ime is flying by and winter is at our door. While we generally do not get the snowflakes or the frosty winter temperatures, we do get the holiday season. The upcoming holidays may have different meanings for many of our readers due to their diverse cultural backgrounds and religious beliefs, but for all of us it should be a time to reflect on the year gone by. It is a time to think about all the big issues which have occurred throughout the year of 2015, as well as the little issues that happened. It’s a season to gage our own conduct. Have we made enough time to spend with our children and spouses? Have we reached out to our neighbors to lend a helping hand to those in need? Have we spent the time to be truly together with our parents, our family and our friends? This is the time to mend minor disagreements, to forgive and forget. This is also the time to remember those less fortunate, to teach our children to share our good fortunes with our loved ones, as well as those in need. There are families right here in our communities who need our assistance. Help make the season brighter for them by giving generously. And consider giving your children gifts they will cherish for a lifetime; the gift of love and the gift of giving. The holidays are the perfect time to teach your children to be thankful for what they have and to help others. For that is truly what the holidays are about. 5th Annual Southwest Ranches Holiday Fun Horse Show Returns By Debby Teich

n December 12, young riders from throughout Southwest Broward will meet for the 5th Annual Southwest Ranches Holiday Fun Horse Show. It is an opportunity for riders, up to age 18, of all abilities to have fun at a free, non-qualifying show. It will be held at Sunshine Ranches Equestrian Park in Southwest Ranches. “Southwest Ranches is proud of our commitment to providing this great opportunity for riders of all levels to gain show experience in an empowering and caring environment,” said December Lauretano-Haines, Parks, Recreation and Open Space Coordinator for the Town of Southwest Ranches. “We are grateful for the support of our sponsors, whose generosity allows us to share this event with everyone at no cost. Each year we see our little show grow a bit. We hope for a great turnout of riders, as well as spectators.” Check in/registration is at 8am and classes begin at 9am. Davie Residents Trained to Respond in a Disaster by Debby Teich
H
urricanes, tornadoes, plane crashes and building collapses, as well as other natural disasters and large scale tragic events, are often reminders that we are all vulnerable. If Davie were to experience a true emergency, communication failures and road blockages might prevent people from accessing emergency services they have come to expect at a moment’s notice through 911. It could take hours or even days for public safety personnel to reach everyone in need. A group of Davie residents is trained to respond in an emergency to help themselves, as well as their friends, families and neighbors until the proper help arrives. They are members of Davie’s Community Emergency Response Team (CERT). CERT is a FEMA program that educates citizens about disaster preparedness for hazards that may impact their area and trains them in basic disaster response skills, such as fire safety, light search and rescue, team organization, and disaster medical operations. CERT members use the training learned in the classroom and during exercises to assist others in their neighborhood or workplace. They are able to provide basic care that will help limit further injury to disaster victims and lessen the possibility of further damage to property. CERT members

also are encouraged to take a more active role in emergency preparedness projects in the community. In order to qualify for Davie CERT, team members must be over 18 years old and live or work in the Town of Davie. Classes meet from 6pm to 8:30pm for eight weeks at the Davie Fire Administration Building, located at 6901 Orange Drive. The initial training consists of approximately 20 hours of free classes. When the residents graduate, they receive a backpack, which includes triage supplies like masks, gauze, splints, gloves, scissors and other items. Class size is limited and advanced registration is required. Harold Grimes recently moved to Davie from Kansas. Cooper City Moms and Sons Spend Quality Time Together Community News

