Happy Thanksgiving

A

round this time of the year , we take a deep

breath and wonder where the time went. The sweltering summer heat is slowly becoming an item of the past, the awesome summer vacation pictures and memories have moved to the back of our minds, and our kids have settled back into their school and sports routines. Now that the Halloween sugar rush has worn off, we are already in full preparation for the Thanksgiving holiday. Wow! Thanksgiving already? In the blink of an eye the entire year seems to have gone by. Another fantastic year of enjoying time with family, friends and neighbors, of being there for each other through good times and bad, and of enjoying each other’s companionship. As we sit down this year with our loved ones from near and far to indulge in a delicious turkey feast, let's give thanks for all the little blessings we have received throughout the year, let’s be generous to those who need our help, and let’s continue to enjoy each other. Happy Thanksgiving everybody! Sincerely, Sven Budzisch Publisher/Owner

On September 27th, Parrys Sommers was crowned Miss Miami Broward Carnival Queen in front of an energetic crowd at the Miramar Cultural Center. “Miramar always celebrates its cultural heritage,” said Miramar Mayor Lori Moseley. “The pageant is a great thing to do, and I enjoy the costumes. They’re so beautiful and so vibrant.” This was the ninth annual pageant, and the organizers from Caribbean Pageantry Inc. added a popular new wrinkle this year: a Little Miss competition for girls between the ages of seven and twelve. Imani Felix-Garvin won the inaugural Little Miss Miami Broward Carnival Pageant, as well as the People’s Choice and Desi Worrell “Spirit of Carnival” awards. Maneesha Puca was the Little Miss first runner up and Little Miss Photogenic, while T’Naya Albury was named Little Miss second runner up. Local Theater Company Launches New Play at Miramar Cultural Center BY JILL SHARPE

A

ct 2 Stage Productions , a local theater company who pres -

ents dynamic, life-changing, wholesome messages, is getting ready to hit the stage once again with their newest production called “Suddenly,” set to premiere at the Miramar Cultural Center on December 5th. Andre Sartin, a resident of Miramar and the theater companies Founder and Executive Director, said this production centers around the life of a young man that is sent home from the military because of a debilitating illness that has taken over his body. Coming home to an uncertain future at times becomes overwhelming to him and his young family. This drama/musical full of singing, strong acting and zany characters demonstrates how we walk out our faith even when life looks dim. Sartin, who is also the playwright, said the inspiration for this production was his pastor who also experienced a rough ride in the military but came home and not only survived but thrived and went on to accomplish great things. “I also drew from the feelings I experienced in my own family growing up in Chicago with a father who was ill but never really recovered like this guy did,” Sartin said. Act 2 Productions consistently looks to deliver creative, spiritual messages through its works. Sartin has written and directed 26 plays through his career and he does it all after he finishes a full day of work at another job. “This is my passion,” said Sartin. “When I am working on a play in the evening I feel like I’m just starting my day as the work gives me so much energy. I also strongly believe in the concept of pursuing the American Dream and I like to show my audiences that anything in life is possible.” Following the premiere in Miramar, “Suddenly” will be staged in Chicago in May and in Atlanta in July. To purchase tickets for the show in Miramar log on to www.miramarculturalcenter.org and click on box office. The theater is located at the Miramar Cultural Center Arts Complex, 2400 Civic Center Place in Miramar. To learn more about Act 2 Stage production, visit www.act2productions.net.

What is the Purple Purse Challenge? The Allstate Foundation is raising public awareness about domestic violence and financial abuse, so more survivors can break free and take steps toward financial freedom. The Foundation’s Purple Purse makes it easier for people to recognize the signs of financial abuse, talk about it and stop it. It helps victims gain control of their purse strings and their lives. Through December 20, our agency will be collecting new or gentlyused donations for Women in Distress. On Saturday, October 4, 2014, El Canario, Tito Puente, Jr. and Grupo Rush all hit the stage at Miramar Regional Park to perform for the approximately 2,500 people who attended the Latin Music Festival hosted by Vice Mayor Yvette Colbourne. “Miramar’s investment in Arts and Culture is a worthy investment that helps to promote tolerance and cultural awareness in our diverse city”, said Vice Mayor Colbourne. Attendees danced and delighted in the wonderful family atmosphere presented for this notable annual event. Plantar Fasciitis/Heel Pain By Neal M. Bullock, DPM, PA

P

lantar fasciitis is an inflammation of the

long band of connective tissue running from the heel to the ball of the foot. Heel spur syndrome is a bony overgrowth on the heel bone. Plantar fasciitis and heel spur syndrome affect women more than men. They can cause the bottom of the heel and arch to become painful.

