Happy Valentine’s Day!

W

ow, time surely flies! New Year’s celebrations are already a month in the past and 2016 is in full swing. While our neighbors in the Northern states are scraping ice from the windows of their cars and shoveling the snow in their driveway, we enjoy the warmth of the Sunshine State. The kids are busy with school and afterschool activities, parents are busy at work, and we are all dreaming about summer vacations. This is also the time of year when we make plans for a special evening with our Valentine. While we contemplate which gift we should purchase for them or which restaurant we shall visit, we need to remember that the monetary value of a gift is a secondary notion. The most important point is that it is a gift that comes from the heart -- and there is no better gift then spending valuable time with the ones we love. This February, give from your heart and enjoy each other’s company. Happy Valentine’s Day everyone! Sincerely,

18th Annual Arts and Crafts Festival in the Pines Is Still Seeking Artists and Vendors By Debby Teich

I

t is not too late for artists and vendors to participate in the 18th Annual City of Pembroke Pines Arts and Crafts Festival in the Pines on March 12 and 13. The Festival will be held at a new location - the City of Pembroke Pines Academic Village. In addition to fine arts and crafts, there will be entertainment, food, arts and crafts fun for children, and much more. The deadline to submit an application is March 4. “The festival offers a great opportunity for artists and patrons alike to purchase and sell fine art and crafts,” said Holly Bonkowski, Division Director of Cultural Arts for the City of Pembroke Pines. “It also showcases music, a hands-on art children’s area and demonstrations by local artists.” Over 100 artists from around the country are expected to participate in the festival, which is presented by the City of Pembroke Pines Recreation & Cultural Arts Department and Pembroke Pines Arts & Culture Advisory Board. They can enter in the following categories: paintings, drawings, photography, wood, glass, mixed media, sculpture, plants, jewelry, musicians, and fine hand crafts. The cost is $175 for a 10’ x 10’ booth and $325 for a 10’ x 20’.

Artists will be eligible to win $500 for Best of Show, as well as $350 in seven categories, including painting, drawing, photography, wood, sculpture, glass and mixed media. Ribbons will also be awarded for plants, jewelry, fine hand crafts and musicians. More than 15,000 people are expected to attend the two-day show. Carlos Fuenmayor created “Knightopus,” the poster used to promote the 18th Annual Art Festival in the Pines. It won in both the poster and painting categories in the Annual Glass Gallery Art Competition held in early October. A limited number of posters will be on sale at the Festival with the proceeds benefiting art and culture in Pembroke Pines. The City of Pembroke Pines Academic Village is located at 17189 Sheridan Street. For artist or vendor applications, contact the City of Pembroke Pines Fletcher Art & Cultural Center, located at 7960 Johnson Street; call 954-986-5037; or visit www.ppines.com.

Carlos Fuenmayor’s “Knightopus” will be used to promote the 18th Annual Art Festival in the Pines.

pproximately 80 Pembroke Pines Police Department Citizen Police Academy (CPA) alumni recently shared stories and reconnected as they celebrated the program’s 20th Officer Manny Salinas; retired CAU Officers Valerie Toth and Clarence Wilson; PSA Cheryl Watters; CAU Officers anniversary with Andrew Feldman and Victoria Lima; and Sergeant Jim Henry dinner, entertainment and awards at the Southwest Focal Point Community Center. The evening kicked off with Mayor Frank C. Ortis, Vice Mayor Iris Siple, Commissioner Jay Schwartz and Police Chief Dan Giustino thanking residents and guests for their continued support of the program. CPA alumnus Bruce Eisner presented Leo G. S. Holland with a certificate for becoming an Honorary Lifetime CPA member for his role in 1995 as the founding CPA alumni. Also recognized were retired Pembroke Pines Police Officers Clarence Wilson, Valerie Toth and Sergeant Mike Arnett, who were instrumental in the founding of the CPA program. “Our Citizen Police Academy is an outstanding example of the Police Department’s partnership with the community,” said Daniel Giustino, Chief of the Pembroke Pines Police Department. “Citizens completing the academy have the opportunity to become a member in any of our community service programs, such as Community on Patrol, Parking Enforcement, and the Civilian Emergency Response Team. We are very proud of the success of our Citizen Police Academy Program.” Twice a year, the Pembroke Pines Police Department offers the 15-week class for people, 18 and older, who live or work in Pembroke Pines. It meets on

