You’re Never Too Old for a Spring Break

S

tudents shouldn ’ t be the only ones to enjoy

a Spring Break. This year, my family and I spent my sons’ Spring Break enjoying the wonders of Florida’s West Coast. Just a few hours from home we were able to spend an afternoon riding roller coasters and coming face to face with jungle creatures at Busch Gardens, only to spend the evening watching the sun set over a beautiful beach. That brief getaway was just what I needed to recharge my batteries. I came back to the office full of energy and memories of quality time spent with my family. Wherever your travel plans take you, now or in the future, don’t forget to bring along a copy of Our City Weston or Town Times magazine. Send us your picture posing with the magazine and you could be our Photo of the Month winner. In the coming weeks we will gather with our loved ones to celebrate the Easter and Passover holidays. For many of our readers, the holidays will not be a joyous time. They fear for their families as tensions rise in Venezuela under the communist dictatorship system. Please support our many Venezuelan neighbors and friends near and far as they fight to bring the current government regime to an end and let democracy rule. Sincerely, Sven Budzisch, Publisher/Owner

Annual Easter Egg Hunt Ready to Roll at Sunrise Athletic Complex By Julie Levin

I

t is one of the surest signs of spring , and most anticipated days

of the year for young children. One week before Easter Sunday, the City of Sunrise will host their annual Royal Easter Egg Hunt. Thousands of candy-filled eggs will once again be rolled out across a field at the Sunrise Athletic Complex for hundreds of youngsters to seek out. The Royal Egg Hunt is set for April 13 from noon to 3 p.m. at the complex, located at 11501 N.W. 44 Street. The city is expecting anywhere from 700-800 children to take part in the event. To make sure everyone has a chance to find eggs, the children will divided into age groups. Parents, except for those with the youngest children, will be asked to remain on the sidelines. Organizers say they encourage the children to share to make sure everyone gets an equal amount of eggs. “We always have extra eggs on the side so if any child doesn’t find as many as another, we always have some extra,” said Beth Zickar, the Leisure Services Director for the City of Sunrise. Organizers also put a number of “golden eggs” on the field, which can be exchanged for special Spring baskets loaded with Easter goodies. Zickar says they used to spread them out on the field, but decided they needed to do a better job of hiding them. “We started putting the golden eggs in larger eggs, but we also have larger eggs out there without golden eggs inside,” she said. Baskets in hand, youngsters await the signal to start hunting for their Easter eggs. Parents are asked to stay on the sidelines so the children can find the eggs on their own.

Kids search for Easter Eggs at last year’s Royal Egg Hunt

This year, Easter Sunday falls on April 20. Traditions associated with the festival include the Easter rabbit, a symbol of fertility, and colored Easter eggs, originally painted with bright colors to represent the sunlight of spring and a symbol of birth. Zickar says many children come dressed in costume for the annual City tradition. After the egg hunt, everyone is invited to join in for an afternoon of rides, inflatables, arts and crafts, face painting and a chance to take a photo with “King Bunny.” “It is a really nice event and a fun day,” she said. The Royal Egg Hunt will be held April 13 from 12 p.m. to 3 p.m. at the Sunrise Athletic Complex, 11501 N.W. 44 Street. It is open to all ages. Children should bring their own basket or bag for the egg hunt. Admission is $5 per participant.

Beeping Egg Hunt Provides Easter Fun for Visually-Impaired Kids By Julie Levin

I

n addition to its annual Royal Egg H unt, the City of S unrise

will also host an innovative egg hunt for children with visual impairments. During its “Egg-stravaganza” Beeping Egg Hunt for Children, participants will be actually able to listen for, rather than see, the eggs they are searching for. “They can actually hear the eggs because they have a loud beeping sound,” said Beth Zickar, the Leisure Services Director for the City of Sunrise. Presented by the City of Sunrise and Lighthouse of Broward, the Beeping Egg Hunt will be held April 12, from 11:00 a.m. to 1:30 p.m. at the Sunrise Athletic

