notes from the SUPERVISOR’S OFFICE 5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - With this hot summer coming to a close, I want to acknowledge the indispensable behind-the-scenes workers that successfully handled recent emergencies, and the young volunteers who have greatly improved Town parks. I would like to thank residents and business owners for their response to the ban on lawn sprinkling. The ban was caused by a break in a water main in the City of Albany which provides the water to meet the Town’s heightened summer water demands. The water plant operators and support staff recognized the problem, devised a solution, and took immediate action. Within days of the emergency declaration, water demand decreased by over 1 million gallons per day. This reduction has enabled the Town to maintain capacity in its water towers which provides the pressure needed at fire hydrants. I also thank the Police Department, Fire Departments, the Guilderland Library, and Guilderland Central School District for placing the emergency notice on their electronic signs. And although we’ve had recent heavy rain events, you might wonder why the lawn sprinkling ban remains in place? While rain helps reduce the demands for outdoor watering, the sudden heavy downpours cause large quantities of stormwater to flow into the Watervliet reservoir which requires more filtration and cleaning efforts, and ultimately reduces the capacity of the water filtration plant. Long periods of light soaking rain are best for the water system but unfortunately may not be best for enjoying outdoor activities. I also thank the efforts of Town employees who provided assistance during our recent heat wave. On short notice, cooling centers were established and the new Tawasentha Park pool house and pool were made available without charge. The pool saw a three-fold increase in users. I am also pleased to announce that the Town was recently notified of an award of $1,200,000 for safety improvements to Carman Road. This funding is under the Federal Highway Safety Improvement program and will be administered by the NYS Department of Transportation which is responsible for design and construction. The proposed work includes adding a two-way left turn lane at Lydius Street, new sidewalks on each side of Carman Road near the intersection, high visibility crosswalks, new pedestrian signals and sidewalk ramps that comply with the Americans with Disabilities Act. These improvements advance the recommendations in the Town’s Fort Hunter/Carman Road Neighborhood Transportation Plan. The work is scheduled to start in 2018. The Town will work 4

Peter G. Barber - Town Supervisor with DOT on the specific design elements and advocate for further safety improvements for Carman Road. As the project progresses, we will provide regular updates and will work with DOT to minimize inconvenience to travelers and residents. On Saturday, September 17th from 8am to 2pm, the Town is holding a Household Hazardous Waste Day at the Highway Department Garage, 6338 French’s Mill Road, just off of Route 146 in Guilderland Center. Please review the list of acceptable hazardous waste at www. townofguilderland.org/transferstation. Also, on Saturday, September 17th from 9am to Noon, the Town is holding a Document Shredding Day at the Transfer Station, across the street from the Highway Department Garage. Residents can bring four boxes of documents and records without charge. Residents can pick-up passes for both of these events at Town Clerk’s Office or Transfer Station. I close by thanking Girl Scouts and Boy Scouts for their volunteer work improving Town parks. Scouts have devoted thousands of skillful hours performing invaluable community services including identifying wildlife, trees, and plants, and then made interactive signs providing descriptions of nature that you might see while hiking the trails in Tawasentha Park; constructing a much needed stream crossing for a hiking trail near the Guilderland Performing Arts Center; improving and marking the extensive trail system; rebuilding approaches and stonework at the hiking bridge over the Normanskill; and constructing a shelter and washing pad for the dog run at Nott Road Park. Scouts have performed numerous other tasks that have helped make Town parks and its amenities more enjoyable for residents. We will continue to highlight the special ways that our young residents have contributed to their community. I hope that you take the time to enjoy your Town parks and hiking trails. This time of year is all about back to school and back to work after the summer. Does it seem like a long time ago since you personally had to think about back to school? I’ll bet a lot of those memories are still fresh in your mind. Remember the first time you got on the school bus? How about your first day in a new school? Do you smile when you remember meeting the person who would become your favorite teacher ever? Can you recall meeting your best friend? So many of our back to school memories were tinged with nervousness. Part of not being able to sleep the night before was anticipation about starting anew. Would it be hard? Would it be fun? What will I learn? Maybe the best thing we can do for ourselves as business people is go back to looking at life through a child’s eyes. Will the next quarter or year be hard? Sure, but fulfilling too. Will it be fun? Yes, if we cultivate a sense of proportion and stick with our value system. What will I learn? Ah, a key question. Asking the question, “What will I learn?” connotes an openness to new ideas, methods, and approaches. The