National Kids to Parks Day Encourages Outdoor Recreation By Debby Teich

n May 16, P embroke Pines families are

encouraged to spend the day exploring one of the 32 parks in the area during the 5th Annual National Kids to Parks Day. The local event is hosted by the Pembroke Pines Recreation and Cultural Arts Department. “The program promotes environmental stewardship and healthy outdoor living,” said Chuck Vones, Director of Recreation and Cultural Arts for the City of Pembroke Pines. The National Park Trust organized the nationwide day of play to engage kids across the country with parks and public lands to promote environmental stewardship and healthy outdoor living. At the heart of the initiative is Buddy Bison, NPT’s mascot, whose message to children and their families is to “Explore outdoors, the parks are yours!” Pembroke Pines residents will have

Golf Tournament Raises Money for Pembroke Pines Charter School System By Debby Teich

G

olfers recently teed off during the 13th Annual

Pembroke Pines Charter School Golf Tournament at Pembroke Lakes Country Club. The 2015 tournament, which was hosted by Pembroke Pines Mayor Frank C. Ortis and title sponsor Waste Pro, raised $85,000 to benefit the Pembroke Pines Charter School System. It has brought in almost $1 million, since it was established in 2002. “This tournament was a great success,” said Mayor Ortis. “The business community supports this educational fundraiser, because they believe in our nationally recognized Charter School System, which produces highly qualified college applicants.” Golfers played on the award-winning, 18-hole, John Stanford designed golf course. Prior to hitting the links, golfers participated in a closest to the tee contest, practiced open driving into Lake Pembroke and enjoyed lunch. Awards were presented following the cocktail reception and dinner. There were also raffle prizes and a live auction. The Pembroke Pines Charter School System was the biggest winner of the 2015 tournament, followed by Rod Rodrigo of A & B Towing, who won the putting contest and closest to the pin on hole 7. The 1st place net winner was the Waste Pro team (Angelo Marzano, Paul DiBlasi, Mike Allen, Ken Rivera). It is also a chance to meet some new people and share information.” The conference is presented by the Aging & Disability Resource Center (ADRC). This year’s theme is “Get into the ACT!” A crowd of close to 400 seniors, professionals and community advocates is expected to attend. There will be free health screenings, health information, educational presentations, lunch and raffles.

Find Bargains at the Flea Market and Bazaar By Debby Teich

expected to meet at the Southwest Focal Point Community Center in Pembroke Pines for the Flea Market and Bazaar. They will have an opportunity to search through tables of treasures from over 100 venders in an indoor, air conditioned room. The event will be held on May 16, from 8am to 3pm, and May 17, from 9am to 3pm. Admission and parking are free. Proceeds will benefit senior programs. “This Flea Market and Bazaar is a collectors’ and bargain hunters’ dream,” said Helen Daniels, Recreation Supervisor.“ With over 100 vendors, all sorts of treasures can be found!” There will be thousands of household items, toys, clothing, jewelry, record albums, baseball cards, tea pots, baby blankets and much more. There will also be food available in Emilio’s Café. Buyers are encouraged to come early, since a large crowd of people always forms before the doors open. Most know what they are looking for and want to be the first to find it. Marty Abel has attended for the past four years. “I am always searching for bargains on antique furniture and old record albums,” said Abel. “I usually find both! It is nice to be able to attend a flea market in the cool indoors instead of

outside in the heat.” The Flea Market and Bazaar is held four times a year. It raises funds for programs at the SWFP Community Center, which provides the community with a wide range of programs and activities that promote physical and mental stimulation, encourage socialization, cultural education and intellectual enrichment. The Center is committed to offering quality comprehensive services and updated programs that respond to the changing needs within our diverse communities. Sundaes with the Bunny Was a Success By Debby Teich

ids had an opportunity to indulge in one of their favorite

foods at Sundaes with the Bunny, held at the Southwest Focal Point Community Center. The annual event was a hopping success! “This year over one hundred boys, girls, moms, dads and grandparents attended Sundaes with the Bunny,” said Francie Novo, Special Events Coordinator for Pembroke Pines Recreation and Cultural Arts Department. “Bunny and Tigger

were very happy to be with the children of Pembroke Pines.” The children enjoyed making their own sundaes with help from volunteers. They received an “egg-ceptionally” big scoop of ice cream and got to choose from a selection of toppings that included Oreos, gummy bears, jelly beans, marshmallow, chocolate chips and much more. They also enjoyed games and dancing organized by Superstar Productions.