ooper City moms and their sons recently gathered for the Mother Son Night of Fun at the Cooper City Community Center. Since 2002, this hometown event has been a way for moms and their sons, K – 5th grade, to enjoy a special evening together. Many of them return year after year. The theme for this year’s event was Race Rally. As the mothers and sons arrived at their tables, they had the opportunity to work on an activity sheet together that featured word searches, a maze, and dot-to-dot pictures geared around the movie “Cars” and NASCAR. Following dinner, the boys and their mothers rotated around to car racing games and activities that included: Start Your Engines (moms/sons competed against each other in the Nintendo Wii game MarioKart), Fan Belt Ring Toss (moms/sons took turns tossing fan belts onto oil cans trying to score a ringer), Drag Racers (moms/ sons competed head-to-head as they sent a toy race car down an incline track to cross the finish line first), Body Shop Bolts (sons guessed the number of nuts and bolts in a large jar) and more. In addition, a DJ led games and played music for dancing. “This event provides a great opportunity for mothers and sons to bond through a variety of fun activities and a bit of friendly competition,” said Annie Boyle, Recreation Program Specialist. “As children become older and want their independence, it is especially important to build special and lasting memories while they’re young.” The City of Cooper City has several other events throughout the year to promote positive family relationships, including Father-Son Adventure, Mother-Daughter Tea, Grandparent’s Day and Daddy Daughter Dinner Dance. CarFit Helps Mature Drivers Find Their Safest Fit By Debby Teich
O
lder drivers are often the safest drivers, because they are more likely to wear their seatbelts, and less likely to speed or drink and drive. Due to the greater fragility of their aging bodies, they are also more likely to be killed or seriously injured when a crash does occur. CarFit is a free interactive and educational program that offers older adults the opportunity to check how well their personal vehicles “fit” them in an effort to increase the driver’s safety, as well as the safety of others on the road. On December 10, from 10am to 1pm, drivers can have their cars checked by certified technicians at Fire Rescue Station #28, 10550 Stirling Road, in Cooper City. Created by the American Society on Aging and developed in collaboration with AAA, AARP and the American Occupational Therapy Association, the 20-minute checkup includes a review of 12 key areas of the driver’s fit to their car, such as adequate space from the steering wheel, proper seat belt use, and properly adjusted head restraints. Drivers will learn how to use and adjust their safety devices. The program also provides information and materials on community-specific resources that could enhance their safety as drivers, and/or increase their mobility in the community. It is not a driving test or mechanical inspection. Some of the areas that technicians cover include: ▸▸ Knowing how to properly adjust one’s mirrors can greatly minimize blind spots for drivers who may wish to change lanes. ▸▸ Good foot positioning on the gas and brake pedals is important. If the driver is reaching with his or her toes to press on the pedals, it can cause fatigue in one’s leg and slowed reaction times. ▸▸ Drivers run a risk of serious injury if they are sitting closer than 10 inches to the steering wheel.

Local Girl Scout Troop Earns Bronze Award community news

N
ine members of Girl Scout Troop #11139 recently earned their Bronze Award, which is the highest honor a Girl Scout Junior can achieve. As part of the requirements, the girls needed to complete at least 20 hours on a “Take Action” project within the community. They chose to focus their efforts on Camp Nocatee, a Girl Scout camp in Clewiston, which they typically visit twice a year. They installed locks on the bathroom, a map of the camp, and signs throughout the property.
“They wanted their privacy in the restroom, and wanted new scouts to be able to find their way easier around camp,” said troop leader Jennifer Goldfarb. They girls started planning their project during a camping trip one year ago. To raise money, they participated in a citywide garage sale, donated $100 from their cookie earnings and reached out to other Girl Scouts across the county to ask for donations. The next step was to take classes to learn how to use the tools that they would need to complete the job, such as drills, screwdrivers, shovels and post hole diggers. This was the first time that most of the girls had ever held a tool. In October, they visited the camp with their dads to finalize the project. They went from site to site to get the work done. By the end of the day, they had installed seven aluminum signs, a large wood sign with a map, and locks on 24 bathroom stalls. “They were very excited when they realized that they could actually do these things that they had never done before,” said Goldfarb. “They were patient and never complained about the heat, the walking or anything! The girls are already talking about the Silver project they want to complete for a nonprofit.” There are ten, 5th grade girls in the troop, which meets at the Cooper City Community Center. Most of them live in Davie and Cooper City. They camp, mentor younger girls, participate in community service and more. Goldfarb’s daughter, Cindy, has been in the troop for seven years. “She learns to be a leader by stepping out of the box and experiencing things she wouldn’t otherwise have the opportunity to do,’ said Goldfarb. “Girl Scouts teaches her to be courageous and care for other people.”
Tropical Troopers Participate in National 4-H Science Day By Debby Teich

