Back-to-School Time is Here
S
ummer is the time to relax and unwind; reju -
venate from the constant chaos of our daily lives. Although we still have a few weeks left of the “lazy days of summer,” we’ll be back-to-school before we know it. It seems like the stores started stocking school supplies within minutes of pulling the leftover July 4th sparklers off the shelves. As we work through the school supply lists, buy new school clothes and get the school physicals done, our kids will soon realize that their summer school vacation is quickly coming to an end. They are starting to look forward to seeing their school friends again. On rare occasions, we might even catch them picking up a book on their own. Before we know it, we will be getting back to our school-time routine with early morning carpool, after-school activities and evening sports practices. But, before that first day of school arrives, let’s enjoy the final days of summer break with our loved ones. Enjoy the beaches, the backyard pool, or a simple BBQ with friends, because soon enough we’ll be back-to-school, again! Sincerely,
Sven Budzisch Publisher/Owner

Rotary Club Members Dig Into the Community with Goodwill Project By Julie Levin
C
lose to one dozen
members of the Rotary Club of Miramar-Pines rolled up their sleeves recently to help a neighbor in need. In early June, the club members organized and pitched in on a tree removal project that was creating a problem in a Miramar neighborhood. The club learned about the problem through the city and decided to help. “Each year we try to work with the city to do a project to help people in need,” said Robert Bell, the Treasurer of the Rotary Club of Rotary members lay sod in the spot where the two trees stood Miramar Pines. “This year, it was the removal of two trees.” For many years, the trees had stood in the swale of school teacher Celeste Murray’s home. Recently, they had become infected and needed to be removed per the city’s code. In addition to their poor condition, they were also a health concern for Murray’s two children who battle asthma. “There was concern the trees could affect their condition,” said Bell. Working in coordination with City Commissioner Yvette Colbourne, Rotary members arranged for two local businesses to donate their services. Bell says ValleyCrest Landscapers took down the trees and removed the stumps, while Waste Pro hauled away the debris. The next day, Rotary members returned to the home to clean up and lay new sod over the empty site.
Rotary leaders say the project was part of the club’s effort to make more of a difference locally. “When people hear about Rotary, they tend to think of the large international projects,” said Bell. “But every Rotary Club gets involved in the community and does local projects too.” The Rotary reaches out each year to the City to find community members in need. Last year, they painted a home badly in need of repair. Other projects through the year include their annual 5K/10K; donations to the Miramar Police Athletic League (PAL); support of Exceptional Theatre Company; book and shoe donations to local schoolchildren; scholarships to Everglades High School students; the Interact Club at Everglades High School and more. Backed by its motto of Service Above Self, Rotary International is an organization of business and professional leaders, known as Rotarians, united worldwide who provide humanitarian service, encourage high ethical standards in all vocations, and help build goodwill and peace in the world. They are always looking for new members. The Rotary Club of Miramar-Pines meets every Thursday from 12 p.m.-1:30 p.m. Those interested in the club’s activities or membership should call 954- 443-0600 or 954-658-2917.

New Program Set to Make Recycling Easier By Julie Levin
A
s of the first of the month , residents have been say goodbye
to the bins and switching to a new, more efficient way to recycle in the City. August 1 was the start date of a new recycling program that now uses 64-gallon wheeled carts. The new fixed-lid recycling container is not only substantially larger than the bins used in the past, but also provides a more convenient user friendly approach that encourages recycling. Provided free of charge, all homes receiving curbside solid waste and recycling collection service began receiving their new recycle carts from the City and Toter, Inc. in July. With the new carts, city leaders hope to increase the amount of recyclables collected curbside by making the program easier and more convenient. Residents will now be able to streamline their recycling efforts by placing all acceptable items into one container. Because it is larger, the new program allows for larger bulkier recyclables that may be difficult to break down such as cardboard boxes and plastic laundry bottles. In case, residents aren’t sure what can go in the cart, there’s a permanently affixed description of acceptable items on board. Among the acceptable items: newspapers, inserts, catalogs, magazines, junk mail, office paper, soft-covered books, file folders, soda

