Happy Thanksgiving

W

ith the Halloween sugar rush slowly wearing off and the holiday season upon us, we take a deep breath and wonder where the time went. In the blink of an eye, the entire year seems to have gone by. Another year of our kids growing up and becoming young adults, of family, friends and togetherness, of being there for each other and enjoying each other’s companionship. When we sit down this month with our loved ones from near and far to indulge in a traditional Thanksgiving feast, let’s give thanks for all the little blessings we have received throughout the year. This holiday season, reach out to your friends, neighbors, co-workers and the less fortunate. Consider opening your heart (and maybe your wallet) to help to provide a holiday meal for those in need.

SWFP Community Center Hosts Annual Thanksgiving Drive Community News

By Debby Teich

F

or millions of Americans, the Thanksgiving holiday is an opportunity to indulge in roasted turkey, buttery mashed potatoes, and pumpkin pie, while enjoying the company of friends and families. For those who are less fortunate, however, the holiday may take on a very different meaning. This month, the staff at the Southwest Focal Point Community Center will host the Annual Thanksgiving Food Drive to reach out to those in need of assistance. With donations from schools, businesses and residents, they are hoping to provide 100 Thanksgiving baskets and meals to families in Pembroke Pines. “We are aware that this is a difficult time for everyone during the holiday season, but there are others less fortunate in our community,” said Jay Shechter, Director of the SW Focal Point Community Center. “Through November 16, we are kindly requesting and accepting donations in the form of canned and dry goods, turkeys, checks or gift cards to purchase these items. We would greatly appreciate your contributions.” Students at City of Pembroke Pines Charter Schools, public schools and private schools have already started collecting items for the Thanksgiving baskets. Some of the items include: stuffing, cranberry

sauce, canned yams, flaked potatoes, gravy, canned corn, green beans, fruit, and desserts. The SWFP Community Center purchases the turkeys, and pies. Once the school drives are complete, members of the Pembroke Pines Professional Fire Fighters Local #2292 will donate their time to assist with transporting bins and help collect food at various locations. They will work with the Pembroke Pines Police Department and other volunteers to help sort and package everything in the baskets filled with a turkey and all the trimmings. Chartwells Food Services, who caters for the Pembroke Pines charter schools, is also a contributor. “On behalf of those who need a helping hand, we extend deep appreciation to those who support the Annual Thanksgiving Food Drive,” said Shechter. “The generous contributions make it possible for families to enjoy this holiday.”

any think of the library as a place to read a book in silence. On November 14, some of these books will come alive at the 14th Annual StoryBook Festival, which will be held from 10am to 4:30pm, at the Pembroke Pines Southwest Regional Library, located in the Pembroke Pines Academic Village. The free family event offers a day of music, dance, storytelling, storybook characters, children’s performances and more. The StoryBook Festival is presented by and funded through the Broward Public Library Foundation with support from the City of Pembroke Pines, Friends of Southwest Regional Library and several others. The first 1,000 children to arrive will receive a free book. Children are encouraged to come dressed in their favorite storybook costumes and join the Storybook Parade. This year’s theme is “Just So…A Tribute to Rudyard Kipling.” Born in 1865, Kipling is well known for his pourquoi stories, a subset of folklore that explains how things came to be the way they are. All of the Storybook Festival activities will center on Kipling’s stories. Storytellers, entertainers and theatrical groups will also incorporate the Kipling story theme into their performances. Headlining the event is “Stand-Up Chameleon” Jackson Gillman, who in 2014 received a Best Educational Show award for his off-Broadway debut as part of the

United Solo Theatre Festival for his show “The Magic of Rudyard Kipling: Just So.” The Teen Room will be turned into the “How and Why” room, which will incorporate the “Just So Stories” by Rudyard Kipling, such as How the Alphabet Was Made. A facilitator will be working with students at local elementary schools to help them write their own pourquoi stories. During the festival, the Friends of the Southwest Regional Library will honor a winner from each class. Winners will receive a gift card and their teacher will receive a gift basket. Some of the other highlights of the festival include: ▸▸ Join the StoryBook Parade, along with a large cast of storybook characters. ▸▸ Watch live children’s performances on three stages. ▸▸ Get creative in the arts and crafts tent. ▸▸ Roam the Fantasy Forest, a magical place where children can interact with their favorite storybook characters. ▸▸ Get your face painted. ▸▸ Swap tales at the “Swappin’ Ground” area, where children can tell their own stories. ▸▸ Bring cameras to take pictures at the StoryBook Photo Spots, which include favorite story book characters. ▸▸ Indulge in tasty treats from the food trucks. Seniors Test Their Spanish Spelling Abilities By Debby Teich

n recognition of National Hispanic Heritage month, seniors once again competed for the title of “Spelling Bee Champion.” The 4th Annual Senior Spanish Spelling Bee was held at the City of Pembroke Pines Southwest Focal Point Community Center. “Every year we see an increase in participants,” said Silvia A. Aguilar, SWFP Community Services Administrator. “It takes a lot of courage to get on stage and participate under pressure with so many people watching.” Pembroke Pines Director of Community Services and Housing Jay Shechter, who loves to play Scrabble, came up with the idea for a Spelling Bee several years ago. After holding the first two in English, the Spanish-speaking seniors wanted a turn. The next contest was in Spanish, in celebration of National Hispanic Heritage Month. The recent Spelling Bee was open to those 18 and older. The tension was high throughout the competition, as sixteen contestants spelled a wide range of words using the pronunciation from the Spanish alphabet, including any special punctuation. The contest started with easy words, such as “blusa” and “hablar” and progressed with more difficult ones. Once contestants misspelled a word, they were eliminated. Adela Nazzarri was declared the winner after she correctly spelled “quebradizo,” which means something that is brittle or breaks easily. She received $50. Luz Pardo, who placed third in the 2014 Spelling Bee, was the 2015 second place winner ($30) and Candelaria Vergara won third place ($20). All three also

