he summer of 2015 is slowly coming to an end. Summer vacations are fading into memory and the kids are settling into their school routines. With football season kicking into high gear, our lives are slowly returning to “normal.” While our afternoons and evenings may seem to be a blur of racing to and from afterschool activities, sports practices and music lessons, let’s not forget that the fall season in Florida has plenty to offer for family fun. The sun is not quite so scorching hot, and the ocean waters are still warm and beautiful. So put down the tablet, switch off the game console, and get out there and enjoy the soothing surf, take an airboat tour through the Everglades, or simply make time for a movie matinee. Nickelodeon Provides an Added Dose of Fun to This Year’s Intercity Summer Games BY JILL SHARPE
I
n celebration of July being National Parks and Recreation Month, more than 200 summer campers in the City of Miramar enjoyed a special day filled with fun, food, games and activities with campers from the City of Miami Gardens and other surrounding areas. The Intercity Summer Games took place at the Betty T. Ferguson Recreation Center located at 3000 NW 199th Street in Miami Gardens on Thursday, July 30th. Not only did the Miramar campers get to celebrate parks and outdoor activities as well as socialize with other South Florida campers, this year’s festivities also highlighted Nickelodeon’s Road to the Worldwide Day of Play (WWDoP) and Nike’s athletic station. WWDoP is an annual celebration designed to encourage children and parents to turn off the television and play -- especially outdoors. The Miramar campers enjoyed the added treat of special guest appearances from Nick’s television, gaming and cartoon shows. Nickelodeon was also on hand to film and photograph the event. Campers Aden Daniels and Michael Grant said their favorite part of the day was seeing the Ninja Turtle and getting slimed! “It was great to do all these fun things with all my friends,” Daniels said. Dinerro Heurtelou liked meeting the Nick characters the best. “It was so awesome to see Paola Andino and Nick Merico who play Emma and Daniel on the show Every Witch Way,” said Heurtelou.

Shayon Tresvant, Educational Instructor, said it was great to see the kids running around and enjoying themselves. “This is a needed break for these kids away from the monotony of school work. “ Janine Alleyne, Recreation Leader with the City of Miramar, said her favorite part of the day was watching the kids get slimed. “I’d like to thank the City of Miami Gardens for inviting us,” Alleyne said. “I hope that we can continue to partner on great activities like this in the future.” Nickelodeon Public Affairs Manager Sydney Cohn said the event in Miami Gardens was one of a series of events held throughout the country leading up to Worldwide Day of Play which is September 26th. “Our aim is to promote active lifestyles and enhance what our partners are already doing out there in the communities,” said Cohn. To provae their point, in addition to providing lots of fun activities at the event, Nickelodeon also presented a $10,000 check to Up2Us Sports to support their programs. Symposium on Breast Cancer Will Provide Vital Information for Miramar Residents BY JILL SHARPE
T
he Miramar Library and Education Center will host a Breast Cancer Awareness Symposium on Saturday, October 10, 2015 from 1:00 PM to 3:00 PM which will cover breast cancer fundamentals such as types and stages of breast cancer, conventional therapy options and clinical trial information. It will also include some of the newer breakthrough treatments such as targeted genetic therapies. Local health care professionals will be on hand as well with information regarding screenings and mammograms. The program will be facilitated by Rance Winkler, PhD, the inventor and developer of the MammoSite RTS. An unprecedented technology in breast cancer treatment, the MammoSite was first featured in Time Magazine’s February 18, 2002 issue when the publication highlighted innovative cancer treatments to date. In one of the largest registry studies ever conducted to evaluate efficacy and satisfaction, 100 percent of 35,000 patients treated with the