cartons and crushed boxes from items such as cereal, tissues, rice and pasta packaging; plastic containers with ID #1-#7 – usually found on the bottom of these containers; such as bottles, milk, water, detergent and shampoo containers; glass food and beverage containers, milk/juice cartons and drink boxes; aluminum, steel or tin food and beverage containers; Cardboard - from non-food items such as shipping boxes. The new program will not create any changes in the collection schedule. Residents who’d like to get rid of their old bins can simply place them outside at the curb on the next scheduled collection day, between August 8 and August 14. There will also be an opportunity to get either larger or smaller wheeled bins, once everyone has had a 90-day opportunity to try the cart that was delivered. Beginning November 1, Public Works will begin accepting requests for different size recycle carts, either 96 gallon or 48 gallon. Those requests will be provided while supplies last. Requests will be taken thru the Customer Service Help Line at 954-602HELP (4357) or at www.miramar602help.com. For further information, residents can call Ralph Trapani, the City’s Solid Waste Manager at 954-883-6832or email ratrapani@ci.miramar.fl.us

New Website Allows Business and Residents to Connect “For Good” By Julie Levin
T
hanks to an innovative new website ,
it is now possible to help those in our community, without ever leaving your computer. The Miramar Pembroke Pines Regional Chamber of Commerce recently installed its new “Chamber for Good” website, which links people and businesses directly to non-profit groups in our area that are in need. “It is an arm of the Chamber that deals with helping the community and the non-profits that are in our community,” said Robert Goltz, the President/ CEO of the Miramar Pembroke Pines Regional Chamber of Commerce. Created by an Arizona Chamber several years ago, the “Chamber for Good” website was launched in South Florida in March. Once online, visitors can read about a list of different causes in Miramar and Pembroke Pines, a bit about their history and their most pressing needs. More importantly, there are also ways to donate money, time or items to whichever group they are interested in. The site is a onestop visit that means less legwork for those looking for a place to donate, and speeds the process to get the help into our community. “You can put the money
where you want to put it. You can go where your heartstrings pull you,” said Goltz. The site also lets visitors connect with non-profits of their choice, so that the groups can contact potential donors when they are in need of specific skills or time. Both members and non-members are welcome to donate to the site, which will contain only non-profits that are 501c3 organizations that support Pembroke Pines or Miramar residents. Right now, Goltz says the website contains information about seven nonprofits, a number they are hoping to increase. “This goes a a long way to taking care of those in our backyard,” said Goltz. The Chamber is committed to continue to provide a variety of venues to assist the business owners of their region to become better businesses by becoming better business leaders. From its humble beginnings over thirty years ago the Miramar Pembroke Pines Regional Chamber of Commerce is thriving and is committed to helping our businesses thrive too! Registration Open for City’s Early Childhood Programs By Julie Levin
S
chool bells are going to start ringing all across South
Florida this month, and if you haven’t already found a place for your preschooler, the city is offering a range of options. Miramar’s Early Childhood Program is accepting fall enrollments for all of their award-winning programs, which includes opening for infants through the afterschool programs. Their program is offered at four locations, all of which provide the community with secure, supervised, learning and play for children. Their programs are licensed by the Bureau of Children and Family Services, Child Care Licensing and Enforcement Division and is a proud recipient of the Gold Seal of Excellence for providing quality childcare. Other benefits include free formula and food for infants and free breakfast, lunch and afternoon snack for all other ages and they do accept Family Central. Enrollment is also open for their VPK, or Voluntary PreKindergarten, programs. The free VPK program includes breakfast and lunch. Extended hours are available. As of mid-July, space was available in all programs, but organizers say parents shouldn’t wait. “Both programs do fill up fast, so parents are urged to call the locations closest to them,” said Joyce Donaldson, an Operations Manager with the City. Program locations include: ▸▸ Vicki Coceano Youth Center 2001 Douglas Road 954-602-4970 ▸▸ Miramar Civic Center 6920 SW 35th Street 954-963-6683 ▸▸ Sunset Lakes 2801 SW 186th Avenue 954-602-3360 ▸▸ Silver Shores 15700 Pembroke Road 954-442-4030