Thursdays, from 7pm to 10pm. There is a nominal fee, which includes a notebook, shirt, weekly refreshments and a graduation ceremony. The next class will be held from February 4 to May 19, but it is already CPA alumnus Bruce Eisner presented full. Organizers are Leo G. S. Holland with a certificate. already taking names for the fall class. The course includes both classroom and field instructions. Attendees get to ride along with a police officer and attend a firearms instructions course. They participate in role reversal scenarios, so they can gain an appreciation for how quickly police officers need to respond. They learn about patrol operations, traffic radar and crash investigations, defensive tactics, homicide investigations, patrol weapons, internet fraud and ID theft, domestic and juvenile investigations, CERT, and crime prevention. They also learn about several specialized units, such as the Crisis Response Team, K-9 Unit, Dive Team, Patrol Operations, Crime Scene, Computer Forensics, Homeland Security, Detective Bureau, Dispatch, and more. Through the years, many of the CPA graduates have become volunteers for the Pembroke Pines Police Department. They work as community patrols and parking enforcement specialists. They also work in the front office, help with finger printing, hand out safety materials at events and more. Heart Smart Lifestyle Changes: Reduce Heart Disease Risks As the number one killer in the United States, heart disease continues to pose a significant risk for all Americans. But, what if you discovered that initiating simple lifestyle David Lopez, MD changes could make a world of difference in preventing the disease? Well, it’s a fact. According to the American Heart Association (AHA), making healthier lifestyle choices can substantially reduce your risk of heart disease. “Small lifestyle changes may have big impact on reducing the risk of heart disease, and aid in prevention overall,” says Cleveland Clinic Florida cardiologist David Lopez, MD. Sounds easy, doesn’t it? Anyone can make healthy lifestyle changes. Simply making smarter choices in diet and exercise is a great start. For example, in general, everyone should get 30 minutes of moderate activity each day. Dr. Lopez shares that being sedentary, or not moving, increases the risk for many chronic health illnesses, including heart disease.

Since regular, moderate physical activity promotes a healthy vascular system, remaining active can be considered a huge step in the right direction towards prevention. “The key is to start slowly and to build up endurance, increasing to 30 minutes of exercise three to five times weekly,” recommends Dr. Lopez. Overall, healthy lifestyle changes that have a positive impact on reducing the risk of heart disease include: • Exercise regularly • Maintain a healthy weight • Watch cholesterol levels • Lower blood pressure • Regulate blood sugar levels • Reduce stress • Manage diabetes, and other chronic illnesses • Stop smoking

What can you do you improve your heart health? Know the risk factors, and be sure to talk to your doctor about the ones that apply to you. Dr. Lopez adds, “It’s never too late to evaluate your lifestyle choices, and make positive changes. Every healthy change you make can increase your quality of life, and help you live longer.”

There will also be food available in Emilio’s Café. Buyers are encouraged to come early, since a large crowd of people always forms before the doors open. Most know what they are looking for and want to be the first to find it. The cost to rent an 8ft. table is $70 in the lobby area and $60 in other areas. Those who want to bring their own table can set up in the outside front pergola area for only $40. The Flea Market and Bazaar is held four times a year (February, May, August, and November). City of Pembroke Pines Declares CPR & AED Training Week in February Community News

By Debby Teich

A

ccording to the American Heart Association, 70 percent of Americans may feel helpless to act during a cardiac emergency, because they either do not know how to administer CPR or

their training has significantly lapsed. Since four out of five cardiac arrests happen at home, if called on to administer CPR in an emergency, the life you save is likely to be someone at home: a child, a spouse, a parent or a friend. Sadly, less than eight percent of people who suffer cardiac arrest outside the hospital survive. The City of Pembroke Pines has declared the first week of February to be “Save a Life Bystander CPR & AED Training Week” in the City of Pembroke Pines. To help recognize this special week, the Pembroke Pines Fire Department is working with Pembroke Pines Academic Village Charter High School Principal Peter Bayer to train approximately 120 students in CPR/AED at the school. “I can’t think of a better opportunity to teach the lifesaving skills of CPR,” said Fire Chief John Picarello. “We truly have a captive and impressionable audience in a learning environment. It’s a perfect fit.” Residents can also participate in free “Friends and Family” CPR/AED training from February 1-5, at 6pm, at the Fire Department headquarters, located at 9500 Pines Blvd. Participants must register prior to attending the class. The course teaches the lifesaving skills of adult Hands-Only CPR, child CPR with breaths, adult and child AED use, infant CPR and relief of choking in an adult, child or infant. It is not for certification and does not provide a course

