5209 Western Ave, Guilderland • (518) 356-1980 • www.townofguilderland.org Guilderland, NY - With this hot and somewhat wet summer coming to a close, I want to acknowledge Town employees who have worked diligently to maintain Guilderland’s lovely recreational facilities and open space, and kept all phases of Town operations flowing smoothly throughout the summer season. The abundant recent rainfall has helped reduce water demand for lawn and outdoor uses, but the lawn sprinkling regulations remain in effect until September 15th. The heavy rain brings large quantities of stormwater into the Watervliet Reservoir which requires prolonged processes at the filtration plant to clean the stormwater, reduces the plant’s output, and thereby leaves lower water levels in the Town’s water tanks. The water tanks require a minimum amount of water to create adequate water pressure in homes and fire hydrants. By next summer, the Town expects to add a new water connection with Rotterdam, which should help with maintaining adequate pressure. I am also pleased to report that the Town’s new advanced life support ambulance has exceeded the goals identified by Dr. Donald Doynow, Town Medical Director, in starting a Town ambulance service including a need for overnight coverage in the Carman Road area and a reduced reliance upon ambulance companies coming from nearby jurisdictions. In the first five weeks of its deployment, the Town ambulance received 175 requests for service in the Town, of which 119 calls required transport to a hospital, and 79 calls required advanced life support including cardiac, advanced respiratory support, monitoring of hospital EKG transmissions, administration of pain management, and IV therapy. In August, there was no need for mutual aid assistance from neighboring communities, in contrast to ninety (90) mutual aid calls in 2018 before the Town ambulance was placed in service.

I joined Animal Control Officers Bob Meyers and Kathy Foley who care for lost and abandoned dogs in a clean, modern, and humane facility. Both officers tirelessly work to reunite lost pets with their families and, when necessary, find loving families for orphaned animals. If you are interested in animal adoption, like “Elsie,” a year old mixed Pug (see photo), please check Animal Control’s page on the Town website or call the shelter at (518) 861-6855. I joined ACO Meyers as he responded to calls for assistance, including his rescue of new born ducklings from a drain in a backyard pool with a protective mother duck closely monitoring. I learned that while ACO Meyers and ACO Foley are well-trained and provide the best care for animals in their charge, they are not wildlife officers. Ducks, foxes, bobcats, coyotes, fishers and other wildlife are under the jurisdiction of NYS Department of Conservation. Animal Control helps monitor unusual activity by these animals and informs NYS DEC. As a result, ACO Meyers could reunite the ducklings with their mother but could not transport the duck family to another location. Instead, the ducks would soon exit the fenced yard and find their own way to natural habitat. I thank ACO Meyers and ACO Foley for their loving care of animals at the shelter and their dedicated and professional service to the community.

Most importantly, the average response time between call and arrival at the scene has been reduced in half from 12.7 minutes to 6.2 minutes in the Carman Road area. I thank the Town’s paramedics and new emergency medical technicians for their indispensable role in providing superior emergency medical care to Town residents and visitors. I also thank Western Turnpike Rescue Squad and Altamont Rescue Squad for their support of the new Town ambulance, including providing backup for the Town ambulance and allowing its housing at their facilities, and their collective role in improving response times.
By now, if you own real property in the Town, you should have received the Town Assessor’s Property Description Report which provides details about your property. I thank residents who have signed and returned the completed report. So far, the response has exceeded expectations, and I thank residents for helping the Assessor with this important task. If you have not responded, please do so by September 10th. In addition to returning the report by mail to the Assessor’s Office at Town Hall, you can email it to assessors@togny.org . If you have misplaced or lost the report, please call the Assessor’s Office at (518) 356-1980 to request another property summary.

Please review the list of acceptable hazardous waste at the Transfer Station’s webpage. Also, on Saturday, October 6th from 9am to Noon, the Town is holding a Document Shredding Day at the Transfer Station, across the street from the Highway Department Garage. Residents can bring up to four boxes of documents and records without charge. Residents can pick-up passes for both of these events at Town Clerk’s Office or Transfer Station.

