The Town Board approved the rezone of property for the construction of a hotel adjacent to the entrance of Crossgates Mall. The rezone was supported by the Westmere Corridor Study which advocated for concentrating more intense commercial development near access to the Northway. The rezone was also made possible by the new Zoning Code which increased the maximum height of hotels and expanded the permitted uses of commercial properties. The new Zoning Code also simplified the approval process and provided greater flexibility for planned unit developments, including the proposed Concordia Senior Community and Pine Bush Senior Living Community. These projects advance the Comprehensive Plan’s goal of encouraging affordable senior housing options for Town residents. The Town also received news that the NYS Department of Transportation had granted the Town’s application for $680,080 in funding for the construction of a new ADA-compliant concrete sidewalk on the south side of Western Avenue from Devonshire Drive (SEFCU/Regency Park) to Mercy Care Lane (Guilderland Public Library). The Town’s application was supported by the Library and was intended to help residents who currently walk to the Library and others who have expressed interest in a sidewalk that would provide a safe pedestrian connection to the Library. The sidewalk and crosswalks will also improve access to Guilderland Elementary School and the YMCA. This project, which is funded by the Federal Highway Administration, will likely be constructed next year. Upon behalf of the Town and its residents, I recognize and thank Don Csaposs, the Town’s grant writer, for shepherding the Town’s application for this latest sidewalk grant through an extremely competitive process. Don’s behind-the-scenes efforts have played an indispensable role in securing funding for other projects including, but not limited to, $3.25 million in grants

Barber - Town Supervisor for managing stormwater which floods homes in McKownville; arranging the funding of sidewalks on both sides of Western Avenue from the City of Albany to State Route 155; a grant for sidewalks on Route 146 in Guilderland Center; and the recent $297,000.00 grant award for a sidewalk on West Old State Road to Lynnwood Elementary School, and funding for improvements to the Town parks, open spaces, historic properties, and water and wastewater projects. These projects have contributed to creating an expanding pedestrian network that links residents to neighborhoods, local businesses, and public places. The arrival of Spring also brings changes to the Town’s parks. The Town’s expanded summer camp and recreational programs are now open for registration at www.guilderlandrec.com or the Parks’ Office on Route 146 across from Tawasentha Park. And if you have not recently visited Tawasentha Park, please check out the new pool house, new Chalet building, and resurfaced tennis courts. For many years, and again this month, boy scouts have helped restore key portions of well-marked trails that extend, via the beautiful bridge over the Normanskill Creek, to adjacent Town-owned open space. Residents are encouraged to enjoy over 20 miles of marked multiple-use (bike and hiking) trails in the Albany Pine Bush Preserve. Many of these trails are located on Town-owned land that is managed by the Preserve, including a trailhead at the Town’s DiCaprio Park for a “through trail” that extends 2.9 miles

to the trailhead at the Madison Avenue Pinelands. Other trails in Town are accessible at the ends of Willow Street and Di Bella Drive. Trial maps with points of interest are available at www. albanypinebush.org. Western Turnpike Golf Course is open for another season. Due to hard work by grounds-keeping staff during the winter, the 27-hole course is in excellent shape. Residents can obtain discounted greens fees with proof of residency. Please call the Pro Shop at 456-0786 for more information. On Saturday, May 13th from 10am to 2pm, the Highway Department will host a Household Hazardous Waste Day when residents can dispose of paint, stain, thinner, solvents, pesticides, herbicides, insecticides, kerosene, and similar materials. The Town website on the Transfer Department’s page has a list of acceptable materials. Residents may pick up free passes at Town Hall or at the Transfer Station. Another Household Hazardous Waste Day will take place on Saturday, September 23rd. In last month’s Supervisor’s Notes, I mentioned that we are working with NYS Department of Conservation and the City of Watervliet to allow fishing at the Watervliet Reservoir from the shore and non-motorized boats. This effort might take time because it will require modification of DEC’s regulations which prohibit fishing at the reservoir. I was reminded that residents can fish at DiCaprio Park’s pond, where the Town once stocked bluegills, bullhead, and crayfish, and maybe trout and bass which might have been present in the stream before it was dammed to create the pond.