completion card. In addition, Pembroke Pines Fire Rescue is providing training to employees in the Police Department, Parks Department and Early Care Learning Center. City Commissioners are also urging other cities and counties throughout the State of Florida to encourage and promote CPR and AED training, and to host CPR and AED training at schools and community centers especially during that week. Throughout the year, Pembroke Pines Fire Rescue offers Heartsaver First Aid CPR/AED every third Tuesday of each month, BLS for Healthcare Providers every third Wednesday of each month, and free CPR classes to City residents, their families and friends using the AHA Family & Friends CPR course every third Monday of each month. Harold Weinstein of Pembroke Pines is well aware of the benefits of knowing CPR. Two years ago he went into cardiac arrest at home and his 17-year-old grandson saved his life by administering CPR before help arrived. A few weeks later, he took a course to learn CPR. Now he is able to help someone else. “If Jonathan had not learned CPR in school, I might not be here today,” said Weinstein. “I urge everyone to take a class. By dedicating a few hours to the course, you might save someone’s life.”

A.C. Perry Elementary Students Receive Free Books

SECTION News School HEAD

M

embers of the Rotary Club of Miramar-Pines are helping students at Annabel C. Perry Elementary School create a home library. For the sixth year, they provided all of the students with a book as a holiday gift. Gail Quigley, retired middle school principal, helped initiate the project. “Many of the students have never owned a book before,” said Quigley, who has been a member of the Rotary for 18 years. “If they don’t see reading at home, how are they ever going to develop reading as something one does for pleasure? Reading at home is very different from reading at school, and we need to have kids experience this difference for themselves.” All of the students visited the resource room to select a book of their choice. By the

time they graduate, they may have received as many as nine books from the Rotary. “This effort is greatly appreciated and is welcomed by our faculty, students, and parents,” said Assistant Principal Christopher A. Gentles. “It encourages our students to read more. It also allows them to increase their vocabulary skills and further expose them to more non-fiction books. We appreciate the continuous efforts of the Rotary Club to partner with us. We encourage more stakeholders to join us in preparing these future scholars.” Rotary Club of Miramar-Pines meets every Thursday, 12:15pm, at Pembroke Lakes Golf and Racket Club in Pembroke Pines. PPCMS - Central Campus to Host Community Garage Sale By Debby Teich

any are looking for ways to get rid of clutter, while others are in search of bargains. The City of Pembroke Pines Charter Middle School - Central Campus can help with both. On February 6, from 8am to 1pm, it will be hosting the 12th Annual Garage Sale in the school parking lot. Proceeds will benefit the school’s Washington D. C. Delegates program. Approximately 300 people are expected to attend. The 8th graders will be selling food to help raise money for their trip to Washington DC., where they will spend six days discovering the importance of being a responsible and active American citizen through an educational program called Close up. Many other high school and middle school students will also be raising money for school groups and clubs. The school typically has over 50 vendors. They will be selling a variety of used items, such as clothing, shoes, furniture, children’s toys and books. Some of the vendors also sell brand new items, antiques and jewelry. The garage sale space is equivalent to two parking spots 17’ x 16’. The fee of $40 is non-refundable. Vendor set up is at 7am. Vendors must supply their own tents, tables and/or chairs. The rain date is February 20. Sandy Krispin has attended the garage sale for the past few years and plans to go again this year. “I always find some great bargains,” said Krispin. “I am always happy when I can purchase a few items and help the school at the same time.”

PPCSS Opens Lottery for the 2016-17 School Year

School News

By Debby Teich

F

or the past fifteen years, the Pembroke Pines Charter School Elementary and Middle schools have earned an “A” rating, based on FCAT scores and other factors. The PPCSS has opened its lottery to re-enrolling students and filling open slots for the 2016-17 school year. The deadline to apply is March 20. “The students in our system receive private school education without paying private school tuition,” said Jonathan Bonilla, Controller for the City of Pembroke Pines. Since its inception in 1998, the PPCSS has received numerous awards and recognitions. It was named a 2007 National Charter Schools of the year. It was awarded the National Blue Ribbon School of Excellence in 2009 for the PPCMS and in 2015 for the PPCES - FSU Campus. The Blue Ribbon award is the highest honor an American school can achieve. In 2015, the PPCHS was recognized by U.S. News and World Report as one of the nation’s best high schools. There are approximately 5,909 students in PPCSS’ four elementary schools, 3 middle schools, and one high school. The lottery pool is primarily used to fill new kindergarten classes each year. It also serves to fill new openings in all grade levels that develop from students exiting and/or school expansions. Over 500 students are accepted each year. Bonilla answered some frequently asked questions about the lottery system: ▸▸ Who is eligible to enroll? The minimum

