notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org

I

t’s September, which means that it’s just about time for summer to start transitioning into fall and to create one of the prettiest times of year here in Guilderland and throughout the region. It also means that school is back in session, and that drivers on all of Guilderland’s roads need to pay careful attention, especially anywhere in the vicinity of school buses. I urge everyone to be mindful that the law prohibits passing a stopped school bus from either direction. This is a statute that we take seriously and enforce here in Guilderland, for good reason. Let’s work together to get the new school year off to a safe start for everyone. On Saturday, September 19 the Town of Guilderland will be holding a Household Hazardous Waste Day event at the Town Highway Garage, located at 6338 French’s Mill Road in Guilderland Center, from 8:00 A.M. until 2:00 P.M. We will also be hosting a Document Shredding Day event on the same day at the Town Transfer Station, at 6363 French’s Mill Road, from 9:00 A.M. until noon. Household Hazardous Waste Day is a great opportunity for a pre-winter cleanout of your basement, attic, or back yard shed, enabling you to insure that a wide range of potentially hazardous materials are disposed of in a safe and environmentally sensitive manner- and you don’t even need to leave your car when you bring your materials to the Highway Garage! A listing of the materials that can and cannot be accepted for processing at this event can be found on the Town website at www. townofguilderland.org. The Document Shredding Day event enables you to bring up to four boxes of documents and records to the Town Transfer Station for confidential shredding, Passes are required for both events, and can be obtained at no charge at either the Town Clerk’s Office in Town Hall or at the Guilderland Transfer Station during normal business hours. A vehicle registration or similar document must

|

Guilderland, NY

be presented as proof of Guilderland residency in order to obtain your pass. If you have any questions about either event, please feel free to call the Transfer Station at 861-6776. Late summer and early fall are wonderful times of year to enjoy a range of recreational opportunities in Guilderland’s parks. The Tawasentha Park pool is closed for the season, and for reconstruction of the pool house after last spring’s fire, but Tawasentha still offers five miles of recreational trails, tennis and basketball courts lovely picnic areas, and a modern playground facility for the kids. It’s a great spot for family recreation. Our neighborhood-scale parks located throughout the Town offer both active and passive use recreational opportunities for all, and of course Guilderland’s Western Turnpike Golf Course offers some of its most pleasant golfing opportunities at this time of year. A number of special rate opportunities are available. Call the Pro Shop at 4560786 to check out the specials and to reserve a tee time. The recent flurry of sidewalk construction is winding down. The project on Main Street in Guilderland Center is now complete, with the sidewalk addition providing a significant improvement in pedestrian safety in the hamlet, as well as giving it a distinct neighborhood feel that it had previously lacked. Sidewalk construction on the south side of Western Avenue is just about complete for the current building season. The work done on Western Avenue in the past two building seasons has helped to create a complete sidewalk network along Guilderland’s principal thoroughfare that extends from Route 155 all the way to the Albany city line, providing significantly improved pedestrian safety, as well as improved connectivity between Guilderland’s residential neighborhoods and the broad range of businesses located along Western Avenue.

Bills for school and library taxes in Guilderland were sent out at the beginning of September, and must be paid in full by September 30 in order to avoid penalties. If you have a mortgage escrow account, your escrow agent should be paying the bill on your behalf. Those who pay their bill directly have a number of options open to them. Remittances can be made by mail, at the Guilderland Office of First Niagara Bank at 1873 Western Avenue, in person at Town Hall, and on-line at the Receiver of Taxes page on the Town website, www. townofguilderland.org. The Tax Office at Town Hall is open from 9:00-4:30 daily, with extended hours until 6:00 P.M. on Wednesdays in September. We are able to accept Discover Card for payments made in person at the Tax Office, and to accept Vis and MasterCard for payments made on-line at the Town website. All credit card payments require the payment of a “convenience fee” based on the amount of the remittance. These fees are assessed by the card processing companies, and the Town does not receive any portion of them. If you have any questions or concerns about your school or library taxes, please take them up directly with the administrators of those facilities. The Town only serves as a collection agent for these bills, and has no authority over school or library budgets. I hope that everyone has had a good summer. Please get out and enjoy its waning days, as well as the transition to autumn, safely. Ken Runion, Supervisor

