What’s the solution to this copyright conundrum? One possibility could be for Congress to create a standard royalty system for lending out e-books. Right now, it’s unclear what the demand would be for such
a change, but as more lenders become negatively impacted, calls for
reform could grow louder. This type of proposed legislation would be a first in the United States, but perhaps the time has come for serious consideration.

resource for Guilderland and the greater Capital District, where anyone can access books and other media free of charge. As libraries like ours continue increase the availability of media governed by the fine print

notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY November is a quiet time in your Town parks, and an excellent time to enjoy hiking trails. Please take a look at Hike Guilderland!, a useful Town website application that provides interactive mapping of hiking trails. When winter’s snows arrive (sorry), the trails are suitable for snowshoeing. The Western Turnpike Golf Course is in excellent condition with year-end specials. When or if that snow arrives, the golf course is used for cross-country skiing and snowshoeing with trails extending into adjacent Tawasentha Park. Sledding takes place at the Winter Recreation Area, a short distance south of the Tawasentha Park entrance. Highway Department employees diligently work to keep Town roads free of obstructions that inhibit travel, limit sight distance, or pose unsafe conditions for pedestrians and vehicles. This work is particular important in the fall and winter. You can help Highway Department crew by raking leaves to the edge of, and not on, the paved road surface. Piles of leaves on streets reduce visibility, particularly in the fall’s lengthening nighttime, and, with heavy rain falls, have clogged storm drains, caused flooded roads, generate odors from decaying leaves and organic material, and unnecessarily increase maintenance costs. November is also the start of restricted parking which helps provide for the safe passage of school buses, emergency vehicles, and highway trucks due to accumulated snow and dark conditions. No parking is permitted on Town roads from November 1st to April 1st between 2am and 7am. On certain streets, there are also posted signs that limit parking to specific days and times. The Town’s Emergency Medical Services (EMS) Department is continuing with its successful assumption of responsibility for providing ambulance services in Town. Response times to calls have been shortened to about five minutes. The EMS Department is planning the deployment of a third advanced life support ambulance during overnight hours to further enhance the arrival time of ambulances at emergencies. The Highway Department has helped immensely with this vital mission by keeping a full complement of ambulances in service with preventive and regular maintenance. The Town’s proposed 2020 budget includes the acquisition of a new ambulance, and establishes and funds a reserve for future ambulance and equipment purchases. Another reminder (there will be more notices over the next few months) that the NYS Thruway plans to remove and rebuild the Old State Road bridge over the Thruway, starting next April. The work is anticipated to take seven months. Old State Road is an important connector road, and the bridge’s extended shutdown will cause significant disruptions. Please take the time now to consider alternative routes for trips that might involve this closed bridge. It will be a major change for daily commuters, weekend travel, and that last minute dash to the airport. As more details about timing become available, we will update the Town website and provide Nixle® notices. The 2020 U.S. Census is coming soon, with the National Census Day, or count day, on April 1, 2020. Peter G. Barber - Town Supervisor It is important to the Town that there is an accurate and complete count, which plays a large role in securing Federal funds, particularly for road improvements, and representation in Congress and redistricting of State and Federal voting districts. The final population figure will also impact the Town’s share of sales tax revenues. We will soon add more information about the 2020 census on the Town website. The Census Bureau is still hiring workers for this vital work. Please check out 2020census.gov/jobs for available positions in the area. You might be interested in seeing if the State is holding unclaimed funds for you or your family members. As of early November, the NYS Comptroller had $16 billion in unclaimed property State-wide, with $56,537,020 held for Albany County residents spread over 112,693 accounts. This free service allows you to input your first and last names in a search engine at www.osc.state.ny.us/ouf/ which will provide you with results consisting of a list of addresses and entities associated with unclaimed funds for the inputted name, and how you can submit a claim, often online, for the funds. At its November 19th meeting at 7pm, the Town Board will hear a presentation by Municipal Energy and Gas Alliance, Inc. about the Community Choice Aggregation program (CCA), which enables the Town to join with other municipalities in combined bids for electrical power upon behalf of residents at lower rates. National Grid would remain responsible for delivery and billing, and continue to handle service calls. Among the CCA goals are savings and rate stability, and a range of renewable energy options. Saturday, November 30th is Small Business Saturday®, a day dedicated nationwide to supporting small businesses. It is well-recognized that two-thirds of every dollar spent at small businesses stays in the Town. Please help support the Town’s expanding and diverse local business community on this special day and throughout the year. On Monday, November 11th, Town offices will be closed in observance of Veterans’ Day. The Transfer Station is closed on Saturday, November 9th. Active MAnAgeMent – cAn You Win the Loser’s gAMe? by

