While this standardized test seems to be the focus of the curriculum in our schools throughout much of the year, don’t despair! Teachers and counselors in our schools are busy engaging students in and out of the classroom. Western High students had an opportunity to check out a variety of colleges at the school’s College Fair, recently. A group of film students from Cooper City High School attended the National Television Convention and two of the students teamed up and took first place in the short documentary category. Read these wonderful stories in this issue and you’ll realize that our kids are learning a lot more than just FCAT workbook material. This issue we meet Debbie Zelman - a truly amazing woman on a mission to fund better treatment for stomach cancer in hopes that a cure will be found. Green Thumb Gardening Earth Day Celebration at Flamingo Road Nursery! By Jim Dezell, Flamingo Road Nursery

oin your friends and neighbors in a beautiful garden setting to celebrate Mother Earth. Throughout the weekend of April 24/25, Flamingo Road Nursery will be hosting free earth-friendly events and activities for the whole family. There will be one hour talks on a variety of garden topics, product demonstrations, plant giveaways, Southern-style barbeque and live music. The fun will start daily at 8 am and continue until 6 pm. The first 100 kids to arrive each day will be given a free butterfly host plant. Jodi, our in-house Butterfly Maven, will be leading discussions about the lifecycle of the butterfly and conduct tours of the Butterfly Pavilion at 9 am and 12 noon Sat/Sun. Kids will also enjoy complimentary pot painting throughout the day and face painting by Curly Sue. Organic gardening techniques and products will be presented at 10 am and 1 pm Sat/Sun. A leading supplier of organics, Lady Bug of Austin, Texas, will provide free samples of compost tea. Espoma, the oldest organic fertilizer producer in the U.S., will be giving away fertilizer samples. The environmental merits of a self-contained earth-friendly hydroponic growing system will also be demonstrated.

fter coordinating Fun in the Field, Matt Hoaglund, 16, is well on his way to becoming an Eagle Scout. The Feb. 27 event included a field day and family picnic for autistic children and their families. More than 100 kids had an opportunity to enjoy a fun filled day at Markham Park, with great food, games and awards. Matt has been involved with Scouting since he was in first grade. He is currently a Boy Scout with Troop 460 and chose this event as his Eagle Scout project. The Eagle Scout rank is the highest advancement in Scouting, with only five percent of all Boy Scouts achieving this honor. In order to become an Eagle Scout, Matt must fulfill requirements in the areas of leadership, service, and outdoor skills. He also has to plan, organize and lead an extensive service project that benefits his religious institution, school, or community. “Scouting has been an amazing adventure for me,” said Matt. “What better way to obtain my Eagle rank, but to give back to the community that consists of some of our most special citizens.” Matt is very familiar with the special needs of these children since his younger brother, Zachary, 15, was diagnosed with autism at the age of two. Matt has volunteered for the Autism Society of Broward County for many years by getting involved in sailing, surfing and other programs. He was recently elected an Honorary Board Member for his service to the community. “I have seen these kids accomplish so many tasks that no one ever expected of them,” said Matt. All of the activities for Fun in the Field were carefully selected so they would be appropriate for autistic children. They included sensory tables, basketball games, obstacle courses, bubble stations, box mazes, bounce houses and more. The City of Sunrise brought out a fire truck and rescue vehicle. There was also plenty of food, including grilled hamburgers, snow cones and pop corn. “For most, this would seem like the scene of a typical Saturday afternoon in South Florida,” said Matt. “But for these families of children with autism, this was a very special day. Kids with autism struggle with sensory issues that sometimes prevent them from enjoying much of what we take for granted. The sounds, smells and temperature can become too much for them to process.” Matt was able rally a tremendous amount of support around his project. Some of the volunteers that came out to help included Troop 460, as well as members of the Key Club and National Honor Society from Cooper City High School, where he is a junior. Others that participated through sponsorship or donations were the Unicorn Children’s Foundation, Behavior Analysis Inc, Miami Children’s Dan Marino Center, Andra’s Hand and the Autism Society of Florida. Donations and raffle items were provided by Sports Authority, Boar’s Head, Publix Supermarkets, Arnold’s Bread, Frito Lay, Kiwanis Club of Cooper City and the Dan Marino Foundation. Matt is hoping to make Fun in the Field an annual event. The proceeds will benefit the Autism Society of Broward, which provides a full range of family support, children’s programming, public outreach and autism awareness campaigns. It also has monthly support groups, parent education trainings with guest speakers, recreational programs including sailing, surfing and monthly sensory friendly