o, the Holiday Season is here! 2013 is basically over; Christmas and New Year’s are upon us; and then we head straight into 2014. I hope that you have had a great year. With this issue in your hands now, it completes Tow Professional’s second full year being published. 2013 has been a good year for us; we have kept our blinders on while looking straight ahead focusing on our goal. The goal is simply this: do what we told our advertisers and audience we would do by bringing a B2B magazine to the market that has good business editorial and editorial about their products. The benefits are countless if you just do what you tell somebody you will do. We just returned from the Baltimore Tow Show. This is the largest trade show in our industry, and it was well attended this year, as always. At this show, we earned the business of Jerr-Dan, and we are very proud to partner with them in marketing. We consider all of our customers “partners” and treat them as such. Without the success of each of them, there is no success for us. As we go into the holidays, let’s remember that Jesus is the reason for the season. When you see the many slogans around you, slow down and think about the real meaning of what is being said: "Peace on earth, good will to men," “Joy to the world," "Hark, the herald Angels sing," "'round yon virgin, mother and Child." The California Tow Truck Association (CTTA) has just completed another Western States Tow Show in beautiful San Diego. We are so excited to be working with the other associations on the west coast, and the show is a great opportunity to have fun with events and competitions, rekindle friendships, and learn about the newest equipment and processes for our industry. The core of the CTTA is education for our industry, and we did our best to represent this, with a full two-day Level 1 Light Duty course and the introductory one-day Level 2 Science of Towing course being taught. In addition to our courses, we had 18 seminars presented by our vendors on various aspects of towing, business operations including HR and legal issues, and fleet maintenance. Allstate provided a great event with towing procedures for specialty vehicles, and we offered 7 Microsoft computer courses to help with managing your business. We were pleased to have a breakfast Meet & Greet session with 6

our new Towing and Recovery Oversight Council, our vision for working for legislation to improve our industry. This has been a tremendous success; immediately embraced by the California Highway Patrol, we are already gaining recognition from our legislative contacts, Department of Motor Vehicles, and other regulatory agencies in the state. We also did a mini-conference with other state associations and had a couple of great sessions sharing information, successes, and challenges that we face. Some are unique, but often one of us has faced it in their area, so we can truly support each other. Miller Industries again provided lots of excitement, from an outdoor scaling demo showing the proper lifting and capacity of vehicles to an outstanding Friday night social event combined with a Recovery Theater presentation under the stars. (Of course, the kids had their own version with a showing of Disney’s “Cars.”) Friday, the racers had fun as they brought out John Force & Robert Hight for autographs and a look at John’s Funny Car. Never to be topped is the amazing hospitality at the Town & Country Resort. One visit to a restaurant and they’ve got your preferences memorized. Always a smile from the staff, and I haven’t seen that much cleaning since I moved out from my mom’s. For our Show and Shine competition and renewed interest from the surrounding states, we brought in a pair of independent auto show judges to ensure impartial judging. We had entrants from as far away as Oregon and Idaho, with vehicles ranging from current year to 1946 classics. It was great fun to see families out there cleaning and prepping their entries, and the excitement on the faces of the winners at the awards ceremony. Just imagine the work sorting and prepping your toolboxes to win the “Best Organized” after a 1,000-mile drive over the Sierra Mountains to the show. Of course, our team is already working on next year’s show, so I can’t wait to see what will top this year. Thanks to all the vendors and attendees. Upon entry into the Baltimore Tow Show, the Jerr-Dan 50/60 Ton Incident Management Body Rotator instantly caught my attention. The first words that came to mind were, “Oh my goodness, WOW!” There was a constant buzz around the truck - people pointing and smiling as they asked the Jerr-Dan personnel one question after the other, to which the knowledgeable staff were happy to answer. New Florida Legislation Benefits Tow Industry, Strengthens NMVTIS Database