Guilderland, NY - Investors are faced with a choice between nearly 8,000 distinct mutual funds (excluding multiple share classes of the same fund), according to data from Morningstar. How can investors be expected to choose wisely from such a large investment universe? As it turns out, the first step may well be to filter out all activelymanaged mutual funds. Standard & Poor’s, a leading financial market benchmarking firm, prepares a semi-annual analysis called the S&P Indices Versus Active Funds Scorecard, or SPIVA Scorecard. The Scorecard seeks to compare the performance of various mutual funds to relevant benchmarks tracked by S&P. The Scorecard is particularly useful for the following reasons: 1. S&P considers all funds available at the beginning of a sample period, and not just those funds which survived through until today, thereby eliminating survivorship bias. 2. The Scorecard compares each mutual fund to a relevant benchmark, as opposed to comparing all funds to a single benchmark such as the S&P 500. 3. S&P provides analysis on an asset-weighted basis, which reflects the fact that an investor is more likely to have access to, say, the American Funds Growth Fund of America ($189 billion in assets) than the FPA US Value Fund ($67 million in assets). For the period ending 12/31/2018, the SPIVA Scorecard showed that on a 10-year trailing basis, between 81% and 93% of US equity mutual funds were outperformed by a relevant S&P index. This means that even in the best-performing category of US equity mutual funds (those in the Large Cap Value space), only 19% of funds outperformed their benchmark. This lends strong evidence to the wisdom of utilizing index funds (rather than actively-managed funds) to assemble
We find two common objections to the advice to avoid activelymanaged funds – the first is to only use actively-managed funds in the “less-efficient” asset classes, such as small-company stocks or emerging markets stocks. However, the SPIVA Scorecard confirms that activemanager underperformance is as robust in these asset classes as it is in more common asset classes such as large-cap US stocks. The second objection we hear is that investors should limit their choice of activelymanaged funds to those with good track records. Fortunately, S&P also publishes The Persistence Scorecard, which illustrates that topperforming actively-managed funds over an observed period are not statistically more likely to remain top-performing funds in a following period. Finance author Charles Ellis offered this sage advice in his book ‘Winning the Loser’s Game’: “Everything I know is known by the market and worked in to the market…The best way to invest is through benign neglect. Get your asset allocation right and leave your investments alone.” We couldn’t agree more!

inters with heavy snowfall can be magnificent, but they can also be challenging for homeowners. Accumulated snow and ice have the potential to damage many aspects of your home and property, including exterior components of your propane system. “Propane is one of the safest and most reliable sources of energy in winter,” said Tucker Perkins, president and CEO of the Propane Education Research Council (PERC). “It keeps your home warm and allows you to cook and have hot water. A propane generator ensures that you have reliable power in any weather.” While you can’t predict the first snow storm or hazardous weather conditions, you can put your family in the best position for safety and warmth by planning ahead. 12

Get to know your propane system. If you are not familiar with your propane system, take a few minutes to review it. Identify core components, including the tank, regulators, meter, piping and supply valves, as well as any appliance vents. Be sure you know where your main gas supply valve is located in case you need to close it in the event of an emergency; in many cases it may be located on your propane tank. Mark your tank and regulator. Use a brightly colored stake or flag taller than the maximum anticipated snow depth as a marker to enable emergency and propane service personnel to locate your tank. Also mark your secondary pressure regulator or meter, which is usually near the side of your home. Check local ordinances about marking tanks and regulators and follow any rules applicable to your area.

Have an adequate supply of propane. Roads leading to your home might not be accessible for delivery, particularly after a snowstorm. Establish a regular delivery schedule with your propane retailer or call to schedule a delivery when the percentage gauge reads 30% to give the retailer enough time to make a delivery and ensure you have an adequate supply of propane. Talk to your contractors. If you use a snow removal service, make sure the service knows the location of all propane equipment on the property. Instruct them to keep their equipment clear of all parts of your propane system, especially tanks, regulators and gas meters. If they shovel snow off your roof, instruct them to never shovel snow onto any part of the propane system and not to block any appliance air intakes or exhaust vents. It may be helpful to designate an area to pile snow safely away from any equipment.

Keep snow and ice from accumu lating on propane equipment. Snow or ice accumulation can potentially cause parts of your propane system to crack or break, resulting in a gas leak. Gently brush away snow or ice that has accumulated around the tank, meter, regulator and any other piping by hand or using a broom. If you must use a shovel, use extreme caution. If you notice any snow or ice buildup that cannot be removed easily, contact your propane retailer. Do not attempt to remove snow or ice by kicking or hitting equipment.