Pembroke Pines Charter High School is one of eight schools in the PPCS system.

requirement for seven of the eight charter schools is that applicants must be Broward County residents. The only requirement for FSU Elementary Charter School is that parents must be a Florida resident. ▸▸ Do certain people get preferential treatment? Yes, there are priorities which are assigned thru the applicant’s highest qualifying category. In order, from highest to lowest priority, they include: parent/guardian is a school employee; active duty military parent/guardian; siblings of current students; Pembroke Pines residents; all other applicants. ▸▸ How do students enter the lottery system for the first time? Parents should go to www.

pinescharterapply.net to complete and submit a lottery application. Parents will be notified of the lottery results shortly after the Open enrollment period ends. ▸▸ Do current students need to re-enroll? Parents are required to re-enroll their student(s) for the new school year, update and/or verify contact information. Visit www. pinescharterapply.net/apply/enroll.php to complete the re-enrollment process. Parents who re-enroll by March 20th will be awarded one volunteer service hour per student. ▸▸ What do students do who are already on the lottery wait list? Parents should go to www.pinescharterapply.net/apply and log in using the email currently on the waitlist file. If the parent cannot successfully log in, then contact a registrar for help or use the forgotten password feature. Please do not start a new account and/or lottery application or else the child will likely lose their current waitlist position in the lottery. Once logged in, parents should check the accuracy of the information already provided in each step of the lottery application to ensure proper placement in the lottery process. Once the final confirmation step is reached, parents should press the “Send My Application” button. For information, visit www.pinescharterapply.net

Pembroke Pines Charter Schools Have Many Fundraisers Planned By Debby Teich

Mayor Frank C. Ortis will host the 14th Annual Pembroke Pines Charter School Golf Tournament on March 25.

28

T

he Pembroke Pines Charter School (PPCS) Foundation is already off to a great start, raising over $40,000 in net proceeds from its Can We Make a Deal fundraiser held in December. The Foundation has a variety of fun and exciting events planned for the remainder of the school year. Three upcoming major event fundraisers include: Taste of Pines, Mayor’s Golf Tournament and the 5K Flamingo Strut. The Foundation is supported entirely by contributions from individuals, businesses and granting organizations. Money raised is used for necessary capital improvements and infrastructure, aid in underwriting the increasing costs of benefits and operating expenses, and to help raise the system’s reserves to financially sustainable levels. Last year, PPCS’ major fundraising events raised approximately $150,000 for the fiscal year 2014-15. “Though the PPCS are no different from any of their neighboring traditional public schools, they receive less funding for education,” said Nalini Sohit-Vazquez, Budget Analyst for the City of Pembroke Pines. “As such, fundraising events have become an important tool in helping us bridge the gap in way of financial support for our children’s education. Contributions given to our schools go directly into raising the quality of education and resources for our PPCS students.” Some of the upcoming fundraisers planned include: ▸▸ Taste of Pines – On February 18, from 6pm - 9pm, area residents are invited to enjoy selections of wine,

samples of cuisine from over 35 local restaurants and live entertainment by Tito Puente Jr., from 7pm-9pm. It will be held at the Southwest Point Community Center. Advanced tickets are $30pp (food only), $35pp (wine and food), $15 pp (kids 10 and under) and are available at all Charter School locations. ▸▸ Mayors Golf Tournament - On March 25, Mayor Frank C. Ortis will host the 14th Annual Pembroke Pines Charter School Golf Tournament. The 18-hole tournament will be held at the Pembroke Lakes Country Club, 10500 Taft Street in Pembroke Pines, and features a barbeque lunch, refreshments on ‘The Green,’ cocktail reception, deluxe buffet dinner, prizes, auction, and more. Cost is $250 per player/$1,000 per team. Over one million dollars has been raised through the years due to the generosity of sponsors and golfers. For information on sponsorship levels and golf registration, contact Kathleen Kuebler at 954-431-4146 or send an email to KKuebler@ppines.com. ▸▸ 5K Run – On April 3, run, walk or skip your way through the streets of Pembroke Pines during the 6th Annual Pill Box Pharmacies Flamingo Strut 5K and Fun Run. The fundraiser will step off from a new location: Flamingo Park at 1900 N.W. 122nd Terrace (Taft Street location) adjacent to The Pill Box Pharmacy in Pembroke Pines. Ask family, friends, co-workers to donate on your behalf. It is not too soon to begin organizing a team. For information, visit www.pinescharter.net or www.ppcsf.org.

