A Halloween Treat!

he memories of summer vacations have slowly faded away. The kids have settled back into their regular school routine, and that typically means mom and dad busy shuttling them around to after school activities. Sports season is in full swing and, thankfully, the heat and humidity are dropping a bit. Finally, we can enjoy family activities and gatherings with friends in our backyards again. These cooler nights signal fall has arrived in South Florida, and that means Halloween is almost here. It’s time to decorate the house with “scary” lights to brighten the spirits of our little ones (and sometimes not so little ones). Let’s have some fun while watching the neighborhood kids roam the streets dressed up in costumes. Pembroke Pines Police Department’s Annual Pines Night Out Returns By Debby Teich
T
he City of Pembroke Pines and Neighborhood Watch invite the community to Pines Night Out, an evening of free activities presented by the Pembroke Pines Police and Fire Departments and Specialty Prevention Partners. Guests will meet crime prevention and specialized units, receive safety tips, and enjoy free entertainment and refreshments. The event will be held on October 23, from 6pm-9pm, at Walter C. Young Middle School and Resource Center. Pines Night Out is designed to bring residents together to promote crime prevention, neighborhood unity and safety, and police-community partnerships. It motivates communities to get involved; to help keep their neighborhoods safe and free from crime; and to serve as extra eyes and ears for the police department. The Police and Fire Department will provide information. Children can visit with “Officer McGruff,” the crime fighting dog, and “Sparky the Firefighter.” There will be a demonstration by the Police K-9 unit. The Police Dive and Rescue Teams, Motorcycle/Traffic Division, Victims Advocate, Police Explorers, Citizen’s

Police Academy Alumni Association, Community Emergency Response Team (CERT) members, Community on Patrol, Bicycle Unit, SRT- Special Response Team (aka SWAT), Field Force, and Missing Persons representatives will also be on site with their displays and handouts, as well as to answer any questions. The Pembroke Pines Fire Department will have fire trucks on display and children/adults can learn safety techniques for fire safety and prevention. Several other agencies will be at the event, including Child ID’s, Poison Prevention, Water Safety, and Blood Pressure Checks. There will also be specialized Law Enforcement agencies available, such as Florida Highway Patrol, US Customs and Border Protection. Children can enjoy face painting, bounce houses. There will stage entertainment, a DJ playing dance music, a costume contest, police equipment to try on, a police motorcycle for picture taking, and more. There will also be free refreshments, such as hot dogs, soda, cotton candy, snow cones and popcorn. Crystal Gayle brings his three children every year. “They look forward to this event all year,” said Gayle. “They love meeting members of the fire and police departments and learn lots of great safety tips. Pembroke Pines Students Receive Free Backpacks By Debby Teich

hanks to the generosity of a Pembroke Pines resident and community groups, 125 elementary and middle school students received backpacks filled with school supplies. The backpacks were distributed the week before school began at the City of Pembroke Pines Athletic Club. “The backpacks were stuffed with everything a student needs to have a successful school year,” said Tom Joyce, Pines Athletic Club Coordinator. “This great event helps the youth in our community begin the school year very well prepared.” The doors opened at 10am and within 20 minutes all 125 backpacks were in the happy hands of pre-qualified students. Volunteers arrived early to prepare the backpacks for the giveaway. This is the second year that free backpacks were given to students. Last year Pembroke Pines resident John Curran secured a community grant that was offered by First Investors, A Foresters Company, where he is a manager. The grant was used to purchase backpacks and school supplies for 50 students. This year, with the help of First Investors, Rotary Club of Miramar- Pines and Therese Homer, he was able to provide 125 students with supplies to make sure they started the school year on the right track. Southern Handcraft Society Holds Annual Holiday Fantasies Show By Debby Teich

f you are looking for the perfect holiday gift, the Southern Handcraft Society has you covered. The group’s annual Holiday Fantasies Craft Show will be held on October 15 (4pm-9pm), 16 (9am-9pm) and 17 (9am-3pm) at the Southwest Focal Community Center. Hundreds are expected to attend the show, which is free and open to the public. “Everyone is welcome to attend the show, where they can enjoy the local handcrafts created with love by members of our community,” said Mary Stephens, member of the Pembroke Pines Chapter. “Once you come to a show, you will look forward to coming back each year.” Since 1989, artists and crafters have been invited to participate in the juried show. Approximately 60 crafters from throughout South Florida will participate in this year’s show, including Southern Handcraft Society members, as well as local artists and crafters. Exhibitors are selected on the basis of excellence, creativity, and craftsmanship. All items must be the work of the exhibitor and must be approved by a jury committee comprised of fellow crafters. All crafters are welcome. The show includes all one-of-a-kind items, such as original paintings and framed arts, as well as wooden, knitted, crocheted, embroidered, and quilted items. There will also be unique candles, table decor, door hangers, wreaths, tree decorations, and ornaments. The crafts will highlight the upcoming holidays (Halloween, Harvest, Thanksgiving, Hanukkah, Christmas), as well as non-seasonal décor. The green section will include recycled, reused, and repurposed items, such as pocketbooks from recycled VCR tapes and clocks made out of CD discs. It will also have other items made out of recycled materials, such as eating utensils, wooden spoons, typewriter keys, mahjong tiles, bingo chips, sweaters and more. In the Country Kitchen section, visitors will find unique homemade jellies, jams, breads, cookies, cakes and other delicious treats. At the jewelry counter, they can purchase new and traditional handmade jewelry, such as beaded items, earrings, rings, necklaces, bracelets, anklets, hair ornaments, and brooches.