PPTOPA Presents “Carousel” On Stage By Debby Teich

I

f you have always dreamed of seeing a Broadway show, the Pembroke Pines Theater of the Performing Arts (PPTOPA) can give you a taste of what it is like. It offers top-notch community theater at an affordable price. Through November 22, “Carousel” will be on stage for several performances. “We invite everyone to come see the show,” said Mina Mandel, executive vicepresident. “The cast is fabulous and talented.” Rodger’s and Hammerstein’s “Carousel” is a classic American musical that explores human frailty, resilience, and the power of forgiveness. It features some of the most powerful music ever written for the stage, including “If I Loved You,” “Mister Snow,” “June is Bustin’ Out All Over,” and the iconic “You’ll Never Walk Alone.” The story revolves around carousel barker Billy Bigelow, whose romance with millworker Julie Jordan comes at the price of both their jobs. He attempts a robbery to provide for Julie and their unborn child; after it goes wrong, he is given a chance to make things right. Billy is allowed to return to earth for one day fifteen years later, and he encounters the daughter he never knew. Louise is a lonely, friendless teenager, her father›s reputation having haunted her throughout her young life. How Billy instills in both the child and her mother a sense of hope and dignity is a dramatic testimony to love’s transcendence. PPTOPA is the oldest continuously operating community theater in Broward County. It was founded in 1993 by a group of dedicated individuals who wanted to provide low cost, high quality live theater for the community, as well as opportunities for anyone interested in assisting in the creation of theater. While technically an “amateur” company, PPTOPA productions routinely feature some of the finest actors and actresses in South Florida. They are teachers, attorneys, doctors, business owners and others who volunteer their time to immerse themselves in something they love. Recent casts have included performers who have headlined productions at Stage Door, Curtain Call, Tamarac, and Actors Theaters. They have been on national Broadway tours, starred in Hollywood films, and written and produced their own plays. Many have been

nominated and selected as recipients of South Florida›s Carbonell awards. PPTOPA presents three shows annually and many of them have attracted as many as 4,000 people. With a full orchestra, as well as professional sets, backdrops and costumes, the plays are expensive to produce. The theater raises money through donations and ticket sales, which range from $14 to $24. The next show will be the Mel Brook’s musical, “Young Frankenstein” in the spring.

A new chapter in cancer care is here.

Don’t Smoke? You Could Still Get Lung Cancer If you think you are safe from lung cancer because you have never smoked, think again. While cigarette smoking is the No. 1 cause of lung cancer, secondhand smoke, exposure to toxins, or a family history of lung cancer can also trigger the disease.

Bruno Bastos, MD

Cleveland Clinic Florida

Oncologist There is a false perception that lung cancer is the result of a personal choice to smoke, so lung cancer patients are not always viewed in the same light as those with other types of cancer.

“There’s a huge stigma associated with lung cancer because the majority of people who die from it are either smokers or former smokers,” says Cleveland Clinic Florida oncologist Bruno Bastos, MD. “But, tobacco is one of the most addictive substances known to man. Addiction is a disease, and nobody deserves to get lung cancer.” Patients who have stopped smoking are still at an increased risk for lung cancer long before they receive a lung cancer diagnosis. “Additionally, the fact is that anyone can be exposed to toxins and develop lung cancer, so this is a disease that should concern everyone,” Dr. Bastos said. The stigma associated with lung cancer has had a negative effect on lung cancer research. Although statistics from the Centers for Disease Control show that more people in the United States die from lung cancer than any other type of cancer, researchers have had a difficult time obtaining funding to find a cure.

The Maroone Cancer Center is the first hospital-based facility in the southeastern United States to install and operate the most advanced nonsurgical technology to break down tumors. This revolutionary, noninvasive approach using external beam radiotherapy improves accuracy, safety and recovery time. Learn how our holistic approach is helping more patients survive cancer.

appointments 855.324.8153

“Other types of cancers also have a lot more survivors who can advocate for funding,” said Dr. Bastos. “There are not enough lung cancer survivors to demand change and those who do survive often blame themselves, and many are not willing to tell their stories.” Despite the lack of funding for research, there has been great progress made in lung cancer diagnosis and treatments over the last several years. “There are many different types of lung cancer,” Dr. Bastos said. “Genetic testing has helped researchers to develop therapies that target specific types of cancer cells.” Immune-based therapies, in which the immune system is primed to attack tumors, also are showing potential for treating lung cancer, Dr. Bastos said. These therapies already have been approved for treating skin cancer. Development of screening tools such as CT scans help with early identification of lung cancer, too, which Dr. Bastos says “could save tens of thousands of lives.”

hether you are a gun enthusiast or you just want to try your hand at shooting, you owe it to yourself to visit Nexus Shooting, one of the most advanced gun stores and ranges in the world. Located conveniently in Davie, this amazing facility is state-of-the-art in every way. It’s the perfect spot for those looking for a fun new sport and hobby, a thrilling and exciting idea for their next date night or peace of mind when it comes to protecting themselves and their families.

vate experience for your family, corporate event, parties, or just a group of friends. The ranges are 100 percent air conditioned and filtered with a million dollar military grade ventilation system allowing you to breathe easy and shoot in complete comfort no matter how hot and humid the Florida weather is outside.

