notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - The Parks & Recreation Department’s 2020 Summer Day Camp and Activity Camp Brochure will arrive in your child’s “backpack mail” later this month, likely during the week of March 22nd. The brochure may be picked up at Town Hall, Guilderland and Altamont Libraries, and Parks & Recreation’s office across from Tawasentha Park. The brochure details more than 120 programs, including sporting activities, swimming and swim lessons, day camps, hobbies and fitness programs, GPAC concert schedule and community events. The summer camp program starts on June 29th and runs until August 7th. These programs are taught and led by talented instructors who are eager to share their expertise and enthusiasm. Registration begins on March 27th at www.guilderlandrec.com or at the Parks’ office. The Parks Department is also introducing a new option for a full day camp for two weeks only as an extension of the traditional 1/2 day camp during the week of June 29th-July 7th, (excluding July 3rd) from 11:45 am - 4:15 pm, with pick-ups until 5:00pm. The program is open to only 48 campers who are entering 3rd grade to 8th grade and are Town residents. Please visit Guilderlandrec.com for additional information and registration details. Registration will begin on March 27th and end June 15th, unless the camp fills up before then. If you are interested in seasonal work as a lifeguard, pool manager, summer day camp counselor, park maintenance or golf course laborer, please visit the Parks & Recreation’s webpage or office for employment applications and more information. During the school spring recess from April 14th to April 17th, the Parks’ Department is also offering two full-day programs, Yoga 4 Teens and Spring Break Fun-N-Games. You can register for these programs at www.guilderlandrec.com. Please bear in mind that starting, weather permitting, on Monday, March 23rd, the NYS Thruway Authority plans to close and replace the Old State Road Bridge over the Thruway for seven months. If you operate one of the estimated 5300 vehicles that daily traverse this bridge, you should keep up to date on the project’s progress by checking the Town website for details and also sign up for free email and/or text notice on Nixle®. The Census Day 2020 day is April 1st, the official date for the nation’s once-per-decade, constitutionally-mandated count of every person, regardless of citizenship status. The Town benefits the most when the Census counts everyone. The Census determines representation in Congress, NYS Senate, NYS Assembly, Albany County Legislature, and other districts. The Town’s Census population will also impact its receipt of County sales taxes which are distributed on the basis of population. Between March 12th and 20th, Town households will receive mailed notification on how to go online and complete the Census questionnaire. This is the first Census that will be mainly completed online rather than in paper form. While you are encouraged to complete the online questionnaire, you will also have the option to respond via phone or by completing and returning a paper Census questionnaire. All information gathered in the Census will be confidential. On Saturday, May 2nd from 8am to 4:30pm at Town Hall, the Parks Department is hosting a NYS Boater Safety Course which satisfies the State’s recently adopted safety requirements for operators of motorized watercraft. The course provides permanent certification. The requirement is phased-in based upon birth date. There is a $10 fee payable to NYS Parks. Over the winter, the golf course clubhouse’s décor was upgraded, and the dance floor in the ballroom was restored. The Nines will offer breakfast, lunch, and dinner, as well as outings, corporate events, weddings, baby showers, and other special events. The first of the Town’s two Household Hazardous Waste Days will be held on Saturday, April 11th from 8am to 2pm at the Highway Department garage. Please take the time to pick-up free resident passes and review the list of acceptable items at the Transfer Station’s page or by calling the Transfer Station at (518) 861-6776. The Albany County Soil & Water Conservation District is offering its annual tree andshrub program with a wide variety of bare root seedlings and transplants, including applectrees, arborvitae, lilac, plum, raspberry, winterberry and dozens of other types. You can also order tree tubes and guards, rain barrels, compost, woodchips, and wildflower seeds. To encourage the use of pollinator plants, with every purchase at the tree sale, the County is providing, at no cost, 10 pollinator plants. The pollinator plant chosen this year is Liatris spicata, also known as Blazing Star. Orders are first come, first served and must be placed by Friday, April 3rd. Order forms can be downloaded at the County’s website (www.albanycounty.com/swcd). You might be interested to learn that 58 languages are spoken by students in the Guilderland Central School District. A list of these languages provided by GCSD is posted on the Supervisor’s web page. The Town’s growing diversity is also evident in the Town’s expanding restaurant options, food selections in local supermarkets, and new sporting and recreational opportunities in Town parks and the YMCA. The latest installment of Somewhat Frequent Questions & Other Items of Interest is the Impact of Invasive Species on Open Space, with details on the impacts of invasive tree species, like the black locusts and white pines, that displace hardwood and native trees, and invasive aquatic species, like water chestnuts, that are proliferating in the Watervliet Reservoir and increasing the cost of producing drinking water. Prior topics included the “Town’s Response to Climate Change” which details the Town’s commitment to sustainable energy and climate-smart development and the launch of a web page devoted to the Town’s environmental initiatives, and “The Comprehensive Plan Process” which explains the Town’s comprehensive plan, its nine neighborhood studies, and possible next steps in the Comprehensive Plan process later this year. ALTERNATIVE DISPUTE RESOLUTION (OR HOW TO HOPEFULLY STAY OUT OF COURT) by Margaret C. Tabak