We hope to have DEC take an inventory of the fish population and determine whether the pond is suitable for regular trout stocking by DEC. The other fishing location is at Tawasentha Park in the Normanskill Creek where pan fish, largemouth and smallmouth bass, and other species are present. If you catch something else or if you are not sure of the species of the fish, share the news and a photograph The start of a great fish story! of your catch with the Parks Department. Please remember that while there is no Town fee for fishing in its parks, New York State requires that persons over 16 years of age must have a fishing license, which you can obtain at Town Hall or the Guilderland Public Library, which also loans fishing poles. WILL YOUR MUTUAL FUND OUTPERFORM? BY

Guilderland, NY - Investors are faced with a choice between more than 8,300 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can mutual fund investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all actively-managed mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1.

S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias.

2.

The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500.

3.

S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the American Funds Washington Mutual Fund ($90 billion in assets) than the Ranger Small Cap Fund ($23 million in assets).

For the period ending 12/31/2016, the SPIVA Scorecard showed that on a 5-year trailing basis, between 80% and 97% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of US equity mutual funds (those in the Multi--Cap Value space), only 20% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble a portfolio. We find two common objections to the advice to avoid activelymanaged funds – the first is to only use actively-managed funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that active-manager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of actively-managed funds to those with good track records. Fortunately, SPIVA’s methodology addresses this point in its Persistence Scorecard, which shows that “only 4.47% of large-cap funds, 3.68% of mid-cap funds, and 9.27% of smallcap funds maintained top-half performance over five consecutive 12-month periods. Random expectations would suggest a repeat rate of 6.25%.” We urge investors to carefully consider that costs (mutual fund fees, sales charges, advisor fees, etc.) and risk (asset allocation) are the two portfolio characteristics that are within your control, and to devote the bulk of your effort to focusing on this factors. Choosing the best mutual fund manager will likely prove to be an exercise in futility.

WHAT DOES A SUNY CAP MEAN NOW? by Margaret C. Tabak

“No child is guaranteed a college education unless her parents are divorced.” 1 Guilderland, NY - While a child can sue a parent to pay for higher education2 , this rarely happens. However, when a family has split they will often agree on a sharing of future college costs, or a court can determine when a child is of college age what his parents should pay. Courts and parents often limit a parent’s responsibility to a share of college with a “SUNY cap’’. This means that if SUNY costs $20,000 and a child attends a more expensive school, the parents’ obligation is still $20,000.

If a child lives with one parent who earns below the qualifying dollar amount but the parents combined incomes are not, will the student still qualify for the scholarship (i.e., what is a family?)?

If the child qualifies but chooses to attend a non SUNY school, do the parents have any responsibility to pay tuition?

If the child receives the scholarship but then leaves New York after graduation, can the child compel the parents to pay the loan back?

Another thing to keep in mind is that the scholarship is limited to the cost for tuition. College also involves many other expenses- room and board; books; supplies; fees. If you have a SUNY cap and your child’s room and board costs exceed that of a SUNY school, there is no question that your responsibility is limited to the SUNY cost.

Now comes along the Excelsior Scholarship3. This provides a child whose family earns less than $100,000 with free tuition at a SUNY or CUNY school if the student is attending full time. The student needs to remain in New York after graduation for an equal amount of time that he received the scholarship for or the scholarship becomes a loan. The intent of the legislation is to provide higher education to New York students, without the crushing financial costs to families. Hopefully, this will be successful. Issues that will need to be addressed by the regulations, parents and courts will be:

The best time to start addressing these issues isn’t as junior is packing his bags for STATE, but in the planning stages. Both parents need to take an active role and participate in looking at the best options for their children, taking into account everyone’s financial situation. I generally know when August has rolled around- not because of the sound of hooves up the Northway, but because my phone is ringing off the hook about disagreements concerning college costs and the payment is due. It is important when making decisions that will involve many thousands of dollars that you speak with an attorney who is knowledgeable in this area of law before a final commitment has been made.

