It’s Back to School Time
T
he lazy days of summer are slowly coming to an end. There are a couple of weeks of pool time, beach days and movie matinees left to relax and unwind; rejuvenate from the constant chaos of our daily lives. Before we know it, the kids will be back to school and we’ll be back to crazy carpool schedules and chauffeuring to afterschool activities and sports practices. Local Artists Invited to Submit Work for Competition Community News

he City of Pembroke Pines Glass Gallery is currently accepting applications for the 11th Annual Art Competition and Art Exhibit. Area artists, 18 and older, can submit paintings, sculptures, mixed media, photography and other mediums for a chance to win cash prizes. A portion of the proceeds from the competition will benefit public art projects in the City of Pembroke Pines. The deadline to enter up to three pieces is August 18. “This juried art competition is a Glass Gallery favorite, because it attracts and features works from new and experienced artists in South Florida,” said Holly Bonkowski, Cultural Arts Coordinator. “Monetary prizes are awarded based on originality, craftsmanship, and overall appeal, as well as best of show.” The winning artwork from the juried competition will be on display in the Glass Gallery, from September 16 to November 16. On October 13, from 7pm – 9pm at the Glass Gallery, the public is invited to meet the artists at a reception, which is sponsored by the Arts and Culture Advisory Board. Winning artists will receive cash prizes in the following categories: Best of Show ($500), Best Photography ($200), Best Painting ($200), Best Mixed Media ($200), Best Sculpture ($200), Best Watercolors ($200), and Art Festival Poster Design ($200). The artwork from one lucky winner will be used to create the poster for the 2016 Annual Arts and Crafts Festival on March 12 and 13, 2016. The winner will

6th Annual Mayor’s Kids’ Day Is A Success Community News

M
others and fathers have their own special day. In Pembroke Pines, so do the children. On June 26, over 2,000 children joined in the fun at the 6th Annual Mayor’s Kids’ Day. The event was made possible by Mayor Frank C. Ortis, as well as over 80 Pembroke Pines businesses. “Our Mayor’s Kids’ Day event is packed with lots of free summer fun and lunch with Mayor Ortis,” said Francie Novo, Coordinator of Special Events for the City of Pembroke Pines. “The day is possible due to the generosity of our local businesses who give gifts, food samples and discounts, as long as the kids are wearing the Mayor’s Kids’ Day wristband.”

Residents, ages 15 and younger, received a special wristband that entitled them to hunt for deals and freebies from local businesses throughout the city. Some of the things they found included swimming, haircuts, ice cream, mini golf, cookies, breakfast, and more. Businesses also offered discounts on purchases, food samples, raffles and more. Mayor Ortis hosted a free, fun-filled lunch for the children at the City of Pembroke Pines Charter High School. Vice Mayor Iris Siple and Commissioner Jay Schwartz joined the Mayor in welcoming parents and children to the lunch, which included unlimited cake from Publix. Children had an opportunity to take photos with

mascots and visit with fire and police personnel, who gave out pencils, stickers, helmets and crayons. They dancercised to the sounds of JS Entertainment and followed the moves of a Baptist Health South Florida exercise dance teacher. Ten children were randomly selected to participate in the Bright Star Money Machine, where they received a goody bag and won prizes, including $50 gift cards to the Mayor’s Cafe. he Pembroke Pines Community Services Department recently hosted the 4th Annual City of Pembroke Pines Open House and Student Art Exhibit. It featured the best of the best from everyday artists who take daytime and evening classes at the Southwest Focal Point Community Center. “Throughout the year our students learn new or enhance existing skills,” said Helen Daniels, Recreation Supervisor at the SWFP Community Center. “We update classes often and are always searching for something interesting and new to offer our members. Our students return year after year because of our high quality programs, professional instructors and affordable prices.” The event included student art exhibits, art demonstrations, dance performances, Tai Chi, yoga demonstrations, face painting, children’s art activities and much more. Pembroke Pines Mayor Receives 2015 Home Rule Hero Award The Florida League of Cities recently presented Pembroke Pines Mayor Frank C. Ortis with a 2015 Home Rule Hero Award. The award is given to local government officials – both elected and nonelected – who consistently responded to the League’s request to reach out to members of the legislature and help give a local perspective to an issue. “Mayor Ortis embodies the definition of a Home Rule Hero,” said Florida League of Cities Legislative Director Scott Dudley. “He is extremely dedicated and works hard for the citizens of Pembroke Pines. He brings that same level of commitment and energy to helping the Florida League of Cities lobbying team and is always ready and willing to contact legislators and help advocate in support of home rule. Mayor Ortis has and always will be a valuable asset to his city and the state of Florida.” Mayor Ortis received the prestigious award for his tireless efforts to advance the League’s legislative agenda and help protect the home rule powers of Florida’s cities during the 2015 legislative session. “Strong home rule powers ensure government stays close to the people it serves,” said Mayor Ortis. “That’s why I have been, and will continue to be, an advocate for the League – to help eliminate unfunded mandates and preemptions, and protect cities’ right to home rule powers.” Mayor Ortis has been a resident of Pembroke Pines since 1977 and has a long history of service to his community. He was elected to the Pembroke Pines City Commission in 1996 and served as Vice Mayor in 1998 and 2002. In August 2004,

