I

think the coast is clear enough for me to say it’s spring! At least it looks like and feels like and smells like spring, and certainly about time, too, after as cold and snowy a winter as I can remember here in Guilderland. Yet it is springtime, and the hiking trails at Tawasentha Park are full of walkers and runners, Western Turnpike Golf Course is filled with golfers, the fields at Nott Road, Di Caprio, and Keenholts Parks are in full use for a variety of warm-weather sports. In our residential neighborhoods, the scents of new growth are in the air and the sounds of lawnmowers are in our ears. This is truly a time of year when I think that most of us would agree that it’s great to live in Guilderland. I would like to express the Town’s gratitude to the members of several local Boy Scout troops for once again being involved in a service day project on April 27 to maintain and improve our hiking trails in Tawasentha Park. For the eighth consecutive year, the Scouts and their adult leaders spent part of their weekend working to cut back brush, spread stone and wood chips on trails, and to do whatever else was needed to make the trails safer and more pleasant for the walkers and runners who use them. Participants in this year’s event were youth and leaders from Troops 24, 33, 50, 83, and 264. Their efforts really make a difference! Western Turnpike Golf Course is open for the season, and bustling with activity. Although our spring opening was delayed slightly as a result of that long winter most of us would care to forget, the course came through the cold months in good shape, and playing conditions are now excellent, thanks to

the hard work of our groundskeeping crew. Please call the Pro Shop at 456-0786 for information on spring specials or to book a tee time, and remember that Guilderland residents always get special rates when they present a resident identification card. If you are a resident but don’t have a card, you can obtain one at the Pro Shop with proof of Town residency. As spring moves along, it’s important for families that need to make plans for children’s activities this summer to remember that registration is currently open for Guilderland’s popular day camp and sports/activities camp programs. The half-day day camp and the sports and enrichment camps are a familiar part of summer in Guilderland, and a lot of sessions reach maximum enrollment early, so I urge you to check your options promptly. Program brochures were distributed last month, but if you need an additional copy, please call the Parks Office at 456-3150. You can also get complete information and register for programs on-line at www.guilderlandrec.com. The fourth annual “MudMania” event will take place on Saturday, June 14 at Tawasentha Park. The event will include both competitive and “fun run” components, with several races setting off throughout the day, along with food and entertainment. Nobody knows what the weather will be that day, but no matter what, there will be plenty of mud throughout the course. Complete details and registration are available at www.tawasenthamudmania.com The schedule has now been finalized for the thirty-fifth consecutive year of free music programming presented at the Guilderland Performing Arts Center. The series will open with “Nervosity”, a show featuring regional high school bands, on Friday, June 20, and will continue on Thursday evenings through mid-August. As always, the series will feature several performances by the popular Guilderland Town Band. Complete program information is available at www.townofguilderland.org. It’s a busy time of year in Guilderland, but I think we all appreciate it after a lengthy winter season. Please enjoy all there is to do in our community, but travel safely to do it! The St. Madeleine Sophie School Home & School Association will be holding our first “Win, Place or Show Golf Tournament” on Tuesday, August 12, 2014 at the Western Turnpike Golf Course in Guilderland. Please join us! In the past two years enrollment at St. Madeleine Sophie School has increased and we look forward to continued growth. Your support will positively impact our school and the lives of the children who attend it. We are thrilled with this growth and through your assistance we will continue to provide students in Pre-K through Fifth grade with academic excellence rooted in faith. Your participation in our tournament supports our long, proud tradition of welcoming any child whose family seeks the gift of a quality Catholic education regardless of their financial circumstances.

We need golfers….and people who want to have fun! The tournament will be a 4-person scramble format with a 9:00 a.m. shotgun start. Q. Are you known for anything special? We offer some of most unique and innovative private and small group training programs such as our NXT series, which can only be found at VENT Fitness.

Q. How long have you been in business? VENT Fitness began as an independent brand in January of 2013, almost a year and a half ago. The facilities previously operated under the same ownership but as a Gold’s Gym franchise since 1991.

Q. Where are you located? VENT Fitness currently has 4 convenient Capital Region locations: Guilderland in the Hamilton Square Plaza, Latham on Rt.2, one mile east of the circle, Niskayuna next to Mohawk Commons and on Rt. 9 in Clifton Park, just past Shenendehowa. We are hoping to expand our Capital Region footprint over the next few years! Q. What hours are you open? Monday through Friday 5 am to 11 pm and Saturday/Sunday from 7am to 7pm.

Q. What do you love most about the business?

I recently met someone who had a tattoo of our VENT icon (green stylized E) on their arm. When he showed it to me, he said that we had completely changed his life. Other members have said that we’ve “saved their lives.” That’s the best part. Q. What do you want the community to know about you? VENT Fitness isn’t just about weights and cardio equipment. Our team is second to none and they’re committed to getting our members results and improving their lives. That extends to the community at large, which we demonstrate by supporting a variety of non-profits, and environmentally friendly initiatives that improve the health of our environment.

Q. How and why did you get into the business?

We are excited because we just celebrated the official grand opening of our new Guilderland club last month and are continuing to renovate the rest of our club locations throughout the year. If you’re interested in learning more please visit www.VentFitness.com.

