FACTS & INFORMATION Thailand is the only Southeast Asian nation never to have been colonized by European powers, is a constitutional monarchy whose current head of state is HM Bhumibol Adulyadej. A unified Thai kingdom has existed since the mid-14th century, and Thailand was known as Siam until 1939 when it officially became the Kingdom of Thailand. Thailand is the 50th largest country in the world; with a land mass close to the size to Spain. Located just 15 degrees north of the equator, Thailand has a tropical climate and temperatures typically range from 19 to 38 degrees C (66-100 F). Thailand’s largest peak, Doi Inthanon, is 2,565 meters (8,415 ft) tall. Thailand covers 510,890 sq km of land and 2,230 sq km of water. The coastline of Thailand is 3,219 km long. Thailand’s longest shared border is with Myanmar (Burma), stretching 1,800 km. The population of Thailand comprises of roughly 65 million citizens, the majority of whom are ethnically Thai, though peoples of Chinese, Indian, Malay, Mon, Khmer, Burmese, and Lao origin are also represented to varying degrees. Approximately 7 million citizens live in the capital city, Bangkok, though this number varies seasonally and is otherwise difficult to accurately count.

This month we have collated full day-trip details for those of you visiting the city with your family. So, rent a car or book a taxi, and let’s get out there to explore the region.

10:30am: Nong Nooch Gardens After your morning stroll along the beach, get in your car, or taxi, and head over to Nong Nooch Gardens, which is approximately a 25-minute drive from Jomtien. Our first stop for the day will be at one of Pattaya’s most popular attractions, known as Nong Nooch Gardens. The gardens are set over 500 acres in size, making it one of the biggest places of its kind in the country.

9am: Morning Stroll on Jomtien Beach Kids love the beach, and nothing will get them on your side first thing in the morning than a stroll along the beach. Have a spot of breakfast in your hotel and then pop over to Jomtien Beach, which is the nicest stretch of sand for a stroll in this part of Pattaya. 9am in the morning in a tourist destination such as Pattaya will be the quietest time to get some sand between your toes and partake in a brisk walk. Absorb the sunrays and let the gentle sea-breeze caress your forehead.

Nong Nooch Gardens is most famous of course for its botanical offerings, but in fact this place has much, much more. For starters, the gardens offer some incredible cultural shows, demonstrating to visitors some aspects of Thai culture and leaving them with a better understanding of Thailand’s history and its people. The shows also include traditional Thai dancing, which is very popular, and even elephants (one of the national symbols of Thailand) performing incredible feats. The elephants can play football, bowl, and otherwise

interact with guests of all ages and sizes. This is a great way to start the day, especially for families. The admission price for adults is 500 THB per person, although it is cheaper for kids. 2pm: Cartoon Network Amazone Water Park Pattaya’s biggest, and some say grandest, brand new family attraction is the adrenalin-filled Cartoon Network Amazone Water Park near Bang Sare. At the time of writing this text, the park hasn’t officially opened, but by the time you read this, it will have already enjoyed its launch on July 31st 2014. After watching the progression of the construction for the past 6 months, you need to take your family over there right away to sample

some of the most amazing waterslides you will find in Southeast Asia. The park is just a 5-minute drive from Nong Nooch Gardens, so this is the perfect place for you and the family to stop next. So just make sure you bring along your swimming gear, because this is something you can’t afford to miss. 4:30pm: Pattaya Floating Market Visiting the famous Pattaya Floating Market is always the correct way to spend a late-afternoon. The market is located on Sukhumvit Road on your way back from the water park, and is the perfect place to relax, have a bit of food and buy some quality souvenirs. The market includes aspects and cultural tidbits from the four main regions of Thailand: the central plains, the south, the northeast (Isaan), and the north. These four regions are all very much distinct from one another, blending together to form what is today the Thai nation. Actually set on a small lake, you can cruise around the market in a long-tail boat if you wish, or just stroll around its wooden bays, absorbing the cultural atmosphere that makes the Pattaya Floating Market so special. Useful Tips Thailand Q&A q: Are there any poisonous/dangerous animals or insects in Thailand? A: Yes there are a few poisonous animals in Thailand, although there are very few incidents that occur. Generally speaking, you will only come into contact with venomous creatures when in countryside or jungle environments. Thailand does have poisonous snakes, scorpions, jellyfish and centipedes, but 99.9% of travelers never have any problems. q: Is Thailand a safe place to walk at night? A: You can find places within any country that aren’t safe – this is a sad fact of life. However, Thailand is one of the safest holiday destinations in the world to walk the streets at any time of the day or night. Use your common sense though, especially if intoxicated. q: Will I be able to access the internet easily when in the country? A: Yes. Although the speed of the internet in Thailand will probably be much slower than your home country, there are hundreds of internet cafes at every turn. If you have a laptop computer, bring it along, because many of the bars, restaurants and hotels now have wireless internet connections. q: What is the voltage of electricity? Missouri-native and Vietnam War veteran. At the beginning of the 60s, Pattaya was just a small yet beautiful fishing village where life rolled by at a pedestrian pace, sleepy and charming, encapsulating the natural abundance that makes Thailand so special. During the Vietnam War, Pattaya became a place of “Rest and Relaxation” for American servicemen on short-term leave from the rigors of the frontline.

