he Fall weather is upon us, and the beautiful leaves are exposing their vibrant autumn colours. As we move into the next season, we celebrate the success of the Summer real estate market and the start of the Fall. Now that Toronto and the Greater Toronto Area have opened up, we can enjoy our communities at our comfort levels. This unconventional year has brought with it many challenges and changes to the real estate industry. Based on TREB reports in July 2020, the GTA saw a 29.5% increase in sales from July 2019. The average sale price in Oakville in July was $1,571,751 versus $1,378,385 in July 2019. According to TREB market reports, sales are up 23.6% in Oakville for July 2020 yearover-year. The Fall will bring with it the USA election, which could affect the real estate market. And if they were lucky enough to see the Porsche Taycan in his driveway with Mark spinning its keys in his hand, they would know that style is not bought, it’s curated.

THE CONTEMPORARY AUTOMOBILE HAS TO EVENLY BALANCE STYLE AND FUNCTIONALITY, AS THE TAYCAN DOES WITH PRECISION. THE DELANO HOUSE DOES THE SAME.

“If Porsche were designing a house,” Real Estate professional Christopher Invidiata told Cummings, “it would look like yours, and if you were to design a car, it would be the Taycan.” So what aesthetic philosophies do the abode and automobile marvels share? “A strict adherence to a truly modern experience,” says Cummings. “Uncompromising quest for quality and excellence, and exceptional use of innovation, space, and symmetry.” The contemporary automobile has to evenly balance style and functionality, as the Taycan does with precision. The Delano House, named after one of Miami’s sexiest hotels, does the same in that, “Every room in the home was built to specific criteria and size with the perfect balance between ergonomic needs and functionality. Every hallway in the house is a minimum of five feet wide. The goal was to capture the right balance of every room being open-concept, yet functional while adhering to a purely modern style with crisp and clean lines truly embracing the essence of being minimalistic.” Cummings’ passion for style is apparent as he describes his awe-inspiring home, whose design inspiration was, “a purely modern Miami style home in the plush, warm, and character-filled presence of Southeast Oakville. In essence, bringing the Delano to Southeast Oakville.’” Technology engages with and informs that style throughout the home. “There are heated floors throughout, sound and lighting automation, video surveillance, and video doorbells all controlled by a robust automotive engine in the hub of the home. All aspects reflect leading-edge technology that compliments the design of the house.”

As the cooler weather arrives, Sheila and I always look forward to bringing our entertaining back indoors with heartier menus and warmer dĂŠcor ideas for our dinner parties. Finding innovative ways to present our fall dishes is one of our favourite things to do, and as with all our entertaining ideas, the little touches we add to our

table make all the difference. For this issue of The Invidiata Magazine, we are showing three of our most popular ideas for fall entertaining along with one of our most helpful tools for planning our parties. We hope you and your guests love these as much as we do!

THE MUSHROOM PLACECARD Placecards are a great way to add a touch of elegance to your dinner party and to also arrange your guests to ensure the conversation flows easily. Placing your guests at a table is an art and can certainly make or break any dinner party. Consider similarities and differences in personalities, but it’s not necessarily about seating similar people together; mix it up with outgoing and perhaps quieter people next to each other to balance the conversation. THE PRE-DINNER CHARCUTERIE PLATTER For me, a charcuterie platter is a staple for entertaining. It serves as the perfect grazing dish for guests as they mingle before a seated fall or winter dinner. There is really no wrong way to put together a charcuterie platter since you can add almost anything, provided the ingredients can sit out at room temperature. There are, however, a few tips I recommend you follow. Firstly, when laying out your ingredients make sure to build up different heights rather than laying everything flat. This can be done by using cheeses of different shapes, pleating over your cured meats for texture, building small bundles of grapes still on the stem, or even by adding mini bowls for your condiments. Secondly, consider varying guest preferences and try to accommodate as many people as possible. Not everyone loves soft cheeses like Brie or Camembert, so consider also having perhaps a white cheddar or a crumbled Parmesan too. For your meats, a spicy Genoa is my favourite, but for those who may have a less adventurous palette, a simple prosciutto is the perfect choice.

