he U.S. Green Building Council (USGBC) South Florida Chapter has recognized the City of Miramar as the 2016 recipient of its Outstanding Green Local Government category. Nominees were evaluated on the ability to show a commitment to integrate a culture of sustainability and growth into their municipal operations and community lifestyle. This included exhibiting a documented ability to lead, advocate and advance the mission of the U.S. Green Building Council. The qualifying region spans the geographical boundaries within Indian River, Okeechobee, St. Lucie, Martin, Palm Beach, Broward, Miami-Dade and Monroe Counties; finalist cities included the City of Coconut Creek, the City of Miami Beach and the City of Miramar. The City of Miramar submitted more than 10 ½ years of responsible green efforts that showcased an ability to redesign and recalibrate its policies to reduce its ecological footprint, pursue sustainable opportunities and most importantly seek out an understanding of how a municipality can affect its surrounding environment and the immediate community. “The City is well aware of the importance of the ‘built environment’ -- it is for this reason why City representatives have been advocates of the US Green Building Council and the USGBC South Florida Chapter for almost a decade,” said City Manager, Kathleen Woods-Richardson. American Tennis and Education Foundation Gets Memorandum of Understanding Affirmed for Tennis Hall of Fame Museum at Miramar Regional Park BY JILL SHARPE

n November 3rd, City of Miramar Elected Officials passed a vote of confidence in support of a Memorandum of Understanding (MOU) between the City of Miramar and the American Tennis & Education Foundation, Inc. (ATEF), a Florida Not-for-Profit Corporation and Member Club of the American Tennis Association. The non-binding MOU lays the foundation of the ATEF’s unsolicited proposal that includes locating the ATEF National Tennis Center, Tennis Hall of Fame Museum, and a Hotel at Miramar Regional Park (16801 Miramar Parkway). This project would be inclusive of an American Tennis Association (ATA)/ATEF Administrative Office and a National Training and Competition Facility subject to City zoning and other applicable rules and regulations. The MOU was requested as a progressive step to memorializing an outline on the project’s scope, anticipated construction, funding schedules, and estimated costs during a Commission workshop on July 6, 2016. “The potential of Miramar to be the home of the American Tennis Association and Black Tennis Museum is amazing,” said City of Miramar Mayor Wayne Messam. “This development is consistent with the expansion of cultural tourism in Broward County and the vision of making Miramar a destination city, while offering access to the highest level of tennis training to our Miramar community. “Walk to School Event” Promotes Pedestrian Safety

O

n October 9, 2016, students at Sunshine Elementary School participated in the “Walk to School Event” to promote pedestrian safety. The tradition - organized by the group, Partnership for a Walkable America - started in 1997 as a one-day event to encourage communities to implement policies to make it safer to walk to school and has significantly grown throughout the years. This year, was the first year that Sunshine Elementary participated in the event. The event was an amazing success as they had over 110 students and parents as well as City Commissioner Mrs. Yvette Colbourne in attendance. During the event the school staff was able to reiterate the fact that walking to school keeps kids active and provides an opportunity to learn about pedestrian

safety and the importance of fully utilizing the services of the school crossing guards. This was also a great opportunity for the schools Resource Officer to discuss ways in which parents can assist Sunshine Elementary in ensuring that students are safe as they transition to and from school each day. The Walk to School Event was also a great opportunity to bring residents of the community together. “This was a perfect day to encourage children to engage in physical activity while enjoying their morning walk to school, especially as we continue to keep our streets safer,” said Denise Dorsett, Intern Principal.

Dolphin Bay Elementary School’s PTA Raises $50,000 for New Addition to Playground SCHOOL NEWS

n October 26, 2016, close to 100 students, parents, teachers and community members, including representatives Manny Diaz, Launa Carbonell on behalf of the Vice Mayor of Broward County, Barbara Sharief, District 2 School Board Member, Patti Good, and members of Everglades High School marching band, as well as the color guard, gathered for a ribbon cutting ceremony for the newly constructed shade for Dolphin Bay Elementary’s main playground. The idea to provide a shade for this playground was first initiated in 2014 under the leadership of Jorge Solis, the Dolphin Bay Elementary PTA President at that time. The following year, under the leadership of PTA President, Kate Alvarez, and with the unwavering support of the school’s principal, Sandra Nelson, the bulk of fundraising, as well as receiving support from the school community, occurred. “The journey was full of obstacles,” said Alvarez. “Thankfully, we were surrounded by people who believed in us and the project, people who helped us overcome each one of them.” And, overcome they did! Under the leadership of this year’s DBE PTA President, Sonia Betancourt, they were finally able to make this dream become a reality. The PTA raised $42,000, and one of their sponsors, Dr. Gottlieb of Miramar

