Happy Holidays from Our Family to Yours

T

he South Florida community is a melting pot of diverse cultures, religions and backgrounds. This makes it the ideal place to learn about the many different holiday traditions our neighbors celebrate. At Our City Media, we feel blessed to work and live with such great and interesting people. The way our unique backgrounds have woven into a common community makes all our lives better. Just think of what we have available. On the same day, you can eat breakfast at a Bohemian bistro in Hollywood Beach, celebrate “Noche Buena” with Cuban co-workers and end the day by lighting candles on the menorah with friends. I can’t think of many other places where you could do that! I encourage you to get out and try something new, learn about someone else’s culture and don’t be afraid to share your own. So, Feliz Navidad! Happy Hanukkah! As-Salaam-Alaikum! Habari Gani! And, Merry Christmas! Best wishes and happy holidays from everyone at Our City Media.

Weston Miracle League Kicks Off Baseball Season in Pembroke Pines COMMUNITY NEWS

BY DEBBY TEICH

T

he Weston Miracle League kicked off its 10th baseball season in Pembroke Pines, giving South Florida children with disabilities the opportunity to play baseball. Once again, the stands have been packed with proud parents and volunteers shouting words of encouragement like “great hit,” “great catch” and “you can do it.” Players can join the league throughout the season, which runs through January 29. The Weston Miracle League serves any disabled child, between the ages of 5 and 18, who has a desire to play baseball. Since baseball diamonds were not exactly designed with wheelchairs and walkers in mind, the Miracle League removes the barriers that keep children with disabilities off the baseball field. There is no cost to participate and previous baseball experience is not needed. All practices and games take place Sundays, from 4pm to 5pm, at Rose G. Price Park’s Miracle League Baseball Field in Pembroke Pines. The park has a field with a special rubberized surface that makes it accessible for individuals with wheelchairs or other assistive walking devices. The atmosphere at the games is very low key and every player leaves a winner. Parents have an opportunity to take a break and relax, while their kids have fun on the field. Some of the players are focused on the game, and others simply want to play catch on the sideline. Each inning all of the players have an opportunity to bat, remain safe on the bases, and score a run. For many of the kids, it is the

highlight of their week. To help the athletes, the Miracle League uses a “buddy” system – pairing each player with an able-bodied peer, age 13 or older. The volunteers attend a variety of middle schools, high schools and colleges throughout Broward County and earn service hours for their participation. Barbara Kopec’s daughter Jackie has been involved with the Miracle League for several years. “This is Jackie’s favorite group because there is no pressure and she can be herself,” said Kopec. “It is very well organized and all of the volunteers are amazing with the kids. Jackie’s favorite part of baseball is having a buddy alongside her.” Daisy Jaime’s 12-year-old son, Andres, has been in the league for the last six years. He has learned the rules of the game, as well as how to hit the ball and play catch. “It makes me feel happy and proud seeing him enjoy a great day participating with other children and interacting with them in a positive way,” said Jaime. “The volunteers and the entire organization make it possible for Andres to be happy and enjoy playing baseball as any child should.” Rose G. Price Park is located at 901 NW 208th Avenue. For information on the Weston Miracle League, or to register online, visit www.westonmiracleleague.com or call 954-478-9694.

Dressed in costume, members of the Florida Citrus Model Train Society help bring the layouts to life

onstructing a model railroad layout involves sculpting, building, painting, laying track and even some electronic engineering. Through January 7, area residents can see a variety of model trains at the Southwest Regional Library during an exhibition hosted by the Florida Citrus Model Train Society. The event is free and open to the public. The model train exhibit will feature multiple layouts, including “HO”, “O”, “N”, and “G” scales. There will be trains and scenes from the early 1900’s to modern times. Many of the exhibits will be decorated for the fall and Christmas holiday seasons. Several members of the Florida Citrus Model Train Society will be dressed in costumes that fit within the “G” Scale exhibit, such as a locomotive engineer, conductor, postmaster, telegraph operator, fisherman, sheriff, psychologist, and more. Each vignette has its own story. Children are invited to participate in a scavenger hunt, as they