Complex, located at 11501 NW 44th Street. The hunt is open to children age 12 and under and organizers are expecting as many as 50-75 people to turn out. The beeping eggs have an on-off switch, and once turned on give off a loud beeping sound that gives away their location throughout Mr. Bunny’s field. The children are escorted on to the large field by family members or friends. Once they find the beeping eggs, they can redeem them for other eggs filled with prizes and candy, prompting huge smiles. “They absolutely love it,” said Zickar. Also on hand for the event will be the City’s Fire Department and Easter Bunny, both providing a very tactile experience for the kids. “For many of them it is more about the feel of the bunny, rather than the appearance of the bunny, so it is a different perspective,” Zickar said. The City has been partnering with Lighthouse of Broward for several years to hold the Beeping Egg Hunt. Once organizers purchased the specialized beeping eggs, Zickar says they reached out to the Lighthouse of Broward to combine their efforts for an annual egg hunt. For more than 40 years, the nonprofit agency has been the primary resource for the visually impaired community, providing specialized rehabilitation and skills to enhance the independence, productivity, and dignity of the blind or visually impaired. Zickar says the Beeping Egg Hunt ensures visually-impaired youngsters don’t miss out on a favorite annual tradition. “We just want to make sure we are providing services for all of our residents and not excluding any one particular group of people. It serves residents of Sunrise, and I’m sure it goes beyond the borders of our community too,” Zickar said. The “Egg-stravaganza” Beeping Egg Hunt for Children with Visual Impairments is set for April 12 from 11:00 a.m. to 1:30 p.m. at the Sunrise Athletic Complex, 11501 NW 44th Street, Sunrise 33351. It is open to children age 12 and under. For registration information, please call Lighthouse of Broward at 954-463-4217.

Sports-themed Sunrise Relay looks to “Defeat Cancer” By Julie Levin

T

here will be

plenty of Gators, Marlins, Dolphins and Panthers to be found at Sunrise’s annual fight against cancer this year. The Relay For Life of Sunrise is set for April 25-26 and organizers are hoping a sports theme will help bring in more participants Survivors walk the opening lap at last than ever before. “We year’s Relay For Life in Sunrise are looking for at least 26 teams to help us this year,” said Jessica DeBlois a Specialist with the Relay For Life Florida Division of the American Cancer Society, Inc. “We had 24 last year.” The overnight cancer-fighting event will be held at the Sunrise Athletic Complex, and this year it will be based on the theme of ”Defeat Cancer.” That means the Relay participants have the option of helping to raise money, while emulating favorite sports heroes. “The teams are all picking a sports team or sporting event and decorating their tent in that way,” said DeBlois. Relay For Life is an opportunity for the community to come together to celebrate people who have battled cancer, remember those we’ve lost, and fight back against the disease. This year the goal for Sunrise Relay For Life is to raise $51,000. Funds raised through the event help the American Cancer Society to impact the lives of those touched by cancer within the community, through both patient services and valuable cancer research. Organizers are still looking for teams made up of friends, families, neighbors,

businesses, schools, hospitals, civic groups, and others who are interested in coming together in the fight against cancer. “The Relay For Life is a community event,” said DeBlois. “So it is really come one, come all. The best events have representation from the entire 24 teams took part in last year’s Relay For Life in Sunrise. Organizers are hoping for more this year community.” Relay For Life got its start in 1985 when Tacoma, Washington physician Gordy Klatt walked and ran for 24 hours around a track. A year later, 340 supporters joined him in the effort and it has grown ever since. Each year, more than 4 million people in over 20 countries take part in the overnight fundraising walk. Members of each team take turns walking around the track. The Relay For Life of Sunrise will include a survivors dinner and opening lap, a luminaria ceremony to honor those who have been touched by cancer, activities and entertainment for all, a family-fun field complete with a bounce house and face-painting, and much more. The Sunrise Relay For Life will be held April 25-26 at the Sunrise Athletic Complex, located 11501 NW 44th St. Opening ceremonies will begin at 6 p.m.on the 25th. In addition to new teams, they are also looking for more survivors to take part and businesses interested in sponsoring the Relay. For more information, visit www.relayforlife.org/sunrisefl

Sunrise to Host Global Simultaneous Running Adventure By Julie Levin

The Wings for Life Run will start locally at the BB&T Center in Sunrise and wind through Sunrise and Weston, before heading north on U.S. 27.