Be alert to snow buildup. Frequently check areas where snow or ice collect on your roof, structures or nearby trees and clear it if you believe it might fall on any part of your propane system. Heavy accumulations of snow or ice falling on tanks, regulators, meters, piping or valves may cause damage that could result in a gas leak. In high snowfall areas, drifting snow and ice sliding off roofs may require additional regulator and vent protection. If you think this may be an issue, contact your propane supplier for guidance on protection of these components. Keep vents clear. Appliance air intake and exhaust vents and chimney flues must always be clear of snow or ice.

Some homes may have direct vents, which are close to the ground. Improper venting can cause carbon monoxide buildup in your home, which could lead to serious illness or even death. Clear driveways and pathways to propane tanks. Remember that a propane delivery truck needs at least a 10footwide path to be able to deliver fuel to your home. Keep the tank area and a path to the tank free of snow. When plowing, snow blowing or shoveling, do not push or pile snow around your tank, meter, regulator or piping.

Stay Alert for Safety As you look for ways to keep your family warm and comfortable, it’s important to keep safety at the top of your list. These tips from PERC can help keep you and your family safe during cold weather. n n n n n
Never use a gas oven or range to heat your home. Never use portable gaspowered heaters indoors unless they’re designed and approved for indoor use. Never use an outdoor barbecue grill indoors for cooking or heating, and never use a generator in a garage or other enclosed area. Keep chimneys, flues and appliance air intake and exhaust vents free of snow, ice and other debris. Consider installing a ULlisted carbon monoxide detector on every level of your home.
If you smell gas: 1. Immediately put out all smoking materials and other open flames. Do not operate lights, appliances, telephones or cell phones. Flames or sparks from these sources can trigger an explosion or fire. 2. Get everyone out of the building or area where you suspect gas is leaking. 3. Turn off the main gas supply valve on your propane tank if it is safe to do so. To close the valve, turn it to the right (clockwise). 4. From a neighbor’s home or other nearby building away from the gas leak, call your propane retailer. If you can’t reach your propane retailer, call 911 or your local fire department. 5. Do not return to the building or area until your propane retailer or emergency personnel determine it is safe to do so. 6. Before you attempt to resume use of your propane appliances, have your propane retailer or a qualified service technician check your system to ensure it is leakfree.

HOPING THAT THE GOLDEN YEARS REALLY ARE by Margaret C. Tabak
Guilderland, NY - Often in divorce cases the retirement assets are the most financially significant ones, and cause a great deal of negotiations and back and forth as the Participant (the one who is receiving the benefit) does not want to distribute a portion to the other spouse (Alternate Payee), and tries to hold on like the captain going down with the ship. There are many types of retirement assets, but they basically fall into 2 categories: 1. 2.
Defined Benefit Plan; Defined Contribution Plan.
A Defined Benefit Plan is what we think of as the traditional pension. One day, after many years of service, you receive a specific monthly payment. This is the defined "benefit". A Defined Contribution Plan generally tends to be some type of deferred compensation such as a 401k or 403b. In this plan, the employer and/or employee each contribute a certain amount of money. At the time of retirement, you do not know what the value will be, as it is dependent on the stock market and how the funds have been invested. From reading the newspapers, we are aware of a local hospital that has not able to fund its defined benefit plan, and a large multinational corporation with a local presence trying to "cash out" its pension plan. What this means is that if your company promised you $1,000/ month for life, an actuarial calculation will be made to determine what the present value of those payments. That is, how much money would you need today to fund your pension? The company then sends you a check for the value of your plan and, like the Terminator, wishes you a “hasta la vista”. 1 What if you were supposed to receive half of your spouse’s pension and there is none? There has not been a lot of judicial review of this situation, but I believe that half of zero is zero. In other words, you may both be out of luck.
What if your pension is cashed out and instead of your former employer sending a monthly payment to your ex, you now have all of the money? Talk to your lawyer immediately! If your ex was supposed to receive half, chances are, she is entitled to half of the cash payment. What if you waived your interest in another asset (such as the house) and now your pension plan has gone belly up? Chances are that you will not be able to revisit your decision, and you now have no house and no pension. It is very important to consider all of your risks when you put all of your eggs (financial planning) in one basket. Don’t make emotional decisions about your financial future. Like the captain of the Titanic, going down with the ship may not be all that it is cracked up to be.

