A Halloween Treat!

T

he memories of summer vacations have slowly faded away. The kids have settled back into their regular school routine, and that typically means mom and dad busy shuttling them around to after school activities. Sports season is in full swing and, thankfully, the heat and humidity are dropping a bit. Finally, we can enjoy family activities and gatherings with friends in our backyards again. These cooler nights signal fall has arrived in South Florida, and that means Halloween is almost here. It’s time to decorate the house with “scary” lights to brighten the spirits of our little ones (and sometimes not so little ones). Let’s have some fun while watching the neighborhood kids roam the streets dressed up in costumes. Be sure to have your camera ready to take some pictures of your children enjoying the trick-or-treating tradition. These are the memories that last a lifetime.

Advances in Mammography: Fighting Cancer in 3D Breast Tomosynthesis

Regular screening mammograms, which create twodimensional views of the breast, can reduce cancer death by 30 percent. But newer technology that creates three-dimensional (3D) mammograms offers important advantages, including greater detection of breast cancers that cannot be seen using those traditional mammograms. In one study of almost 13,000 women, use of 3D mammograms resulted in a 40 percent increase in detection of invasive breast cancer. This new technology is available at both Cleveland Clinic Florida’s academic medical center in Weston, as well as the West Palm Beach location. “Tomosynthesis gathers images of the breast from several different angles, to create a series that forms the 3D image,” says Maria Artze, MD, a Cleveland Clinic Florida radiologist who specializes in breast imaging. “Having these various images reduces the challenge of seeing areas where tissues overlap, and so improves the radiologist’s ability to detect breast cancer.” The technology makes it possible for the first time for radiologists to see a 3D image of the breast. Because of the high level of detail it provides, the images also highlight masses and abnormalities that conventional mammograms might miss. “In images of the breast, dense tissue appears white, and cancer appears white,” says Cassann Blake, MD, Cleveland Clinic Florida breast surgeon. “Tomography gives us much more detail compared to other types of mammograms. Especially for women with dense breast tissue, this detail is important.”

For the patient during the screening, the procedure will be familiar to other mammograms they’ve had. The only difference is that part of the equipment moves in an arc around the breast, instead of staying stationary. Studies also show that with tomosynthesis, fewer patients need to return for additional mammograms, visits that can cause stress and expense, plus exposure to additional radiation. Research further shows this procedure provides a 15 percent decrease in the number of “false positives,” where tissue looks cancerous but through biopsy (tissue sample) or another exam is later found to be normal. So 3D mammograms can also help women avoid unnecessary biopsies. “Early detection of breast cancer is a key area that we want to highlight,” Dr. Blake says. “Offering the advantages of the 3D mammogram is part of our goal to provide our patients with the best quality of care. Residents Throughout the City Take Part in National Night Out Events to Support Crime Prevention

iramar residents took to the streets all over town on Tuesday, August 4th to celebrate National Night Out, an occasion designed to raise awareness about crime prevention. The Miramar Police Department (MPD) partnered with several local homeowner and civic groups to coordinate a variety of neighborhood gatherings and community walks across the city.

As people filtered into the park and lay down blankets in the grass, MPD Chief of Police Ray Black spoke about the day’s importance. “The crime rate is down in the U.S., in Florida and here in Miramar,” he noted. “We have that continuous partnership with the community where if there’s something wrong, whether

first community here,” said Mary Raynor, President of United Neighbors of Miramar and a key event organizer. “Everyone has really been coming together for this.” Across town, Vizcaya Park held a block party similar to Branca Park, and several other neighborhoods also commemorated the National Night Out. The Ashlar, Haven Lake Estates, Riviera Isles and Sunset Lakes communities each put on their own activities and the River Run, Riverdale, Franklin Farms and Water View neighborhoods collaborated for one event together at River Run Park. No matter what part of Miramar they came from, people were proud of their neighborhood and wanted to do what they can to make where they live even better and safer. “Every August, we