A 2013 Florida law that affected state towing procedures has resulted expedited notification of out-of-state owners and lien holders and had a positive impact on the National Motor Vehicle Title Information System (NMVTIS). Effective July 1, Florida law requires a search of the NMVTIS database as part of the towing "good faith" search procedures for out-of-state vehicles, and adds reporting requirements for the salvage and towing industry. Auto Data Direct (ADD), an approved NMVTIS inquiry provider, saw an immediate impact when the law went into effect. “From June to July we saw a 65% increase in the number of Florida towing companies accessing NMVTIS records,” said Auto Data Direct (ADD) President Jim Taylor. “In that same period we saw a 48% increase in salvage vehicle records reported from towing companies.” Florida towing facility operators can now search for vehicle's current state of title online, through NMVTIS, and then request ownership information for non-Florida vehicles from the state identified. Web-based NMVTIS inquiries significantly speeds up the search process and reduces the number of good faith notices sent to law enforcement agencies. The same legislation also requires tow operators report information about salvage vehicles they handle to NMVTIS prior to applying for a Certificate of Destruction and provide proof of reporting at the time of application. The reporting requirements strengthen state titling procedures and provide an additional consumer protection benefit. Habits of Highly Happy Towers

There are certain towers who seem to maintain their joyful state and their love for life – no matter what. You and I probably could agree that some of the towers are definitely “highly happy” towers. It turns out that joyful people tend to have a few habits that help them get the most from life and keep them looking on the brighter side of things. So, if you want to infuse more happiness into your life, right now, make these 10 habits as part of your daily routine.

Habit #1 – Appreciate life Develop an attitude of gratitude and count your blessings. When you start looking for things to be thankful for, you’ll discover more reasons to be grateful. Me, I have bad legs, but I at least have legs. Ads from the Wounded

Warrior Fund remind me just how bad it would be to have a missing limb. These wounded warriors have to retool themselves and learn to embrace Habit #2.

Habit #2 – Keep learning Invest time and energy into continually learn-

ing and developing new skills. Keep your brain stimulated with exciting information and hobbies. Take a “wreckmaster” class and improve your skills. Get certified!


Habit #3 – Laughter Don’t take life too seriously! Laugh at yourself – and OFTEN. Make light of your circumstances and infuse fun into daily activities. Frequently in my classes, I’ll remind the group that it takes 7 muscles to smile and 28 to frown. Don’t let your face be caught working overtime. Laughter will allow you to benefit from the habit of forgiveness.

Habit #4 – Forgiveness Holding onto anger, resentment or jealousy will only hurt you. Learn to forgive others and yourself for mistakes. Let it go and move on. Towers sometimes want to get even. It’s tempting when things don’t go as they should, but let it go. Forget about it and move on.

Habit #5 – Meditation or prayer More and more research is showing that prayer and meditation has major benefits for health and well-being. They increase positive emotions, life satisfaction and the immune system function. Spending time with nature, expanding your spiritual self through reading

good books, prayer or meditation and just going to church, will help. Take my word for it.

Habit # 9 – Surround yourself with those people who take you higher

Habit #6 – Love

Surround yourself with happy, positive people who truly want the best for you and people who will support you on your journey to success.

Nurture your relationships with family and friends and make it a priority to spend quality time with your loved ones. Be a supportive ear during good and bad times. My parents and all five of my brothers are already fellowshipping with the Lord. I still wish they were here, but I know I’ll send them again one day. Tell your family that you love them before it is too late.

Habit #7 – Stop comparing Happy towers don’t waste their time worrying about what others think or are doing. Happy towers don’t gossip. Let go of the need to judge and criticize others. Instead, concentrate on creating and living your life.

Habit #8 – Be positive Make a determined effort to see the glass half filled instead of half empty. Always look for the silver lining in any situation. If you notice a negative thought creeping into your mind, counteract it with a powerful, positive affirmation.

Habit #10 – Be a thinker I want people to think “outside-the-box.” Spend time each day reflecting on how you can make things better. Ponder this question everyday: “How can I leave earth a better place than how I’ve found it?” Next time I see you, I would love to hear how many of the habits you’ve been able to implement since our last meeting. BOTTOM LINE Another year is rapidly approaching, and we, as business owners, will have a whole new set of challenges facing us. I would never have guessed that healthcare would be such a big challenge. Up until now, most of the small business never had to offer any type of healthcare to its employees. If we did, the employee would have to pay a portion of it. When I ran my business, for the longest time I never offered any type of healthcare benefits. As I built my business, I wanted to give my employees the opportunity to have healthcare benefits, so I offered them a policy where they would pay a part of it and I would pay a part of it. Out of 36 employees, only 5 wanted the benefit. They had other means for healthcare if the need should arise. Now the government is making it mandatory that each employee have insurance. They say the payments can be as low as $40 a 16

month. That is fun money for most of my employees, and they will be mad when they have to make that payment. Let’s try and take a look at what we will be facing in the future. The following is just an interpretation of what is in the bill. If you are following the news, you know the bill is changing all the time.

