Getting into the Holiday Spirit
T
ime is flying by and winter is at our door. While we generally do not get the snowflakes or the frosty winter temperatures, we do get the holiday season. The upcoming holidays may have different meanings for many of our readers due to their diverse cultural backgrounds and religious beliefs, but for all of us it should be a time to reflect on the year gone by. It is a time to think about all the big issues which have occurred throughout the year of 2015, as well as the little issues that happened. It’s a season to gage our own conduct. Have we made enough time to spend with our children and spouses? Have we reached out to our neighbors to lend a helping hand to those in need? Have we spent the time to be truly together with our parents, our family and our friends? This is the time to mend minor disagreements, to forgive and forget. This is also the time to remember those less fortunate, to teach our children to share our good fortunes with our loved ones, as well as those in need. There are families right here in our communities who need our assistance. Help make the season brighter for them by giving generously. And consider giving your children gifts they will cherish for a lifetime; the gift of love and the gift of giving. The holidays are the perfect time to teach your children to be thankful for what they have and to help others. For that is truly what the holidays are about. Enter the Master Chef Holiday Cookies Baking Challenge By Debby Teich
W
hen it’s cold outside, baking is a great way to warm up the kitchen and spread some holiday cheer. If you have a holiday cookie recipe that gets rave reviews from family and friends, it may be worth some money. The Master Chef Holiday Cookies Baking Challenge will be held on December 15, at 10am, at the Southwest Focal Point Community Center. There is no cost to enter. “This challenge gives home ‘chefs’ the chance to showcase their culinary skills and possibly win a cash prize,” said Helen Daniels, Recreation Division Supervisor. “Remember to be creative. Judges are not only looking for the best tasting dessert, they are also looking for the dessert that is beautiful to look at!” The Master Chef Baking Challenge got its start in 2005, when Daniels created the Chocolate Challenge as one of the evening activities at the Valentine’s Dance. In 2012, the event was expanded it into a Master Chef Baking Challenge, requiring other key ingredients. This year, there was a Chocolate Challenge in February, a Cupcake Challenge in June and a Mango Madness Challenge in August. In the upcoming challenge, contestants can bake and decorate up to three holiday cookies. They should be presented in a festive way on a holiday cookie tray. Judges are looking for the cookies that capture the “magic” of the holiday season. Only home baked entries will be accepted. Store bought entries are not allowed. Prizes will be awarded for the top three delightfully delicious and visually stunning desserts. All entries will be judged based on appearance, texture and overall

flavor. Cash prizes include 1st ($50), 2nd ($30), and 3rd ($20). Winners will also receive bragging rights as “Master Chef.” Once the judges have tried all of the entries, audience members will have an opportunity to sample them. Daniels says that this challenge is her favorite, since holiday cookies are a tradition in her family. “Each year, everyone tries to outdo each other with new cookie creations,” said Daniels. “My personal favorite was my mother’s Stained Glass Cookies that could be hung on our Christmas tree. They were sugar cookies with cutouts that were filled with different colored bits of hard candies. The candies melted into little ‘panes of glass’ that allowed the Christmas tree lights to shine through.” The deadline to register is December 14. Participants must be a member of the SW Focal Point Community Center, which is located at 301 NW 103rd Ave, in Pembroke Pines. It is free to join. Weston Miracle League Kicks Off Baseball Season in Pembroke Pines Community News

T
he Weston Miracle League kicked off its 9th baseball season in Pembroke Pines, giving South Florida children with disabilities the opportunity to play baseball. Once again, the stands have been packed with proud parents and volunteers shouting words of encouragement like “great hit,” “great catch” and “you can do it.” Players can join the league throughout the season, which runs through January 31. The Weston Miracle League serves any disabled child, between the ages of 5 and 18, who has a desire to play baseball. Since baseball diamonds were not exactly designed with wheelchairs and crutches in mind, the Miracle League removes the barriers that keep children with disabilities off the baseball field. There is no cost to participate and baseball experience is not needed. All practices and games take place Sundays, from 4 to 5pm, at Rose G. Price Park’s Miracle League Baseball Field in Pembroke Pines. The park has a field with a special rubberized surface that makes it accessible for individuals with wheelchairs or other assistive walking devices.
