Effective July 1, 2021, the possession of a limited quantity of marijuana in Virginia became legal. Virginians over 21 are now allowed to possess up to one ounce of marijuana, and to own up to 4 plants. Despite this limited right of possession, selling marijuana is currently scheduled to remain illegal until 2024. This delay will allow the establishment of the Virginia Cannabis Control Authority, an administrative agency modeled after the Alcohol Beverage Control Authority, which is “vested with control of the possession, sale, transportation, distribution, and delivery of retail marijuana and retail marijuana products in the Commonwealth, with plenary power to prescribe and enforce regulations and conditions under which retail marijuana and retail marijuana products are possessed, sold, transported, distributed, and delivered, so as to prevent any corrupt, incompetent, dishonest, or unprincipled practices and to promote the health, safety, welfare, convenience, and prosperity of the people of the Commonwealth.” 4.1-601, Code of Virginia 1950, CU COGPFGF |+V KU KORQTVCPV VQ TGOGODGT VJCV VJG WUG and possession of marijuana remain a federal crime. Plants grown in a residence may not be visible from any public way and must have a tag attached to each plant containing the owner’s name, driver’s license number and a statement that the plant is being grown for personal use only. Plant owners must also prevent access to the plants by anyone under twenty-one. The manufacture of marijuana concentrate from these plants is prohibited, and the owner of property may not knowingly allow anyone to manufacture marijuana concentrate on his or her property. area to avoid the inference of a violation of the law. Consumption in a public place or offering marijuana to another in a public place is also prohibited. The use of marijuana in the common areas of apartment communities therefore remains clearly illegal. Owners are faced with two problems caused by the new status of marijuana, however, one legal and the other practical. First, owners face serious consequences if they knowingly allow the manufacture of marijuana concentrate by their residents. Should you suspect this may be occurring on your property it is important to take appropriate action promptly. This is probably more likely to occur in a single-family dwelling than in an apartment, but language prohibiting this conduct should be included in your lease or a lease addendum. The practical problem could arise from residents who are heavy marijuana smokers, since the smell of the smoke is stronger than that of cigarettes. Excessive smoke could still be considered a nuisance if it disturbs the neighbors and could be addressed by a lease violation PQVKEG +P CFFKVKQP [QW CTG UVKNN CNNQYGF VQ RTQJKDKV any smoking or even the possession of marijuana on the premises. Once you have established your policy towards the use and possession of marijuana, make sure that you adopt a clear lease addendum around these issues and discuss your policy upfront with new applicants and tenants. Marijuana is once again on the agenda in the 2022 General Assembly session, and with the change in its makeup after the 2021 elections major changes could be enacted. Stay tuned for updates!

Potholes also expose property owners and managers to liability for personal injuries and vehicle damage that can result. The fact is that the asphalt on parking lots and roadways are the single largest capital expense for property managers and potholes are a recurring problem for all of us. We decided to learn more about what causes potholes, what can be done, and what are the modern best practices in the industry to address potholes and asphalt management.

WHAT CAUSES POTHOLES? Water and gravity are the main culprits behind most potholes. Gravity helps water from rain and melting Ã Ü Ì w ` Ìà Ü>Þ Li i>Ì Ì i >ë > Ì Ì iÀ `i Ì i earth at just the right spot, leaving a void and setting the stage for the asphalt above to crack or buckle. In cold weather areas, the water beneath the asphalt can freeze and expand, further deteriorating the condition of the asphalt and the earth beneath. It turns out that no potholes start out big. They all start out nice and small and then weather and continued use make it worse, allowing in more water, causing more erosion, further deteriorating the damaged area.

{do nothing} Some property managers elect to do nothing until the damage grows large enough to warrant hiring a paving company to repave the entire lot or to cut out and replace the damaged asphalt. Calling out a paving company to do anything generally requires large capital expenditures because they must send out a crew of 8-10 people along with millions of dollars worth of equipment. Such repairs are usually loud and disruptive, requiring property managers to give notice to tenants and close sections of the effected lot.

At a rate of about $40 a piece, maintenance crews typically apply a DIY cold patch (a cold bag of material you can buy at i i« Ì® Ì w « Ì iÃ Ì i À «>À } lots and roadways. The problem is that water continues to seep in and cause more erosion of the earth beneath, making such repairs temporary at best. The damaged asphalt will continue to deteriorate and get worse with weather and continued use.

INDUSTRY BEST PRACTICES Seeing as how parking lots and roadways represent such a huge capital investment for most all property managers, we wondered about modern approaches to asphalt management. A survey of various Departments of Transportation reveals consistent advice that property owners ought to be proactive when it comes to potholes, advising that if the damage is not properly corrected in a timely manner, the damages will get worse and may V>ÕÃi Ài « Ì iÃ Ì v À ° / i Ã> i / vwV > à express frustration that the public sector is still too reactive, consuming over 95% of their available budgets on reactive capital, locking them in a neverending cycle that does not allow them to proactively maintain their own pavement. If property managers can catch and properly repair minor asphalt damage early, this will greatly extend the life of the pavement. To be durable however, a cold patch just won’t work. Such repairs require a hot asphalt mix to enable a heat seal between the repair and the surrounding pavement so that water cannot seep through. Maintenance contracts are another trend in the industry. Property managers obtain maintenance contracts covering landscaping and other building ÃiÀÛ ViÃ] yiiÌà > ` Ûi V iÃ] > ` 6ÉƂ ÃÞÃÌi ð Why not for asphalt maintenance?
