For one local couple a decision to call in landscaper and a fencer to retain, fill, level and fence a small sliver of land at the side of their home has turned into an expensive and time consuming nightmare.

The project involved the addition of several sleepers on top of the

existing boundary retaining wall, the installation of a wooden fence on top of that and then the distribution of some fill, mulch and plants up to the sleeper level which effectively created a level yard at the side of the house.

When the work was brought to the attention of Council it was deemed to be outside the rules of an "accepted development" and in breach of development laws.

It was suggested the couple should hire a private building certifier and try to lodge a retrospective building approval given the limited nature of the works. That process, as it turns out, was an exercise in futility.

In the course of investigating the retaining walls it was established that the original wall on the block made no allowance for any extra load.

The extra soil against the sleepers was deemed to be over the load limit of the original wall.

The owners were advised to remove the extra load - the fill, mulch and plants, and then the sleepers and fence on top should be okalthough they may have to trim the wooden fence height in one section to fit under a two metre height limit.

One letter sent to the owners by Council outlines the potential maximum fine for a building without a permit breach as a penalty of 4500 units, or the equivalent of a $620,329 fine.

At the time of going to print the owners

remain in discussion with Council over the issue.

While they are seeking quotes to remove their garden, they are reluctant to incur more costs when a precedent appears to have been set for the area with similar retaining wall and fence set ups clearly visible across the estate.

They say there was no disclosure of the rules around building near retaining walls when they bought their block and there are hundreds of home owners in the area who need to be aware of the rules as they may find themselves in a similar situation - all it takes is one complaint for Council to investigate.

A Sunshine Coast Council fact sheet on "Building a Retaining New Wall states that "an application for carrying out building works needs to be lodged and an approval from a private building certifier for all retaining walls must be given, unless it meets the

It states a retaining wall may be constructed without approval, as 'accepted development' where it meets all of the following criteria:

• no surcharge loading over the "zone of influence" for the wall (defined in the Building Regulation 2021 - Schedule 1, section 3)

• total height of the wall, and of the cut or fill retained by the wall, is no more than 1 metre above the wall's finished ground level

• the wall is no closer than 1.5 metres to a building or another retaining wall

• the wall is structurally adequate and compliant with the National Construction Code (Building Code of Australia)

• the wall complies with all relevant council siting and planning requirements

• all other relevant approvals are obtained to construct the wall over any infrastructure such as sewer pipes,

stormwater mains and easements, and

• the wall is not part of the fencing for a regulated swimming pool

A DESIRE TO REDUCE FOOD WASTE, TO HELP OTHERS AND TO ADVOCATE FOR A LESS WASTEFUL FUTURE HAS SEEN PEREGIAN SPRINGS' RESIDENT MICHELE LIPNER NAMED AS THE SUNSHINE COAST CITIZEN OF THE YEAR.

Michele is the founder and coordinator of the local chapter of OzHarvest.

Each month she is joined by a team of volunteers who collect more than 15,000 kilos of quality surplus food from 40 food donors and re-distribute it to 45 agencies to feed people in need.

Outside of food recovery, OzHarvest also delivers a range of education programs locally including Cooking for a Cause and Food Education and Sustainability.

Sunshine Coast Council Acting Mayor Rick Baberowski said people like Michele formed the

backbone of our Sunshine Coast community.

“This year, we received 63 Sunshine Coast Australia Day nominations across seven categories with a common thread weaving through each one — every nominee was praised for their selflessness and their dedication to helping others,” Cr Baberowksi said.

“Together the nominations form a glorious account of the actions of everyday people who make a difference.

“It’s a humbling account and every nominee should feel very proud.

Mason is also an award-winning artist and songwriter and uses this as a platform to raise awareness and generate funds and support for mental health.

Emerging from a strong line up of contenders for the Community Group of the Year Awards for 2023 were The Board Meeting Surf Charity and Sunshine Coast Riding for the Disabled who were judged to be equally worthy of the category win, producing a tied result.

FUNDRAISING BOOST FOR PBSLSC

THE BANK ACCOUNT AT PEREGIAN BEACH SURF LIFE SAVING CLUB WAS GIVEN A WELCOME TOP UP LAST MONTH WITH THE DISTRIBUTION OF $80,000 TOWARDS THE CONSTRUCTION OF A NEW CLUBHOUSE BUILDING

The big cheque came out to formalise the handing over of funds raised by Peregian Family and Friends over the past two years to help Peregian Beach Surf Lifesaving Club to continue on its journey of re-vitalisation in the years ahead.