12

search for things within the two-level “G” scale layout, which is 26ft. X 12ft. For example, they might be looking for a goat eating hay, a cat licking milk, a band playing on the front porch of the “Whistle Stop Diner” or the black cat on the stairs of the “Bates Hotel.” There is also a large “HO” scale model train display on the stage that guests can operate with the supervision of a FCMTS member. “It is a great way for people who are interested in the hobby to find out more about it,” said Ken Sargeant, president of the club. “They can also learn about train safety and much more.” The Florida Citrus Model Train Society displays model train layouts throughout the community, in addition to conducting educational programs for students. Member Ken Sargeant teaches train safety through Operation LifeSaver and makes presentations at various schools, clubs and organizations. Society members meet every Monday and Friday,

at 8am, for breakfast at the Blue Moon Diner in Cooper City “We have members of all ages who share a passion for toy trains, fun activities, lively debate and new friendships,” said Sargeant. “Our goal is to share the traditions and fun of model trains and to provide a reasonable venue for children of all ages to experience the history, traditions and joys of toy trains. We want to develop interest in our hobby and make it available to the general public.” The event is free and open to the public on Monday, Tuesday, Wednesday, Thursday & Saturday, from 12noon to 4pm. It is closed on Fridays & Sundays. Southwest Regional Library is located at 16835 Sheridan Street. For more information about the Florida Citrus Model Train Society, visit www.fcmts.org.

PPCES-East Campus Reaches Out to Children with Cancer BY DEBBY TEICH

W

hen the Pembroke Pines Charter Elementary School - East Campus student council wanted to do something special for children with cancer during Children’s Cancer Awareness month, and for the patients at the Joe DiMaggio’s Pediatric Cancer Center, they decided to organize a dress down and baseball hat day with a BOGO twist – buy one, give one. It was a classic example of children helping children. “Our students wanted to do something special for children suffering from cancer and they turned to the Golden Rule for inspiration,” said Alina Perry-Smith, East Campus Curriculum Specialist. The hats came in many colors, including blue, pink, red, and green, as well as the colors associated with childhood cancer - orange and yellow. Students who donated five dollars received two baseball caps, one to decorate for a sick child and one to take home. Students

18

who purchased the hat wrote a special note to be given with their hat. “The students showed such empathy in their messages in hopes the child who received their note would feel better,” said Perry-Smith. The students far exceeded the goal they set. “We had hoped to donate a minimum of 100 baseball caps for the young patients,” said Perry-Smith. “In the end, our student council sold enough to donate 200 caps.” Throughout the school year the East Campus engages its kindergarten through fifth grade students in opportunities to learn about their community, practice intentional acts of kindness, promote good citizenship, and meet business/community leaders. They recently held a dress down day for Breast Cancer Awareness to benefit the American Cancer Society. “We are always looking to expand the horizons of our students, which is why we hold Career and Community Read-in Days and host student clubs, such as Relay for Life, Beach Patrol and K-Kids,” said Perry-Smith. “The sole purpose is to bring the world to life for our students.” Joe DiMaggio Children’s Hospital is the only freestanding children’s hospital in Broward County to offer a dedicated pediatric hematology/

West Broward High School Presents the 8th Annual Hispanic Festival

SCHOOL NEWS

BY DEBBY TEICH

O

n December 9, from 4pm to 8pm, the community will gather for the 8th Annual Hispanic Festival at West Broward High School. Sponsored by the WBHS Spanish Honor Society, the festival will include music, arts and crafts, Spanish food, vendors and more. Students and families will also have an opportunity to gather information about college. The only cost to enter is a non-perishable food item. Proceeds will benefit Children’s Harbor in Pembroke Pines. “Our goal is to raise funds to benefit Children’s Harbor, which works to create a safe and healthy environment for children in the foster system,” said Eileen Torraca, founder and sponsor of WBHS’s National Spanish Honor Society. “Through the preparation of this activity, my students learn a great deal about the needs that exist in our community and the power of having people come together for a noble cause.” Guests can indulge in a variety of Latin cuisine, including: arroz con gangules; alcapurrias; bacalaitos fritos; flan de coco, de vainilla, de queso; arroz imperial; tres leches and much more. Some of the music will include: Luis el Jibarito and Ara Oko (authentic Spanish music), Voces De America (Mariachi), Zanco

dancer from Levine Entertainment, DJ Rohan Slacks, Valentina Girardo (belly dancer), Ramirez (Colombian music) and Latinos in Action Dance group. There will