Co-owner Bernard Hsiao, M.D., PhD answered some commonly asked questions about Nexus.

Describe the showroom. Our guests call our one-of-a-kind showroom the “Guggenheim Museum or Apple Store of gun stores” due to its spacious, clean and modern appearance showcasing hundreds of firearms.

What services/products do you offer? We offer gun and ammo sales, rentals, repairs, accessories, a 75 foot indoor range and training. What distinguishes Nexus from its competitors? Nexus is the only 5 star rated range in all of South Florida and is one of only 63 in the entire nation (out of an estimated 18,000 ranges) to have received this distinction. We received this award through our dedication to providing an unparalleled shooting and shopping experience as well as industry leading customer service. Nexus Shooting is an all-encompassing entertainment venue highlighted through the use of our revolutionary interactive live fire virtual range technology, the Nexus Lanes. Since the invention of the firearm, we have been shooting the same way, making holes in non-moving paper targets. This is of limited value when trying to learn practical real world skills. It’s highly unlikely that an intruder in your home is going to stand there like that paper target. Our proprietary technology allows you to shoot your gun and real ammo at interactive video targets such as video scenarios, shooting galleries, moving targets, zombie games, skill drills, and more. Each shot is analyzed by a computer and provides instantaneous feedback to help you become a better shooter. The Nexus Lanes bring your shooting skills to the next level while making it fun and entertaining at the same time. We also have a traditional paper target range as well. Describe the shooting range? With 40 lanes of shooting fun, Nexus has more capacity than any other range in the Southeast U.S. The ranges are subdivided into multiple rooms so that you can rent an entire room and have a completely pri-

Who is your typical customer? We attract a high number of non-traditional customers who might otherwise be intimidated to visit a gun store such as women, kids, tourists, and especially first time shooters. Novices are warmly received and are taken step by step through the entire process.

Do you rent firearms? Yes, we have a very extensive rental selection with almost 150 different firearms available. Choosing a firearm is a very personalized process and our rental program allows our guest to try out a variety to find the perfect one. We also rent a number of military, exotic, and even fully automatic firearms.

The Nexus Lanes... real gun, real ammo, real fun!

Describe your staff. Our staff is friendly, highly trained, and professional. They are experts at guiding our customers in renting and trying different firearms or purchasing one in our state- ofthe- art showroom. Our certified instructors also provide basic and advanced training. Describe the membership requirement and benefits. Nexus has one of the best memberships in the industry, only $10 for a lifetime membership that comes with a LOT of amenities. This gives you access to our range, creates a digital account to store your scores from the electronic Nexus Lanes, access to members only promotions and discounts such as our free classes for firearm law and youth safety, and tracks your spending for reward points. What kind of licenses are available? We like to be flexible with the kind of practice our guests do. Rapid fire, holster draws, prone positioning and shooting on the move are all permitted. However, at the same time, we provide a safe, environment for all shooters by qualifying guests who wish to practice these skills through our multi-level licensing system to ensure they can do so proficiently and safely. There is a

short qualification test for each of the three levels (Rapid Fire, Operator, and Elite) which is overseen by one of our NRA certified instructors. Once a guest reaches the Elite level, they are invited to participate in our weekly Elite drill nights where we set up an entire obstacle course in our tactical bay and we practice room clearing, shooting on the move, and other tactical and competition based skills.

NOVEMBER 2015 | Our City Pembroke Pines

What classes and training do you provide? Nexus provides classes and training for shooters at all levels. We have classes for concealed weapons permits, first time shooters, women and youth and basic firearm operation for all different gun types. We offer advanced training every Wednesday and Thursday night with our Elite drills. Nexus also offers private lessons to custom tailor the training to the individual’s needs. All classes are taught by our highly experienced NRA certified instructors. Is it expensive to visit Nexus Shooting? You might think we are the most expensive shooting range in the world based on the high level of amenities and the first class environment we provide, but that couldn’t be further from the truth. In fact, we aren’t even the most expensive range in Broward County. All of our pricing is comparable to any local store and range. We understand that our guests work hard for their money, and we feel that Nexus provides a nicer environment and experience for the same price. Who wouldn’t want to drive a Ferrari for the price of a Toyota? That’s the value we provide. Nexus Shooting is located at 2600 Davie Road in Davie. It is open from MondayFriday from 10am - 10pm; Saturday from 9am to 10pm; and Sunday from 9am-8pm. Preston Howell Sets His Sights on Broadway