With the exception of the Miramar Civic Center, the same locations are also accepting applications for their afterschool programs. The afterschool program includes pick up of your child from the nearest elementary school (the Vicki Coceano Youth Center offers bus transportation from Sea Castle Elementary, Sunset Lakes offers pick-up from Sunset Lakes Elementary and Silver Shores picks up from Silver Shores Elementary). Homework assistance, games and activities, early release days and an afternoon snack are also provided. Parents, call the center nearest you.

Fairy Tales and Fables Come Alive at the Miramar Library By Julie Levin
T
hrough a fun , high - energy performance , a school teacher
turned storyteller helped to bring several children’s books to life at the Miramar Branch Library recently. Several dozen parents and kids came out to the library June 6 to be entertained by Windell Campbell. Campbell’s unique show incorporated the art of puppetry with storytelling. The longtime Tampa-area school teacher brings to life folk, fairy tales and fables to young audience around the state. “I saw a story teller a while back, and it inspired me,” Campbell said. Campbell works to create a unique partnership with his young audiences, by making them an interactive part of his memorable tales. Lizett Correa’s 14-month old daughter Lily got to sit on stage with her dad, and pretend to moo whenever a cow was mentioned in one of the stories. Correa says summer library programs like Storytelling with Windell Campbell have provided great entertainment for her daughter this summer. “They are free and great for the kids, she has already learned so much from it,” said Correa. For more information, visit www.windellcampbellstoryteller.com Olivia and Riley Ney joined Campbell on the stage for part of the show

There were also vendors selling clothing, jewelry and other novelties. “The event highlights the diversity of our great City by providing an opportunity for all to see the many facets of our Caribbean community,” said Vice Mayor Alexandra P. KLA School of Pembroke Pines Offers a High Quality Educational Program By Debby Teich
T
he KLA School of Pembroke Pines is more than a childcare
learning center. It is a place where children’s abilities, competences, and natural aptitudes are nurtured in ways that develop new and inherent talents. It offers a high quality educational program combined with a modern, clean, and vibrant environment. Managing Directors Cristina Muci and Patricia Monaco answered some commonly asked questions about the school.
How long has KLA been open? We opened the KLA School of
Pembroke Pines two years ago, as a result of the success in our preschools in other areas, as well as the increasing demand for high quality, preschool education.
What is the school’s philosophy? We are inspired by the Reggio Emilia Approach to early childhood education. This Italian philosophy is based on the belief that children are capable and curious, and that this natural curiosity guides them in their process of learning. Teachers become co-learners with the children and their role is one of collaboration and of observation. We regard parents and families as the children’s first teacher and the environment as a third teacher. What ages do you serve? We
offer programs for children ages 3 months (Baby Nido class) to four years old. The 4’s class also includes students who are actually 5 years old and whose birthdays are after the September 1st cut-off.
Are the owners active at the school? Yes. The own-
ers actively participate in the school’s daily operations. Our main objective is to guarantee our families that their children are safe, happy, and that they are learning.
Describe the team. Our
pedagogical and administrative team is highly motivated and focused on achieving the goals that we have established as an organization. They are also passionate about the Reggio Emilia approach and about early childhood education. This dedication and passion is apparent in every aspect of our school’s life. They are constantly exchanging ideas and collaborating with each other. They become co-learners with the children and educational partners with their families.
Describe the facility. We have a lot of windows in the classrooms and common areas, which allow crisp natural light to enter throughout the day. There is a Piazza, or central area, for encounters and communication. It is a place for children to participate in the elements of provocations that we set up for them. This space also serves as an introduction into what takes place in other areas of our school. What is Baby Nido? The word “Nido” means “nest” in Italian. Our Baby
18
August 2013 | miramar town times
Nido program caters to the needs of children from 3 months through 12 months old.
Describe the 2’s, 3’s and 4’s classes. All of our pro-
grams cater to the needs of children in accordance to their ages. The teachers develop weekly projections for our programs. These projections are open ended, since our teachers are always gauging and analyzing what seems to interest the children. We help the children discover their aptitudes, skills, and talents through their own means and through their own experiences.
What is the Atelier? “Atelier”
is a French word which means “studio” or “workshop.” Our Atelier is an extension of each classroom. It is a place where the children and teachers are able to access materials that the children can find in their communities and at home. We want school to reflect their lives at home, in their community, and in the world in general.
Do you offer before and after care? We offer early
care, from 7am to 9am, and aftercare, from 3pm to 6pm. Some of our aftercare activities and enrichment programs include Spanish classes, ballet, gymnastics, and Baby Sensory. We are in the process of adding Mandarin classes, yoga, Zumbatomic and others.
Can students enroll all year long? Our enrollment is open all year long.
We work with families to offer them the support they need while their children are adapting and transitioning to their new environments and new friends.
Do you offer camp? Our summer camp consists of three sessions. The first two sessions are three weeks long and the third session is two weeks long. During summer camp, we offer children a myriad of fun and games, and joyful experiences. Do you have other locations? KLA Schools Corporation has four loca-
tions in the Miami area, including: Brickell, Aventura, Coral Gables, and Doral. It is also expanding into other states, such as California, Seattle, and Texas. KLA School of Pembroke Pines is located at 18055 NW 8th St., in the Pines Professional Campus. For information, visit www.klaschools.com or call 954-443-6168. I hope this letter finds you well and enjoying your summer with family and friends. In addition to my summer get away, I always manage to sneak in a little work. One of those work products is keeping track of where our City stands. According to the 2012 Census Estimate, our great City of Miramar stands at 128,729 residents! It is a great number that reflects the desirability people have to live here. But that number also has a down side in that we may have more people going hungry in our City and in Broward County.