he was elected Mayor, and in January 2008 he was re-elected for a second mayoral term. Mayor Ortis was appointed to Vice Chair of the Broward League of Cities 2010-2011 Legislative & Advocacy Committee and the Broward League of Cities 2010-2011 Education Committee and the Leadership Development Committee. He was appointed Vice Chair to the United States Conference of Mayors Committee on Jobs, Education and the Workforce, 2010-2011. In August 2007, he was installed as President of the Florida League of Cities and served as Chair of the Florida League of Cities’ Resolutions Committee at the 2007 FLC Annual Conference. He garnered recognition from the Florida League of Cities by receiving the Cities of Excellence Mayor of the Year Award in 2006. Mayor Ortis was elected to the Board of Directors of the National League of Cities in November 2007. He was appointed to the Board of Advisors of the U.S. Election Assistance Commission (EAC) in 2007. In November 2008 Mayor Ortis was elected to the auspicious body of Leadership Florida. Mayor Ortis lives with his wife Barbara Parlavecchio Ortis, a real estate professional, and his stepson Nick. His son, Christopher, currently serves as a deputy with the Broward Sheriff’s Office. He has three grandchildren, Kara, Kyle and Keegan.

In an effort to promote quality landscaping within Pembroke Pines, the City sponsored the Natalie Belmonte Great Yards Award contest. The winners were recently announced at a City of Pembroke Pines City Commission meeting. The winners, who were selected by the Landscape Advisory Board, received commemorative plaques. They were: Eddie N. Linares, Joseph M. Zappia, and the Pembroke Pines Charter School - East Campus Art in Bloom garden. “The winning properties were chosen based on their integration of Butterfly Gardening, Design and Function, Maintenance, Florida Friendly value and the use of Hardscapes,” said Sue-ling Rosario, Landscape Planner, Planning and

Pembroke Pines Felines Get Free Sterilization By Debby Teich

ittens make a cute pet. Unfortunately, however, they are often abandoned once they grow older. The Humane Society of Broward County and Broward County Animal Care & Adoption are teaming up for “Mission Catpossible,” a collaborative spay/neuter project for felines to reduce the number of unwanted cats. Pembroke Pines residents who live in certain zip codes are now eligible to have their cats sterilized for free. These zip codes include: 33023, 33024, and 33025. The program also includes zip codes in other cities: 33009, 33021, 33060, 33314, 33317, 33324, 33325, and 33315. Proof of residency is required. According to Christopher Agostino, President/CEO of the Humane Society of Broward County, each year the HSBC provides low cost spay/neuter to nearly 12,000 pets that have homes, as well as for feral and free roaming cats. This is in addition to spaying/neutering more than 8,000 animals that are placed through the shelter’s adoption program. “Our goal is to sterilize an additional 4,000 felines in the next 12 months,” said Agostino. Anyone interested should make an appointment. The procedure is performed on the HSBC mobile unit seven days a week. Vaccinations, microchipping and testing are available for a fee. Jack Dickinson, who lives in the 33023 zip code area, is planning to call HSBC. “I have been meaning to get my cat neutered,” said Dickinson. “I will definitely take advantage of the free service.” The HSBC is a private, non-profit organization supported by donations from people and companies who want to help the animals. The shelter receives no government funding and is not affiliated with any local or national organization with a similar name. Broward County Animal Care and Adoption is dedicated to

providing shelter for lost and homeless animals. The agency provides access to hundreds of shelter pets hoping for a new home. Ortis stopped by and visited with guests. “Our members enjoy celebrating the Fourth of July with us,” said Jay Shechter, Director of Community Services and Housing for the City of Pembroke Pines. “Many of our members come from other countries where freedoms are limited. They join us and begin to understand and appreciate the importance of the freedoms available in the United States of America”.