ational Youth Science Day is one of the many ways that 4-H teaches youth across the nation how to respond to challenges in their communities and the world. Members of the Tropical Troopers, a homeschool group of 12 children from K-11th grade, recently volunteered and participated in this year’s event, Motion Commotion, which empowered youth to explore the physics of motion and distracted driving. Tropical Troopers helped facilitate the Motion Commotion event for approximately 300 local school children at Tree Tops Park. They also completed a separate project, which combined a speeding car collision and a distracted driving demonstration in a simulated activity that investigated the physical and human factors of motion. “Many children learn best by completing hands on activities,” said Jackie Matzirakis, parent volunteer. “The 4-H National Youth Science Day activity is a great way to present material that can be abstract or complex and really break it down to a visual, concrete level.” During the project, they molded clay figures and put them in cars that were provided to them. They adjusted the ramp incline and the objects that the car crashed into to see the different outcomes and apply the physics concepts. To show how easily one can be distracted by texting (specifically texting and driving), they caught a ruler that was dropped by their partners and then tried catching it

again while texting. They saw how texting slowed their reaction time. “As our kids get closer to the driving age, they’ve now had an opportunity to see how distractions like texting can affect their driving,” said Rosaria D’Aquino, group leader. D’Aquino’s 12-year-old daughter, Michele, participated in the project. “I enjoyed volunteering at Tree Tops Park and teaching the many students there,” said Michele. “I also enjoyed learning more about physics.” Matzirakis’s two children, Annaleisa, 10, and Nicolas, 13, also participated. “The texting experiment was a real good example of why you shouldn’t text and drive and how detrimental it could be,” said Nicolas. “It was interesting to see that a clay figure with more mass stayed in the car better, whereas a smaller clay figure was ejected from the car more easily,” said Annaleisa. Fourteen-year-old McKenzie Iszler also participated. “I learned about the dangers of texting and driving. Your reaction time is a lot slower and can cause you to crash into a car or other object.” The mission of 4-H is to empower youth to reach their full potential, working and learning in partnership with caring adults. The four Hs in 4-H are: Head (managing, thinking), Heart (relating, caring), Hands (giving, working), and Health (being, living).

PRP Therapy Proves Effective in Combating Hair Loss Dr. Jean-Claude Nerette
A
lthough typically associated with men, hair loss or thinning is not uncommon in women in their 50s and 60s. In fact, over 30 million U.S women suffer from hereditary hair loss, according to the American Academy of Dermatology. The psychological effects are severe. Registration Opens in Davie for Youth Baseball

T
he Town of Davie offers a wide variety of recreational and competitive sports programs throughout the year for boys and girls, ages 3 to 15, at the Bamford Sports Complex. The programs are offered in a safe, fun and well supervised environment. Weekday activities begin no earlier than 6pm and the participants play on Saturday mornings and early afternoons. Through January 10, youth can enroll in baseball. The program runs from February to mid-May. Town of Davie programs are offered to residents and nonresidents. They currently include: baseball, basketball, flag football, cheerleading and soccer. The Town also offers Smart Start programs for children ages 3 and 4 in flag football, soccer, baseball, and basketball. All of the coaches are volunteers, who must pass an FDLE background check by the Town of Davie. The focus on the children is through positive coaching, team work, socialization skills, and sportsmanship. Approximately 500 boys and girls, ages 5 to 15, participate in the baseball program. Practices and games are held on weeknights and Saturdays. It includes the following divisions: T-Ball (ages 5-6), Coach Pitch (ages 7-8), Atom (ages 9-10), Minor League (ages 11-12) and Major League (ages 13-15). Six year olds can play either Tee Ball or Coach Pitch based on their experience. Parent meetings and player ratings for ages 3-10 will be held on January 30 and for ages 11-15 on
February 1. Registration fees are: ages 5-9 - $105/Davie residents; $155/nonresidents and ages 10-15 - $130/Davie residents; $155/nonresidents. It is not too early for children ages 3 and 4 to learn to play through Smart Start Baseball. Smart Start programs are designed to teach the basic fundamentals of sports in new and innovative ways using sports equipment with which children feel comfortable. Parents help teach the basics of catching, hitting, throwing, and running bases. The parent meeting for Smart Start Baseball is scheduled for January 30, at 9am at Pirate field. The program is held on Wednesday evenings and Saturday mornings. Registration fees are $75 for Davie residents and $100 for nonresidents. Howard Kaufman plans to enroll his three-year-old son in the Smart Start program and his seven-year-old son in baseball. “I feel fortunate that the Town of Davie has such wonderful programs for the kids,” Kaufman. “They will get a great foundation in baseball, as well as other sports.” Davie Pine Island Park/Bamford Sports Complex is located at 3801 S Pine Island Road. Davie Youth Lacrosse Opens Registration for 2016 Season By Debby Teich

