ell, I don’t really think that too many people out there will have the opinion that there hasn’t been enough winter this year! I checked some seasonal averages before I sat down to write this, and found that we have been a bit above average for snowfall so far this season, but well below average in terms of temperature. Here’s hoping that the latter part of winter is a little milder for the sake of everyone, including, our animals, throughout the Town.

The Town will be going forward with plans to construct sidewalks along Route 146 in the hamlet of Guilderland Center in 2014. This project is being principally funded with a grant awarded to the Town under the NY State Transportation Improvement Program. YEAR-END TAX STRATEGIES

T

his is the time of year when many of us are busy preparing and gathering the information necessary for the completion of our 2013 income tax returns. Below are several items that you should be aware of as it relates to this process. By the second week of February, you should have received your forms W-2 (employment wages) and any 1099R (retirement income), 1099-INT, or 1099-MISC (other income) statements for 2012, as well as your VRFLDO VHFXULW\ EHQHÀWV VWDWHPHQW LI DSSOLFDEOH <RX should also begin receiving forms 1099-DIV and 1099B for any directly-owned investments such as mutual funds. ,I \RX RZQ D EURNHUDJH DFFRXQW \RX ZLOO OLNHO\ ÀQG that you will not receive your consolidated brokerage tax statement until the beginning of March at the latest. To reduce the possibility of having to send amended tax statements due to late or corrected reporting by various investment companies, many brokerage ÀUPV KDYH RSWHG WR GHOD\ PDLOLQJ WKHVH FRQVROLGDWHG statements. Other considerations may include real estate taxes paid, mortgage interest, medical expenses, investment advisory fees, forms K-1, estimated income tax payments, charitable donations (whether by check or in-kind), etc. The 2013 individual income tax landscape is very similar to 2012. There were minor increases to personal exemptions, standard deductions, and taxbracket thresholds. Higher income taxpayers will notice the return of the 39.6% federal marginal tax bracket (which kicks in at $400,000/$450,000 of taxable income for individual/married taxpayers). Also single/married households with more than $200,000/$250,000 of adjusted gross income may be

faced with an additional 3.8% tax on any investment income as a new Medicare Surtax which went into effect in 2013. We encourage you to consult your tax preparer to determine if you are eligible to make a 2013 contribution to a Traditional IRA or a Roth IRA. The maximum contribution limit to either type of account for 2013 is $5,500 ($6,500 if you had turned 50 by 12/31/2013). 2013 contributions to individual retirement accounts should be made no later than April 15, 2014. Whether you elect to self-prepare your income tax returns or hire a professional, we suggest you make all efforts to determine that you are taking advantage of any available opportunities for tax savings or tax deferral. In particular, retirement account FRQWULEXWLRQV PD\ VHUYH WKH GXDO EHQHĂ€W RI KHOSLQJ WR reduce income taxes now while providing additional income during retirement.

“Oshins of Smiles” Coming Back in 2014 I’d like to take this opportunity to thank all of my patients for their support during this period after the fire at my office. We continue to provide dental services in an alternate office and can be reached at 356-5635. We look forward to rebuilding in 2014 and serving you in our new office. February is DENTAL HEALTH MONTH as well as the month that brings us Valentine’s Day. We may think of “sealing” the special day with flowers, chocolates, or a kiss but we can also give ourselves a gift of dental health by “sealing” our teeth. Dental sealants act as a barrier to prevent cavities. Sealants are painted directly on to the tooth enamel protecting the chewing area where even thorough bushing may miss such as the back teeth (premolars and molars).

P!

Sealants bond to the tooth’s grooves and depressions protecting them from plaque and acids. During your regular dental visit your dentist will check on the condition of the sealant and reapply when necessary. Sealants are strong protectors of the chewing surface of your teeth and may last, under normal chewing conditions, several years before reapplication is necessary.

ry

ers, of

The possibility of tooth decay begins early in life. Protect your children, teenagers, as well as yourself from tooth decay. We can all benefit from sealants at any age.