Who has to cover their workers? The issue that most people know about is the “employer mandate,” a loose term for a set of fines for businesses that don’t cover their workers. That’s a big issue for small businesses that might be right on the edge of 50 workers. Starting in 2015, any employer with the equivalent of 50 or more full-time workers will have to pay a $2,000 annual fine for each worker, not counting the first 30, if they don’t offer health coverage.


And if they do offer health coverage, it has to meet the law’s “affordability test.” A worker shouldn’t have to pay more than 9.5 percent of his or her income for self-only coverage, and the plan shouldn’t cover less than 60 percent of the costs. If the coverage fails either of those tests, the employer will have to pay a $3,000 annual fine for each worker that goes to a health exchange for coverage and gets a subsidy for it. The catch, though, is that it’s not just businesses with 50 actual full-time workers. It also applies to any business that has the equivalent of 50 full-time workers. In other words, when they add in their part-time or seasonal employees, their hours will add up to at least a few more full-time people. Who counts as a full-timer? Anyone who works at least 30 hours. That’s one of the biggest complaints restaurants and retailers have about the law’ 30 hours just isn’t a standard anyone uses, but it’s in the law now. A lot of business are trying to figure out how they can get their employees to less than 30 hours a week. Some employers are making everyone part-time and cutting their hours. When your employees get mad because of the cut in hours, the service you provide will definitely change and your customers will suffer for the changes. I can see some businesses raising their price to offset this expense. Obama administration officials say 96 percent of businesses in the United States are too small to be hit by the coverage requirements, and of the ones that are big enough to fall under the mandate, more than 90 percent already offer health coverage.

In 2011, as a result of the new law, a business will have to report the value of an employee’s healthcare coverage on W-2 forms. Many companies provide coverage for employee dependents not enrolled in other employer-based health plans up to age 22 or 23; next year, that age limit will rise to 26. All lifetime caps on insurance policies offered through employer-sponsored plans will be eliminated in 2011. Penalties will increase for the misuse of HSA funds, and workers with FSAs and HSAs will not be reimbursed for money used for over-thecounter drug purchases.

The Affordable Healthcare Bill will mean: Outrageous Costs At a time of exploding federal spending and budget deficits, both the House and Senate bills would add far more than a trillion dollars to the mind-boggling financial liabilities we taxpayers already face. Even the stated price tags of these bills are fraudulent products of statistical manipulations. One way they try to reduce costs is to remove a quarter of a trillion dollars in doctor Medicare reimbursements from the bills. Another way they try to balance the books is to impose years of tax increases to fund these bills, before the outrageous spending actually kicks in. When it does, the “cost curve” in later decades will soar upward, and deficits will pile up by the billions. In addition, the bills would vastly expand the already-bankrupt Medicare program. Keep

Soaring Taxes This bill contains taxes that will hit your employees and the owners of small businesses who are counted on to create jobs. Doctors will also take the hit, as they will get millions of new patients paying a very low rate. The legislation also proposes hefty taxes on better private-insurance plans, which would penalize and undermine existing employer-employee benefits packages. These are just a few of the many new taxes and fees the bills would impose on us.

The affordable healthcare program will create a gigantic new federal entitlement program that would add millions of new, taxpayer-subsidized claimants for health-insurance coverage. Then it would force insurers to accept all comers—regardless of any actuarial risk factors— and to provide them coverage that is far beyond what many people actually require. On the other side of the equation, the affordable healthcare program will increase taxes on those private insurers, expecting them somehow to pay all the new benefits. It will also increase taxes and fees on


hospitals, doctors, pharmaceutical manufacturers, and the inventors of new medical devices—thus punishing those who create and provide medical treatments. Inevitably, this will deter many of them from developing or offering vital new medical treatments for patients, and it will even force some of them out of business.