The atmosphere at the games is very low key and every player leaves a winner. Parents have an opportunity to take a break and relax, while their kids have fun on the field. Some of the players are focused on the game, and others simply want to play catch on the sideline. Each inning all of the players have an opportunity to bat, remain safe on the bases, and score a run. For many of the kids, it is the highlight of their week. To help the athletes, the Miracle League uses a “buddy” system – pairing each player with an able-bodied peer, age 13 or older. The volunteers attend a variety of middle and high schools throughout Broward County and earn service hours for their work. Daisy Jaime’s 11-year-old son Andres is a special needs child diagnosed with autism. While participating in the Weston Miracle League for the last five years, he has learned the rules of the game, as well as how to hit the ball and play catch. “It makes me feel happy and proud seeing him enjoy a great day participating with other children and interacting with them in a positive way,” said Jaime. “The volunteers and the entire organization make it possible for Andres to be happy and enjoy playing baseball as any child should. he City of Pembroke Pines Community Services Department recently hosted its first United States Military Veterans Employment Expo “Be A Hero, Hire A Veteran” at the SWFP Community Center. The event attracted over 200 Veterans from every branch of the service. Dressed for success, they attended workshops on resume writing and interviewing techniques to fine tune their resumes. They also met employers who were screening and recruiting applicants in keeping with the Employment Expo theme: “Be A Hero, Hire A Veteran.” “This was a great experience for everyone involved,” said Pembroke Pines Commissioner Jay Schwartz, who initiated the idea for the Expo dur-
ing a Pembroke Pines Commission meeting earlier in the year. “We had over 200 Veterans attend our Employment Expo and they received exactly what they were looking for. They learned information about new career opportunities and met potential employers.” The Veteran’s Employment Expo is part of the City of Pembroke Pines Re-Energize and Re-Connect Initiative, which has a goal of providing resources and housing at the R & R Village for Active and Honorably Discharged Members of the military. Some of the people welcoming the steady stream of Veterans included: Jay Shechter, Director of Community Services for the City of Pembroke
Pines; Silvia A. Aguilar, Community Services Administrator; Pembroke Pines Mayor Frank C. Ortis and Carl Shechter, World War II Army Veteran and Commissioner for the City of Pembroke Pines. “We are very pleased with the turnout and so are the exhibitors, who represented 35 employers, a dozen veteran service agencies, and two schools which link veterans to benefit information and career guidance,” said Shechter. “We are committed to helping members of the military transition back into civilian life.” Based on positive feedback from employers and US Military Veterans, plans are now in the works for a 2016 Veterans Employment Expo.