movies. Seen on Scene Town of Davie Receives Outstanding Urban Forestry Program Award The Town of Davie Landscape Division recently won the “2009 Outstanding Urban Forestry Program” award given by the Florida Urban Forestry Council (FUFC). This category included all cities in Florida with a population over 20,000.The award was presented to the Town Council at a recent Davie Town Council Meeting. The Town was recognized for saving and relocating 336 trees from the I-595 construction project and planting them on Town property. FUFC further acknowledged the Town’s efforts in developing major street tree planting plans, obtaining hundreds of thousands of dollars in grants, working with a local elementary school, and completing several other projects. Davie Mayor Brings Special Guest to I-595 Express Groundbreaking Ceremony Mayor Judy Paul, Town Coucilmembers, and dignitaries helped Governor Charlie Christ break ground at the Florida Department of Transportation and I-595 Express Project. Shannon Norris from Silver Ridge Elementary was the mayor’s special guest. Shannon had won a contest at her school, and the prize was a day with the Davie mayor. Shannon spent the day shadowing Mayor Paul at Town Hall and learning about local government. Her day with the mayor culminated with the wonderful groundbreaking ceremony in Davie where Shannon received special treatment from the governor and helped him in the ceremony. Cooper City Salon Host Cut-A-Thon for Doctors without Borders Attitude Salon and Boutique in Cooper City held a Cut-A-Thon recently to benefit Doctors without Borders in its Haitian Relief effort. The event was a huge success and the salon raised $1,910 with 100% of the proceeds going to this great cause. Lisa Conlon Dodge owner of Attitude Salon and Boutique, decided to hold the Cut-A-Thon after a number of her stylists approached her about wanting to help the people of Haiti. Twenty stylists donated their services and day off to make the Haitian Relief Cut-a-Thon possible. school news Western High School Hosts College Fair By Debby Teich
Choosing a college or university can be a very difficult decision. Once students narrow down their choices, they often struggle with what is required for admission. Western High School recently took some of the mystery out of the process with its second annual College Fair, open to all Western underclassmen and parents as well as those from surrounding high schools. Western is one of seven high schools in Broward County that offer college fairs within a three day period in late February. Many of the top colleges and universities throughout the country participate in the National College Fair in Miami, organized through the National Association for College Admission Counseling. These Broward County high schools piggyback on this event to increase their chances of attracting a wide variety of colleges.

The list included most of the major Florida schools, such as UF, FSU, USF, UCF, Florida Gulf Coast, UNF, UWF, UM, FAMU, Stetson, University of Tampa, Jacksonville University, Broward College and Nova Southeastern University, as well as a variety of schools from across the country, like Boston University, Harvard, University of Chicago, Cornell, University of Alabama, Washington University at St. Louis, Purdue, Savannah College of Art & Design, the Art Institutes and more. Each one had a table set up offering parents and students an opportunity to talk informally with representatives and ask questions about admissions requirements, scholarships, campus life, necessary GPA’s and test scores, financial aid and anything else they wanted to know. Brook Simon was one of more than 300 people that attended the event. Although she is only in her freshman year of high school, she is already starting to think about college. She is interested in attending the University of Florida and went to the fair to get more information. “I know so many people who had good grades, but did not get in to the University of Florida,” said Brooke. “I want to make sure that I understand what I need to do so I have the best shot at getting in. I was able to speak to a school representative who gave me some good advice on what classes to take. I also discovered several small colleges at the fair that I might be interested in attending.” Lisa Solovay, Western’s BRACE College Advisor, who organized the event, visits every 9th, 10th, 11th and 12th grade English class to help guide the students and answer any questions. She encourages the students to start building their academic resume as early as possible. Many of her discussions focus on Florida schools, since a large percentage of the school’s 3,200 students end up there as a result of rising tuitions, Florida Pre Paid and Bright Futures. In response, Mrs. Solovay recently took 54 Western juniors on a Florida Public University tour, visiting 6 Florida universities over a 3-day period. “Students have to start thinking about college from the moment they enter high school,” said Solovay. “Colleges look at every grade they earn and course they take, beginning in 9th grade. All college-bound students should take the most challenging classes they can handle while getting involved in leadership and extracurricular activities to help set them apart from other students. I tell the students to focus on something they love to do and find ways to share it with other people.”