MPPRCC Offers Bench Sponsorships at The Shops at Pembroke Gardens By Debby Teich

T

he M iramar Pembroke Pines R egional Chamber of Commerce (MPPRCC) and The Shops at Pembroke Gardens are offing companies the opportunity to sponsor a bench at The Shops of Pembroke Gardens. A portion of the proceeds will benefit the MPPRCC Scholarship Foundation. “I have always wanted to have art on display in the common areas at The Shops at Pembroke Gardens,” said John C. Collier, Sr. Property Manager for The Shops at Pembroke Gardens, who came up with the idea. “I am amazed at the artistic talents that have been displayed in other communities. A few months ago, this artistic desire collided with the operational issue of repainting our benches.” There are currently 56 benches located throughout the shopping and restaurant facilTwo decorated benches at The Shops at Pembroke Gardens ity. Each bench will be painted by a juried artist with the theme of “Art in the Gardens.” All of the artwork will be non-commercial in nature and include designs that incorporate florals, plants, trees, birds, bees, butterflies, and other garden items. Sponsors can provide their own artist or pick one of pre-approved artists on the list. Area artists are invited to submit their renderings. The cost to sponsor a bench and trash receptacle is $3,000. According to Collier, $1,500 will go to the approved artist; $500 will be set aside to cover costs of

paint, barricades, plaques on the sides of the bench indicating the artist’s name, the title of the piece, and the name of the sponsor; and $1,000, plus any funds remaining from the $500, will go to the Chamber’s Foundation. Companies can also sponsor a single bench for $2,500. The benches will be displayed at the shops over the next two to three years. When the Pembroke Gardens wants to change the designs, it will bring in new benches and donate the old ones to local parks for area residents to continue to enjoy. “This program shows the area that we have a great quality of life,” said Robert Goltz, President/ CEO of MPPRCC. “We are proud of the arts in our city.” The MPPRCC Scholarship Foundation is a 501c3 organization. It is the umbrella organization for the Chamber’s philanthropic and educational programs like Chamber for Good and the Care Bear program. Each year, the Foundation provides four to six scholarships, ranging from $500 to $2000. At the Gold Star Breakfast last month, it awarded the scholarships and honored all of the Teachers of the Year in Miramar and Pembroke Pines. Girl Scout Troop Participates in Waterway Cleanup By Debby Teich

W

est L ake Park is now a little

cleaner thanks to the efforts of Girl Scout Troop 10610. They recently participated in the 38th Annual MIASF Waterway Cleanup at the park. “It was a great time to discuss the reasons to clean up after yourself, and why Girl Scouts strive to ‘make the world a better place,’ which is part of our law,” said Michelle Shore, troop leader. “The girls had a blast helping the community and look forward to next year’s cleanup.” This is the second year that the girls have participated in the cleanup at West Lake Park. They had so much fun last year that they decided to do it again. They picked up trash throughout the park, including the tennis courts, parking lot, and pavilions. They filled eight garbage bags with parts from two bikes, a punching bag, Christmas and Halloween decorations, and more. Several employees from Miller Legg and some cub scouts joined their effort. “The waterway cleanup was fun, because I did it with my friends,” said eight-year-old Cady Shore, who has also participated in cleanups at the beach and Anne Kolb Nature Center. “The best part was that I helped to clean up our environment. The animals could have gotten sick or hurt from the trash in the park. I’m glad that we cleaned it up.” “I think it was nice to clean up the park to keep the birds and other animals from eating it and maybe

dying,” said nine-year-old Meghan Coleman, who participated in a cleanup for the first time. There are 12 girls in the troop, which meets at Epworth Church on Johnson Street. Most of the girls live in Pembroke Pines and have been in the troop since it was formed four years ago. Throughout the year, they help out in the community. They box and donate food to Bread of Life, a local food pantry. They participate in the GSSEF annual Food Drive in April and the GSSEF annual Baby Basics drive in October. They also enjoy a variety of fun activities with the Council, such as Mall Madness. “I love to watch the girls discover, connect, and

take action,” said Shore. “It is great to see the girls blossom into leaders.”