W

hen the starter ’ s

mark is given during a first of its kind running race next month, it will be a signal heard around the world. Wings for Life, the world’s first and only simultaneous global endurance event, is set for May 4 and Sunrise is one the cities where runners will take to the course. They’ll join thousands of other runners worldwide who will set off simultaneously on 39 different courses in 36 countries on six continents. “It’s going to be unique to runners because they are truly participating in a global event,” said Zoltan

Polgar of Coral Springs, the Race Director. The Wings for Life World Run is a global effort to raise funds and awareness for spinal cord research. Locally, the race will start at 6 a.m. at the BB&T Center in Sunrise. It will then wind through Sunrise and Weston before making a northwesterly turn along U.S. 27. The Sunrise race is one of just four locations in the U.S., along with Santa Clarita, California; Denver, Colorado; and Atlantic City, New Jersey. Everyone around the world runs at the same time. “All locations will run at the same time, regardless of their locations across the globe,” said Polgar. Another unique aspect of the Wings for Life is that the race has no fixed distance or finish line and is based on distance, rather than time. Participants will

10

April 2014 | SUNRISE town times

set their own race distance goal and will be followed by a moving finish line. 30 minutes after the runners set off, official Catcher Cars will set off behind the packs in pursuit of the runners. When a Catcher Car passes a runner, their race is over. “A finish line vehicle will pass you along the course and register you as finished based on distance, not time. That’s what makes it so very unique,” Polgar said. The last man and last woman running will be declared the winners and the top male and female finishers in Sunrise will earn a spot in any race venue in 2015. According to Wings for Life, more than three million people around the world are living with a spinal cord injury and every year, at least 250,000 more sustain a traumatic spinal cord injury. A non-profit foundation, Wings for Life says that 100 percent of all donations are used for research purposes only. The race will be held May 4 and will begin at 6 a.m. at the BB&T Center in Sunrise. Registration is $50 The deadline for applications is April 20. For more about the run Wings for Life, visit www. wingsforlifeworldrun.com.

Sunrise-Based Child Advocacy Agency Honors Local Supporter By Julie Levin

S

unrise - based J ewish Adoption and

Foster Care Options (JAFCO) will be holding its annual Spring Luncheon this month, where they will also take time to honor a longtime supporter. The spotlight will fall on Julie Talenfeld of Plantation, who plays a key role in JAFCO’s annual holiday celebration. Talenfeld is the founder and president of Boardroom Communications, which has handled public relations for JAFCO since 2007. But the relationship has also grown to a different and more personal level since then. For the past six years, Talenfeld’s family has also sponsored JAFCO’s Annual Chanukah party, bringing in traditional Hanukkah fare and even piles of “snow” for the children in JAFCO’s care to enjoy. “Every year, without fail, Julie’s family helps our children feel loved during the holidays by sponsoring our annual Chanukah party and giving them the feeling of warmth they deserve throughout the entire year,” said Sarah Franco, executive director of JAFCO. Julie and her husband Howard Talenfeld are also JAFCO Godparents. Established in 1992, JAFCO is a nonprofit organization which provides services to abused and neglected children in South Florida. In 2009, JAFCO extended their mission to include services and support for families who are raising a child with a developmental disability such as autism, spina bifida, cerebral palsy, intellectual disabilities, Prader-Willi syndrome and others.

Many of their services are offered at the JAFCO Children’s Village in Sunrise, a 5.6-acre residential facility that includes a 24-hour emergency children’s shelter and group homes that provide a safe home for dozens of children from newborns up to 21 years of age. Talenfeld will be honored at JAFCO’S 6th Annual Spring Luncheon which will be held April 9 at Temple Beth Emet in Cooper City, with a shopping boutique followed by lunch. This year’s luncheon will also feature guest speaker Cindy Krischer-Goodman –a Miami Herald columnist who will talk about balancing work and family. In 2009, Boardroom Communications was also presented with JAFCO’S prestigious Jacob’s ladder Award for Child Advocacy. “Seeing smiles on these kid’s faces is truly a wonderful gift,” said Talenfeld. “I am very fortunate to be able to make a difference -- and what a difference being able to help has made to me and my family.” JAFCO’S 6th Annual Spring Luncheon which will take place April 9 at Temple Beth Emet in Cooper City. Tickets for the luncheon are $54 per person and the event begins at 10:30 a.m. For more information, visit www.jafco.org Julie Talenfeld will be honored at JAFCO’s 6th Annual Spring Luncheon