Since 1988, members of the Southern Handcraft Society’s Pembroke Pines chapter have been meeting to explore their love of arts and crafts. In the Pembroke Pines chapter, there are approximately 30 members that range in age from teenagers to seniors. They join to learn more about knitting, quilting, jewelry making, beading, glass etching, woodwork and other handmade items, as well as to be surrounded by others who share their passion and want to have fun doing it. The club is always looking for new members. Meetings are held on the second Thursday of each month at 7pm, at the Southwest Focal Point Senior Center. nited States Military Veterans have experience working as part of a team to accomplish difficult tasks in a stressful environment, so they should have no problem finding jobs. Unfortunately, that is not always the case. On October 6, from 9am – 3pm, the Southwest Focal Point Community Center will be reaching out to Veterans and potential employers to help connect them at a job fair. “This is going to be an important opportunity for Veterans to connect with potential employers and learn about services available,” said Jay Shechter, Director of Community Services and Housing for the City of Pembroke Pines. Veterans should come dressed for success. At the job fair, they will have an opportunity to: ▸▸ Meet with Federal agencies and local business employers ▸▸ Discover new job opportunities ▸▸ Have interviews on the spot with employers who are prepared to screen and recruit. ▸▸ Network with Veteran friendly employers ▸▸ Connect with Veteran Services Veterans that need help polishing up on their skills can participate in workshops on resume writing and interviewing techniques. “The workshops add another dimension to the Expo by teaching and assisting Veterans how to maximize their marketability to a potential employer,” said Shechter. The Veteran’s Employment Expo is part of the City of Pembroke Pines Re-Energize and Re-Connect Initiative, which has a goal of providing resources and housing at the R & R Village for active and honorably discharged members of the military. “The bottom line is that we are committed to helping members of the military transition back into civilian life,” said Shechter.

After receiving brand new customized Kevlar Level II ballistic vests at a recent City Commission meeting, six members of the City of Pembroke Pines K-9 unit are now well protected. Jeff Desilets, was preparing to retire from the City of Pembroke Pines Police Department and they wanted to recognize the many years he spent dedicated to public law enforcement service. “We are a family that understands and respects what freedom, public service, and sacrifice is all about,” said Thomas Stein, who has been in the public and private sector law enforcement business all his life and whose son is a professional soldier. The Steins partnered with Point Blank, Protect the Paws...a K-9 Cause, and two corporate sponsors (Areas USA, Neret & Finlay) to provide the K-9 officers with brand new, custom fit, Kevlar Level II ballistic vests that would be made and delivered prior to Desilets’ retirement last month. Each canine had measurements taken for the vests, which have the same thread count as a police officer’s vest, weigh approximately five pounds, and cost $724. The following K-9’s, along with their “partners,” received the vests: ▸▸ Sergeant Christopher Chacon-Chang and K-9 partner Kilo ▸▸ Officer Eric Forseth and K-9 partner Aksel ▸▸ Officer Craig Rupp and K-9 partner Bullit ▸▸ Officer Heath Wagner and K-9 Siep ▸▸ Officer Patrick Pagliai and K-9 Natz ▸▸ Officer Russell Munzer and K-9 partner Argos Officer Munzer and Argos are the newest members of the Unit. They replaced Adam Feiner, who retired from the K-9 Unit along with his partner Shak. Argos is in training to become Florida Department of Law Enforcement certified, which requires 480 state mandated and documented training hours, as well as an additional 80 training hours suggested by the Pembroke Pines Police Department. “We appreciate the generous donation of these ballistic resistant vests by Mr. and Mrs. Stein and Ms. Holmes, as our canines serve to protect the protectors of our dedicated K-9 Unit,” said Pembroke Pines Police Chief Dan Giustino. “We also thank the Stein family for making their donation in honor of Sergeant Jeff Desilets’ 25 years of dedicated service.” Now a quarter of a century after joining the City of Pembroke Pines Police Department, Desilets is busy contemplating his choices in the next phase of his life. One thing is for sure; it will involve helping people. “This was really something,” said Sgt. Desilets. “I am so honored to have been blessed with a friendship that would leave such a legacy of protection. I still remember my first day on the job.”