2015 Festival

be booths representing many of the Spanish speaking countries. Spanish class projects will be on display. Students will also have an opportunity to ask questions about college and careers. There will be several representatives from area colleges, as well as a panel of professionals, including 1st Sargent Torres, JROTC leader and Veteran; Blanca Guerra, World Languages Curriculum Specialist; Joseph Guerra, retired bank CEO; Naseema Otram, nurse, and many others. Several alumni will also be there

to answer questions, including: Kayla Ziadie, studying Journalism at University of Florida; Carlos Arroyo, studying Information Systems at FIU and Alex Guzman, studying Biomedical Engineering at Broward College. Proceeds from the event have benefited Children’s Harbor for the past seven years. Last year, the club presented Children’s Harbor with a check for nearly $1,000. In the spring, club members always spend some time with the residents of Children’s Harbor. Last year they went bowling together and the club paid for everything. “Bowling was such a memorable day for both the society members and the children,” said senior Samirah Khan. “After seeing the smiles on their faces, every minute of hard work became worth it. They are the reason why we put such a great amount of time and effort to making the Festival the best it can be.” It is not too late for companies or organizations to sponsor the event and showcase their goods and services. “This is a fantastic opportunity to market their product to the community in our area,” said Torraca. To sponsor the event, visit www.westbrowardhigh.org and locate the event flyer.

PPCHS Spanish Honor Society Collects Teddy Bears BY DEBBY TEICH

P

sychological studies have proven that stuffed animals have a significant calming effect on children in stressful or traumatic situations. Thanks to the efforts of the Spanish Honor Society of Pembroke Pines Charter High School, police officers in Pembroke Pines are now putting this theory to the test. They now have stuffed animals to keep in their patrol cars to help them comfort a child. The Spanish Honor Society encourages all of its members to give back to the community. The club recently held a schoolwide stuffed animal drive for the Pembroke Pines Police Department. After getting approval from school administrators, club members collected 82 boxes to place in each classroom and wrapped them to look like presents. To promote the drive, they hung flyers, visited classes and spoke on the morning announcements. After three weeks, they

20

collected 927 stuffed animals. “Giving back to the community is absolutely necessary for these students to see how important they are, and how the smallest contribution can impact another person’s life,” said Sharon Ferrer, Spanish III teacher. “The students were enthusiastic about giving back to their community and making a difference.” Ana Colicchio, club president, recalls the day the delivered the stuffed animals. “The jaws of every single officer and the photographer dropped as we kept unloading bags and bags of these stuffed animals,” said Ana. “They talked about how they never expected such a huge turnout and how they were only expecting one bag. The sheriff told us how important our donation was. They begged us to do it again next year.” Club member Sophie Fabien says she heard first-hand about the positive impact the stuffed animals can have. “One student from our high school told us that when she was a child, she was in a car accident, and the officer at the scene comforted her with a stuffed animal,” said Sophie. “It

almost instantly made her feel better. It’s all about the small things we do in our community that unite us as one.” Club members plan to continue to give back to the community and world throughout the year. They are currently selling handmade, woven bracelets for $6, which are made by poor Nicaraguan artists for the non-profit organization, “The Pulsera Project.” They send all of the profits back to the organization, which uses the money to educate the artists. Each bracelet is tagged with the artist’s photo and signature. Some upcoming events include the “Jag Cup Soccer Tournament” in January and Bubble Run in March. The club also offers tutoring for students who need help in Spanish courses.

Broward County High School Seniors Vote in First Presidential Election

SECTION NEWS SCHOOL HEAD

BY DEBBY TEICH

I

n government class, students are learning that each vote matters. One hundred seniors from three Broward County high schools met at Pembroke Pines Charter High School last month to make sure their votes counted. They voted in their first presidential election during early voting at the Broward County Southwest Regional Library. “Our students are making and ultimately will live with the history of their vote,” said William Quigley, PPCHS Government and Economics and Law teacher who organized the event. In keeping with a four-year tradition, the PPCHS seniors were greeted by Pembroke Pines city officials; Pembroke Pines Mayor Frank C. Ortis; Commissioners Iris Siple, Angelo Castillo and Jay Schwartz; City Manager Charles Dodge; and Principal Peter Bayer. The group was joined by School Board Member Patti Good and Representative Richard Stark for a commemorative photo on the steps of Susan B. Katz Theater of Performing Arts at the River of Grass ArtsPark. Following the photo, the seniors and officials walked across campus to vote with their peers from Flanagan and West Broward High Schools. Quigley says he teaches his students about the importance of due diligence; being educated about the issues facing and affecting their city, state and federal government; and respecting the opinions of others.