When the American warships sailed into Pattaya Bay, there were hundreds, and sometimes thousands of tired and stressed soldiers desperately seeking solace within this beautiful beachside location. “It really was like all our Christmases and birthday parties all came at once,” said John. “When word got out that an American warship was coming to town, Thai girls were sleeping on the beaches waiting for us to arrive.”

“You really couldn’t believe what Pattaya was like in the 1960s,” said John Holmes (no relation to the famed porn-star of the same name),

“News travelled fast,” said John. “All of a sudden, word was out that the American soldiers were spending lots of time in the village and had more money than sense.” Indeed, Pattaya’s reputation rapidly grew as a place where you could find anything you were looking for in terms of female companionship. “Pretty Thai girls flocked to Pattaya, kick-starting the party atmosphere that still remains its hallmark today over 50 years later.”

Impoverished Thai girls from the rural Northeastern region of Isaan flocked to Pattaya, seeking good fortune in the hope of sending money back to their families and improving their standard of living. “These were the days when the 500 baht note was the highest denomination,” said John. “Most of the girls had very rarely even seen a 500 baht note before, let alone actually owned one, but they acclimatized to that quite quickly.”

I had to ask myself the question, “Was Pattaya always like this, and if not, how did it become this way, and even more interestingly what was it like before?”

In the 1960s, Walking Street was little more than a shack-lined street, dusty and dirty. No-one could imagine the changes over half a century later. “We really couldn’t believe our luck,” said John. “The beaches were beautiful and untouched, the water was transparent and clean, the bevy of babes were astounding to young and naive lads such as us, and there wasn’t a single 7/11 in sight.” The funniest thing about John was as soon as the war was over, he hot-stepped back to Pattaya and has been living here on and off the past 50 years. “Lots of guys who stood alongside me in Vietnam couldn’t wait to get back here after the war. Going back to live in Birmingham, Alabama, was not even an option to guys who had experienced a brave and exciting new world,” said John. “To be honest, Pattaya changed us for life, and things could never be the same again.” We all know that feeling John! What are some of the potential benefits of signing a prenuptial agreement? • Assurance A prenuptial agreement sets the financial arrangements and agreements between couples before their marriage. Future concerns about money, work, children, home, and any other mutual issues can be discussed openly. By setting forth a formal agreement, both parties will be assured that their valuables will be disposed of according to their intentions and both will be aware on what to anticipate in the event of dissolution of marriage. • Protect Premarital Assets Both parties can retain personal properties and