Arts and Crafts Festival in the Pines Is a Success By Debby Teich

ver 10,000 people enjoyed the two - day 17 th Annual Arts

and Crafts Festival in the Pines at The Shops at Pembroke Gardens. The juried event, which was hosted by the City of Pembroke Pines Recreation and Cultural Arts Department and the Arts and Cultural Advisory Board, attracted 91 artists and fine crafters. Three Pembroke Pines residents – Tom DeVita, Gail Miller and Joni Esser Stuart – won awards for their work. “We were so pleased to have high quality artists from around the country who offer a wide range of creative art innovations in their fine arts and crafts,” said Holly Bonkowski, Cultural Arts Coordinator for the City of Pembroke Pines. The category winners included: Cynthia Linden (Fine Handcrafts/Mixed Media), Brad Kelly (Photography), George Moss (Drawing), Gail Clark (Fine Handcrafts), Joni Esser Stuart (Glass), Lisa Davin (Jewelry), Debra Kaszovitz (Mixed Media), Tom DeVita (Painting), John Antczak (Sculpture), Gail Miller (Plants) and Don Kaufman (Wood). Cynthia Linden was also awarded “Best in Show” and Guillermo Mazzotti won the poster contest for “Watching You.” “A limited edition poster of Mazzotti’s Faces was personalized and sold at the Festival to benefit the Pembroke Pines Arts and Cultural Board,” said Rose Colombo, Advisory Board Chair, who serves with board members Richard Coberly, Herman Freedman, Deborah Hartner, Norma Menasche and Earl Rodney, as well as Vice Chair Ruth T. Rosenberg and Secretary Sandi Marie L. Epstein. In addition to visiting the shops and restaurants, festival goers enjoyed a variety of musical entertainment, and watched members of the Wood Turners take blocks of wood and create beautiful objects for daily use and art. Children had a great time in the music tent and also created their own works of art in the Make and Take projects tent. The Arts and Culture Board also used the Festival venue to educate the community about Mayor Frank Ortis’ green initiative: Re-engage, Recycle and Reinvigorate and to promote environmental community awareness.

he next Pablo Picasso, R embrandt or Andy Warhol might be living in Pembroke Pines. The public is invited to the opening reception of the High School “Artists of Tomorrow” exhibit on May

26, from 6pm to 9pm, at the City of Pembroke Pines Southwest Focal Point Community Center. It will be on display through June 2. The opening reception will feature a meet and greet with the high school artists; music by Cameron Wheeler and Savanah Almeida; and refreshments from Emilio of Emilio’s Café’. The Pines West Camera Club will be preserving the event in photographs for each of the artists and their respective schools. This is the first year of the exhibit. It is not too late to enter. “We read of youngsters who steal, do drugs, and drop out of school,” said Nazimovitz. “I believe that if there were other things in their lives, such as art, music and theatre, they would have a better way of expressing themselves and become a credit to society.” The work represents a variety of mediums, such as oil, charcoal, photography, mixed media and more. Some of the artists that will be exhibiting include: Anakarina Beckhart, Jocelyn Arismendi, Coleen Sanciemente, Enman Gorrin, Kristen Abreau, and many others. Seniors to Test Their Spelling Abilities By Debby Teich

high during the 5th Annual Senior Spelling Bee, hosted by the City of Pembroke Pines Southwest Focal Point Community Center (SWFPCC). The event will be held on May 12, from 12:30pm – 2pm, at the Community Center, 301 NW 103rd Avenue in Pembroke Pines. Cash prizes will be awarded to first place, second place and third place winners. The deadline to sign up is May 8. “Spelling Bees are not just for young students,” said Suzy Felix, Activities Coordinator for SWFPCC. “It’s a memory, multi-player game for seniors that helps to keep their minds young and healthy. They still love to compete with their friends.” The brave seniors will sit quietly on the stage. Chapel Trail Elementary Unveils “Gator at the Trail” By Debby Teich