National League of Cities Awards City of Pembroke Pines Bronze Medal
T
he National League of Cities (NLC) recently recognized Pembroke Pines Mayor Frank C. Ortis for completing key health and wellness goals for Let’s Move! Cities, Towns and Counties (LMCTC). LMCTC is a major component of First Lady Michelle Obama’s comprehensive Let’s Move! initiative to ensure that kids can grow up healthy. LMCTC works closely with local elected officials nationwide to adopt policies that improve access to healthy affordable food and opportunities for physical activity for their constituents across five goal areas. “We congratulate the City of Pembroke Pines for your dedication to building a healthier community for children and families,” said NLC President Ralph Becker, Mayor of Salt Lake City, Utah. “Through the tireless leadership and action of local elected officials in cities, towns and counties across the country, we hope to see continued progress in reversing America’s epidemic of childhood obesity.” The Bronze Medal in Goal #1 was awarded to Pembroke Pines for action taken to improve access to healthy food and increased opportunities for physical activity for students in early care and education programs through active interagency collaboration. The directors and staff of the Early Development Centers educated the children and families about nutrition and exercise. “The schools worked with different agencies to model their program after the Transforming Our Community’s Health initiative, which is a collaborative effort among more than twenty community organizations and ten coalitions,” said Dr. Lisa Libidinsky, principal at the Pembroke Pines Charter Elementary School -FSU Campus. The schools focused on physical activities, nutritional options for lunch and snacks, and newsletters that provided tips for parents to implement at home. “The City of Pembroke Pines and its nationally recognized Charter School System take great pride in receiving this award,” said Mayor Ortis. “We plan to work our way up to the Gold Medal!” All LMCTC sites have the opportunity to earn up to five gold medals, one for each actionable goal to which they commit to as part of the initiative. Medals are awarded to local elected officials based on their achievements in each of the fol-

he City of Pembroke Pines invited dog owners and their four legged friends to participate in the 3rd Annual BowWow Ween, a Halloween event for dogs at the Pembroke Pines Dog Park. Dogs and their owners had a paw-sitively good time as they participated in costume contests and games, won prizes, and met with pet-friendly businesses. This year, children participated in a “future veterinarian clinic,” where they took care of their furry stuffed friends. “This bark-tacular event is growing in popularity,” said Francie Novo, City of Pembroke Pines Special Events Division. “Last year about 300 people attended and we had more than twice that this year.” The dogs enjoyed the Hydration Station provided by Whole Foods Market Pembroke Pines. Judy’s Bath and Boutique sent a mascot to pose with everyone, Pooches in the Pines gave out information on lost dogs from the Pembroke Pines area and the Fletcher Art and Cultural Center set up a doggy-themed craft station for children. Bariatric Surgery – An Effective Way to Lose Weight A third option, adjustable gastric banding, is not widely used today because it does not have the same long-term effectiveness of the other two procedures, but some patients still prefer it. For people who need to lose weight but have been unsuccessful with diet and exercise, there are procedures known as bariatric surgery that can help. Types of bariatric surgery There are three main types of bariatric surgery. All are done laparoscopically (minimally invasive) and only require the patient to be in the hospital for one day. Most patients do very well with these procedures and can return to work in about 2 weeks. The procedure with the longest track record is gastric bypass, in which a small pouch is created, restricting food intake, and bypassing a segment of the small intestine. This limits the amount of food intake and its absorption. Another option is to have a gastric sleeve, in which only the size of the stomach is limited. This option requires patients to follow dietary changes more closely.
Very recently another option has been approved for people with less severe cases of obesity: the intragastric balloon. This is a non-surgical procedure, in which a balloon is inserted into the stomach via an endoscopy, under light anesthesia. The balloon is removed in a similar way after six months, and nutritional counseling continues for one year. To be a candidate Ideal candidates for bariatric surgery have a Body Mass Index (BMI) of 35 or higher, as well as a weight-related condition, such as diabetes, sleep apnea, high blood pressure or heart disease. Patients who have a BMI of 40 or higher can have the surgery even if they do not have any coexisting conditions. Additionally, for consideration of the intra-gastric balloon, candidates would have a BMI of 30-35. Getting started At Cleveland Clinic Florida, patients who inquire about bariatric surgery are asked to attend one of our free seminars – usually offered twice a week – so they can learn about the procedures and start to discuss insurance issues. After that, they come back for an individual appointment at which a complete physical is done, as well as consultation
to discuss which procedure is best for them. Patients also attend a physician-directed nutrition class. The next step is to await clearance from their insurance company, which may have additional requirements, such as losing weight on a supervised diet prior. This can take 3 to 12 months. A final step is for patients to receive approval to proceed from their primary care physician and any specialists they may be seeing, such as cardiologist or a diabetes specialist. Success Overall, our patients lose about 70 percent of their excess weight in the first 18 months following surgery. The intra-gastric balloon leads to a 2530% of excess weight loss. Many see dramatic improvements in their other health problems as well. Patients who continue to follow the nutritional plan and come for annual follow up appointments as recommended usually keep the weight off for life.