Dermatology, worked with PTA Board member Jessica Shuman, to successfully write a grant that awarded the school $8,000 from the American Academy of Dermatology. “The mission of the PTA is to make every child’s potential a reality by engaging and empowering families and communities to advocate for all children,” said Betancourt. “Dolphin Bay Elementary’s PTA does many fundraisers throughout the year to support projects like these, but all of it always goes back to the children. This project has been a long and arduous one, but we want the children to know that if you have a dream, and believe in it, it can happen! Perseverance, passion, determination and teamwork made our dream happen!” The Dolphin Bay Elementary PTA is grateful to the school staff, students, sponsors and community members for all the support they received. The PTA wanted to leave a message for future generations that enter Dolphin Bay Elementary. So, they had artists Michelle and James Morse, create a mural of a dolphin going through a wall with the following message written by Michael Jordan: “Obstacles don’t have to stop you. If you run into a wall, don’t turn around and give up. Figure out how to climb it, go through it, or work around it.”

Three Schools in Miramar Get Set to Implement Prestigious College Prep Program

he future looks bright in the Everglades Zone! On October 21, 2016, Principal Ricardo Santana of Glades Middle School and members of the Glades Middle Administration hosted an Innovation Zone Meeting. During this meeting, Principal Santana, Principal Dunbar of Everglades High School and Principal Charpentier of Sunset Lakes Elementary announced they are implementing Broward County Public School’s first PK-12 Cambridge Curriculum.

The Cambridge Curriculum also known as the Advanced International Certificate of Education is a rigorous college preparatory program. The AICE is an innovative method of academic study offered solely through the University of Cambridge in Cambridge, England. Upon completion of the curriculum, students will earn a prestigious AICE diploma which is recognized worldwide as a gold standard of excellence. This educational journey will

begin with elementary students learning the fundamentals of inquiry and project based strategies which is designed to engage active and creative learning. As they progress to middle school they will continue and expand on the fundamentals while adding on interdisciplinary and student research work products. During the high school years students are given the flexibility to choose a course of study that best meets their abilities and interests. They are able to create a schedule of courses that are relevant to their future goals. Principal Santana said he was excited to partner up with Sunset Lakes Elementary and Everglades High School to bring the Cambridge Program to our students in the community. “The PK-12 Cambridge concept will create greater connectivity between schools, a sense of coherence, and an opportunity to accelerate learning for our students,” Santana said.

Fairway Elementary Student Honored at School Board’s “Just Do It...I Did” Ceremony BY JILL SHARPE

O

n October 13, 2016, Ruth-Ann Brown, a third grade student at Fairway Elementary, was acknowledged at the “Just Do It, I Did” ceremony through the School Board of Broward County. The Exceptional Student Education and Support Services Division of the Broward County School District created “Just Do It” in 1999. It is a campaign to recognize and honor the achievements or improvements of students with disabilities in a variety of areas. This campaign is part of Disability and History Awareness weeks, which are the first two weeks in October. Ruth-Ann, started school at Fairway Elementary in first grade and has an Autism Spectrum Disorder, according to her teacher Miriam Cushanick. For the first two years at Fairway Elementary, she was in a Special Programs selfcontained classroom. She was able to achieve so much success and improvement though that she is now receiving gifted academic instruction in the general education setting for much of her day. “I chose to submit Ruth-Ann to receive the “Just Do It.. I Did” award because I felt she should be acknowledged for all the hard work she has put in to overcome academic and behavior issues,” said her Cushanick. “Ruth-Ann now utilizes learned coping skills to manager her emotions. She is a motivated learner. Her other teachers describe her