THE NOTEBOOK by Margaret C. Tabak, Esq.

If you picked #3, you are correct. A well-kept notebook, in my line of work, often avoids the use of your hanky. Parents who are apart often have to share expenses. Some of these are statutory, health insurance, medical expenses, and child care1, while others may be agreed upon, such as extracurricular activities. While it may seem simple to share the cost of routine expenses, people often get into disagreements as to how much is owed, or simple don’t pay their share. This often leads families back to court where they may spend more money in legal fees than they would have had they simply billed/or paid the expense. Here are some suggestions as to how to avoid these problems: 1. Have a clear agreement. Your final agreement or Order should be specific as to what each parent is obligated to pay for and what his/her share of that expense is. If you are paying for optical- are you agreeing to pay for contact lenses? If you are paying school expenses, does that include field trips or just pencils? If you are “sharing” is that 50/50 or some other amount? 2. Have a clear reimbursement scheme- If your agreement says that the parent who has incurred an expense will be reimbursed, what does that mean? What is the time frame? Language such as “the parent who has incurred the expense will provide proof to the other parent (i.e., receipt, cancelled check) within 2 weeks of incurring the expense and will be reimbursed within 2 weeks of providing proof ” means that within 1 month that expense should be billed and reimbursed. 3. Keep Track! - This brings me to “The Notebook”. While there are many online programs for separated families that help track expenses and reimbursement, if you are not using one of them I cannot stress how helpful a simple 25¢ notebook be. As you make any payment, jot it down. For example: 9-4-18 $100 support paid by income deduction. When you incur an expense, have a chart: Date incurred/ Date sent/ what expense was for/ how much/ when was it reimbursed. If the other parent does not reimburse you, then you have a list of blanks and can easily make the calculations and prove what is owed to a court. Many of my clients like to use spreadsheets, such as excel. The problem is that spreadsheets can easily be manipulated. While creating a spreadsheet from your notebook may be helpful, nothing works as well, or is as easily persuasive, as walking into court with your pile full of notebooks with records that are accurate and easy to read. Don’t be “too busy.” A minute here and there keeping track of expenses and paying your share can save you a great deal of time, money, and aggravation in the long run. 1

Section 529 college SavingS PlanS by

Guilderland, NY - Those interested in saving money towards future higher education expenses are faced with several different options. Among these options is a Section 529 College Savings Plan, which has emerged over the past 20 years as a popular college savings vehicle. Section 529 plans are administered by the state in which the plan is offered. The various plans which are available are similar in the following regards: 1.
A plan is established by an account owner (typically the person who funds the account), with a designated student beneficiary. The owner and beneficiary can be the same person.
2.
Contributions can be allocated among a number of different investment options offered within the plan.
3.
The account balance grows tax-deferred over time.
4.
If used to pay for qualified higher education expenses for the account beneficiary, withdrawals are made on a federal and state tax-free basis.
5.
The owner may change the account beneficiary, provided the new beneficiary meets certain relationship rules compared to the former beneficiary (i.e. sibling, child, etc.).
6.
If the owner and beneficiary are different, the owner may accelerate up to five years of the annual gift tax exemption (currently $15,000 for 2018) into a single year. Thus, a single owner could open a 529 savings plan with a named beneficiary and immediately contribute up to $75,000 to the plan without incurring gift tax consequences (please consult your tax advisor for additional information).
Beyond the above, various states have additional potential benefits. For example, a New York State resident who owns and contributes to a NY Section 529 Savings Plan is eligible for a state income tax deduction of up to $5,000 ($10,000 if married filing jointly) for contributions made during a given year. New York State offers two Section 529 Savings Plans – the Direct Plan, and the Advisor-Guided Plan. The Direct Plan contains investments managed by The Vanguard Group and holds approximately $21.6 billion of assets, while the Advisor plan offers investments from JP Morgan Funds and holds approximately $5.3 billion of assets. The Direct Plan has total administrative and investment costs of 0.16% per year. The Advisor Plan has total administrative and investment costs which range from 0.40% to 2.11%. Additionally, Advisor-Guided Plan contributions may be subject to front-end or back-end sales charges. While the Direct Plan does not require an advisor relationship to establish an account, investors may still wish to consult a Registered Investment Adviser who can provide guidance on the account-opening process and investment selections. Additionally, would-be 529 plan investors should be aware of the potential impact on financial aid to the beneficiary.