Q - The DOW is at 10,600 and is up 60% in the last year. I got out of the market about a year ago. Is this a good time to get back in? A - First of all, it is our fundamental opinion that an “investor” is not out of the market. We leave that to the gamblers/speculators. That being said, it is most important to have clearly understood investment objectives and a reasonable idea of your risk tolerance. We would find it difficult for most anyone to achieve their long term financial goals without some exposure to equities. When you make the decision to get “out” of the market you have to not only be right as to when to get out but also when to get back in. This is an impossible task to get right all the time. We do believe this is a good time to be an investor in equities but the 60% move in the market does suggest some modest caution in the near term. We would suggest a dollar cost averaging approach over the next 612 months with some downside triggers should we see any semblance of a selloff in the market. Q - Interest rates are very low. I am retired and need income producing investments. What are you recommending to your clients? A - This is probably one of the most difficult issues facing our retired clients today. First, we think it is most important not to stretch for yield. In other words, every investor should have criteria that doesn’t waiver just because income yields are low. Remember what you are doing when you buy a bond you are loaning some entity your hard earned money. Your credit standards should not be relaxed simply to get more income. We have the majority of client assets in very safe, high quality, tax-exempt municipal bonds where we see tremendous value (particularly if income tax rates increase as we expect). There are step-up FDIC insured CDs we have bought recently with attractive yields. We also recommend clients allocate some portion of their portfolios to Master Limited Partnerships (MLPs), high yield municipal bond funds and diversified equity portfolios with a dividend focus. These investments will provide better yields and an element of diversification to an income focused portfolio. You should consider annuities that provide guaranteed minimum income benefits. These types of annuities are excellent planning tools and can effectively turn defined contribution plans into your own personal pension plan with defined income benefits. Q - I am hearing a lot about the ROTH IRA conversion. Is this something I should consider? A - We believe everyone with a qualified plan should evaluate this opportunity but

it is not the right thing to do for everyone. This is, in our opinion, a very attractive strategy for investors that meet certain criteria but this should only be considered with the assistance of a knowledgeable financial professional. While we do not know your unique situation, there are some basic guidelines to help decide if this is something for you to consider. We feel strongly you should only consider this if you can pay the conversion taxes from a source outside the IRA. You should also expect your retirement tax bracket (including state and local taxes where applicable) to be higher than your current tax bracket for the conversion to have maximum benefit. There are many other advanced planning strategies for particularly wealthy individuals that would be difficult to address in this forum. We strongly encourage anyone with significant assets in a qualified plan (i.e. IRA, 401k, 403b, self-directed pension, Keough, etc.) to seek the advice of a financial professional with specific expertise in this area. Q - I lost a lot of money in the tech crash in 2000-2002. I still believe in technology companies but I am afraid to lose more money. A - We believe there are great companies in every sector including technology. Technology companies require significant capital to continue to innovate and secure their future market share. There are great opportunities in cash-rich, high growth technology companies today. Our focus is generally on large cap companies with defensible market positions and significant barriers to entry for competitors. The small and mid-cap technology companies offer tremendous upside potential but also more risk. We would encourage investors to utilize professional money managers (i.e. mutual funds, separate account managers) with expertise in this asset class or get adequate diversification through an exchange traded fund (ETF).

school news Sagemont Students Seek Invention Inspiration from Computers By Stacey Bomser
T
he Sagemont School takes great pride in its reputation for being technologically advanced. Technology is infused throughout the curriculum, with even the youngest students learning computer skills. At the Upper School, laptop computers are an integral part of the learning experience. Students in grades six through twelve use laptops daily, both in class and on campus, to connect to the school’s state-of-the-art wireless network. This promotes “anywhere, anytime learning.” Lower school students use computers for hands-on learning. But, they’re not just working on computers, they’re working with computers. Third through fifth grade students are dissecting computers and using the parts to create unique inventions, as part of a trimester theme on Inventions and Inventors. The inspiration for this hands-on lesson was a comical comment Media and Technology Specialist Doris Quintero overheard when she was a kindergarten teacher. “One of my students while practicing letter sounds using the computer, stopped working, knocked on the computer and asked, ‘who is in there?’ After that incident, I created a unit on machines and how they work.” In light of the invention theme, she decided to reprise the unit and concentrate on computers. Her goal is for students to gain an understanding of everyday inventions with respect to how they function, what makes up the machine and to appreciate the

wire cutters and screwdrivers, the students started by disassembling old computers. “I never knew such a small part could power so much, like a brain,” noted fifth grader Karl Ackermann after discovering the hard drive inside his computer. Upon removing the cover of a computer, third grade Alexandra Kreitenstein exclaimed, “It looks like a little town from up high.” She later learned the part she was referring to as a town was actually the motherboard. The students also disassembled other machines to find similarities in parts and create a mock invention of their own. In addition, after dissecting the computers, the students used functioning computers to research information on the history of computers, names of parts, who invented or patented the parts, and why certain elements are necessary for the computer to function. Armed with their newfound knowledge, the students will answer the big question: What would the world be like if the computer was not invented? A question that is sure to provoke some interesting answers, considering these children have grown up with computers. In 2000, the year many of them were born, over 60% of all American households owned a personal computer. Today, that number is close to 80%, with most homes having more than one computer.