H

opefully you have taken advantage of the New Year to make a positive change. We are in the middle of a very cold winter and my youngest son, Mete, has heightened his interest in fishing to include ice fishing. Some of the greatest memories I have of growing up are from ice fishing with my uncle in Westchester. I took the opportunity to capitalize off of Mete’s interest to create some new memories. Just this winter we have already caught four different types of fish, met some very interesting people with tremendously excellent character, participated in a fishing tournament, seen a muskrat poke up to say hello in our ice fishing hole, observed countless birds, had days without a nibble and persevered through challenging weather. Like in every other experience I have related to you, ice fishing is chock full of life lessons. The first is that the phrase chock full comes from the Turkish word çok (“choke”) which means a lot. The rest of the lessons are of character, like in martial arts, like in football and countless other sports and situations. Perseverance, patience, self control, indomitable spirit and respect are just a start. You must persevere through cold weather that can sometimes be literally brutal, patiently wait, control your reactions to set back always keeping good spirits and maintain respect for the nature that surrounds us through appreciation and following fishing rules and etiquette. The ability to do all of this is enhanced when the rest of the family shows up with hot drinks and a steaming pot of chili.

I have found that it is not about the fishing, it never has been. There will be fish, or there will not, but the conversation and camaraderie that comes from the journey is what matters the most. My best memories are not about fish caught, but what happened together with my uncle when the weather was horrendous and the fish weren’t biting. Fishing may not be your bag, but surely something is. You may not have kids, but you have relatives and friends. Find that something to share and do together and let the bonding and memories begin. For many of my students, Taekwondo is one of their things and the impact is indescribably. My family has bonded together at Taekwondo, but the latest addition is a fitness center membership that my wife shares with Mete. All the same lessons, all the same bonding and all of the togetherness we all crave. Make it happen, you will thank yourself.

In this article, I will discuss what mediation is, what it is not, and the positives and negatives of mediation in the context of a matrimonial or family law matter. What is mediation? Mediation is an alternative method to resolving disputes between two parties. The parties meet with a neutral third party known as a “mediator.” To call oneself a “mediator” in New York, one does not necessarily have to have any training in mediation (although many mediators do participate in some form of training). The role of the mediator is to help parties communicate effectively and work together to reach an agreement. While the parties control the terms of the agreement, the mediator can help prepare the written agreement that encompasses the terms agreed upon. The written agreement, if properly signed, is binding on both parties. What mediation is not: mediation is not litigation and it is designed to be non-adversarial. The mediator does not “represent” the interests of either party. Mediators do not give advice to, or advocate for, either party. Mediation can be beneficial for the right people. It can be less expensive and less time consuming. Mediation works best when both people are cooperative, can communicate effectively, and are willing to engage in open, honest, and fair negotiations. Mediation is not a “one size fits all” process because it is not appropriate in many situations. For example, mediation is never appropriate when there is a history of domestic violence between the parties. It is also not appropriate when there is a history of financial abuse by one party against the other, or when one party uses the “bully pulpit” to manipulate the other party.

A mediator does not have to be an attorney or have any specialized legal training (although there are some that do). This presents an interesting problem: if your mediator does not have the legal expertise to know what your legal rights are or the possible outcomes if you decided to litigate your case, then how do you know that the agreement you are entering into is fair and consistent with the law? If you had to have heart surgery, would you select a surgeon who has only read about the procedure from a book, or would you rather have a surgeon that has years of experience performing the surgery in the operating room? I know who I would select! The opposite of “mediation” is not always “litigation.” An experienced matrimonial and family law attorney can help you achieve an amicable agreement if that is your goal. So you should consult with that attorney before deciding that mediation is the best option for your situation. If you do not consult with an attorney first, then minimally you should consult with an attorney before you sign any agreement prepared through mediation. If you do not, then you will be stuck with the bargain that you struck, even if it was a bad one! Leyla A. FEATURED Q & A with Russell Stouffer, RTS Construction, Inc. Q. What year did your business start? A. We opened our doors for business in 2001. Q. Where are you located? A. Our home office is located in Altamont and we have customers in the entire greater capital district. Q. What is your phone number and website address? A. Our main business number is 518-813-8411. Be sure to check out our website, www.rtsconstruction.com for more information about our company, photos of some of our projects and references.