ited Chapel Trail Elementary to view one of the students’ latest creations – “Gator at the Trail.” The free standing sculpture of an alligator, the school’s mascot, used art to convey an important message about recycling. The school wide project was inspired by Goradesky’s “Gator in the Bay,” an Art Basel instal-

lation of a 230-foot long alligator designed to raise awareness of the need for Everglades’ conservation. Goradesky’s alligator has a three-story head that floats on a self-propelled barge, and a body made up of a mosaic of photos that he took in the Everglades. The body contains 102 4’x8’ floating rectangular panels comprised of over 6,528 unique images that create the illusion of an alligator when seen from a distance. Although Chapel Trail’s project was on a much smaller scale, it was designed to accomplish a similar goal. Like Goradesky’s project, the school’s alligator helped to raise awareness of the need for conservation and showed how recycled materials can be used to create art. The students participated in the creative process, along with help from administrators and parents. After coming up with an idea, they created a cardboard model. PPCMS – Central Student to Compete at National Florida MathCounts Competition By Debby Teich

Pines Charter Middle – Central student, was recently named 2015 State Champion at the Florida MathCounts competition held in Orlando. From May 7 to 10, Saaketh, along with the three other top participants (all from Broward), will represent Florida at the MathCounts national competition in Boston. MathCounts inspires excellence, confidence and curiosity in middle school students through fun and challenging math programs. Florida MathCounts is sponsored and hosted by the Florida Engineering Society, with support from companies such as Lockheed Martin, Shell Oil, and Boeing. Saaketh’s journey began in January, when he competed against 250 “mathletes” from over 26 middle schools at the MathCounts Broward County chapter level and won. In March, he competed against approximately 240 sudents from 45 middle schools at the state level. After coming in first in the written round, Saaketh entered the countdown phase. He successfully competed one-on-one against the other contestants answering a series of challenging questions in 45 second or less, and was able to maintain his first place position. He received a $400 cash prize, as well as a trophy. To prepare for the national competition, Saaketh

and the rest of Florida’s team have been meeting to develop strategies that will help them excel at the individual level, as well as in team rounds. They are using many of the same materials they used to train for the state competition, but on a more difficult level. On May 7, the team will test its skills against 224 mathletes from across the country at the MathCounts national competition. The countdown phase of nationals will be webcast live at www.mathcounts. org on May 8 at 3pm. Saaketh qualified to participate in Florida MathCounts during all three years in middle school. PPCMS - Central Campus Students Win Top Ribbons at Science Fair By Debby Teich

M

iddle school students at the

Pembroke Pines Charter School Central Campus developed a variety of projects for the Annual Broward County Regional Science and Engineering Fair. Several of them captured the attention of judges, including Jayvyn Dacas, who had an opportunity to compete at the State Science and Engineering Fair Competition in Tampa. “Science fairs increase the students’ awareness of problems in their community and give them an opportunity to find solutions to these problems,” said Piper Spencer, middle school science teacher. “Science fairs also provide an opportunity for students to display their scientific talent and to receive recognition for their achievements.” Approximately 50 students participated in the school Science Fair. Most of them are in the 6th grade Advanced Science classes. Ten of these students were selected to compete at the district fair and eight of them were awarded ribbons that ranged from first to fourth place. Juan Marin built three batteries with Gatorade, natural salt water, and salt water made with iodized salt. After measuring the maximum voltage produced, he determined that the battery made with the iodized salt generated the highest voltage. Bianca Greydinger built two identical solar ovens and placed a protective film over the top of one of them. I