Can Do Kid

By Debby Teich

E

Preston Howell

leven-year-old Preston Howell of Pembroke Pines dreams of performing on the Broadway stage one day. With his new role in the 6th annual Aventura Mall Young Stars Showcase, he is one step closer to the New York stage. Preston was one of eleven kids, ages 8-15, selected

to perform in the Vegas-themed event, which will be held on November 15, at the Aventura Arts & Cultural Center. It will feature a glitzy stage, sequined costumes and familiar songs from Vegas stars. As the King of Pop, Preston will be performing an Elvis medley that includes “Jailhouse Rock,” “Blue Suede Shoes” and “Hound Dog.” He has been working closely with his mentor and coach, Ben Bagby, to learn some of the classic Elvis moves and is excited about the performance. “I have been working on this for a long time now,” said Preston. “When they added the dancers as my background, I knew that the audience would love it even more. I can’t wait to do this for an audience and to hear them cheering.” Preston’s career started five years ago with just a few Frank Sinatra songs that he learned with his dad, Paul. His mother, Pamela, says she could not believe the voice that came out of him. “I knew that his pitch and tone was unique,” said Pamela Mori-Howell. “His sweet voice was one of gift.” Although Preston’s mother regularly reminds him that this type of career can be difficult, he is convinced that there is nothing else for him. “I love how I feel when I am on the stage,” said Preston. “It comes naturally to me.” Preston has already been in many productions, including community theatre, school shows and more. In January, he will be in a special performance of Seussical the Musical by the acclaimed Jupiter Maltz Theater. He has also been very involved in the

Pembroke Pines Theatre of Performing Arts, which has become like his second family. In summer 2014, he performed at PPTOPA as Gavroche in Les Miserables. Last summer, he was in the male ensemble of Mary Poppins. In addition, he has been involved in choir at Florida Christian School, participating in All State Choir and Elementary Drama. He also sings as a soloist at his church, Christ Covenant in Southwest Ranches. Preston hopes that his music will provide a new means for him to give back to his community. “I would like to give back to my schools for teaching me all that I know” said Preston. Preston also wants to give back to other charitable organizations that are close to his heart, such as the Joe DiMaggio Children’s Hospital Foundation, where his mother worked for many years.

PPCS Students Bag the Trash During a Coastal Cleanup

School News

By Debby Teich

“We all had a great time helping with the beach cleanup,” said Piper Spencer, Science Department Head at the Central Campus. “Our students are very motivated to help keep their environment clean. They were very surprised and disappointed to see what people leave on the sand after enjoying a day at the beach.” Around the world, people participating in beach cleanups found many strange items, including a lawnmower in Spain, plastic banana in Guatemala, paintbrush in Malyasia and 32 lightbulbs in Ghana. Worldwide, the top five items collected, which have the worst impact on sea turtles, are: cigarette butts, food wrappers, plastic bottle caps, straws/stirrers and plastic beverage bottles.

H

ollywood North Beach Park is now a little cleaner thanks to the efforts of students from the Pembroke Pines Charter School System. Students, who range from kindergarten to high school, recently participated in the 30th Annual International Coastal Cleanup. In total, they collected over 500 pounds of garbage at the cleanup, which has become a school tradition. After applying sun screen and putting on gloves, the students hit the sand. As they bagged up the debris, they became increasingly aware of the amount of trash people left behind. This was particularly concerning to the students at the East Campus, who adopted a sea turtle nest earlier this year. “As we picked up bottles, cans, cigarette butts, wrappers, cups, and forks, our students become more and more aware how little respect people have for their environment and the large negative impact trash has on sea creatures and birds,” said Lisa Dizengoff, Science Chair at the East Campus. “After this experience, our students won’t hesitate to remind people to use garbage cans and not leave trash behind…anywhere!” For information, visit www.pinescharter.net.

his month, the U.S. Department of Education will honor 285 public and 50 private schools at a recognition ceremony in Washington, D.C. and Pembroke Pines Charter Elementary School – FSU Campus will be among them. United States Secretary of Education Arne Duncan recently announced that the school has achieved the coveted National Blue Ribbon School 2015 designation. The school held an assembly to announce the honor to students, faculty and staff. “Our school was one of 335 schools from all over the United States of America that achieved the National Blue Ribbon School status,” said Dr. Lisa Libidinsky, PPCES-FSU principal. The National Blue Ribbon Schools Program honors public and private elementary, middle, and high schools where students either achieve very high learning standards or are making notable improvements in closing the achievement gap. ing content. The award flag gracing a school’s building is a widely recognized symbol of exemplary teaching and learning. With students seated on the cafeteria floor, Libidinsky called up each teaching team by grade, as well as the special area teachers and support staff. They posed for photos in their new t-shirts that stated, “I Teach! What’s your Super Power?” The shirts were donated by the Parent Teacher Association. “The design on the Shirt has an ‘S’ for Superhero, because there is a hero in each one of us,” said Libidinsky. Duncan spoke to the assembly in a video message. “This honor recognizes your students’ accomplishments and the hard work and dedication that went into their success. Your journey has taught you collaboration, intentional instruction, and strong relationships in school and with your community. You represent excellence—in vision, in implementation, and in results—and we want to learn as much as we can from you.”

ast month, the United States Secretary of Education Arne Duncan announced that 335 schools achieved National Blue Ribbon School status for 2015. I am very proud to announce that the Pembroke Pines Charter Elementary School - FSU Campus was one of those schools to achieve National Blue Ribbon School status for 2015. The U.S. Department of Education will honor 285 public and 50 private schools at a recognition ceremony on November 9 and 10 in Washington, D.C. In its 33-year history, the National Blue Ribbon Schools Program has bestowed this coveted award on more than 8,000 of America›s schools. The National Blue Ribbon Schools Program honors public and private elementary, middle, and high schools where students either achieve very high learning standards or are making notable improvements in closing the achievement gap. The award plaque affirms the hard work of students, educators, families and communities in creating safe and welcoming schools, where students master challenging content. The award flag gracing a school›s building is a widely recognized symbol of exemplary teaching and learning. I would like to congratulate Principal Dr. Lisa Libidinsky, the faculty, and students past and present for receiving this prestigious award.