Studies show that one of the first things people notice about someone is their smile and that a good smile creates positive self-image, something all parents wish for their children. Take charge of your child’s health this school year by incorporating good oral health habits into their daily routine and by packing healthy lunches. Many school children go straight to sporting practices after school and turn to sugary foods and drinks from vending machines which are disastrous to their oral health. An alarming increase in the consumption of sports and energy drinks, with the hopes of improving their sports performance and energy levels is instead causing irreversible damage to teeth, specifically with the high acidity levels the drinks contain, which erodes tooth enamel, the glossy outer layer of the tooth. This is turn causes teeth to become overly sensitive, prone to cavities and more likely to decay leading to more missed school days, lower academic performance and more missed work for parents. Simple preventative check-ups twice a year can head off decay and help you and your child learn how to protect their teeth throughout the year. Bite size carrots, fruits, nuts and bottled water are the best after school snack options and give children the fuel they need to excel in academics and physical activities. If your kids play sports, be sure they have a custom made mouth guard to keep their teeth safe from injury. Ensure your child is ready, returning to class flashing a happy and healthy smile! Low Back Pain and Disc Injuries By: Dr. Kim Leis-Keeling

L

ow back pain can be caused by many different conditions. One condition that I see every day with my patients is lumbar disc herniations. I have patients with acute disc injuries, non-surgical disc injuries, chronic disc conditions that flare up and patients that are candidates for surgery but are opting out. Most often, there are secondary issues with the disc injury such as arthritis, scoliosis, spinal stenosis, nerve impingement causing decreased sensation, weakness or numbness and tingling. These conditions left untreated can continue to cause more pain and faster degeneration of the spine.

Injuries to the disc can occur gradually over time from wear and tear or happen suddenly. Most often, I see patients who have had chronic low back pain for months or even years that they have not treated and will have an acute injury that will result in disc herniation. It is usually happens by doing something simple like bending to pick up something off the floor, or a sudden twist or even a sneeze that will send them to their knees in agonizing pain. They often describe excruciation low back pain with radiating pain into one leg or foot. There may also be numbness, tingling or loss of sensation in the limb.

In between each vertebra (bone) of our spine is a cushion called the intervertebral disc. These discs provide separation of the vertebra. This creates space for the nerves to branch out from the spinal cord and travel to various body regions. The nerves in the cervical spine (neck) travel into your arms and give you strength, sensation and motor control. The nerves in your low back travel into your pelvis and legs to give the similar functions. The spinal discs also act as cushions to absorb shock and allow for spinal flexibility.

There are different degrees of disc injuries. A disc bulge is an injury in which the annulus, the fibrous outer layer of the disc, is still intact but is pushed out to the side or back in to the spinal cord space. A disc herniation is where there is injury to outer surface of the disc and the material inside the disc is starting to come out but still intact. A disc extrusion is the most severe injury in which the nucleus of the disc, the gel like material inside, has completely come out of the disc and is in the spinal cord space. All of these can cause nerve

impingement. Symptoms typically include lower back and hip pain, pain that radiates into a leg/foot, numbness and tingling. Often times the pain becomes stronger in the leg than the low back. We have had great success treating these types of back injuries. Many of these conditions respond well to chiropractic treatments such as spinal traction or decompression, cold laser therapy and a rehab program involving spinal stabilization. As always, if you or someone you know is suffering with lower back pain, please give chiropractic a try. For further questions, call the Sports & Spinal Wellness Center for a free consultation at 518-869-3415. Please visit our website for more information at www.sportsandspinalwellness.com. We would be happy to be a part of your healthcare team.