A study of 1.2 million men born between 1950 and 1976 determined a link between cardiovascular fitness and intelligence. Researchers from the Institute of Medicine at The University Of Gothenburg, in Sweden analyzed the physical capacity, brain power and socioeconomic status of men when they reported for military duty at 18. The data which was published in an issue of Proceedings of the National Academy of Sciences suggests that men with greater cardiovascular fitness were more likely to be more intelligent and experienced greater success. Interestingly, there was no association between muscular fitness and their intelligence. f you are like most people, you look forward to a good night’s sleep. The following TRUE or FALSE statements may provide some food for thought while waiting for the REM zone...
TRUE or FALSE 1. Sleeping with two pillows under your head is better for you than sleeping with one. FALSE: Whether you sleep on your side or on your back, using two pillows under your head will force your spine into an abnormal position. In the short term this abnormal spinal position can cause muscle and ligament soreness, tightness and fatigue. Eventually, chronic spinal problems may result. Sleeping with one pillow is better, and a correctly contoured “cervical” pillow or small cervical roll is best. Contoured pillows or cervical rolls provide optimum support for your neck while sleeping, and help to maintain normal cervical lordosis (spinal curvature in the neck) and spinal alignment. 2. Sleeping on your stomach is one of the least healthy positions in which to sleep. TRUE: Lower back and neck pain are two of the more immediate and obvious signs that “stomach sleeping” is not good for you. For some people, sleeping on their stomach may not produce symptoms for months or years. Unfortunately, when symptoms do start poor sleeping habits are usually well established and spinal problems have become advanced. The preferred position in which to sleep

This will help maintain the back in neutral position, and minimize early morning low back stiffness. 3. The best position in which to read in bed is to lie on your back with your head propped up high. FALSE: Chiropractic doctors treat many patients with neck and upper back problems that are the direct result of poor postural habits. A common postural mistake involves the habit of lying on one’s back with the head propped up while reading or watching television. This position forces the head and neck into extreme sustained flexion, causing compression of the spinal discs, stretching of the spinal cord and cervical nerves that come out of the cervical spine, and abnormal tension on the posterior neck muscles. In small doses, such stresses are normal and easily accommodated by the body. The problems begin when these positions become habitual or a regular part of one’s routine. Repeated and long-term postural abuse will almost invariably cause chronic soft tissue damage, spinal distortions and accelerated spinal degenerative change. The best position in which to read while in bed is the same as when you are sleeping - lying on one side with the head and neck in a neutral position. Think posture... always! health & wellness My Secrets to Winning the War on Obesity; a National Pandemic By Gabriela Rosenthal
F
eeling tired, hungry, and cranky most of the time is no laughing matter. Many of us do not eat properly which could cause us to have many of these symptoms and more. Have you ever wondered where the saying “It isn’t over until the fat lady sings” came from. What does this mean? Does this mean that obese people sing better than people with a normal body mass index or fat percentage. It is thought to be a reference to opera, so many performances of which seem to end with a set-piece aria by a wellbuilt soprano, but its recent links are mainly with sport, so much so that some people think that is the origin. None the less recent studies have shown that having a BMI greater than 25 is not healthy and the quality of life goes down as your BMI goes up. Coming from a person who once weighed 260 pounds, the grass is definitely greener on the other side. I once wore a size 24 and now slip into a slender size 2. Although my singing voice was not better 130 pounds heavier, there are many more enjoyable things I can now do. Instead of not being able to walk to the park with my 4 kids and falling asleep at 3 in the afternoon we all now run to the park and play on the slides together. I even challenge them on the swing from time to time. We have a new improved relationship. Treating people with weight problems has always been a daunting challenge for physicians. The solution is not as simple as telling patients to consume less food and I am personally familiar with this scenario from both sides of the weight loss fence. To date, I have lost over 120 pounds participating in the weight loss program offered by the Center for Medical Weight Loss (CMWL). I believe so strongly in their philosophy and products that I incorporated my professional career into my weight loss endeavor. I serve as the Weight Loss Specialist at the Center for Medical Weight Loss on University