Seniors Audition for Miami HEAT Golden Oldies SECTION HEAD Community News

O
ver 100 seniors proved that age is just a number. The vivacious group recently auditioned for 19 spots on the Miami HEAT Golden Oldies at the Southwest Focal Point Community Center in Pembroke Pines. Although all of them were age 60 or over, they worked on mastering the latest dance moves with rhythm and style. The Golden Oldies have been performing for the Miami Heat for 11 years. They have become the NBA’s most popular senior citizen dance team. During the audition, the Miami HEAT was looking for the hippest, coolest, and young-at-heart senior citizens to be a part of its 2015-2016 senior citizen hip-hop dance team.
Wearing the required red, black, and/or white outfit, as well as dance or athletic shoes, men and women from all over South Florida brought their “A” game to the audition. As they worked up a sweat, they were judged on their overall presence, as well as their smile, performance and energy. Only the best dancers made the cut to the second round of auditions. “The 2015-16 Golden Oldies are the hottest dance team we have ever had,” said Jay Shechter Director of Community Services and Housing for the City of Pembroke Pines. “They are high energy and full of life…just like the City of Pembroke Pines.”
Meet Solange Ritchie – Author of “The Burning Man” By Debby Teich
S
olange Ritchie is already receiving praise for her new mystery/thriller, “The Burning Man.” On November 4, at 7pm, she will be appearing at Barnes and Noble in Pembroke Pines, 14572 SW 5th Street, for a lecture and book signing. She will reveal some of the techniques she uses when she writes, such as closing her eyes. “When I write, I sit, close my eyes and go through each of my senses and the effect,” said Ritchie. “That way, you put the reader in the scene.” Born in Jamaica, Solange Ritchie immigrated to the United States at age 11. Since then, she has been a dynamic force for change. She currently spends part of her time in Pembroke Pines, where her family lives, and the rest in Newport Beach, California, where she practices law. In her debut thriller, Ritchie unravels a string of harrowing murders, while drawing readers into the mind of a depraved genius. At the heart of the novel is the story of the killer’s adversary, Cat, who is one of the country’s most accomplished FBI forensic pathologists. Ritchie traces the painfully real struggles of a driven woman who is torn between her career demands and motherhood, as well as a family saga involving her young son and his loss of innocence. As a successful lawyer, Ritchie wanted to help readers understand how difficult it can be for women that have to balance work and family.

“I feel that so many women today face the struggles of work-life balance, especially professional women,” said Ritchie. “We all want to be great mothers, great wives and great career women, but it is a tough road to hoe. I felt that including this portion of Cat’s life would make her human and relatable to many career women, such as myself. It also shows a soft side of a woman whose exterior appears hard. At work, she has to be hard, but at home, she is a big softie.” One of Ritchie’s goals is to strengthen and modernize the thriller/mystery genre with the addition of strong female characters that go beyond portraying women as victims or femme fatales. “The primary reason I started writing Dr. Catherine (“Cat”) Powers is because I was tired of reading the ex-military macho guys and the male gumshoe detective types—all men,” said Ritchie. “I thought we need some strong power women in this genre who can kick butt and take prisoners. We need a woman who is strong, bright, relatable and genuine. And of course, a little ESP never hurt anyone.”

Pembroke Pines Remembers 9/11 Community News

ver 300 people attended the 14th Annual City of Pembroke Pines Patriot Day Honor Ceremony at the City’s Memorial Pavilion to remember those lives lost to terrorism on September 11, 2001. The audience was filled with survivors, families who lost loved ones, local fire fighters, and police task force units. This year the ceremony featured Colonel William J. Truax, USMC, who addressed the crowd along with Pembroke Pines Mayor Frank C. Ortis, Vice Mayor Iris Siple, Commissioners Carl Shechter, Angelo Castillo and Jay Schwartz. Col. Truax spoke of moments in history that are etched in our memories. Times when most us remember exactly where we were and what we were doing. As examples, he listed the stock market crash of 1929, Pearl Harbor Day, assassination of John F. Kennedy, Challenger disaster and September 11, 2001. During the Remembrance Ceremony, the City of Pembroke Pines Police and the Fire Department Honor Guards participated in the Presentation of Colors; Pastor Peter Tokar gave an invocation; Cameron Wheeler sang God Bless the USA; Mayor Ortis recited the Pledge of Allegiance; and Katie Harmon sang the National Anthem. At 8:46am, the moment the first plane crashed into Tower 1, the crowd was silent as a 10-second siren sounded, Kenny Ahern played the bag pipes, and the flags were lowered. The one hour program ended as the City of Pembroke Pines Charter Elementary School chorus sang God Bless America. On September 11, 2011, the tenth anniversary of the attack on Freedom, the City of Pembroke Pines unveiled its September 11th Memorial at the Pembroke Pines City Center Memorial Pavilion, 10300 Pines Boulevard. The powerful art project honors the 9/11 victims, survivors and those who assisted in the recovery. It is open throughout the year for people to visit, mediate, pray, and remember. Residents can submit photos of Military loved ones, living or deceased, for permanent display on the “Salute OUR Soldiers” wall located on the first floor of Pembroke Pines City Hall. ore than 800 treasure seekers are expected to attend the City of Pembroke Pines Community Center Antiques and Collectibles Show, benefiting the Southwest Focal Point Community Center. It will be held on October 10, from 9am to 4pm, and October 11, from 10am to 4pm, at the Southwest Focal Point Community Center, 301 NW 103rd Avenue. “People come to this show to find the game they played as a child, the juice glasses their greatgrandma set the table with, or vintage clothing to update their wardrobe,” said Jay Shechter, Director of Community Services and Housing for the City of Pembroke Pines.