“People talk about coming to America to live the American Dream,” said Quigley. “Well, the dream only becomes a reality when American citizens are educated on the laws governing our country, live ethically, get involved in their community, and vote. Do you see action or inaction by elected officials? Make informed decisions and your vote will make the difference. No one is right or wrong because of an opinion, we tell our students if you don’t see eye to eye with someone, then agree to disagree, agreeably!” On the same day, Pembroke Pines Charter Academic Village Middle school students participated in a mock vote and were addressed by Pembroke Pines city officials who spoke about the importance of becoming informed about issues, taking responsibility for their community and country through active involvement in the political process and exercising their American right to vote. “Today our middle school students heard directly about the importance of voting and our newly eligible students from the class of 2017 enjoyed a rite of passage when they exercised their right to vote,” said Peter Bayer, PPCHS Principal, as he watched the students file into to vote. ver 1,400 Pembroke Pines elementary school students recently competed in the Pembroke Pines Fire Department’s 20th Annual Fire Prevention Week Poster Contest, which promoted Fire Prevention Week’s theme “Don’t Wait Check the Date! Replace Smoke Alarms Every Ten Years.” “The more children involved who understand the need to take responsibility for fire safety the more lives that will be saved,” said John Picarello, Fire Chief of the Pembroke Pines Fire Rescue. “This contest teaches lessons that will last a lifetime.” Posters were judged based on how well the safety message was incorporated into the poster, creativity

Pembroke Pines Update BY MAYOR FRANK C. ORTIS CITY OF PEMBROKE PINES

ASK THE MAYOR

I

t has been another wonderful year for all of us in Pembroke Pines, and I want to send season’s greetings to all of the Pembroke Pines residents and businesses that make this a very special city in which to live and work. May you and your families enjoy the very best of the holiday season. There are many exciting events planned throughout the city during this holiday season, including our annual Snowfest, Sundaes with Santa and Holiday Open House at the Southwest Focal Point Community Center. You can find many more activities and information on our website at www.ppines.com and on our Facebook page at www.facebook.com/cityofpembrokepines. Just a reminder that shopping during the holiday season can present unique dangers, which is why taking a few preventative measures can help keep the holiday season joyous. The Pembroke Pines Police Department offers these tips to help make everyone more careful, prepared and aware during the holiday season: ▸▸ Shop during daylight hours whenever possible. If you must shop at night, go with a friend or family member and park near a well-lit area. ▸▸ Avoid wearing expensive jewelry, so thieves are not tempted. ▸▸ Do not carry a purse or wallet, if possible. ▸▸ Avoid carrying large amounts of cash. If you do, keep it in your front pocket. ▸▸ Always carry your driver’s license or identification along with necessary cash, checks and/or a credit card you expect to use. ▸▸ Notify the credit card issuer immediately if your credit card is lost, stolen or misused. Keep a record of all of your credit card numbers in a safe place at home. ▸▸ Even though you are rushed and thinking about a thousand things, stay alert to your surroundings. ▸▸ Avoid overloading yourself with packages. It is important to have clear visibility and freedom of motion to avoid mishap. ▸▸ Beware of strangers approaching you for any reason. At this time of year, con-artists may try various methods of distracting you with the intention of taking your money or belongings. To end the year on a very positive note, we are all very excited about the opening soon of our Pembroke Pines City Center. We can’t wait to share opening information with you – please keep an eye on our website and social media for announcements. I have great hopes for a new year in which all of our best expectations are met. May it be a safe and joyous holiday season for all of you, with a happy and prosperous New Year!