as a pleasure to have in their class and the other students in the Special Programs class look to her as a role model and say they want to be able to go out to mainstream like Ruth-Ann,” Cushanick said. id you know that age related macular degeneration (AMD) is one of the foremost causes of vision loss in individuals over the age of 65? AMD is a condition that affects the macula of the retina which is responsible for clear central vision. Age Related Macular Degeneration Indications The first warning signs of AMD are often fuzzy vision and spots in the center of vision. Since the symptoms typically come on slowly without any pain, symptoms may not be detected until more severe vision loss is apparent. For this reason, it is very important to schedule a routine eye examination, particularly after the age of 65. What are the Risk Factors for Age Related Macular Degeneration? If you are of Caucasian decent, over 65 years of age, a smoker who consumes a diet low in nutrients or has family members that have had AMD, you are at higher risk of developing the disease. Any individual that is at increased risk should make certain to have a yearly eye exam. Discussing proper nutrition with your optometrist can also help lower your risk of developing AMD. Dry AMD and Wet AMD In general, AMD is typically diagnosed as either dry or wet. The dry form is found more frequently and may be a result of advanced age and macular tissue thinning or pigment build-up in the macula. The wet form is also known as neovascular age related macular degeneration. It results from the growth of new blood vessels beneath the retina, which leak blood that destroys the retinal cells and results in blind spots in the central vision. Often wet AMD is the more serious of the two. Macular Degeneration Treatment While there isn’t cure for AMD, certain treatments exist that can delay the progression. Depending on whether one has dry or wet macular degeneration, the course of treatment may involve laser surgery or medical injections or in some cases, dietary supplements. In either case, early detection and treatment is essential. Dr. Chesen will also be able to recommend devices to help you deal with any visual difficulty that you have already sustained. Vision loss that cannot be corrected by eyeglasses, contact lenses or surgical procedures is called low vision. There are a growing number of low vision devices that can be used today that can make everyday activities easier.

How Homeowners Can Overcome Landmark Florida Supreme Court Foreclosure Decision Favoring Lenders BY OMAR J. ARCIA, ESQ. FORECLOSURE DEFENSE, BANKRUPTCY AND CONSUMER ADVOCACY ATTORNEY

O

n November 3, 2016, in the case of Bartram v. U.S. Bank N.A., the Florida Supreme Court ruled in favor of lenders in a decision that homeowners’ advocates say will create renewed uncertainty for borrowers about whether they can stay in their homes. In a nearly unanimous decision, the Court determined that mortgage lenders can file new foreclosures against borrowers who won their cases more than five years ago if the borrowers defaulted again within five years of the first case’s dismissal. Homeowners argued that banks should abide by the same limitations period as every other litigant in the State of Florida. The Supreme Court, however, showed its true colors by essentially carving out a “bank friendly” exception to the five year rule in mortgage foreclosure cases. The Court made it clear that, for purposes of the statute of limitations, whether the prior foreclosure action was dismissed with or without prejudice has no bearing on whether a lender may file suit on a separate default (i.e., a new non-payment event). Also, where there is a new default post-dismissal, the lender can file a second (or third, or fourth, and so on) foreclosure and accelerate the entire debt, as long as it does so within five years of the new default. In short, this means a lender that filed previous foreclosures that were dismissed can now send out a new non-payment letter to the homeowner and keep foreclosing for the entire amount due as many times as needed until the borrower either reinstates the debt, modifies the loan, or loses the house at a foreclosure auction. The Supreme Court decision will result in a new round of foreclosures throughout Florida, reigniting collection on thousands of loans that had been in a holding pattern due to prior dismissals, and will have a major impact on borrowers whose foreclosure cases were dismissed and who thought they owned their homes “free and clear.” There are several ways to defend the anticipated assault on Florida homeowners by lenders. First and foremost, retain qualified foreclosure defense counsel with years of experience and a successful track record in court, such as the Arcia Law Firm. Next, you can short circuit a new foreclosure filing by initiating a well-documented loan modification application with assistance of counsel. Under guidelines by the Consumer Finance Protection Bureau, a loan servicer may not initiate a foreclosure action while it is in the middle of reviewing a borrower for modification. If a foreclosure is filed, you must be prepared to aggressively defend the action, raise every available defense and counterclaim under law in order to negotiate a settlement or prevail at trial. Is There Ever a Right time to Buy or Sell Real Estate? BY PATRICK SIMM