T

he summer is coming to an end, and I don’t know about you but I am exhausted! Traditionally the summer time at the chamber is a “down” or “quiet” time, where our phones may not be ringing as much, but we still have some work to do for the fall. Well this summer, was over the top busy with us getting ready for fall events, working on current events, updating our website, putting together new programs, etc., And not to mention, in our down time the staff has tried to soak up as much of summer as we possibly could. While this is a great time for us, and I believe we are on the brink of some great things at the chamber, I had to remind myself to slow down just like many of us need to. We had a mixer in August at the Altamont Vineyard and Winery which was a beautiful serene setting, and a great place for us to host some of our health and wellness vendors to remind everyone of work place wellness. Speaking with one of our vendors and members, Andrea from Orenda Yoga, I was reminded that sometimes all we need to do is just sit and “be”. When was the last time any of us was just being “still” and not doing something? Probably not anytime recently that is for sure! This

is why it is important for us, our businesses, and our employees to be healthy, know how to handle our anxieties, and our mental health as well. That being said, we are very happy with our health and wellness program kicking off and so far has seen much success! That being said we are extending opportunities for businesses to show themselves at a fun casual atmosphere with us, the Bethlehem Chamber of Commerce, Colonie Chamber of Commerce, Southern Saratoga Chamber of Commerce, CAYP, and the Albany Rotary on Wednesday September 16th at Schmoozapalooza! Schmoozapalooza will be taking place at the Polish Community Center from 4-7pm and will be a fun time to relax in a nice setting and get to know some other businesses in our region. We are also hosting our 7th Annual Ladies Night Out on Wednesday September 30th which is taking place at the Italian American Center from 530-8pm and will once again showcase health and wellness vendors and businesses that are detrimental to women’s health and well-being. This year there is a $5 charge associated with the event to help pay for the cost of food and ½ of the proceeds, $2.50 for each admission ticket will be donated to The Next Step Inc., which helps women recover from addiction. The next month is a busy one for us! We will also be working on Guilderland’s very own Shared Workspace! More news to come on that VERY shortly, but we cannot wait to share the news with our community and local businesses to help them do business better in Guilderland. Any questions or comments, please call me or email me at 518-456-6611 or egauthier@guilderlandchamber.com

Sincerely, Erika Gauthier, President

Back To School By Master Rice

A

s pre-season football begins to enter the television programming our fun filled summer camp winds down and the children know that school is around the corner. Mostly because I remind them periodically. When I remind them by making some joke about hearing the busses warming up or the parents celebrating, I am pleased that more than half of the children actually react favorably. We are martial artists of excellent character, so this is expected, but I think this is probably universally true. Children of all ages start to look forward to the organization and framework that school brings to their lives. This becomes most apparent as we enter mid August. Children love when school ends, but they also, for the most part, love when it begins. In past articles I have discussed how the new school year represents a new start, a chance to begin again and about great character and showing it in school. More than ever we need to show great character through leading by example, for homework and for success. We need to show perseverance and other great character. We need this most of all now because we have a still expanding new common core curriculum. I write still expanding because this year the curriculum finally reaches 11th grade. I

know it has not been an easy move for any, but is this the first time we have had a change? Since I have started teaching, I have worked in all of the math curriculum systems implemented by our state. Each of my children have been in a grade that has been through a different set of math courses, and their ages are just about 3 years apart! Whether or not I think that is crazy doesn't really matter; along with their outstanding teachers, I helped them succeed within the system. Curricula come and go with the people that create them, and I go with the flow, doing the best job that I can to help the students and my own children strive for success within the new system. I don't drag any of them into my opinions about the curriculum or my concerns about my work. For goodness sake they are children; they are worried about getting a good grade, playing with their friends, getting their drivers license, a date, or graduating. They need support, help and most of all a positive attitude. The math course I teach will change next year completing the high school math curriculum cycle. It will require a lot of extra work on my part and some of the rest of us in the math department. None of that work will be optional, none of it will be disputable and certainly none of it will need to be reflected on