T

oday a growing number of men are seeing cosmetic surgeons for procedures specifically tailored to meet their unique needs. More than ever, men are making the choice to improve their appearance with the use of Botox, fillers and cosmetic procedures. According to American Society of Plastic Surgeons (ASPS), male plastic surgery rates have significantly increased since 2000 and the notion that cosmetic procedures are just for women no longer exists. Wrinkles don’t just affect women, so it only makes sense that both men and women can use these treatments. Often times, men are seeking to regain a more youthful look, improve their self-image, maintain their edge, and feel better about their appearance. Plastic surgeons have procedures to meet and often exceed their expectations. A little Botox or filler can rid the face of fine lines, marionette lines, crow’s feet, brow furrows and other signs of aging or sun damage. Wrinkles are not the only thing Botox is used for — often men use products such as Botox to decrease sweating, or hyperhidrosis, in the armpits or hands. Specifically, Bro-tox, which is the name given for male Botox injections, is on the rise as it is one of the most subtle non-invasive skin rejuvenation procedures on the market. The procedure is fast, virtually painless, and easy. Botox injections leave no signs of having “work done,” so men are able to keep the so called “character” but lose the lines, resulting in a smoother, lifted and relaxed appearance without facing the stigma associated with cosmetic procedures. According to the ASPS, in 2011 there was a 56% increase in minimally invasive procedures such as Botox injections and fillers in males. Increasingly, a number of guys are considering non-invasive cosmetic procedures to appear more approachable, to stay competitive in an ever younger and competitive workforce, and to generally increase their overall confidence. Although the application technique is similar for these procedures it should be noted that men and women have very differing facial anatomy. Men’s skin is thicker, with more oil glands and more hair than female skin, and the aging process is different in the two genders. Women, in their younger years, have more fat pads in their faces, and as time marches on the fat pads diminish and the skin begins to sag. Because men have less dense fat pads, the sagging process isn’t as apparent, but stronger muscles in the forehead and around the eyes can lead to deeper, etched lines in men. As such, men can be treated with the same Botox techniques as women, but often require more units to treat the larger muscles in their face. Forehead lines require care in men so consideration should be given to the masculine brow when treating men. As usual, using an experienced master injector is always important. A cosmetic evaluation to discuss any questions and concerns is sometimes all it takes to get the conversation started. Dr. Tamy Faierman is a Board Certified Plastic Surgeon. Her office is located at 17130 Royal Palm Boulevard, Suite 1, in the Windmill Professional Campus in Weston. Office hours are Monday through Friday from 9:00 am-4:00 pm. LEGALLY SPEAKING

Will I Be Fired? BY MAYLEIDYS PORRASPITA, ESQUIRE

A

s the year wraps-up and with the holidays upon us, the financial burdens on everyday working families seem to multiply. Family gatherings, gifts and family travels place additional stress on a working budget. We are all hoping for good hours and maybe even a bonus at the end of the year in order to make ends meet with all the additional expenses. However, if you are injured at work during such times, the concerns immediately get much bigger. As a recently injured worker right before the holidays, you may be struggling about what to do. Do you report your claim or do you keep quiet in fear of being fired? Undoubtedly the question arises: “Can I be fired for filing a Worker’s Compensation claim?” Under Florida law, an injured worker cannot legally be fired for reporting a work accident or filing a Worker’s Compensation claim. An employer who fires a Claimant for being injured at work can potentially face a suit for retaliatory discharge.

It is important to note that I said legally. The distinction is important because in theory nothing can prevent an employer from firing an employee for any reason and it is unlikely that they will admit the accident is the reason for the firing. The employer will often cite misconduct on the part of the employee or a reduction in work force to justify the discharge. Therefore, reporting an accident can potentially lead to being discharged; however, failure to do so can leave a Claimant in a serious financial situation with medical bills that would otherwise be covered by Worker’s Compensation. Although there is no requirement to be represented by an attorney during a Worker’s Compensation claim, an unrepresented Claimant is at a serious disadvantage, particularly when there is a concern regarding a potential firing. The Claimant’s attorney can obtain the Claimant’s work history and guide the Claimant through the complexities of the system. The Employer and the insurance carrier will undoubtedly have an attorney well versed in the law and who will adamantly represent the employer and the Carrier. A Claimant, unfamiliar with his/her rights and how to obtain those rights, might not know how to best protect himself/herself if fired or be able to avoid the firing all together. Most importantly, the injured worker is not burdened with the cost of legal representation since the attorney representing the Claimant only gets paid when benefits are secured for the Claimant and these costs are usually the responsibility of the insurance carrier who has failed to timely and properly provide the benefits. If you or a loved one has been injured at work, feel free to contact our office for a free consultation. The Law Offices of Mayleidys Porraspita, P.A. are located in Pembroke Pines. If you have any questions regarding the matter discussed in the article above or any other Worker’s Compensation question or concern please call our office at 800-492-5455. Hablamos Espanol.