PFAF founder and president Leigh McCready said the cheque presentation was the culmination of five years of advocacy, blood, sweat and tears to get the local surf club re-started, after it was wound up in 2014.

“Back in December 2017, we incorporated a residents’ association to speak up for the two-thirds majority of locals who wanted a surf club building that was fit for purpose, that provided clear visibility to the water for safety, enabled fast emergency access to the beach and allowed members and guests to support the club financially through a restaurant and bar overlooking the water,” Ms McCready said.

“We worked with Noosa Heads SLSC to get the Peregian Nippers program started again in 2018 and helped add many new lifesavers to our volunteer patrols.

"In 2022, finally a new ‘Surf Life Saving Club’ and ‘Supporter’s Club’ were both re-incorporated and affiliated with Surf Life Saving Queensland (SLSQ), a first in Queensland lifesaving history.”

“The next step is to build a new clubhouse, as Peregian has been rated the third worst in Queensland by SLSQ.

"While the club isn’t available yet to bring the kids for a meal and a drink, the current venue can be hired for events.”

Whether or not the existing club house is replaced on its current site, or it is in fact built

elsewhere is something only the future will tell. At this point current planning laws do not allow any building to be constructed closer to the dunes at Peregian Beach park, and any major development of the existing clubhouse would be required to pass Council approvals.

Peregian Beach SLSC president John Roderick told PFAF members the money was very much appreciated.

"The money will go towards long term purposes for the Club. Money will be astutely looked after before any expenditure; I can assure you of that.” Mr Roderick said.

The 2022/23 season marked a major milestone for the club as it took further control of patrolling of Peregian Beach and the management of its own Nippers.

In the past few years, Noosa Heads SLSC has provided key elements of support, on and off the beach, to assist the club on its quest to once again stand alone.

ARTISTS ON TRACK FOR EASTER

The annual event will be held at the Coolum Civic Centre from April 7 to 10, stretching from three days to four this year off the back of its increasing popularity with local art lovers.

More than 200 original artworks will be offered for sale over the four days, comprising both traditional and current styles including oils and watercolours to acrylic, mixed media and pastel works.

Award winning Australian artist Garry Dolan has been named as the VIP guest

speaker and judge for this year’s event and will share his story and demonstrate his technique as part of the proceedings.

Dolan is well known for his art and has a passion for capturing the grace and movement of ballet dancers.

It’s a passion that has earned him the title of Artist in Residence at a number of ballet companies.

He is also a founding member of Sunshine Coast Plein Air Painters.

Entry to the exhibition is

free and visitors have the opportunity to vote for their favourite artist in the “People’s Choice award”.

All are welcome to attend the official opening and presentation of prizes by Garry Dolan on Saturday, April 8 at 3pm, as well as the opportunity to enjoy the music provided by local group “The Shoplifters”.

NO MOVEMENT ON REC CLUB

THE FUTURE OF THE PEREGIAN SPRINGS REC CLUB REMAINS IN LIMBO

THIS MONTH.

The Recreation Centre, at 222 The Avenue was listed for sale by Colliers International in October last year with expressions of interest to be lodged by November 24.

At the time an Aveo spokesperson said the group was keen to move on the sale as quickly as it was able in order to have the club open

and operating for the community once again. As at January 29 they had not had any news to report.

Ridges Principal Body Corporate chairman Roger Cook said there had been no contact from either the selling agent or Aveo in regards to the recreation centre this month.

The Centre was put up for sale after Ridges' body corporates voted against accepting a deal to transfer the asset to the PBC.

GET SET FOR SOME OFFBEAT FUN

MUSIC LOVERS TAKE NOTE, THE ANNUAL OFFBEAT MUSIC FESTIVAL WILL BE RETURNING TO THE IMPERIAL HOTEL IN EUMUNDI ON SATURDAY, MARCH 25.

As of the end of January the festival had announced artists including King Stingray, Queen P, Moreton, Greatest Hits, DJ Rolplay, the Gubbi Gubbi Dancers, Thelma Plum, Gretta Ray, Electric Fields, Clews, Clea, Blues Arcadia, Playlunch, Eastbound Buzz and Tommy Gun.

Festival Director Alice Jones says the exciting line-up brings some of Australia’s best acts to Eumundi for the first time and showcases the diversity of fresh talent that is blazing a path through the Australian music scene.