Over 5,000 people attended the celebration at the Pines Recreation Center Festival Grounds, sponsored by the City of Pembroke Pines. Residents relaxed on blankets and lawn chairs, as they listened to free entertainment, enjoyed treats from the Food Truck Round Up, and watched the fireworks show. There were also free rides and activities for the children. At another celebration, over 650 people participated in an all-American afternoon during the Annual July 4th BBQ at the Southwest Focal Point Community Center. Members were served a free BBQ lunch, and enjoyed entertainment, dancing and prizes. Members arrived dressed in their finest red, white and blue in hopes of win-

Girl Scouts Is Recruiting New Members Community News

G
irl Scouts of Southeast Florida serves more than 15,000 girls in grades K-12. It builds girls of courage, confidence and character, and provides them with a safe place to discover more about themselves and the world around them, to connect with others, and to take action to make the world a better place. This month, the Wildflower Service Unit, which serves Pembroke Pines, will be recruiting new girls for the upcoming school year. They can join existing troops or form new ones. There are many troops located in Pembroke Pines, including #10845. Formed in January 2015 with 8 girls, Troop #10845 will start the new school year with 15 girls. It is a multi-level troop, with girls from ages five to thirteen. Most of the girls attend the Pembroke Pines Charter Schools, and some have been in the group for as long as six years. The troop is always in search of interesting projects to help the community and earn badges. Learning activities have included camping, healthy cooking, managing
finances, visiting cultural sites and more. Troop leader Johanna Vega was a Girl Scout for 10 years. “I grew up as a Girl Scout, and the kind of knowledge, experiences and friendships that you develop are wonderful life skills that I want to pass to younger generations,” said Vega. “My kids are learning a lot of important life skills besides what they are learning at school.” Three of Vega’s own children are in her troop – Madeline, 13, Chloe, 10, and Amelie, 5. “Girl Scouts is fun,” said Chloe, who has been in scouting for the past four years. “We do something new every time. I am learning a lot about helping animals. I like when we go camping, make campfires to cook s’mores, go canoeing, and have food drives for homeless people. I’ve learned archery, and how to filter water and make lamps from natural materials in case we lose power during a storm.” Jazmine Mella, 13, joined the troop a year ago. “I am having fun with all the activities,” said Jazmine. “I enjoy being myself and feeling safe. DBS for Movement Disorders: Tuning the Brain There are more than 100 nervous system disorders that afflict millions of people across the globe. Many of the disorders affect a person’s movement and alter their motor controls. This includes balance, gait, speed of movement, tremors, jerks and abnormal postures. Deep brain stimulation or DBS has successfully treated these symptoms and allowed many sufferers to reclaim their lives. At Cleveland Clinic Florida’s Pauline Braathen Neurological Center, a collaborative approach is utilized. The team of neurologists and neurosurgeons has pioneered the use of DBS since the original clinical trials in the mid1990s. Cleveland Clinic Florida continues to be at the forefront of innovative breakthroughs and successful treatments.
DBS is the use of a small electrical current sent to the brain. Electrodes are placed in specific areas of the brain; the location depends on each patient’s specific symptoms and treatments. The electrodes are connected by wires to a pacemaker-like device, implanted in the chest. The device will continuously send electrical pulses to the brain targets, stopping the impulses that cause tremors or other movement disorders. This treatment has been successful in treating disorders such as Parkinson’s disease, dystonia and Tourette syndrome. DBS is a very safe and effective treatment. Patients who undergo DBS see a 50 to 70 percent improvement in their movement symptoms and a significant reduction in their tremors. They’ve also reported an average of 50 percent improvement in their walking and balance following surgery. Most DBS

patients are able to significantly reduce their medications after undergoing the procedure. The neurologist evaluates each patient and employs non-surgical treatments first. If further treatment is needed, the neurologist and the neurosurgeon will work together to coordinate the DBS procedure, as well as throughout the surgery. Patients are awake under mild sedation for the procedure, because surgeons need to ensure the electrodes are controlling the patient’s abnormal movement. This collaboration is vitally important because the difference between success and failure is measured in millimeters. In the past a lesion was created in the areas of the brain that were abnormal in order to treat movement disorders. Now, instead of injuring the brain, we electrically stimulate it to re-establish normal movements with minimum risk to other areas of the brain. The results are often dramatic. For patients with severe tremors, it’s practically a cure; often their tremor is completely gone. For patients with Parkinson’s, we usually see marked improvement in symptoms and a decrease in the need for medication. There are many complex factors that must be taken into account before considering DBS. You should discuss your condition and symptoms with a neurologist who specializes in movement disorders. Patients who have tried medical treatments including medications, and have not attained satisfactory control of their disorder, should talk to a physician about their DBS options.