How Homeowners Can Overcome Landmark Florida Supreme Court Foreclosure Decision Favoring Lenders BY OMAR J. ARCIA, ESQ. FORECLOSURE DEFENSE, BANKRUPTCY AND CONSUMER ADVOCACY ATTORNEY

O

n November 3, 2016, in the case of Bartram v. U.S. Bank N.A., the Florida Supreme Court ruled in favor of lenders in a decision that homeowners’ advocates say will create renewed uncertainty for borrowers about whether they can stay in their homes. In a nearly unanimous decision, the Court determined that mortgage lenders can file new foreclosures against borrowers who won their cases more than five years ago if the borrowers defaulted again within five years of the first case’s dismissal. Homeowners argued that banks should abide by the same limitations period as every other litigant in the State of Florida. The Supreme Court, however, showed its true colors by essentially carving out a “bank friendly” exception to the five year rule in mortgage foreclosure cases. The Court made it clear that, for purposes of the statute of limitations, whether the prior foreclosure action was dismissed with or without prejudice has no bearing on whether a lender may file suit on a separate default (i.e., a new non-payment event). Also, where there is a new default post-dismissal, the lender can file a second (or third, or fourth, and so on) foreclosure and accelerate the entire debt, as long as it does so within five years of the new default. In short, this means a lender that filed previous foreclosures that were dismissed can now send out a new non-payment letter to the homeowner and keep foreclosing for the entire amount due as many times as needed until the borrower either reinstates the debt, modifies the loan, or loses the house at a foreclosure auction. The Supreme Court decision will result in a new round of foreclosures throughout Florida, reigniting collection on thousands of loans that had been in a holding pattern due to prior dismissals, and will have a major impact on borrowers whose foreclosure cases were dismissed and who thought they owned their homes “free and clear.” There are several ways to defend the anticipated assault on Florida homeowners by lenders. First and foremost, retain qualified foreclosure defense counsel with years of experience and a successful track record in court, such as the Arcia Law Firm. Next, you can short circuit a new foreclosure filing by initiating a well-documented loan modification application with assistance of counsel. Under guidelines by the Consumer Finance Protection Bureau, a loan servicer may not initiate a foreclosure action while it is in the middle of reviewing a borrower for modification. If a foreclosure is filed, you must be prepared to aggressively defend the action, raise every available defense and counterclaim under law in order to negotiate a settlement or prevail at trial. If you would like more detailed explanations of different options available to homeowners in foreclosure, at risk of foreclosure, or considering bankruptcy are discussed in our new consumer friendly DVD developed by the Arcia Law Firm entitled “Fight for Your Home,” available for purchase on our website. If you mention that you heard about the DVD through this magazine, you will receive a FREE copy during the appointment. Over the last 21 years, the Arcia Law Firm has successfully represented dozens of homeowners in our community against foreclosures, and has negotiated hundreds of loan modifications. Contact the Arcia Law Firm at 954-437-9066 to schedule your free consultation with Omar Arcia to discuss your case in detail. ASK THE EXPERT

BY CHARLES A. MESSA, III, M.D., F.A.C.S.