am excited to announce that the

Broward County Commissioners recently awarded the City of Pembroke Pines a $462,350 “Broward County Tourist Development Tax (TDT) Capital Challenge Grant” for construction towards the Civic Center Cultural Complex. The TDT is a local option tax for tourism-related purposes. This is a very exciting and appreciated input towards our Civic Center, which is the centerpiece for the Pembroke Pines’ City Center project. The four-story, flexible-use building will incorporate a 180,000 square foot multi-purpose Civic Center, which will house city offices. It will have a Performing Arts Great Hall that will accommodate 3,500 audience members and offer flexible seating and professional staging options for various performances, conferences, small concerts and a variety of special events. There will also be an 8,000 square-foot, stand-alone Arts Center opening to the Plaza, and a one-acre Central Plaza that connects the Civic Center to the planned City Center mixeduse walkable residential, retail, entertainment and office district.

However, this experience gave me a new appreciation for the split-second decisions that our officers must make, whether that’s verbally or in using deadly force, on a daily basis in order to keep our communities safe. The American Heart Association (AHA) Family & Friends CPR course is for people who want to learn CPR, but do not need a course completion card for employment. The course is ideal for students, new parents, babysitters and others interested in learning how to save a life. The course teaches the lifesaving skills of adult Hands-Only CPR, child CPR with breaths, adult and child AED use, infant CPR and relief of choking in an adult, child or infant. Skills are taught in a dynamic group environment by using the AHA’s researchproven practice-while-watching technique, which provides students with the most hands-on CPR practice time possible. The two-hour class is offered in the evenings on the third Monday of each month.

Real Estate Market Headed Toward Normalcy

Which Breast Surgery Is Right for You?

fter years of total extremities , the

South Florida Real Estate market seems to be headed towards some sort of normalcy. What is normal one may ask? Well what it isn’t is the years of excessive highs and lows that we’ve been through in the last fifteen or so years. Those years brought three cycles, two that heavily favored home-sellers and one that heavily favoring home-buyers. I am here to say that we are now entering the next phase, where neither the buyers and/or sellers have the advantage. Houses are staying on the market longer, as high prices and a surplus of new inventory continues to slow the once red hot market. The combination of new supply and weakening demand due to affordability leads to the situation where homes are lingering on the market longer. Unfortunately for the masses, the dream of home ownership is quickly eluding the average homebuyer, as salaries and inflation are failing to keep up with the increase in housing prices. According to RealtyTrac Inc., home price appreciation in the tri-county area outpaced salary increases by a 7 to 1 ratio over the past two years. During that time, the area’s median home price rose 32.3 percent, while wages grew at 4.4 percent. South Florida saw double-digit annual pricing growth in 2013 and 2014 as the real estate market recovered from the great housing recession we encountered in the late 2000’s. Prices have seemingly returned to the 2004 levels and, in my opinion, are approximately 30% below the peak of the housing boom in 2006. The median home price in Broward County now stands at approximately $280,000. In Pembroke Pines and Miramar, this amounts to single family home with approximately 1,700 square feet under air having a two car garage. The South Florida real estate market remains strong, but the good times can’t last forever. It is unreasonable to believe that we can and will sustain double digit appreciation in prices year after year. Industry experts predict appreciation to be within four to six percent in 2015, which will mirror the historical averages. A four to six percent increase is sustainable and in turn equals a healthy real estate market. So, is the bottom going to fall out of this current cycle? Chances are very slim that this will happen, as the current cycle is built on cash deposits and equity, not speculation and debt as the previous illusive housing boom was. Another enticement is that foreigners around the world continue to perceive South Florida as a safe place to invest and conduct their business. According to the Miami Association of Realtors, Latin Americans account for about 68 percent of foreign buyers in South Florida. Venezuelans are the largest international drivers of our market, followed by Argentinians and Brazilians. It will be interesting to see the numbers as we approach the summer and the hot buying season for real estate in South Florida. What we have and always will have going for us here in South Florida is that we continue to attract people. We will continue to attract them, because of our beautiful beaches, fabulous weather and a friendly business climate, with no state income tax! ccording to the American Society for