I’m not choosing political sides here. I’m on Medicare, so this doesn’t affect me. My wife has a preexisting problem, so she will benefit from the bill if she can find an insurance company to take her. This article is intended in making you think about some new problems you will be facing next year. I have talked to a lot of towers who are ready to just get out of the business. TOW

Lost Individual Choice All the talk of adding “choice and competition” to the health-insurance market is a complete fraud. The bills do not free individuals to buy insurance across state lines —“choice and competition” that would actually reduce the cost of insurance. Instead, the bills propose a host of new mandates on private individuals, employers, and private insurers. Under penalty of fines or jail, individuals will be forced to buy costly coverage, and employers will be forced to provide it. Compliance with all these ever-expanding governmental edicts will drive up the costs for physicians, hospitals, medicines, treatments, and private insurance premiums. Skyrocketing costs will force more and more people into the “public option

Broken Promises The pending legislation will not cover all the uninsured; it will not add to freedom of choice for consumers; it will not be “deficitneutral;” it will not “bend the cost curve downward;” it will not prevent illegal aliens from receiving taxpayer-subsidized medical care; it will not prevent government payments from funding controversial procedures such as abortions; and it will not allow people to “keep their current coverage.” The cost to implement an affordable health care program is estimated from $940 billion to $1.76 trillion. Since the government has no money of its own, it must take close to a trillion dollars more from taxpayers in order to afford the first 10 years. Every year after 2021 will cost more than a quarter trillion dollars based on today's estimates. These numbers will only get worse in time because moral hazard will necessarily cause the amount of claims to rise relative to the cost. Even more shocking is the increase in power of the federal government through this legislation. Remember the government will use the IRS to monitor the activity of this new legislation. That means if your company is not implementing this new coverage, you could get a call from the IRS. Think about your business as you run it today. By Dan Watson this issue of Lube Talk, I will respond to the numerous questions I receive from month to month about gear lubes. From the questions I receive, I realize that folks are not really sure what gear lubes are or exactly why they are different from motor oils. I want to briefly introduce gear lubes and discuss their classification system. Then, we will look at proper applications for gear lubes. First, a little knowledge of gears is important in order to understand the function of gear lubes (please refer to Figure One for this discussion). Gears transmit motion and power from one rotating shaft to another rotating shaft, providing multiple applications of power transmission. There are several types and various geometric shapes for gears, but I will only address automotive applications. In Figure One, spur gears, bevel gears and hypoid gears are displayed; sun and planetary gears will be discussed with automatic transmission systems. Spur gears are simple gears with easily meshing gear teeth that transfer power between parallel shafts. Bevel gears allow intersecting shafts to transmit power. Hypoid gears facilitate the transfer of power between non-intersecting shafts at right angles. The important concept to grasp in these gear sets is the action of contact and sliding motion. The spur and bevel gears are engaging and rolling in motion, whereas the pinion and ring in the hypoid gears are contacting and sliding. This sliding action allows the Hypoid gears to transmit greater power (the force is distributed over the sliding area), providing for smaller differentials in auto and truck applications.

Design and Function of Petroleum/Synthetic Gear Oil With this summary introduction to gears, we can now go forward with the design and function of gear lubes. Gear lubes must achieve the following: •

Provide for proper shifting in manual transmissions at all temperatures

Maintain fluid separation of moving metal surfaces

Reduce friction and wear

Lubricate associated bearings

Prevent scoring of highly stressed gears

Provide fluid flow in cold temperatures

Remove heat during operation to maintain safe temperatures

Demulsify (separate from water)

Prevent rust and corrosion

Resist foaming and dissipate entrained air bubbles

Be compatible with all seals

Gear lube is a complex product accomplishing a multitude of functions, and if any of these functions are ignored, it can result in damage to the components.