Pamper Your Pooch at the WBHS Dog Wash By Debby Teich

O

n February 6, from 10am – 2pm, West Broward High School (WBHS) students earning their Veterinary Assistant Certifications will be pampering pooches to help raise money for the program. The public is invited to bring their pooches to the school for a Dog Wash, which will be held near the school’s softball field. For $5 per service, students will wash and blow dry the dogs, trim their nails and express anal glands. A licensed Veterinarian will also be offering a vaccination clinic from 12noon – 2pm. The booster club is hoping to raise $2,000, which will be used to purchase lab supplies and other supplementary learning materials. Approximately 350 WBHS students are currently enrolled in the vocational program. They are earning a Veterinary Assistant Certification through the Florida Veterinary Medical Association at the same time they are earning their high school diplomas. The certificate allows them to work in a veterinary office as a vet assistant and gives them an advantage during the hiring process. There are five levels for certification, which are taken over three years. The students have the option of taking additional classes in which they go off campus and intern with partner veterinarians. Students learn basic care of companion animals and livestock, common diseases and parasites, effects of overpopulation, use of and training of service animals, anatomy/physiology of companion animals,

restraint, veterinary lab skills, and more. The FVMA requires the students to earn 500 clinical hours within a year of their certification test to earn full certification 250 of those hours are earned on campus as part of class time and the remainder must be earned working under the supervision of a licensed veterinarian. “Some of students are interested in going on to Vet school or want to work as a Vet Assistant after high school,” said Tara Terribile, Vet Assisting Teacher & Program Director, who has been teaching the vocational program at the school since it opened in 2008. “Others just love animals and want to learn more about them.” Senior Tomislav Balenovic has been in the program for four years. He volunteers at Hometown Animal Hospital in Weston and plans to become a veterinarian and specialize in exotics. “I have learned so much both inside and outside of class,” said Tomislav. “We are extremely lucky to have this program and to have Ms. Terribile as our teacher. The program offers a unique experience in high WBHS student Tomislav Balenovic practices his school, and I already have skills during University of Georgia’s Veterinary Career Aptitude & Mentoring summer program. a great head start on the career I wish to pursue.” Pitbulls and Pitbull crosses are not permitted. Enter the parking lot at 210th and 2nd. Follow road to area bordering softball field. West Broward High School is located at 500 NW 209th Avenue.

PPCES - FSU Students Send Holiday “Stockings for Soldiers”

SECTION News School HEAD

By Debby Teich

K

indergarten students at the City of Pembroke Pines Charter Elementary School - FSU Campus now have a greater appreciation for the men and women who are protecting their freedom. For the second year in a row, they sent holiday packages to American soldiers serving overseas. “Many of our friends and family are continuing the fight for our freedom,” said kindergarten teacher Kimberly Caballero. “This project instills appreciation for service in our students and is a tangible reminder to our soldiers that the Pembroke Pines Charter School FSU Campus appreciates them and thanks them for their service.” Caballero started the initiative in 2014 following a Veterans Day lesson. After learning about the important and dangerous jobs performed by the United States Military, along with the daily sacrifices endured by the soldiers, the students agreed that they wanted to find a way to thank the soldiers. They collected donations of non-perishable foods and personal care items. They also wrote and drew special notes of appreciation for each soldier. They placed everything in a care package, which also included a PPCES - FSU spirit shirt. Two weeks later, the students and soldiers had an opportunity to “meet” during a FaceTime session. The soldiers thanked the young students for their thoughtfulness and generosity. This year, the school sent fourteen packages containing 160 holiday stockings stuffed with travel size goodies to American soldiers serving overseas. Four members of the military personally visited the school to express their appreciation for the care packages. The school’s effort has now been expanded to include Valentine’s Day, Veterans Day and the holiday season. Those interested in donating travel size items for the care packages can drop them off at the main office of the City of Pembroke Pines Charter Elementary School – FSU campus, located at 601 SW 172nd Avenue in Pembroke Pines. Pembroke Pines Update