electing an estate planning attorney can be overwhelming. Here are some pointers to help you make the right choice. Qualifications. It is fair to question an attorney as to how they developed their estate planning expertise. Often attorneys who are transitioning, or trying to expand their practice, present themselves as an estate planning attorney although they might have little experience. Ask how many trusts have you drafted? Do you hold any advanced degrees? To which professional associations do you belong? Keep in mind that it is impossible to be an expert in all areas of the law. Attorney’s Fees. Cost is always an important factor, however, making your decision solely on price may not be wise. In setting fees, a reputable attorney will consider the amount of time that they will need to invest and the complexity of the plan. Once they know what needs to be done, they can quote a fee. Customized Documents. Every family situation is unique. A high-quality estate plan should be custom drafted to fit your needs and the needs of your family. Be suspicious of attorneys who quote flat fees over the phone for anything more than a simple will, or who advertise low prices for trusts. This often means the attorney does not custom draft documents but rather uses the same boilerplate document for every client and simply fills in the blanks. That is not planning, it’s simply word processing. The Process. During your planning meeting your attorney should spend several hours with you and your spouse gathering detailed information about you, your children, grandchildren, and other loved ones. You will share the dreams and fears you have for yourself and your family. Whether you are single, divorced, widowed, married , or have a blended family, the planning process should also include a lot of interactive questions intended to help formulate the unique plan that is right for you. Be sure to ascertain exactly which services your attorney provides and whether there are additional costs for: trust funding (changing title and/or ownership to your trust); answering questions and telephone conversations with you or your financial advisors; reviewing and explaining your estate plan with your successor trustees and with your family in the event of your disability or death; future modifications to your estate plan; and recording and filing fees. Success. A successful estate plan establishes clear instructions to inform your successors and trustees as to what your objectives are and what they should be doing . Your planning also establishes a team of professionals who are ready and able to advise and assist you and your successors. Look for an estate planning attorney with whom you feel you can develop a long-term bond and relationship and with whom you and your spouse feel comfortable and at ease. Planning is not a transaction, it is a lifelong exercise. Chemistry is important, as is competence and shared values. Do your research. Ask questions. Advanced Abdominal Contouring