he SilverLakes community, which has 5,140 homes, offers a variety of events for residents throughout the year, and it relies on volunteers to help make all of them a success. A group of five seniors from West Broward High School, who have been volunteering on a regular basis for the past four years, recently received special recognition from the Board of Directors for their efforts. “Broward County Public Schools requires 40 hours of community service to graduate, and these five seniors have volunteered above and beyond that amount,” said Cathy Balenovic, SilverLakes Community Affairs Director. “They volunteered because they wanted to, not because they had to.“ Throughout the years, they have offloaded pumpkins for the Pumpkin Patch, hidden eggs for the Easter Egg Hunt, helped set up equipment for outdoor movie nights, manned the popcorn and snow cone machines, helped children with art activities, and much more. Elementary Students Learn the Importance of Placing Smoke Alarms in Bedrooms SECTION News School HEAD

lementary school students throughout Pembroke Pines recently learned about the importance of having working smoke alarms in bedrooms. They competed in the Pembroke Pines Fire Department’s 19th Annual Fire Prevention Week Poster Contest, which promoted Fire Prevention Week’s theme “Hear the Beep Where You Sleep.” The winning posters were displayed at Pembroke Pines City Hall during Fire Prevention Week. “Learning about fire safety saves lives,” said Fire Chief John Picarello. “For children, it provides benefits that will last a lifetime.” According to National Fire Protection Association, half of all U.S. home fire deaths occur at night between the hours of 11pm and 7am, when people are most likely to be sleeping. Having a working smoke alarm in the home cuts the risk of dying in a
fire in half. “The location of a working smoke alarms in a home can mean the difference between life and death,” said Fire Marshal Sandra Lluis. “A working smoke alarm can alert occupants they need to get out of the home before a fire spreads, thus increasing their chances of survival.” During Fire Prevention Week, members of the fire department held fire safety presentations, gave fire station tours and distributed thousands of brochures, firefighter helmets, coloring books, and stickers. Students from 13 schools submitted 530 posters for the contest. According to the rules, the poster had to contain the Fire Prevention Week theme. Each child had to make their own poster, which was judged on originality. Trophies were awarded for 1st, 2nd, and 3rd place.

PPCES – FSU Campus Dedicates Peace Rock Garden By Debby Teich
D
uring Peace Week, first grade students at Pembroke Pines Charter Elementary School – FSU Campus read “Only One You” by Linda Kranz, a story that encourages readers to look at life in a new way and to find ways to make the world a better place. The book inspired them to create a Peace Rock Garden at the school. The book is about a little fish whose parents decide it is time to share different messages of wisdom with him. After reading the book, the first graders painted rock fish. The small project quickly took on a larger life when students from all grades, as well as many teachers, staff members and PTA officers, decided to join in and create their own painted rocks. Many contained messages, such as “help someone when they get hurt,” “love each other,” and “stop fights.” The rocks were incorporated into a Peace Rock

Garden located near the cafeteria. “All students pass by this area as they are going to the cafeteria for lunch each day,” said Dr. Lisa Libidinsky, Principal of the Pembroke Pines Charter School FSU Campus. “The garden gives them a visual way to remember the story and the advice.” The project also tied in with this year’s theme for Red Ribbon Week Peace, Love & Me. I’m Drug Free! During an assembly, SRO James Hyde recited the “I Have the Power to Stay Drug Free Pledge” and student council officers read advice from “Only One Me.” They advised students to always be on the lookout for a new friend, to find their own way, and to make the world a better place. After students sang a peace song, Dr. Libidinsky and Assistant Principal Alan Pfau cut the ribbon for the new garden.