question also flags the humility shown by admitting we don’t know all the answers. The question helps the person who is new in business to understand that knowledge comes in increments so it will take some time to get a grip on real competency. It is a question which keeps the seasoned veteran fresh and young at heart. What will I learn today? One of the key missions of the Chamber of Commerce is to help our members learn and expand their business horizons. Come on, back to business. OLYMPIC RECAP: CUPPING THE ATHLETES By: Dr. Kim Keeling Guilderland, NY - Watching the Olympics is one of my favorite sporting events to follow. But I can honestly say that I am always glad when it is over because I loose so much sleep trying to watch every night. This year’s events were so exciting to watch. I enjoyed the inspiring stories highlighting the hard work and determination these athletes endure to achieve their goals. The hot topic in this year’s summer games revolved around Michael Phelps and his “spotted” back. These infamous spots are a result of a treatment technique call cupping. What is this cupping all about? Cupping is an ancient technique that dates back to the Egyptian, Chinese and Middle Eastern cultures. There are different techniques of cupping: dry, wet and myofascial cupping. Dry cupping is the traditional technique that uses glass cups in which the clinician soaks a cotton ball in alcohol, lights it on fire inside the cup to create a heat vacuum then places the cup on the skin of the patient. This can be done over acupuncture points or on an area where Cupping with fire and glass cups Cupping with plastic cups you are trying to promote healing by increasing blood flow to the area. More recently, rubber vacuum cups have been replacing the glass cups because they are easier to use. Wet cupping can be done with glass or plastic cups but prior to applying the cup, the skin is poked with a small lancet. During this technique blood is drawn from the tiny hole to stimulate a stronger result. In our office we use Myofascial Cupping – which does not leave bruise spots on your body. This is a newer technique in which only one cup is used. Lotion is applied to the treatment area so the cup can easily glide across the skin. The skin is gently lifted off the body to loosen fascial adhesions, reduce scar tissue, increase blood flow to dehydrated muscle, bringing fresh oxygenated blood to the injured area to promote healing and instantly increase range of motion around stiff joints. I have been using cupping for almost 15 years with patients and is one of the most effective tools we use. written by Master Rice Guilderland, NY - In most areas of our lives people form cliques that can be, or at least appear, closed. At GMA we battle this tendency and develop community spirited character. Community and belonging are an essential part of any life. As we go back to school this sense of belonging is very important for our students and children. I remember my own schooling and recall many times when I felt excluded or afraid to join. I was reminded of this topic recently in class when I was forming partners for a kicking activity. Students always choose their own partners at least twice during class at GMA. I noticed that there was an odd number in the class so I knew there would need to be a group of three somewhere. What I saw next, and it is quite common, was that there was one less experienced child left who didn’t have a partner and they weren’t sure what to do. More than one pairing called to them and asked them to join their group. The most remarkable part is the positive and encouraging way in which the students beckoned the flailing single; I heard “join us, it will be awesome!”, “don’t worry come with us” and “we got you, no worries.” Another thing I noticed was that there were quite a few parings of high belts with low belts and older students with younger students. This leadership behavior among all of our students is one of the things that makes our program so strong, but the real benefit is that it contributes to the community we live as well. As I reflect, I realize that such acts of kindness, leadership and community that I observed
in class would have meant so much to me in my classes as a child in grade school. It would have, I am certain, changed her my life for the better. This is why I am so happy to be able to help students become better leaders in our school and in our community; their lives improve by becoming better leaders and the lives of those they help in our community become better through kindness. We have a great community in the schools of our fine district as well. The difference for me is that the students I see here at GMA have been working with me and practicing their community character for many years. My blackbelt students have been here at least 4 years some of whom I work with every day. At school we must say good bye to our students after just one year, each year developing a new community. I admire all of the work my colleagues do to promote great character in our schools and in our community. I have been very fortunate to live and work here. The district’s impact on the lives of my children have been wonderfully positive. I hope that my taekwondo students continue to demonstrate great character outside GMA and I look forward to continuing to hear great things from my colleagues about demonstrated leadership and community spirit among our blackbelts. If you hear that one of your students is a blackbelt of ours, know that you can expect excellent character, leadership and community spirit.