the students. I need to be positive and lead by example for their success and as importantly their comfort and happiness. I am not at all saying that we adults should not dispute in a peaceful proper manner the changes that come our way through government. That is a right we have, and a major principle upon which our country was founded. I am saying that we have to maintain a positive attiwtude for our children and students. They deserve the best chance at success by not being part of any negativity. They need a supportive positive attitude regardless of our opinions. They should not be talking to their friends about how they are going to opt out, they should be talking about the prom, an upcoming game, an achievement over the summer or going to the movies. They deserve the chance to be children; successful, positive, happy children. Remember, for all of us involved, change can be great, change can be difficult and change can be bad. We have been through many changes in our lives, those that were bad were probably undone and we got through the ones that were good. In the end it was all good. It may not be all good right now, but in the end, it will be, or as we now know, it is not yet the end.

TAX PLANNING VS. TAX PREPARATION BY DOUGLAS BAUER

M

any people focus their attention on income tax preparation at the beginning of each year, prior to the annual April 15th income tax filing deadline. While filing income tax returns in a timely manner is certainly a prudent strategy, it is often too late to engage in any effective income tax planning, as the year for which you are filing your tax return has already passed! Income tax planning should be a year-round activity. Here are some items you may wish to consider for tax year 2015: • Ensure that you are on pace to make your desired level of employer-sponsored retirement plan contributions. For 2015, the maximum contribution amount to such plans is generally $18,000 per employee, plus an additional $6,000 for those who are age 50 or older. Additionally, many plans now offer the option to make contributions to a Roth account. • Verify whether you are eligible to make a tax-deductible contribution to a Traditional IRA or a contribution

to a Roth IRA. You can contribute as much as $5,500 to such an account in 2014, plus an additional $1,000 if you are at least 50 years old. • Taxpayers in the 15% or lower federal marginal income tax bracket (taxable income of $37,450 or less for a single filer, or $74,900 or less for joint filers) may wish to take advantage of the 0% federal long-term capital gains rate. For example, a married couple with taxable income of $50,000 could realize up to $24,900 of long-term capital gains with no federal capital gains tax bill! However, please be aware that realizing capital gains may impact the amount of your social security which is taxable, and may impact eligibility for certain incometested programs. • On the other hand, capital loss harvesting can be an effective income tax reduction strategy. Taxpayers are allowed to claim up to $3,000 per year in capital losses, in addition to washing out any realized gains, as

a direct reduction in adjusted gross income. For a taxpayer in the 25% marginal federal tax bracket, a realized capital loss of $3,000 can reduce her federal tax bill by as much as $750. • Consider “bunching” or “prepaying” future charitable donations through the use of a donoradvised fund. Such a fund potentially allows a taxpayer to take an immediate income tax deduction this year for planned giving which may not occur until many years down the road. Please consult your tax preparer and/or financial advisor to determine if any of the above strategies are appropriate for your overall financial situation. With taxes, as in many other areas of life, a little bit of planning can go a long way. We encourage you to make tax planning a year-round activity, and not just the one hour per year you scramble to assemble your records for your tax preparer!

TRASH TALK

by Vince Coppola, Owner of Scrapster, LLC Remember the other day/today when the temperature went over 90 degrees with 300% humidity for the 100th me? It reminded me of someone explaining how you could determine the temperature when you don't have a thermometer. The frequency of a cricket's chirps fluctuates with the temperature, so if you count a cricket's chirps for 15 seconds and add 37, you will have the approximate outdoor temperature (in Fahrenheit). Huhwhaaaaaa t??? Have you ever seriously tried to do this-it’s basically impossible. A hummingbird with a triple shot of espresso can’t even count that fast. I tried asking Rainman and he gave up a er 4 seconds. I mean, c’mon, who thinks of this stuff!?!?