BEFORE

Q. How and why did you get into the business? A. I started the company by myself in Denver, Colorado in early 2000. I’ve been doing fine carpentry and building since I was a kid. My dad and several teachers taught me a lot in the beginning and then I spent many years teaching myself new and different things. Family brought us to Altamont in 2008 which is where my wife was raised. Q. Are you known for anything special? A. We don’t specialize in any one type of work. We focus on everything residential and enjoy the challenge of updating a home, a new addition or general remodeling project that fits with the character of the home.

Q. What do you love most about the business? A. I truly love working with people. Creating a new look, adding space or updating a space and then watching the customer’s reaction is a great feeling. Q. What do you think is your biggest challenge with the business? A. The biggest challenge I find today is keeping up with all the new and different material choices, gadgets and technology. Customers have big wish lists and we do everything we can to help educate the customer and ourselves to make their dreams come true. Q. How far ahead should I plan my project? A. Even the smallest projects require planning. A good rule of thumb is to start planning when you first begin thinking about a project. Keep pictures from magazines, write down websites, visit showrooms and prepare to be overwhelmed with all the choices. The good thing is that anything is possible. Q. What was your favorite project and why? A. I don’t think I have one favorite project. We really enjoy projects in general where we have to be really creative in our design/build, get to use new and different materials/products and can make a new space or remodel look as though it was always that way. Q. What do you want the community to know about you? A. We are a full service residential and light commercial construction company with the man power, experience and knowledge to make your next project or dream a reality. As a customer you can expect great customer service, collaboration, communication, design help and an all around positive experience. FEBRUARY RECOMMENDATIONS AT THE GUILDERLAND PUBLIC LIBRARY By Natalie McDonough

2228 Western Ave, Guilderland • (518) 456-2400 • www.guilpl.org

As we stay indoors, reading or listening to books, we seem to have more time to sink our teeth into a good long book. The library has some great recent titles that, despite their length, we don’t want to end. The Goldfinch by Donna Tartt (771 pages) Tartt’s new book has been long-awaited, coming out almost 12 years after the release of her last novel, The Little Friend. A review from the New York Times notes that “The Goldfinch is a rarity that comes along perhaps half a dozen times per decade, a smartly written literary novel that connects with the heart as well as the mind....Donna Tartt has delivered an extraordinary work of fiction.”--Stephen King.

Little Failure by Gary Shteyngart (349 pages) From the author of Super Sad True Love Story: A Novel, this darkly humorous memoir chronicles Shteyngart’s family after a move from Leningrad to Queens in the late 1970’s. The title of the book comes from an English translation of the nickname that his mother gave him. Expecting to fail at everything he did, he survived adolescence, college and life in New York City, before achieving great success with his third novel.

Doctor Sleep by Stephen King (531 pages) And speaking of Stephen King, A after his recent “Alternate History” novel 11/22/63, King returns to his roots with a follow-up novel to his terrifying and incredibly popular, The Shining, focusing on the young boy, now adult Dan Torrance. It’s classic King, and has been heavily requested at the library. There had been talk several years ago that King might stop writing novels, but fans are thrilled to see a new novel, especially one that revisits an earlier work. Saints of the Shadow Bible by Ian Rankin (389 pages) While fans may have thought that they had seen the last of Inspector John Rebus with Rankin’s last book, Standing in Another Man’s Grave, he returns to the Edinburgh police force in this 20th book in the series. These mysteries are rough, with a main character who goes beyond the stereotype of a “seen it all” cop and is often compared to Michael Connelly’s Harry Bosch and the gritty characters of novelist and “The Wire” writer, George Pelecanos. If you haven’t read Rankin, get ready to seek out his earlier books, many of which have been fairly recently published in the United States.

David and Goliath by Malcolm Gladwell (305 pages, also available as an audiobook and read by the author) Gladwell’s books give a fascinating look at the world we live in and are wonderful to listen to, as he provides an insight into his own books that another narrator couldn’t match. In his most recent work, he looks at underdogs and the role that they have played in history, starting with the famous battle of the giant and the boy with the slingshot. As always, Gladwell’s books make you think about what you think you know about people and events in the past, and offers a new perspective on topics that we believe we have already figured out.

