Guilderland, NY- During November, a month that sometimes but not always heralds the impending change of seasons, there is always a lot going on in Guilderland. I want to make you aware of some of them. The Town Highway Department is in the midst of its annual leaf pickup program. Our fleets of vacuum trucks are circulating throughout Guilderland, picking up leaves on all streets where the trucks are capable of operating. There are two dates assigned for each street, and the road crews will be in your neighborhood on those days. They may be there on other days as well, as they are circulating throughout the Town on other days, as their schedule allows. If you live on a street where the vacuum trucks are unable to operate for one reason or another, Highway Department crews will be picking up bagged leaves on your street. Leaf collection schedules were published in the Town newsletter in September, and can also be viewed on the Town website, www. t o w n o f g u i l d e r l a n d . o r g. Please call the Highway Department at 861-5108 if you are unsure about pickup dates in your neighborhood. Please rake loose leaves to the curb, and try to avoid having them impede traffic or visibility. We will also be picking up brush and branches this fall. These items should be bundled, tied with twine, and be of a size that a single worker can move around and place in the truck. If everyone cooperates in maintaining visibility around piles of leaves, and in keeping branch and brush bundles manageable, our dedicated employees will be able to keep the fall collection program moving along safely and efficiently for all. The Western Avenue sidewalk construction project is winding down for 2014, having seen the achievement of its goal for the current year, the completion of an uninterrupted sidewalk network on the north side of Western Avenue that stretches from the Albany City line out to Route 155. A contract will be let shortly for the completion of a similar sidewalk network on the south side of Western Avenue, with work to begin and be completed in

2015. Also, a contractor has been selected to construct a sidewalk network along Main Street (Route 146) in Guilderland Center. It is anticipated that the contractor will do some of the preliminary landscaping work for this project during 2014. The actual installation of the sidewalks, however, will take place in the spring due to the pending arrival of the winter season. Each year, I like to remind our residents that they have a number of ways to keep themselves up to date on Town affairs. Town Board meetings take place on the first and third Tuesdays of the month at 7:30 P.M. They are broadcast live on Cable Channel 17, then rebroadcast at 1:00 and 7:30 on the following Friday, and at 7:00 P.M. on the following Saturday. The Planning Board meets on the second and fourth Wednesday of each month at 7:30. Meetings are broadcast live on Channel 17, then rebroadcast the following Thursday at 1:00 P.M. and the following Saturday at 7:00 P.M. The Zoning Board of Appeals meets on the first and third Wednesday of each month at 7:30 P.M. Meetings are broadcast live on Channel 17, then rebroadcast at 1:00 P.M. the following Thursday, and at 7:00 P.M. the following Saturday. All meetings are held in the Town Board Room on the first floor of Town Hall, and the public is always welcome to attend these meetings. I think that November is a wonderful time of year to think back on the many things we have to be thankful for, as both Americans, and also as residents of this special community of Guilderland. Sometimes it takes the form of venting, sometimes it’s out of frustration and anger. However, what are most people doing to change that complaint? Or doing to change their situation? We see this almost daily here at the chamber. We hear complaints about the economy, taxes, business is slow, or an employee not doing their job, etc. While it is our job as a chamber of commerce to help our members and help them come up with alternatives, or solutions, meeting people who can help them, or just a different way of thinking, we more often than not see people not implementing the changes because they are ‘too busy’. Too busy doing busy work and not making the changes that they need to in order to succeed. So the question remains, why are we all so ‘busy’? A member came in not too long ago and we talked about many different subjects. I asked him why he joined the chamber. He is a local business who does well, and honestly, not the type of person you would see becoming a member of a business organization. His response was quite simply ‘because you have to help others to get help’. I was quite honestly blown away. While this should not be news to anyone, rarely can you put your finger on a reason like that. We expect for others help us when we need it, but do we do the same for them? If we want to meet a prospective client we will ask someone to maybe introduce us, or to call them or send them an email to garner ourselves up more businesses, but have we done the same for someone else when we know we will not get business in return? I think that this is what has changed in the business world in the last few years. People used to regularly network for business and personal reasons. People belonged to Elks Lodges, sat on committees, and other community organizations or councils. But now we are all too “busy” to take time out of our day to help someone else or focus on a task. In today’s society we would much rather give a few dollars if we can’t commit to something, which makes me wonder why? We cannot blame this all on technology, I think a lot of it has to do with most family households have two working parents, and we put more pressure and demand on ourselves than ever before. Things are no longer simple. The point of all of this? Well, that same member I spoke with also went on to say that the other big reason why he joined our chamber was that he walked in to an event and one of our groups and he felt like it was an oasis for him. It was a way for him to unwind and talk to others going through the same thing he was as a small business. He could take his blinders off and breathe a little bit knowing he was no longer going it alone. In a way it took the pressure off of him. A “side effect” of this was that he has done well making connections and establishing relationships, which is what the chamber is all about! REAL ESTATE EXPERT REVEALS IF SOLAR PANELS INCREASE THE VALUE OF YOUR HOME Guilderland, NY - It is a question that we are starting to hear as real estate professionals almost every week. “I am thinking of selling my home, should I put solar panels on to increase the value?” It has been the subject of much debate among local real estate consultants and there does not seem to be a common agreement on the answer. The solar industry will tell you adding panels increases the value of your home, yet for the most part the actual statistical data supporting this claim is weak. In short the answer is it depends. If you are thinking of selling in the near term, the real question is “Is adding