Representation you can trust. Legal Counsel to Community Associations Since 1977

On a more serious note, I continue to be concerned and outraged about the recent rash of police officers being shot and disrespected. As community leaders, we work to ensure open communication exists and is encouraged, and mutual trust and respect is built and rebuilt among those in our community and those who serve to protect it. Our Pines Night Out, which was held in October, supports this goal. We are proud of our police. Let’s change the rhetoric and all show support. Please also remember to mark your calendars for November 11, at noon, at the Pembroke Pines City Center Veterans Memorial Pavilion, located at 10300 Pines Blvd., where a solemn ceremony of remembrance for all veterans will take place. The ceremony will include the presentation of colors, guest speakers, and lunch for the veterans. Pembroke Pines Veterans Memorial Commemorative bricks are still available. For more information on purchasing a brick, please call 954-435-6520. I would like to wish you and your family a very Happy Thanksgiving. As always, if you have any questions or concerns, please do not hesitate to contact my office at 954-435-6505, or by email at fortis@ppines.com.

Buttock Enhancement a.k.a. BBL (Brazilian Butt Lift) Ask the Expert

by Charles A. Messa, III, MD, FACS

J

ennifer Lopez, Beyoncé and Kim Kardashian started a craze for an enhanced buttock as flat or less protruding rear ends everywhere are being surgically enhanced into more shapely curves and feminine fullness. More women everywhere are considering, or getting buttock enhancements – lifted, sculpted, or augmented. Tighter fitting clothing, such as low-cut sweats, workout pants and leotards, are seen in public more often and a more shapely feminine figure has become aesthetically more desirable. The popularity of the butt lift is not just a U.S. fashion fad. Many women desire to enhance their buttock and thigh region to create a beautiful buttock shape and the very attractive sweep of the lower back, hips and waist. The buttock augmentation (a.k.a. Brazilian Butt Lift) is enjoying a surge in popularity, because women are unhappy with their buttocks, viewing them as too flat, too wide, or sagging. They were either born like this, or lost the form and shape of their buttocks after losing or gaining weight. Pregnancy, or just aging alone, can also affect the size, projection, and profile of the buttocks. Inability to achieve perky buttocks and sexy curves through exercise and muscle toning has frustrated health-conscious women. There are a variety of cosmetic surgery procedures available for those who desire youthful, fuller, and perky buttocks, with a more sensual body profile. These techniques vary depending on what is actually missing and what is the overall body frame and form. For example, there are many who are either genetically or by weight gain have developed “fat and wide” buttocks. Liposculpture can shape their buttocks and the surrounding tissues to make the buttocks rounder and more proportional to the rest of the figure. On the other hand, there are those who have “flat and wide” buttocks. In addition to utilizing liposculpture to shape their waist, hips and buttocks, fat injection or grafting is used to augment the buttocks and to provide fullness and projection. Because it also helps to lift loose buttock tissue, this procedure is also referred to as a Brazilian Buttock Lift. Contrary to the above, there are some with sagging buttocks who are not a candidate for Brazilian Buttock Augmentation. These are people whose buttocks sag as a result of massive weight loss, such as after a gastric bypass surgery. These individuals would benefit from a body lift procedure which removes excess skin and helps to lift their thighs and buttocks. During your consultation, Dr. Messa will review your treatment options for buttock contouring, augmentation and enlargement. He will discuss if you are a good candidate, surgical options and techniques, potential risks and complications of surgery, pre and post-operative instructions, as well as what to expect after surgery. Dr. Messa is board certified by both the American Board of Plastic Surgery and the American Board of Surgery, an active member of the American Society of Aesthetic Plastic Surgery, American Society of Plastic Surgeons, and a Fellow of the American College of Surgeons. He is a recognized expert in cosmetic plastic surgery and has achieved Allergan’s Black Diamond Award as one of the top 1% of plastic surgery practices in the country by volume. Dr. Messa has also achieved Chairman status with Medicis and Mentor Corporation. This award honors distinguished leaders in cosmetic surgery for demonstrating expertise and excellence through a high volume of aesthetic product procedures. The certification is awarded to leaders in the field of medical aesthetics and demonstrates their commitment to innovation, excellence, and the highest level of patient care. t is becoming somewhat commonplace for individuals who are going through a dissolution of marriage or other family law matter to avoid the cost of an attorney. In some instances, such strategy can be cost effective and successful. If it’s a short term marriage with little or no assets and no minor children, the process can be somewhat simple. This of course means that the parties are in full agreement and are basically just seeking to terminate their marriage. Any issue which is not resolved will complicate the process. The problem arises when individuals attempt to resolve their case without having the necessary knowledge and sign away their rights. Often they realize that they may have made a mistake and as a result seek a way to void the Agreement. It is often too late and the decisions they made are final and legally binding. A Marital Settlement Agreement is a legally binding contract entered into between two parties. Of course there may be legal grounds to set it aside under certain circumstances.