Thirdly, have some fun and add something unexpected! My go-to is honey served right off the honeycomb since most people likely won’t have seen this before, but nowadays you can buy it at most high-end grocery stores.

THE MAIN COURSE PRESENTATION The famous saying goes that “people eat with their eyes” and nobody believes that more than us. How you present a dish can make a huge difference in how your guests will enjoy it. Trust us, we know. An example of this is using unexpected vessels for traditional courses. Here we showcase a main course of thinly sliced tenderloin over roast parsnip purée in a mushroom rosemary jus served in a stemless wine glass. FALL WARM UP 5 Ways to Feature Your Fireplace

Whether you’re thinking about building a new fireplace or changing out an existing one, a fireplace adds much warmth, architectural detail and a focal point for any room and a great place to flaunt your personal sense By Andrea Colman of style.

1 | CUSTOM BUILT-INS When designing family rooms, I’m often tasked with creating cohesiveness between a homeowner’s flat-screen television and fireplace. A great way to achieve this is to hang the television above the fireplace and surround it with floor-to-ceiling custom cabinetry. Not only does this create a stronger focal point in the room and a place to showcase accessories, but it adds a lot of valuable storage space for games and audio equipment.

2 | ARCHITECTURE & INTEREST A new fireplace is a great opportunity to add architectural interest to your home. If you’re updating an old or dated fireplace, there are many wonderful ways to artfully usher it now into 2020. Retile the interior in an unexpected colour or a cool pattern, such as herringbone or Erth Coverings textural stones. Add a chunky stylized mantel or paint it in a glossy, hot hue like Pantone’s 2020 Color of the Year, Classic Blue. The idea is to make it unusual and unique.

3 | ARTWORK Another way to amp up your fireplace is with art. Artwork is an instant attraction, and the fireplace makes the perfect home for a large-scale, bold piece. Just remember to maintain a sense of visual balance between the fireplace and the artwork overhead. The rule of thumb is the art should be 2/3 to 3/4 the width of the fireplace, and suspended three to six inches above the mantel.

4 | GET TRENDY While fireplaces are known for their traditional appeal, a modern design can give a home some much-needed edge. I love the look of linear fireplaces, such as those offered by companies like Valor. They are sleek and contemporary, thin and available in a variety of widths. Double- and three-sided fireplaces are gaining popularity, allowing you to enjoy a single unit from various vantage points and different rooms entirely! Also on trend are gas-fed fire ribbons featuring flickering flames that rise from rocks, sand or glass in place of traditional logs, yet offering the warmth and beauty of a traditional fireplace. Create a minimalist look by tucking a firebox flush into the drywall. Alternatively, for a more contemporary aesthetic, surround the box with stone finish or porcelain that extends to the ceiling.

5 | UN-FUNCTIONAL & FABULOUS Even without a crackling fire, a non-working fireplace can still add interest and act as a fabulous focal point for your space. My dream car as a kid was a Porsche 911—the mid-70s Carrera model, in silver. Or maybe the motorsport classic emblazoned with logos and the number 147 in bright red that finished 5th in the 1965 Monte Carlo Rally. My dad would give me a Porsche calendar every Christmas, and as the next December rolled around I’d cut out each of the previous year’s months and paste them all over my bedroom walls. My favourite Hot Wheels and dinky toys were always those of the iconic German carmaker. Porsche, to me, was the very epitome of automotive excellence. It still is. FRANK CLEGG Frank Clegg is by no means a techaverse Luddite, tilting at the windmill of relentless progress. In fact, his 14 years as Microsoft Canada CEO, and later as an effective activist for several grass-roots causes, make him uniquely well suited for the quest he has championed since 2012: raising awareness about the potentially harmful effects of electromagnetic radiation emitted by wireless technology. Clegg first became aware of the dangers of electromagnetic radiation when a group of concerned neighbours called his attention to some cell towers erected near his Oakville, Ontario home. He took