solar panels to my home the best thing I can do to improve the value?” In general the answer to this not an issue, and makes the installation the value. If you are going to stay in

If you are considering installing solar panels do it for the right reasons which include the cost savings, reducing our reliance on fossil fuels, etc. not because you are selling and trying to increase

your home for several years installing solar panels makes sense because of the cost savings, environmental benefits, and current rebates available. While installing solar panels in an attempt to increase your home’s value for sale does not make sense, there are several improvements that will help in this area. Q. What year did you start your Family Medicine practice? Who are your current medical providers? A. I opened Guilderland Family Medicine on October 25, 1989 as a solo practitioner after completing my Family Medicine Residency at St. Clares Hospital. Francois Vachon, D.O. joined me in 1995 and we then helped form CapitalCare Medical Group, LLC in 1998. Q. Why did you become a Family Physician? A. I became a family physician because I enjoy taking care of patients of all ages. We have a number of patients who have been with the practice since its inception and we also continue to accept new patients. The feedback we have received from surveys and from our Patient Advisory Council indicate that our patients appreciate our medical staff ’s compassion and attention to detail. We currently sponsor the Guilderland United Travel soccer club. Q. What do you think is your biggest challenge with the medical profession at this time? A. We are currently struggling with trying to develop a cost effective healthcare system that provides comprehensive and quality medical care for all. We want to help our patients find more cost effective medical tests and medications, yet are frustrated by many of the burdensome demands of recent healthcare reform efforts by both the government and insurance companies. We strive to improve patient satisfaction, increase efficiencies and decrease costs, yet are often overwhelmed by complex electronic medical record systems that frequently create burdensome demands on our physicians. We would prefer to focus more our energies on our patient’s medical needs, rather than the needs of the electronic medical record system.

Active Management – Can You Win the Loser’s Game? Investors are faced with a choice between more than 8,000 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all actively-managed mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1. S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias. 2. The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500. 3. S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the Vanguard Total Stock Market Index Fund ($348 billion in assets) than the Munder Bond Fund ($87 million in assets). For the period ending 06/30/2014, the SPIVA Scorecard showed that on a 5-year trailing basis, between 78% and 93% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of US equity mutual funds (those in the Small Cap Value space), only 22% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble a portfolio. We find two common objections to the advice to avoid activelymanaged funds – the first is to only use actively-managed funds

in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that active-manager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of actively-managed funds to those with good track records. Bradford Cornell’s 2008 paper “Luck, Skill and Investment Performance invalidates this strategy. His results “indicate that most of the annual variation in [fund] performance is due to luck, not skill.” If skill is scarce while luck dominates, then past performance should not be relied upon to make investment decisions for the future. As we are told time and time again, past performance is not indicative of future results. Finance author Charles Ellis offered this sage advice in his book ‘Winning the Loser’s Game’: “Everything I know is known by the market and worked in to the market…The best way to invest is through benign neglect. Get your asset allocation right and leave your investments alone.” We couldn’t agree more!