his month families throughout the City will be observing that timeless annual ritual: the first day of school. It’s a time when parents may breathe a sigh of relief, and students and teachers anticipate new beginnings and new challenges. Unfortunately, however, the beginning of school is also a time when children are at an increased risk of transportation related injuries from pedestrian, bicycle, school bus, and motor vehicle incidents. There are many more children on the road each morning and afternoon, and many drivers’ patterns change. Please remember a few tips to make this a safe and happy school year start for the whole community. For motorists, when a school bus or children are present, slow down and proceed with caution, obeying all traffic laws and speed limits. Always stop for a school bus that has stopped to load or unload passengers. Red flashing lights and an extended stop arm mean the school bus is stopped to load or unload children and if you are on two-lane road, state law requires you to stop.
Always be alert for children walking in the street or biking to school, especially where there are no sidewalks. When driving in neighborhoods or school zones, watch for young people who may be in a hurry to get to school and may not be thinking about getting there safely. For parents, please help your children learn and practice the safety rules for walking, bicycling, or riding in a passenger car, school bus or transit bus. Supervise young children as they are walking or biking to school or as they wait at the school bus stop. For students, when riding a school bus, learn and practice the safety rules for waiting at the bus stop, getting on and off the bus, and riding the bus. If walking to school, learn and practice the safety rules for pedestrians, cross at cross walks, obey all traffic signs, traffic lights and safety patrol instructions. The City of Pembroke Pines is also participating in the #SaferBy4 Campaign to reduce preventable child deaths by bringing awareness to water safety and safer sleep practices for infants. And, to end on a very happy note, the City was recently awarded a $500,000 grant from the Florida Cultural Affairs Division for construction of our new Civic Center Cultural Complex. ipoabdominoplasty is an advanced technique bringing significant change to the traditional tummy tuck. The procedure involves a combination of traditional liposuction with an open skin and fat removal procedure, typically referred to as a tummy tuck. The combination of the two procedures enables the plastic surgeon to contour and shape the abdomen and the adjacent areas more completely. Patients who have experienced increased skin laxity and excess fat deposition in the abdomen, hips, and waist can now transform their bodies into a more beautiful shape. This procedure is ideal for patients who have excess skin and fat with abdominal weakness, commonly seen after childbirth, weight loss, and with the alterations that are seen with the aging process. Lipoabdominoplasty safely combines suction-assisted lipectomy (liposuction) with abdominal muscle tightening and skin removal. The fat, which is removed via lipoaspiration, can be added to other areas of contour deficiency like the buttocks through fat grafting or transfer. This combination reshapes the entire midsection and buttock giving the individual the shapely body contour they desire. The technique should be used with caution in patients who have a history of smoking or previous abdominal surgery, and should be performed only by experienced surgeons who are certified by the American Board of Plastic Surgery. There are a number of important variables that determine whether a patient is a candidate for a lipoabdominoplasty. For any plastic surgical procedure to be a complete success, medical and psychological fitness for surgery is a prerequisite. The appropriate patient typically is close to their ideal body weight with anatomic features that may be improved surgically, including loose skin, excess fat, and weakened abdominal muscles. The distribution of fat is one determinant of the improvement a patient will have from a tummy tuck. Fat in the superficial tissue is the type that is possible to pinch. This superficial fat may be removed through excision (tummy tuck) or aspiration (liposuction). If skin laxity or looseness is significant, the skin and fat should be removed with a tummy tuck. If the skin elasticity is adequate; however, the superficial fat may be removed through liposuction alone. Liposuction may flatten the abdomen, but it will not tighten the skin significantly. Patients who have soft, distended abdomens frequently have lax muscles or a separation of rectus muscle in the midline known as diastasis. This is common after multiple pregnancies making it a great procedure for “Mommy Makeovers” or significant weight loss patients. When patients have excess skin that extends to the lateral hips and lower back or buttocks, an extended or circumferential abdominoplasty may be necessary. For most patients the resultant incision is well hidden within underwear and bathing suit lines. The procedure usually takes 2 – 3 hours. Patients should prepare to rest for a minimum of one to two weeks after their procedure. Dr. Messa is board certified by both the American Board of Plastic Surgery and the American Board of Surgery, an active member of the American Society of Aesthetic Plastic Surgery, American Society of Plastic Surgeons, and a Fellow of the American College of Surgeons. A
s we go through our daily lives, we often come upon situations which require us to make decisions. Sometimes these decisions can be minor in nature and other times they can be somewhat more complex. None of them compares to the decision a person has to make in deciding if they should pursue a divorce from their spouse. I hear these questions almost every day from either prospective or existing clients: “Should I stay married or get a divorce?” “Should I accept this deal or go to trial?” “What should I do?” Unfortunately, divorce attorneys don’t always have the answers. I can certainly advise a client based upon my 35 plus years of experience, but in reality the decision must always be that of the client. When I meet with a prospective new client who is considering a divorce, I am often asked for my opinion as to what he or she should do. I explain that I do not ever encourage an individual to get divorced, but obviously sometimes that is in fact their best option. It is, however, a very personal decision that he or she must make based upon all the factors involved.