I have seen a number of individuals that come to my office with a signed Mediation Agreement. These individuals went to mediation without the benefit of an attorney. Mediation is a process in which a neutral third party attempts to resolve the parties’ differences. The important aspect of mediation to remember is that a mediator is neutral and does not represent either party and should not give legal advice. Therefore, if parties choose to attend mediation when not represented by an attorney, they are on their own. Often individuals feel pressured to resolve the case so they can move on with their lives. This can sometimes lead to individuals agreeing to something they would not have agreed to if they took the time to consider it. If that person had an attorney, he/she would have been advised as to the consequences of that provision and at least the decision would have been an educated one. I often ask an individual who comes to see me with a signed agreement and was without benefit of an attorney, “Why did you sign this?” Their reply is usually, “I just wanted to get it over with.” Sometimes trying to save money by handling your case without the benefit of an attorney will result in a higher cost over the years. It is important to remember that the only issues which can potentially be changed or modified are child support, alimony and time sharing. Issues concerning the distribution of assets are not subject to change unless an individual can show fraud or duress. If an asset is waived because you wished to get the case over and subsequently you realize it was not in your best interests, likely nothing can be done to correct your mistake. If you have any doubts or concerns about the terms of an Agreement; don’t sign it and instead talk to a family law attorney. The law firm of Evan H. Baron and Associates is located at 1655 North Commerce Parkway, Suite 201, in Weston. If you have any questions concerning this issue or any other family law matter, call the office at 954-385-9160.

Pinched Nerves In The Foot (Neuromas)

N

erves are small string-like structures that provide sensation and/or give the signal to muscles to move. Some nerves may be susceptible to injury because of their location in the foot or ankle. The most commonly injured nerves are on the ball of the foot, located at the base of the second, third and fourth toes. These nerves provide sensation only to the middle three toes and may be compressed by a ligament that runs over it. Symptoms of a neuroma include pain in the ball of the foot. Often, numbness, burning, shooting or a tingling sensation in the toes is common. Some or all of these symptoms may be present. Some people feel cramping in the toes. The pain is often aggravated by running, aerobics or activities that put stress on the ball of the foot. Driving may aggravate the neuroma as well. Pain may be lessened by taking the shoe off and rubbing the foot. Causes include compression of the nerves against a tight ligament as well as arthritis or bone spurs from the adjacent joints. Soft tissue cysts can cause compression of the nerve. The nerve may become irritated from tight shoes, especially high heels, or sports that put increased stress on the ball of the foot, including tennis and running. The goal of treatment is to reduce the inflammation around the nerve and prevent further trauma to it. Antiinflammatories may be used to lessen inflammation; cortisone injections or oral anti-inflammatories may be beneficial. Changing to wider shoes without a heel or changing activities temporarily from weightbearing exercises to biking and swimming may also help. Physical therapy may be of benefit to reduce inflammation. Orthotics or metatarsal pads to correct faulty biomechanics can be used in small heels and all sports shoes. Doctors may administer a series of localized Alcohol injections (sclerosing injections) into the nerve to stop the nerve from functioning. Removing the nerve surgically may be necessary if conservative treatment fails. This is an outpatient procedure. A local or twilight anesthesia is used. The procedure takes approximately 15 minutes. One or two days off of work is needed. A surgical shoe is worn for four to five days and then a sneaker may be worn. Postoperative pain is minimal. The patient progresses to regular shoes over a two to four week period. Certain activities such as biking and swimming can be done in a week; sports may take three to eight weeks to resume. Prognosis is excellent. Carlo A. Messina, DPM, is a Board Certified Reconstructive Foot and Ankle Surgeon, Diplomate American Board of Foot and Ankle Surgery. f you are the parents of a child with special needs such as a mental or physical disability, you face the challenge of providing for them while you are alive, as well as seeing that they are taken care of after you are gone. The expenses of caring for a family member with special needs can be overwhelming, and ongoing medical care may not be covered by private insurance plans. State and local governments offer assistance, but it is subject to strict financial eligibility requirements. So what can a parent of a child with special needs do (or not do), to assure adequate care throughout their lifetime, yet not disqualify them from govern-

ment assistance? First, it is important that parents, grandparents, and others be discouraged from establishing custodial accounts for a minor child with special needs. Why? Because once the minor child reaches adulthood, distribution from the custodial account may disqualify them from government services. A well-meaning grandparent’s act of generosity can actually do more harm than good. The same disqualification applies if a child with special needs is left assets outright, or through a trust. What about leaving money to a trusted relative to be held on behalf of a beneficiary? While that sounds like a reasonable plan, the relative could lose the inheritance through their own divorce, bankruptcy, lawsuits or simply by mismanaging the assets. In addition, should the selected relative die, the inheritance becomes part of their own estate. Fortunately, the government has established rules allowing assets to be held for the benefit of an individual with special needs, without risking their eligibility for government assistance, in a trust, called a “special needs” or “supplemental needs” trust. How does this work? A special needs trust preserves government benefit eligibility while at the same time providing assets that can meet the additional needs of the person with a disability that goes beyond provisions for the basic needs and limited medical and long-term support and services of Medicaid or Supplemental Security Income (SSI). These life-enhancing expenditures can include: supplemental education and training; out-of-pocket medical and dental services; transportation (including purchase and maintenance of a vehicle); travel and vacations; hobbies and recreation; purchases such as computers, electronics, and furniture; personal care aide; athletic training and completion; and special dietary needs. Most importantly, a special needs trust must be designed specifically to supplement, not replace public benefits. Funds from a special needs trust cannot be distributed directly to the disabled beneficiary. Rather, funds must be disbursed to third parties who provide goods and services for the use and enjoyment by the beneficiary. Often, supplemental needs trusts are funded with life insurance proceeds, thereby providing resources exactly when they are needed. Special needs trusts are a critical component of your estate planning if you have a child or grandchild with disabilities. Estate planning is a deliberate, premeditated act of love. Life can change in an instant. What are you waiting for? Bruce Iden earned his J.D. from George Washington University National Law Center and his L.L.M. in taxation from the University of Miami School of Law. He has been practicing in the area of estate planning and probate and trust administration for over 30 years. Adopting an Attitude of Gratitude By Alina Gastesi-de Armas MA, MEd, LMHC