he City of Pembroke Pines Police Department recently honored 21 students at Pembroke Pines Police Department Headquarters during its November “Student of the Month” ceremony. The students were nominated by their respective teachers based on criteria set forth by the Pembroke Pines Police Department. This included: exemplary behavior, good citizenship and being a good role model to others. Following a welcome by Sergeant James Henry, the Pledge of Allegiance and remarks by the Command Staff, Mayor Frank C. Ortis and Commissioner Schwartz, the students were commended for the special actions and behaviors that led to their nominations. Each of the honorees was presented a certificate, posed for a photo and received a goodie bag. They also walked the “Honor Walk,” shaking hands with Twenty-one elementary school students from throughout the City of Pembroke Pines pose with their certificates, along Crime Dog McGruff, members of the Pembroke Pines with members of the Police Department Command staff and City officials. Veterans Honored at Chapel Trail Elementary By Debby Teich
S
tudents at Chapel Trail Elementary in Pembroke Pines recently honored their parents, grandparents, aunts, uncles and friends who fought for their freedom. Fiftysix Veterans, who have relatives at the school, enjoyed a celebration breakfast in observance of Veterans Day. This year’s theme was “Heroes Within.” “This year’s theme came about when our principal was talking to a veteran and he mentioned that his hero is his family, who gives up a lot to allow him to do his job,” said Liz Grafe, media specialist. “We realized that we all have ways of being heroes within ourselves.” After each branch of service was announced, the veterans paraded around the bus loop with their families. Next, they proceeded to the assembly, where the scouts led everyone in the Pledge of Allegiance and the school chorus sang the National Anthem. Principal Teresa Lipkins, Director of Office of School Performance and Accountability Mark Strauss, Assistant Principal Richard Schreidell and City of Pembroke Pines Commissioner Jay Schwartz welcomed the veterans. Schreidell explained the meaning of the Missing Man Table (also known as the Fallen Comrade Table) that was set up in memory of fallen, missing, or imprisoned military service members. All of the grades participated. Kindergartners made hats and flags. First grade students recited “A Hero Is...” in English and Spanish. Second grade students made “thank you” cards and third graders recited the Preamble to the U.S. Constitution. Two fourth grade students recited poems they wrote - America’s

Warriors by Kiley Irizarry and Heroes Unite by Brandon Rios. Two fifth grade students also recited poems they wrote - The Soldier in My Family by Alyssa Cirillo and The Rising Heroes by Mohamad El Hayek. The chorus sang “United We Stand,” an original song by Music Director Leonard Hodge and all of the students closed the assembly with “You’re a Grand Old Flag.” One of the many highlights also included a Coast Guard helicopter, which flew around the school. After the ceremony, the veterans had an opportunity to visit with the students.

t has been another wonderful year for all of us in Pembroke Pines, and I want to send season’s greetings to all Pembroke Pines residents and businesses that make this a very special city in which to live and work. One of this year’s highlights has been to see the walls of the Pembroke Pines multi-use Civic Center going up. The four-story flexible-use Civic Center will be home to plays, conferences, small concerts and a variety of special events for all residents and visitors to enjoy. It’s been a long time coming, but we are now seeing it being built before our eyes and look forward to its completion. As we look back on this past year, we are so proud to have been acknowledged in so many ways for the programs, activities and work our city provides. Pembroke Pines has received the National League of Cities Award- Bronze Medal in Goal III - Smart Serving for Students and Goal I: Start Early, Start Smart for the “Let’s Move! Cities, Towns and Counties” initiative, and a Certificate of Appreciation from the Wyland Foundation “2015 Wyland National Mayor’s Challenge for Water Conservation.” We were also recognized by the Florida Department of Health in Broward County as the “2015 State Surgeon General Healthy Weight Community Champion,” and we were awarded a $500,000 grant from the Florida Cultural Affairs Division for construction on the Civic Center Cultural Complex and a $462,350 Broward County Tourist Development Tax Capital Challenge Grant for the Civic Center. Kudos to all who have helped us achieve these awards and grants.