This is the 12th year of the antique show, which has grown throughout the years. It is offered twice a year, in April and October. This month, it will bring together more than 40 dealers from across the country that will display their items in a clean, air conditioned room. They will be selling a treasure trove of quality antiques and collectibles including depression glass, vintage postcards, tools, linens, silver, toys, jewelry, small furniture, books, lamps, quilts, coins, military, pottery, clocks, art and much more. Plant and orchid dealers will be at the show on both days and an antique appraiser will be available on Sunday for a fee of $3 per item. Emilio’s Café will also be open for homemade meals, snacks and refreshments. Pembroke Pines resident Gloria Balter is looking forward to the show. “I love visiting with all of the vendors,” said Balter. “I have filled my home with so many items from the show. Last year, I purchased a piece of art that turned out to be worth much more than I paid.” Lou Schwartz also plans to attend. “I always attend both shows,” said Schwartz. “I collect clocks and always find some great ones.” Proceeds from the antique show will benefit the SWFPCC. The 53,000-square-foot facility offers a multitude of services and is the site for many special city events. Miracle League Kicks Off Fall Season Community News

ho says that miracles can’t happen? The West Pembroke Pines Optimist Miracle League recently held Opening Ceremonies to kick off its fall season, which runs through November 13. Approximately 65 children with disabilities took to the field for a friendly game of baseball. The bleachers were filled parents, friends and relatives cheering throughout the game. Students from Flanagan High School’s baseball team served as the Angels in the outfield and assisted each player. Commissioner Iris Siple, Carol Campesi, Assistant Director of Recreation & Cultural Arts, the Girls Scouts and many others attended. “This program affords our special kids the opportunity to participate in America’s past time and build lifelong friends and relationships,” said Frank Marquez, who co-founded the league and serves as coach/president. “It’s an amazing feeling that we experience every season. The smiles are priceless.” The Miracle League provides opportunities for children, ages 5 to 21, with special needs and disabilities. The West Pembroke Pines Optimist Club runs the program with assistance from the City. It is sponsored by Joe DiMaggio Children’s Hospital, which provides players with a full uniform, team pictures, trophies and more. There is no cost to participate.
The League is held at Rose G. Price Park, which has a field with a special rubberized surface that makes it accessible for individuals with wheelchairs or other assistive walking devices. Games are held on Friday nights at 7pm. Everyone plays two innings; there are no outs; and the only rule is to have fun. “The parents get to sit back and enjoy watching their kids play the game of baseball,” said Mario Salceda, Administrator for Memorial Healthcare System, who co-founded the league and serves as coach/treasurer. “The kids really look forward to coming every week. Some even sleep in their uniforms.” Daniel Estrada, 23, has participated in the Miracle League for the past nine seasons. “He enjoys the game of baseball like any other young guy,” said his mother, Mara Duarte. “He is able to have community integration with his peers and also exercise to maintain a healthy body. Congresswoman Wasserman Schultz Visits Pines Lakes Elementary
School News

uring a recent visit to Pines Lakes Elementary, Congresswoman Debbie Wasserman Schultz had an opportunity to read to fifth grade students on International Literacy Day and take a tour of the school’s new STEM lab. Congresswoman Wasserman Schultz read from “What Do You Do with an Idea,” by Kobi Yamada. In the story, a child helps bring an idea to fruition. As the child’s confidence grows, so does the idea itself. One day something amazing happens, because she does Congresswoman Debbie Wasserman Schultz reads not give up on her idea. to the students. The Congresswoman spoke to the kids about not being afraid to express their ideas. She explained that she started her political career with just an idea. She was told to wait until she was older and had more experience, but she never gave up on it. After she read, she visited the school’s new “Fab Lab.” The colorful, bright room has no desks to make it feel more like a tech lounge than a classroom. Instead of chairs, the students sit on bounce balls or the carpet. The room also has a laptop cart and will soon have a 3D printer. “In the STEM lab, the children feel relaxed and free to create, inquire, discover and imagine,” said Sophia Whittaker, fifth grade teacher. “Each time a class enters the lab, whether it is their first or their tenth time, their eyes pop open and you hear them say, ‘Wow!’” In the lab, Congresswoman Wasserman Schultz had an opportunity to see the fourth graders working on the first schoolwide STEM project. They were designing and building bridges out of straws to support pennies. The winning bridge held 243 pennies. She reinforced the importance of the STEM program,
which allows children to take chances in subjects they might otherwise avoid out of fear. She told the students that were lucky to have a place like the STEM Lab, where they could “get messy, make mistakes and not worry about a grade.” The lab is currently used by fourth and fifth graders, who can chose it as their elective for the quarter. From Monday to Thursday, they work on different engineering challenges. On Fridays, they can choose to participate in Genius Hour or Cool Math, or continue working on their challenge. “The STEM Innovation in Engineering program will engage students in projectbased learning using hands-on engineering applications,” said Susan Sasse, principal. “This program is designed as a student-centered environment where knowledge and literacy will connect to Science, Technology, Engineering, and Mathematics. It will prepare our students as creators of the future and 21st century problem-solvers.”