I

f there is ever the right time to buy Real Estate, it’s now! Interest rates are still at historical lows and the market is in the midst of a shift, as it moves towards a stable market, whereby neither buyer nor sellers have the edge. The edge lies within the price and condition of the property being sold. At this point in time, Buyers who “sit on the fence” waiting for the home prices to decline have another surprise coming to them, as home prices are on the cusp of stabilizing and are appreciating at the historical average of 4% to 6% in most areas. The other challenge that exists for buyers that are currently “on the fence” is that mortgage interest rates have been slowly rising within the last few months. At the time of writing this editorial, rates are an average of 3.75% for a 30-year fixed rate loan. What buyers are not taking into consideration is the effect that the interest rates have on them as purchasers. How does this affect the buyer? The collective mentality of the average buyer is to postpone the purchase in order to either save more for either a larger down payment or wait for the prices to either stabilize or correct/fall. What is not being taken into consideration is the fact that for every one percent increase in the interest rate, there is a 10% decrease in the buyer’s purchasing power. For example, a buyer who can afford a $300,000 home at today’s rate will only be able to afford one at $285,000 if the rates go up by 0.5%, and one at $270,000 if the rates go up by 1.0% from the current rate. This is something to think about if you are one of these buyers with the above mindset. Given the opportunity to purchase, I would certainly move forward in the buying process. Over time, once becoming a homeowner, the “American Dream” will take care of itself in monetary appreciation, as it always has over a period of time.

When is it the right time to sell? Depending on the circumstances that create the motivation to sell, the right time is now! Why? The market, as I mentioned, is currently experiencing a shift from a total seller’s market into a more stable one. Buyers are just “sitting on the fence,” while the available housing inventory is slowly rising. At some point in time, within the next several months, the Law of Supply and Demand is going to kick in. There is no doubt that buyers will have a wider selection of homes to choose from as history repeats itself! So, if there is a need to sell, price and condition is what counts. Sellers that are “testing” the market end up frustrated and, more often than not, lose time, effort and money in the consequence. Some Thoughts on Legacy

L

egacy means so much more than the assets we leave behind in the form of an inheritance. Most of us never give much thought to what our legacy might be. We think about a will, or trust, that carefully lays out how our property is distributed after we are gone. It’s usually about our “stuff.” Interestingly, studies on adults and their inheritances may surprise and disappoint you. The Journal of Family and Economic Issues reported that adults who receive an inheritance save only half of what they receive. Other studies point to statistics showing virtually all money or property left to love ones in the form of an inheritance is consumed within 14-17 months. So thinking in terms of money and property, a legacy has a very short shelf life. With that in mind, let’s explore other ways to leave a legacy that will live on long after you are gone. Charitable Giving. Making charity a part of your estate plan does two important things. Most obviously it provides support to a cause or causes you deem important. But it is also a teaching moment for your loved ones; it reinforces the importance of providing for the greater good. Many of us have made quiet personal promises to support a charity or cause “later,” or “when we can better afford it.” Making room in your final wishes for charitable giving answers those promises. Aside from the tax advantage charitable bequests generate, this selfless act can echo for generations. Many people leave a percentage of their estate to charity instead of a specific dollar amount. By leaving a percentage, your family and charity will receive proportionate shares regardless of how large or small your estate is. Instead of leaving money to a charity in a will, you may also consider naming a charity as a beneficiary of an insurance policy or retirement plan. Ethical will. An ethical will has ancient origins, originally appearing in the Book of Genesis when a dying Jacob spoke with his sons to share wisdom and his hopes for how they should live their lives. Originally, ethical wills were communicated orally, but were later written as letters. Today, ethical wills are known as “legacy letters.” It is a way to communicate to loved ones your hopes and dreams, regrets, and lessons learned. Often apologies are offered and forgiveness is sought. Family lore, favorite jobs, funny stories may all be part of your letter. A well-circulated legacy letter was written by President Obama to his daughters on the eve of his first inauguration. Think of a legacy letter as a way to pass long not only wisdom, but your love to a future generation. Estate planning is a deliberate, premeditated act of love. Life can change in an instant.