SYLVIA MANTELLA Socialite, philanthropist and Mantella Corp. marketing chief Sylvia Mantella may be best known for her support for Canadian fashion – her Instagram feed has thousands of followers, and she sits on as many as 11 fashion- and culture-related boards. “Our fashion industry in Canada is on par with any other country in the world,” she says. But her attention isn’t just restricted to the creative needle arts. Along with a range of other worthy causes, including childhood cancer and the Toronto Public Library, she has long been a strong supporter of animal rights. When a family friend who owned a Miamiarea sanctuary asked if she and her husband, Mantella Corp. CEO Robert Mantella, would be willing to foster a tiny baby two-toed sloth, the experience changed her forever. The couple eventually went on to open a now

40-acre private sanctuary outside Palm Beach, which has rescued and sheltered more than 200 endangered and abused animals, ranging from big cats to kangaroos. One in particular stands out in her memory: a little capuchin monkey rescued from a research lab, where she had suffered repeated trauma for nearly forty years. But her will to live was affecting; Sylvia renamed her Hope and was able to ensure that her last years of life were spent in fresh air and comfort. Clegg’s advocacy group, Canadians for Safe Technology, or C4ST, is particularly alarmed about the coming of 5G, since the technology requires small cell antennas that could end up beaming RF radiation into every living room, kitchen and child’s bedroom across the country. In Clegg’s view, it’s not about calling a halt to progress, but in seeking a moratorium at least until Health Canada’s guidelines are updated for the 21st century and safer alternatives are developed. JOAN KELLEY WALKER Saskatchewan-born Joan Kelley Walker has pursued a successful career as a journalist and broadcaster, but since her marriage to Magna International CEO Donald Walker in 2000, she has pursued two areas that have fascinated her since childhood: helping mothers and children, and fashion. Personally as well as financially, her charitable endeavours range from HIV/AIDS, to clean air and water, to helping new moms in Cambodia. This summer, she took part in a “virtual” dock party in Muskoka, Ontario, where she and Don have a cottage, to help raise funds for the CNIB’s local camp for kids living with sight loss. “I believe we share the world communally,” she says, “and with that comes great responsibility.” She brings the same generous attitude to fashion; she sees fashion as a form of self-expression, and feels women should be free to do the same no matter where in the world they live. A few years ago, her first designer collection of highly wearable clothes, the Joan Kelley Walker Collection, retailed at Walmart; true to form, proceeds were donated to the Breakfast Club of Canada. SHAE INVIDIATA Entrepreneur, speaker, realtor and human rights activist, Shae Invidiata is the founder and executive director of FreeThem, a not-for-profit anti-human trafficking organization established in 2010 to work towards ending human trafficking and exploitation in Canada. SARAH NICOLE LANDRY “My mantra is to rid ourselves of body shame and show up confidently to exist in a world and for memories we deserve to make.” Sarah Nicole Landry didn’t set out to be an Instagram influencer. In the beginning, the now 35-year-old Guelph, Ontario, mom posted the same things the rest of us do: pics of her kids, travels, friends. But in 2013, with three children all under the age of 7, a photo taken at a baby shower shocked her: she looked just the way she felt – overweight, overwhelmed and ashamed over her larger body. She began a vigorous diet and exercise program, documenting her progress on Insta and her blog, The Birds Papaya (a portmanteau of her kids’ nicknames). That first year she lost 80 lbs; another 34 came off within the next two years. Then things began to turn dark. Dieting had become an obsession. But when her eight-year-old daughter said, “Everyone loves you just

because you lost weight,” Sarah realized that a healthy weight and lifestyle is about a lot more than being thin. She had merely been exchanging one form of oppression for another. CHASE SANDY When Halton Regional Police Service members Tamara and Jeff Sandy’s four-year-old son Chase was diagnosed with kidney cancer, their lives narrowed to one focus: helping their son get through the biggest battle of his young life. But even with Provincial health coverage, there are a myriad of small expenses that quickly add up when caring for a family member with cancer: everything from parking and gas to meals, accommodations and loss of income while you are at the hospital. The Sandys found themselves buoyed by an outpouring of support from friends, family and HRPS co-workers, freeing them to devote their full attention to their son’s recovery. When, thankfully, Chase was declared cancer-free, his parents decided to pay it forward. The charity they founded, Chase’s Gift, raises funds to assist families of children with cancer