In 1991, there were very few options for health and fitness facilities in the Capital District. Having grown up in a family who ran successful franchises in the auto industry, we realized there might be a similar opportunity in the health and fitness industry. Shortly after graduating from Siena, my brother and I learned about Gold’s Gym and after some due diligence moved forward with partnering with the franchise.

Guilderland NY- Spring is upon us and it means many things, including melting snow, blooming flowers, and kids playing outside again. It also means it’s time to review your property tax assessment. Market values have changed dramatically over the past several years and many, many property assessments are outrageously inaccurate. However, the property tax assessment is one area most homeowners overlook prior to sale. There is a direct correlation between the tax burden on a home and what a buyer can afford or is willing to pay. A lower tax burden simply allows a buyer to afford more home and allocate funds from the tax payment to the mortgage payment, which is obviously preferable to the seller. We recently listed a home for $99,000 that is grossly over assessed and has a tax burden of $7,200. Buyers qualifying for a $100,000 mortgage can’t buy this home because the tax burden per month is more than the mortgage payment and more than any other $100,000 home in the area. In another example, we recently listed a $600,000 home with an assessment over $800,000. The result was a tax burden $6,500+- more than competing $600,000 homes. It makes it hard to compete when a buyer can buy a similar home with $6,500/year lower property tax bill. If you

have a luxury home valued over $500,000 and your town has not done a revaluation in the past year or two there is a high probability that your assessment is not in line with current market values. arlier this year, a New Jersey teenager (“Rachel”) made national headlines because she sued her parents, requesting that they pay for her private school, living expenses, and college tuition. Rachel claimed that her parents had kicked her out of the house, abandoning her, and refused to pay for any of her school costs. At the time of the lawsuit, Rachel was living with a friend and the friend’s parents. Rachel’s parents said that Rachel left home voluntarily because she did not want to obey their rules. When the news of this lawsuit broke, plenty was said about Rachel and her parents and most of the comments were not pleasant. While the media did its best to demonize this family, little was said about the law that Rachel was relying upon to sue her parents. Ultimately, Rachel withdrew the suit against her parents. What if Rachel and her family lived in New York and Rachel sued here? What would Rachel’s rights be to sue her parents for child support in New York? In New York, a parent has a duty to support a child until that child’s 21st birthday. There are exceptions to this, such as if the child is married, joins the military, or is over the age of 18 and employed fulltime. Assuming that none of the exceptions apply to Rachel, she is entitled to child support from her parents as long she is under the age of 21. Even if Rachel is 18 and spends her day loafing around on the couch, her parents have an obligation to support her. A parent may feel she is in a “no man’s land.” The child isn’t doing anything bad, he’s just not doing anything, and the parents still have to support him. But what if Rachel moves out of her parents’ home because does not like their motto of “our house, our rules”? Even worse, what if Rachel is living at home, staying out until all hours, bringing anyone home she pleases, using drugs, etc.? Do Rachel’s parents still have an obligation to support her? Based on this example, Rachel’s parents could argue that Rachel is “constructively emancipated” and that she is not entitled to child support. “Constructive emancipation” is a legal doctrine in which the law treats a child, although under the age of 21, as emancipated from her parents. In order to prove constructive emancipation applies, Rachel’s parents must show that Rachel:

(1) is of “employable age,” (2) that Rachel left home voluntarily, without cause or parental permission, and; (3) that Rachel left for the purpose of avoiding parental discipline and control. If Rachel’s parents can prove (1) through (3) above, then the Rachel will be deemed to have forfeited her right to child support from her parents. Constructive emancipation is a sophisticated concept and it takes good lawyering to successfully prove that this doctrine applies to a particular situation. Unfortunately, as we saw from the New Jersey case, constructive emancipation cases can tear families apart and damage the relationship between the parents and the child. Leyla A. TEA BY ANY OTHER NAME… Relaxing chamomile tea, refreshing hibiscus-based fruit teas and caffeine free rooibos don’t come from the tea plant. So why do we call them teas? The word “tea” typically gets generalized for a drink made by steeping anything in hot water. Technically, if what you’re steeping isn’t from the tea plant, it is a tisane. Fruit tisanes are especially popular. Most have a hibiscus base which is tart. These make great iced teas. Strawberry Festival, Blueberry Jubilee, Orange Pineapple Punch and Black and Blue (all the berries you can imagine) are some favorites at Short and Stout. Add a little bit of sugar and the flavor is as bold as a juice rather than what most people think of as tea. Herbal tisanes are also very popular. Many of these tisanes are functional ayurvedics (a-your-vay-dics - Indian system of medicine). Most people have heard of calming chamomile tea. Rooibos (roy-boss) is a bush in South Africa that is wellregarded as a tea alternative because of its robust flavor and its natural caffeine free quality. Prospect Hill Cemetery Seeks Community Support Guilderland, NY - Prospect Hill Cemetery has stood along Western Turnpike, now Western Avenue, as a visible part of the Guilderland community since it was founded in 1854. The grounds, which total over 50 acres, house the burial sites of many individuals whose names are prominent in the history of the Town, as well as several hundred military veterans whose service dates as far back as the War of 1812. Prospect Hill houses the remains of 161 veterans of the Civil War, and includes a “Soldiers Lot” and Gothic monument erected to memorialize veterans who served in that conflict.