T

he eyes are the first thing we notice when we meet someone. Beautiful eyes can make up for other features that are less than ideal. Likewise, eyes that are tired, droopy, or puffy may not reflect a vibrant inner self. It is often said that the earliest signs of aging are around the eyes. Perhaps people are always questioning whether or not you had a good night’s sleep, because your eyes are swollen with bags. Fortunately, at the Weston Cosmetic Surgery Center, we can give you dramatically younger looking eyes through “eyelid lifts,” also known as blepharoplasty. A primary reason for droopy eyes is simply due to age. It can also be hereditary. As everything droops, so do the eyebrows. As the outer part of the eyebrows droop, the skin of the upper eyelids will look saggy, as if you had developed extra skin that was not there several years before. Removing this “extra” skin can drastically improve that droopy look. Another reason for “tired eyes” is because of droopy or migrating eyelid fat. This fat is held back by a thin wall of fibrous tissue called the orbital septum, which weakens over time. The fat, held firmly back by this wall in youth, can bulge with age, giving you “baggy” upper and lower eyelids. Blepharoplasty removes this extra fat and tightens the wall, restoring a youthful contour. For those patients with puffiness under the eyes or baggy upper and lower eyelids, laser eyelid surgery can reduce and often eliminate these problems. The end results are a more alert and youthful look around the eyes. The prominent fat pockets can be removed from a hidden incision along the inside surface of the eyelid. This “no stitch”, no external scar technique is utilized when patients have fat prominence of “eyelid bags” alone without excess or sagging eyelid skin. If minimal excess skin is present, a skin pinch technique is combined with transconjunctival fat removal. In this case, a “pinch” of lower eyelid skin is removed. These techniques typically result in less swelling, less discomfort, and shorter recovery time. I will assess which technique is ideal for your eyes during your personal consultation. Recovery from eyelid surgery usually takes seven to ten days. Sunglasses allow you to go out in public immediately after surgery, and make-up can be worn within about one week. Normal activity can be resumed within a few days, and exercise can be resumed within 14 days after surgery. If the eyes looking back at you in the mirror are not reflecting how you are feeling, it might be time to consider a blepharoplasty. Do you have a thoughtful and comprehensive estate plan which includes:

Some Thoughts on Legacy BY BRUCE IDEN, ESQUIRE

L

egacy means so much more than the assets we leave behind in the form of an inheritance. Most of us never give much thought to what our legacy might be. We think about a will, or trust, that carefully lays out how our property is distributed after we are gone. It’s usually about our “stuff.” Interestingly, studies on adults and their inheritances may surprise and disappoint you. The Journal of Family and Economic Issues reported that adults who receive an inheritance save only half of what they receive. Other studies point to statistics showing virtually all money or property left to love ones in the form of an inheritance is consumed within 14-17 months. So thinking in terms of money and property, a legacy has a very short shelf life. With that in mind, let’s explore other ways to leave a legacy that will live on long after you are gone. Charitable Giving. Making charity a part of your estate plan does two important things. Most obviously it provides support to a cause or causes you deem important. But it is also a teaching moment for your loved ones; it reinforces the importance of providing for the greater good. Many of us have made quiet personal promises to support a charity or cause “later,” or “when we can better afford it.” Making room in your final wishes for charitable giving answers those promises. Aside from the tax advantage charitable bequests generate, this selfless act can echo for generations. Many people leave a percentage of their estate to charity instead of a specific dollar amount. By leaving a percentage, your family and charity will receive proportionate shares regardless of how large or small your estate is. Instead of leaving money to a charity in a will, you may also consider naming a charity as a beneficiary of an insurance policy or retirement plan. Ethical will. An ethical will has ancient origins, originally appearing in the Book of Genesis when a dying Jacob spoke with his sons to share wisdom and his hopes for how they should live their lives. Originally, ethical wills were communicated orally, but were later written as letters. Today, ethical wills are known as “legacy letters.” It is a way to communicate to loved ones your hopes and dreams, regrets, and lessons learned. Often apologies are offered and forgiveness is sought. Family lore, favorite jobs, funny stories may all be part of your letter. A well-circulated legacy letter was written by President Obama to his daughters on the eve of his first inauguration. Think of a legacy letter as a way to pass long not only wisdom, but your love to a future generation. Estate planning is a deliberate, premeditated act of love. Life can change in an instant. What are you waiting for? Bruce Iden earned his J.D. from George Washington University National Law Center and his L.L.M. in taxation from the University of Miami School of Law. He has been practicing in the area of estate planning and probate and trust administration for over 30 years. For more information, or to schedule a complimentary estate-planning consultation with Mr. Iden, please contact Iden Law Offices at (954)885-0085.