“It’s a pretty huge line-up for a boutique festival, so for music-lovers it is a rare opportunity to see these bands in a really relaxed setting, and we love that tickets are limited – it makes the experience really special,” Alice said.

“Having big name artists like Thelma Plum, King Stingray and Electric Fields, alongside quiet achievers like Moreton and Clea is such a thrill and one of best things about OFFBEAT,” she said.

“It’s the artists you didn’t know that grab your heart and pull it from your chest, or make you lose yourself in the crowd dancing, arms in the air.”

CHRISTMAS LIGHTS WINNERS

In South East Village the local body corporate committee went one step further, promoting a Christmas Lights competition where judges would roam the streets, identifying outstanding displays, and award a prize for best house and best duplex.

All frontages in South East Village were eligible, provided there was no breach of the by-laws at the time of judging, and Lot contributions were up to date.

There were two categories - best in a house or unit, and best in a ‘dual key’.

This year’s winners were 30 Kauri Crescent for Best House or unit in a Duplex and 2/22

Kamala Close for Best Dual Key.

The two winners each received a voucher for breakfast for four at The Pool Café to the value of $85.

BE AWARE OF OPTUS EMAIL SCAM

THE AUSTRALIAN COMMUNICATIONS AND MEDIA AUTHORITY HAS ISSUED A WARNING TO AUSTRALIANS TO BE AWARE OF THE LATEST EMAIL SCAM SENT USING CONVINCING OPTUS BRANDING.

ACMA says the scam letters will often mention the recent Optus data breach and ask those receiving the letter to click on a link to update or confirm their details for ‘security reasons’.

It says other examples might look like a payment reminder asking you to click on a link to pay a fake outstanding bill or update your payment method.

“Common among all of these scam messages is a sense of urgency – that if you do not act quickly, your account will be closed or suspended, or your service disconnected,” ACMA says.

Things that help to identify the scam are typos and/or sender email addresses that are not related to Optus.

Optus has issued advice that they “will never ask for your personal or sensitive information via email or messages”.

ACMA says if you’re unsure if a message is legitimate, always contact Optus via their publicly available contact details rather than the details provided in a message.

GREEN BINS HELP HIT THE TARGET

DID YOU KNOW THAT PUTTING SMALL BRANCHES INTO YOUR GARDEN BIN BEFORE GRASS CLIPPINGS PREVENTS GRASS STICKING TO THE BOTTOM?

Sunshine Coast Council has released a new video that shares some ideas on how to make the most out of the “green” bin.

Environment and Liveability Portfolio Holder Cr Maria Suarez said remembering what goes in your garden organics bin was really very simple.

“If it grows in your garden, it can go in the bin,” Cr Suarez said.

“And that’s the extent of it – please only put grass clippings, small branches and twigs, leaves, non-invasive weeds, garden prunings and old flowers in your garden bin.”

Garden waste is taken to Council tips where it is processed into mulch and placed in windrows to age.

Once it’s had enough time to break down, the mulch is made available to ratepayers for use on their gardens.

“From July to October 2022, since the expanded service began, more than 6300

tonnes of kerbside-collected garden organics have been diverted from landfill, recycled and reused,” Cr Suarez said.

“Our Sunshine Coast community has really taken up the chance to help our environment by using the fortnightly garden organics bin to divert more waste from landfill and prevent harmful greenhouse gas being released into the atmosphere.

“A total of 86,000 households now have a garden organics bin with an extra 45,000 joining the service since the expanded program began on July 11, 2022." Cr Suarez said.

“We have a goal to be a zero net emissions organisation and low carbon region and decomposing waste is a big contributor to greenhouse gases.”

A veteran of the broking scene, Trevor has been with Aussie for more than 20 years.

He has also been recognised in the Mortgage Professional Association’s Top 100 Brokers on several occasions as well as being recognised as Regional Broker of the Year.

Trevor opened the Aussie Coolum franchise in Birtwill St several years ago and now works with his team to service the loan needs of customers in the greater Coolum area.

PUSHING INTO THE NEW YEAR

HAPPY NEW YEAR AND 2023 PRIORITIES

There are good reasons why people flocked to the Sunshine Coast over this Christmas period – we are a lifestyle capital and we locals enjoy the world’s most enviable way of life.