Aesthetic Plastic Surgery, breast augmentation is one of the most commonly performed cosmetic surgery operations in our country. Patients will often come to our office wanting their breasts to be fuller and are not certain which type of surgery is best for them. Is an implant necessary, or lift, or both? The technique used to enhance a woman’s breast should be individualized based on each woman’s personal appearance goals and unique anatomy. A common misconception is that breast implants make a woman’s breast stay up longer and not sag. This is not true. A breast implant adds volume or size to the breast. An implant can increase breast width, projection, and firmness, but doesn’t prevent the breast from sagging with time, especially if a woman doesn’t wear a bra. When a woman loses breast tissue volume or size as a result of weight loss, pregnancy, or through natural deficiency in breast development, then placing a breast implant beneath the glandular tissue or under the muscle (pectoralis) will enhance the appearance. When there is excess breast skin, such that the nipple and areolar position is now below the fold of the breast, then a breast lift or mastopexy is most likely necessary. This procedure involves removing the excess skin and tightening the remaining breast tissue to elevate or lift the nipple and areola and the breast itself. The type of mastopexy procedure utilized depends on the shape and the degree of sagging (or ptosis). There are three main types of breast lifts depending on where the incisions are placed on the breast. Periareolar (Benelli, around the nipple only), circumvertical (lollipop, around the nipple and from the nipple to the fold), and inverted “T,” or anchor incision same as above with an additional incision along the inframammary crease or fold. All are safe and effective techniques for lifting the breast depending on the degree of sagging. A breast augmentation and mastopexy can be safely performed at the same time, depending on the patient’s anatomy and individual history. An implant can improve the aesthetic appearance of the breasts when volume or size enhancement is necessary, in addition to skin tightening or lifting. In general terms, if a patient is an A or small B cup bra with sagging breast tissue, a breast lift and implant would be beneficial if the patient desires an increase in breast size or projection. When a patient’s breasts are a full C or D cut, then the breast lift alone may be sufficient depending on her individual breast appearance goals. As with facial rejuvenation and body contouring, there is no single breast enhancement procedure that is applicable to every patient. A thorough preoperative consultation and discussion of each woman’s individual appearance goals is essential to ensuring the proper surgery technique is performed. elocation involves a parent who

wishes to move out of this jurisdiction with his/ her minor children. This issue can surface during a divorce or after a divorce has been finalized. The fact that many of the residents of South Florida are originally from another location adds to their desire to move “back home,” where they may have emotional and perhaps financial support. Sometimes a family relocates to South Florida due to a job transfer or a better career opportunity. It may require the couple to move away from the comfort of their home and the security of their family. The problems that a desire to relocate creates cannot usually be resolved by a simple agreement. As an example, mom wants to move back to Massachusetts with the parties’ two minor children. They are either in the midst of a divorce or the divorce has already occurred. Dad is choosing to stay in South Florida and has no desire or intention to move back north. Can mom move? Can dad stop her? The answer to each of these questions is “perhaps.”

The law in Florida allows a parent and the minor children to relocate a maximum of 50 miles from the address where they reside. This, of course, can cause problems as well. If both parents are involved in the children’s lives, a move of 50 miles can drastically change a time sharing schedule. A relocation of even 10 miles can affect a child’s school district. A change of 50 miles will require, more often than not, a modification of the time sharing schedule. Midweek dinners or morning drives to school with the parent remaining in the area will become impossible. This is especially true if the parents are following a 50/50 time sharing schedule. If a move of just a few miles can alter a time sharing plan, imagine how a relocation of hundreds of miles will affect the status quo. The law does, however, allow for relocation under certain circumstances. The court must weigh the benefit to the minor children against the effect it will have on the parent/child relationship. It’s true that the relocating parent may experience better financial circumstances if allowed to move, but how will the parent/child relationship suffer as a result? There are generally no easy answers. The most important thing to remember is that a parent cannot relocate with a minor child beyond 50 miles without court order or agreement of the other parent. In reality, even a 50 mile change will usually require a modification to be filed, as long as it affects the current time sharing schedule. The parent seeking to relocate must file a petition and fully inform the other parent of his/her intentions; including address of new residence, purpose in moving and a proposed time sharing schedule. Family court judges will often express the fact that these types of cases are the most difficult to decide. heel pain daily, especially during or after activity? Do they remember any traumatic event or did the pain just occur? If this sounds like your child, there is a high probability that they have Calcaneal Apophysitis (or Sever’s Disease). This is actually a condition and not a disease. This occurs when the growth plate (apophysis) located at the bottom and back of the heel (the portion of the bone that allows growth) becomes painfully inflamed. Although plantar fasciitis (inflammation of the ligament that supports the arch) is the most common cause of heel pain in adults, it is extremely uncommon in children.