Statistics

▸▸ ▸▸ ▸▸ ▸▸ ▸▸

▸▸ Plantar fasciitis and heel spur syndrome are the most common causes of plantar heel pain. 73% of patients with heel pain are diagnosed with either plantar fasciitis or heel spur syndrome. 15% of patients who see a podiatrist complain of heel pain. 90% of those who suffer from plantar fasciitis or heel spur syndrome respond to non-surgical care. 83.5% of the patients with plantar fasciitis or heel spur syndrome pain with first steps in the morning. Plantar fasciitis can occur with or without a heel spur present.

Causes

▸▸ Stretching to the long band of tissue that connects the heel and the ball of the foot ▸▸ Muscle imbalance ▸▸ Bone deformity ▸▸ Obesity ▸▸ Trauma ▸▸ Tightness of the muscles on the back of the leg

N

ew clients often believe that they do not

need a trust because their estates are small. Yet, nowadays, trusts are not only for the rich and famous. Why? Because it’s less about avoiding estate taxes and more about the protections that trusts can provide. I use the following scenarios to help clients understand why a trust is a very important element in nearly anyone’s estate plan: Meet our hypothetical family, George and Jenny, who have been happily married for 25 years with three children, Jessica, age 20, Josh age 15, and Jonathan, age 12. Both have a will. George’s will leaves everything to Jenny, and Jenny’s will leaves everything to George. After they are both gone, their wills leave everything to their children. Imagine George dies and all of his property transfers to Jenny. The following year, while rushing to an appointment on a rainy morning, Jenny loses control of her car and rear ends a school bus full of trial attorneys heading to the annual Ft. Lauderdale “I’ll See You in Court!” Convention. Several of the attorneys are injured and lawsuits follow. So now what happens to Jenny’s inheritance from George? It’s all gone to creditors. What is left to raise her children? Nothing. If George and Jenny had used a trust in their estate plan, the final outcome could have been different. While Jenny’s property would still be subject to creditor claims, her inheritance from George inside a trust could have been safe for her and their children. In our next scenario, Jenny dies and George later remarries Susan, a woman with four children from three previous marriages. When George passes, his property, including what he inherited from Jenny, could go to Susan and eventually be inherited by Susan’s children. Jessica, Josh and Jonathan might be completely disinherited! With a properly drawn trust, George and Jenny can rest assured that even if the surviving spouse remarries, when they are both gone, their money will go to their children. Now envision George and Jenny enjoying retirement and their grandchildren, but not liking Jessica’s husband, Robert. Jenny fears that their son-in-law will never earn a decent living and will depend on their daughter Jessica to support him for the rest of his life. George also worries that, if they leave a substantial inheritance to Jessica and she ultimately divorces Robert, a substantial portion of Jessica’s inheritance could be lost to Robert. If George and Jenny leave the inheritances to their children via a trust, these assets will not be commingled with their children’s marital property, and will not be the subject of division and distribution in the event of a divorce. These examples illustrate several ways trusts can protect assets from creditors and predators. Whether your family is like George and Jenny’s, a blended family, or has a completely different make up, you should discuss your needs and concerns with a qualified and experienced estate planning attorney to see how a trust can protect your loved ones and their inheritances long after you are gone. Bruce Iden earned his J.D. from George Washington University National Law Center and his L.L.M in taxation from the University of Miami School of Law. He has been practicing in the areas of estate planning and probate and trust administration for over 30 years. Protecting Yourself from Economic Crimes and Scams By Sheriff Scott J. Israel