PPCMS Central Campus Students Plant A New Garden By Debby Teich
M
embers of the Builders Club at Pembroke Pines Charter Middle School Central Campus are reaping the benefits of their new garden. During the summer, the students met on campus to weed six garden boxes and plant new crops for the 2015-16 school year. The Central Campus is a Schoolyard Certified Wildlife Habitat. It is part of the Million Pollinator Garden Challenge, a national effort to restore critical habitats for pollinators in peril. The students planted native plants that attract butterflies, birds and bees. Some of these include: dessert rose, fire bush, almond verbena, milkweed, porter weed, dakota gold, cotton and PowWow wild berry. “The gardens are used to teach elementary and middle school students about environmental science/ecology,” said Piper Spencer, Science Department Head, PPCMS Central Campus. Sponsored by Kiwanis International, the Builders Club has approximately 40 members. It provides opportunities for students

to work together in service to school and community, develop leadership potential, foster the development of strong moral character and encourages loyalty to school, community and nation. Students in the Builders Club at PPCMS Central Campus are responsible for taking care of the garden. This includes watering, weeding, fertilizing and performing other tasks. “Maintaining the school garden is one way we serve the school,” said Jayvyn Dacas, club vice president and a 7th grader. Last month, club members participated in the Coastal Clean Up at North Point Beach in Hollywood.