One of the most alarming facts that came from the 2008 Recession, and continues still today, is the great increase in people going hungry, especially children. In fact, the summer break is a tough time for many children because the hot meal they get while in school is no longer there during the summer break. That hunger is not just limited to inner cities but surprisingly in the suburbs as well. Many of those single-family, two income homes suffered more hungry families than any other time in history. We all know the story of how it happened - one or both parents lost their jobs, a family member got sick, or work hours are lowered. Of the 128,729 residents in Miramar, approximately 37,331 are children under 18 years old. Of those, 37,331 children, one in four will go hungry every night. That’s 9,333 of our Miramar children. Our City and Broward County have operated food banks to help those in need, but we need your help. We as a community need to do our part. I implore you to please donate food to our City’s local pantry and Broward County’s local pantry. To contact Miramar’s Food Pantry, please call 954-889-2722. It is located in the Multi-Service Complex located at 6700 Miramar Parkway. Broward County’s local pantry is currently hosting a 365 Food Drive and can be contacted at publicinfo@ broward.org or you can drop-off your food donations at any of their drop off locations listed at http://www.broward.org/FoodDrive/Pages/FoodDrive.aspx. It is hard to imagine that in a country as advanced and plentiful as ours a child could go to bed hungry. Nevertheless, it is a reality that we must work together to change. Warmest Regards, ori C. Moseley L Mayor

o adolescent likes to be caught wearing
something that makes them different. For some teenagers, eyeglasses can often feel that way. Just the thought of wearing glasses can send a teenager running in the other direction. In comparison, a newly published report says that kids and teenagers who wear contact lenses feel a significant enhancement in their appearance. The research results show that starting at the age of eight, children may prefer being offered the choice of contact lenses. The research was recorded in Eye & Contact Lens, which is published by the Contact Lens Association. Just how do contacts enhance an adolescent’s self-esteem? Young adults are self-conscious and they often feel better about themselves when glasses are not the center of their appearance. Contact lenses may help teens feel greater selfesteem and more comfortable around others by providing them with a less visible option for vision correction.