N

o one can ever be completely safe from a

scam or identity theft – not even the sheriff of Broward County. Earlier this year, I received two checks in the mail from a company purporting that they owed me money from a past transaction. But there was a catch: the company explained the checks were written to me in error for more than the amount owed to me. All I needed to do was deposit the checks and wire the company the difference. I knew right away that something was wrong. I directed BSO detectives to investigate, and they instantly recognized the two checks were worthless. If criminals try to scam the sheriff, they will certainly try to do it to you! The most effective economic crime, however, is one in which criminals steal your identity. This is a growing problem affecting millions of Americans every year. Using advances in technology, criminals can obtain and use your personal information easier than ever for their own illegal intent. Your identity can be stolen in a variety of ways: from your trash, over the phone or online (including from the computer records of stores in which you have shopped at in person). BSO is helping in the fight against identity theft. We provide residents a convenient, safe way to dispose of personal documents, check stubs, credit card offers, receipts and other items that might contain sensitive data through our free, monthly Shred-AThon events throughout Broward County. For a list of upcoming dates and times in your city, please visit www.sheriff.org. BSO, in collaboration with the Florida Department of Financial Services, also works to protect our seniors from economic fraud and scams. Operation SAFE (Stop Adult Financial Exploitation) provides free workshops for seniors, their caregivers and families to empower themselves against scammers. To schedule an Operation SAFE workshop in your community, contact our Economic Crimes Unit at 954-321-4200. Remember, you are the best line of defense in protecting yourself against identity theft and scammers. Best of all, it is easy to do. Do not leave financial bills or letters with sensitive information in your mailbox or in your vehicle. Never to carry your Social Security card in your purse or your wallet. Carry only the ID and credit cards you need. Leave the others locked in a secure place. Do not give credit card or Social Security numbers over the telephone to strangers who may call you. These individuals may pose as a bank, charity, the IRS, the police or even a friend or family member. Use more complex passwords on all online credit card, bank and phone accounts, and use different passwords on different accounts. Never use identifying information, such as your mother’s maiden name, the last four digits of your Social Security number or your birthto Go $14.95 A portion date as passwords. If someone has stolen or is using credit cards or checks that belong to you, immediately notify the financial institution which issued them. If you feel like you have been targeted or were victim to a scam, file an immediate police report with your closest law enforcement agency, and place a fraud alert by calling one of the three national credit reporting companies (Equifax, Experian and TransUnion) that keep records of your credit history. Finally, obtain a free copy of your annual credit report (www.annualcreditreport.com) to ensure there are no unauthorized accounts associated with you. As sheriff, I am committed to stopping these criminals. With your help, by being proactive and aware, together we can even stop scams before they happen. For information, visit www.sheriff.org.

What is Color Blindness? By Michael Chesen, OD

C

olor blindness is a disorder affecting the

capability to see colors under typical light or to discern colors as they are normally seen. Generally, the condition is present at birth, but it can also result from old age or a number of diseases of the eye. The discernment of color depends on cones located in the eye. People are usually born with three kinds of pigmented cones, each of which perceives various wavelengths of color. When it comes to pigment, the size of the wave is directly linked to the perceived color tone. Short waves produce blue tones, middle-sized waves are perceived as green tones and longer waves are seen as reds. Which type of cone is affected impacts the spectrum and severity of the color blindness. Because it is a gender-linked recessive trait, green-red color deficiency is more frequent in men than in females. Still, there are a small number of females who do experience some degree of color blindness, particularly yellow-blue deficiencies.

Color vision deficiencies are not a debilitating condition, but it can impair educational progress and work performance. Not having the ability to distinguish colors as friends do can quickly and negatively impact a student’s confidence. For working people, color blindness could become a disadvantage when competing against peers trying to advance in a similar industry. There are several examinations for color blindness. The most common is the Ishihara color test, named after its inventor. For this test a patient views a plate with a circle of dots in various sizes and colors. Within the circle appears a digit in a particular tint. The patient’s ability to see the number inside the dots of contrasting colors indicates the level of red-green color sight. Even though inherited color vision deficiencies can’t be treated, there are some steps that might improve the situation. Some evidence shows that wearing tinted contacts or anti-glare glasses can help people to see the distinction between colors. More and more, computer applications are becoming available for regular personal computers and even for smaller machines that can assist users to distinguish color better depending upon their specific diagnosis. There are also exciting experiments being conducted in gene therapy to correct the ability to distinguish colors. How much color vision problems limit a person is dependent upon the type and severity of the condition. Some individuals can adapt to their condition by familiarizing themselves with alternate cues for colored objects or signs. For example, many individuals are capable of learning the shapes of traffic signs (rather than recognizing red) or contrasting items with paradigms like a blue body of water or green trees. If you notice signs that you or a child might be color blind, it is recommended to see an optometrist. The sooner you are aware of a problem, the sooner you can help. To book an eye exam for your child, contact Dr. Michael Chesen at 954-437-9733. Pearle Vision is located at 2909 Dykes Rd., in the Fountains of Miramar Shopping Plaza.