As we enter 2023, I reaffirm a pledge I made in my maiden speech in 2016: “to be Sunshine Coast’s man in Canberra and not Canberra’s man on the Sunshine Coast” - my loyalty lies at home and I’ll continue fighting for our region.

This year, I want to see tangible outcomes where I have secured funding, including: completion of the Maroochydore Rd / Mons Rd interchanges of the Bruce Highway (over $300M); ramping up of Phase One of the North Coast Rail Line (over $500M), and; starting work on the Mooloolah River Interchange on the Sunshine Motorway (over $300M).

I’ll also be continuing my campaign for better rail services to the Coast, including full duplication of the North Coast Rail Line to Nambour (the $5 million I secured for design work is yet to be matched by the Queensland Labor Government); and a new line along the CAMCOS corridor to Maroochydore (the $1.6 billion we secured is yet to be matched by the Queensland Labor Government and funding has been postponed by the Federal Labor Government).

These aren’t my only priorities of course, but they’re the big ticket ones.

SPORTING AND PARASPORTING CHAMPIONS

It was great to recently meet another group of local sporting and parasporting champions.

Thirty four (34) young sports stars were recognised in the latest round of Local Sporting Champions and Local Para Champions grants for 12-18 year olds.

I would particularly like to give a shoutout to Sienna Potter from Peregian Springs - 2022 Hygain IQ State Championships (Equestrian) I look forward to following their journey to the 2032 Games!

The year is off to a flying start for our local community, which kicked off with our annual Coolum Beach Australia Day Awards held recently.

Congratulations to the Citizen of the Year, Brennan Carolan (right, top), and to our Community Group of the Year, Coolum Hearts (middle). The Volunteer of the Year was awarded to both Dave Cush of the Coolum Beach Surf Lifesaving Club (pictured right, bottom) and Coolum and Northshore Coastcare’s Leigh Warneminde.

Great to see such deserving recipients being recognized for their many years of service to our local community. A big thank you also to the Lions Club of Coolum Beach for once again hosting these important awards.

Speaking of local heroes, time is running out to nominate individuals for the 2023 Queensland Greats Awards. These awards are an opportunity to honour the State’s home grown heroes across three categories – individual, institution, and posthumous, and close on 17 February, 2023.

PLASTIC BOOST FOR BOARDWALK

Recycled plastic features prominently in a rejuvenated boardwalk showcasing a hidden bushland oasis on the Sunshine Coast.

Located at Yaroomba Bushland Park and nestled amid lush rainforest behind Point Arkwright, the elevated 152m boardwalk has been rebuilt using sustainable products, making it more accessible and storm resistant.

Sunshine Coast Council Division 8 Councillor Jason O’Pray said the upgrade provided a great opportunity for the community to get active and become immersed in nature.

“It replaces the aged wooden walkway off Neurum Road, with a careful construction approach to ensure zero harm to vegetation and wildlife,” Cr O’Pray said.

“It now offers a safer and more durable

asset for our community to explore this magic pocket of parkland.”

Cr O’Pray said the Yaroomba Bushland Park was a special place, much-loved for its picturesque walks, abundant wetland, vine forest, Wallum woodlands, shaded picnic areas and quiet children’s playground.

“The boardwalk connects to a one-kilometre walking and cycling circuit that’s perfect for people of all ages to enjoy,” he said.

The $300,000 Yaroomba Bushland Park boardwalk project was funded by Council’s Minor Capital Works Program, and local residents have been thanked by Council for their patience and understanding throughout the works.

Sunshine Coast Environment and Liveability Portfolio Councillor Peter Cox said that while every day could be a beach clean-up day, he was delighted to see the community come together annually on this designated day.

“We are a turtle-friendly community on the Sunshine Coast and this is our chance to make a difference to our threatened turtle hatchlings,” Cr Cox said.

“Cleaning up the beaches will give these little guys the best start in life.”

Sunshine Coast Council, in partnership with TurtleCare Sunshine Coast, Reef Check Australia, Unitywater, SEA LIFE Sunshine Coast Aquarium and Noosa Council, wants everyone to help out on February 4 by tidying up their local beach.

Volunteers can register to pick up litter at various beach locations between Noosa and Caloundra from 6am to 7.30am.

Surf Club, to enjoy a free barbecue, participate in a prize draw and other fun activities and, most importantly, to weigh and sort the collected debris.

The event will be single-use plastic-free, so make sure you bring a reusable water bottle, coffee cup and gloves, as well as enclosed footwear and sun protection.