Although teens are frequently fitted with contact lenses, children under 13 are not usually given the option of lenses. Many eye doctors and parents don’t believe that children are mature enough to deal with them properly. With the right instruction, however, children as young as eight years old are very capable of wearing and caring for contacts and they should be offered the option. Generally, before your child purchases contacts, you should consult your optometrist to find out about any potential issues your child might have. Our Miramar optometry practice can help you determine the right prescription for your teen’s contacts. If your child or teenager is in need of vision correction, why not consider contact lenses? Through just a simple soft lens, you can enhance your teen’s self-image. With the large array of contacts on the market, you and your eye care practitioner can work with your child to decide what type of lens is most suitable for their character and lifestyle. For further assistance with your summer eye care and eyewear needs, contact Dr. Michael Chesen at 954-437-9733. Pearle Vision is located at 2909 Dykes Rd., in the Fountains of Miramar Shopping Plaza.

ne of the most difficult things that
Orthopedic Surgeons have to deal with is what to do with the knee that has irreversible cartilage damage. The knee joint, specifically the undersurface of the patella, the end of the femur and the top of the tibia are covered by a substance we call articular cartilage. This looks and functions like the carpet that is covering the floor in your house. It is a smooth cushioned surface that helps the knee joint move in a frictionless environment. Without healthy articular cartilage the knee joint can not function properly. Exposed bone in the knee joint by deficient, inefficient cartilage leads to arthritis, pain and disability. Patients present to the office stating that they injured the knee joint. They complain of swelling, pain going up and down stairs, getting out of the car, changing directions, unable to run or jog without pain. The injury is usually after an event that the patient can recall without any problems. The Orthopedic Surgeon gets some simple X-Rays in the office Transplant Of Cartilage and usually they are normal. You see, articular cartilage does not show up in X-rays. After a thorough physical exam the initial treatment usually consists of ice, rest, anti-inflammatory medications and physical therapy. However, if the initial physical exam demonstrates severe findings or the symptoms persist or they do not resolve, then the patient will need to get an MRI Scan to check for articular cartilage problems. The MRI Articular Cartilage Damage Scan is the diagnostic study of choice in the detection of articular cartilage damage (botton photo), meniscus tears and ligament injuries. If the patient has an articular cartilage defect (bottom photo) this is considered to be a permanent problem for the knee joint. This leads to abnormal friction forces, inflammation, pain and eventual destruction of the rest of the knee joint. Classically, patients who continued to have problems eventually developed arthritis and required a total knee replacement. Today, with advances in science, we can offer patients alternatives to try to salvage the knee joint. This consists of procedures that can be done through small incisions in the knee joint (Arthroscopic Surgery). The arthroscope is the instrument that has allowed us to manage this issue through small incisions. We can do a chondroplasty with shaving, chondroplasty micro fracture or bone drilling or bone picking. The chondroplasty is stimulating your cartilage, stimulating your body to make new cartilage in the defective area. The recovery from this type of surgery usually requires the patient to use crutches for one month and in most cases the patient returns to full unrestricted sports activities in six to nine months from the day of the surgery. Other patients can have a transplant of cartilage (top photo). This is usually reserved for those patients who failed to heal with the chondroplasty and have a focal well circumscribe defect in the articular cartilage. The surgery is also done through mini incisions, usually two or three. The rehabilitation consists of crutches for four to six weeks and range of motion exercises. After this healing period, the patient returns to activities of daily living and finally to sports within six to nine months from the day of the surgery. Dr. Moya is a Board Certified Orthopaedic Surgeon specializing in knee and shoulder surgery. He completed his doctoral fellowship at Harvard University, receiving his medical degree from the University of Medicine and Dentistry of New Jersey (Robert Wood Johnson Medical School). Dr. Moya completed his orthopaedic residency at the University of Puerto Rico. He practices at the South Florida Institute of Sports Medicine located in Weston at 1600 Town Center Blvd., Suite C, (954) 389-5900, and in Pembroke Pines at 17842 NW 2nd Street, (954) 430-9901.