ACL Reconstructive Surgery By Dr. Al DeSimone

here are many views regarding indications for

ACL Reconstructive Surgery such as age, activity/demand level and degree of instability. Most individuals, especially moderate to high demand athletes, regardless of age, who have a complete tear of their anterior cruciate ligament, as well as clinical and functional evidence of instability, are candidates for ACL Reconstructive Surgery. When considering the pediatric or adolescent population, there has been extensive debate in the literature over the last ten years. Initially, treatment was consistent with bracing, rehabilitation and activity modifications (cessation of sports); however, due to the noncompliance of this patient population and their persistent knee instability with daily activities, these patients will often have further injury to the chondral and/or meniscal surfaces, resulting in degeneration and functional impairment. Non-surgical treatment in this patient population is not advised. When considering ACL Reconstructive Surgery in pediatric and adolescent patients, age and amount of growth remaining becomes vital, as this may tailor the technique used to reconstruct the child’s knee. The major consideration is the potential risk of injury to the growth plate/physis resulting in growth disturbance before skeletal maturity. One surgical option is a physeal (growth plate) sparing procedure, which is an allsoft tissue technique considered in the younger athletes because of their amount of growth remaining. This procedure is often non-anatomic but does improve functional stability and completely avoids the growth plates. Another physeal sparing technique in this age group describes the use of drilling superficial bone tunnels within the epiphysis. With the use of fluoroscopic guidance during arthroscopy, this technique secures the graft in a relative anatomic position, but still avoids the growth plates. In a slightly older child, since most of the growth comes from the femur, one may consider a partial transphyseal approach. In this procedure, the graft is brought through a transtibial (physeal) tunnel and is fixed to the femur in a near anatomic position avoiding the physis. A surgeon will often use an all-soft-tissue graft and fix the graft away from the femoral and tibial growth plates, thus, avoiding growth disturbances. Transphyseal anatomic ACL Reconstructions is considered in adolescents and adults, as well as those children who have minimal growth left. This allows for anatomic graft placement by creating tunnels at the native origin and insertion sites of the original ACL. With this arthroscopic technique the surgeon drills through the growth plates and depending upon the age of the patient, one may consider soft tissue (hamstring) graft or bone patella tendon bone graft to reconstruct the ACL. The type of tissue used and fixation technique will depend upon the patient’s skeletal maturity and growth remaining. My gold standard for skeletally mature teenage athletes and young adults is bone patella tendon bone autograft with intraphyseal fixation. When there is a contraindication to using intraosseous fixation I will use hamstring autograft and fix the graft away from the growth plates. These two techniques provide excellent stability with no growth disturbance. I would advise against the use of cadaveric (allograft) tissue in this younger population as there is a higher incidence of graft failure with return to high demand sports. There are few indications where non-surgical treatment is advised. First is in the low demand sedentary individual who doesn’t describe functional instability in their day-to-day activities. Next is the young athlete who sustains a partial injury to the ACL but still presents with good clinical stability. In these patients I closely monitor and follow their progress and often advise for the use of a custom de-rotational brace when returning to their sport. The last patient is that patient who is unable, for medical reasons, to pursue surgery because of the potential inherent risks of anesthesia. For these patients I will often advise a physical therapy program, bracing and activity modifications. Alfred A. DeSimone, MD, is a Board Certified Orthopedic Surgeon, Fellowship Trained in Sports Medicine. He Specializes in Complex Knee Ligament and Shoulder Reconstructive Surgery. He practices at the South Florida Institute of Sports Medicine at 1600 Town Center Blvd., Suite C, Weston. To schedule an appointment, please call (954) 389-9178. Three Reasons Why You Should Hire a Law Firm to Negotiate a Successful Short Sale By Omar J. Arcia Foreclosure Defense and Consumer Bankruptcy Attorney

R

ecently our law firm has been retained by numerous clients

who are being sued by their former lender after completing a short sale of their homes. They received what is called a deficiency judgment action. In other words, the lender (or some third party that purchased the debt) sued the homeowner for the difference between the amount owed under the loan and the amount of the short sale.