hen a resident of our city joins the

military and gives his life to defend his nation, it is fitting and proper that our city ensures that their life and sacrifice is never forgotten. Such was the sacrifice of Lance Corporal Patrick Xavier, United States Marine Corps, who was killed in action in Afghanistan. Patrick was a constituent of the City Commission District I represent, and I’m thankful to my colleagues for honoring his memory in this way. Before giving his last true measure of devotion in defense of our nation on a field of battle, Patrick and his family lived together in our city, where he grew up and his mother still resides. To honor him and all members of the military, which he so well represented, the City Commission, with the concurrent approval of the Broward County Commission, voted unanimously to name 172nd Avenue within our city limits in his honor. It gives me great pride to know that for decades to come, as we pass that Avenue, his sacrifice, and those of his comrades in arms, will be marked as a reminder that our freedoms must sometimes be defended and protected by young men and women in uniform. Our freedoms are precious, worth protecting, and should never be taken for granted.

Using a Chapter 13 Bankruptcy Plan to Keep Your Home and Investment Properties for Much Less Than You Owe By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney

ost consumers are familiar with a simple Chapter 7 bank-

ruptcy in which all of the debtor’s assets are liquidated and all unsecured debt, such as credit cards and medical bills are wiped out. Did you know that within a Chapter 7 your lender has the right to continue a foreclosure process on your home if you owe more than the market value of the home? Yet many consumers are unaware of the far reaching benefits of a Chapter 13 bankruptcy. Unlike a Chapter 7 bankruptcy, under a Chapter 13 a debtor restructures, instead of liquidating debts. A Chapter 13 debtor is able to repay over a period of 3-5 years all mortgage arrearages, late fees, escrow shortages, and even past due homeowner association (HOA) dues. Also, credit card and other unsecured debt can be negotiated down to about one percent (1%) of the amount owed, student loan payments may be reduced, IRS liens can be reduced or wiped out, car payments can be lowered or eliminated, and even attorneys’ fees are paid over time as part of the Chapter 13 plan. Perhaps the most beneficial part of a Chapter 13 plan is the ability to remove all second mortgages, lines of credit and other liens (including HOA liens) from your principal residence, and to significantly reduce principal balances on investment properties. In order to qualify, the debtor must be employed, or have a regular source of income, and the amount owed on the first mortgage of your principal residence must be greater than the market value of that home. As it relates to the debtor’s investment properties, under a Chapter 13 plan you are able to wipe out any second mortgages or credit lines, and reduce the principal balance of the first mortgage on each property to the current fair market value, payable at a low fixed interest rate, amortized over 10-15 years, through an affordable monthly payment. Once a debtor submits a Chapter 13 plan and begins to make payments, the lender cannot proceed with a foreclosure. If you owe more on your first mortgage than the fair market value of your home; have one or more additional mortgages, lines of credit or other liens on that property; and are currently employed, you may be a perfect candidate to file a Chapter 13 bankruptcy. If you also have investment properties which are upside down in value, and would like to keep them because they are generating rental income, a Chapter 13 bankruptcy is the ideal solution to resolve your mortgage crisis instead of wasting countless hours attempting to modify your loans directly with lenders. World of Knowledge Learning Center (AWOK) is one of the single largest VPK providers in Broward County. The Center offers an accelerated learning program where young children can think, explore and create through age appropriate activities created specifically for the school. Describe your business. AWOK is recognized as one of the top early

learning centers in Broward County. We provide excellence in early childcare. We just celebrated 11 years in the community. What ages do you serve? We serve ages 1-6, including K-1st grade.