he future of plastic surgery lies in stem cell science and optimization of fat grafting for soft tissue augmentation. For years, patients focused on eliminating fat. Today, fat (or adipose) cells are utilized for restoration of soft tissue volume loss that occurs with aging. Recent advancements in stem cell isolation have led to the application of stem cell enriched fat grafts. A fat transfer involves harvesting a patient’s own fat cells through a lipo-aspiration procedure, then separating the fat cells from the accompanying serum into a pure fat cell graft for transfer to the face, body, or breasts to restore soft tissue volume. Research has shown that when fat cells are enriched with stem cells to form culture expanded adipose desired stem cells there is a higher quantity and quality of newly formed adipose and connective tissue. With this technique, the amount of fat which survives after a lipofilling procedure improves to 80 – 90% with more predictable and long lasting results. Fat cells survive in the range of 50 – 75% with present techniques requiring over correction of the soft tissue defect to ensure proper enhancement. The term “stem cell” when used in advertisements for facelifts and hair transplants is not applicable, because stem cells haven’t been isolated clinically for these procedures. Using the term “stem cell facelifts” is an attempt by the advertiser to mislead patients into thinking they are receiving a new cutting edge procedure. Scientifically, fat cells do contain immature stem cells, as well as platelet rich plasma, which have a higher portion of stem cells than plasma alone. When fat is injected into the face, theoretically a small concentration of stem cells may be present in the newly grafted fat. For buttock enhancement, autologous fat transfer procedure has become the procedure of choice to improve size, shape, and lifting of the buttocks. In recent years, fat grafts have been used in breast reconstruction procedures, both for post-mastectomy reconstruction and post breast augmentation contour irregularities. Autologous fat grafting procedures are being utilized for primary breast augmentation more often for women who desire a small increase in breast size and fullness. The technique is still being studied to determine its long-term effects, including issues with mammography and subsequent breast cancer detection. The techniques for maximizing results in fat transfer have evolved over the past several years. With ongoing research and clinical application, fat will be used universally for soft tissue augmentation and become the gold standard for such procedures. Holiday Cheer? By Evan Baron
M
ost people think of the holiday season with gleeful anticipation of time with family. For couples who have been through a divorce, the holiday season can often be a very stressful time. This stress can also be felt by the children of a divorced couple. It is not uncommon for holiday visitation issues to surface during this time of year. Hopefully the parties’ settlement agreement or Parenting Plan is specific as to time sharing. Over the course of approximately 30 years of practice, my clients have experienced many issues concerning holiday visitation. The biggest obstacle to solving an issue in court during this time of year is the reality that court time is very difficult to schedule during December and, as such, last minute issues usually will not be addressed. Of course the parties are always able to try and work things out on their own or with the help of attorneys and mediators. I would certainly suggest not waiting until the “last minute” to address any concerns. The best way to ensure there will be no conflicts during the holidays is to anticipate potential problems ahead of time and address them in the marital settlement agreement and/or Parenting Plan. The more specific your agreement is, the more likely you will not experience conflicts along the way. For couples with minor children, Parenting Plans have been mandatory. These Parenting Plans are designed to be very specific as to time sharing in an effort to head off any trouble in years to come. Unfortunately, these Parenting Plans were not used prior to the latter part of 2008. Therefore, many existing agreements do not include this provision. I believe the most important thing to remember is that any time sharing arrangement should always keep the best interest of the children as a priority. Children want to spend time with both parents and this is especially true during the holidays. They also want to be a part of any family gatherings. Sometimes that is not always possible, but advanced planning may be able to achieve this goal. Often parents divide the entire winter break in half, with Christmas day being the “exchange day.” As an example, in odd numbered years such as 2015 perhaps Dad has the children from the day school ends until noon Christmas Day. Mom will pick up the kids and keep them until school begins again. Next year, they can reverse the schedule. In some cultures, Christmas Eve is more of a celebration, so perhaps one parent can celebrate every Christmas Eve and the other Christmas Day. Also remember that “gift giving” is not a competition, with the winner being the parent who spends the most money. Often times the finances of each parent may not be the same and one must buy gifts within his/her budget. For a parent to embarrass the other by purchasing a more expensive and lavish gift is only going to lead to hard feelings and potential problems. Hopefully, the parents can discuss this issue beforehand and plan together. Often parents wish to visit family out of town. Consider the feelings of your former spouse and the children in the planning such a trip. Children have the need to be with extended family during the Holidays. Perhaps holiday trips out of town can be rotated from year to year between parents. Mom and Dad can certainly make the holiday season a joyous time for their children or they can focus on themselves and make it a time that everyone would like to forget. F