Lube tAlk Classification of Petroleum and Synthetic Gear Oil The American Petroleum Institute (API) establishes the service classifications for transportation gear lubes as follows: • GL-1 through GL-3 designates gear lubes for light loads on spiral and bevel gears. This classification is usually satisfied by motor oil. • GL-4 designates the type of service characteristics of gears, particularly hypoid, in passenger cars and other automotive equipment operated under high speed/ low torque and low speed/high torque conditions. • GL-5 designates the type of service characteristics of gears, particularly hypoid, in passenger cars and other automotive equipment operated under high speed/shock load, high speed/low torque, and low speed/high torque conditions. The Society of Automotive Engineers (SAE) establishes the system to classify gear lubes by viscosity grades. The exact values for the viscosity grades are beyond the scope of this article; however, understanding the designation is important. Gear Lubes use a designation such as 75W-90 to indicate the viscosity grade. The 75W is the winter rating, and it establishes the cold weather performance of the

lubricant. The 90 is the operational viscosity (measured at 210ºF). The lower the W number, the better the lube oil functions in cold weather. The higher the second number, the more viscous (thicker) the oil. Manufacturers stipulate the required GL and SAE classifications for a particular gear set. The recommendation is based on the geometry (spur, bevel, hypoid etc.), as well as on the load and environmental conditions. Automotive applications usually come down to transmissions and differentials. Materials used in the construction of the components like transmission synchronizers can require different types of additives in the gear lubes. Gear Lubes are formulated by selecting base oils from petroleum or, in the case of synthetic gear oil lubes, synthetic oils and then adding in specific chemicals to achieve the rated classification. The additives consist of anti-wear, anti-foaming, anti-oxidation, demulsifiers, corrosion inhibitors, friction modifiers, viscosity improvers and extreme pressure additives and specialty additives where required. The specific formulations are determined by the manufacturer, and all gear lubes are not created equal. OEMs (Original Equipment Manufacturers) determine the required gear lubes for the gear sets in their manufactured products. You can find the specified gear lube listed in the owner’s manual,


and, in general, this is the gear lube you should use. Look for a viscosity rating, like 75W-90, and a classification, such as GL-4 or GL-5. A classic error made by consumers is to buy thicker gear lube in order to get “better” protection. While there are times when using a 75W-140 or 75W-110 instead of the specified 75W-90 is appropriate, such a change should only be made on the advice of a lubrication professional. The failure rate for gears is very low, but the failure rate for bearings is not so low. Bearings are better lubricated by thinner oils, so the change to a thicker lube in the gears increases the likelihood of bearing failures. Towing is a heavy duty use of the vehicle, and, depending on the combined gross vehicle weight (including trailer), it may be prudent to use a heavier weight gear lube. The action of shifting transmission gears can hammer the gears in the differential when pulling heavy loads. Thicker gear lubes provide better shock absorption at the gear face and prevent spooning or cupping gear teeth. Some gear lube manufacturers have started to offer 75W-110 in order to provide better protection when pulling heavy loads without sacrificing as much fuel efficiency as 75W-140. If you plan to use your vehicle for heavy towing, my advice is to not guess. Contact a lubrication specialist and get the recommendation that is right for your vehicle and your driving conditions. The transmission is nothing like the differential and rarely will GL5 gear lube be required. When there is a gear lube specification, it

will routinely be for GL-4. GL-4 gear lubes contain less extreme pressure (EP) additives and are suitable for brass alloys. Some transmissions use brass synchronizers and the sulfur-based EP additives can react with brass and destroy the synchronizers. A great many manual transmissions are now using automatic transmission fluid or motor oil. Others even use certain synchromesh fluids developed by the manufacturers. The best policy is to stick with the recommendations of the transmission manufacturer.

Petroleum or Synthetic Gear Oil? When selecting gear lubes for your vehicle, you will have to choose between petroleum and synthetic gear oil. There is no argument in the lubrication profession over this question; synthetic gear oil is overwhelmingly superior in every category measured. Large trucking companies, like UPS for instance, use nothing but synthetic gear oil for better fuel economy and to extend equipment life. “SO THAT’S WHY MY INSURANCE IS