Drive, in Pembroke Pines, Florida. In my opinion, obesity is a disease plaguing the majority of Americans and as such the symptoms need to be treated under the direction of physicians through an individually customized weight loss program. Gabriela Rosenthal (before) As Americans we are constantly bombarded through the media to be thin and the rising costs of healthcare are through the roof as a result of our nation being overweight. There are numerous rewards and benefits afforded to people who maintain a healthy lifestyle including emotional stability, becoming medication free and statistically less prone to life shortening diseases. Each day, I am approached by our patients asking me, “What should my normal weight be?” I tell them that normal weight needs to be gauged on an individual basis. On average, a person’s weight routinely fluctuates between 10 and 15 pounds. This does not mean the patient can not be considered healthy; on the contrary, I advise patients to avoid being consumed with these numbers and understand that this weight variation should be considered a safe zone allowing leeway for other things to develop such as self-esteem, empowerment and positive thinking. There is a fine line between normal weight and being categorized as overweight and once a patient’s weight loss maintenance has begun, I do not like to see them gain more than five pounds from their goal weight. According to Webster’s Dictionary, the definition of overweight is, “the property of excessive fatness”. The term obese is classified as, “excessively fat”, or a “weighty man”. In the world of medicine we categorize a patient’s weight by determining their body mass index (BMI). The BMI provides the physician a definitive number which is used to calculate the percentage of body fat a person possesses. For example, a person between 20-25 is considered within the normal weight range. An individual scoring within 25-30 is categorized as overweight and those scoring between 30-40 are considered obese. Individuals scoring greater than 40 are categorized as morbidly

obese and potentially 100 pounds overweight. Who is to say that a person within the normal range does not have 10-15 pounds more than the individual who’s BMI is closer to 20? From a health standpoint the physicians at CMWL feel that it makes more sense to define obesity in terms of fat percentage and not solely by measuring weight or BMI. A normal fat percentage can range anywhere from 20-30% for women and 18-25% for men. Our practice also has proprietary equipment that provides us with a full body composition analysis which can be used to determine a patient’s fat percentage, resting metabolic rate and daily caloric count. This means that all of us are afforded some room to grow. According to Dr. Cohn-Gelwasser, “there may not be many benefits associated with carrying a little extra weight; however, being too thin can be extremely dangerous.” For example, a BMI less than 20 is categorized too thin. Gelwasser analyzes every patient with a battery of tests to insure that there are no signs of anorexia, bulimia or malnutrition. or the millions of Americans who suffer from digestive diseases, new technologies are improving our ability to see the smallest details of the digestive tract. Capsule endoscopy, which has the patient swallowing a pill-sized camera, also allows the GI specialist to view the entire small bowel. Endoscopic ultrasound is now used to examine the lining and walls of the upper and lower gastrointestinal tract and nearby organs such as the pancreas, liver and gallbladder. Q: Are there new technologies aiding the diagnosis of digestive diseases? A: There are several advanced technologies that are innovating GI diagnosis, though they are not yet widely available. One technology, called the Spyglass™ Direct Visualization System, allows the physician to view all quadrants of a patient’s bile duct, improving gallbladder disease diagnosis. Meanwhile, the Bravo pH Receiver is a new minimally invasive tool for diagnosing gastroesophageal reflux by monitoring the patient’s pH level in the esophagus. lthough we South Floridians do not experience much of the seasonal changes; the traditional spring is now among us and people are going to start spending more time in their lawns. Unfortunately it is also the time when people are going to start using more toxic chemicals on their landscapes. However, we’re here to tell you now, that contrary to popular belief imposed upon us by millions of dollars of marketing from the chemical manufactures, it is NOT necessary to use these chemicals to enjoy a healthy, green, and weed free lawn. The key is not to focus on the problem that you can see. You must tackle to source of the problem, which in the majority of our cases, is a soil deficiency. If you have been using synthetic fertilizers or chemical pesticides, your lawn has been depleted of its nutrients and living organisms. Chemical fertilizers do not enrich the soil; they only feed the vegetation including the weeds. This is why you also have to buy specific herbicides with your fertilizer, most commonly known as “weed and feed.” By the time you finally get your lawn to meet your expectations of perfection, you have applied a cocktail of chemicals that has turned your landscape into the equivalent of addict that has become chemically dependent. Why Loan Modifications Simply Don’t Work By Omar J. Arcia, Esq., Foreclosure Defense and Bankruptcy Protection Attorney