oot and ankle injuries are very common in sports or in general activities of daily living. Many structures including bone, ligament, cartilage and joint lining may be injured. Injuries may occur from a single traumatic event or from overuse. Injuries may occur during the teenage years that may manifest themselves later on. These injuries may cause stiffness and pain in the foot or the ankle joints, especially after getting out of bed first thing in the morning to walk. This stiffness and pain will be present for a proportional period of time usually to the degree of joint injury. With weightbearing, the joint usually loosens and the person is able to ambulate. This stiffness and pain will redevelop if the person sits for a period of time and tries to get up and walk. As the day goes on, the foot or ankle may ache, especially with excessive activity. Swelling may be present over the area that is injured. Instability may develop if the ligaments have been injured causing the foot or ankle to constantly twist. When these injuries are unresponsive to conservative treatment which may include orthotics, medication or rehabilitation, arthroscopic surgery may be necessary to remove the damaged tissue in the foot and ankle. A miniature camera is placed into the injured joint allowing an image to be seen on a television screen. The joint is visualized and small instruments are introduced into the joint to clean out and repair the damage. Fragments of bone and cartilage are often removed. Suctioning of debris and smoothing rough surfaces will often allow a joint to resume its normal gliding motion. Arthroscopic surgery is used to treat the following conditions: chronic joint pain and swelling; arthritis and bone spurs; loose bone and cartilage fragments; stiff, scarred joints; and ankle fractures that have not completely recovered. The cartilage in the ankle joint may have been damaged during the injury causing chronic stiffness and pain that may be mild but never goes away completely. Patients often think that this is a very livable condition. However, once treated arthroscopically, a full return to activity may be possible. Carlo A. Yes, very definitely. Let’s look at a common estate planning document, a durable power of attorney. Several years ago financial institutions lobbied the Florida legislature to change the applicable law to protect banks and brokerage firms from liability if a durable power of attorney is misused or forged. The new law suggests certain “magic” language which, if included in the durable power of attorney, provides this protection. If your document was drafted before 2011, it most likely does not contain this magic language. While some financial institutions may still accept your durable power of attorney, it is much more likely that they will not. Another change to the law, which took effect on October 1, 2015, affects your health care power of attorney. The Florida legislature has revised the law to clarify confusion surrounding when a health care power of attorney becomes effective. Your health care power of attorney can be effective immediately, but only if you so designate. If not, your treating physician must first determine that you are unable to manage your own care before they will take instruction from your designated agent. The new law also offers new choices in terms of designating a health care surrogate for a minor child. Because of this change in the law, there is new language that should be part of your health care power of attorney. How do I know if laws have changed that may affect my estate planning documents? The best way to is to contact your estate planning attorney and schedule a periodic review of your plan. Many attorneys provide maintenance programs and will affirmatively contact their clients if relevant laws change. While there is a fee to belong to a maintenance plan, there are usually no charges for required document updates. We highly recommend that you review your documents regularly, and update when necessary. Why risk potential problems or delays with your document when you may urgently need it. Helpful Tips for Landlords and Tenants in Florida By Vanessa J. Bravo and Omar J. Arcia
A
t the Arcia Law Firm, we are familiar with both residential and commercial landlord tenant law, and with the different strategies involved in filing an eviction action as a landlord, and defending one as a tenant. There are important considerations in each. On the landlord side, the proper time to file an eviction action is critical, whether it be due to a failure to pay rent, or due to a tenant staying after the expiration of the lease. One situation requires a particular kind of 3-day notice and the other does not. In fact, serving a 3-day notice on a holdover tenant can be construed as a renewal to the lease, an invitation to stay, and an extension of the lease. Many people also do not know that holdover tenants are liable for double the amount of monthly rent, due at the end and not the beginning of each holdover month. A proper notice advising of such holdover tenancy prior to the expiration of the lease is a valuable tool to ensure that tenants vacate on time, or pay the costly price for staying without permission. Tenants also need to know under what conditions the landlord is entitled to keep their security deposit, and in which situations a tenant may legally withhold payment of rent. Each scenario is described in Florida’s Residential Landlord Tenant statute. It is the landlord’s duty to maintain the premises, but it varies depending on whether the residence is a single-family home, a duplex, or a dwelling unit.