SO HIGH! ecently we had an insured come into our office, and, upon noticing how nicely decorated our office is, he remarked, “So that’s why my insurance is so high!” What the insured did not know is that Cally Alexander has an eye for decorating. With a couple of gallons of paint, a few nice paintings strategically placed and, of course, an office full of women, she can turn a barn into a five-star hotel lobby. I took care of the insured’s issue at the time and then proceeded to explain the real reason as to “WHY” his insurance was so high. In the course of the past 15 years, I have seen many insureds make the same incorrect assumption: the “AGENT” is raising my insurance premium each year to pay for all this. It is neither the agent nor the agency that controls whether an insured’s rates increase, decrease or renew as expiring. Though insurance companies will have a state-approved base rate, there are many other factors that will affect the premium…some being location of the business, years in business, experience of the owners, age of the units, turnover in drivers, along with other factors. And, of course, one of the main reasons is “CLAIMS.” Just as “LOCATION, LOCATION, LOCATION” of a restaurant may make or break their success, “CLAIMS, CLAIMS, CLAIMS” often determines a towing company’s success and the premiums they pay. With a few extra steps, an insured can almost eliminate this issue as a reason for premium increase. Rarely will you find a “CLAIM FREE” business, but taking the time to follow the steps below may decrease the risk of claims, therefore potentially avoiding a non-renewal or massive increase in premium.

KNOW YOUR DRIVER BEFORE YOU HIRE When hiring drivers, many owners will have the prospect take a drug test, driving test and possibly a written test. What they fail to do is check the prospective driver’s driving record. As part of the insurance submission requirement, an agent will run the MVR (Motor Vehicle Record) on a prospective driver. The individual may have some infractions but still qualify per the insurance company’s guidelines. Due to the “Privacy 24

If you, as an employer, are truly interested in hiring an individual as a driver, consider asking the prospect to provide you with a copy of their MVR. For a small fee, anyone can obtain a copy of their MVR on the Internet from the Dept of Public Safety. This report will give you some indication if this individual has a need for speed, is careless in their driving, or is “Accident Prone.” If the driver has nothing to hide, and is serious about the job, this could be beneficial to both. Most drivers have experience with another towing company; ask for and always call their references. It’s possible they are looking to move to another towing company for a reason, one that could come with a cause for concern. Knowing who you are hiring could save you money down the road. TRAIN DON’T DRAIN Whether you hire someone that has experience or is a newbie to the towing industry, TRAIN them your way and to your standards. Don’t rely on what they learned from their prior employer, as it may not be the correct way, YOUR way. Remember, they represent your business, and what they do or don’t do could result in a claim. Most cargo claims are the result of a driver not following the correct procedure in loading, unloading or tying down a unit in tow. Worn equipment and a driver that takes shortcuts is a claim waiting to happen. A regular check of the equipment and the unit by a properly trained driver is essential in avoiding cargo claims. A driver that goes from Dr. Jekyll to Mr. Hyde behind a powerful wrecker is a danger to the community and your business, with a potential of causing high liability claims and pay outs. Have you seen a tow truck with a vehicle in tow try to beat a red light? What about the driver who just “tapped” the car in front of him yesterday, today and will probably do it again tomorrow? The next time it may be more than just a tap! What about the medium tow truck towing an 18 wheeler? Oops,

If an insured has several years of frequent claims or high monetary claim pay outs due to driver error, it could be a deciding factor in the premium. As a towing company, review your losses. Why are they happening? Is it a particular driver, a lack of following procedures, old or worn out equipment, etc.? Once you determine the reason, decide what needs to be done to avoid the issues in the future. Contact

your agent and together form a loss prevention plan in order to potentially prevent a claims related increase. With a plan in place, the statement, “So that’s why my insurance is so high” could be a phrase of the past. TOW

Training a driver properly and holding the driver accountable to your standards will keep you from draining your bank account with deductibles and higher insurance premiums. SINK OR SWIM…. The public will remember a towing company by the driver that performed their tow. A poorly trained or irresponsible driver could sink your business. A properly trained and responsible driver with a good attitude and a concern for others in their time of need could have your business swimming towards a prosperous future. Whom you choose to hire and how you choose to train can make a difference. Knowing how the driver’s actions can affect your insurance premiums is a beginning to understanding as to why your insurance premium may be so high. As mentioned earlier, most insurance companies start at a base rate and will then increase or decrease premium based on several factors. Though insurance premiums will almost always increase from year to year due to inflation or the cost of living, you can keep some of the cost down. Claims are going to happen, and when they do, your insurance company will be there to take care of you. Even when you, as an employer, are doing everything possible to avoid claims, there will be that one claim that was unavoidable. Most insurance companies understand this and will usually work with the agent in keeping the premium increase to a minimum. When your policy comes up for renewal and there is a pattern of frequent claims or same driver claims, it raises a red flag.