The Jamboree took place at the Doctor’s Hospital Training Facility in Davie recently and drew 26 of the top flag football programs from around South Florida. “Every year, the participation continues to grow and the girls are getting better,” said Miami Dolphins Executive Director of Community Affairs Twan Russell. “This shows how much girls flag football has evolved as a sport and we look forward to doing it again in 2015.” The Bengals beat the West Broward Bobcats 19-13 in their match. The 13-game Jamboree followed a flag football clinic to help the teams get ready for the start of the flag football season. “I think that the games were very exciting and the kids had a good time out here,” said BCAA County Athletic Director Rocky Gillis. “We are seeing more participation in girls flag football and events like this continue to aid our efforts in growing the program.” 16 years ago, the BCAA became one of first conferences in the state of Florida to go full force with girls flag football. They have been partnering with the Miami Dolphins since then to help the sport grow.

City to Pour over Applications for Outstanding Citizens Scholarship By Julie Levin

T

he City of S unrise is getting

ready to recognize the accomplishments of its most outstanding high school seniors. In order to provide recognition, and financial assistance to eligible graduating high school students, the City has created the Outstanding Citizenship Scholarship Program. After encouraging students to apply, the City now has the task of selecting the two most deserving students, since the application window closed April 4. Organizers say the scholarship committee goes well beyond simply looking at grades and GPA. “We are looking for well-rounded students in our community that have financial need,” said Beth Zickar, the Leisure Services Director for the City of Sunrise. “We are really looking for that student that might not have a 4.0, but may have really contributed outstanding things to their community.” The program is open to graduating high school seniors who are residents of the City of Sunrise and meet the program’s income guidelines. The two winners receive scholarships for 60 credit hours, which covers two years of higher education at most Florida schools. Zickar says the scholarship was created so that everyone could have an equal opportunity to continue their education past high school. “Sometimes there are hurdles and they may just not have the finances.

Sometimes it’s about going that extra hurdle to help the community. It’s not always about that 4.0. We want to work with them and see that they have the opportunity to at least get those first two years in at school,” she said. Zickar says once the application window closes, they go to the City’s Education Advisory Board, which assists in the decision process. Members go through all of the applications to make sure the applicants meet minimum qualifications, and then narrow down the list to 10 finalists. Those students are asked to come in and make a presentation to the advisory board, who then make recommendations on the two most deserving applicants. “We get a fair amount of applications, so it is a tough decision,” said Zickar. “We are looking for them to demonstrate outstanding citizenship through volunteer work that they’ve done.” The decision is expected to be made in May, and the winners will be announced at a City Commission meeting. Zickar said the pride in the parent’s faces when they come to the commission meeting and see their children being recognized for their hard work is wonderful. “Many of these students had tremendous challenges to overcome and the fact that they did, and they rose above, is so incredible. You can see the joy in their parent’s faces,” she said. For more information, call 954-747-4600.

Legally Speaking

What Will It Cost? By Evan Baron

T

he one question that I am always asked by a

prospective client is, “How much will this cost me?” It is obviously a very fair question, which deserves an answer. Unfortunately, often my answer is not well received by the individual. It is not because my answer suggests an extremely large fee, but rather the answer is open ended. I tell them I am unable to give them a complete cost, due to the fact that billing is based upon the amount of time it will take to conclude the case. The more time, the more work, the higher the fee. I explain that the fee is really controlled by the clients and not the attorneys. If they can reach a fair and equitable agreement the cost will obviously be less than a contested matter. The more a client litigates the more money they will spend. I do not “cap” my fees in a divorce action. I have been asked many times to quote a final, 100% complete price. I am unable to accommodate that request. It is unfortunate, but the cost of litigation cannot be determined at the initial meeting.