INJURY PREVENTION FOR RUNNERS

Guilderland, NY - Running is a lifelong sport. The key to a maintaining a pain free running career is knowing the risk factors of common injuries and making a valiant effort to prevent them. Training mileage, workout intensity, running form as well as training surfaces all contribute to longevity in this sport. Due to the repetitive nature of this activity, runners are prone to overuse injuries such as plantar fasciitis, shin splints, patellofemoral joint syndrome and IT Band pain. These injuries typically result from overtraining, muscle imbalances and faulty mechanics; and can be prevented when caught early. Follow these tips to keep you running. SMART MILEAGE: The body of an average person training for a long distance race will start to be challenged when weekly mileage exceeds 40 miles. Keep this in mind with marathon and half marathon training, which often require lengthy training runs to prepare for these races. Increasing mileage too quickly is a common error with runners eager to get a jump-start on their training program. As a general rule, do not increase your mileage more than 10% from the previous week. Recent research finds that you should never increase training mileage more than 30% over a 2-week period. VARY WORKOUT INTENSITY: Runners who train faster and cover longer distances take more overall steps. This stress to the lower body increases the risk of developing injuries to the foot, ankle, knee or hip. Therefore, training programs recommend to alternate your short and long distance runs. Also, keep high intensity speed training to twice a week allowing adequate time for recovery. VARY TRAINING SURFACES: When running outside on the roads, you should always run against traffic. However, if the roads you run on are cambered or crowned, the uneven surface can wreak havoc on the legs over time. If you are running on sidewalks to avoid crowned roads, this may not be the best option since cement sidewalks are 5x harder than asphalt. Hill running adds challenge to training, but remember that impact forces are significantly higher while running downhill. Softer grass and trail surfaces are more forgiving on the legs, so try to switch up your training surfaces! IMPROVE RUNNING FORM: Excessive bouncing significantly increases the amount of force transmitted through the body, which sets the stage for increased risk of injury. Over striding, particularly when the heel of the foot strikes the ground first, results in high impact forces transmitted through the body at initial contact. The vast majority of distance runners are heel strikers, this is a normal gait pattern. However, midfoot striking is thought to be protective for many reasons. Midfoot strikers have increased knee flexion at initial contact with the ground, decreased stride length and increased step frequency. This results in decreased bouncing, decreased compressive forces at the knee and decreased stress on the quadriceps muscle; all of which help protect against injury. ADEQUATE WARM-UP/COOL DOWN: Runners are notorious for skipping out on stretching and proper warm-up and cool down. When and how you stretch can impact your performance. Research has found that active or dynamic stretching is best performed as a warm-up prior to a workout. The goals of dynamic stretching are to increase core body temperature, increase flexibility in the muscles and joints being used during activity, facilitate neuromuscular control and increase energy storage in the muscles. It has been found that dynamic stretching before endurance running improves endurance performance. Dynamic stretching may include activities such as high knee stepping, skipping, lunges and squats. It is very important for runners to stretch the hamstrings, piriformis, hip flexors, quadriceps, calves and adductors. Stretches should be held at least 30-60 seconds for 2-3 repetitions. Research has showed that 3-4 weeks of static stretching following a training session may lead to improvements in overall performance. GMA Success at New York State Championships By Master Rice

Guilderland, NY - The other day, one of our students was explaining how someday they hope to have their own taekwondo school. They prefaced the conversation by explaining that they weren’t “sure what twists and turns their life would take, but...” This made me think, again, about the beauty of the mystery of life, the time continuum and how you just never ever know what can happen next. This time, however, my focus was on the causes of the choices we make. As soon as our conversation concluded, I immediately thought about how the choices we make that change the direction of our lives are caused by two opposing yin and yang forces: negative people, situations or environments and positive opportunities for change. In the case of this student, as is true for many local seniors, not the least of whom is my own son, it is positive energy and opportunity presented by college acceptance. Here are some examples of how positive and negative energy causes decisions for change. I moved to Turkey with my wife because it was a tremendously positive and exciting opportunity. Living and working there was beyond awesome, but after 7 years, negative changes in some policies of the school at which we worked combined with a positive opportunity in Westchester caused our return to the U.S. The Westchester adventure soon presented a number of negative people and places that brought us here to Guilderland and allowed me to have the conversation that caused me to write this article. This last move in direction and location was caused purely by negative environments and negative people. It came upon us without any new opportunity. We simply decided to move and then just made the opportunity happen. Recognizing positive opportunity and working diligently to verify it is easy. We must work very hard to learn to recognize negativity because it is not always apparent. I am certainly no expert, but I guess that the difficulty in recognizing negativity is what really lies at the crux of the dilemma for people in codependent situations or abusive relationships. We must not delay in acting to remove the negativity or remove ourselves from the negative environment. Remaining will wear us down and cause us to act in ways that we do not expect and are uncharacteristic for us. I look at all of the changes the positive and negative yin and yang forces have brought to my life in the same way. Despite the discomfort caused by negative experiences, I value them the same. This is because I am where I am and who I am as a result of all of them. I have also learned a lot from each experience to help make better decisions as I move forward. There are many times I feel like I waited too long, but I say this hesitantly because again, perhaps the waiting in those cases is what gave me what I have now. So, in the end again, I must cherish it in entirety and keep moving. We live, we learn, and if we can deny negativity a breeding ground, the world will be a better place. Despite what some people think, I’m pretty sure that’s why we are here.