National Night Outs have taken place on the first Tuesday in August since 1984 and the day’s largest gathering in Miramar happened at Shirley Branca Park. Members of the allvolunteer Miramar Park Homeowner’s Association (MPHA) met at Fairway Park beforehand for a community walk that would end at Branca Park. “I’m interested in the community I live in and making sure it’s always safe,” said Roland Abel. “I want to get other community members participating so that we can be the eyes and ears for the police. You can never have enough people that are willing to help. I believe if you see something, you should do something about it.” Community education and entertainment mixed in equal parts at Branca Park as the United Neighbors of Miramar, Tropical Homes CrimeWatch and the MPHA had booths alongside several law enforcement agencies that brought different eye-catching vehicles with them. The Florida Highway Patrol encouraged people to wear their seatbelts through demonstrating their rollover simulator, a car chassis that spins around with test dummies inside. Both the Coast Guard and the Border Patrol landed helicopters in the park and the MPD drove a replica of the first patrol car their department ever had, a 1955 Ford. That was

Joe DiMaggio Children’s Hospital and the Miramar Community Garden had educational booths set up while people donated blood on board One Blood Center’s Big Red Bus. “I was born and raised here and I’m glad this event is in the eastern part of Miramar since we were the

Thankful Miramar Residents Enjoy Back-to-School Event

A

s a new school year begins, the City of Miramar offered a helping hand to parents and students with their Back-To-School Fun Day Health and Info Fair. Held on August 8th, organizers estimated that approximately 600 people visited Shirley Branca Park to enjoy the event and pick up a free backpack and school supplies. Even the late afternoon heat and threat of rainstorms could not keep the crowds away as about 1,000 book bags were given out. Vice Mayor Darline Riggs hosted the day, along with the sponsorship of the Miramar Police Athletic League and several other businesses and community organizations. “We’ve had a great turnout today,” said Vice Mayor Riggs. “This is my first time coor-

dinating this, but I’m looking forward to doing this yearly.” The book bag giveaway was open to any Miramar resident with students enrolled in Kindergarten through the 12th grade. Organizers stipulated that children must be present for the giveaway but there were plenty of activities for kids of all ages. The two large, inflatable bounce houses proved to be quite popular while some kids threw footballs and played in the grass. Families took a break from the heat to grab a snow cone or a bag of popcorn while DJ Nickymix provided a lively mix of tunes. Even with a small army of volunteers helping out, the line of people waiting for a backpack wound around the park, with reported wait times of up to 45 minutes. However, organizer extraordinaire McKinley Lauriston kept the line moving and spirits remained high. It should be noted that these were not generic book bags given out, as children often had their choice of bags featuring popular movies and television shows like Dora the Explorer, Frozen, Guardians of the

Galaxy or the Pixar movie Cars. After picking up their backpack, families moved to a separate line to pick up a packet of school supplies containing pens, pencils, erasers, notebooks and pencil sharpeners. “Everything was good here,” said Sandra Burgos, who has lived in Miramar for 22 years and was there with her daughter Emaly, who attends Miramar Elementary School. “I always come out to events like this and I volunteer at my daughter’s school.” Between visiting the vendors, picking up school supplies and playing at the park, families left the event tired but happy. Christelle Pierre-Louis, who has three kids attending school in Miramar, said the event was very helpful. “It’s one less expense I’ll have this year,” Pierre-Louis said.

Miramar High Poetry Slam Winners Win a Trip to Chicago

M

iramar’s best and brightest students recently won a statewide spoken word competition, propelling them towards a trip to Chicago to further hone their craft. The poetry slam team from Miramar High School (MHS) won the inaugural “Louder Than a Bomb” (LTAB) contest in April and a MHS contingent traveled to Chicago in July for a week of writing workshops. The LTAB competition began in Florida hosted by the Jason Taylor Foundation as part of their poetry program. The foundation, run by the Miami Dolphins great, coordinated literacy projects for many years before participants at the Miramar Youth Enrichment Center encouraged them to branch out into spoken word performances. The Miramar team of Autumn Williams, Desiray Baptiste, Hillary Nomes, John Persaud and Deja Shuler beat out groups from 30 other schools at the LTAB finals, held at Nova Southeastern University. One of the biggest benefits of being in Chicago was the opportunity for the MHS poets to learn more about writing at the University of Illinois. “Chicago has so much culture surrounding it,” said Nomes, a rising senior. “To be around so many people that have so much talent and emotion, it makes you want to be better at what you do. It was refreshing to be a part of something that is not just a hobby but a step for change.” Another team member and incoming senior, Desiray Baptiste, also relished her time there. “Chicago was the biggest blessing,” she said. “I learned so much and this goes to show what following your dreams and having faith can do.” The students were mentored by Veneisha Clarington, an English teacher at