“Hey, Bart.” “Yeah”. “Did you hear that cricket chirp 54.2 mes in the last 15 seconds?” “You know what…I did!” “This is weirder.” “What is?” “I added 37 and guess what…it adds up to 91.2 and it’s actually 91.2 degrees out…these 2 things are totally related!!!” “No way!!!!!!” Just one of those things that pops into your head during a bout of heatstroke. The funny part is if you instead convert your findings to Celsius it will help predict the stock market. I hope everyone enjoyed Summer, but before we break out the crickets let’s look forward to a cooler Fall and ge ng organized around the house before Winter’s inevitable series of blizzards. Do you have fitness goals? by Chad Southwick

W

hen was the last time you set and achieved a personal goal? How did it make you feel? Personal achievement is one of the most powerful experiences a person can have. Whether you’re training for a marathon, a sport that you love to play, or simply want to lose a few pounds; goals are goals are goals. And no goal is more or less important - unless you choose to prioritize them that way. If you aren’t training towards achieving a goal, then you are mindlessly doing random work for the sake of work.

a meaning to your goal that is more important than a number on a scale and you’ll be more willing and able to follow through.

What kind of goals should I set?

Losing weight is one of the most popular and ambitious of fitness goals these days. There is no shortage of “new year’s resolutioners” that make their honest but limited attempts to lose weight every January after months of neglect. You might even find yourself in this category come January. It is a noble effort but often leads to disappointment and can wreak havoc on your self-esteem if not approached realistically.

Yes, you may want to lose some body fat, but that goal is very complicated and has a number of lifestyle factors playing into it. When you start working out after long periods of inactivity, your body can go into a sort of metabolic shock from the increased physical stress. If your eating, sleeping and stress patterns are as volatile as most Americans’, your body will use this new physical stress as a reason create more hunger and store more food to counteract the change in lifestyle. Therefore, setting weight loss goals at the start of a new workout routine is typically a poor approach. We can still track bodyweight as a lagging metric in the long run but it is by no means a leading indicator of improvement in a good workout program.

When setting goals, it’s important to know what you’re really looking to accomplish. At the root of it, most people just want to feel better about themselves. Unfortunately, society has trained us to fixate on the weight loss side of the equation. So ask yourself: “do I really want to lose [5/10/etc.] pounds, or do I want to [fit into my skinny jeans/ be able to run an entire 5K/ etc.]?” Assign

If your underlying goal is to feel better about your body, setting precise strength and/or conditioning goals is going to be much more productive and satisfying than setting weight loss goals. Oh and on the way to achieving them, you’re likely going to burn off some of that body fat, build some strong/lean muscle and have more energy to enjoy the activities you like to do!

What do you really want to do?

At CrossFit Aevitas, we help people with all sorts of fitness backgrounds and ambitions create and achieve their own unique set of goals. We discuss goal setting in our ABC program, and work with athletes individually to not only create realistic and measurable goals, but to assign time frames and expectations for the accomplishment of their goals. Check back in next month’s issue for more info on how to set specific strength and conditioning goals that will change the way you work out forever. For more articles like this and information about our CrossFit ABC program, visit www.crossfitaevitas.com, email us at info@crossfitaevitas.com or visit us at our facility in Charles Park just off of 155.

Women’s Eye Health by Dr. Chad Vaughn Guilderland, NY - Nearly three and a half Americans age 40 and older suffer from visual impairment, and 2.25 million are women. In fact, of the four leading causes of blindness in older Americans; macular degeneration, cataract, glaucoma and diabetic retinopathy, the rate of women’s cases outnumber the men in all four categories. There are various reasons for this: women generally live longer than men and women have hormonal fluctuations during their lives that negatively affect their eyes. There are many lifestyle choices you can make for yourself and for your family to reduce the risk of getting eye diseases.