The Town’s Response To Climate Change How is the Town addressing climate change? Commitment to Sustainable Energy In 2018, the NYS Energy Research Development Agency (“NYSERDA”) recognized the Town as a “Clean Energy Community” based upon the Town’s clean energy initiatives in: (1) adopting the State’s unified building permit application for building solar installations; (2) utilizing NYSERDA’s software to monitor the Town’s energy usage; and (3) installing a free EV dual charging station at Town Hall. The Town used a NYSERDA grant to convert Town Hall and parking lot lighting to LED. In 2019, the NYS Department of Environmental Conservation recognized the Town as a “Climate Smart Community.” The Town has pledged to address the effects of climate change by enacting climate-smart land use principles, setting goals for climate action, decreasing energy use and shifting to renewable energy. In 2019, the Town partnered in a community solar installation in Amsterdam which has resulted in substantial energy credits from National Grid. The Town also recently issued a request for proposals for a solar facility at the Town’s closed landfill.
Open Space Preservation The Town has over 700 acres of open space with over 200 of these acres acquired in the past three years. This open space will allow creation of a “green infrastructure” of multi-use trails connecting neighborhoods, schools, and businesses, and protecting stream corridors, see www. timesunion.com/news/article/Rail-Trail-grows-in-Guilderland-12969841... This open space was cited in ranking the Town as the “most desirable” upstate community by young adults, see www.timesunion.com/photogallery/article/Guilderland-rated-most-desirable....
Sustainable Development As recommended in a 2017 neighborhood study, the Town created a Transit-Oriented Development District (“TOD”) which focuses upon CDTA’s regional transit center at Crossgates Mall and the underutilized ring road with direct access to the interstate highway system. The TOD District encourages sustainable development with more dense residential development within walking distance of the transit center and shopping. In 2019, the Town established a new water connection with Rotterdam with a pump station designed to allow water flow in both directions between the two communities. This municipal interconnection is the latest Town effort to diversify water sources to meet an ever-increasing demand for our growing Town. This new water resource will substantially reduce electricity and chemical treatments costs at the Town’s water filtration plant.
What other actions is the Town considering to address climate change? Community Choice Aggregation The Town is now exploring the Community Choice Aggregation (“CCA”) program which would allow the Town to purchase electric power on behalf of residents from an alternative energy supplier while still receiving delivery service from National Grid. The CCA supports the use of renewable energy. The Town has joined with Bethlehem, New Scotland, and Voorheesville in this effort.
Conversion of Street Lights to LED The Town is working with the NYS Power Authority on purchasing more than 600 street luminaries from National Grid and converting them to LED. To reduce costs, the Town is partnering with New Scotland, Altamont and Voorheesville on a combined effort to maintain the LED lights.
Conservation Easement Program The Town Board has commenced a Conservation Easement (“CE”) program which provides property tax benefits to owners interested in protecting farmlands and sensitive areas. The CE program complements the Town’s other environmental tools including planned unit developments, conservation subdivisions, and open space acquisitions. From Town of Guilderland website. We profiled your business before and what’s new and exciting? A. We purchased another John Deer Tractor and Inverted snowblower bringing our total to 4 which keeps our customer to tractor ratio low. Q. When is the best time to sign up for your snow and all-in one services? A. Any time of year because we operate in all four seasons. We sell snow contracts in July and have people sign up for lawn care in January.

We can work up a plan and price quote that can meet your needs. Sometimes a perspective customer has greater expectations than we can deliver so it’s our job to identify your needs. I would like to think it’s about our communication and that we always return phone calls. But the biggest reason is our equipment. If you ever watched our tractors and snow blowers clear snow, you would agree it’s the best way to clean a driveway that is full of snow. Most driveways can be cleared in 2 min or less without snow piles or damages to your lawn. When it comes to lawn care we use smaller mowers that operate at slower speeds giving you a better cut and they don’t compact the soil and tear up the grass like big zero turn mowers. If your property has hills and uneven terrain, our mowers are safer and are designed with a lower center of gravity allowing us to operate better on steep hills. Our mowing equipment can also be set up with specialized equipment to help with spring and fall clean ups. DR. KEELING’S “CHRISTMAS MORNING” GRANNY SMITH FRENCH TOAST Ingredients: 1 stick of real butter 1 cup of brown sugar 2 granny smith apples 1 loaf of Challah bread 1 can of sweetened condensed milk 10 eggs 1-2 tsp cinnamon

Ingredients: 1 pkg. Kings Hawaiian Rolls (12 ct.) leftover sliced turkey (about 1 cup), or get a rotisserie chicken from the grocery store 3 slices of Swiss cheese in ¼’s 1 C homemade stuffing or stovetop cranberry sauce (homemade or canned) 1 ½ t Dijon mustard 1/8 C butter melted ¼ T onion powder ¼ t Worcestershire sauce
Directions: Step 1: In a medium bowl whisk together, melted butter, mustard, onion powder, Worcestershire sauce, set aside.