MHS who advises the poetry program there. “We’re a new program but growing,” said Clarington. “The students want to share their talent at every opportunity. It means a lot for our school.” Clarington has seen students use poetry as a way to express themselves when problems arise. “A student was recently on the verge of dropping out,” she recalled. “A friend encouraged him to come to the spoken word group and he stayed in school because he didn’t want to miss the feeling he got from being

around these friends.” Another student submitted a piece from the spoken word program as part of her college application. “She got into Stanford University and the admissions officer there told her that her poem made her stand out from the other applicants,” Clarington said. ver these past few months we have had a number of initiatives take place in our City and I wanted to provide you with an update as well as a preview of what’s to come. The Town Hall Meeting to discuss the City’s opposition to oil drilling six miles west of Miramar was informative and well-attended. Our panelists, Henry Sniezek of Broward CountyEnvironmental Protection and Growth Management, Michael Bennett of AECOM, Jamie Alan Cole of Weiss Serota Helfman Cole & Bierman and a number of elected officials from neighboring cities discussed the potential effects oil drilling would have on our ecosystem, where we are legally as a result of Kanter Real Estate having filed for a permit to drill and next steps for the Community and Elected Officials. Currently, The Environmental Protection Agency requested additional information from Kanter in order to better evaluate their application, which is due to the EPA in November. As we wait for the responses to come in, we’ve asked Elected Officials to pass resolutions in their own cities opposing oil drilling in Broward and asked for them to sign up as a party of interest which will keep them informed of what is taking place. We ask the public to do as follows: ▸▸ Call, E-mail or write your State Representative/Senator ▸▸ Voice your concerns with your sphere of influence, churches, organizations & neighbors ▸▸ Contact your municipality to encourage them to pass a #NoDrillingInBroward Ordinance ▸▸ Social Media #NoDrillingInBroward In August, Miramar hosted The National Black Caucus of Local Elected Officials Annual Conference. It was a proud moment for our City as we welcomed over 200 elected officials from throughout the United States. We were honored to welcome Keynote speakers Congressman Alcee Hastings and State Senator Chris Smith as they addressed attendees. In addition, we toured a number of Miramar’s locations, showcased our wonderful City and shared best practices with our guests. The Commission recently voted unanimously to support the Haitian Community regarding the Mass Deportations taking place in the Dominican Republic against Haitians and Haitians of Dominican descent. Lastly, I want to invite you to attend the State of the City Inaugural Address taking place on Thursday, October 1, 2015 at 6:30 p.m. in the Miramar Cultural Center at Town Center. he gradual cooling off of the once “red hot” Real Estate market has generated several concerns for home sellers as we head into the latter part of 2015. The days of simply placing a For Sale sign in the front yard, receiving multiple offers and getting more than you expected within days have unfortunately come to an end. So, what measures does a serious seller have to take in order to to sell your home in a fairly balanced market? This is not a science; it is more of a simple adjustment to one’s mindset mixed with a little bit of common sense. Two simple but critical suggestions for selling your home in a market that is in the process of correcting itself are: Price it right from the start. This is one of the best practices that you can engage in when you’re in a competitive market. This is also one of the hardest obstacles for sellers to overcome, as they are usually only concerned with what it would have sold for in the good old days and not with what it can sell for at this point in time. Sellers need to place themselves in a neutral emotional state and ask themselves a simple question with reference to their asking price: “If I were a buyer looking for a home of this nature, would I make an offer with the knowledge that I can get a better value (in essence “more house”) for my money somewhere else within the neighborhood?” To get a pulse on your property’s fair market value, you should count on the expertise of a Realtor and/or get the house appraised by a licensed independent appraiser. Pricing it slightly above the appraisal value, but below the prices of comparable homes in the neighborhood that are for sale, usually does the trick.