The cost of a divorce can increase based upon a number of factors. It often times is due to an unreasonable expectation by one or both of the clients. Unreasonable expectations often lead to litigation, because a settlement cannot be achieved. Unfair settlement offers can also lead to higher fees, since nobody should settle for an unreasonable and unfair resolution. In addition, some aspects of a divorce case are not even negotiable. As an example, child support is determined by Florida Child Support Guidelines and is statutory. Therefore, the amount of support is not negotiable between the parents. Higher fees can be generated by lack of cooperation or failure to act in a timely fashion. Financial discovery is an important aspect of a divorce case. There are certain requirements which must be fulfilled within a specific time frame. Many clients get totally stressed out when I hand them their “homework,” which requires gathering certain financial documents and completing a Financial Affidavit. I do understand why it becomes a stressful task. Just because you may be going through a divorce does not mean that all other aspects of your life are put on hold. The financial tasks are time consuming. Many individuals who are going through a divorce are not emotionally ready to deal with the completion of financial documents. Unfortunately, these tasks have to be completed in a timely fashion. Failure to do so will lead to motions being filed and hearings being set before a judge. The result is always additional fees, which should not be necessary; but for the client’s failure to complete the task in a timely manner. These are just some examples of situations which can cause fees to increase. As I stated previously, very often it is the client who controls the cost. Perhaps now you can understand why a set fee in a divorce is not a possibility. The law firm of Evan H. Baron and Associates is located at 1655 North Commerce Parkway, Suite 201, in Weston. Sorting our Way Through the “Menopause Maze” By Dr. Michele Lapayowker D.O., FACOOG

F

orties and Fabulous! We are all starting to

experience the wonders of the infamous “change of life”. What is menopause vs. post menopause vs. peri menopause? I am asked this question several times a day. Women begin to have changes in their menstrual cycle as early as in their late 30’s through their mid fifties. It is important to remember that this is different for every woman, and most importantly, a natural process. Women will frequently experience changes in their menstruation pattern, skipping cycles, bleeding more frequently, heavier or longer, and “hot flashes” or some type of temperature change. I often hear complaints of difficulty sleeping, maintaining their weight, an increase in premenstrual irritability and bloating. Many women also have questions regarding a decreased libido or desire for sex despite being in a loving and stable relationship. They complain of vaginal dryness, dry skin and thinning hair. The good news is, there are many options for women to regain their balance and improve these symptoms. While we cannot always reverse all of these symptoms, many of them can be improved and truly benefit a changing woman’s quality of life. The terms used to describe this period of change that women go through are defined generally as the transition or the menopause. The definition of menopause is a label used for a woman who has had no cycles for 12 months barring other medical issues. The average age of the menopausal woman is 51 years old. The term perimenopause refers to the 10 years prior to this point when a woman experiences many signs and symptoms. The most important part of my conversation with a woman who falls into this category is to reassure them that this is both a normal and natural process and they are likely not exaggerating their complaints. Every woman experiences this

period of their lives differently. Some women may feel extreme symptoms and others may breeze through this time without noticing much change. Our ovaries are simply not producing the same levels of hormone that they did in our twenties and thirties. At the same time, women must understand that many but not all symptoms can be improved or eliminated and it takes time to see if the interventions will be effective. Believe it or not, adopting a healthy lifestyle with good nutrition, exercise and stress management is truly the first line for every woman’s defense. We then discuss proper supplementation, and the topic of hormone replacement therapy. Hormone Replacement Therapy refers to giving a synthetically or bio-identical version of the hormones that our body is no longer producing regularly. HRT deserves a formal conversation with the details of all the risks and benefits. The first step every woman should take is to have her full annual exam including a detailed medical history, physical exam, pap screening, mammogram and if indicated, a bone density exam. I then recommend baseline hormone screening with any other pertinent lab work and a visit to review all. We can then address each patient’s concerns and together create a plan to make our way through the “menopause maze.” Dr. Michele Lapayowker is a Board certified Gynecologist serving women in Broward since 1995. Her Plantation Office is in the Bennett Medical Plaza at 201 NW 82nd Ave, Suite 104, Plantation, Fl., 33324. Drowning is the leading cause of death of children ages 1-4 in Broward County, according to the Florida Health Department of Broward County.