e are very proud to be participating in a Veterans Employment Expo this month at our Southwest Focal Point Community Center on October 6. In attendance will be Federal agencies, local business employers, and Veteran Services contacts. Veterans will have an opportunity to network, discover new job opportunities and also interview for various positions on the spot. The day before there will be workshops on resume writing and job interviewing techniques to ensure Veterans are prepared for the Expo. This month, we will also begin our annual Thanksgiving Food Drive that assists 100 families throughout our city. For the past 12 years, donations have been collected from schools, businesses and residents so that families in need can receive bins of various canned and dried foods, turkeys and various other items for a bountiful Thanksgiving meal. Please keep an eye out for our donation boxes and know that non-perishable items can also be dropped off at the Center. Additional community events include a Shred-A-Thon on October 17 and a Pines Night Out to promote crime prevention, and neighborhood unity and safety on October 23. Holiday fun events for residents of all ages will also take place including our annual Bow Wow Ween for our furry friends; a Ghoulish Guardians Pumpkin Carving Contest; and Boo-ville, an evening filled with rides, a pumpkin patch, treat stations, spooky movies and costume contests. Three Keys to a Successful Foreclosure Appeal By: Vanessa J. Bravo, Esq. and Omar J. Arcia, Esq. Foreclosure Defense, Bankruptcy & Appellate Attorneys
I
t’s important for homeowners to know that if they lost a foreclosure trial, they have the right to seek reversal of that ruling through an appeal. There are at least three keys to keep in mind and successfully appeal a negative trial court ruling. First, a homeowner must ensure that a court reporter is present at the trial or hearing from which an appeal may be taken. In most, though not all, scenarios, the appellate court will need a transcript of the hearing or trial in order to even proceed with the appeal. If the appellate court is being asked to review something that the trial court decided by hearing testimony and evidence, the appellate court will need a transcript of the proceedings in order to review what happened and make a decision. An exception to the need for a transcript of the proceedings exists where there is a summary judgment hearing instead of a trial. At this kind of hearing, judgment is entered based on the documents filed, so the appellate court can fully review the lower court’s basis for its decision without a transcript.
Second, most people don’t know that although a notice of appeal is filed, the foreclosure sale of the property will still go forward and the bank can still seek to collect any money due on the note after the property is sold, i.e., a deficiency judgment. In order to stop the sale after filing a notice of appeal, the homeowner must file the appropriate motion in the lower court based upon the filing of the notice of appeal. The plaintiff may insist that a “supersedeas” bond (appellate bond) be paid. In cases where the judgment is secured by real property, as in foreclosure cases, the law allows for the lower court judge to set a bond at any amount (including no amount at all), and requires that the judge hold a hearing to consider all relevant factors for setting a bond: the value of the property and whether the value exceeds the amount of the judgment, whether the homeowners occupy the property, whether the property is being rented, if the homeowners are paying insurance or maintenance assessments for the property, and whether the property is deteriorating, among other factors. Third, and most importantly, foreclosure appeals must be handled by attorneys experienced in handling the sale cancellation and supersedeas bond issues in the lower court, as well as identifying all potential errors to be raised on appeal. Foreclosure law is a very active area of the law, with new cases and directions in the law changing constantly. W
hat does it mean to fund a trust, and why is it so important? Once you create a revocable living trust there is one last step that should not be overlooked: funding your trust. Trust funding is the process of retitling certain assets to name your trust as the new owner or, in some cases, naming the trust as the primary or contingent beneficiary of your assets. Unfortunately, many people who invest time and money into creating a revocable living trust fail to do this. With some important exceptions, all of your real property, personal property and business interests should be funded to your trust. If your trust is not properly funded, many assets may still have to go through a probate proceeding after your death before eventually reaching your trust and its beneficiaries. We own real property in more than one state. Can we put all our property into one revocable living trust? Yes, and this is one of the advantages of a revocable living trust. Without a funded trust, not only will the property you own in the state where you are legally domiciled be subject to probate, but the real property you own in another state will go through an ancillary probate in accordance with that state’s laws. By funding both properties into your single living trust, you eliminate the need for both probate proceedings. How can I obtain help with funding my living trust? Your first resource is the attorney who drafts your estate planning documents. If necessary, your attorney can create a deed for any real estate placed into your trust, and assist in transferring non-real estate assets. Your CPA, CFP, or financial advisor can also help with completing forms to name your trust as a new owner or beneficiary. Considering the importance of funding your trust, it is wise to seek professional advice. Our trust is long and contains very personal information. Do we really have to provide a copy, just to fund it? A financial institution needs to know who has the authority to act on behalf of your trust as this information will insulate them from potential legal liabilities. Your attorney should prepare for you a Certification of Trust which shows the legal name of the trust, a list of the trustees and successor trustees, and the trustee powers. By Florida statute, any company doing business in the state must accept the Certification of Trust in lieu of the entire trust. Do we have to file a different income tax return for our trust? Assuming your trust is revocable, that is, you maintain control over it and can make changes to it until your death or legal incapacity, you will not have to file a trust income tax return while you are living. You can continue to file your single, joint, or separate personal tax returns using your Social Security number as usual. Upon your death, a separate tax return may be required for the trust. he eyes are the first thing we notice when we meet someone. Beautiful eyes can make up for other features that are less than ideal. Likewise, eyes that are tired, droopy, or puffy may not reflect a vibrant inner self. It is often said that the earliest signs of aging are around the eyes. Perhaps people are always questioning whether or not you had a good night’s sleep, because your eyes are swollen with bags. Fortunately, at the Weston Cosmetic Surgery Center, we can give you dramatically younger looking eyes through “eyelid lifts,” also known as blepharoplasty. A primary reason for droopy eyes is simply due to age. It can also be hereditary. As everything droops, so do the eyebrows. As the outer part of the eyebrows droop, the skin of the upper eyelids will look saggy, as if you had developed extra skin that was not there several years before. Trimming this “extra” skin can drastically improve that droopy look. Another reason for “tired eyes” is because of droopy or migrating eyelid fat. This fat is held back by a thin wall of fibrous tissue called the orbital septum, which weakens over time. The fat, held firmly back by this wall in youth can bulge with age, giving you “baggy” upper and lower eyelids. Blepharoplasty trims this extra fat and tightens the wall, Before restoring a youthful contour. For those patients with puffiness under the eyes or baggy upper and lower eyelids, laser eyelid surgery can reduce and often eliminate these problems. The end results are a more alert and youthful look around the eyes. After The prominent fat pockets can be removed from a hidden incision along the inside surface of the eyelid. This “no stitch,” no external scar technique is utilized when patients have fat prominence of “eyelid bags” alone without excess or sagging eyelid skin. If minimal excess skin is present, a skin pinch technique is combined with transconjunctival fat removal. In this case, a “pinch” of lower eyelid skin is removed. These techniques typically result in less swelling, less discomfort, and shorter recovery time. I will assess which technique is ideal for your eyes during your personal consultation. Recovery from eyelid surgery usually takes seven to ten days. Sunglasses allow you to go out in public immediately after surgery, and make-up can be worn within about one week. Normal activity can be resumed within a few days, and exercise can be resumed within 14 days after surgery. If the eyes looking back at you in the mirror are not reflecting how you are feeling, it might be time to consider a blepharoplasty. T
he majority of my Family law practice is devoted to divorce (dissolution of marriage) cases. That, however, is not the only area of family law that I am involved in. There are those cases which do not involve a marriage at all. Here is an example of what I am referring to. Let’s say a couple decides to live together and not get married. During their relationship they have a child, perhaps two. They stay together for several years even after the children are born, but they never get married. After a number of years they grow apart and decide to move on with their lives and separate. The question becomes, what issues might need to be addressed in this relationship. Many of us have heard the term, “Common Law Marriage.” In states that recognize Common Law Marriage, a couple that is together for a number of years is in essence presumed to be married. Therefore, certain issues would need to be addressed based upon their “break up.” Florida, however, does not recognize Common Law Marriages. If a couple has not entered into a state sanctioned marriage, whether it be in Florida or any other jurisdiction, they are not considered to be married in Florida. That can be significant in some cases. Assets or debts will not be addressed in the family court. There will be no provision for spousal support. This is true no matter how many years the parties may have been together. If there are disputed property rights, it will be determined in civil court by the filing of a lawsuit and not by the filing of any divorce petition. Of course, we still have to address the issues involved with the minor children. In Florida, if a child is born outside of a marriage, an action to determine Paternity must be brought. Unless paternity is established, a father will not be granted any of the rights of a parent. If the father wants to share in the parental responsibility or if either party wants to seek child support, a paternity action must be brought. Either the mother or the father can file for paternity of a child. If Paternity is denied, the court will order a DNA test, which will determine if the individual is in fact the father. If there is no dispute, then an Agreed Order of Paternity can be entered. Once it is established, the Father shall have all the same rights and responsibilities of any Father. These rights would include Shared Parental Responsibility and time sharing. It would also require that child support be paid by either the mother or the father depending upon the income of each party, the time sharing schedule and the child support guidelines. oot, ankle and leg problems in the growing child are often considered to be “Growing Pains” in the bone and muscles of the lower extremity. While in a small number of cases this might be true, in a majority of the cases the pains that plague these children and teenagers may be caused by lower extremity malalignment problems. Growing pains are often seen in children who are excessively flatfooted or whose feet point to the outside. Children may also appear very knockkneed. Tight calf muscles can not only cause but significantly aggravate the pain that these children are experiencing, especially at night. Leg pain is most commonly seen, especially at night after a long day of activity. Pain with activities, especially along the inside of the knee, lower leg, ankle and foot, may also be seen. This is often associated with a general avoidance of activities and sports and premature fatigue with many activities. Many children can also develop lower back pain.