A

s Thanksgiving draws near, we are very much aware of the arrangements that must be made for the celebration. For most of us the machinery of Thanksgiving has already been set into motion, and in just a few days we will sit down to share our Thanksgiving meal. The essence of the holiday, however, is not in the preparation or the arrangements but the meaning of the day. It is a day to count our blessings, to give thanks to God and to be grateful for our plentiful lives. Wouldn’t it be wonderful if this feeling of appreciation lasted longer than a day or a meal? What holds many people back from experiencing this feeling of thankfulness throughout the year? Entitlement is the culprit. In direct conflict with thankfulness is a sense of entitlement. There are many things we feel entitled to: fair treatment, sensitivity for our plight, and undying respect. But entitlement is not a feeling; it is a chosen reaction to a feeling. It is a belief, a judgment, and often an inappropriate one at that. Anger, hurt, sadness, and grief are feelings and while we have every right to have and experience those very legitimate feelings, we do not have an inalienable right to express them any way we want, anywhere we want. We expect young children to be inflexible with their wants; the problem comes when it continues after preschool. “Everybody else is...” “They all have...” “If you really loved me...” are key expressions people use to impose their entitlement. Teenagers are notorious for expecting the best of everything, despite financial realities, their own efforts and/ or their behavior. Parents often fall prey to guilt and peer pressure by trying to meet every want so as to keep their children from feeling the discomfort of not “having-it-all”. This tactic fails to teach children responsibility and delayed gratification and thus, creates adults who have little to no frustration tolerance. The anecdote to entitlement is an attitude of gratitude. In fact, eliminating entitlement and embracing gratitude can improve physical health as well as promote personal growth; imagine the spirit of the Thanksgiving holiday throughout the year. Furthermore, an attitude of gratitude has been shown to improve one’s ability to cope with stress and encourage positive interaction with others. Practicing an attitude of gratitude creates a shift in our thinking, leaving us more open to peacefulness and contentment because we are focusing on the goodness in our life. Keys to adopting an attitude of gratitude: ▸▸ Make it a habit of expressing gratitude to your spouse for their support and acts of services. ▸▸ Express gratitude to coworkers for their efforts, to store clerks for their helpfulness and to your children’s teachers for their time and patience. ▸▸ Take time to acknowledge your blessings and give thanks to God for the gifts you have received in your life, relationships and successes. ▸▸ Keep a journal and write about things you are grateful for. John F. Kennedy once said, “As we express our gratitude, we must never forget that the highest appreciation is not to utter words, but to live by them.” Thanks for reading! Most Common Mistakes by Homeowners Attempting to Obtain a Loan Modification By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney

A

s a result of various nationwide class actions and lawsuits filed against mortgage companies by private individuals and government agencies, lenders have become more receptive and willing to assist homeowners in modifying their loans. However, lenders have also become more demanding of certain documentation to support loan modification requests. These are the most common mistakes homeowners make when processing a loan modification on their own. Provide too much information. Most Homeowners believe that the more information they provide to their lender about their finances, the more likely their loan modification will be approved. Just the opposite is true. Most lenders are looking for specific information regarding a homeowner’s income and expenses, specific reasons to support a financial hardship for a loan modification, and they require a specific order and timeframe to submit the required documents. Overwhelming your lender with the same unnecessary documents time and time again will only place your file farther back in line for consideration. The Arcia Law Firm has represented homeowners that have been trying to modify their home loan on their own for years, and within just a few months after retaining the Firm and submitting the appropriate documents, a loan modification is achieved. Last year, the Arcia Law Firm successfully modified over 130 loans, and so far we have modified more than 120 loans this year. Refuse to seek legal assistance. We have counseled hundreds of clients in mortgage related cases through the years, and the most significant mistake that homeowners make is to wait until the last minute to hire a knowledgeable and experienced attorney. Many homeowners think they can easily defend themselves in a foreclosure proceeding, process their own loan modification, and save their home. However, some of the legal defenses to a foreclosure are highly technical and require specialized knowledge. The attorneys representing banks and the judges overseeing these cases are interested in obtaining a final judgment of foreclosure, sale of the property at a public auction and closing the case. In more simple terms, this means you are out of your home before you can finish your loan modification. The key to preventing this end result is for every homeowner, either in foreclosure or at risk of foreclosure, to stop playing “Russian Roulette” with their family home and immediately hire a highly qualified law firm. Detailed explanations of different options available to homeowners are discussed in a consumer DVD developed by the Arcia Law Firm entitled “Fight For Your Home.” If you mention that you heard about the DVD through this magazine, you will receive a complimentary copy during your free consultation to discuss your case in detail. The attorneys at the Arcia Law Firm are privileged to successfully represent dozens of homeowners in our community. We have foreclosure defense, loan modification and bankruptcy departments. You can view videos and testimonials of our satisfied clients at our website under “Success Stories.” If you are struggling to make your monthly mortgage payments, if you are in the middle of a frustrating loan modification process, or if you just received foreclosure papers, contact the Arcia Law Firm today at 954-437-9066 to schedule a free personal consultation with Omar Arcia, or visit www.arcialawfirm. com to schedule your appointment online.