Without it, your future spouse’s liability and negative credit history can become your own and creditors can go after the marital property even though only one spouse is the debtor. • Protecting Family Business Prenuptial agreement keeps control and protects ownership of assets, finances and properties belonging to a family business. In the absence of a premarital agreement, a court could award some of your ownership rights in a family business to your partner that can lead to a potentially difficult situation in case the marriage fails. • Protecting Family Members Often a prenuptial agreement is used to designate responsibility and to protect the interests of children from a prior marriage as well as children from the upcoming marriage. By signing a formal agreement, you can ensure that your children receive the assets, property or money you want them to have in the event of separation. • Protecting Family Heirlooms Heirloom could be anything valuable passed down from generations to its family members. A prenuptial agreement can ensure that family heirlooms are kept out of the marital estate as this is important when there are children from a prior marriage or other relatives for whom they are intended. • Minimizing Divorce Acrimony and Costs By entering into a prenuptial agreement, there is less stress and bitterness and less to fight about upon a divorce procedure. Divorce may be far less expensive if the spouses’ respective rights are arranged. Prenuptial agreements need to be writing and signed before the marriage with at least two witnesses present and must be registered in the local office where the marriage will take place. This must be written in both Thai and English or the spouse’s native language for better understanding of both parties. It is important to consider that prenuptial agreements cannot be altered except by authorization of the court. It is extremely important that both parties understand exactly all the rights and obligations that goes along with the signing of the agreement that is why each party needs legal counsel from their own respective lawyers. INDIA Although a comparatively long process, I have to give it up that it seems to be very protective of the buyer. Basically, it’s a five-step process: 1) Check for any encumbrances - Checking for any outstanding loans, taxes, liens, etc. (dating back 30 years!) = 5 days 2) Preparation of final sales contract by lawyers =7 days 3) Payment of stamp duty =1 day 4) Execute final sale deed and submit documents =1 day 5) Issuance of new title deed = 30 days So, start to finish you’re looking at a 6 – 7 week process at a cost of about $1,000 USD plus about 6% of the property value – not far off the rate in Thailand (depending on who you ask, of course :) MALAYSIA

How Does thailand stack Up?

T

he relative simplicity of transferring property title in Thailand is generally a pleasant surprise for first time foreign buyers. Anyone who has traversed the waters of a land registry department in Thailand can attest to the fact that, although seemingly unorganized and, at times, inexplicable, the process is reasonably quick and painless if you have a knowledgeable Thai by your side. In just a few hours, all property taxes, stamp duty and transfer fees are paid and the name on the chenoud (title) has physically been changed. This is not to say the process is free from frustrations – inflated transfer fees, unexplained ‘special taxes’, the expected ‘tea money’, mismatched signatures, expired visa stamps, 58

improperly filled out Power of Attorney forms, invalid Tor Tor 3 documents – these are all very common issues that may arise. Thankfully, most issues are usually sorted through expected means and all is well. Purchasing property through professionals is a good way to deal with these potential pitfalls as most support staff will have transferred untold numbers of properties and are well prepared for most scenarios – most of which will have been troubleshot prior to arriving to transfer. The relative ease of transfer of title in Thailand does not necessarily carry over into other Asian countries. Below are some examples of the processes and processing times to transfer title elsewhere in Asia.

Malaysia is quite interesting in that the government stipulates that in a sales contract, although most terms and conditions can be set forth by the buyer and seller, a closing date of up to 3 months must be given with a mandatory extension of 1 month should it be needed – very good for the purchaser. Also, generally a small deposit of 3% is paid initially as sort of a booking fee. A notarized sales contract will be drafted within a few weeks of this with an additional 7% deposit paid. From here it becomes quite longwinded with a pretty bureaucratic process that generally takes a minimum of 2 – 3 months for local Malaysians and a whopping 4 – 6 months for foreigners. Fees and stamp duty are quite low, averaging about 2.5% of the value plus legal fees of around 0.5%. I can now see why the Malaysian government’s initiative to get foreigners to purchase property and gain long stay visas was a bust. Six months to transfer a property seems a little outrageous to say the least.

At a cost of 4% of the property value plus small additional fees, it’s not so bad. PHILIPPINeS Again, quite a number of steps, but not too painful: 1) Notarize the sales contract = 1 day 2) Obtain certified copy of last tax balance sheets = 1 day 3) Obtain tax clearance letter = 1 day 4) Obtain certificate that all is clear with internal revenue = 21 days 5) Pay stamp duty and capital gains = 1 day 6) Pay transfer tax = 1 day 7) Apply for registration of title deed = 10 days 8) Obtain new tax declaration in new buyer’s name = 2 days It’s a lot of formality with the taxman, but the fees paid are about 3.25 – 5% of the total value, making it quite reasonable. Total time here is about 38 days. Not bad compared to some of the others. Drawing conclusions from this is a bit redundant – hopefully we’ll all just be that much happier next time we’re queued up next time at the Pattaya Land Registry.

CAMBODIA Did anyone expect this one to be easy? This is a 7-step process: 1) Title check and search at land office to check for any encumbrances = up to 30 days 2) Contact village chief to obtain additional information on property = 10 days 3) Check and search on seller whether it be a