I can advise a person as to the law and how his or her case will probably get resolved. I say probably, because when there are two parties involved it is impossible to predict what the other party will be seeking. I often explain to a client that no matter how reasonable they may be, the process will also depend upon the reasonableness of their spouse. So I am asked, “What should I do?” I tell them that it is their decision and they will know when it is time to make that decision. I have had individuals return to retain my services one or even two years after their initial consultation. It took that long to be able to answer the question, “What should I do?” Once the process has begun, I am also often asked, “What should I do?” when faced with the decision to either enter into a marital settlement agreement or proceed to trial. Once again, I can advise them based upon the law and my experience, but no attorney can ever guarantee a particular result if the case goes to trial. Often times the agreement is extremely fair and equitable and, as such, I advise my client that it is a good deal for them and they should certainly consider it. If the offer is equal to “their worst day in court,” then the decision is also fairly easy - why settle a case when you will probably get better results from a judge. Of course the usual reason is financial, since it costs more money to go to trial than to settle. We sometimes have clients who disregard our advice and accept a “deal,” which may not be the best that they can receive. Of course, it is ultimately their decision. So, in reality the person who can best answer the question “What should I do?” is the client. Of course, I can only hope that decision is made after they consider my advice. The law firm of Evan H. ower extremity muscle cramps are one of the most common on-the-field problems in all sports. Most muscle cramps occur in the calf muscle but they can also be seen in the hamstring and thigh muscle. Muscle cramps occur more often in climates that are hot and humid. They also occur earlier in a season when athletes are not as well conditioned. Muscle fatigue and twitching usually precede cramping. They usually do not occur in the earlier part of an activity. Once a muscle cramp occurs the muscle tightens to such a large degree that the athlete is not able to move the leg properly. The athlete usually falls down to the ground in pain and the affected muscle is firm. This makes the foot very difficult to move as it is pointing down. It is important to be sure that the athlete has suffered from a cramp and is not suffering from any other type of injury which may include a fracture, ligament injury, muscle tear or Achilles tendon rupture. Once the trainers or coaches are certain that a cramp has occurred the treatment is to stretch the muscle that is cramped. This includes gently bringing the foot up from its down position while keeping the knee locked. This will stretch the calf muscle and lessen the pain and tension. If it occurs in the hamstring it is necessary to keep the knee extended and to lean your body forward trying to touch your toes. If it occurs in the thigh muscle it is important to flex the knee as much as possible while leaning your body back to stretch the muscle back to its original length. Massaging the muscle also helps to relieve the cramp. After the cramp has gone it is important to keep the muscle stretched and not to sit as the muscle may retighten very quickly. It is very important for the athlete to be rehydrated on the sideline. Getting back into the game should be done after proper hydration and muscle stretching. Cramping that is associated with severe dehydration may be a precursor to heat stroke. It is important that the athlete be of sound mind before they return to playing. Prevention of cramping includes proper preseason conditioning. This must include strength training and muscle stretching. Adequate hydration is necessary before each game. Remember that drinking fluids immediately before a game is not the best way to prevent these problems. Hydration is important hours before a game. Fluids should be administered throughout the game to offset fluid loss during an activity, especially in warm climates. New Laws Level the Playing Field for Homeowners Facing Foreclosure By Omar J. Arcia, Esq. Foreclosure Defense and Consumer Bankruptcy Attorney
O
ne of the most difficult challenges we face in assisting homeowners through the process of a loan modification, is avoiding the threat of foreclosure, or foreclosure sale of the property we are trying to preserve. The Consumer Financial Protection Bureau (CFPB) issued new mortgage servicing rules designed to protect borrowers when it comes to mortgage loans. These rules became effective a little over one year ago, but many homeowners are unaware of these important changes in the law. Our experience has shown that homeowners that take full advantage of these rules have obtained excellent loan modification results, have been able to stop foreclosure sales, correct escrow and payment issues on their account, and even cancel foreclosure trials.
Under the new rules mortgage servicers are required to implement major changes in the way they do business. A mortgage servicer is the company that collects monthly mortgage payments from borrowers on behalf of the owner of the loan, as well as tracks account balances, manages the escrow account, handles loan modification applications, and pursues foreclosure in the case of defaulted loans. The CFPB now requires mortgage servicers to send more detailed periodic billing statements, provide timely interest rate adjustment notices, promptly credit mortgage payments, provide payoff requests in seven days or less, provide options to force-placed insurance, and quickly resolve errors and provide information requests. The most significant benefit for homeowners from these rules is that it restricts “dual tracking.” Dual tracking is when a mortgage servicer considers a homeowner for a loan modification, and at the same time proceeds with a foreclosure action against that homeowner. Under the new rules, a mortgage servicer cannot start foreclosure until at least four months after the homeowner stops paying the loan to provide the homeowner enough time to pursue a loan modification. If a loan modification application is made, the servicer cannot start foreclosure unless the servicer notifies the borrower that he/she is not eligible for any loan modification, the borrower rejects a loan modification offer, or the borrower fails to comply with a trial modification. Also, if already in foreclosure, the mortgage servicer cannot request final judgement or conduct a foreclosure sale if the homeowner submits a complete loan modification package at least 37 days before a trial, final judgment or foreclosure sale.