For example, renters of single-family homes and duplexes need to maintain much more than the dwelling unit tenants, including their own heat, pest control, and garbage removal. However, the lease itself may provide for a wider range of landlord’s duties. Finally, it is very important to note that any tenancy lasting any time over one year must be in writing. Rights and duties pertain to all tenancies, whether they exist under a written or verbal rental agreement. A tenancy pursuant to a verbal agreement has to be ended in a particular way, depending on whether it is a week-to-week or month-to-month tenancy. Whether you’re a landlord or a tenant, we can guide you through an eviction lawsuit and can also determine if the lawsuit is more properly an ejectment action, which is filed when the occupant of the premises is occupying the property not pursuant to a lease but because of some other ground that gives the occupant the belief that they have the right to occupy the premises. Orthotics: Are They All the Same? section Ask the Expert head

O
rthotics: are they all the same? Are they all created equal? No, they are not. Orthotics, sometimes referred to as “orthoses” or even “arch supports,” is a device inserted into a shoe. It can range from a felt pad to a custommade shoe insert. It can correct an abnormal or irregular walking pattern. Orthotics allow people to stand, walk, and run better and with more comfort. While over the counter orthotics, typically seen in drug stores, are available and may help ease mild symptoms, they typically do not correct the wide range of symptoms that prescription foot orthoses can. Prescription orthoses are custom made to fit a person’s unique foot structure. Orthotics come in many shapes, sizes, and materials and fall into three general categories: those that change foot function, those that are mainly protective in design, and those that combine functional control and protection.
Rigid orthotics fall into the first category. They are designed to control function and are used normally for walking and dress shoes. They are often made of firm material like plastic or carbon fiber. They are made from a mold after a podiatric physician takes a plaster cast (or other image) of the foot. Rigid orthotics control motion in two major foot joints that lie below the ankle joint. They can improve or eliminate strains, aches, and pains in the legs, thighs, and lower back. Soft orthotics are mostly used to absorb shock, increase balance, and take pressure off sore spots of the foot. They are effective for diabetic, arthritic, and deformed feet. Soft orthotics are usually made of cushioned materials, so they can be worn against the sole of the foot. They extend from the heel past the ball of the foot, and include the toes. Soft orthotics, like rigid ones, are made from a mold after the podiatric physician takes a plaster cast. Lastly, there are the semi-rigid orthotics. They provide foot balance for walking or engaging in sports. They are typically made from soft material and reinforced with more rigid material. Sometimes they are prescribed for children with flat feet and in toeing or out toeing disorders. They are additionally used to help athletes mitigate pain while they compete. D
o you know someone with epilepsy – the neurological disorder that causes sudden, recurring seizures due to abnormal electrical activity in the brain? Chances are you might, because it’s the fourth-most-common neurological disorder today. With approximately 2.3 million adults and 500,000 children in the United States coping with epilepsy, it’s important to make access to leadingedge neurological and epileptic care easier than ever.