iabetes is a disease which affects millions of
people. The body does not produce insulin, which is needed for sugar to be absorbed by tissues and organs. If sugar is not absorbed by tissues, it can circulate in the blood and lead to many problems like blindness, heart disease, kidney disease and various foot disorders. Ordinary problems can quickly escalate to serious complications when a person has diabetes. Problems most often occur when blood flow is poor or when there is nerve damage in the legs and feet. The American Diabetes Association has estimated that about one in five people with diabetes will end up in the hospital for foot problems. The most common ways that diabetes can affect your feet include: nerve damage, poor circulation, and wounds and ulcerations. Nerve damage is also called “neuropathy.” Nerve damage causes a person to feel no pain. While this may sound like a good thing, it most certainly is not. Pain protects us. With neuropathy in your feet, you will not be able to adequately sense the temperature of objects. You could step on something hot and seriously burn yourself and not know it. Also, you may not feel it when you step on a foreign object. If you stub your toe or step on glass or a nail or other sharp object, you will not be able to sense the injury. Unfortunately, I have seen many diabetic patients who have had foreign objects in their feet and have not become aware of it until they see a red and swollen foot which is filled with infection. Poor circulation is also known as “peripheral vascular disease.” Diabetes affects the blood vessels and the diseased blood vessels cannot get enough blood flow to the feet. Often, diabetics complain of pain in their calves when they walk. This can be a sign of poor circulation. Also, pain in the legs while sleeping is a common complaint. People with poor circulation notice an increase in redness as well as dryness and coolness in their feet when touched. They also experience a difficult time healing when a sore or open wound occurs. Ulcerations are a fancy term for open breaks in the skin. These breaks in the skin are deceiving and dangerous for diabetics, because a tiny blister can turn into a large open wound if not cared for properly. In addition, a wound on the foot is challenging, because most people are forced to walk directly on the wound making healing difficult, and many with neuropathy cannot feel it. Early diagnosis and intervention can keep the wound from worsening. People ask me all the time: “how can I take better care of my diabetic feet?” The first thing I tell my patients is to stop smoking. Smoking can lead to a host of problems including poor circulation to the feet. Diabetics should see their podiatric physician on a regular basis. Cuts or breaks in the skin or an ingrown nail may seem like small problems, but they can become very serious, very fast for the diabetic. You should tell the doctor about any changes in your foot, such as changes in color, shape or sensitivity. Your podiatrist should inspect your feet carefully at every visit. Your doctor should also check your feet for changes in blood vessel, muscle or nerve problems. People with diabetes must be extra vigilant when caring for their feet. In addition to seeing their podiatrist regularly, they should check their feet daily and carefully by looking between the toes, at the toe webs, and on the bottoms of their feet. Above all, never walk barefoot and see your doctor at the first sign of infection or inflammation. Dr. Neal M. Bullock’s office is located at 17013 Pines Boulevard, in Pembroke Pines. It’s Hurricane Season: Are You Prepared? By Matt Chrupcala
F
rom J une through N ovember , hurricanes are
at their peak. During a hurricane, heavy rains and catastrophic winds barrel through coastal areas and can severely damage or destroy homes and businesses. To help you plan and remain safe during these potentially deadly storms, we’ve gathered the following safety tips for you and your family:
Staying Safe in the Storm During Hurricane Season: ▸▸ Plan evacuation routes and designate a “post-disaster contact person” that family members know to call once the storm is over. ▸▸ Stock up on items such as bottled water, canned goods, manual can/bottle opener, flashlights, battery-operated radio, nails, tarps and plywood. ▸▸ Keep an up-to-date log of all of your possessions with photographs and videos, and review your home insurance policy. ▸▸ Trim your trees and shrubs to minimize damage.