T
here are various opinions on what caused the real estate crisis. Whichever side is to blame, one thing is becoming increasingly evident – traditional loan modifications do not work. In 2009, less than 5% of all loan modification applications were approved by lenders, and more than half (55%) of loans modified were 30 days or more late within six months, according to the Office of the Comptroller of the Currency (OCC). While lenders claim to be more willing to modify borrowers’ loans, many just aren’t offering deals that borrowers can afford over the long term. Lenders promote loan modification because it is the best alternative for the lender, not the homeowner. These are the principal reasons why loan modifications fail. 1. Modified loans often carry higher balances than the original loan. Since many lenders add unpaid amounts to the principal loan balance, after a loan modification, homeowners often end up with more mortgage debt than they originally incurred. A recent study found that an average of $10,800 was added to mortgages when they underwent a modification. 2. Modified loans often carry higher monthly payments. It should come as little surprise that with few lenders reducing principal — and most tacking on fees to the loan balance — nearly half of all loan modifications actually resulted in increasing a borrower’s monthly payment. When a loan modification doesn’t reduce the monthly payment, or reduce it enough, the chances are quite high that the homeowner will fall behind again on payments. 3. Despite modifications, many homeowners are still upside down. Most borrowers owe far more than their home is worth after the real estate collapse. Since most modifications result in an increased principal loan balance, the time consuming process of a modification simply converts most homeowners into “renters” of their own home with no possibility of realizing any equity in their lifetime. 4. Homeowners accept unaffordable terms, and waive important legal rights Desperate to save their homes, many homeowners will accept loan modification offers they can’t really afford. Just several months after signing a loan modification agreement, most homeowners are usually in a worse position than when they began the process. Nearly every loan modification agreement contains a waiver of rights in which the homeowner must release the lender from any liability for serious violations of state and/or federal laws. 5. Navigating the system is difficult. Homeowners could be tied up in the loan modification process for months, will complete several rounds of applications and financial statements, and will wait hours on the phone. Many homeowners seek help from so-called “loan-modification specialists,” claiming to be affiliated with attorneys. Rest assured, these are outright scams. They will take your money upfront and do nothing in return.
End the Modification Insanity, and Take a Proactive Approach
First, perform a detailed audit of your loan, which may reveal serious violations of Federal and State laws committed by your lender. Banks, lenders and servicing companies will only negotiate fairly and justly with homeowners if you can demonstrate that they have violated the law and may be exposed to a judgment for significant damages. Second, hire a qualified law firm with knowledge about the types of claims a consumer has, and who can expose and use this very real threat against banks, lenders and servicing companies. A qualified law firm will also be able to identify and present proven legal defenses to a foreclosure action. I
n may instances, depending upon the complexity of a case, expert witnesses maybe retained to assist in both the preparation and presentation of the evidence. These experts are not always necessary and are often not always affordable. Their involvement requires additional fees to be paid for their time and expertise. Prior to retaining such an expert I will always consult with my client to advise them of the necessity of such a witness and the anticipated costs. Sometimes it is just not affordable to the client. There are certain cases when an expert witness is absolutely necessary to prepare the case for both trial and settlement. It is impossible to structure a settlement if we are not aware of the actual values of certain assets. The actual value of the marital home or the family business are important factors which must be determined. Judges will not guess as to these values and web sites which estimate certain values are not dependable or even admissible in court. Here are some of the experts we often encounter in a dissolution case: ▸ Property appraiser to determine the true value of real property. ▸ Forensic Accountant to determine the assets, liabilities and income of the parties. ▸ Business valuator to determine the value of a business owned by the parties.