icknamed “the fastest sport on two feet,” lacrosse combines basketball, soccer and hockey. It continues to grow in popularity in South Florida, especially since it became sanctioned at the high school level. Davie Youth Lacrosse is now registering players for the 2016 season, which runs from January 25 to April 30. “The kids love lacrosse, because it is action-packed with plenty of scoring,” said Pete Dunne, who co-founded the Davie program with Shaun Bamforth in 2008. “Athletes of all ages, skills and sizes can play the sport. It is very easy for new players to pick up the game, especially if they start at a young age.” The program is organized and run by the Davie Youth Lacrosse Foundation, Inc., a 501c3 charitable organization. Davie Youth Lacrosse is a “travel” recreation program, with a focus on giving players of all skill levels a quality learning experience and an opportunity to have fun playing lacrosse. Players are taught improved agility, conditioning,

team work, and the skills necessary to play lacrosse. They are also taught to respect the game, as well as the other players. Davie Youth Lacrosse has approximately 340 boys and girls, in grades kindergarten to 9th, who play on 17 teams. They practice twice per week, with games on Saturdays against other recreational lacrosse teams throughout South Florida. Practices and home games are held at Bamford Park in Davie. Experience is not a requirement to join - just a willingness to learn and have fun. To encourage new players to try the game, the program has loaner gear available for younger players. There is also an advanced training program for new and experienced players from January 4 - 14. More information is available at www.faststartlacrosse.com. Many of the players who have been through the program are now playing at high schools throughout South Florida, as well as for colleges and universities. “Our players have been recognized inside and outside the state of Florida for the skills they have learned and developed in the program,” said Dunne. Dunne says they are always looking for coaches, with or without experience. They will teach the volunteers everything they need to know about the game. want to give credit where credit is due. So, perhaps a confession can help clear the air so there’s no misunderstanding. Before I talk about my confession, though, let me say a few other things first. Let me start by explaining the photo in this letter. You know, when I meet people in town they usually say, “Oh, yeah, I know you, you’re Dr. Rick. I’ve seen your ad with that picture of you and your family.” Well, I’m the guy on the right. Twenty-five years ago something happened to me that changed my life forever. I was a junior in high school and I started getting migraines. I had suffered from intense headaches since childhood. Over the years, I consulted many medical doctors, and specialists. I went through all kinds of tests, MRIs, and treatments. ressed as witches, pirates, clowns and other Halloween favorites, children and adults of all ages enjoyed the “Spooktacular Adventures of Little Boo the Ghost,” an annual FUN-raiser presented by the Drama Department at Archbishop Edward A. McCarthy High School. After the show, audience members had an opportunity to dance with cast members. They also collected candy and other goodies as they went trick or treating down the hallways

of the school. Proceeds from the show benefited the AMHS Drama Department. “The play is a Halloween favorite,” said Cindy Keegan, AMHS Artistic Director, who wrote the original play in 2012. “Children come back year after year.” The educational, funny and compassionate musical is about Little Boo, a young ghost who is trying to find her way in the world. Halloween is coming