M

any New Year resolutions were made, and for most of us they are probably already being broken. If getting fit or social is part of your New Year’s resolutions, February is a great month to join the many fitness and other classes offered at the SWFP Community Center. For additional information please call 954-450-6888 and ask for the activities desk or visit www.ppines. com, click on Departments and select Community Services. This New Year began with growth and exciting changes. The City’s purchase of a postal distribution center at the end of last year on a 27-acre site at the corner of Dykes Road and Pines Boulevard has allowed the City to incur a $5.7 million profit upon its sale. The developer’s plan will transform the post office building into a modern commercial and retail space, and adds 120 single family homes. This not only brings new revenue into our City, but also gives current and new residents the opportunity to purchase single family homes and shop at the same location. We also are all watching with excitement as our Civic and Cultural Center continues to be built and is taking shape.

In addition to our internal growth, the municipal boundaries for the City also grew by approximately 60 acres when the annexation of the former Broward County Women’s Correction Institute parcel became official. The City of Pembroke Pines now consists of approximately 22,237 acres or 34.8 square miles. More information on these and other various issues, along with a glimpse at what will be happening in our future, will all be discussed at my annual State of the City Address on Monday, February 24, 2016. It will be held at 7pm, at City Hall in the Commission Chambers, 10100 Pines Boulevard in Pembroke Pines. I look forward to seeing everyone at the meeting and sharing ideas. This is also the time of year that our Pembroke Pines Charter School System’s admissions lottery is underway. It is held now through March 20, 2016. Students currently in our system have been notified to re-enroll and those on the waiting list were asked for updates. Anyone wishing to enter the lottery should visit www.pinescharter.net As always, if you have any questions or concerns, please do not hesitate to contact my office at 954-450-1020, or by email at fortis@ppines.com.

Estate Planning Concerns for Singles

M

ore than half of all adults in America are single. It is common to hear singles say they don’t have many assets, so having a will or other estate planning documents are not necessary. Actually, modern estate planning is less about money, and more about control. Whether single, married, divorced or widowed, with or without children, most people want to control their life while they are alive, and then choose who will be in control should they become disabled. They also want to leave what assets they do have, to whom they want, while not leaving behind a legal mess for family members to unravel. Whether you have children or not, there are estate planning issues for singles to consider. Here are some areas to discuss with an estate planning attorney. Single with minor children. If you have minor children, it is vital to designate whom you wish to serve as their guardian. Think about this. Even if your children have a surviving parent, they may not be your choice to serve as guardian. What about leaving assets to your minor children? Realistically, leaving an inheritance to minor children can be fraught with risks. Who manages the assets for your minor children? Should you select your ex-spouse, or perhaps another family member? Often parents select one person to serve as guardian for minor children, name another individual to manage and invest assets for their children, and possibly choose a third to determine asset distributions. Single with adult children. When a child turns 18, he or she is fully capable in the eyes of the law to receive their inheritance and make life decisions, such as selecting a college, or managing and spending their own money. For many, life insurance, 401(k) and IRA accounts constitute a significant portion of their estate. Severe and irreversible tax consequences can result from careless withdrawals from these inherited assets by “young” beneficiaries. Parents of 18-year olds recognize that while their child is technically an adult, it may be much too early to expect thoughtful decisions regarding their future and their finances. There is no substitute for careful planning. Single without children: If you are single without children, keep in mind that Florida law provides that your assets be inherited by your parents. If your parents do not survive you, your assets will be inherited by your surviving siblings. Having a will is essential if you wish to leave your assets to anyone other than your immediate family. Illness or disability. Whether you have children or not, there are important decisions to make regarding who is authorized by you to assist with medical and financial matters should you become ill or disabled. Advance legal directives, in the form of health care powers of attorney, durable powers of attorney, living wills, and HIPAA releases, insure your bases are covered in various scenarios. Without such documents, urgent medical care, managing a business or your finances, and communicating with governmental agencies such as the IRS, or Social Security Administration, may need to be determined by the court. Estate planning is a deliberate, premeditated act of love. Life can change in an instant. What are you waiting for? Bruce Iden earned his J.D. from George Washington University National Law Center and his L.L.M. in taxation from the University of Miami School of Law. He has been practicing in the area of estate planning and probate and trust administration for over 30 years. The Truth About Restraining Orders I am often questioned about the process involved in obtaining a “restraining order.” Many people believe that such an Order can be obtained if a husband and wife get into a verbal argument or if someone is harassing them. This is not true and Florida law is very specific as to the requirements needed to seek such an order. First of all, there is in fact really no such legal document as a “restraining order.” The Order that can be obtained is called an Injunction for Protection Against Domestic Violence. As the title suggests, this order is to protect someone from domestic violence, which is defined as any criminal offense resulting in physical injury or death of one family or household member by another family or household member. The statute goes on to further explain that anyone who is either the victim of domestic violence or has reasonable cause to believe he or she is in imminent danger of becoming the victim of any act of domestic violence has standing to seek an injunction.