▸ Actuary or pension evaluator to determine the value of a pension ▸ Appraiser to determine value of personal property such as jewelry or collectibles ▸ Guardian Ad Litem to represent the interests of minor children ▸ Psychologist to evaluate emotional issues of the parties and or their minor children. ▸ Drug counselor to determine if in fact either party may have a drug dependency. As you can see this could be a rather exhaustive list. Each of the above individuals are either privately retained or appointed by the court. Sometimes each of the parties retains their own expert. Each of these experts may render a differing opinion which would result in the Judge determining which of the experts’ testimony he/she will depend on. The opinion of an expert is not to be taken as absolute fact and therefore their opinions are subject to attack, just as like any other witness in court. The hope is that with proper preparation and a credible expert witness, the chances of a fair settlement is more likely. Of course not all cases require the assistance of an expert. Often times the issues in dispute can be resolved without their knowledge and expertise. As I have often stated, no two cases are the same and as such they cannot be treated in a similar manner. ome people are reluctant to make a personal injury claim after an automobile accident because they are concerned that their insurance company will increase their rates or drop them as a policyholder. If you are the victim of an accident, which is not your fault, you should make a claim under your policy without fear that your carrier will enforce a surcharge. Insurance carriers should not surcharge your policy if you are not at fault for the accident. If you have faithfully paid your premium you should look for your carrier to live up to their part of the insurance policy. It is true that an insurer can surcharge your policy if you are at fault for an accident and they have to pay out on a liability claim. A surcharge is an additional charge added to the basic policy premium. Typically the surcharge will last for three years and then be eliminated at that time. Each insurance company’s underwriting requirements are different so you should check with your company to see how they apply surcharges. Some companies have underwriting guidelines which permit them to surcharge for an at fault accident if they have to pay out over a certain amount of money. Also, companies can non-renew your policy based upon their underwriting guidelines. However, you may be eligible for reimbursement of the surcharge if you meet any of the following requirements: 1. if you can show that you were reimbursed by or had a judgment against the person responsible for the accident,

2. if you can show that you were struck by a hit-and-run driver and the accident was reported to the police, 3. if you can show that a court ruled you were not at fault for the accident or adjudicated not to be liable, or 4. if you can provide a written statement to your insurer that you were not at fault and the insurer’s file does not provide information to overturn this statement. 5. In conclusion, if you take the time to purchase the proper insurance and pay those expensive premiums, you should not be afraid to use the coverage when you have a loss. aul Owers of the Sun Sentinel stated: The scale of the problem is daunting: More than half of all residential mortgage holders in Broward County are under water,’ California research firm, First American CoreLogic said last week. In Palm Beach County, nearly half of mortgage holders fall in that category.
What should a homeowner do?
Some are opting for the short sale. The homeowner alerts the bank that he qualifies as “a hardship” and needs to sell. As of April 1, 2010, the bank is to immediately send out an “evaluator” who will set the price as an approved short sale. This will hopefully move the process. However, banks are buried in the paperwork of their current inventory. If a homeowner is not qualified to sell his home as a short sale, his list price must be “compelling.” Competing with the approved short sales and foreclosures in his market affects his appraisal. The homebuyer’s tax credit is ending April 30, 2010. The federal government will no longer be buying back mortgages, and the private sector will be taking over . . . which usually means . . .interest rates will rise. Fewer buyers will be able to qualify resulting in an increase in inventory. An increase in inventory means a further reduction in sales prices. If the home does not sell, foreclosure may be the next step. Rental properties will be more in demand. A renter could be locked into a lease, and the owner/landlord may be in a hardship situation. The renter could be forced out. The tenant has a forty-five day window to vacate; however, this may not be enough time to relocate. The tenant may never recover his deposits (having been spent by the landlord) and what about those moving costs! New options are in the pipeline. ooper City High School seniors Angela Robledo and Nicole Payton are one step closer to achieving their dreams. Both girls are passionate about film and hope one day to use it to make a difference in the world. Last month, they were part of a group of CCHS students who traveled to Anaheim, California for the National Television Convention. Since both girls are equal rights activists, they decided to head to the LGBT Center (lesbian gay, bisexual, and transgender center) on Irvine’s University of California campus to tell the story of a Day in the Life of a gay marriage. On the way, they heard that there was protest over budget cuts so they quickly switched gears. They
caught up with a group of more than 500 students and began filming a Day in the Life of a Student Protester instead. “We were so excited because we knew we had stumbled upon the perfect documentary,” said Angela. “We interviewed as many protesters as possible and tried to capture the entire experience. We let their interviews tell the story.” They were one of the first teams to finish editing the four-minute documentary and even had two hours to spare. “It was such a thrill to win first place!” Both will study film after they graduate from high school. Angela will attend Florida State University to study documentary production. “I find solace in watching films,” said Angela. “I hope that one of my future films can do for someone else what current movies have done for me.” Nicole will go to New York University to study film. “I want to produce trailers,” said Nicole. Angela and Nicole are on the staff of the school’s Cowboy Television (CTV), which received the highly prestigious “Excellence Award” in Broadcasting Journalism for their weekly newscast at the conference. CTV keeps the student body and faculty informed of all of the activities and achievements of CCHS students. The 20-minute show is packed with interesting news and sports journalism, as well as sketch comedy. It is run by a diverse crew of carefully selected journalists, filmmakers, and actors. CCHS students took home several other awards. Jessica Alpern and Lauren Lopilato received 2nd place in “Tell The Story” competition and Maxine Shepard received 2nd place in “Broadcast News Writing.”