When There Is a Hurricane Threat: ▸▸ Refill your prescriptions, fill-up your car with gas and withdraw a week’s worth of cash since power outages may interrupt these services temporarily. ▸▸ Place important and valuable papers, such as your log of possessions, in waterproof bags. ▸▸ Cover windows and doors and secure outdoor furniture. ▸▸ If you live in a trailer home and are told to evacuate, do so immediately. During a Hurricane: ▸▸ Listen to your battery-operated radio for instructions from the local authorities on evacuation and safety guidelines. ▸▸ Seek shelter in an interior room away from windows, such as a closet. If you hear the winds subside, do not assume that the storm is over. The calm may be the eye of the storm, in which the worst part is yet to come. ▸▸ If the electricity goes out, use a flashlight to see; do not use candles. After a Hurricane: ▸▸ Stay inside until notice has been issued. If you were told to evacuate, do not return home until you have been given permission by the authorities. ▸▸ When inspecting your home for damage, wear sturdy shoes and clothing as protection. ▸▸ Contact a trained expert to turn off damaged utilities and appliances instead of trying to do it yourself. ▸▸ Drink only bottled water until tap water is deemed safe. Planning is important when it comes to hurricanes, and that includes having the proper home insurance. Contact INEX Risk Services of Florida, LLC at (954) 251-3673 or mchrupcala@inexrisk.com to learn more about all our insurance and risk management solutions.

Legally Speaking
What Homeowners Need to Know about Florida’s New Speedy Foreclosure Law By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney
A
fter a two year effort, Florida legislators approved a new
foreclosure law that significantly affects the rights of homeowners struggling to pay their mortgages. Under the veil of “helping Florida’s economic recovery,” Governor Rick Scott signed House Bill 87 into law on June 7, 2013. Unless this new law is overturned by the courts, it is expected to have a profound impact on the foreclosure process in favor of the banks and homeowners’ associations. The new law permits a lender or its servicer to file a foreclosure action and instead of being required to prove its right to foreclose, it unfairly shifts the burden on the homeowner to “prove” that the lender “does not have the right” to foreclose. This new procedure is time sensitive, and if the homeowner does not provide the necessary evidence, a final judgment of foreclosure is entered. In as quickly as 45 days, the property could be sold at a foreclosure auction. The new law also provides homeowners’ associations with same expanded rights to quickly evict non-paying homeowners through this new expedited foreclosure process.
For homeowners that are behind on their mortgage or HOA payments (but not yet in foreclosure), it is imperative that you immediately consult with a legal professional about your case. There are a number of “pre-foreclosure” steps that must be taken in order to defend yourself and your family from this new speedy foreclosure law. Remember that you will only have a limited amount of time (20 days) to prove that the party suing for foreclosure does not have the legal right to do so. This means that the evidence needs to be gathered before the foreclosure process starts, and there are critical requests for information that must be presented to lenders prior to a foreclosure to avoid losing your home. The new speedy foreclosure law also states that if your house is foreclosed on fraudulently, you cannot get it back. You will only be entitled to file an action for damages against the lender or other party that obtained the wrongful foreclosure. We all know that in foreclosure cases there are a disturbing number of mistakes being made by banks and their attorneys. For those homeowners currently in foreclosure, it is critically important that any mistakes in the process be identified and brought to the attention of the court BEFORE a final judgment. In short, this new speedy foreclosure law is wrong, and it clearly violates the due process rights of the good citizens of Florida. It will force many more homeowners into bankruptcy as the only reliable means of saving their home. More detailed explanations of different options available to homeowners in foreclosure, at risk of foreclosure, or considering bankruptcy are discussed in a new consumer-friendly DVD developed by the Arcia Law Firm entitled “Fight For Your Home,” available for purchase on our website. If you mention that you heard about the DVD through this magazine, you will receive a FREE copy during the appointment to discuss your case in detail with a member of our qualified legal team.