he Friends of the Davie Farm Park recently announced the “Catch the Farm Park Fever” Campaign. The self-sustaining, working farm celebrates local rural history and is dedicated to “making a difference” in the community through hands-on programs for visitors of all ages. Located on 84 acres on Shotgun Road in western Davie, the Governor Leroy Collins Farm Park (also known as the Davie Farm Park) is embarking on the start of its construction. The Town of Davie’s newest park is a mini urban working farm that will provide an opportunity for youth and community programs focused on a variety of topics—including agriculture, nutrition, the environment, and Davie’s history—and will become an important agri-tourism destination. We want to educate the community about the vital roles that farming and good nutrition play in our lives. Kids think their food comes from the grocery store, and the Davie Farm Park is a great way to help them understand where their food actually comes from and learn about healthy eating habits. Visitors of all ages will have the opportunity to learn about agricultural production from seedling to market and about the area’s agricultural history in a “hands-on” environment. They’ll also see firsthand how this self-sustaining park will generate its own electricity by harnessing the energy of solar power, wind power, and fuel cell technology. The park’s mission is “making a difference,” which is all encompassing. Other programs will include equestrian programs for at-risk children as well as those with special needs, 4-HClub initiatives, nutrition programs, and a working farmer’s market to showcase the crops that will be cultivated on the premises. Additional proposed elements for the farm park include: ▸▸ an educational farming area for the corps, fruit trees, and recreational trail ▸▸ a barn/education center with livestock as well as pastureland ▸▸ an equestrian area and public trail connection ▸▸ a playground with farm-themed equipment ▸▸ picnic pavilions/outdoor classrooms ▸▸ a farm and wildlife observation overlook ▸▸ a butterfly garden ▸▸ native landscaping ▸▸ space for events and public meetings Friends of the Davie Farm Park Inc. is a nonprofit 501(c)(3) organization. The group’s mission is to preserve and protect the past, present, and future of Davie’s agriculture and natural resources through education and demonstration. In partnership with the Town of Davie, The group has been instrumental in providing formative planning and direction for the site development and is actively working to obtain key sponsorships through naming rights as well as monetary contributions for the newest of Davie’s parks. Bariatric Surgery – An Effective Way to Lose Weight A third option, adjustable gastric banding, is not widely used today because it does not have the same long-term effectiveness of the other two procedures, but some patients still prefer it. For people who need to lose weight but have been unsuccessful with diet and exercise, there are procedures known as bariatric surgery that can help. Types of bariatric surgery There are three main types of bariatric surgery. All are done laparoscopically (minimally invasive) and only require the patient to be in the hospital for one day. Most patients do very well with these procedures and can return to work in about 2 weeks. The procedure with the longest track record is gastric bypass, in which a small pouch is created, restricting food intake, and bypassing a segment of the small intestine. This limits the amount of food intake and its absorption. Another option is to have a gastric sleeve, in which only the size of the stomach is limited. This option requires patients to follow dietary changes more closely.
Very recently another option has been approved for people with less severe cases of obesity: the intragastric balloon. This is a non-surgical procedure, in which a balloon is inserted into the stomach via an endoscopy, under light anesthesia. The balloon is removed in a similar way after six months, and nutritional counseling continues for one year. To be a candidate Ideal candidates for bariatric surgery have a Body Mass Index (BMI) of 35 or higher, as well as a weight-related condition, such as diabetes, sleep apnea, high blood pressure or heart disease. Patients who have a BMI of 40 or higher can have the surgery even if they do not have any coexisting conditions. Additionally, for consideration of the intra-gastric balloon, candidates would have a BMI of 30-35. Getting started At Cleveland Clinic Florida, patients who inquire about bariatric surgery are asked to attend one of our free seminars – usually offered twice a week – so they can learn about the procedures and start to discuss insurance issues. After that, they come back for an individual appointment at which a complete physical is done, as well as consultation
to discuss which procedure is best for them. Patients also attend a physician-directed nutrition class. The next step is to await clearance from their insurance company, which may have additional requirements, such as losing weight on a supervised diet prior. This can take 3 to 12 months. A final step is for patients to receive approval to proceed from their primary care physician and any specialists they may be seeing, such as cardiologist or a diabetes specialist. Success Overall, our patients lose about 70 percent of their excess weight in the first 18 months following surgery. The intra-gastric balloon leads to a 2530% of excess weight loss. Many see dramatic improvements in their other health problems as well. Patients who continue to follow the nutritional plan and come for annual follow up appointments as recommended usually keep the weight off for life.