MORE THAN JUST A “CRACK” By: Dr. Kim Leis-Keeling

H

ave you ever wondered what it is like to go to a chiropractor? Most people have the perception that you lay on a table to get “cracked”. Well, the experience at our office is much different. I know that there are lots of chiropractors and lots of different techniques so I wanted to share a little bit about our approach to chiropractic care. Chiropractic Adjustment Techniques- We use a variety of methods to re-align joints or to improve flexibility with a join that has restricted motion. The typical chiropractic manual adjustment means that we are physically moving the joint and the joint will often give a “cracking” sound. The “crack” is just a release of gas within the joint but by moving the joint to get the release, will help increase the range of motion of the joint. We also use hand held adjusting tools called an Activator and an Arthrostim. These are gentle techniques that do not produce any sound in the joint, but help to restore motion. Another technique that we utilize for lumbar discs and low back pain is a traction table. This works great to decompress the spine and ease low back pain. All of the techniques are modified individually based on the patient’s condition, age and comfort level. Myofascial Release- I feel that an adjustment will only go so far unless you address the connective tissues around the joints. The connective tissues include muscles and the fascia that surrounds them. Everyone knows what muscles are but not many people are familiar with what fascia is. Fascia is a very thin layer of tissue that surrounds each individual muscle and also creates a layer between the skin and the muscles. It allows your skin to glide on the muscles below. When the fascia gets “sticky” it can limit muscle contraction, limit movement and be painful. Try to imagine your entire body with shrink wrap around it, this would limit muscle contraction, movement and be painful. If you find yourself saying that you keep stretching but still feel tight, then you most likely have fascial adhesions. If you or your kids are always self-adjusting “cracking” your own neck or back, then you probably have fascial adhesions. You are trying to free up that uncomfortable range of motion and the quick “crack” gives temporary relief but what you need is to have the fascia released. The techniques used to release the myofascial system are similar to hands on massage but without lotion. We also teach patients techniques to get similar relief at home.

Instrument Assisted Soft Tissue Techniques – This is a technique that can be used in myofascial release to increase range of motion. It can also be used to treat tendonosis conditions. Tendonosis is a result of chronic tendonitis. Tendonitis is an acute condition that when treated correctly should heal with 10 weeks. If it persists, there is actual physiologic tissue change within the tendon cells in which they begin to degenerate and harden. So you have had tendonitis for years, then you are not fixing the cause of the

20

February 2014

OurTowneGUILDERLAND.com

problem and you do not have the proper diagnosis. The goal of Instrument Assisted Soft Tissue work is to restart the healing process by getting blood flow back into those tendons so they can heal. The instruments used are stainless steel or plastic tools. Therapeutic Exercise- Once we have addressed the myofascial concerns, addressed any structural alignment needs, we always incorporate stabilizing exercises and home stretching. I feel that it necessary to always start with core stabilation for most conditions and add in specific needs of the patients. ALCAT Food Sensitivity Testing- I love this test! This blood test takes the guess work out of what foods you are reacting to or sensitive to. This is not an allergy test. It is a food sensitivity test. The lab tests your blood cells inflammatory response to actual food particles. They can test up to 200 foods including fruits, vegetables, spices, meats, dairy, grains, etc. Patients are always surprised to find out the results because who would expect to have food sensitivity to a nutritious food? This can help with many conditions including headaches, chronic sinus problems, chronic inflammation, digestive concerns, pain, anxiety, arthritis, etc. Low Level Laser-Often referred to as cold laser, this modality is a light therapy that improves tissue repair, reduces inflammation and reduces pain when applied to the injury site. The treatment time is usually 2-10 minutes and is painless and heatless. Electrical Muscle Stimulation- This is used by many chiropractors and physical therapists. It is an electrical therapy that stimulates muscle contraction at a low level to enhance pain relief and muscle relaxation. This is just sample of some of the procedures that we use to help our patients every day. We also use various taping techniques, braces when needed, provide custom foot orthotics, running evaluations and more. If you or someone you know could benefit from the care we provide, we would be happy to have a free consultation with you. As always, if you have questions about this article, please feel free to contact me at the Sports & Spinal Wellness Center at 518869-3415. Are You Throwing Away Thousands of Dollars In PotenƟal Profits? Free Report Reveals 7 Costly Mistakes People Make When Selling Their Homes Guilderland, NY- John and Jody Smith tried selling their home through a marketing firm that caters to private sellers. After having it on the market for five months and spending over $1,200 for magazine ads and dozens of newspaper classified ads, they threw in the towel. “Once you’re involved, you realize how much you don’t know,” says Jody. “Exactly,” agreed John. “Our original intention was to sell the home ourselves in order to avoid paying a commission but, in all honesty, we bit off more than we could chew. There is much more to selling a home than we ever realized.”