Wearing sunglasses that block both UVA and UVB, but also reducing the amount of bluelight will help decrease the risk of cataracts and macular degeneration.

Annual eye exams aid in early diagnosis of eye disease. Like any disease early detection and treatment is the best way to slow or stop the progression.

Healthy diet rich in green leafy vegetables and colorful fruit, along with fish rich in omega 3 fatty acids contain an abundance of nutrients that are beneficial to our eyes.

Women may feel they need to put the health of their children and spouses in front of their own, but need to be reminded that they are just as important. Scheduling eye appointments for the entire family including themselves, is one way to make sure they are getting the care they need. Call Vaughn Vision at 9820123 to schedule an appointment and let us be part of keeping your eyes healthy for years to come.

Cardiovascular exercise improves delivery of necessary nutrients to our eyes and help with the removal of waste products that can build up in the macula area. Quitting smoking, besides increasing cancer, and lung disease, smoking also increases the risk for eye diseases.

GUILDERLAND PUBLIC LIBRARY

2228 Western Ave, Guilderland • (518) 456-2400 • www.guilpl.org

From the Director... GPL is full of stories, but not all of them are to be found in the fiction collection or in the DVD racks. Many of the more interesting stories center upon you, our customers, or the Library staff. Late in August, we had one such story, and I want to share it with you. You’re probably aware that early in the summer we sent out a call to our youngest patrons to design our new Kids Library Card. They responded enthusiastically: We received about 50 entries. I am pleased to announce that after spirited online voting on six marvelously creative finalists, we have a winner! The winning design was created by one of our newest and youngest patrons, a young lady named Shuying (Melody) Gao; GPL’s new Kids Library Card features Melody’s artwork. (The cards are being introduced on September 8, at the start of Library Card Sign-Up Month.) Our Youth Services Department Head, Librarian Beth Rienti, ran into a glitch when she tried to contact Melody’s family to let them know she’d won: The phone number was out of service. Beth was on the point of sending a letter when Librarian Sandy Tabor had an extraordinary experience. The story’s best told using Sandy’s words from an email she sent the Library staff that late-August evening:

“Just want to share a fun ‘series of fortunate events’ @ GPL tonight. “At about 6:10 a woman came up to the Youth Services desk and asked if she and her daughter could attend Kindergarten Boot Camp at 6:30. She explained that they were from China and had been in the US for about a month. She was hoping her daughter could come to the program to learn about school in the US. “We chatted and … I walked with them to the Helderberg Room and was waiting to introduce them to Beth Rienti [Youth Department Head, who was running Kindergarten Boot Camp], so Beth would be aware of why an older child was attending the program. “While I was waiting, the mother came over to me with the GPL Kids brochure and showed me the cover with the winning library card design, and told me her daughter had drawn and submitted the picture!!! I introduced them to Beth who explained that she had been unable to reach them by phone to tell them that the daughter had won … and was so happy to meet them. “But wait – it gets better. It turns out the family has just moved to Guilderland! “They came back to the desk after the program to tell me how welcomed and happy they felt at the library – and to take pictures to send home. “A very fun and fortunate series of events…GPL is a very special place.” Sandy’s exactly right: GPL is a very special place.

Thank you to everyone that came out to support us at our “Gathering of Friends” fundraiser. To make a Donation Mail to: Guilderhaven inc. 6655 Route 158 Altamont, NY 12009

GPL is now loaning Playaway Launchpads, the first-ever secure, preloaded learning tablets that children can borrow from their Library. Pre-loaded with high-quality learning apps and ready to borrow, every Launchpad is durable enough to take the punishment only a youngster can provide. They are rugged; drop-tested and kid-approved. Launchpads are self-contained; the apps cannot be changed or deleted, so they are ideal for kids. Plus there are no external connections (WiFi, Ethernet, Bluetooth), so what you, as a parent, see on the Launchpad’s screen is what your child is going to get. You can borrow Launchpads for two weeks, and you can renew them once for a total three-week loan period. There are no restrictions about whether adults or kids can check them out, so if you want to swing by and pick one up for the kids this weekend …