Helpful Tips for Landlords and Tenants in Florida By Vanessa J. Bravo and Omar J. Arcia
A
t the Arcia Law Firm, we are familiar with both residential and commercial landlord tenant law, and with the different strategies involved in filing an eviction action as a landlord, and defending one as a tenant. There are important considerations in each. On the landlord side, the proper time to file an eviction action is critical, whether it be due to a failure to pay rent, or due to a tenant staying after the expiration of the lease. One situation requires a particular kind of 3-day notice and the other does not. In fact, serving a 3-day notice on a holdover tenant can be construed as a renewal to the lease, an invitation to stay, and an extension of the lease. Many people also do not know that holdover tenants are liable for double the amount of monthly rent, due at the end and not the beginning of each holdover month. A proper notice advising of such holdover tenancy prior to the expiration of the lease is a valuable tool to ensure that tenants vacate on time, or pay the costly price for staying without permission. Tenants also need to know under what conditions the landlord is entitled to keep their security deposit, and in which situations a tenant may legally withhold payment of rent. Each scenario is described in Florida’s Residential Landlord Tenant statute. It is the landlord’s duty to maintain the premises, but it varies depending on whether the residence is a single-family home, a duplex, or a dwelling unit.
For example, renters of single-family homes and duplexes need to maintain much more than the dwelling unit tenants, including their own heat, pest control, and garbage removal. However, the lease itself may provide for a wider range of landlord’s duties. Finally, it is very important to note that any tenancy lasting any time over one year must be in writing. Rights and duties pertain to all tenancies, whether they exist under a written or verbal rental agreement. A tenancy pursuant to a verbal agreement has to be ended in a particular way, depending on whether it is a week-to-week or month-to-month tenancy. What a Seller Needs to Know Before Closing – Part I
Y
ou hired a Realtor and put your house on the market at what you feel is fair market value. After several showings from various interested persons, and then perhaps after a second look, a buyer makes an offer. It may not be what you expected. Perhaps the offer includes contingencies, seller’s concessions and repairs up to 3% of the purchase price, which gives rise for concern about ever reaching closing. This is actually the beginning of a successful transaction. Negotiations and counter-offers are a normal part of the home-selling process. Here’s how you both get to the closing table.
The Offer The buyer presents the offer on a residential purchase agreement – either the CRSP, FR-BAR or FR-BAR AS-IS. There are other contracts that could be used; however, these are the most commonly used by professionals in our industry today. This contract is a legally binding instrument only when all parties have agreed to all the terms and there now exists an effective date. Using one of the documents listed above (with the appropriate associated addenda or riders), the buyer inserts all the terms they would like to include: ▸▸ Price ▸▸ Down payment ▸▸ Closing date ▸▸ Any contingencies, such as a financing contingency ▸▸ Or any other terms on the buyer’s wish list, including the personal property that may stay with the home (appliances, hot tubs, etc.) If you, the Seller, like the offer, you can accept it by signing the contract. At this point, the offer turns into a binding purchase agreement. Neither you nor the Buyer can back out of the deal unless the contract allows you to do this. Some examples include: if the buyer’s home inspection throws up material repairs that the buyer is not willing to take on or the Buyer gets denied a mortgage and has attached the appropriate addenda allowing him out of the deal with his deposit monies. In most cases, the original offer from the buyer is not acceptable. You now have two choices: ▸▸ Reject the offer outright ▸▸ Make adjustments to it (counter-offer) Making a Counteroffer The Seller’s counteroffer is made right on the original offer and initialed by the Seller to be initialed by the Buyer -- should the Buyer agree. The Seller may: ▸▸ Raise the offer price ▸▸ Request a higher earnest-money deposit ▸▸ Delete some of the personal property the buyer is asking you to sell with the home ▸▸ Change (shorten) the inspection period ▸▸ Change the closing date The appropriate addenda must be attached and signed by the Buyer. ▸▸ The owner has filled out a four-page owners’ disclosure, which must be reviewed and signed by all parties ▸▸ If there is a COA or HOA, same must be disclosed ▸▸ Any lead-based paint issues (if the home is built before 1978) ▸▸ Any mold or defective drywall – right to inspect on behalf of the Buyer ▸▸ The right of the Buyer to cancel because of insurance premiums exceeding a certain percentage of the sales price ▸▸ Appraisal contingencies and so forth This article will be continued next month . . . M
ost people think of the holiday season with gleeful anticipation of time with family. For couples who have been through a divorce, the holiday season can often be a very stressful time. This stress can also be felt by the children of a divorced couple. It is not uncommon for holiday visitation issues to surface during this time of year. Hopefully the parties’ settlement agreement or Parenting Plan is specific as to time sharing. Over the course of approximately 30 years of practice, my clients have experienced many issues concerning holiday visitation. The biggest obstacle to solving an issue in court during this time of year is the reality that court time is very difficult to schedule during December and, as such, last minute issues usually will not be addressed. Of course the parties are always able to try and work things out on their own or with the help of attorneys and mediators. I would certainly suggest not waiting until the “last minute” to address any concerns. The best way to ensure there will be no conflicts during the holidays is to anticipate potential problems ahead of time and address them in the marital settlement agreement and/or Parenting Plan. The more specific your agreement is, the more likely you will not experience conflicts along the way. For couples with minor children, Parenting Plans have been mandatory. These Parenting Plans are designed to be very specific as to time sharing in an effort to head off any trouble in years to come. Unfortunately, these Parenting Plans were not used prior to the latter part of 2008. Therefore, many existing agreements do not include this provision. I believe the most important thing to remember is that any time sharing arrangement should always keep the best interest of the children as a priority. Children want to spend time with both parents and this is especially true during the holidays. They also want to be a part of any family gatherings. Sometimes that is not always possible, but advanced planning may be able to achieve this goal. Often parents divide the entire winter break in half, with Christmas day being the “exchange day.” As an example, in odd numbered years such as 2015 perhaps Dad has the children from the day school ends until noon Christmas Day. Mom will pick up the kids and keep them until school begins again. Next year, they can reverse the schedule. In some cultures, Christmas Eve is more of a celebration, so perhaps one parent can celebrate every Christmas Eve and the other Christmas Day. Also remember that “gift giving” is not a competition, with the winner being the parent who spends the most money. Often times the finances of each parent may not be the same and one must buy gifts within his/her budget. For a parent to embarrass the other by purchasing a more expensive and lavish gift is only going to lead to hard feelings and potential problems. Hopefully, the parents can discuss this issue beforehand and plan together. Often parents wish to visit family out of town. Consider the feelings of your former spouse and the children in the planning such a trip. Children have the need to be with extended family during the Holidays. Perhaps holiday trips out of town can be rotated from year to year between parents. Mom and Dad can certainly make the holiday season a joyous time for their children or they can focus on themselves and make it a time that everyone would like to forget. Beware of Embedded Dental Plan Ask the Expert