DIVIDING A RETIREMENT ASSET? SPECIAL RULES MAY APPLY. Guilderland, NY - As the Capital District encompasses the seat of state government, many in our community are employed by government entities. Government employees often participate in employer-sponsored retirement plans, such as pensions, deferred compensation plans, etc. A retirement asset is often the single most valuable asset that a person owns (other than real property). To the extent that the retirement asset, or any portion of it, was acquired during the marriage, it is subject to equitable distribution upon a divorce. For example, if one spouse participates in a pension (we will call this spouse the “participant”), the pension would be equitably distributed so that the other spouse will receive a share of the pension at the time the participant retires. You may recall from our prior articles, that “equitable distribution” refers to the method used in New York for dividing marital property. Equitable distribution means that property is divided fairly, but not necessarily equally. Although New York law governs how the retirement asset is divided between spouses, the actual division of the retirement asset may be governed by federal law if the asset falls within scope of the Employee Retirement Income Security Act of 1974 (“ERISA”). ERISA is a federal law that is designed to protect certain retirement assets so that a retiree has enough income after retirement. ERISA prohibits the assignment of the retirement asset to another person

(such as a creditor). Pensions, deferred compensation plans, and 401(k) plans are examples of retirement assets that are subject to ERISA. While ERISA does not prohibit the right of a former spouse to receive a share of a retirement asset, the former spouse cannot receive her share unless and until a court order known as a Qualified Domestic Relations Order (“QDRO”) is signed by a court. This is a special court order that directs the plan administrator of a retirement asset to pay a portion of the participant’s account to his former spouse. This order must be written in a manner that complies with federal law and the plan administrator’s rules before it will be “qualified” and recognized as a valid QDRO. A QDRO must also be written so that it is consistent with the marital settlement agreement, or Judgment of Divorce, which provides how much the former spouse is to receive for her share in the retirement account.

Since a QDRO cannot be signed until a Judgment of Divorce is signed, I have encountered many people who have either forgotten that a QDRO is necessary or who wait years (sometimes decades!) to have the QDRO prepared. This is unwise, especially if the former spouse is entitled to receive survivor benefits if the participant-spouse dies prior to or after retirement. Without a QDRO on file, a plan administrator will not recognize any rights that the former spouse may have in the retirement asset. As the division of a retirement asset implicates state and federal law, and since a QDRO must comply with the rules of each plan administrator, a QDRO should always be prepared (and reviewed) by a skilled attorney. If a QDRO is not done, or done incorrectly, the participant or former spouse could lose out on several hundred, if not thousands, of dollars.

LIVING MY OLYMIC DREAM By: Dr. Kim Leis-Keeling

Guilderland, NY- It has always been a career goal of mine to work with elite athletes in professional sports or at the Olympic level. For the past 2 weeks I have been living my dream. I was fortunate enough to get invited to do a 2 week chiropractic rotation at the Olympic Training Center in Lake Placid. What

were covered with photos of athletes standing on Olympic podiums with medals wrapped around their necks. I remember watching some of these athletes during my childhood and some were from this past Olympic Games in Sochi- just a few months ago. These were the very athletes that were my patients

from 14-17 years old that basically live at the training center. They train all day while taking online high school at night. They are hoping to make it to the 2022 Olympics-eight years from now. That is pure dedication. The bobsled athletes were a mix of past Olympic medalists to new recruits from post college sports.

an amazing experience it has been. From the minute I checked into the training center, I felt like I had entered a strange world. What was this place? Everyone was incredibly fit and muscular. It was like I just left my “Average Joe” world and walked into “Global Gym” from that movie Dodgeball. The athletes were always dressed in Olympic jackets, TEAM USA everything and sweat pants. It didn’t take long for this suburban mother to notice that Olympians don’t wear yoga pants. (I was going to have rethink my own workout gear). The walls 20

the past few weeks. Word spread around fairly quickly that there was a chiropractor in the training room and my schedule filled up fast. I was nervous at first. How was I going to adjust these muscular monsters? It only took a few minutes to get over being “star struck” and it was time to get to work. The sports that have been training over the past few weeks were bobsled & skeleton, luge, biathlon, ski jumpers and aerial ski development team. The aerial development team is all young kids