LEGALLY SPEAKING

The Gray Divorce BY EVAN BARON

T

he Baby Boomer generation has had a huge impact on many categories of American life from music to art to technology. Those same boomers are now impacting family law as well. Statistics have shown that the overall divorce rate over the last 20 plus years has declined. This could be because the marriage rate has decreased as well. In spite of this overall decline in divorce, the rate for those couples over 50 has doubled over the same span of time. One out of every four divorces filed in 2010 were involving couples over 50. This increase in the divorce rate of these boomers has led to the term “Gray Divorce.” There are probably many factors which have led to this increase. As this generation increases in age, more and more people are celebrating their 50th birthday and, as such, the over 50 population has increased; the greater the number of people, the greater the number of divorces. There are however other factors to be considered. People are generally living longer, which results in potentially very long marital relationships. As people age, their prospective on life sometimes changes as well. Their mortality comes into issue and couples who are not happy in their marriage no longer wish to remain together for the later part of their lives. Some couples wait until their children are grown and have established their own lives. Parents feel that after raising their children it is now “their time” to explore and enjoy life. Unfortunately, in many instances their spouse is not who they wish to share this experience with. Finances are the most significant issues that accompany divorces for individuals in the later years of life. After years and years of working, owning a home, and placing funds in retirement, the plans that were in the past shared disappear with the signing of a Final Judgment granting the divorce. In Florida, equitable distribution of assets almost always results in an equal division between the parties. As a result, each will have only half of what they owned together. Expenses will increase as there will be the necessity of funding two residences. This often times leads to parents moving in with their children or taking in a roommate. In addition, because the majority of their working years are behind them, they have less time to try and re-coup their losses. Homes, which are usually a couple’s largest asset, will often have to be sold. Monthly pension checks divided between the parties can result in a party having to continue working beyond the normal retirement age. There may be an alimony component which could cause additional financial complications. Although divorce proceedings for more mature adults can be less complicated due to the avoidance of child-related issues, there are financial issues which less mature couples do not have to address. I strongly suggest that before decisions are made it would be best to discuss your concerns with an experienced family law attorney. The law firm of Evan H. Baron and Associates is located at 1655 North Commerce Parkway, Suite 201, in Weston. If you have any questions concerning this issue or any other family law matter, call the office at 954-385-9160.

Habitual Toe Walkers

A

t the beginning of independent walking, toddlers may walk on their toes. Within three to six months the heel should be touching the ground during gait. Intermittent toe walking may be present in normal children until age six or seven. Tightness of the calf muscle is the primary cause of the child that toe walks. Underlying neurological disorders have to always be ruled out. Most children who present as persistent toe walkers are able to lower their heels to the ground when standing but not walking. Walking heel-toe is possible for a few steps but usually awkwardly due to tight calf muscles. Toe walkers are more common in boys and in many cases is a cause of concern. Treatment of habitual toe walkers is necessary to avoid problems that can occur secondary to compensating for the abnormal posture. Compensation may occur by hyperextending the knee, rotating the entire leg towards the outside or having the foot turn down or out, causing a flat foot. It is important to assess the degree of muscle tightness in the hips, knees and legs. Spontaneous resolution may take place in some cases. If the gastroc soleus (calf muscles) are not severely tight, physical therapy or stretching at home may be of benefit. If unresponsive, serial casting may be necessary. Serial casting is a process in which the foot and leg are placed in a cast with the foot held in a neutral position. The muscle is placed under stretch while the cast is on and walking is strongly encouraged to help the muscles stretch. Children who are sedentary who are placed in a cast do not get the same benefits as those that are active. Casts are applied every ten to 14 days until the muscle is slightly overstretched. It may take as little as two to as many as eight weeks to improve the muscle flexibility. The casts are applied one leg at a time to allow for the activity level needed for successful treatment. Following the casts, a night splint may be used for up to six months to maintain calf flexibility. In rare cases, the muscle is too tight to respond to serial casting. Surgical lengthening of the Achilles tendon through three little holes in the skin may be needed. It is an outpatient procedure. Casts are applied postoperatively for six to eight weeks. Once healing takes place, physical therapy is provided to maintain lower extremity strength and flexibility. An excellent long-term prognosis is the norm. Carlo A. Messina, DPM, is a Board Certified Reconstructive Foot and Ankle Surgeon, Diplomate American Board of Foot and Ankle Surgery. He is a Foot and Ankle Surgeon with the Foot, Ankle and Leg Specialists of South Florida and specializes in treating infants, children, teens and adults.
