Getting into the Holiday Spirit
T
ime is flying by and winter is at our door. While we generally do not get the snowflakes or the frosty winter temperatures, we do get the holiday season. The upcoming holidays may have different meanings for many of our readers due to their diverse cultural backgrounds and religious beliefs, but for all of us it should be a time to reflect on the year gone by. It is a time to think about all the big issues which have occurred throughout the year of 2015, as well as the little issues that happened. It’s a season to gage our own conduct. Have we made enough time to spend with our children and spouses? Have we reached out to our neighbors to lend a helping hand to those in need? Have we spent the time to be truly together with our parents, our family and our friends? This is the time to mend minor disagreements, to forgive and forget. This is also the time to remember those less fortunate, to teach our children to share our good fortunes with our loved ones, as well as those in need. There are families right here in our communities who need our assistance. Help make the season brighter for them by giving generously. And consider giving your children gifts they will cherish for a lifetime; the gift of love and the gift of giving. The holidays are the perfect time to teach your children to be thankful for what they have and to help others. For that is truly what the holidays are about. Credit Union Honors Police Officer For His Volunteer Work Rescuing Dogs and Feeding Kids at Ronald McDonald House BY JILL SHARPE
O
ver a five-week period this summer Tropical Financial Credit Union, in Miramar, invited the public to nominate a local hero—someone in the tri-county area who goes above and beyond to do things for the greater good of the community. A panel of judges sorted through nearly 450 nominations that were weighed using three main criteria: total community impact; the number of people positively affected by their actions; and the compelling nature of their stories. Scholes, an employee of the Miami-Dade County Police Department since 1989, emerged from the pack thanks to his long history of organizing dinners for kids at the Ronald McDonald House Miami and finding homes for rescue dogs – primarily German Shepherds. He was independently nominated by several friends and others who knew about his good works. Tropical Financial held a check presentation for Scholes on October 15— International Credit Union Day. He was presented with $2,500 in cash and a $1,000 donation to his favorite charity, Ronald McDonald House Miami. “For over 80 years, one of Tropical Financial’s

core values has been ‘people helping people’,” said Richard Helber, president and CEO. “ While we’re proud of our employees who help improve the financial lives of our members every day, we wanted to recognize those in our community who go above and beyond in helping others. That’s why we formed the League of Financial Goodness. When we work together, we create caring communities, which makes our community of South Florida a better place to live and work. I want to congratulate Elliott for being our League of Financial Goodness Local Hero and congratulate all of the nominees.” Scholes, a 51-year-old resident of northwest MiamiDade County, has organized and cooked monthly dinners for children and their families at Ronald McDonald House Miami for more than eight years. His relationship with the nonprofit began when he found out one of the patients enjoyed police cars and decided to pay the boy a visit, along with a few other officers, so he could enjoy their squad cars. That initial visit led to Scholes volunteering to cook an entire Thanksgiving dinner for the House. The monthly dinners began shortly thereafter. Each month, he‘s joined by a group of friends who help him cook, serve and pay for the meals.

“The Ronald McDonald House is near and dear to me,” Scholes said. “The volunteers who help me are amazing. Each month, I get fellow police officers, 911 dispatchers, family members and friends to commit their time. Seeing the smiles on these kids’ faces makes it worthwhile for all of us.” When Scholes is not working, volunteering at Ronald McDonald House Miami or spending time with his wife and 10-year-old son, he rescues and fosters dogs throughout South Florida. Over the last five years, he has located homes for more than 35 dogs, mostly German Shepherds. He personally covers veterinary costs, extensively reviews prospective dog owners and follows up with owners to make sure the dogs are receiving proper care and attention. “I am truly humbled and grateful to Tropical Financial and the individuals who nominated me for this honor,” Scholes said. “The ultimate reward for me is the time I get to spend with the wonderful kids at Ronald McDonald House and helping these dogs find a loving home.” One of Elliott’s nominators, Vicky Artel, summed it all up this way: “If he isn’t the best hero, I don’t know who is.”
Citizens’ Police Academy Celebrates 20th Anniversary SECTION HEAD Community News

ore than 200 graduates from Miramar’s Citizens’ Police Academy attended a reunion, held on September 26, 2015 at Miramar Regional Park. Graduates came together, along with police personnel and city dignitaries, to celebrate the 20-year anniversary of the program. Tania Rues, Public Information Office for the City of Miramar Police Department said, qualified Miramar residents interested in learning more about the Miramar Police Department and the field of law enforcement can sign up for the free 14-week academy. “Certified instructors provide citizens with a better understanding of the day-to-day operations of the police department,” Rues said. Class topics include: DUI enforcement, economic crimes, burglary investigations, juvenile and child abuse investigations, and the role of the Medical Examiner office. Demonstrations by the K-9 unit and laser/radar are performed; students also have the opportunity to participate in the ‘Ride-Along’ program, allowing them to ride with an officer during a regular patrol shift. The 41st class of the Citizens’ Police Academy is scheduled to begin in February 2016. Classes meet every Tuesday from 7:00 p.m. - 9:00 p.m. Interested Miramar residents who want to apply can call 954-602-4351, pick up an application in person at police headquarters or download an application at www.miramarpd.org.