Some of them have never even taken a trip down the bobsled track and they were trying out for TEAM USA. I thought they must have been out of their minds. I’ll never forget the day these athletes got to push that sled down the track for the first time. Thank goodness they have the best drivers in the world to get them down safely. I have never seen excitement like that before. On the reverse side of the excitement, is also lots of disappointment. As you can imagine with this level of athletic talent and sports, also comes intense injuries. There

were a number of athletes that got sent home to recover from concussions, ankle injuries, torn ligaments and need to set their hopes on making the team next year. Living on campus took me back 20 years and felt just like living in the college dorms. Community lounge areas, study areas, laundry rooms and of course a cafeteria. Everyone is curious about the kind of food it takes to grow an Olympian, right? Well, here is the scoop. The cafeteria has made changes over the years. I was talking with the cooks and an employee who has worked at the training center for 22 years. He recalls years ago when they would serve lots of fried foods, burgers, hotdogs and desserts. He said they used to make fresh donuts for the athletes but once the machine broke, they never replaced it. (Apparently, some scientist discovered that type of food is not good for the athletes). Gradually, over time the menu has become more nutritious. They have

eliminated desserts all together. One athlete said he remembers when they stopped serving desserts last year and he lost 10 pounds within a few weeks. They do have ice cream but the athletes rarely eat it. They do have a soda fountain which has Powerade, ice tea and 2-3 soda choices but the athletes don’t drink the soda. Breakfast was always the same, vegetable omelets, oatmeal, hard boiled eggs, scrambled eggs and either pancakes or waffles. Cereal is limited to granola, Corn Flakes and Rice Krispies’s. Lunch and dinner tend to be similar with spaghetti with red sauce, rice, steamed vegetables, potatoes, chicken, pork tenderloin, broiled fish and lean cuts of beef. The cooks say they get bored making the same things for the athletes and try to use different seasoning but the athletes prefer plain chicken breast. There is always a salad bar and a large refrigerator filled with Greek yogurt, Kefir and fruit. I did get pretty excited one day when we had Jell-O, but was sorely disappointed after my first bite

because it was sugar free. I definitely have a giant piece of pie waiting for me in the near future. My experience at the Olympic Training Center has been a dream come true. I learned so much from the sports medicine staff and the athletes. I will cherish these memories forever. For now, I am thrilled to be back home in my ordinary chaotic life filled with “Average Joes”. I’d like to say a special THANK YOU to all my patients & staff, my husband and children for putting up with me being gone for 2 weeks. I missed you all! But to have an Olympic hopeful come up to me and say “I had my best time after you treated me!” made it all worth it. I try to help all of my students understand that saying thanks is excellent and many times the socially expected response, but feeling it and showing it is more important. Doing things for your parents unexpectedly and saying that you did it because you wanted to help and you are so grateful for what your parents have done for you, is a very good way to demonstrate your gratitude. Showing appreciation is significantly more valuable than saying a simple thank you.

As we approach Thanksgiving keep your focus on being selfless as your way of giving thanks. Being selfless in general is a way to say to the world at large that you are grateful for what you have, what you are able to do, and who you get to

be with. By contributing to the greater good by selfless acts we show our appreciation for what we get out of the world. Even when times are darkest and the world seems to be giving us nothing but challenges, we know deep down that it is not really true and we can change our outlook by performing selfless acts of kindness. Even if nothing changes for us, and things are still dark, we made someone else better and improved our surrounding world. It costs us nothing and certainly it did not make our situation worse.

During challenging times for our community it is even more important to be kind and selfless to all we encounter. I believe that a focus on selflessness and kindness lies along our current path of evolution. I know that there are still horrible things happening, from our community stretching out to the whole world, but if you put it all in historical perspective, we are making steady progress toward a more kind, selfless and tolerant people. You don’t even have to go back a thousand years in a history book to see how violent and selfish things were. Go back further and you can become quite appalled. All of us can do our part to continue to be as selfless as we are able and spread the good character we have to assist our evolution along the right path. I try every day do this in the high school and my taekwondo school. I am not always successful, but just writing this become cathartic and re-inspires me to try harder. It is a small contribution to the greater good and has an impact no matter how small.