The basis for such an injunction therefore must be based upon either acts of violence or acts which would result in the other party having a reasonable belief that there was imminent danger of such violence. Conversely, injunctions will not be issued based upon harassment or threats which do not prove to result in imminent fear of harm. To obtain the Injunction, a sworn affidavit must be filed and presented to a judge. If the Judge feels that the evidence is sufficient, a Temporary Injunction will be issued. This will usually require the Respondent (the person who has the injunction issued against him/her) to vacate the marital residence and to have no contact, direct or indirect, with the complaining party. A hearing will then be held within 15 days, giving both parties the opportunity to present their case to a judge. At that hearing, either party can be represented by an attorney. The Judge will then determine if the Injunction shall remain in effect or whether it shall be dismissed. Injunctions can remain in effect for a certain period of time or indefinitely. The Injunction can also be modified allowing minimal contact to discuss issues such as child visitation. The purpose of this Injunction is to offer protection to someone who has been the victim of domestic violence or has a reasonable fear to believe that he/she will be a victim. Unfortunately, it is sometimes abused by individuals who use it as a means to “get back” or punish their spouse. I often say that the Injunction is to be used as a shield, to protect an individual, and not as a sword to harm someone. The Petition seeking the Injunction is sworn to by the applicant as being true. It is unlawful to lie under oath. Nobody should allow themselves to be a victim of domestic violence. If you are, the law exists for your protection. The law firm of Evan H. Baron and Associates is located at 1655 North Commerce Parkway, Suite 201, in Weston. How to Wipe Out Second Mortgages, Avoid Foreclosure and Stay in Your Home By Omar J. Arcia, Esq. Foreclosure Defense and Consumer Bankruptcy Protection Attorney

T

housands of homeowners in our community are 20-50% upside-down on their home mortgages and are looking for a way out. Some are frustrated in their attempts to modify their home loans, and others simply choose to give up their home because they don’t know their rights. Wouldn’t it be much easier to save your home if you only had a first mortgage to worry about? Also, since the real estate market is improving, think of all the equity you could build up years from now if you could wipe out your second mortgage or credit line today? For homeowners who have taken out a second mortgage on their home and lines of credit, facing our current economic climate can be challenging. This is especially true if the second mortgage or credit line has converted from an interest only to a principal plus interest payment. Additional liens on your home beyond your initial mortgage, however, can be wiped out through a Chapter 13 personal bankruptcy. When mortgage liens are removed from a property during bankruptcy proceedings, it is referred to as “stripping” the lien.

Bankruptcy courts permit a second mortgage or line of credit to be eliminated if the total amount owed on the first mortgage exceeds the market value of the home. For example, if you owe $200,000 on the first mortgage of your principal residence, and $150,000 on your second mortgage of that same residence, BUT your principal residence is only worth $195,000, the $150,000 second mortgage is wiped out in a Chapter 13 bankruptcy, tax free. In a Chapter 13 bankruptcy, you can also reduce the total amount owed down to the appraised value on investment properties. Tax liens and association liens can also be stripped off in Chapter 13 proceedings. More importantly, you will be able to catch up on any past due mortgage payments through affordable installments spread out over 3-5 years, or even modify your mortgage through a loss mitigation program offered in South Florida bankruptcy courts. This allows you and your family to stay in your home, and none of your creditors will be able to contact you with annoying phone calls, or proceed with a foreclosure. Detailed explanations of different options available to homeowners are also discussed in a one-of-a-kind DVD developed by the Arcia Law Firm entitled “Fight For Your Home.” If you mention that you heard about the DVD through this magazine, you will receive a complimentary copy during your free consultation to discuss your case in detail with a member of our highly experienced legal team. The attorneys at the Arcia Law Firm have more than 25 years of combined legal experience, and we are privileged to successfully represent hundreds of homeowners in our community. We have foreclosure defense, loan modification and bankruptcy departments all in one office. If you are struggling to make your monthly mortgage payments, if you are in the middle of a frustrating loan modification process, or if you just received a foreclosure summons, contact the Arcia Law Firm today at 954-437-9066 to schedule a free personal consultation with an attorney, or visit www.arcialawfirm. com to schedule your appointment.