As part of the election on Tuesday, May 16, voters will choose Trustees to serve on the Library’s Board. The three Trustee candidates are:

The Guilderland Public Library’s Board

of Trustees has approved a 2017/2018 operating budget of $4,038,583. This is based upon a tax-levy of $3,689,217. Details of the budget are available at www.guilpl.org/budget. The budget vote is on Tuesday, May 16, from 7 am to 9 pm, at local elementary schools. The community is invited to a Public Comment Session on the budget on Thursday, May 11, at 6:30 pm, in the Library’s Tawasentha Room.

The Board’s statement on the budget: “As always, our primary goal is to maintain the level of service you expect while keeping the physical plant in good repair. And it is this latter challenge that this budget addresses. While efficiencies in operations and staffing result in level or minor increases in expenditures, it’s the building itself where we have to direct resources. We have devoted increased funds to Properties (Capital Improvements, etc.) by reallocating funds from Physical Plant operations. As we have done for the past two years, we have reduced the amount of money needed to run the building – the Physical Plant line – through negotiating reduced prices for building services and the installation of high-efficiency lighting. “Three major projects were completed last year: repair of the unsafe loading dock, replacement of the roof, and installation of the above-mentioned lighting. But as with any quarter-century old building, additional work is needed. Anticipated Gifts and Grants for 2017/2018 total more than $282,000; this grant money will help pay for replacing major components of the decadesold, inefficient HVAC system. “As for the increase in Professional Services, the interior design of the library is a period-piece dating back over two decades. Staff has done what it can to arrange the interior for maximum

She holds a BA in English Literature from SUNY Oswego and a Master’s Degree in Special Education from CUNY, The City College of New York. For the past five years she has worked as a stay-at-home mom, but before that she had a nine-year career as a teacher in New York City, working in special education. Her last position was an Evaluation Coordinator, Early Intervention, for the Visiting Nurse Service of New York. Ms. Rivas’ statement: “Whenever I moved to a new city, I always tried to get to know my local library, and I did the same thing when I moved to Guilderland. Not only was I happy to find this library offers so many wonderful books, but it also offers a wonderful sense of community. The staff works tirelessly to offer programs and resources that are engaging, fun, educational, and thoughtprovoking. “As a Trustee, I would be able to give back through an institution that plays a vital role in its community. As a lifelong reader, and educator, the library to me is a place that offers not only books, but also computers, tax forms or a quiet place to study … resources that help a community thrive, and I would like to be a part of that.”

What a Realtor Knows….. (That online sites don’t!) Realtors all pay to be on the regional MLS (Multiple Listing Service) system which allows us to post houses and allows your realtor to look at them. The information gets picked up by Zillow, Trulia, Realtor.com, etc; however, all of the information isn’t correct and it can be outdated. The following information is what a realtor uses that you may not be able to get online! •

A history of the home’s sales, listings, expired listings, sales that fell through, etc.

The lot size, zoning designation, any additions and their size, flood info and more.

Maps of the location, which yes, you can see, but also the school district, taxing municipality, and other local information that may not be on an internet site.

The “comp” data! You like a home, but how much is it really worth? Realtors look at sold homes over the last year that are exactly alike, as well as homes for sale to see how prices compare.

Knowledge about home types and their differences; for example, older homes often do not have large bedrooms-no one cared way back when!! Or, what’s a raised ranch, split level and just plain ranch? We know, and know how each can fit your family and needs.

We know about the eras of home building and materials, like asbestos tiles, siding and pipe wrapping, vermiculite, lead paint and more.

And last but not least…the house just went under contract or isn’t for sale!! I have so many clients send me a list of houses they found on the internet, for me to say half are pending sales and 2 were never for sale; it’s great to use both, but the living breathing realtor has the best knowledge.

Many of my clients come from people who just want info like the above; how much is their home worth, what they could easily do to resell, will it pass inspection, what elementary school the kids would go to. I give a lot of free advice; it always benefits me as much as the person asking- I know they have the right info and that I am a pro! Call me with your questions, trust me, I know more than Zillow!!