It’s classic Grisham and a real page-turner.

But for this cagey literary forger, his life is about to get considerably more complicated as he starts to receive letters threatening to expose his and Adam’s secrets. FOR ADOPTION Moose is a small sweet lovable long-hair blue gray male kitty looking for a forever home. When we met him his situation was dire. Moose was living outside a funeral home for the last several years w/ a neighbor feeding him from time to time and in desperate need of dental work due to rotted teeth and no regular drinking water. We were told that the last few winters he would crawl into a neighbor's garage via a hole in the wall to try and stay warm. Although Moose was in a terrible situation he would roll over and give us his belly to be rubbed. Moose is a remarkable resilient kitty! Moose is now rescued and living in a foster home. He is the ultimate lap cat. He likes to purr and sit next to you or in your lap and then purr some more. He never stops wanting to be patted. When you come home he will run up to you with his short little legs and greet you with a meow. His other favorite things to do are play w/ his cat-nip toy and look out the window and watch the birds. Moose will do best in a quiet home. He may start out slowly but then he will become your best friend. He is enjoying his foster mom and gets along very well w/ the other kitties in the house!Moose is healthy! His senior blood work looks great and he has had a complete dental. The vet estimated his age around 7 to 10 yrs old. He is neutered, tested negative for FIV/Felv, and up-to-date on his vaccines. She was found starving in an inner-city back yard. She had a severe flea allergy with very little hair on her body and looked so very helpless. Although she would run up to the home owner begging for food he choose not to feed her. Ivy was rescued and she immediately thanked us by curling up in our lap and snuggling. Although Ivy is almost one year old she still has some kitten qualities. She has energy and loves to run around the house. She loves her toys!! She also likes to take time out from her playing to cuddle in your lap or help you with your office work. She will want to cuddle up and sleep w/ you every night with no exceptions! Ivy loves to look out windows and meet you at the door when you come in. She likes to be around the home activities. Although Ivy gets along very well w/ the other 5 cats in her foster home Ivy insists on being the only cat to sleep on the bed w/ her Dad at night. Ivy is spayed, up-to-date on her vaccines and has tested negative for FIV/Felv. TEA SEASON HAS ARRIVED: THE TOP 4 QUESTIONS WE GET ASKED ABOUT TEA. What is tea? Tea comes from two closely related plants originating in China and India. White, Green, Oolong, Black and Pu-erh are all from these tea plants, but what happens after new growth is harvested determines the tea type. White and Green teas are plucked and dried for preservation by the sun or pan fried. White tea is light, while green tea has a grassy flavor. Oolong, with buttery/ nutty flavor, is picked, bruised and left to partially oxidize. Black teas are fully oxidized and are quite strong with a malty character. Pu-erh is aged black tea and is known for its earthy finish. What about other teas? If the plant, flower, or leaf you are steeping doesn’t contain the tea plant, it is a tisane. Most fruit and herbal tisanes are caffeine free and known for their medicinal qualities. For example, chamomile is known for its calming affects. Rooibos (ROY-bos) is known to aid digestion. Hibiscus is suggested to help blood pressure and hypertension. Yerba Mate is used as an energy booster. How should I brew my tea? Each type of tea has a recommended water temperature and length of steeping for optimal flavor. Generally, a teaspoon of tea leaves is used for an 8oz cup. Some teas may call for more and the drinker can always adjust the amount to his/her preference. Here is a brewing cheat sheet to go by: Tea

What’s the difference between loose tea and tea bags? As the tea market is growing, you might come across whole leaf tea in specially designed tea bags, but typically if you cut open a paper tea bag, you’ll find dust. That’s what the industry calls the smallest particles in the sorting process. When pounds of whole leaf tea are processed, the damaged and dried pieces fall to the bottom. This is scooped up and put into tea bags. Part of our evaluation of new tea is looking for the freshest leaves that shine and have a great aroma. This is indicative of tea that isn’t dried out, has its essential oils ready to be infused, and will provide a flavorful cup.