FACT: Among children in this age group, most drownings occur in the family swimming pool. FACT: In Broward – which has more swimming pools than any other county in the state – an average of seven toddlers drown each year. The good news is that drownings are preventable. One of the most effective ways to prevent drowning is to teach children how to swim, and having constant adult supervision in and near the water. In the City of Sunrise, children as young as 10 months can begin swimming lessons through the Parent and Tot classes, and can be enrolled in private lessons at 18 months. Swim classes at a young age aim to develop the child’s comfort level in the water as the foundation to build on. Additional skills, such as immersion underwater while holding their breath and having their eyes open, floating on their front and back, and reaching and kicking to the wall are introduced at as early as 10 months old. The City of Sunrise offers a session of free group swimming lessons beginning in April to Sunrise residents. These lessons are held at Village Pool and are offered in addition to the regular paid lesson programs offered at the Civic Center pools through the City lifeguard instructors and “Sunrise Swimming” contracted instructors. Lessons and instruction are a great start, but continued exposure to the water and practice is needed to maintain skills. Remember, swimming lessons are not a substitute for adult supervision – especially for children four and under. Don’t let your loved ones become statistics. You can protect your children from water dangers. Here’s how: ▸  One of the most effective drowning-prevention devices you can install is a four-foot-tall safety barrier (known as a pool isolation fence) with a selfclosing, self-latching gate. Other options include door alarms that sound when a pool-access door or gate is opened and pool alarms that detect when a person or object enters the water. ▸  If your child is missing, check the pool area first. ▸  Designate a responsible adult to supervise children at all times during water-related activities, including swimming and bathing. ▸  Keep rescue equipment – such as a life preserver – near the pool. ▸  Have a phone handy, but use it only for emergencies, not casual conversation. ▸  Remove all toys from the pool immediately after use. Floats and other objects could attract a child to the pool area. ▸  Learn CPR, and post CPR instructions near the pool. Performing CPR while paramedics are on the way could make the difference between a drowning and a near drowning. For more safety tips and information on swimming lessons, visit the City of Sunrise website at www. sunrisefl.gov.

MAyor’s Message

Enjoy All the City of Sunrise Has to Offer By michael Ryan, Mayor of Sunrise

S

pringtime in S unrise! We

offer plenty of opportunities to enjoy the great outdoors starting with our popular Earth Day Festival on April 5th. This is a community celebration of green living that also offers live music, children’s activities, amazing food and a variety of interesting vendors and exhibitors. Our City is focusing heavily on sustainability. We just observed Earth Hour (3/29) as a community, and are working on a system of bikeways and trails that will encourage residents and visitors to appreciate our beautiful surroundings up close. Other important green initiatives include our participation in Broward County’s GO SOLAR program, which provides home and business owners with a streamlined permit process that reduces the cost and time associated with installing solar roof panels. We’re also a leading partner in the County’s Conservation Pays program, which offers Utilities customers free low-flow shower heads, as well as rebates on water- and money-saving toilets. And, since 2011, Sunrise residents have been able to earn rewards through our Recyclebank.com program, which incentivizes recycling and other green activities.

The City’s growing Little Free Library network also provides opportunities for recycling – on a literary level. If you have a gently-used book you’d like to share with the community, place it in one of the repurposed newsracks we’ve installed at City parks and facilities: the Village Multipurpose Center Gymnasium, Welleby Park, Flamingo Park, the Sunrise Civic Center, and Nob Hill Soccer Club Park. You can read the story of this awardwinning Sunrise Leadership Academy project, as well as its Wisconsin roots, at www.sunrisefl.gov. If you haven’t yet attended one of our Tunes ‘N Trucks concerts (or even if you have), you’ll want to be part of the excitement on April 11, when Jimmy Buffett tribute band The Caribbean Chillers takes the stage. This free performance is complemented by great meals from food trucks as well as local restaurants. Come relax, meet new friends and hang out with neighbors in a fun, family atmosphere under the stars. Of course, April is also the time for our traditional spring activities, including a Beeping Egg Hunt (4/12) for children with visual impairments, as well as our Royal Egg Hunt (4/13).

