Attention 4-H Members: Active or new members who purchase from the 2014 Harvest Sale—a heifer calf, yearling, or cow that delivers a heifer calf in 2015—will be eligible for a $75.00 rebate upon completion of the 2015 club achievement program, and completing the rebate form (available at the sale) as instructed. Terms & Conditions Terms: The terms of the sale are cash or cheque payable at par at sale location. All settlements must be made with the clerks of the sale before any cattle will be released. Credit arrangements: The sale committee request that potential buyers make credit arrangement with the individual seller prior to the sale. Bid: Every animal consigned to the sale must be sold by auction. No private sales will be allowed except as otherwise provided for in the terms and conditions. No by-bidding will be permitted. Each animal will be sold to the highest bidder. Disputes: In cases of disputes, bidding will be reopened between the parties involved. If no further bid is made, the buyer will be the person from whom the auctioneer accepted the last bid. The auctioneer’s decision in such matters shall be final. Purchaser’s risk: Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser’s risk for a reasonable length of time. Announcements: From the auction block will take precedence over the printed matter in the catalogue. Buyers are therefore cautioned to pay attention to any such announcements. Certificate of registry: The proper registration or recordation paper, as the case may be, will be duly transferred and furnished to the buyer for each animal after settlement has been made. Shipping: Assistance will be given in making shipment after the sale, but the Sales Manager or seller assumes no risk. Expenses incurred are the responsibility of the purchaser. Purchasers are requested to furnish shipping instruction when making settlements. Health: All animals will have passed the required tests as determined by Agriculture Canada at sale location. It is buyer’s responsibility to determine health requirements for importing any animal into his province or state. Sales Management assumes no responsibility for the health status of any animal in the sale. Breeders guarantee: Bulls – Should any bull fourteen (14) months of age or over fail to prove a breeder after being used on cows known to be breeders, the matter shall be reported in writing to the seller within six (6) months following the date of purchase or six (6) months after the bull has reached fourteen (14) months of age. The seller will then have the right and privilege of six (6) months to prove the bull a breeder. No guarantee is given that semen collected from the bull will be suitable for artificial insemination. Females – Cows represented as being “pregnancy tested safe” have been examined and declared safe by a licensed veterinarian and will be accompanied by a veterinarians certificate to this effect. They are 2

considered breeders without further guarantee. Cows with calves at side shall be considered breeders also, without further guarantee. Cows and heifers represented as “bred” are not guaranteed safe in calf, but they and open heifers selling as individual lots are guaranteed to be breeders. No guarantee shall apply to suckling calves. In the event a female is claimed to be a non-breeder after having been bred regularly to a bull known to be a breeder and after having been treated by a licensed veterinarian, the matter must be reported in writing to the seller within six (6) months of sale date. For heifers under twelve (12) months of age and purchased as single lots and who fail to conceive to the service of a bull known to be a breeder, the matter must be reported to the seller before the heifer reaches eighteen (18) months of age. The seller shall have six (6) additional months in which to prove any such female a breeder and may use any registered bull of the breed available to him. Any female returned will be at the purchaser’s risk. No guarantee is given that a pregnant female will deliver live calves, nor that she will carry calves full term, nor that the calf carried will not be mummified. The seller is not responsible for damage caused by foreign bodies after the animal has been sold, nor for sickness not apparent at sale time. Exceptions to guarantee: In cases where the animal is subjected to any hormonal or surgical reproduction techniques after the sale, the guarantee shall be null and void. Settlements: Transportation charges on animals returned to the seller are for account of the purchaser. No incidental expenses such as feed, A.I. signing fees, interest, veterinary charges, etc., will be charged by either party when making settlement. If the seller is successful in proving the animal a breeder, then said animal will be reclaimed by the purchaser at his expense. Should the seller fail to so prove the animal a breeder, then the buyer is guaranteed a satisfactory replacement F.O.B. ranch or location of original or a refund of the purchase price paid F.O.B. selling point. In no event shall the seller be responsible for more than the purchase price. Should a dispute arise over the quality of a replacement animal, the Sales Management will appoint a mediator. Rights & obligations: The above terms and conditions of the sale shall constitute a contract between the buyer and the seller and be equally binding to both. Resale of animals following the purchase in this sale shall constitute a separate transaction and the rights and obligations of the two parties concerned thereto are not covered by the terms and conditions of the sale. Tampering: Any person caught tampering with any cattle entered in the sale/show ring or administering any product, solution, or liquid internally will be disqualified from the sale/show. Further, that person will be required to leave the premises. Ottawa Valley Simmental Club (OVSC) is an Agent Only. It is to be understood that OVSC is only acting as a medium between Buyer and Seller and is not in any way responsible for any failure on the part of either party to live up to his/her obligations.

An update from V5 Simmentals

Life at V5 Simmentals is always interesting, sometimes stressful, but oh so rewarding when you still can see young interested people working with cattle. Dylan Foley Simmentals are housed with the V5 herd, so I have a chance to see Dylan plan his program. Highlights such as flushing his beautiful RF Chocolate Rose 230Z, embryos implanted in various cows—and seeing the resultant calves! Then, along with some young helpers, prepare animals for the shows (of which, he supports many). We have an interesting herdsire walking our pastures (after our A.I.ing is done with both herds), a Crossroad Radium 789U son, LFE FS Lewis 516Z, purchased from Lewis Farms Ltd., Spruce Grove, Alberta. We like his calves! Due to an unexpected health problem, V5 had to step back from the training program this year. Back on track in the New Year. Come for a visit, talk cattle and see our herd. Visitors are always welcome.