Guilderland, NY - The use of non-litigation dispute resolution has been in use in other States and down State and is now making its way up the Hudson to Albany and beyond. Chief Judge Janet DiFiore is promoting a program where parties in civil cases will be referred to mediation or some other form of alternative dispute resolution (ADR) as the first step in a case that is proceeding in court (presumptive ADR).1 This process will refer cases routinely to mediation and other forms of ADR. This will apply to a broad range of civil cases, including divorce cases. The focus will be on mediation. Our Team is Springing into March with Some Fresh CE March is already under way, and so is the excitement of the team at Oshins of Smiles. So many new continuing education opportunities are coming our way. Dr. Oshins and his team are always building upon the knowledge they already have in the field of dentistry and dental sleep medicine. We do this to better ourselves for the quality of care for our patients. We continue to learn and grow as a team, so that we can educate our patients fully and properly. We gather enough data, so we can understand the issues that patients are having, and so we may treat the cause without hesitation. We only relay information from what we have learned and by staying current with continuing education courses and lectures. We are not stuck in the old ways of dentistry. So, what types of continuing education courses are we gearing up for? In March, Dr. Oshins and his team will be attending a two-day conference on “An Interdisciplinary Approach to Understanding and Implementing Sleep Disordered Breathing Protocols”, in Rochester, NY. We have been gathering a lot of research for the past 2 years in this very necessary field of dental sleep medicine. This is one way we stay current. Dr. Oshins, as many of you already know, did his residency at the University of North Carolina, in Dental Sleep Medicine. Snoring is not a joke in our book. It is a very serious condition that 9 times out of 10, gets overlooked as, “Oh, he or she just snores.” “No big deal.” Well, it is a big deal. As a Dental Wellness Practice, Dr. Oshins and his team will evaluate you. Not only your teeth and gums but rule out a sleep breathing disorder. When you have your initial exam as a new patient, Dr. Oshins will check your airway, look for any clinical signs, and ask you some questions relating to the sleep questionnaire you filled out online. He will do this exam on adults and children. Many patients will say, “I have never had an initial exam at the dentist like this.” “Thank You.” We take pride in what we do, and Dr. Oshins passion emanates on his team, as to how he wants his patients to be treated, as well as getting them healthy. In addition, in May, Dr. Oshins and his team will be going to Dearborn, Michigan, to the Wellness Dentistry Network Member Rally. Here we will be continuing our education on perio disinfection, airway, microbiome and functional medicine, heart disease as well as nutrition and diabetes. We as a team will be learning about the new data on what elements play a key role in oral and systemic disease, and the effectiveness of products and procedures. All of the health consequences relating to a compromised airway. How certain foods you eat can have an effect on your gut microbiome. Understanding that it is necessary for dentists and physicians to collaborate with one another for you, the patient, especially with the data that shows a correlation between a sleep breathing disorder and heart disease. Will Your Mutual Fund outperForM? by

Guilderland, NY - Investors are faced with a choice between more than 8,000 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can mutual fund investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all actively-managed mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1.

S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias.

2.

The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500.

3.

S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the Fidelity Contrafund ($119 billion in assets) than the Delaware Mid Cap Value Fund ($26 million in assets).

For the period ending 06/30/2019, the SPIVA Scorecard showed that on a 10-year trailing basis, between 80% and 97% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of active US equity mutual funds (those in the Mid Cap Growth space), only 20% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble a portfolio.