Treatment is important early on. Changing a child’s shoe gear to add more support to the foot and ankle may provide immediate help. Avoiding barefoot and flat shoes is necessary. Custom molded orthotics (shoe inserts) will immediately help to realign the foot and the entire lower extremity. This will almost overnight eliminate the problem. Physical therapy may also help to decrease overall muscle tightness and to improve muscle strength and coordination. If the foot is flat and associated with tight calf muscles, stretching the calf muscles in a walking cast is critical to not only eliminate the problem but to prevent a recurrence. If the flatfoot deformity is severe, there is a small percentage of children that will benefit from a procedure to realign and “correct” the flatfoot. An excellent prognosis is always seen when the cause is identified and the problem treated. Carlo A. ow many of us have suffered from annoying and painful conditions like ingrown nails, thick nails, and bruised nails? We continue to put on our favorite shoes, our toes squirming inside them, and walk around in discomfort. We hope that the problem will go away on its own if we ignore it. Ignoring the problem, however, will not make it go away. Ingrown nails can be very painful. It occurs when a toe nail grows into the skin surrounding it. This can happen typically on either edge of the big toe. The cause of an ingrown nail may be due to improper trimming, inherited nail deformities, injuries, fungal infections or too much pressure on the nail. People commonly complain the most about ingrown nails when walking. Pain may be felt at the tip of the toe or all the way back to the base of the toe. You should not dismiss the pain as minor, because it could lead to infection, inflammation or even more serious conditions. Treatment for an ingrown nail should include an evaluation by a podiatric physician. If the nail is infected, he could prescribe an antibiotic. He may also trim the nail, remove part of the nail and/or treat the nail with a substance that will keep the ingrown part of the nail from growing back. To lesson pain, the podiatrist may give an anesthetic during the removal procedure. Bruised nails can be caused by an acute injury to the toe or a repetitive injury. Podiatrists often see these injuries in patients involved in sports like running or in patients who have had heavy objects fall on their toe. The big toe is most commonly the victim. A podiatrist may treat the bruised nail by removing it with the aid of an anesthetic, or drilling a hole in the nail to relieve pressure and promote drainage. You may also be prescribed pain medication. Soaking or icing the nail may also help. If your pain is tolerable, the nail can be left alone to fall off. A new nail commonly grows in to replace the old nail. There can be many causes of abnormally thick or crumbling nails: injury, pressure from shoes, fungal infections, diabetes, psoriasis or vascular disease. Sometimes the nail will loosen and fall off. The nail can also appear brittle, rigid, or yellow as well as thick. It is important to visit a podiatrist if you have this problem, because it may be a symptom of a serious underlying condition. If the thick nail is caused by a fungal infection, a culture may be done. If the nail is not infected, it may be thinned by trimming, filing or grinding. Advances in Mammography: Fighting Cancer in 3D Breast Tomosynthesis