In every one of these cases, the homeowner was not represented by an attorney during the short sale process, but instead, chose to handle it themselves, or to allow a realtor to manage the entire process. Most realtors, however, are solely interested in “closing the deal” and receiving their commission, not in the most complete and favorable outcome for the seller/homeowner. Even though a realtor must be involved in listing the property and securing a purchaser, here are at least three reasons why you should hire a law firm to negotiate a successful short sale. ▸▸ Avoid the dreaded deficiency judgment. The principal reason to hire a law firm to handle a short sale is to avoid any deficiency judgment action by your lender after the short sale is completed. A qualified law firm, like the Arcia Law Firm, regularly negotiates “deficiency waivers” with lenders, and demands that the proper language and releases be included in the short sale approval letter in order to ensure that our clients do not have to contend with the costly defense of a deficiency action, collection hassles or have to file bankruptcy in the future. ▸▸ Lenders negotiate differently with a law firm. It is no secret that lenders behave differently when a law firm is involved in the short sale negotiation than when dealing with a realtor. An attorney understands the law and its implications for his/her client, and will not accept as true any unwritten promises by the lender’s short sale negotiator. The end result of a short sale negotiation using a law firm is that the terms of the deal are clearly outlined with no room for the lender to later change the terms. ▸▸ Quickly identify and clear title defects. The short sale process may be stalled or blocked altogether if issues arise with title defects on the property being sold. The Arcia Law Firm can quickly identify any title issues delaying a short sale, order a lien search, and clear any title defects in order to complete most short sales. Our law firm also closely supervises the actual closing in order to ensure that our clients’ rights are fully protected from start to finish during the short sale process. The Arcia Law Firm is privileged to represent dozens of satisfied clients in our community for whom we have successfully short sales. More detailed explanations of different options available to homeowners, including short sale information, are discussed in an instructional DVD developed by the Arcia Law Firm entitled “Fight For Your Home.” If you mention that you heard about the DVD through this magazine you will receive a FREE copy during your visit to discuss your case in detail with a member of our legal team. You may contact the Arcia Law Firm at 954-437-9066 to schedule your free personal consultation with Omar Arcia to discuss your case. You may also visit www.arcialawfirm.com for more information about the Firm, our staff and credentials, detailed articles, informative videos, and to make your appointment online.

MESSAGE FROM THE MAYOR

Why I’m Thankful Every Day Lori C. Moseley, Mayor

I

s it me or is time getting away from us? It seems

like yesterday we were getting ready to celebrate the 2013 Holiday season. I absolutely love this time of year. I get to spend time with my family while sharing stories and breaking bread. What I look forward to most however is reflecting on the year’s experiences. Learning with every challenge presented and discovering more about myself through it all! Being grateful shouldn’t be expressed during a holiday season or when things are going well. We should be thankful for the obstacles that define our will, character and drive us to persevere. As I reflect back on the year thus far I am grateful for the countless experiences and lessons learned. I am thankful for those that would test me and those that made me smile. Moreover, I’m simply thankful for each day I can wake up to learn all over again.

As the Mayor of the beautiful City of Miramar, I am thankful to have this platform where I’m able to share my life’s journey with you. So this holiday season, be happy, be merry but above all be thankful. Continue this throughout the year and may you all realize every dream and cultivate every experience! Yours Truly, Mayor Lori C. Moseley

The holidays may be especially difficult after experiencing

the loss of a loved one. What is usually seen as a time of joyous memories can become extremely painful. As it has been for 3 generations, keeping the needs of our community in mind is important to us. The Boyd-Panciera families and staff invite you to join us for two Special Holiday Support Events.

6:30pm · Registration and Refreshments 7:00 pm · Program- Rev. Bob Sands, Certified Grief Recovery Specialist; will speak on “how to deal with the stress of the holidays” In closing, we will share in a special “Candle Lighting Ceremony” in memory of your loved one.

Buddy is a 22-month old rescued Labradoodle. His favorite person is Aaron. The only time he barks is when he is demanding attention because we won’t play with him. He loves to play hide and seek and also loves to catch and burst bubbles. Buddy was last seen smiling and wagging his tail.

What is different about your shooting range? We created a true

entertainment experience. Our advanced virtual range, the Nexus Lanes, brings your shooting to the next level, while making it fun at the same time. Since the gun’s invention, people have been making holes in paper targets, which is of limited value when training and can become mundane over time. Our live fire technology lets you shoot your gun and real ammo at constantly updated interactive video targets, such as defensive scenarios, shooting galleries, zombie games, skill drills, asteroids and more. A computer provides instant feedback by scoring and analyzing each shot. We also have a standard paper target range. Additionally, we do weekly tactical and competition drills where shooters move and shoot through an obstacle course setup for real world training.