We find two common objections to the advice to avoid activelymanaged funds – the first is to only use actively-managed funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that activemanager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of activelymanaged funds to those with good track records. Fortunately, SPIVA’s methodology addresses this point in its Persistence Scorecard, which shows that “only 4.03% of large-cap funds, 5.88% of mid-cap funds, and 5.75% of small-cap funds maintained top-half performance over five consecutive 12-month periods. Random expectations would suggest a repeat rate of 6.25%.” We urge investors to carefully consider that costs (mutual fund fees, sales charges, advisor fees, etc.) and risk (asset allocation) are the two portfolio characteristics that are within your control, and to devote the bulk of your effort to focusing on this factors. Choosing the best mutual fund manager will likely prove to be an exercise in futility.

A NEW APPROACH TO CHRONIC PAIN By: Dr. Kim Leis-Keeling

Guilderland, NY - I remember when I was going to chiropractic school, one of my professors said to us “Your patients will push you to be a better doctor.” This is so true. As I have practiced

through the years, I have helped so many patients get relief from

back pain but there have also been some that I have not been able to help. Most of these difficult cases are patient that have been in chronic pain for 6+ months. Just as I have felt the frustration of my patients who are looking for answers and desperate for pain

relief, it is equally frustrating for me to have to tell a patient that

I have tried everything I know, but it is not helping. It has led me

on a quest to find a new approach to chronic pain which may help these more difficult cases. I knew that movement was likely the

missing key but when people are in chronic pain, they don’t want to move. I needed to find a way to make this happen.

Last fall I began a unique Pilates certification program that was developed by a physical therapist who specialized in movement therapy. The program integrates the movements and equipment used in Pilates with the principles of rehabilitation. To clarify, there are different styles of Pilates. In Classical Pilates, there

is a certain pattern or order in which the exercises are typically done (I am NOT doing Classical Pilates). In this approach, I

must decide what exercises would be appropriate for my patients

based on their injuries and duration of pain. Much like designing an injury rehab program. It is looking at a piece of exercise

equipment and using it with a clinical mindset. So of course, I

have been implementing the exercises as much as possible with patients.

The Library of Congress receives more than 20,000 items every day, and only half remain in the permanent collection. 7 STEPS TO PLAN A REMODEL (Family Features) Remodeling your home can be one of the most exciting projects to undertake. Whether you’re thinking about a bathroom update, kitchen overhaul or a new room addition, planning and setting realistic expectations are critical in ensuring your project goes as smoothly as possible. Consider these steps from the National Association of the Remodeling Industry (NARI) before you get started: 1.

Determine your goals and needs. Understand why you are undertaking the project, whether it’s for resale value or so you can enjoy your home more. If looking to increase resale value, consider the neighborhood and potential upgrades that can have the highest impact when going to market. If remodeling can make for a more comfortable space, create a list of “must-haves” and “nice-to-haves” then evaluate what’s feasible. Being realistic about needs and wants can help you create a budget.

Get inspired. Whether watching home improvement shows or browsing the internet, finding photos of styles and looks you admire can be beneficial when sharing your vision with a remodeling contractor.

Understand your budget. Setting a budget and staying within it is critical to the project’s success. Be sure to build in a contingency fund for unforeseen expenses. Project expenses should factor in the cost of products, labor and project management. There are also possible additional costs such as long-term maintenance, repairs, energy use and a dining out budget if undergoing a full kitchen remodel or hotel costs sometimes necessary with large-scale projects. To avoid any unpleasant surprises, be sure to get a written estimate and scope of work once you’ve selected a contractor.

Determine timing. If there is a specific event driving your remodel, work backward through the various project stages to determine a realistic timeline. Build in additional time as a buffer for unexpected delays and recognize remodeling contractors typically have long lead times and may require flexibility to deliver optimal results.

Find a contractor you trust. Home remodeling can be stressful no matter how well you plan, but a dependable partner can make the process go smoother. While some of the best references may come from neighbors, friends or family members, a trade association like NARI can help with its online “Find a Remodeler” tool. Make sure any contractor you’re considering has several years of relevant experience, as well as liability insurance.

Check references. When it comes to remodeling your home, you can never be too careful when choosing who to work with. Be sure to follow up on references, read reviews online and even check out the work of any remodelers you’re considering hiring, if possible.