Do only what my insurance covers! Scenario #1: A 10 year old girl complains of frequent headaches and when it begins to interfere with attendance at school, her parents take her to the doctor. After accessing the child, the doctor states he needs an x-ray for a more decisive diagnosis. The parents agree. The doctor finds a tumor and reports that luckily it is early and very small and feels with immediate treatment, there will be a positive outcome although unsure if his treatment will be covered by insurance. The parents tell the doctor to do whatever is needed. Scenario #2: A 10 year old girl complains of frequent jaw pain and when it begins to interfere with attendance at school, her parents take her to the dentist. After accessing the child, the dentist states he needs an x-ray for a more decisive diagnosis. The parents disagree stating that x-rays are not covered under their dental plan. The dentist is concerned for the child and so takes an x-ray at no charge and finds decay, but luckily it is small and feels if treated immediately, there will be a positive outcome. The parents feel that since it is small, they can put this off for a few months as they have vacation plans and can’t afford this right now as their current dental insurance will not cover the procedure. While on vacation, the child wakes up in pain, this time with a swollen jaw. They take her to the emergency room and find the tooth is abscessed and she needs to be put on an antibiotic. Another x-ray is taken only to find that the decay spread and the root is now involved and the child now needs a root canal or she will lose the tooth. It is a mistake to let benefits be your sole consideration when you make decisions about dental treatment. People who have lost their teeth often say that they would pay any amount of money to get them back. Your smiles, facial attractiveness, ability to chew and enjoy food, total body wellness and general sense of well-being are dependent upon your teeth. Understanding your dental benefits is not easy. There are many different plans as there are contracts. Your employer has selected your plan and is ultimately responsible for how your contract is designed. It is important to know that each contract will specify what types of procedures are considered for benefits. Even if a procedure is medically or dentally necessary, it may be excluded from your contract. This does not mean that you do not need the procedure. It simply means that your plan will not consider the procedure for payment. Here are answers to a few common questions regarding dental insurance:
But my plan says that my exams and other procedures are covered at 100%! That 100% is usually what the insurance carrier allows as payment toward a procedure, not what your dentist or any other dentist in your area may actually charge. The allowed payments are sometimes referred to as UCR or “usual, customary, and reasonable” charges. However, UCR more typically represents a list of payment amounts negotiated between your employer and the insurance company. An employer usually selects a plan with a list of payments that corresponds to its desired premium cost per month. Therefore, there usually will be a portion not covered by your benefit plan. I received an “Explanation of Benefits” from my insurance carrier that says my dental bill exceeded the “usual and customary”. Does this mean that my dentist is charging more than he/she should? Remember that what the insurance carriers call “usual and customary” is really just what your employer and the insurance company have negotiated as the amount that will be “allowed” as payment toward your treatment. It is usually always less or even much less than what any dentist in your area might actually charge for a dental procedure. It does not mean that your dentist is charging too much. If I always have to pay out-of-pocket, what good is my insurance? Even a benefit that does not cover a large portion of the cost of what you need pays something. Any amount that reduces your out-of-pocket expense helps. Why is there an annual maximum on what my plan will pay? Maximums limit what a carrier has to cover each year. Dental plans are different from medical plans, in that dentistry is needed frequently. Medical emergencies are rare. It is your dentist’s responsibility to recommend what you need. It is the insurance carrier’s job to control payments. What should I do if my insurance doesn’t pay for treatment I think should be covered? Dentists do not have the power to make your plan pay. If your insurance doesn’t pay, you are responsible for the total cost of treatment. Sometimes a plan will pay if patients send in claims for themselves, or if the Employee Benefits Coordinator where patients work steps in. Each chef will make a bulk dish for all attendees to sample and rate. 2. The top 4 chefs will participate in a cook off, “CHOP STYLE” with only ingredients from the market. Guilderland Basketball Club for Girls