This Month in Sunrise: • Earth Day Festival. Saturday, April 5, from 10:00 a.m. to 4:00 p.m. at Sawgrass Sanctuary. • Tunes ‘N Trucks Concert featuring Jimmy Buffett tribute band The Caribbean Chillers. Friday, April 11, at 6:00 p.m. at the Sunrise Civic Center. • “Egg-stravaganza” Beeping Egg Hunt for children with visual impairments. Saturday, April 12, at 11:00 a.m. at the Sunrise Athletic Complex. • Royal Egg Hunt. Sunday, April 13, at 12:00 p.m. at the Sunrise Athletic Complex. Admission: $5 per participant. • Relay for Life. Friday, April 25, at 6:00 p.m. at the Sunrise Athletic Complex.

For more information about our great city, including the events and programs I’ve mentioned here, please visit us online at www.sunrisefl. gov and www.facebook.com/sunrisefl. Have a wonderful month!

Join The Fun at…

How to Combat Light Speed Foreclosures By Omar J. Arcia, Esq. Foreclosure Defense and Consumer Bankruptcy Protection Attorney

S

ince J une 2013, when the Florida legislature approved addi -

tional funding to clear the huge backlog of residential foreclosures, major changes have occurred to the time in which foreclosure cases are brought to trial. Previously it would take anywhere between 18 months to two years before a foreclosure case was completed. Today, most foreclosure cases are set for trial or final judgment within 6-8 months. The goal is to erase the statewide foreclosure backlog by 2016. Based on these state time limits, it may appear that judges in South Florida are more concerned with eliminating the backlog than with dispensing justice. If you are in foreclosure or at risk of foreclosure, how can you combat against “light speed” foreclosures? The most important tool you can use to defend against our courts’ quests to drain the dockets is to hire a qualified and experienced foreclosure defense attorney to guide you through the minefield of valid defenses to a foreclosure action. First, don’t settle for anything less than an initial face-toface meeting with the attorney. Let’s face it, if they are too busy to meet with you personally to review your case, they will just be “too busy” to actually help you with your case. Also, make sure that the attorney has plenty of litigation and trial experience (at least 15 years), and that the attorney regularly practices in the county where your case is pending. Finally, make sure the attorney has a proven track record of outstanding results and satisfied clients. Ask the attorney to refer you to at least three satisfied clients. If they refuse to provide you this information, thank the attorney for her time, don’t waste another minute of your time, and leave the office. Another critical tool to defend against “light speed” foreclosures is to ensure that the law firm you hire to defend your case has established loan modification and consumer bankruptcy departments. This will give you the very best opportunity to save your home. If your legal defenses to the foreclosure case are not accepted by the court, you can process a loan modification, reinstatement, or short payoff of your loan. If all else fails, right before the foreclosure auction of your home takes place, you can file a consumer bankruptcy and attempt to complete the modification within the bankruptcy proceeding. The attorneys at the Arcia Law Firm have more than 40 years combined litigation and trial experience, and we are privileged to successfully represent hundreds of homeowners in our community. We have foreclosure defense, loan modification and bankruptcy departments all in the same office. We will gladly refer you to our satisfied clients, so you can be confident in your decision to hire our Firm. Detailed explanations of different options available to homeowners are also discussed in a new DVD developed by the Arcia Law Firm entitled “Fight For Your Home.” If you mention that you heard about the DVD through this magazine, you will receive a complimentary copy during your free consultation to discuss your case in detail with a member of our highly experienced and determined legal team. If you are struggling to make your monthly mortgage payments, if you are in the middle of a frustrating loan modification process, or if you just received a foreclosure summons, contact the Arcia Law Firm today at 954-437-9066 to schedule a free personal consultation with an attorney (not a paralegal or assistant), or visit www.arcialawfirm.com to schedule your appointment online.