Still, John and Jody had had enough and d following the instructions in the reportt they began interviewing a number of reall estate agents to represent their interests in n the market. Within thirty days of listingg with a professional Realtor, John and Jodyy sold their home at a very substantial profit. When asked if they had any sage advicee to offer anyone else preparing to sell theirr home, John answered, “Yes. It really doesn’tt matter what you end up doing, selling yourr property yourself or enlisting the servicess of a licensed Realtor, you would be doingg yourself a great favor if you were to requestt a copy of this free report. I cannot begin too even explain how valuable the information n was to us. It literally saved us thousandss of dollars and months of wasted time and d effort.”

About four and a half months after they actively began marketing their own home, one of Jody’s co-workers showed her an article offering a Free Report Revealing 7 Costly Mistakes People Make When Jody agreed, shaking her head and smiling. “That’s right. Requesting a copy of thatt Selling Their Homes. Realizing she and John were obviously free report was the one thing we did right. n doing something wrong, Jody immediately I recommend it to everybody that is even remotely thinking about selling their r called the number listed in the article and left her name and address, requesting a home.” copy of the report. The report arrived in the mail three days later and outlined mistakes they were making in their attempts to market their home. In addition, the report offered seven specific steps to take ensuring the sale of their home for the most money in the shortest amount of time.

message from SCRAPSTER, LLC OFFICIAL CAPITAL DISTRICT UPDATE: The Winter Blues are here! If you’re like me, you want the snow covered landscape during the holidays, but as soon as the presents are put away, you start glaring at the thermometer (or more probably checking weather.com) every ten minutes. We start wishing/praying for Spring to arrive, as in NOW. All it takes is one balmy 29 degree day and the next thing is you are mentally preparing for the grill and lawn furniture to be taken back out of the garage. But wait a second. Didn’t that kind of expensive, pseudo stainless steel grill epically fail during your Labor Day family barbeque? Oh, there it is in the corner of what used to be a two car garage but is now a 2 tons of junk storage facility. You recall the painful vision of Aunt Martha finally losing her ba le of the bulge through the fabric on that kind of expensive but now crumpled beyond recogni on pa o chair. How the heck did you accumulate 4 sets of snow res for cars you don’t even own any more? What exactly is in these boxes that say both “Kid’s College Stuff ” and “Class of 1984” on them? Maybe you were saving them for your grand kids? Yeah, that’s it. Now is the perfect Ɵme to beat the rush and start to “Reclaim Your Domain”! (I’m pre y proud of this last line even though it doesn’t rhyme exactly). Every me we finish a clean out I always hear the same things from customers: various expressions of new found happiness, big sighs of relief, quick bursts of dancing followed by unbridled joy, and of course the standard cry of “Why didn’t I call Scrapster last year?” “We Hear You and We’re Here For You!” (Di o on the proudness factor, I’m on a roll!!!). “Time To Turn Those Winter Blues Into Greener Hues!”. Yep, should have stopped while I was ahead. Scrapster is local family owned business which provides a NO COST scrap metal, appliance and electronics removal and recycling service. Our other services include LOW COST Junk Removal and Television Removal, and Clean Outs. We are insured, convenient, and reliable. We provide top Quality work every me you need us.