Condition truly matters. Yes, condition does matter! “The first impression is the only impression.” Clean, declutter and depersonalize. Make all the necessary repairs from chipping paint to leaky faucets to replacing light old light fixtures. Do whatever you can to make your home show impressively to potential buyers. The notion is to make the home look as if it was ready for a photo shoot for a magazine or a catalog. Creating the emotional “wow” factor goes a long way. Remember, logic makes you think and emotions make you act. Additionally, create neutrality by toning down uncommon colors. Depersonalize it by removing personal items from the buyer’s immediate view. Potential buyers need to be able to visualize themselves in your home and not be critical of it. Although the peak home buying season is over, taking the two simple steps as outlined above will almost certainly guarantee a successful sale. any South Florida neighborhoods are governed by community associations. It is imperative that these associations follow the necessary protocols to ensure meetings and elections run as smoothly as possible, including the following best practices: First, in an effort to promote participation and ensure voting by the qualified individuals, it is advisable that association management take the steps to verify that the association’s roster of owners is current and includes a description of all the individuals on title to the home or unit. The roster should further be organized in numerical order by unit numbers or addresses to facilitate the registration and ballot verification process. While a search of the county public records deed database is the most accurate source to verify ownership of units or homes, a more economical approach is to verify the ownership from the county’s property appraiser’s office. Once obtained, these records should be placed in a binder, together with copies of the deeds organized in the same order as the roster or sign-in sheet. Consider organizing the binder with dividers separating each floor/ street, as this step may further facilitate the verification of ownership on the day of the meeting or election. Proxies received prior to the meeting should be verified so as to ensure that they are dated and signed by the owner or other qualified voting member. Once the proxies have been verified, they should be logged in on the sign-in sheet. A note should be included on the sheet indicating the person who has been designated as the proxy for the corresponding unit, in order to ensure that the designated proxy signs-in at the meeting on behalf of the appropriate unit or home. The valid proxies should be organized in a folder in the same order as the sign-in sheet for reference at the time of the meeting. Ballots received in advance of the election should be organized in the order of the roster. The board should further consider appointing an independent committee to validate that the outer ballot envelopes have been properly executed and signed by the qualified voter(s) prior to the scheduled time of the election. This process will serve to further streamline the ballot validation process, which would otherwise have to be performed at the time of the meeting. Bear in mind that outer ballot envelopes may not be opened prior to the meeting. The executed Proof of Notice Affidavit for the annual meeting should also be available at the meeting. In addition, be sure to have plenty of blank ballots, envelopes (inner and outer ballot envelopes) and voting certificates on hand at the election for use by any owner who has lost or misplaced their ballot or voting certificate and would like to cast a ballot in person at the election. By adhering to these suggested best practices, working with qualified community association legal counsel and following all of the other prescribed protocols for the annual meeting and election, associations can help to ensure that their elections are in compliance with Florida law. hat does it mean to fund a trust, and why is it so important? Once you create a revocable living trust there is one last step that should not be overlooked: funding your trust. Trust funding is the process of retitling certain assets to name your trust as the new owner or, in some cases, naming the trust as the primary or contingent beneficiary of your assets. Unfortunately, many people who invest time and money into creating a revocable living trust fail to do this. With some important exceptions, all of your real property, personal property and business interests should be funded to your trust. If your trust is not properly funded, many assets may still have to go through a probate proceeding after your death before eventually reaching your trust and its beneficiaries. We own real property in more than one state. Can we put all our property into one revocable living trust? Yes, and this is one of the advantages of a revocable living trust. Without a funded trust, not only will the property you own in the state where you are legally domiciled be subject to probate, but the real property you own in another state will go through an ancillary probate in accordance with that state’s laws. By funding both properties into your single living trust, you eliminate the need for both probate proceedings. How can I obtain help with funding my living trust? Your first resource is the attorney who drafts your estate planning documents. If necessary, your attorney can create a deed for any real estate placed into your trust, and assist in transferring non-real estate assets. Your CPA, CFP, or financial advisor can also help with completing forms to name your trust as a new owner or beneficiary. Considering the importance of funding your trust, it is wise to seek professional advice. Our trust is long and contains very personal information. Do we really have to provide a copy, just to fund it? A financial institution needs to know who has the authority to act on behalf of your trust as this information will insulate them from potential legal liabilities. Your attorney should prepare for you a Certification of Trust which shows the legal name of the trust, a list of the trustees and successor trustees, and the trustee powers. By Florida statute, any company doing business in the state must accept the Certification of Trust in lieu of the entire trust. Do we have to file a different income tax return for our trust? Assuming your trust is revocable, that is, you maintain control over it and can make changes to it until your death or legal incapacity, you will not have to file a trust income tax return while you are living. You can continue to file your single, joint, or separate personal tax returns using your Social Security number as usual. Upon your death, a separate tax return may be required for the trust. olor blindness is a disorder affecting the capability to see colors under typical light or to discern colors as they are normally seen. Generally, the condition is present at birth, but it can also result from old age or a number of diseases of the eye. The discernment of color depends on cones located in the eye. People are usually born with three kinds of pigmented cones, each of which perceives various wavelengths of color. When it comes to pigment, the size of the wave is directly linked to the perceived color tone. Short waves produce blue tones, middle-sized waves are perceived as green tones and longer waves are seen as reds. Which type of cone is affected impacts the spectrum and severity of the color blindness.