with cash, gift cards and restaurant meals, all designed to help make this difficult journey a little easier. Today, Chase is a healthy, active 15-year-old and is considering either becoming a history professor (he is a major history buff), or a lawyer (he’s interested in civil rights, immigration or defence). ARYAN GAUTAM Fourteen-year-old environmental activist Aryan Gautam wants to show people that taking care of the environment starts with each of us, whether globally or at home in Mississauga, Ontario. As the Peel region’s youngest founder and director of the federally incorporated environmental non-profit organization, Save The Planet - Open Doors, one of his priorities is to encourage and include youth in his environmental activities. The organization’s social media seeks not only to chronicle his efforts but to inspire young people to participate. In the best spirit of young entrepreneurs, he is constantly conceiving and acting on new ideas for helping to protect the environment. Last year he collected and recycled 500 aluminum cans from around his

neighbourhood – a personal challenge he detailed in an article for the Mississauga News – and challenged fellow citizens to match his target. Lately, he’s launched Project Butternut Reforestation, aimed at diversifying and restoring butternut trees, one of just two native walnut species in Canada and on the endangered list. He’s also working on an initiative called H.E.E.R (Housing Energy Efficiency Rating), which aims to add a metric of ecoefficiency to real estate listings, working to ensure that H.E.E.R is implemented into MLS (Multiple Listing Service). All property insurance policies, whether home, condominium or tenants, will have some coverage for contents, but is the limit included on the policy sufficient for your need? Some higher valued home policies will offer reduced contents options to offset premiums. Condominium and apartment dwellers are asked to estimate the value of their contents for insurance purposes. It may be tempting to place a lower value on your contents in order to save money on insurance premiums, but in the event of a loss, is it worth it? In addition, some contents are subject to â&#x20AC;&#x2DC;special limitsâ&#x20AC;&#x2122;, due to their nature, example: Items that are easily lost or stolen, such as jewellery, collectibles, numismatic or philatelic property are typically included in those items. Characteristically, the maximum an insurance company for jewellery is between $6,000 and $10,000 for an insured claim. Bicycles, watercraft and other sporting equipment, may also be subject to limited coverage on your policy. Simply increasing your contents limits wonâ&#x20AC;&#x2122;t help for these types of items. So how do you protect your assets and ensure that you have the right coverage? Talk to your insurance provider about the limits on your policy and confirm what is included in your contents coverage. You may need to consider scheduling items of value to ensure you have enough coverage to replace or repair those higher valued items. Scheduling items of value will offer added protection and may reduce or eliminate deductibles. In addition, some carriers will offer additional coverage for newly acquired items of a similar nature to ensure no gaps in coverage if you choose to purchase an additional piece while you are away on holiday or on the spur of the moment purchase. Therefore, it may be time to re-examine your personal contents. Have you recently inherited pearls from your mother or a pocket watch from your grandfather? Perhaps you are the lucky recipient of a gift of something small but very valuable, such as an engagement ring, family ring or necklace. What about that instrument you have had since you were a child? Perhaps you recently invested in that dream set of golf clubs. Maybe there is a vase that has been tucked away in a cupboard or a sculpture that you picked up for a song years ago at an auction, or a family portrait that hangs on the wall that no one has thought twice about for some time. Jewellery should be appraised by a qualified gemologist. The jeweller you purchased an item from may have an appraiser on staff or make a recommendation of one. The piece of art purchased at the gallery may have a qualified appraiser or guide you to one. Your insurer may also offer recommendations of an appraiser near your home. An appraisal for insurance purposes should include the name of the owner of the item, a detailed description of the item, including a photo, the value and the name and credentials of the appraiser. The popularity of an artist or changes in the market values of precious metals and gems will cause values for art and jewellery to fluctuate over time; thus it is recommended that appraisals be re-done every few years to ensure the items are insured to a current and correct value. Costs to schedule items may vary based on the number of items to be scheduled and their value, whether they are stored in a safe or vault when not in use; additionally if your home has a monitored alarm system. Some insurance companies offer the option of blanket insurance for jewellery or art, allowing you to select a limit on the insured value without having to itemize the list of pieces; a benefit for those who changeover pieces at times, however there may be a limited insured amount for any one piece. DIVORCE 101 FOR CANADIANS WHO OWN U.S. REAL PROPERTY

