, who is also up for adoption. He could very easily be adopted out with Batman. Ivy is a very tiny energetic playful female looking for her forever home. She weighs in at seven pounds and is just now one year old. She enjoys people and will meet you at the door when you come home. Ivy is social and will be wherever you are in the house. She enjoys other kitties in her foster home. Ivy was found literally starving in an abandoned garage in the inner-city while struggling to feed her five kittens. She was being a great mom at the detriment of her personal health. The neighbors would watch her and the kittens but no one stepped up to feed them. Ivy is our hero! Ivy is spayed, up-todate on her vaccines, and negative for FIV/ Felv.