It happens every third Thursday of the month through the month of May. According to Tamara Gant, Communications Program Producer for Miramar, other cities such as Ft. n Tuesday, October 27, 2015, Sunset Lakes Elementary inducted nineteen students into their chapter of the National Elementary Honor Society. The nineteen students were chosen based upon criteria that included, but wasn’t limited to, academic achievement, community service, leadership and demonstration of responsibility. The induction ceremony was hosted by Principal, Marc Charpentier and Assistant Principal Designee Denise Lizano as well as the chapter advisors Mrs. Aileen Soto and Ms. Beth Register. The four pillars were represented by Sylvia Correa, acting Principal at Discovery Elementary who spoke about Responsibility; Patricia Good, Chair, School Board of Broward County who spoke about Service; Sandra Nelson, Principal at Dolphin Bay Elementary School who spoke about Scholarship and Tammy Gilbert, Principal at Silver Lakes Elementary who spoke of Leadership

s we kick off the holiday season, I wanted to pause and wish Miramar the best during this Holiday season. This time of year presents each of us an opportunity to reflect, spend time with our families and perhaps take a well deserved vacation. As you celebrate the holiday season, I invite you to some great events and activities coming up in the great city of Miramar for the holiday season. The Tree Lighting Ceremony at Shirley Branca Park in historic Miramar takes place on Saturday, December 5th from 6 p.m. – 9 p.m. Join us on the East side of Miramar for a Holiday Show, mini carnival, ice skating, food vendors and a special guest from the North Pole! If you’ve visited Town Center recently, you see those trees have already been lit and are shining bright. On December 9th, we will have a groundbreaking ceremony for the Miramar Regional Park Amphitheater. This is exciting as it sets the City on a path to being a cultural destination for residents and visitors. Our employees will celebrate the holidays together during the annual Employee Appreciation Denim and Diamonds Party where they will also showcase their talents. The senior community from the Multi-Service complex, will have their gathering filled with music, dance, and so much more. This is a very active group that takes part in a number of activities on a daily basis. If you know someone in that age group who would enjoy meeting new friends and being active, have them visit. In the constant effort to control costs, many centers start cutting back on a very important part of the equation, safety. Helpful Tips for Landlords and Tenants in Florida By Vanessa J. Bravo and Omar J. Arcia
A
t the Arcia Law Firm, we are familiar with both residential and commercial landlord tenant law, and with the different strategies involved in filing an eviction action as a landlord, and defending one as a tenant. There are important considerations in each. On the landlord side, the proper time to file an eviction action is critical, whether it be due to a failure to pay rent, or due to a tenant staying after the expiration of the lease. One situation requires a particular kind of 3-day notice and the other does not. In fact, serving a 3-day notice on a holdover tenant can be construed as a renewal to the lease, an invitation to stay, and an extension of the lease. Many people also do not know that holdover tenants are liable for double the amount of monthly rent, due at the end and not the beginning of each holdover month. A proper notice advising of such holdover tenancy prior to the expiration of the lease is a valuable tool to ensure that tenants vacate on time, or pay the costly price for staying without permission. Tenants also need to know under what conditions the landlord is entitled to keep their security deposit, and in which situations a tenant may legally withhold payment of rent. Each scenario is described in Florida’s Residential Landlord Tenant statute. It is the landlord’s duty to maintain the premises, but it varies depending on whether the residence is a single-family home, a duplex, or a dwelling unit.
For example, renters of single-family homes and duplexes need to maintain much more than the dwelling unit tenants, including their own heat, pest control, and garbage removal. However, the lease itself may provide for a wider range of landlord’s duties. Finally, it is very important to note that any tenancy lasting any time over one year must be in writing. Rights and duties pertain to all tenancies, whether they exist under a written or verbal rental agreement. A tenancy pursuant to a verbal agreement has to be ended in a particular way, depending on whether it is a week-to-week or month-to-month tenancy. Whether you’re a landlord or a tenant, we can guide you through an eviction lawsuit and can also determine if the lawsuit is more properly an ejectment action, which is filed when the occupant of the premises is occupying the property not pursuant to a lease but because of some other ground that gives the occupant the belief that they have the right to occupy the premises. o you’ve found the home of your dreams and it looks like it’s in pristine condition. Now you’re thinking of skipping the home inspection process in order to save money. More often than not, this turns out to be a costly decision that ends up costing more than the price of the home inspection itself. Believe it or not, home inspections are a significant part of the home buying process. Although everything your eyes can see in this home is in working condition, buyers need to be certain that everything that you don’t see is also in good operating order. For example, buyers need to know that the roof is watertight and the air conditioning and heating system is in good working order. A thorough home inspection safeguards you against this before you “inherit” these potential issues. If you choose not to have a home inspection, the problems eventually becomes yours after the sale. It’s to the advantage of the buyer to know what to expect from a typical home inspection. There is no uniform certification of licensing process for home inspectors in the state of Florida; therefore home inspections tend to differ from one company to the other. Home inspections commonly include a comprehensive report on the property’s heating and cooling system (the age, condition and expected life span of the unit or parts of the unit), plumbing and electrical systems, appliances, walls, windows and doors, ceiling, flooring, roofing and the foundation. Most inspection companies have affiliated licensed professionals, like roofers and pest control companies