M
arissa Zoldan goes through life with the same passion, grace and agility she expressed as an Elite gymnast. Although no longer performing on the balance beam, Zoldan still performs a delicate balancing act every day. The hands-on mother of seven, plus one stepdaughter, volunteers at her children’s school, runs TAG USA Gymnastics with her husband Michael, and still finds time to devote to various charities. Zoldan feels fortunate to have been blessed with a beautiful family and successful business, but life was not always so picture-perfect. Three years ago, her life was turned What is your mission? To reach out to help as many people as possible. I want to help people’s lives and make a difference when someone faces a devastating diagnosis or financial hardship. Which causes do you support? Our family is dedicated to supporting organizations that work to find cures for women’s and children’s cancers and also charities that provide assistance to the needy and homeless in our community. Why are these causes important to you? I think everyone falls on hard times, either through health issues or job loss, especially in these times. We all have to do what we can to help and support each other. What motivated you to actually create the Foundation? Coming through the struggles I faced in my own life, I knew the right thing to do was to help others. Our family has the opportunity and motivation to help others in our communities.

Our City Weston had the opportunity to speak to her about the Marissa Zoldan TAG USA Gymnastics Charitable Foundation. What is your goal for the Foundation? We will partner with organizations such as Habitat for Humanity, HELP USA and the Leukemia & Lymphoma Society. Ideally, these organizations would use our funds to accomplish their projects. How does TAG USA Gymnastics fit into this? Through the growth of the gym we have a pulpit to communicate ways to help those in need. TAG USA has grown so much in the year that we have owned the gym. Our team successes have brought national recognition in athletics. We are considered the number one gym in South Florida. We are reaching more people than would otherwise be possible. Are your gymnastics students involved? Our students and their families have been extremely supportive. Members of our Team helped build a Habitat for Humanity house in Miami, even the youngest athletes helped with the construction and landscaping. We have also conducted food drives to benefit the WECARE Food Pantry, gifts for JAFCO, and scholarships for children. Why do you think it’s important for children to be involved in charitable work? Michael and I teach our children that charitable deeds are important. There are children in our community who go to bed hungry each night and single mothers fighting cancer and worrying about how they are going to care for their kids while going through treatment. I want my children to know that we all need to help in whatever way we can. We all need to do our part. Does the Foundation have any big projects planned? We are planning a major Broward community event for December 2010. The event will be open to the entire community and hope that with all our involvement, we make it a success. It’s Their Business Lice Cleanique Helps Families Stay Free of Head Lice By Debby Teich
A
s many as 12 million people get head lice every year, often creating a stressful experience for children and their families. South Florida Family Health & Research Centers/Lice Cleanique has been helping families stay head lice free for almost 15 years. The company was founded in 1996, by Lidia Serrano, Clinical Director. It was the first clinical research site exclusively for the study of head lice and has grown into one of the most respected head lice drug development services. It currently has three locations - Miami, Fort Lauderdale and Delray Beach - that are designed exclusively for the removal, treatment and clinical research of head lice. Each is staffed by board certified physicians, nurse practitioners, and clinical research personnel that are fully trained to identify and provide safe and effective removal of head lice. Head lice are tiny, wingless parasitic insects that live on people’s heads and feed on extremely small amounts of blood drawn from the scalp. Their bites may cause a scalp to become itchy and inflamed, and persistent scratching may lead to skin irritation and even infection. An adult, or louse, is about the size of a sesame seed and the eggs, or nits, are even smaller. Although a louse and egg are very small, they

can still be seen by the naked eye. Head lice are most common among children, ages 3 years to 12 years (girls more often than boys) and their families. Although they are spread easily from person to person, they are not considered dangerous. Close contact during school, summer camp, slumber parties and sports activities, as well as sharing personal belongings, such as hats or hairbrushes, puts people at risk. Personal hygiene has nothing to do with getting head lice. Lice Cleanique’s medical staff works closely with schools in Dade, Broward and Palm Beach to screen one classroom or an entire student body for head lice. The charge is only $1 per child, which is typically paid for by the school’s PTA. The clinic’s staff is highly trained in working with children and helps eliminate diagnostic confusion. During the screenings, the children that have lice are identified so the parents can be notified. The child with lice, as well as other family members, can treat it using lotions and shampoos that are available at the store without a prescription. Serrano cautions, however, that many of the products kill the insects, but not the eggs. The eggs must be killed or removed to prevent the lice from returning. Lice Cleanique’s staff is trained to remove the eggs manually with a nit comb so they are not passed to friends and siblings. They guarantee that children will be lice free for school admittance right after their first visit to the clinic.