MammoSite therapy showed no recurrence after a five year period. Today the MammoSite is considered the gold standard radiation therapy system for breast cancer treatment, replacing the traditional 6-7 week regime with a five day therapy. Miramar Family Creates Fund to Help Children With Disabilities BY JILL SHARPE
M
iramar resident Ryan Soto is only three-years-old but already he and his family are serving as an inspiration to a lot of other children and families. Ryan was born with a congenital hand deformity. His parents were understandably worried that their son would not be able to do many ordinary things. “Ryan’s journey has not been an easy one,” said his mother Aileen. “But he has shown us life’s challenges are meant to make us stronger.” The family started Ryan in therapy when he was just two months old and before they knew it Ryan began proving everyone wrong as he conquered one obstacle after another and found “his own way” of doing things. “Ryan became such an inspiration to others that even his doctors and therapist made him a poster child for children with physical disabilities,” Aileen said. “Likewise, Ryan’s can do attitude inspired our family to serve as advocates for other families who feel hopeless about their child’s disability.” The Soto family partnered with the Miami Children’s Foundation to create Ryan’s Helping Hand Fund to spread awareness and to raise money for research, equipment, and treatment for children with upper limb differences like Ryan. They set up a fan page on facebook (www.facebook.com/ ryanshelpinghand) to collect donations for the fund and also to help children like Ryan feel supported within their community. For their first event, Ryan’s Helping Hand will be participating in the Miami Children’s Hospital Foundation annual 5K Run/Walk on Saturday, September 19th. All donations made to the team will go directly to the fund and will be allocated specifically to children with limb differences. The event starts and finishes at Coral Gables City Hall. Two Miramar Police Captains Graduate From Esteemed Programs BY JILL SHARPE
M
iramar Police Captain James Dunkelberger and Captain Shalida Smith recently graduated from the nation’s top law enforcement development training academies. Captain James Dunkelberger was one of four South Florida law enforcement officers who graduated in June from the FBI National Academy in Quantico, Virginia. As FBI National Academy graduates, these officers enter into a select group made up of less than one percent of the country’s law enforcement officers. The FBI National Academy, one of the premier law enforcement academies in the world, is dedicated to the improvement of law enforcement standards and has long been a benchmark for professional continuing education. Captain Dunkelberger has a Master of Public Administration from Barry University and is currently working towards his doctoral degree Captain Smith attended the esteemed University of Louisville’s Southern Police Institute Administrative Officers Course. The Southern Police Institute is an advanced education and training institute whose mission is to enhance the professional development of law enforcement practitioners. It has been consistently ranked among the top law enforcement educational and training schools in the nation. Captain Smith was designated a “Dean’s Scholar” of academic excellence for earning a letter grade of “A” in each of her courses. Captain Smith also holds a Bachelor of Professional Studies and a Master of Public Administration from Barry University. Miramar Police Department Chief Ray Black congratulated Captain Dunkelberger and Captain Smith for their commendable achievements. “Both of these individuals are dedicated professionals whose accomplishments reflect favorably upon themselves, our city, and the law enforcement community,” Chief Black said.

Tropical Financial Credit Union Awards College Scholarships to Local Students School News

O
ne student from Miramar and three other local students headed to college in the fall received $1,000 scholarships from Tropical Financial Credit Union on July 29th at the credit union headquarters in Miramar. Jose Olivia, the scholarship winner from Miramar, is enrolled at Pasco-Hernando State College in New Port Richey Florida. The other winners were Joshua Davis from Tamarac, who will be attending Florida Institute of Technology in Melbourne, Jordan Suarez, from West Palm Beach, who will attend the University of Florida in Gainesville and Cortland Brigham from West Palm Beach, who will attend Liberty University in Lynchburg, Virginia. Tropical Financial Credit Union, a not-for-profit financial institution that serves Southeast Florida, first began awarding college scholarships last year. In addition to the four students who graduated high school this past spring, Tropical Financial also gave out one non-traditional scholarship — a new category for adults already out of high school, but who want to continue their education. It’s available to someone, for example,
going back to school after being in the workforce or someone trying to obtain a graduate degree. The inaugural non-traditional scholarship went to Crystal Reed of Opa-locka who will be getting her grad degree from Widener University in Chester, Pennsylvania. “I want to congratulate all of this year’s scholarship recipients,” said Rich Helber, president/ CEO of Tropical Financial Credit Union. “By helping young people pay for their education, we are starting them on a path to one day becoming financially independent. As a credit union, assisting people achieve financial prosperity is one of our top priorities.” All of the applicants were required to submit a 500-word essay highlighting their educational goals, personal objectives and outlining ways in which Tropical Financial has, or could, help them reach financial goals. Other factors considered are community involvement, charitable works and extracurricular activities. To be eligible, the applicants had to live in the tri-county area, have a high school GPA of 2.5 or better and already be enrolled in an accredited college or vocational program.