Regular screening mammograms, which create twodimensional views of the breast, can reduce cancer death by 30 percent. But newer technology that creates three-dimensional (3D) mammograms offers important advantages, including greater detection of breast cancers that cannot be seen using those traditional mammograms. In one study of almost 13,000 women, use of 3D mammograms resulted in a 40 percent increase in detection of invasive breast cancer. This new technology is available at both Cleveland Clinic Florida’s academic medical center in Weston, as well as the West Palm Beach location. “Tomosynthesis gathers images of the breast from several different angles, to create a series that forms the 3D image,” says Maria Artze, MD, a Cleveland Clinic Florida radiologist who specializes in breast imaging. “Having these various images reduces the challenge of seeing areas where tissues overlap, and so improves the radiologist’s ability to detect breast cancer.” The technology makes it possible for the first time for radiologists to see a 3D image of the breast. Because of the high level of detail it provides, the images also highlight masses and abnormalities that conventional mammograms might miss. “In images of the breast, dense tissue appears white, and cancer appears white,” says Cassann Blake, MD, Cleveland Clinic Florida breast surgeon. “Tomography gives us much more detail compared to other types of mammograms. Especially for women with dense breast tissue, this detail is important.”

For the patient during the screening, the procedure will be familiar to other mammograms they’ve had. The only difference is that part of the equipment moves in an arc around the breast, instead of staying stationary. Studies also show that with tomosynthesis, fewer patients need to return for additional mammograms, visits that can cause stress and expense, plus exposure to additional radiation. Research further shows this procedure provides a 15 percent decrease in the number of “false positives,” where tissue looks cancerous but through biopsy (tissue sample) or another exam is later found to be normal. So 3D mammograms can also help women avoid unnecessary biopsies. “Early detection of breast cancer is a key area that we want to highlight,” Dr. Blake says. “Offering the advantages of the 3D mammogram is part of our goal to provide our patients with the best quality of care. I
t is estimated that up to 40% of the world’s population suffers from varicose veins in various forms. In about 50% of the cases, cosmetic vein issues are often a sign of treatable underlying circulation issues. Many people do not know, however, that congestive heart failure and varicose veins are often mistaken for one another. While vein symptoms often manifest themselves cosmetically, they can be and are often part of a greater circulatory problem. The leg swelling that is often considered to be a problem with the heart or blood pressure is often just veins underneath the skin that have failed to work properly. Symptoms often associated with vein disease include leg pain, discoloration, heaviness, swelling, throbbing, itching, restless leg syndrome, cramping, burning and fatigue. Vein disease is a progressive disease, so symptoms will worsen if left untreated. Varicose veins may indicate a critical blockage in deeper veins, a condition called deep vein thrombosis, or DVT, that can be life threatening. A DVT is a blood clot, or thrombus, which typically forms in the calf veins of the leg, but can also develop in the deep veins of the thigh. In addition to the aching in the legs caused by this serious condition, there is also a psychological toll that stems from the appearance of these unsightly veins. Those that suffer from this condition are often too embarrassed and self-conscious to show their legs, which has a tremendous effect on their life-style and overall daily enjoyment of life. Through a relatively simple procedure, using the latest, cutting edge technology, in very little time, you can greatly reduce the symptoms and source of varicose veins. Enodvenous Laser Treatment (EVL) is a quick, minimally invasive laser treatment and does not require hospitalization or complicated surgery. EVL is an FDA-approved procedure in which a small optic fiber is inserted through a needle into the varicose vein, which heats and closes the vein. The entire procedure takes about one hour and causes minimal discomfort. Performed under ultrasound guidance, EVL uses laser energy to treat varicose veins by closing off the vein, preventing it from flowing in the wrong direction down the leg. Your body then naturally uses a multitude of other healthy veins to return blood to the heart. The latest Varicose Vein Treatment, called Foam Sclerotherapy, uses special equipment that helps isolate the affected veins and their origins. Street Dedication Explorers
The City of Pembroke Pines Police Department Explorer Post 108 recently participated in the 2015 Florida Association of Police Explorers Annual Conference and Competition. Scoring 30 points above their nearest competitor, the Pembroke Pines Post won the state championship.

Former Pembroke Pines resident Lance Corporal Patrick Xavier, Jr. was killed in action on May 18, 2010. In his memory, the City of Pembroke Pines re-named 172nd Avenue to Lance Cpl. Patrick Xavier, Jr. Avenue. Family, friends, elected officials and members of the United States Marine Corps 4th Civil Affairs Group recently gathered for the dedication.