The easiest example of perseverance to demonstrate application to everyday life is breaking technique. In Taekwondo we practice our foot and hand techniques on boards and cement slabs. Sometimes accomplishing the break can take multiple tries, but each and every student must eventually succeed; they must persevere. The student learns slowly how to persevere and eventually applies the skill seamlessly to everyday life. When they are faced with a challenge in life, they remember how hard they worked to learn Taekwondo and how hard it was to break a giant stack of cement, and compared to those things, their everyday challenge diminishes. It is easier to cope, because they have overcome significant physical and mental challenges in Taekwondo. Breaking things with Taekwondo techniques is a parallel to the challenges we face in life which gives us practice in coping by perseverance.

By doing this you can get used to persevering, or as I like to say, “powering through it”. It doesn’t have to be Taekwondo or any martial art for that matter. But find some ways to put yourself on the spot, to push yourself for physical achievement, make it hurt a little and gain from it, because sooner or later, we will get hurt, and we will have to persevere. Practice often, practice now, so that you cope and persevere when you least expect that you will have to.

Building Strong Bones By: Dr. Kim Leis-Keeling

I

am always looking for interesting topics to write my articles about. So I turned to none other than my seven year old daughter for a topic. I asked her what I should write my next article about and her response was “Write about bones and how you crack them. Tell everyone how good it feels and how it makes me feel better.” Well, that sounds like a great idea; however, I really don’t crack bones. But let’s write about the bones parts. Bone health is such an important aspect of human growth and development. From the moment children are born we are thinking of calcium intake for strong bones. As we age, we are thinking of preventing osteoporosis and keeping our bones healthy. So what can you do to maintain strong bones? The 3 most important nutrients are calcium, vitamin D and vitamin K. The combination of these mega bone building nutrients will give you the best chance at fighting bone loss. Calcium: It should be pretty much engrained in your brain by now that calcium is necessary for strong bones. It is always best to try to get as many of your nutrients from food before adding a supplement. Good sources of calcium are found in cheese, yogurt, milk, dark leafy greens, blackstrap molasses, black-eyed peas, tofu, soy milk, orange juice and almonds. Vitamin D: It is essential for optimal health, especially when it comes to bones. Vitamin D and calcium work together for absorption. The best source is from the natural sun exposure for 15-20 minutes per day. If your Vitamin D levels are low in your blood then you may need to supplement. Recent studies have indicated that these two nutrients alone are not enough to build strong bone. What research is now discovering is that Vitamin K is a necessary nutrient to keep calcium in the bones. Vitamin K: Vitamin K has been thought of for blood clotting purposes in the body but its benefits go far beyond that. There are actually 2 forms of Vitamin K, K1 and K2. Vitamin K1is found in green leafy vegetables and is primarily for blood clotting. Vitamin K2 is produced from the good bacteria that live in your gut. It can also be found in grass feed organic animal foods such as dairy, butter, eggs and it is found in fermented foods such as natto (Japanese fermented soybeans), Brie and Gouda cheeses. Vitamin K2 plays a very important role in bone health by working with calcium and Vitamin D to build a strong structure.

. Tom is about 6 years old, very social, and the ultimate lap cat! His favorite thing to do is sit in your lap. His owner "put him outside" when he was a year old because his urine smelled and he supposedly didn't have the money to get him neutered... A kind neighbor has been feeding him for the last few years. This winter the same neighbor turned on a furnace in his garage and moved Tom into the garage. Tom thanks the neighbor by sitting in his lap for hours!! Two weeks ago Tom was moved to a wonderful, loving foster home. He is so very happy and has NO interest in going outside! He gets along well w/ his sister and brother cats and doesn't mind the dogs. Tom likes to be held and is very affectionate. He will meet you at the door when you come home and lay with you on the sofa and watch TV.

The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1. S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias. 2. The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500. 3. S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the PIMCO Total Return Fund ($250 billion in assets) than the Munder Bond Fund ($22 million in assets). For the period ending 12/31/2013, the SPIVA Scorecard showed that on a 5-year trailing basis, between 61% and 86% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of US equity mutual funds (those in the Small-Cap Value space), only 40% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble a portfolio. We find two common objections to the advice to avoid actively-managed funds – the first is to only use actively-managed funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that active-manager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of actively-managed funds to those with good track records. Bradford Cornell’s 2008 paper ‘Luck, Skill and Investment Performance’ concluded that “the analysis…provides further support for the view that annual rankings of fund performance provide almost no information regarding management skill”. In other words, buying yesterday’s winner is not a sound strategy in achieving future outperformance. We urge investors to carefully consider that costs (mutual fund fees, sales charges, advisor fees, etc.) and risk (asset allocation) are the two portfolio characteristics that are within your control, and to devote the bulk of your effort to focusing on this factors. Choosing the best mutual fund manager will likely prove to be an exercise in futility.