ew clients often believe that they do not need a trust because they don’t have multi-million dollar estates. Yet, nowadays, trusts are not only for the rich and famous. Why? Because it’s less about avoiding estate taxes and more about the cost savings and protections that trusts can provide. A properly drafted and funded trust avoids the expense, delay, and loss of privacy that a probate administration would cause. The following scenarios help my clients understand why a trust may be worth considering. Meet our hypothetical family, George and Jenny, happily married for 25 years with three children, Jessica, age 20, Josh age 15, and Jonathan, age 12. Both George and Jenny have created wills, leaving everything to each other. After they are both gone, their wills leave it all to their children. Sounds like a logical plan? Maybe not. Tragically, George dies suddenly and, according to his will, all of his property transfers to Jenny. The following year, while rushing to an appointment on a rainy morning, Jenny loses control of her car and rear ends a school bus full of trial attorneys heading to the annual Ft. Lauderdale “I’ll See You in Court!” Convention. Several of the attorneys are injured and predictably lawsuits follow. Now what happens to Jenny’s inheritance from George? It’s likely all gone to creditors. What is left to raise her children? Perhaps nothing. If George and Jenny had used a trust in their estate plan, the final outcome may have been different. While Jenny’s property would still be subject to creditor claims, her inheritance from George inside a trust would be safe for her and their children. In another sad scenario, imagine that Jenny dies first. George later remarries Susan, a woman with four adult children from several previous marriages. What happens when George passes? His property, including what he inherited from Jenny, may go to Susan and eventually to Susan’s children. George and Jenny’s children could be completely disinherited! With a properly drawn trust, George and Jenny can rest assured that even if the surviving spouse remarries, their money will go to their children. Finally, think of George and Jenny happily enjoying retirement and grandchildren, but unfortunately not too fond of Jessica’s husband, Robert. Jenny fears that their son-in-law will never earn a decent living, and be dependent on their daughter Jessica to support him for the rest of his life. George worries that if they leave an inheritance to Jessica and she ultimately divorces Robert, a substantial portion of Jessica’s inheritance could be lost to her “no good husband.” If George and Jenny leave the inheritances to their children in a trust, these assets will not be commingled with marital property. Therefore, in the event of a divorce, daughter Jessica’s inheritance will not be the subject of division and distribution. Estate planning is a deliberate, premeditated act of love. any doctors believe that around 80% of learning occurs through a child’s eyes. Since a child’s eyesight may change frequently, consistent eye and vision care is crucial to a student’s classroom success. Surprisingly, most parents are not including eye exams as part of their child’s back-to-school doctor’s visit line-up. Furthermore, survey results show that over 50% of parents don’t take their child for an eye exam until at least age three. The AOA actually suggests that children receive their first eye screening at six months, then comprehensive vision examinations starting at age three, before beginning school. Exams should continue to be booked routinely every other year from that point on. Often the issues a child deals with in the classroom can come from sight difficulties. The number of students who are suffering from undiagnosed vision problems is quite high. Over 60% of students classified as students with learning-disabilities actually have undiagnosed vision problems. Your child will be much better off if you take a proactive role in ensuring your child is seeing properly. Don’t push off your child’s first vision screening until kindergarten. Pediatricians should perform a dilated eye exam to discover any serious eye problems within the age of two months. Every child should have a complete eye checkup by age five, since early intervention can make a difference. Additionally as a parent, it’s important to see whether your child is reading sufficiently. Generally, kindergarteners are excited to look at books and try and figure out words. Children that don’t read books may be experiencing a vision problem. Winning Foreclosure Defenses Take Center Stage