rthritis is a degenerative process that may take place in any joint in the body. Cartilage covers the end of the bone and helps to form the joint. It allows a joint to move smoothly. When the cartilage wears down, arthritis develops. Bone spurs and cysts occur as the joint wears abnormally. Over a period of time, the arthritis becomes worse, causing more pain, stiffness and deformity in that joint. Causes of arthritis can include injuries to the joint from trauma (fall or crush injury) or from repetitive stress. Also, abnormal bone or joint position that may be hereditary or acquired over time. Repetitive trauma over a long period of time can also predispose to arthritic changes. Signs and symptoms include stiffness in the joint (foot or ankle) that loosens with weightbearing early in the arthritic process. Prolonged stiffness can occur as the arthritis advances. Often chronic low-grade ache in the joint affected as the day wears on. Also, swelling around the joint and tenderness diffusely around and on the joint surface. Other signs include difficulty performing activities due to stiffness and pain as well as wearing closed shoes, especially heels in women. In some cases, progressive lowering of the arch is noted. Treatment options include oral or injectible medication, proper shoe gear, orthotics may help lessen the inflammation. Physical therapy can help improve range of motion and strength around the joint. Arthroscopic or open surgery may be necessary to remove the abnormal tissue causing the joint pain and swelling. Bones may need to be repositioned to allow more normal joint movement and prevent further damage to the joint. If the arthritis is severe, joint replacements or joint fusions may be necessary to restore the person to normal activities.

Prognosis is excellent if the underlying cause is identified and the problem is treated early. Prognosis is good if the arthritis is not too advanced and arthroscopic or open surgery is necessary to remove abnormal tissue. If the arthritis is severe and fusions or joint replacements are performed, this will eliminate the painful movement and allow a patient to return to work and many activities, including sports. Carlo A. Messina, DPM, is a Board Certified Reconstructive Foot and Ankle Surgeon, Diplomate American Board of Foot and Ankle Surgery. s a person ages, there is a loss of collagen and elastin in the skin, alteration in the skeletal framework, and a progressive loss, or atrophy, of facial fat. These alterations in skin, fat, and bone result in distinctive changes in facial appearance. Increased skin laxity, prominence of the nasolabial folds and jowls, increased depth and number of facial wrinkles, characterize the aging face. A youthful face is fuller, more angular, with high cheekbones, a distinctive jawline, and smooth skin. In order to achieve the optimal result in facial rejuvenation, it is necessary to address all the underlying elements that affect the appearance of the face. There are four areas to treat – skin surface, laxity or excess skin, soft tissue support structure, and biochemical composition within the skin. The first is the skin surface – fine lines, wrinkles, pore size, and skin texture. This area is rejuvenated through typical skin treatments, such as fractional laser therapy, chemical peels and microdermabrasion and Botox® and Dysport®, as well as topical creams, such as Retin A, glycolic based products, and moisturizers that contain Hyaluronic acid. These products help diminish fine facial wrinkles and improve pigmentation. The second area to address is skin looseness or laxity, as well as skin excess. When redundant skin creates deep folds and jowls, the excess skin should be removed. There are multiple face-lifting techniques. The specific procedure should be adapted to the individual patient’s anatomy through a mini face lift or full facelift, or modification of these procedures such as an “S” lift or lifestyle lift. Thirdly, the soft tissue structure that supports the skin may need to be enhanced. Fat grafting adds volume that is lost as a result of atrophy of facial fat and descent of supporting soft tissue. During the early stages of facial aging, soft tissue fillers, such as Juvederm®, Restylane®, and Radiesse® can accomplish this as well. Finally, an area that most surgeons and patients neglect is the skin, the organ. The biochemical makeup of the skin is affected by what we eat and put into our bodies. Omega 3 fatty acids and antioxidants aid in restoring a healthy appearance to the skin. Consuming foods high in essential fatty acids, vitamins A, C, D, and E and antioxidants make the skin appear more youthful. Avoiding sun exposure and not smoking also improves skin appearance. To summarize, as we age, the alterations that take place resulting in an aging appearance are multifactorial. Because of this, treatment options must also address all these components – the skin surface, skin excess, structural support, and the skin composition.