Among these options is a Section 529 College Savings Plan, which has emerged over the past 15 years as a popular college savings vehicle. A September to Remember Guilderland, NY - September is a busy month here at the Guilderland Public Library, with many fine library programs, underscored by three large-scale events that are sure to be fun. On Saturday, September 10th, the library is partnering with our neighbors, the YMCA, and Our Lady of Mercy Life Center, along with the Town of Guilderland, to present our first Community Day. A full slate of events is scheduled to take place from 11 a.m. to 3 p.m. at all three venues. The library will host an exercise class provided by YMCA staff, along with a great puppet show, â&#x20AC;&#x153;Puppet Palooza,â&#x20AC;? presented by The Puppet People, at 2 p.m. The Guilderland Police Department will be here doing fingerprinting and creating identification cards for kids, and our monthly Better Books Sale is going on from 10 a.m. to 4 p.m. Next door at Our Lady of Mercy, the band Big Medicine will perform in the parking lot from 1:30 p.m. to 3 p.m. A wonderful chicken dinner will be served from 11 a.m. until whenever itâ&#x20AC;&#x2122;s all gone. Tours of the facility and a big community bingo game will also be taking place. The YMCA is getting into the act with several bouncy houses for children, as well as free use of the facilities for the day, even for non-members. Barbara Lukas, of WMHT, will do one of her great family learning events, â&#x20AC;&#x153;Family Number Fun and Activities,â&#x20AC;&#x2122; at 10:30 a.m. that dayâ&#x20AC;&#x201D;only this time sheâ&#x20AC;&#x2122;ll be at the YMCA instead of the library! Then on September 24th, the Guilderland Library Foundation holds its second annual fundraising gala, entitled â&#x20AC;&#x153;A Novel Affair, Chapter Two!â&#x20AC;? The Foundation is the libraryâ&#x20AC;&#x2122;s fundraising arm, and does so much to strengthen the library. Since we sold out the event last year, weâ&#x20AC;&#x2122;ve moved the event to a larger venue, The Albany Country Club. The party starts at six, with a cash bar, light music by the Mixed Company Band, light hors dâ&#x20AC;&#x2122;oeuvres and a stellar silent auction featuring over 70 items donated by businesses and individuals in Guilderland and surrounding areas. Dinner starts at seven, and features four great selections: Flat Iron Steak, Chicken Saltimbocca, Roasted Salmon Filet, or Grilled Vegetable Napoleon. This yearâ&#x20AC;&#x2122;s gala will honor Garry Robinson of Robinsonâ&#x20AC;&#x2122;s Ace Hardware, and the entire Robinson family for being a cornerstone of the Guilderland Community for over 50 years.