I
n the quickly changing landscape of foreclosure cases in Florida, at least two new defenses are being accepted by courts in favor of homeowners. If these defenses are presented with the appropriate cases to a judge, it should result in a dismissal or final judgment in favor of the borrower. The key is knowing when and how to present these defenses in your case. The first defense is one we have previously mentioned in other articles; statute of limitations. The laws that set deadlines by when lawsuits must be filed are called statutes of limitations. Different deadlines exist for different types of lawsuits, and they vary by state. In Florida, there is a five (5) year statute of limitations to file a foreclosure case. A lender that filed a previous foreclosure case which was dismissed for any reason CANNOT re-file another foreclosure case using the same date of non-payment, if the new lawsuit is filed more than five years after the date you stopped paying the mortgage. A key to a judgment in favor of the homeowner in the new action is proving that the default date on the old and new lawsuits are identical.
Another winning defense is based on the language of the notice of default and acceleration sent by the lender prior to the foreclosure. This is also commonly referred to as the “demand letter.” If the demand letter you received prior to a foreclosure indicates that you should “file a court action” in order to assert your defenses to acceleration and default, then it contradicts the language of your mortgage. Florida is considered a judicial foreclosure state, unlike the majority of states in the U.S. This means that a lender seeking to foreclose in Florida must first sue the homeowner in order to obtain title to the property after non-payment of the mortgage. A homeowner is, therefore, not required to file a court action in Florida to assert defenses to foreclosure. However, many lenders drafted their demand letters incorrectly by using language that is only appropriate to non-judicial states. Florida homeowners can use this mistake to their benefit, and may be able to dismiss the foreclosure case altogether. hope you have had a wonderful summer, participating in activities enjoyed by you and your families. I wanted to bring something of concern to your attention and hope you support the decisions we are moving forward with to protect the City of Miramar and our County. Recently, Kanter Real Estate LLC applied to the Florida Department of Environmental Protection (DEP) for exploratory oil drilling on 20,000 acres of land the company owns in the Everglades, only 6 miles west of the City of Miramar. This is an environmental and water supply matter that concerns not only Miramar, but all of Broward County. There are many reasons to raise objection to this permit application. Exploratory oil drilling has potential impacts to the sheet-flow of the Everglades and current Everglades restoration projects, contamination of surface waters, effects on wildlife, and the enormous risk to the Biscayne Aquifer – a primary source of drinking water for millions of our residents in Broward County and beyond. I have asked our city attorney to assess our legal options and provide us with other measures that may be taken to potentially intervene in the process. In addition, I have contacted the mayors of all the Broward cities as well as the Broward County Commission to request their support in this effort. I am proud to say that a number of cities including Pembroke Pines, Davie, Sunrise, Wilton Manors have responded. I have also heard from a number of representatives who are also ready to step forward.
The site is only 6 miles away from Miramar.
The City of Miramar unanimously passed a resolution expressing Miramar’s objection to the permit application and oil drilling that impacts Miramar. The resolution asks that Broward County cities and the Broward County Board of County Commissioners support us in objecting to the application. I hosted a meeting on August 18th with stakeholders from the City, the public and fellow mayors to provide information regarding the permit process, our legal options and a call to action to stop this activity, which could potentially impact our quality of life and harm our environment. Their usual answers follow, “mmm”, “I think you’re exaggerating”, “It will settle in a few days”, “but you look great!!”, “the friend of a friend left town”. The latest options in prostate cancer treatment. Improvements in the effectiveness of prostate cancer treatments are changing the outlook for men diagnosed with the cancer for the better. Prostate cancer is the most common non-skin cancer in men, Barbara Ercole, MD and the second leading cause Urologist of cancer death among men in the United States. One in seven men is likely to be diagnosed in their lifetime; most cases are found in men over age 65. Today’s prostate cancer treatments include surgery, radiation and drugs that slow cancer cell growth. The safety and effectiveness of these treatments are steadily improving. “Each treatment has its own benefits and risks, and choosing the right approach can be complicated,” says Barbara Ercole, MD, a urologist at Cleveland Clinic Florida in Weston. “Narrowing treatment options depends on several factors, which include the stage of the cancer and patient comorbidities and preferences.” In some cases, no treatment might be the most appropriate first step. Called “active surveillance,” this strategy allows men with early-stage or very slowgrowing prostate cancer to avoid treatment and its side effects. The patient’s cancer is regularly monitored so that action can be taken if the cancer grows or spreads.

Radiation therapy is a treatment option that kills cancer cells and shrinks tumors. Radiation can be produced from a machine outside the body (external radiation) or by putting materials (often referred to as radiation “seeds”) that produce radiation into the area where the cancer cells are found (internal radiation or brachytherapy). One of the most common surgical treatments for prostate cancer is radical prostatectomy, which involves the removal of the entire prostate. This can be done through an incision in the lower abdomen (open approach), or using robot-assisted surgery. Robotic prostatectomy is a type of minimally invasive surgery that uses robotic equipment and allows surgeons to operate through small ports rather than large incisions. “Unlike many cancers, prostate cancer usually allows the patient a significant window of time to consider their options,” says Dr. Ercole. “Make sure you understand all of the information before you and your physician agree on a course of treatment.”

The show will take place on October 3rd in the Au-Rene Theatre at the Broward Center for the Performing Arts.