he Affordable Care Act (also known as ACA or “Obama care”) requires that all insurance plans meet “10 Essential Benefits.” Pediatric dentistry is among these benefits. For this reason, many insurance plans are being offered with dental coverage. They can be offered as two separate medical and dental policies, known in the insurance industry as “stand alone” policies. This is traditionally how people have been purchasing insurance for years. In addition, there has been a new creation called “embedded” plans. In this type of insurance, the dental portion is embedded within the medical. At face value, they seem very attractive and we have noted that many families have chosen to drop their traditional plans for these new embedded plans. In many instances, the plans have not met expectations. I hope to clarify some of the potential pitfalls and offer important questions to ask prior to making the switch. First let’s evaluate the highlights of each type of plan: ▸▸ “Stand Alone” plans: They are completely separate entities from medical insurance. They have relatively low deductibles, usually between $25 and $50 dollars. They have annual maximum benefits and usually cover preventative treatment close to 100%. Orthodontics may or may not be covered, depending on the plan. The main benefits of these plans are that the deductibles are small and the benefits are transparent. ▸▸ “Embedded” plans: These are pediatric dental plans which are embedded within the medical plan. The majority of these plans share the medical deductible. As you know, these medical deductibles can be rather large (on average, $2,000 per individual). What this means is that until you pay your deductible, all dental is paid out of pocket including preventative treatment such as cleaning and x-rays. They can also be very tricky to understand. For example, the benefits table may read that they cover 100% of preventative. However, the majority only cover it once the deductible is met. Additionally, many state that there is an orthodontic coverage. However, the majority only cover for cases deemed “medically necessary”, which includes only the most difficult cases. In all fairness, there are some plans which are “embedded” with a separate dental deductible and those that will cover preventative at 100%. The only problem is that all the right questions must be asked in advance. If not, benefits may not be understood until the procedures are billed out. By this time, open enrollment periods are usually closed. We recommend keeping it simple, especially during this transition time. Stick with PPO policies. These are available in “embedded” or “stand alone” policies and ensure that you will be able to retain your current healthcare providers. When possible, choose a “stand alone” dental policy. They are usually more transparent and new “out of pocket maximums” (also mandated by the ACA) have made them even more attractive. If you do choose an “embedded policy,” verify that the policy has a separate deductable from the medical portion. Also make sure that preventative treatment is covered at 100%, even before the deductible is met. Remember, your best resources in making decisions are a knowledgeable insurance broker and your current dental office. Drs.