ARE YOU MY MOTHER? PART TWO by Leyla Kiosse Guilderland NY - Families come in many shapes and sizes today, and the law has not kept up with medicine or social values that have created them. Until now. You may be raising the child of your spouse or partner, caring for the child, supporting the child, having the child call you “Mom” or “Dad.” But what happens if the relationship between the adults sours? What are the rights of the “non”-parent? On August 30, 2016, the New York Court of Appeals rendered a decision in the Matter of Brooke S. B. v. Elizabeth A. C.C., which now provides guidance on the custodial rights of non-parents. We first told you about this case in our February 2016 Our Towne article. The Brooke S.B. case involves two different same-sex couples who never married or entered in a civil union. Both couples in the case were in a long-term relationship and agreed at some point to have a child together. In each case, one partner carried the child while the other was active in the pregnancy in all other ways (attending doctors’ appointments, caring for the pregnant partner, attending the birth of the child and cutting the umbilical cord, etc.). In each case the couple lived with and raised the child together, and the child continued to have contact with the non-biological “parent” even after the couple broke up and physically separated. In each case, the child referred to the biological parent as “mom” and the other “parent” as “mama” (even though the non-biological “parent” had not adopted the child). When the relationship between each couple deteriorated, the biological parent cut-off the other “parent” from having access to the child. The non-biological, nonadoptive parent in each case petitioned the court to seek custody and/or visitation with the child. The Court of Appeals was asked to decide in each case whether the former partner, who had no biological tie to the child (and who had not adopted the child), could be considered a “parent” within the meaning of Domestic Relations Law Section 70 such that she had a right to seek custody of, or visitation with, the child. The Court answered that question in the affirmative. The Court specifically overruled the prior case on the rights of non-parents (known as the Alison D. case), and held that “where a partner shows by clear and convincing evidence that the parties agreed to conceive a child and to raise the child together, the non-biological, nonadoptive partner” has the right to seek visitation and custody under the Domestic Relations Law Section 70. While the Court of Appeals has now provided guidance on the rights of non-adoptive, non-biological “parents” of children, the holding of the Court is a narrow one. In order to ensure that the rights of the non-biological parent are protected under all circumstances, that person should take all steps to adopt the child because an adoptive parent has rights equal to a biological one. It reminded me of someone explaining how you could determine the temperature when you don't have a thermometer. The frequency of a cricket's chirps fluctuates with the temperature, so if you count a cricket's chirps for 15 seconds and add 37, you will have the approximate outdoor temperature (in Fahrenheit). Huhwhaaaaaattttt??? Have you ever seriously tried to do this-it’s basically impossible. A hummingbird with a triple shot of espresso can’t even count that fast. I tried asking Rainman and he gave up after 1 second. I mean, c’mon, who thinks of this stuff!?!? “Hey, Bart.” “Yeah”. “Did you hear that cricket chirp 54.2 times in the last 15 seconds?” “You know what…I did!” “This is weirder.” “What is?” “I added 37 and guess what…it adds up to 91.2 and it’s actually 91.2 degrees out…these 2 things are totally related!!!” “No way!!!!!!” Just one of those things that pops into your head during a bout of heatstroke. The funny part is if you instead convert your findings to Celsius it will help predict the stock market. I hope everyone enjoyed Summer, but before we break out the crickets let’s look forward to a cooler Fall and getting organized around the house before Winter’s inevitable series of blizzards. ESTATE PLANNING FOR YOUR DIGITAL AFTERLIFE
(Part 2)
Guilderland, NY - Last month we addressed the issue of what happens to your digital assets at death. In the absence of consistent and comprehensive legislation, user licensing agreements (which only 1 in 1 million people actually read before clicking “I Agree” or “Accept”) control. Because each company has its own agreement and policies, dealing with a deceased’s accounts can be frustrating, time-consuming and costly. The policies for Facebook, Twitter, Amazon/Kindle, and Apple/iTunes were addressed previously. The policies of PayPal, Yahoo, and Google/Gmail are discussed here, along with a discussion of how to preserve your information so your family and estate representative can access your accounts after your death. PayPal Deactivating a PayPal account is relatively easy if the proper documentation is submitted. The Executor or Administrator of the estate must fax to PayPal a copy of the death certificate, their own government-issued ID, a copy of the Will or Letters Testamentary identifying them as the Executor, and a letter directing PayPal to deactivate and distribute anything left in the deceased’s account. Yahoo Yahoo accounts are not transferable upon death; Yahoo’s position is that any and all rights to your account are personal to you and terminate upon your death. A request by your estate representative to close an account must be accompanied by the Yahoo ID of the deceased, a copy of the court documents (Letters Testamentary) appointing the estate representative, and a copy of the death certificate. Google/Gmail If a user dies without designating anyone to manage their account, Google will automatically delete the account 9 months after the date of the last login. However, if someone other than the original user is accessing the account, Google considers that an impersonation, which is a violation of the licensing agreement. Therefore, if you give your spouse your account information and Google finds that person has been