Because it is a gender-linked recessive trait, green-red color deficiency is more frequent in men than in females. Still, there are a small number of females who do experience some degree of color blindness, particularly yellow-blue deficiencies. Color vision deficiencies are not a debilitating condition, but it can impair educational progress and work performance. Not having the ability to distinguish colors as friends do can quickly and negatively impact a student’s confidence. For working people, color blindness could become a disadvantage when competing against peers trying to advance in a similar industry. There are several examinations for color blindness. The most common is the Ishihara color test, named after its inventor. For this test a patient views a plate with a circle of dots in various sizes and colors. Within the circle appears a digit in a particular tint. The patient’s ability to see the number inside the dots of contrasting colors indicates the level of red-green color sight. Even though inherited color vision deficiencies can’t be treated, there are some steps that might improve the situation. Some evidence shows that wearing tinted contacts or anti-glare glasses can help people to see the distinction between colors. More and more, computer applications are becoming available for regular personal computers and even for smaller machines that can assist users to distinguish color better depending upon their specific diagnosis. There are also exciting experiments being conducted in gene therapy to correct the ability to distinguish colors. How much color vision problems limit a person is dependent upon the type and severity of the condition. Some individuals can adapt to their condition by familiarizing themselves with alternate cues for colored objects or signs. For example, many individuals are capable of learning the shapes of traffic signs (rather than recognizing red) or contrasting items with paradigms like a blue body of water or green trees. Three Keys to a Successful Foreclosure Appeal By: Vanessa J. Bravo, Esq. and Omar J. Arcia, Esq. Foreclosure Defense, Bankruptcy & Appellate Attorneys

I

t’s important for homeowners to know that if they lost a foreclosure trial, they have the right to seek reversal of that ruling through an appeal. There are at least three keys to keep in mind and successfully appeal a negative trial court ruling. First, a homeowner must ensure that a court reporter is present at the trial or hearing from which an appeal may be taken. In most, though not all, scenarios, the appellate court will need a transcript of the hearing or trial in order to even proceed with the appeal. If the appellate court is being asked to review something that the trial court decided by hearing testimony and evidence, the appellate court will need a transcript of the proceedings in order to review what happened and make a decision. An exception to the need for a transcript of the proceedings exists where there is a summary judgment hearing instead of a trial. At this kind of hearing, judgment is entered based on the documents filed, so the appellate court can fully review the lower court’s basis for its decision without a transcript.

Second, most people don’t know that although a notice of appeal is filed, the foreclosure sale of the property will still go forward and the bank can still seek to collect any money due on the note after the property is sold, i.e., a deficiency judgment. In order to stop the sale after filing a notice of appeal, the homeowner must file the appropriate motion in the lower court based upon the filing of the notice of appeal. The plaintiff may insist that a “supersedeas” bond (appellate bond) be paid. In cases where the judgment is secured by real property, as in foreclosure cases, the law allows for the lower court judge to set a bond at any amount (including no amount at all), and requires that the judge hold a hearing to consider all relevant factors for setting a bond: the value of the property and whether the value exceeds the amount of the judgment, whether the homeowners occupy the property, whether the property is being rented, if the homeowners are paying insurance or maintenance assessments for the property, and whether the property is deteriorating, among other factors. Third, and most importantly, foreclosure appeals must be handled by attorneys experienced in handling the sale cancellation and supersedeas bond issues in the lower court, as well as identifying all potential errors to be raised on appeal. The balloon is placed empty endoscopically (through the mouth) under a mild sedative in a 20 minute procedure. The balloon is filled with saline inside the stomach.