that provide an official analysis that is included in the cost of the inspection. Home inspections usually run between $300 to $500, which is usually dependent on the size of the property, its age, and the type of home. Inspections can cost more if additional services to the typical inspection are required. That might include a four point inspection on older homes that may be required by insurance companies that focuses on the following: heating and air conditioning, electrical wiring and panels, plumbing connections and fixtures, and the roof. It is important to note that a typical home inspection usually covers only relative or potentially serious issues. Some issues, such as mold or defective drywall, may need further examination from a licensed professional that could potentially cost an additionally one to five thousand dollars. So, what do you have to look for in a home inspection company? One of the first things to note is that the State of Florida does not have a certification or licensing process for home inspectors. As a general rule, the home inspector you choose should hold a license in home construction such as a general contractor license or have some knowledge in the construction industry. Additionally, look for home inspectors that are members of the American Society of Home Inspectors (ASHI), a nationally recognized organization that requires a certain level of expertise and competency from their members. I recommend that a buyer accompany the inspector during the examination, so that one can learn more about the maintenance and preservation of the house, ask questions, and get a real sense of the any immediate and potentials issues that could arise after the purchase. Several years ago financial institutions lobbied the Florida legislature to change the applicable law to protect banks and brokerage firms from liability if a durable power of attorney is misused or forged. The new law suggests certain “magic” language which, if included in the durable power of attorney, provides this protection. If your document was drafted before 2011, it most likely does not contain this magic language. While some financial institutions may still accept your durable power of attorney, it is much more likely that they will not. Another change to the law, which took effect on October 1, 2015, affects your health care power of attorney. The Florida legislature has revised the law to clarify confusion surrounding when a health care power of attorney becomes effective. Your health care power of attorney can be effective immediately, but only if you so designate. If not, your treating physician must first determine that you are unable to manage your own care before they will take instruction from your designated agent. The new law also offers new choices in terms of designating a health care surrogate for a minor child. Because of this change in the law, there is new language that should be part of your health care power of attorney. How do I know if laws have changed that may affect my estate planning documents? The best way to is to contact your estate planning attorney and schedule a periodic review of your plan. Many attorneys provide maintenance programs and will affirmatively contact their clients if relevant laws change. While there is a fee to belong to a maintenance plan, there are usually no charges for required document updates. We highly recommend that you review your documents regularly, and update when necessary. Why risk potential problems or delays with your document when you may urgently need it. Bariatric Surgery â&#x20AC;&#x201C; An Effective Way to Lose Weight A third option, adjustable gastric banding, is not widely used today because it does not have the same long-term effectiveness of the other two procedures, but some patients still prefer it. For people who need to lose weight but have been unsuccessful with diet and exercise, there are procedures known as bariatric surgery that can help. Types of bariatric surgery There are three main types of bariatric surgery. All are done laparoscopically (minimally invasive) and only require the patient to be in the hospital for one day. Most patients do very well with these procedures and can return to work in about 2 weeks. The procedure with the longest track record is gastric bypass, in which a small pouch is created, restricting food intake, and bypassing a segment of the small intestine. This limits the amount of food intake and its absorption. Another option is to have a gastric sleeve, in which only the size of the stomach is limited. This option requires patients to follow dietary changes more closely.
Very recently another option has been approved for people with less severe cases of obesity: the intragastric balloon. This is a non-surgical procedure, in which a balloon is inserted into the stomach via an endoscopy, under light anesthesia. The balloon is removed in a similar way after six months, and nutritional counseling continues for one year. To be a candidate Ideal candidates for bariatric surgery have a Body Mass Index (BMI) of 35 or higher, as well as a weight-related condition, such as diabetes, sleep apnea, high blood pressure or heart disease. Patients who have a BMI of 40 or higher can have the surgery even if they do not have any coexisting conditions. Additionally, for consideration of the intra-gastric balloon, candidates would have a BMI of 30-35. Getting started At Cleveland Clinic Florida, patients who inquire about bariatric surgery are asked to attend one of our free seminars â&#x20AC;&#x201C; usually offered twice a week â&#x20AC;&#x201C; so they can learn about the procedures and start to discuss insurance issues. After that, they come back for an individual appointment at which a complete physical is done, as well as consultation
to discuss which procedure is best for them. Patients also attend a physician-directed nutrition class. The next step is to await clearance from their insurance company, which may have additional requirements, such as losing weight on a supervised diet prior. This can take 3 to 12 months. A final step is for patients to receive approval to proceed from their primary care physician and any specialists they may be seeing, such as cardiologist or a diabetes specialist. Success Overall, our patients lose about 70 percent of their excess weight in the first 18 months following surgery. The intra-gastric balloon leads to a 2530% of excess weight loss. Many see dramatic improvements in their other health problems as well. Patients who continue to follow the nutritional plan and come for annual follow up appointments as recommended usually keep the weight off for life.