using your account after death, they can suspend or terminate the account at their discretion. However, Google has an option called the “Inactive Account Manager” which allows users some discretion in deciding the fate of their accounts once they are deceased or the account has been inactive for a specified period of time. Up to 10 friends and family members will be notified if your account becomes inactive and they will be able to download data (e.g., blogs, uploaded YouTube videos) from your account for up to 3 months. This does not mean that your digital manager will have full access to your account. Google states that only “in rare cases we will be able to give an estate representative access to a Gmail account”. The estate representative must first initiate “Step 1” which requires a death certificate, the Gmail address of the deceased, and a government issued ID for the person making the request. If, and only if, the initial request is approved, will you be allowed to proceed to Step 2 of the application, which requires further legal documentation, including a court order. Even then, Google warns, not every request is granted and they reserve the right to deny a request at their own discretion. Even accounts that let you designate a digital manager will not let that person fully access your account after you die, at least without some fairly strenuous legal

Whereas these are handy and good references for all of us who manage numerous accounts, it does not address the very real concern that impersonating someone else (the deceased) online is a violation of virtually all licensing agreements. The management of digital assets in the context of estate planning is an area in dire need of intelligent, uniform
legislation. The existing patchwork quilt of rules and licensing agreements is a challenge to both users and estate planners alike. When you consider your estate plan, take the time to address the disposition of all of your assets, including your digital assets, which can be of great sentimental as well as monetary value. Now, more than ever, a conversation about your digital assets is an essential part of a comprehensive estate plan. His handsome looks and gentle demeanor will steal your heart. Aiden needs a home where he will be the only cat as he carries the Feline Leukemia virus. Aiden is two years old and loves to cuddle. “TANNER” is a neutered male cat, who was found in a back yard in January looking for food. When we took him in to be neutered, he tested positive for Feline Leukemia, therefore cannot be released back outside with other cats. He needs a home without other cats or with other cats who are Feline Leukemia positive. He is very friendly: likes to be brushed, loves to play w/toys, sat in my lap while sewing at the machine. I pick him up all the time. He had his Rabies Vaccine and Distemper Vaccine. He doesn’t seem to trust the foster dog that is downstairs w/ him so wants to atttack the dog (they are separated by a doggie gate and Tanner gets to come out when the foster dog is out for a walk. TILLMAN is an extremely gentle laid back 5 year old kitty who had a very tough life prior to being rescued. He is an extremely handsome short-hair grey tiger w/ a white chest and feet. His green eyes will melt your heart when he rolls over to give you his belly to be rubbed and rubbed. Tillman was found living outside in the winter in the inner-city. He was scrounging for food trying to stay warm and alive. When he was rescued it was initially thought he had lost his one ear due to frost bite. However the vet feels he was born with only a partial ear. His hearing is just fine! Tillman enjoys other kitties and hangs out with the five other cats in his foster home. He is shy at first but quickly adjusts because he loves to cuddle and be out with the family. Tillman is a HUGE lover. He will want to sleep with you at night snuggling right up next to you or on top of you. He will wait for you in the morning along with the other kitties for his “wet food snack”and greet you when you come home. He loves to hang out and will look to you for words of encouragement. Although he has no interest in going back outside he enjoys watching the birds and squirrels from the windows. The best home for Tillman might be a quieter home where he can continue to feel safe and blossom. In return Tillman will reward you with lots of gentle snuggles. Ivy is a very tiny energetic playful female looking for her forever home. She weighs in at seven pounds and is just now one year old. She enjoys people and will meet you at the door when you come home. Ivy is social and will be wherever you are in the house. She enjoys other kitties in her foster home. Ivy was found literally starving in an abandoned garage in the inner-city while struggling to feed her five kittens. She was being a great mom at the detriment of her personal health. The neighbors would watch her and the kittens but no one stepped up to feed them. Ivy is our hero! Ivy is spayed, up-todate on her vaccines, and negative for FIV/ Felv.