In fact, for some couples, the extra quality time together in quarantine proved to be the proverbial straw. And while it may have been difficult to get aligned in the marriage, it’s very important to get aligned in the divorce, particularly for Canadians who own U.S. real property. With all the cultural and economic similarities between the U.S. and Canada, it’s often shocking to discover how the two countries’ tax systems are so different and how that creates complications for taxpayers on both sides of the border. Of course, there are foreign tax credits and the Canada-U.S. Income Tax Treaty, but without the right understanding of how these systems work together, one may find themselves in a double taxation trap. For example, when Canadians who own U.S. real property are separating or divorcing, there is often a misconception that if one spouse retains the property, they can both avoid the rigmarole of paying taxes on capital gains. Unfortunately, this is not the case. When it comes to the division of U.S. real property resulting from the marital breakdown of a Canadian couple, U.S. tax rules dictate that the property is disposed of at fair market value by a transferor spouse and acquired at market value by a recipient or transferee spouse. Although no money is exchanged, the spouse who relinquishes the right to the property must come up with enough cash to pay a U.S. 15% withholding tax, known as Foreign Investment in Real Property Tax Act (FIRPTA) tax. The transferor spouse must provide the funds to the transferee spouse, who will remit the withholding tax to the IRS, along with certain paperwork, within a narrow timeframe. For the transferee spouse, the penalty for failing to meet this obligation is $10,000 USD. When tax season rolls around the following spring, the transferor spouse files a U.S. non-resident income tax return to report the disposition of the U.S. real property. The expectation is that the transferor spouse will receive a refund of the difference between the withholding tax and the actual tax. The transferor spouse is required to have a U.S. tax ID (i.e. a social security or Individual Taxpayer Identification number). Now, for Canadians who own U.S. real property, here’s where the potential tax exposures enter into the picture.

In Canada, the value of the property at the time of the division is the original cost of the property, unless an election is made to transfer the property at market value. So, by default, Canadians who own U.S. real property and are separating or divorcing will transfer the property from one spouse to another with no other considerations and no tax to pay in Canada – at the time. Instead, the CRA imposes tax when the property is eventually sold by the transferee spouse, and the gain is computed on the appreciation of the property from the time it was acquired within the marital union. This is where good alignment between the divorcing couple is critical. Here’s why. If the transferor spouse feels the Canadian default option is better, they may be creating a double taxation situation for themselves and the transferee spouse by paying tax in the U.S. now and not being able to recover it through a credit in Canada later. In this regard, alignment on tax treatment can serve as a negotiation tool in the separation or divorce process for Canadians who own U.S. real property. By matching the timing of the transfer on both sides of the border, the transferor is responsible for U.S. and Canadian tax for the appreciation of the property from the date of purchase to the date of transfer, and the transferee spouse is responsible for U.S. and Canadian tax from the date of transfer to the actual sale. If the timing is not aligned, the transferor will be responsible for U.S. tax for the same period and will not be responsible for any Canadian taxes, while the transferee spouse will be responsible for paying U.S. tax on the gain from the date of acquisition to the actual sale and Canadian tax on the gain from the original purchase date to the sale date. As Canadian taxes tend to be higher, this late discovery may cause even more financial damage to the transferee spouse. It’s important to ensure that Canadians who own U.S. real property, and are going through a divorce, enlist the guidance and expertise of someone who knows both tax systems. With proper alignment of the tax treatment and application of foreign tax credits, both spouses can come out of the marriage… well…a little less scathed.