I

t is estimated that up to 40% of the world’s population suffers from varicose veins in various forms. In about 50% of the cases, cosmetic vein issues are often a sign of treatable underlying circulation issues. Many people do not know, however, that congestive heart failure and varicose veins are often mistaken for one another. While vein symptoms often manifest themselves cosmetically, they can be and are often part of a greater circulatory problem. The leg swelling that is often considered to be a problem with the heart or blood pressure is often just veins underneath the skin that have failed to work properly. Symptoms often associated with vein disease include leg pain, discoloration, heaviness, swelling, throbbing, itching, restless leg syndrome, cramping, burning and fatigue. Vein disease is a progressive disease, so symptoms will worsen if left untreated. Varicose veins may indicate a critical blockage in deeper veins, a condition called deep vein thrombosis, or DVT, that can be life threatening. A DVT is a blood clot, or thrombus, which typically forms in the calf veins of the leg, but can also develop in the deep veins of the thigh. In addition to the aching in the legs caused by this serious condition, there is also a psychological toll that stems from the appearance of these unsightly veins. Those that suffer from this condition are often too embarrassed and self-conscious to show their legs, which has a tremendous effect on their life-style and overall daily enjoyment of life. Through a relatively simple procedure, using the latest, cutting edge technology, in very little time, you can greatly reduce the symptoms and source of varicose veins. Enodvenous Laser Treatment (EVL) is a quick, minimally invasive laser treatment and does not require hospitalization or complicated surgery. EVL is an FDA-approved procedure in which a small optic fiber is inserted through a needle into the varicose vein, which heats and closes the vein. The entire procedure takes about one hour and causes minimal discomfort. Performed under ultrasound guidance, EVL uses laser energy to treat varicose veins by closing off the vein, preventing it from flowing in the wrong direction down the leg. Your body then naturally uses a multitude of other healthy veins to return blood to the heart. The latest Varicose Vein Treatment, called Foam Sclerotherapy, uses special equipment that helps isolate the affected veins and their origins. The veins are then injected with a mixture air and a solution that causes it to become a foam. This procedure is almost painless, results are immediate, and for most, the results are permanent. The bottom line is that varicose veins and spider veins are treatable. The first step toward treatment is to figure out which type of veins you have. You should see a physician trained in the circulatory system for a thorough consultation and an ultrasound to determine the most effective treatment for you. In addition to making your legs look cosmetically better, vein treatment can actually improve your circulation so that you have healthier legs as well. It’s easier than you think to get yourself back in shorts again for summer!

Why You Need a Professional Inspection When Purchasing a Home Real Estate

By Patrick Simm

S

o you’ve found the home of your dreams and it looks like it’s in pristine condition. Now you’re thinking of skipping the home inspection process in order to save money. More often than not, this turns out to be a costly decision that ends up costing more than the price of the home inspection itself. Believe it or not, home inspections are a significant part of the home buying process. Although everything your eyes can see in this home is in working condition, buyers need to be certain that everything that you don’t see is also in good operating order. For example, buyers need to know that the roof is watertight and the air conditioning and heating system is in good working order. A thorough home inspection safeguards you against this before you “inherit” these potential issues. If you choose not to have a home inspection, the problems eventually becomes yours after the sale. It’s to the advantage of the buyer to know what to expect from a typical home inspection. There is no uniform certification of licensing process for home inspectors in the state of Florida; therefore home inspections tend to differ from one company to the other. Home inspections commonly include a comprehensive report on the property’s heating and cooling system (the age, condition and expected life span of the unit or parts of the unit), plumbing and electrical systems, appliances, walls, windows and doors, ceiling, flooring, roofing and the foundation. Most inspection companies have affiliated licensed professionals, like roofers and pest control companies that provide an official analysis that is included in the cost of the inspection. Home inspections usually run between $300 to $500, which is usually dependent on the size of the property, its age, and the type of home. Inspections can cost more if additional services to the typical inspection are required. That might include a four point inspection on older homes that may be required by insurance companies that focuses on the following: heating and air conditioning, electrical wiring and panels, plumbing connections and fixtures, and the roof. It is important to note that a typical home inspection usually covers only relative or potentially serious issues. Some issues, such as mold or defective drywall, may need further examination from a licensed professional that could potentially cost an additionally one to five thousand dollars. So, what do you have to look for in a home inspection company? One of the first things to note is that the State of Florida does not have a certification or licensing process for home inspectors. As a general rule, the home inspector you choose should hold a license in home construction such as a general contractor license or have some knowledge in the construction industry. Additionally, look for home inspectors that are members of the American Society of Home Inspectors (ASHI), a nationally recognized organization that requires a certain level of expertise and competency from their members. I recommend that a buyer accompany the inspector during the examination, so that one can learn more about the maintenance and preservation of the house, ask questions, and get a real sense of the any immediate and potentials issues that could arise after the purchase. The result is a uniform, durable, high-quality, and attractive finish.