She is great with kids but needs to be the only dog. Please considering opening your heart and home to this dear girl. She didn’t ask for this life and deserves a second chance to live a happy life! NTPI Fellows® have completed a demanding three-part curriculum that has uniquely prepared them to effectively represent their clients before all administrative levels of the IRS. Having successfully completed coursework covering all variances of examinations, audits, collections and appeals, and having studied best practices and role-playing, Fellows know the entire process from both the client and IRS perspective. While earning the EA license denotes competence and the right to represent taxpayers, Fellows have made the commitment to a higher level of knowledge and excellence which further sets them apart. The course, open only to enrolled agents, CPAs and tax attorneys, was developed to prepare licensed representatives to protect their clients’ rights by disseminating the most recent information about IRS laws and procedures critical to representation. Enrolled agents (EAs) are a diverse group of independent, federally-authorized tax practitioners who have demonstrated a high level of technical competence in tax and are licensed to practice by the Internal Revenue Service. The only federally-authorized tax practitioners with unlimited rights of representation before the IRS, EAs advise and represent taxpayers who are being examined by IRS, are unable to pay taxes or are trying to avoid or recover penalties. EAs also prepare tax returns for individuals, partnerships, corporations, estates, trusts and any other entities with tax-reporting requirements. Unlike tax attorneys and CPAs, who may or may not choose to specialize in taxation, all EAs specialize in taxation and are required by the federal government to maintain their professional skills with continuing professional education. Enrolled agents are “America’s Tax Experts!” Dennis Magilton is a member of the National Association of Enrolled Agents (NAEA) and the NYS Society of Enrolled Agents

SAME AS HE EVER WAS

by Leyla A. Kiosse

M

ary and John met shortly after John divorced his first wife (Cathy). While they were dating, John shared with Mary details about his divorce from Cathy. John was bitter about the breakup of his marriage and in his mind Cathy was the cause for the divorce. After all, Cathy was the one that wanted the divorce, not John. John and Cathy had two children together, and John’s bitterness towards Cathy would surface when it came to issues concerning the children. John would tell Mary that Cathy was a “bad mother” and he would not hide his disrespect for Cathy in front of their children. Although John and Cathy entered into a separation agreement and resolved the divorce without litigation, John told Mary that he purposely made the process difficult for Cathy. He felt that Cathy should not receive any of the marital assets and he refused to sign an agreement that gave Cathy anything. In the end, Cathy gave in to John’s demands. Moving on with her

life was more important than the house, the retirement accounts, or any of the household furnishings (all of which John received). John even went so far as to throw out all of Cathy’s clothes, jewelry and family photos, just so there would be nothing left for her. Based on John’s description of Cathy, Mary felt that John’s feelings and his behavior were justified. Fast forward five years, John and Mary are married and have one child of their own. Mary has become increasingly unhappy in the marriage. Mary finds that marriage to John is difficult; he is selfish, demanding, and petty. Any argument between them results in John holding on to feelings of resentment. If he feels wronged in some way, John is bitter and cruel towards Mary. Mary wants a divorce. When she tells John that she wants to end things, John goes ballistic and tells Mary that everything in the marriage is her fault, and that he will make things difficult for her.

Does John’s reaction to Mary sound familiar? It should. Over the years, I have represented many clients who come to me upset and distraught about the way in which the other spouse treats them, either during the marriage or the divorce or both. After speaking with the client it often becomes clear to me that the person the client is describing is the same exact person that she married. If he was petty, selfish, and demanding before the marriage, then he will likely be the same way after the marriage. If you are in a relationship with someone whose hatred towards his ex-spouse interferes with his ability to treat that person with respect in front of their children, what will he do to you? People rarely change. In the above example, John is the same as he ever was. The only difference is the target of his behavior. Remember that.