Celebrates 30 Years! Guilderland, NY - Thirty years ago a small group of Guilderland parents were looking for a place where their daughters could play organized basketball. While there were CYO teams affiliated with local churches, they were limited as to how many non parish players they could take. It turns out, other communities were facing the same issue. As girls basketball was becoming more and more popular, the need for a league in the Capital District became evident. Hence, the Guilderland Basketball Club for Girls became a founding member of the Capital District Girls Basketball League. Today, GBC Girls has grown from 4 teams, to several teams from 3rd grade to 8th grade. We provide AAU opportunities, Summer skills camp, fall open gyms, and skill programs in the winter for 1st and 2nd graders.
Thru it all we have stayed true to ideals of the original members, stressing sportsmanship, developing skills and most of all learning how much fun basketball can be! The Capital District League has also grown from the few original members to 16 clubs across the region, offering girls in this area the finest in travel basketball competition. Many graduates of GBC have gone on to play at the high school and college levels. Some are making comparisons to the market we experienced 10 years ago and are starting to believe that we may be doomed to repeat ourselves. Others are just plain wrong when it comes to what it takes to qualify for a mortgage.
Today, we want to try and clear the air by shedding some light on what’s causing some of these headlines, as well as what’s truly going on. Myth #1: We Are Headed for Another Housing Bubble Home prices have appreciated year-over-year for the last 76 straight months. Many areas of the country are at or near their peak prices achieved before the last housing bubble burst. This has many worried that we are headed towards another housing bubble. Reality: The biggest challenge facing today’s real estate market is a lack of homes for sale! Demand is strong, as many renters have come off the fence and are searching for their dream homes. Historically, a normal market requires a 6-month supply of inventory in order for prices to rise with the rate of inflation. According to the National Association of Realtors (NAR) there is currently a 4.3-month supply of inventory. The US housing market hasn’t had 6-months inventory since August 2012! The concept of supply and demand is what is driving home prices up! Myth #2: The Rumored Recession Will Lead to Another Housing Market Crash Economists and analysts know that the country has experienced economic growth for almost a decade. When this happens, they also know that a recession can’t be too far off. But what is a recession? Merriam-Webster defines a recession as “a period of temporary economic decline during which trade and industrial activity are reduced, generally identified by a fall in GDP in two consecutive quarters.” Reality: Recession DOES NOT equal housing crisis. Many people associate these two terms with one another because the last time we had a recession it was caused by a housing crisis. According to the Federal Reserve,
over the last 40 years, there have been six recessions. In each of the previous five recessions, home values appreciated. Myth #3: There is an Affordability Crisis Looming Rising home prices have many concerned that the average family will no longer be able to afford the most precious piece of the American Dream – their own home. There are many different affordability indexes supported by different organizations that all measure different data. For this reason, there is a lot of confusion about what “affordable” actually means. The monthly cost of a home is determined by the home’s price and the interest rate on the mortgage used to purchase it. According to Freddie Mac, interest rates have risen from 3.95% in January to 4.59% just last week. Reality: As we mentioned earlier, home prices have appreciated year-over-year for the last 76 months, largely driven by high demand and low supply. According to a recent study by Zillow, the percentage of median income necessary to buy a home in today’s market (17.1%) is well below the mark reached in 1985 – 2000 (21%), as well as the mark reached in 2006 (25.4)! Interest rates would have to increase to 6% before buying a home would be less affordable than historical norms. The starter-home market has appreciated at higher levels (9.4% year-over-year) than any other market. One reason for this is the fact that many of the first-time buyers who have flocked to the starter-home market are being met with high competition. For some hopeful buyers, it may take more than a good offer to stand out from the crowd! Bottom Line There is a lot of confusion in today’s real estate market. If your future plans include buying or selling, make sure you have a trusted advisor and market expert by your side to help guide you to the best decision for you and your family.
